Segundo Circuito \n\nJudicial de San José. Goicoechea, a las diez horas con diez minutos del \n\nveintinueve de junio de dos mil veintiséis. \n\nRECURSOS DE APELACIÓN interpuestos en la presente causa seguida \n\n[Nombre 001], quien es mayor de edad, costarricense, con \n\ncédula de identidad número [Valor 001], nacido en Limón, el 21 de junio de \n\n1987, hijo de [Nombre 002] y de [Nombre 003], soltero, \n\ncomerciante, vecino de Limón; por el delito de PESCA ILEGAL en perjuicio de \n\nLOS RECURSOS NATURALES. Intervienen en la decisión del recurso, las juezas \n\nRosaura Chinchilla Calderón, Kathya Jiménez Fernández e Ivette Carranza \n\nCambronero. Se apersonó en esta sede la licenciada Karol Vanessa Delgado \n\nRivas, defensora particular del encartado y el licenciado Andrés Alfaro Ramírez en \n\nsu condición de Procurador Penal y, \n\nRESULTANDO: \n\nI.- Que mediante sentencia número 201-2026, de las 15:40 horas del seis \n\nde mayo de dos mil veintisiete (sic, así en minuta), el Tribunal Penal del II Circuito \n\nJudicial de la Zona Atlántica, Flagrancia, resolvió: \"POR TANTO: De conformidad con \n\nlo establecido en los artículos 39 y 41 de la Constitución Política 1,4, 11, 12, 16, 18 a 20, \n\n30, 31, 53, 54, 71, 73 y 110 del Código Penal; 1, 2, 9, 153 y 154 de la Ley de Pesca y \n\nAgricultura: 1 a 15, 142, 180 a 184, 265, 360 a 361, 363 a 365, 367, 422 a 429 y 432 del \n\nCódigo Procesal Penal: 1045-1046 del Código Civil; 122, 124, 127 de las reglas vigentes \n\nsobre responsabilidad civil del Código Penal de 1941; se declara a [Nombre 001][Nombre 001] autor responsable de UN DELITO PESCA ILEGAL, cometido en\n\nperjuicio de LOS RECURSOS NATURALES, en tal carácter se le impone la pena MULTA \n\nDE VEINTE SALARIOS BASE, que corresponde a la suma de cuatrocientos sesenta y \n\ndos mil colones; así establecido por el Consejo Superior del Poder Judicial para el año \n\ndos mil veintiséis para un monto total de NUEVE MILLONES DOSCIENTOS CUARENTA \n\nY CUATRO COLONES, que deberá pagar dentro del plazo de quince días hábiles a partir \n\nde la firmeza de esta sentencia. Se ordena la cancelación de la licencia de pesca ante el \n\nInstituto Costarricense de Pesca y Agricultura. Se ordena el comiso de la totalidad de los \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 2 \n\nbienes decomisados y descritos en las actas ACTo-AASP 1024-2026 y 1025 de folios 12 y \n\n13, con excepción de la embarcación tipo pipante y el respectivo motor, sobre los cuales \n\nse concede el plazo de tres meses para que el propietario se presente en su reclamo. De \n\npasar este plazo sin reclamación se procederá al comiso a favor del Estado. Asimismo, se \n\ndeclara CON LUGAR LA ACCIÓN CIVIL RESARCITORIA incoada por la actora civil \n\nProcuraduría General de la República. Se ordena al demandado civil a indemnizar el \n\nDAÑO ocasionado y los intereses generados desde el momento del hecho hasta la \n\nliquidación de montos en fase de ejecución y firmeza del pronunciamiento, \n\npronunciamiento que se hace en abstracto según la normativa procesal. Asimismo, se le \n\nordena al pago de ambas COSTAS que deberán liquidarse en la vía de ejecución. \n\nComuníquese lo pertinente al Registro Judicial, al Juzgado de Ejecución de la Pena y a la \n\nDirección Nacional de Adaptación Social para lo de su cargo. Se resuelve en lo penal sin \n\nespecial condenatoria en costas. Quedan las partes notificadas vía oral. José Alexander Gómez Moreno. Juez del Tribunal de Flagrancia de Pococí.\" (Sic, el uso\n\ngramaticalmente incorrecto de las mayúsculas es del original). \n\nII.- Que, contra el anterior pronunciamiento, interpusieron recursos de \n\napelación la licenciada Karol Vanessa Delgado Rivas, en su condición de \n\ndefensora particular del encartado y el licenciado Andrés Alfaro Ramírez como \n\nProcurador Penal. \n\nIII.- Que, verificada la deliberación respectiva de conformidad con lo \n\ndispuesto por el artículo 465 del Código Procesal Penal, el tribunal se planteó las \n\ncuestiones formuladas en los recursos de apelación. \n\nIV.- Que en los procedimientos se han observado las prescripciones legales \n\npertinentes. \n\nRedacta la jueza Chinchilla Calderón; y, \n\nCONSIDERANDO: \n\nI.- Admisibilidad y competencia. La licenciada Karol Vanessa Delgado \n\nRivas, en su condición de defensora particular del encartado y el licenciado \n\nAndrés Alfaro Ramírez como Procurador Penal interpusieron recursos de \n\napelación contra la sentencia dictada en autos, decisión que es impugnable por \n\nesta vía (taxatividad objetiva) y por tales sujetos (taxatividad subjetiva). Estas \n\nimpugnaciones se plantearon mediante escritos motivados, aportados ante el \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 3 \n\nórgano de instancia y dentro del plazo legal (pues la sentencia integral se emitió el \n\n06 de mayo de 2026, aunque por error material en la minuta escrita se consignó \n\n2027 y los recursos se presentaron el 22 y 27 de mayo del año en curso, \n\nrespectivamente, es decir antes de la fecha de vencimiento que era el 28 de mayo, \n\nhabida cuenta de la exclusión de fines de semana y el asueto del 08 de mayo) y, \n\npor ello, deben admitirse las impugnaciones, sin que sean necesarias ulteriores \n\nformalidades pues, de lo contrario, se incumpliría el mandato establecido en el \n\nartículo 8.2.h de la Convención Americana sobre Derechos Humanos y lo resuelto \n\npor la Corte Interamericana de Derechos Humanos en el caso de Mauricio Herrera \n\nUlloa contra Costa Rica, sentencia de 02 de julio de 2014. La defensora cuestiona \n\nla sentencia en forma genérica, pero todos sus alegatos aluden al tema penal, de \n\nmodo que la condena en abstracto al pago de los daños y perjuicios no ha sido \n\ncuestionada expresamente y por tratarse de un extremo civil en donde rige el \n\nprincipio dispositivo (sin actividad de parte no hay análisis pues el sujeto procesal \n\npuede disponer libremente de bienes patrimoniales) ha de entenderse firme tal \n\nextremo. \n\nII.- En el primer motivo de la extensa impugnación planteada por la \n\ndefensora del encartado —de 24 páginas en donde se reiteran las mismas ideas \n\ny luego se agregan los informes de búsqueda con la herramienta de inteligencia \n\nartificial— se alega la errónea valoración de la prueba testimonial de los dos \n\nguardaparques e indebida fundamentación de la sentencia. Indica que el que los \n\ndeclarantes sean funcionarios públicos no significa que, per se, sean honestos y \n\ndigan la verdad, máxime que el principal beneficiario en este tipo de delitos es el \n\nServicio Nacional de Guardaparques al que se le gira un 70% de los ingresos por \n\nmulta y la pena es de varios millones de colones, lo que facilitaría el trabajo de \n\ntales funcionarios, nada de lo cual se valoró. A la apelante le llamó la atención el \n\ndecomiso de varios ejemplares solo de una especie de pez, de similar tamaño y \n\nen un único color, capturada en cerca de 40 minutos, que fue el tiempo que \n\nestimaron los deponentes, cuando, usualmente, al tirar la cuerda, se obtienen \n\notras especies, distinto a como sucede en estanques, donde solo está el animal \n\nañadido y por el tipo de alimentación suelen engordar o crecer en forma similar, lo \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 4 \n\nque explicaría el similar tamaño. Esto, añade, es congruente con el dicho del hijo \n\ndel encartado de que ellos tienen estanque de mojarras rojas y su padre sacó \n\nunas para llevar a un amigo en Parismina. Además, menciona que no hay estudio \n\nque determine que en esa zona solo esa especie exista y tal cosa permita concluir \n\nque siempre que se tirara de la cuerda (porque no se usó trasmallo) se pescara \n\nesa especie. Considera que los testigos faltaron a la verdad pues uno dijo que el \n\nencartado troleaba (tira la cuerda con carnada al agua y la lancha avanza para \n\nque la especie pique en el arrastre) y otro que la lancha estaba detenida. \n\nConsidera ilógico que si el encartado sabía que la patrulla de Guardaparques lo \n\nhabía adelantado, estuviera pescando en la zona o que, cuando se le hizo la señal \n\nde detención, no lanzara las mojarras al agua, máxime que cuatro estaban vivas, \n\ncomo mencionaron los testigos que usualmente sucedía para dificultar la acción \n\nde la autoridad. Para la defensa esto no sucedió porque en su psique sabía que \n\nno estaba actuando en contra de la prohibición, dado que las mojarras provenían \n\nde un estanque de su casa a las que alimenta y por eso tenían similar peso y \n\ntamaño. Critica el cuestionamiento que hace el juez a la forma de transporte de los \n\npeces (tirados en el piso de la lancha y no en hieleras o bolsas si eran para \n\nconsumo). Dice que los oficiales tienen problemas personales con su cliente y que \n\nes incongruente que ellos vieran al encartado lanzar la cuerda de pescar y no \n\nprocedieran de inmediato a su detención en el Parque Nacional Tortuguero \n\n(máxime que, según ellos, él se hizo el disimulado y escondió dicho implemento), \n\nlo que podría ser un incumplimiento de deberes, sino que esperaran a hacerle un \n\nfijo más adelante. El encartado aportó fotografías de la lancha de los \n\nguardaparques y, por tanto, pudo haberse desecho de la evidencia de ser ilegal, \n\nsin que lo hiciera. Indica que no era que él invocara prueba tasada, sino que el \n\neventual uso de binoculares usualmente se refiere en los informes para dar \n\ncerteza de que se observa a ciertas distancias, pero en este caso se le dijo al \n\nendilgado que lo estaban grabando, no que se usaron binoculares, objetos \n\ndiferentes y de estos, en el informe no se indicó marca ni características, distintas \n\na “largo alcance”, para que la defensa cotejara, como sí se hizo con el GPS (así \n\nen recurso). Narra que en el informe policial se mencionó la presencia del hijo \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 5 \n\nmenor de edad del encartado; los oficiales aludieron a la presencia de dos hijos; \n\n[Nombre 001] dijo que el día de los hechos iba con un perrito en una lancha, se aportó una \n\nfotografía con la fecha de los hechos y en donde se ve el can y que todo eso \n\nimpedía que el tribunal dijera que el testigo [Nombre 001] se estaba confundiendo con otro \n\nhecho, sin lo cual debieron darle credibilidad y dejaba sin efecto el dicho de los \n\noficiales. Refiere que a la prueba de descargo se le exigió precisión pero no se \n\nvaloró con igual baremo la de cargo. Para la apelante las referencias de que la \n\nlancha del encartado iba a poca velocidad es una apreciación subjetiva en la que \n\nno se tuvo en cuenta la potencia altísima del medio de transporte oficial (400 \n\ncaballos de fuerza) frente al poco caballaje del motor de la lancha del encartado \n\n(200 caballos) que podría generar la impresión de moverse a baja velocidad. \n\nIncluso acota que le preguntó a un modelo de inteligencia artificial —que el \n\napelante estima más acertado que otros— la ubicación de las coordenadas de \n\ndetención (que ubicó adecuadamente), la distancia y tiempo de recorrido de ese \n\npunto a la casa del encartado a partir del tipo de motor de la lancha de su \n\nrepresentado y obtuvo como respuesta 35 km y 3.5 a cuatro horas, lo que \n\nimplicaría que la velocidad de desplazamiento era normal y no lenta, dada la hora \n\nen que el testigo dijo que salieron de la casa y la hora de detención. En otro tema, \n\nalude al tiempo de vida de las mojarras, que se determinara que había cuatro \n\nvivas y dos muertas pues aquellas movían branquias y una llevaba anzuelo, el \n\ntiempo en que se descomponen si no están en agua y sí bajo el sol, que el tribunal \n\nconsiderara que estaban recién pescadas pues aún estaban resbalosas y, \n\nnuevamente con apoyo en un modelo de inteligencia artificial generativa, indica \n\nque el dicho del testigo de descargo es congruente con el de su padre, pescador \n\nexperimentado, en cuanto a esos aspectos (tiempo en que la especie puede \n\npermanecer viva si está en agua o a la sombra). Pide la nulidad de la sentencia. \n\nEn el segundo alegato menciona la existencia de una sentencia contradictoria e \n\nincongruente pues en la parte dispositiva se aludió a la cancelación de licencia por \n\nimperativa legal, pero en ninguno de los considerandos se desarrolló el tema, lo \n\nque debía hacerse por tratarse de una sanción accesoria. Manifiesta que la parte \n\ndispositiva es el resumen de lo analizado en la considerativa pero no la sustituye \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 6 \n\ny, en este caso, solo se mencionó el tema en la dispositiva. Además, su \n\nrepresentado no declaró, pues su abogado no se lo permitió y él desconocía que \n\nse podía apartar del criterio profesional por lo que en este momento, en alzada, lo \n\nhace. La defensora introduce una supuesta manifestación de él en donde rechaza \n\nlos cargos y afirma que él vive fuera del Parque Tortuguero y ahí tiene una laguna, \n\ndesde hace cerca de un año, en donde cultiva mojarras negras y rojas, las cuales \n\nalimenta con comida de tilapia y se han ido reproduciendo. Con un amigo hicieron \n\nel experimento de ver si sabían más ricas las cultivadas o las silvestres y por eso \n\nél transportó las que le decomisaron, que eran todas rojas, sin limpiar, de similar \n\ntamaño. Describe la hora de salida de su casa, el motor y potencia de su lancha, \n\nel tiempo que duraría donde su amigo y la velocidad, que iba con sus dos hijos, la \n\nembarcación de los Guardaparques les pasa, toman la foto y en la entrada de \n\nCaño Negro lo detuvieron. Dice que él fue guardaparques voluntario por un año, \n\nque no estaba pescando, que cuando se pesca se lanza el engañador y pica \n\ncualquier especie y no solo una, tiene permisos para pescar en aguas abiertas y \n\nno se iba a exponer a hacerlo en una zona que sabe prohibido, fue él que acercó \n\nsu embarcación a la oficial pues aquellos no pudieron y, de saber que estaba \n\nhaciendo algo ilegal, habría tirado las mojarras al agua. Refiere haber aportado \n\nfotos y videos de su estanque de peces y haber tenido problemas con [Nombre 008] pues su padre, de 80 años, le ganó juicios por ser un malcriado y el\n\nsentimiento se ha trasladado hacia la familia. Indicó que dicha persona no le \n\npermitió hacer una llamada al biólogo Renato por unas tortugas que había en su \n\ncasa y que les iban a colocar GPS (así en escrito) y el oficial, sabiendo que su \n\npropiedad estaba sola, fue y se llevó las tortugas y las liberó casi en la playa, \n\nexponiéndolas a depredadores, con lo que casi las mató y que si él no hubiera \n\ntenido los permisos por eso le abre otra causa, pues lo persigue. Dice que él una \n\nvez fue sentenciado producto de un abreviado y que ajusta su vida a la ley y que \n\nesta vez no es cierto y la pena es una multa. Pide se acoja el recurso y la \n\ndefensora pide que se anule la sentencia. No hubo respuesta de la contraparte. Se \n\ndeben rechazar las quejas que, por tener aspectos en común, se abordarán en \n\nconjunto. De previo a ello, conviene hacer una descripción de lo acaecido en la \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 7 \n\nfase de juicio. (A) Resumen de actuaciones. En el presente asunto, por medio de \n\ndos acusaciones de diversos organismos estatales se le atribuyó al encartado el \n\ndelito de pesca ilegal estipulado en el numeral 153 de la Ley de Pesca y \n\nAcuicultura No. 8436, sobre la base de los siguientes hechos contemplados en el \n\nrequerimiento fiscal: \n\n«El día 8 de marzo del 2026, al ser aproximadamente las 7:40 horas en \n\nLimón, Pococí, Cariari, Tortuguero, Parque Nacional Tortuguero, Bocana \n\nCaño Negro, lugar donde se encontraba el imputado [Nombre 007], \n\nmomento en el cual, a sabiendas de que se encontraba propiamente dentro \n\ndel área protegida del área silvestre propiamente del Parque Nacional \n\nTortuguero y utilizando una caña de pescar mediante la cual logró pescar \n\nilegalmente dentro de los límites de este Parque Nacional una cantidad de \n\nseis pescados de la raza mojarra, cuyo nombre es vieja maculicuada cada \n\nuna con 1,90 peso para un peso total de 1.95 kilos de pescado, con lo cual el \n\nseñor imputado puso en peligro la continuidad de las especies del ecosistema \n\nribereño.» \n\nPor su parte la Procuraduría General de la República (que, además, ejerció \n\nla acción civil resarcitoria sobre idéntica base fáctica) expuso lo siguiente: \n\n«1.- El día 8 de marzo del año 2026 aproximadamente a las 16:15 horas \n\nfuncionarios del Parque Nacional Tortuguero, realizando un patrullaje de \n\ncontrol y protección en el Parque Nacional Tortuguero, específicamente en el \n\ncanal principal laguna Tortuguero, coordenadas CRttM 0,5 norte 1148721 y \n\neste 562953, sitio que se encontraba dentro del humedal Caribe Noreste, el \n\ncual es catalogado como sitio Ramsar, en un bote pipante que corresponde al \n\nnombre de [...] con matrícula [Valor 002], el mismo porta un motor de 20 hp 4 \n\ntiempos, número de serie 075818 BD a sabiendas de la licitud de sus actos, \n\nutilizando artes de pesca tipo caña de pescar, el imputado [Nombre 001] pescó 6 individuos de la especie moharra (Vieja maculicauda) con un\n\npeso total de 1.95 kg. 2.- Con las faenas de pesca realizadas por el imputado \n\n[Nombre 001], dentro del Parque Nacional Tortuguero, se lesionó \n\nel ambiente a través de la afectación de una serie de valores como lo es el \n\nvalor comercial, siendo este el valor del costo de los productos o \n\nsubproductos de un animal silvestre o su homólogo doméstico generado de la \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 8 \n\nventa en el mercado nacional y se estima a través de la suma del valor de la \n\ncarne más el valor de los subproductos o productos. Por otra, del valor \n\necológico, radica que cada individuo, defínase como miembro de una \n\nespecie, cumple una función y juega un papel importante a nivel ecológico. El \n\nvalor ecológico puede ser catalogado como inapreciable, pasajero o \n\npermanente de acuerdo al sitio donde se realice y el grado de afectación. El \n\nvalor de protección sea lo que con dichas acciones, además se amenazaron \n\notros hábitats marinos. Por otra parte, el valor de restauración busca que el \n\necosistema afectado regrese a un Estado lo más parecido al anterior de la \n\nalteración estructural y funcionalmente. En caso de fauna silvestre, el valor de \n\nrestauración contempla los costos para el cuidado de un individuo desde su \n\nnacimiento hasta su adultez reproductiva. En el caso de los peces, sería \n\nnecesario contar con al menos un estanque para su reproducción, las \n\ncapturas, accesorios, afectan también la cadena alimenticia de otras especies \n\ncomo las aves marinas, razón por la cual no se permite pescar en las zonas \n\nprotegidas debido a los daños que pueden ocasionar a la diversidad marina, \n\nlas cuales pueden ser devastadoras. La valoración económica del daño \n\nambiental ocasionado por parte del actuario ilícito del imputado fue calculado \n\npor el SINAC en la suma de 901 072,75 colores.» \n\nEl debate se desarrolló durante dos audiencias en las que se incorporó, \n\ncomo prueba documental, el informe del SINAC de 8 de marzo de folios 1 al 11, el \n\nacta de decomiso de folios 12 a 14, el acta de disposición final de folio 15, las \n\ndenuncias de folios 20 al 29, la certificación de antecedentes penales de folio 32, \n\nel informe de SINAC de 10 de marzo del 2026, la valoración económica de daño \n\nambiental, copia de las fotografías de folios 65 a 71, copia del certificado de \n\nnavegabilidad de folio 72, la copia de la licencia de folio 73, un dispositivo de \n\nalmacenamiento USB con varios archivos: tres de video y 20 de imagen y se \n\nevacuó la declaración de los funcionarios [Nombre 008] y [Nombre 009] ([Nombre 010], admitido en el auto de apertura a juicio, no se recibió) así\n\ncomo del hijo del encartado [Nombre 001]. \n\nLa sentencia se emitió unipersonalmente, de forma oral, y consta \n\nrespaldada en el archivo 260001021263PE-06052026033848-2_Multi el cual tiene \n\nuna duración de dos horas. En esta, luego de describirse el contenido de la prueba \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 9 \n\ntestimonial, tal y como lo exige el numeral 143 del Código Procesal Penal, se \n\nprocedió a efectuar el análisis intelectivo (a partir del minutero 37:04) y jurídico del \n\ncaso. El motivo de la condena fue lo siguiente: \n\ni. Las declaraciones de [Nombre 008] y [Nombre 009] \n\nfueron coherentes entre sí y con la prueba documental y no consta que exista \n\nningún motivo para que ellos inculpen falsamente al encartado. Si bien el primero \n\nera conocido de previo carecía de relación de enemistad y el otro no conocía al \n\nprocesado. \n\nii. Ambos testigos narraron que la lancha en que iba imputado estaba en el \n\nParque Nacional Tortuguero, que viajaba a una velocidad lenta y usando ellos \n\nbinoculares ven a una persona que lanza la cuerda al agua o que iba \n\ntroleando y eso les genera la sospecha de que está pescando razón por la que \n\nrebasan la embarcación (momento en que la persona de la embarcación baja la \n\ncaña y la oculta, se hace como el disimulado). Los guardaparques refieren que \n\nvan a hacer una vigilancia más adelante para asegurarse. Ambos describen que \n\nse ubican a una distancia segura, en los márgenes del canal, ocultos en la maleza \n\ny desde ahí, observan con binoculares la lancha y es ahí en donde ven a la \n\npersona lanzar la cuerda. Uno de los oficiales ve al encartado sacar de la laguna \n\npescado, en tres ocasiones diferentes (momento en que la lancha se detenía). \n\nDeciden esperar hasta que se acerquen a la embarcación. Los testigos identifican \n\nal encartado y a dos menores de edad y son enfáticos en que solo el adulto hacía \n\nesas labores a quien identifican por las ropas y condición etaria. Ahí es donde ven, \n\nen el piso de la lancha, seis individuos de mojarras. Los oficiales concluyen que \n\nestán recién sacados, porque cuatro de ellos tienen signos vitales (boquean o \n\nmueven agallas intentando respirar), están húmedos y resbalosos. Ambos testigos \n\nnarran que se le dijo al encartado que iba a ser detenido y trasladado a un puesto \n\npolicial, momento en que el procesado niega haber sacado los especímenes de la \n\nlaguna y afirma traerlos de una laguna de su casa, lo que los policías descartan \n\npor las condiciones de los pescados y el haberlo visto lanzar la caña, que una \n\nmojarra aún tiene la pompa o tipo de anzuelo y porque hay una caja con señuelos \n\ny la caña de pescar en la embarcación. Además mencionan que el encartado \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 10 \n\nintentó ofrecerle dinero a cada uno para terminar las cosas. Esa versión, dice el \n\njuez, es lógica y creíble. Ellos mantuvieron su misma relación de hechos del \n\ninforme y las denuncias, se sometieron al interrogatorio y su versión fue firme, solo \n\nhubo un punto diferente sobre la dinámica de la observación (uno dijo que la \n\nvigilancia se hizo en un solo punto y el otro en varios) pero no es relevante y por \n\nsus labores diarias alguno pudo haberse confundido. \n\niii. La versión del hijo del encartado ni siquiera da seguridad de que se esté \n\nrefiriendo al mismo acontecimiento pero hay que partir de que sí. El joven aludió a \n\nque sacaron seis mojarras del estanque de la casa, criadero privado, las depositan \n\nen el suelo de la embarcación, alistan la comida y salen rápido a entregarle esas \n\nmojarras a una amistad y comprar combustible. Como dos horas de la salida de la \n\ncasa fueron abordados por la policía y oye la discusión en que su papá decía que \n\nla traía de la casa y la estaban grabando. Dijo que en su vivienda hay cuatro \n\nestanques, uno en construcción y ahí tienen mojarras, guapotes y tilapias. Aunque \n\neso, dice el juez, podría generar una duda, el tribunal descarta esta versión porque \n\nno es conciliable con lo dicho por los oficiales. [Nombre 001] dice que nunca se detuvieron \n\nlo que contradice a los oficiales del SINAC que los vieron varias veces detenidos y \n\nuna persona lanzaba la caña. También hay una contradicción grosera sobre el uso \n\nde la caña, pues el joven dijo que no se usó y solo se andaba en la embarcación. \n\nComo ambos relatos contrarios no pueden ser ciertos a la vez, hay que valorar, \n\ndijo el juez, que el joven es hijo del encartado y aunque eso no significa que \n\nmienta, tiene un interés diferente en el proceso; tampoco recuerda muchos \n\naspectos o no los narra con detalle, es una narración escueta. El joven entra en \n\ncontradicciones pues acepta que su papá, cuando lleva pescado de su criadero a \n\notras personas, lo echa en un balde o hielera para que no se pudran, pero en esta \n\nocasión no lo hizo, sino que iban en el suelo de la embarcación. Además, llevaba \n\ncañas y aditamentos de pesca. Eso no es lógico pero sí lo es la versión de los \n\nguardaparques. Tampoco es aceptable que por la rapidez echaran los peces al \n\nsuelo de la embarcación pues después de sacarlas del estanque alistaron comida \n\nsegún el joven, entonces no era que salieran tan rápido que no tuvieran esa \n\nprevisión mínima. Los oficiales indicaron que esos animales si no se destripan se \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 11 \n\npudren con rapidez y desde la salida hasta la detención pasaron dos horas y \n\nmedia y aún les faltaba trayecto, por lo que no es aceptable que los animales se \n\ntransporten así. \n\niv. El resto de la prueba documental corrobora la tesis de cargo: se ubican \n\ncoordenadas que corresponden a un parque nacional; se indica los oficiales que \n\nparticiparon; el decomiso de especies (mojarras rojas y negras), caña de pescar, \n\nembarcación, motor y hay fotos del sitio. \n\nv. Hay fotos y videos que se presumen que son de la casa del encartado, \n\naunque este no declaró. No consta la fecha de esas fotos o videos, se ve que hay \n\nlagunas, que el encartado saca peces y se ven sus hijos. El tribunal no puede \n\nconcluir nada de ahí porque no hubo una versión del encartado y el tribunal no \n\npuede sustituir a las partes. La fecha de los datos de guardado de los videos es \n\nposterior a los hechos. El certificado de navegabilidad y la licencia de pesca no \n\nson relevantes porque no aplican en parques nacionales. \n\nA partir del segmento 1:24:39 se hace el análisis jurídico y, en síntesis, el \n\nencartado fue condenado como autor del delito estipulado en ese numeral que \n\nrefiere: «Artículo 153.- Quien autorice o ejerza la actividad de pesca comercial o de \n\npesca deportiva en las áreas silvestres protegidas indicadas en el primer párrafo del \n\nartículo 9 de esta Ley, se sancionará con multa de veinte a sesenta salarios base y la \n\ncancelación de la respectiva licencia. Si corresponde al funcionario público que \n\nautorizó el ejercicio de la pesca en estas áreas, se le aplicarán las sanciones \n\ndisciplinarias, administrativas y penales respectivas, con respeto al debido proceso.» (el \n\ndestacado es agregado). Se le impuso la pena de “…veinte salarios base, que \n\ncorresponde a la suma de cuatrocientos sesenta y dos mil colones; así establecido por el \n\nConsejo Superior del Poder Judicial para el año dos mil veintiséis para un monto total de \n\nnueve millones doscientos cuarenta y cuatro colones.» Además, se le canceló la \n\nlicencia de pesca “por imperativo de ley”, se resolvió el tema de la acción civil en \n\nabstracto por tratarse de un proceso de flagrancia, se ordenó el comiso del resto \n\nde bienes salvo la lancha y el motor fuera de borda (es decir pescado, cañas de \n\npescar, instrumentos de pesca) y se le dio plazo para aportar la documentación de \n\ntitularidad de la embarcación y el motor para su devolución, so pena de comiso por \n\nno reclamo. Hasta aquí el contenido de la sentencia impugnada. (B) Decisión de \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 12 \n\nlos reclamos. Este tribunal ha procedido a examinar meticulosamente el \n\ncontenido de la prueba evacuada en el debate y el análisis efectuado por el juez \n\nde instancia y concluye que en este no se notan yerros que afecten la validez de lo \n\nresuelto. Es cierto, como lo indica la apelante, que el hecho de que los \n\nguardaparques sean funcionarios públicos no significa que por esa sola razón sus \n\ndichos sean aceptables y creíbles pero es que, en este caso, no fue ese el criterio \n\nvalorativo que usó el juzgador sino que mencionó tal cosa solo para indicar que \n\ncarecían de interés directo en el asunto —la referencia del encartado de que ha \n\ntenido problemas con uno de ellos solo la introduce en la atípica \"declaración\" \n\nescrita que inserta en el recurso, pero, en todo caso, aunque se aceptara \n\nhipotéticamente que hubiesen existido problemas previos entre uno de los \n\ndeclarantes y su padre, ello no significa que los hechos sean falsos o que el otro \n\noficial, a quien no conocía, mienta y decida establecer hechos falsos en \n\ndocumentos públicos solo como “solidaridad a su compañero”, aspecto en lo que \n\nno hay ninguna prueba—. Nótese que el juzgador de mérito desciende al \n\ncontenido de los relatos para establecer si estos tienen logicidad interna y \n\nconcordancia con el resto de la prueba, si se ha mantenido el relato en el tiempo, \n\nsi hay concordancia entre los diferentes elementos de prueba y, entonces, la \n\ncredibilidad de los guardaparques no se fija solo por su condición de funcionarios. \n\nIgual sucede con el dicho del hijo del encartado a quien se le niega valor \n\nprobatorio no porque fuese familiar del imputado (aspecto que se menciona para \n\nindicar que no está en la misma condición de aquellos sino que respecto de él sí \n\nhay un interés personal, pero no se considera determinante) sino porque, \n\ninternamente, su dicho es incoherente en tanto luce descabellado que si se busca \n\nprobar si la carne de mojarra silvestre es de mejor sabor que la de mojarra criada \n\nen lagunas (que es la versión que introduce el encartado en su atípica declaración \n\ninserta en el recurso) se pesque estas y se lancen, sin ninguna preparación previa, \n\nal piso de una lancha en un viaje de varias horas y expuestas a la luz del sol, \n\nsabiendo que en tales condiciones se corre el riesgo de generar que la carne del \n\npescado se pudra. Además, tampoco es lógico que si el encartado iba solo a \n\nentregar esos pescados y adquirir combustible, llevara implementos de pesca en \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 13 \n\nla lancha. El juez, incluso, señala que no hay seguridad de que el escueto relato \n\ndel hijo se refiera a los mismos hechos que nos ocupan, pese a lo cual procede a \n\nanalizarlo. En otras palabras, aunque hay una serie de nebulosas aún así asume, \n\nen beneficio del encartado, contextos sustantivos de esa declaración, sin que la \n\ndescarte por razones formales. A partir de eso el juzgador analiza en forma \n\nconjunta la prueba y llega a la conclusión condenatoria que este tribunal avala. \n\nPara la recurrente, el que un 70% del dinero obtenido por las multas esté \n\ndestinado al Servicio Nacional de Guardaparques, según la ley especial que rige la \n\nmateria, sería una causal para estimar que los guardaparques pueden mentir, \n\npues de esa forma mejorarían sus condiciones laborales. Sin embargo, aunque \n\nesa posibilidad existe, no puede establecerse como una premisa que se niegue \n\ncredibilidad a las declaraciones de esos funcionarios en todos los casos, o \n\ngeneralizadamente (admitiendo el argumento contrario de que por esa condición \n\nse tratará siempre de testimonios mendaces) sino que se requieren indicios que \n\nhagan verosímil tal posibilidad, los cuales, en este caso, no se dan. Inclusive, si de \n\nobtener recursos se tratara, ya no para la institución sino a título personal, habría \n\nsido más favorable para los guardaparques no gestionar este proceso, pues, \n\nsegún dijeron, el encartado les ofreció dinero para que terminaran las cosas más \n\nrápido, sin que por tal cosa se pusiera denuncia adicional alguna, lo que denota, \n\nademás, que no había un interés subjetivo de perjudicar al sindicado. \n\nLa tesis de descargo ha radicado en el hecho de que el encartado tiene, en \n\nsu propiedad, lagunas con este tipo de peces y para ello en el recurso se introduce \n\nuna versión del encartado en tal sentido (la cual no fue sometida a los principios \n\nde oralidad, inmediación y eventualmente contradictorio pese a lo cual se valorará \n\ncon el fin de evidenciar que esta no modifica lo resuelto) y se aportó, en fase de \n\njuicio, fotos y videos en tal sentido. Esta cámara ha analizado este material y, en \n\nefecto, en las cintas se observan las lagunas en una propiedad privada que el \n\nimputado dice que es donde habita, se ve al encartado lanzar la atarraya y extraer \n\npeces que él identifica como mojarras negras y rojas, se ubica el localizador \n\nsatelital (GPS por sus siglas en inglés: Global Positioning System) con las \n\ncoordenadas del sitio dentro del Parque Nacional (aunque esta ubicación es \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 14 \n\ndiferente al sitio en que él fue detenido lo que afirmó es que sí posee lagunas con \n\neste tipo de peces dentro del parque) y, en otro film, se ve la lancha navegar, con \n\nun niño al frente con un perro y los pescados en el suelo de la lancha. El material \n\nvideográfico y fotográfico sí fue analizado en la sentencia y el juez, aunque indicó \n\nque este no estuvo acompañado de ninguna versión del encartado que le diera \n\nsentido a lo que allí se observaba (aspecto que ahora se subsana en el recurso) \n\naún así no permitía eximir a este de responsabilidad por varias razones: i.- las \n\nfotos y videos carecían de fecha y la que correspondía a sus metadatos de \n\nguardado en el dispositivo de almacenamiento eran posteriores a los hechos; ii.- el \n\nvideo de la navegación no puede asociarse con este evento pues solo se ve un \n\nniño y un perro y los oficiales aludieron a que, el día de los suceso, el imputado \n\nestaba acompañado por sus dos hijos. Este análisis es acorde con las reglas de la \n\nsana crítica máxime que, como se observa en la hoja de delincuencia, si el \n\nprocesado ha sido condenado, antes (y él mismo así lo dijo en su declaración) por \n\ndelitos similares de pesca ilegal, las imágenes de la lancha con pescado pueden \n\nno ser de la fecha del evento que ahora se juzga. En todo caso, lo esencial y lo \n\nque resuelve el caso es que la condena de él deviene no solo por el decomiso de \n\nlos individuos en la embarcación, sino porque los oficiales afirmaron haber visto al \n\nencartado lanzar la caña al agua, ocasión en la que la embarcación se detenía, \n\npues antes circulaba a poca velocidad y se le observaba “troleando”, es decir, \n\nlanzando el anzuelo en diversas partes con la lancha en movimiento. En otras \n\npalabras, aunque se aceptara hipotéticamente, solo para efectos analíticos, que \n\nhubo una extracción de algunos peces de la laguna particular en la casa del \n\nsentenciado y que se transportaban de ese modo atípico (en el piso de la \n\nembarcación, sin limpiar, expuestos al sol, sin bolsa, balde o hielera) aún así el \n\ndelito subsiste en tanto el encartado fue visto lanzando la caña en las aguas del \n\nTortuguero, Parque Nacional en el que tal actividad está prohibida. Incluso, los \n\noficiales indicaron que también lo estaría el tener, en estanques privados dentro \n\ndel parque nacional, ese tipo de peces, aspecto que solo se acota a mayor \n\nabundamiento pues no solo no fue objeto de juzgamiento sino, tampoco, de \n\ndebate o contradictorio. A partir de la tesis defensiva descartada en instancia —y \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 15 \n\nen cuyo ejercicio este tribunal observa el respeto de las reglas argumentativas— la \n\napelante efectúa una serie de especulaciones sobre si las especies son del mismo \n\ntamaño y peso, razón por la que provendrían de estanques. Esto tampoco es \n\naceptable. Primero porque parte de su teoría del caso y no combate la \n\nargumentación del órgano de instancia que la desechó. Segundo porque aún \n\nasumiendo hipotéticamente su versión, en el propio video aportado por el \n\nencartado se observa que, cuando él lanza la atarraya en sus estanques, extrae \n\nindividuos de diferente tamaño, por lo que la tesis de que su tamaño obedece al \n\ntipo de alimentación se descarta. De cualquier forma, el informe y acta de \n\ndecomiso alude a tamaños y pesos aproximados, no exactos, se describen \n\nmojarras negras y rojas (no solo de un tipo) y nada obsta que, en las labores de \n\npesca, si se obtienen especies que no sean las buscadas (por especie o tamaño) \n\nestas sean devueltas a, o desechadas en, las aguas de las que se extrajeron, de \n\nmodo que las similares características de lo hallado en la lancha no es indicativo \n\nde nada más que de la pesca ilegal, en tanto había animales aún vivos, \n\nboqueando, resbalosos y otro con parte del anzuelo aún en su cuerpo, nada de lo \n\ncual se explicaría con un transporte de especies de la casa del encartado, luego \n\nde dos horas de viaje. \n\nTodo lo dicho hasta aquí, determina que la recurrente no solo efectúa un \n\nanálisis individual de cada elemento (y no conjunto como ordena el numeral 184 \n\ndel Código Procesal Penal) sino que pretende prueba legal o tasada al considerar \n\nque era necesario un estudio técnico que indicara el tipo de peces de la zona, su \n\ntamaño, etc. pues la existencia de la especie se determina por su decomiso en la \n\nembarcación, aún con parte del anzuelo y boqueando. Tampoco era necesario \n\nque se describiera el tipo de binoculares pues las reglas de la experiencia \n\ndeterminan que cualquiera que sea la marca o tipo de estos permiten observar lo \n\nque sucede de lejos, aspecto en el que rige la libertad probatoria conforme al \n\nnumeral 182 del Código Procesal Penal. Asimismo, es irrelevante que en el \n\ninforme no se describiera la marca o tipo de binoculares y sí se hiciera respecto \n\ndel localizador satelital (GPS por sus siglas en inglés Global Positioning System) \n\nque se le dijera al encartado que lo estaban grabando cuando “solo” lo vieron con \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 16 \n\nbinoculares pues la referencia policial de la grabación bien pudo emitirse para \n\nvalorar el lenguaje corporal o verbal del encartado (quien, en efecto, procedió a \n\nofrecer dinero a los guardaparques para cerrar más rápidamente el caso según \n\ndijo él ante el cuestionamiento que ellos le hicieran de por qué les ofrecía cien mil \n\ncolones a cada uno si no estaba pescando). \n\nEn otro orden de ideas, la apelante afirma que es ilógico que si los \n\nguardaparques vieron que el encartado estaba pescando no lo detuvieran en ese \n\nmismo momento sino que adelantaran su embarcación y lo esperaran más \n\nadelante y también califica del mismo modo el comportamiento del sindicado de, \n\npese a haber visto a la policía, continuar en la actividad ilegal. Sin embargo, este \n\nrazonamiento no es atendible. Los oficiales explicaron que querían cerciorarse de \n\nque la actividad que estuviera efectuando el encartado fuera la de pesca pues, \n\naunque en un primer momento les pareció que era así, eso fue a la distancia, \n\nmientras se acercaban y no tenían tal seguridad. Eso habla de la objetividad de \n\nsus labores y no de incumplimiento de funciones como afirma la parte impugnante. \n\nFue por eso por lo que pasan cerca (momento en que captan el indicio subjetivo \n\nde que el procesado tira la caña de pescar al suelo de la embarcación, como \n\ndisimulando) y deciden posicionarse más adelante, en la orilla, y usar binoculares \n\npara verificar y es ahí donde lo ven lanzar al menos en tres ocasiones la caña. En \n\ncuanto al comportamiento del encartado, más bien la lógica indica que, si la lancha \n\noficial siguió, él pudo haber creído que ya el peligro habría pasado y jamás esperó \n\nque los oficiales se detuvieran más adelante a vigilarlo, lo que explica que \n\ncontinuara tras el objetivo que se había fijado esa mañana. Tampoco es razonable \n\nafirmar que, ante el acercamiento de la embarcación, el sindicado procediera a \n\ndeshacerse de los pescados (o no lo hiciera porque conocía su licitud al provenir \n\ndel estanque casero), pues no solo hubo algún nivel de sorpresa en la intervención \n\nsino que, por la cantidad de ejemplares obtenidos (a ese momento seis), dicha \n\nlabor era difícil en el poco tiempo disponible. Es decir, para no deshacerse de la \n\nevidencia hay diversas explicaciones posibles y no solo la que se ensaya en el \n\nrecurso. En todo caso, ya los oficiales habían observado la actividad y detectaron \n\nla presencia de la caña, cuerda e implementos en la embarcación. \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 17 \n\nNo observa esta cámara que haya existido, tampoco, un doble baremo en \n\nla valoración del material de cargo respecto del de descargo. No es cierto que a la \n\nprueba de descargo se le exigiera precisión que no tuvo la otra. El juez fue muy \n\namplio al indicar que la única contradicción entre los guardaparques radicó en la \n\ncantidad de observaciones que efectuaron desde puntos fijos, pero esto se pudo \n\ndeber a un mal entendido o a confusión entre hechos del mismo tipo en que ellos \n\nintervienen, en tanto que, al joven, aún partiendo de un mayor número de \n\ninconsistencias formales (fecha de fotos, si iba o no con el hermano, etc.), se \n\nasumió que aludía a este hecho y se descendió al contenido de su relato, \n\nvalorándolo por el fondo como ilógico. Tampoco es aceptable que la percepción de \n\nvelocidad de las embarcaciones dependa de la mayor capacidad de sus motores \n\npues si bien la oficial puede ser mucho más potente, los dos guardaparques \n\nfueron claros en que el procesado a veces detenía por completo su lancha, lo que \n\ncoincidía con algunos lanzamientos de la cuerda. \n\nPor último, el resto de las argumentaciones que hace la apelante, relativas \n\nal uso de un chat de un modelo de inteligencia artificial que aporta impreso, no \n\nsolo han sido elementos ajenos al contradictorio (no se han ofrecido como prueba, \n\nlas contrapartes no han podido argumentar al respecto, etc.) sino que, \n\nvalorándolos hipotéticamente, tampoco modificarían lo resuelto pues, por un lado, \n\nparten de la tesis defensiva ya descartada con diversos elementos directos e \n\nindiciarios de prueba (el encartado no tenía por qué llevar caña de pesca e \n\nimplementos en su lancha si iba solo a entregar pescado a un amigo y cargar \n\ncombustible y ambos le fueron decomisados; fue visto por dos guardaparques \n\nlanzar la cuerda, se puso nervioso y lanzó tal implemento al suelo de la \n\nembarcación cuando los oficiales lo alcanzaron en una primera ocasión, había \n\nespecies aún vivas, una con resto de anzuelo, que no habrían resistido el viaje de \n\ndos horas expuestas al sol y lanzadas al piso de la embarcación). Por otro lado, la \n\nlógica refiere que cualquier pez, extraído del agua de la que obtiene oxígeno y \n\nlanzado a un piso de la embarcación expuesto al sol, muere rápidamente, sin que \n\nlogre sobrevivir dos horas, de modo que por mucho que se hagan esfuerzos por \n\nestablecer tiempos de ruta distintos (según velocidad de la embarcación) el propio \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 18 \n\nhijo del encartado fue quien manifestó la hora de salida de la casa, el tiempo \n\nestimado hasta que fueron intervenidos y el propósito del viaje, aspectos usados \n\npara calcular en dos horas o dos horas y media la travesía. \n\nLa última de las quejas alude a que la cancelación de licencia se indicó en \n\nla parte dispositiva y no en la considerativa y aunque tal cosa fue así, no afecta la \n\nvalidez de lo resuelto pues el juez fue claro en que se trataba de una adición de lo \n\ndecidido inmediatamente antes, en una sentencia oral que es más espontánea o \n\nmenos rígida que una escrita, y que, en todo caso, la decisión surgía por \n\nimperativo legal, como en efecto ocurre según se verá en el siguiente apartado, de \n\nmodo que no requería mayor fundamentación más que la aplicación de la norma. \n\nAsí las cosas, aún valorando hipotéticamente la atípica declaración \n\nintroducida en el recurso y material no sometido al contradictorio (respuestas de \n\nun chat de inteligencia artificial) lo resuelto en cuanto a la determinación fáctica \n\ndebe mantenerse y los argumentos deben rechazarse. \n\nIII.- En el único reclamo del recurso de la Procuraduría General de la \n\nRepública se reprocha la falta de aplicación del artículo 110 del Código penal y la \n\nerrónea fundamentación del tema al rechazarse el comiso de la embarcación tipo \n\npipante, que corresponde a nombre de “[...]” con matrícula [Valor 002], motor de \n\n20 hp de cuatro tiempos serie 75818BB, la cual fue utilizada por el imputado para \n\nnavegar en las aguas de los Canales del Parque Nacional Tortuguero, donde fue \n\nsorprendido realizando faenas de pesca, los cuales le fueron decomisados, \n\nordenándose en la sentencia la devolución de dicho bote al imputado (propietario \n\nregistral), sin haber ordenado la anotación registral de presente proceso. Indica \n\nque el tribunal consideró que la multa impuesta y la cancelación de la licencia \n\nhacían desproporcional la medida y para ello el tribunal dijo apoyarse en un voto \n\nde la Sala Constitucional sobre el comiso de vehículos en conducción temeraria. \n\nEl apelante indica que no se dieron los datos de ningún voto relativo al comiso, de \n\nningún órgano jurisdiccional y eso, a su juicio, vicia la motivación pues no se \n\npuede reconstruir el razonamiento. Narra que el tribunal sostuvo que, de acuerdo \n\ncon el numeral 152 inciso a) de la Ley de Pesca y Acuicultura, la cancelación de la \n\nlicencia de pesca era un imperativo legal y esa obligación impedía conceder el \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 19 \n\ncomiso por lo gravoso de la sanción, lo que la parte recurrente estima erróneo, \n\npues dicho numeral no contiene tal obligación, sino solo una facultad que bien \n\npudo no aplicarse para ordenar el comiso. Afirma que la sentencia es \n\ncontradictoria pues aduce, como motivo para rechazar el comiso, que el encartado \n\nperdería los medios de trabajo usuales, pero a la vez le canceló la licencia de \n\npesca, que es a lo que se dedica. Arguye que si la preocupación por la situación \n\ndel enjuiciado era tanta, hubiera sido mejor ordenar el comiso del bote y \n\nmantenerle la licencia de pesca, porque así habría podido usar prestados o \n\nalquilados otras embarcaciones, en tanto que pescar sin licencia es un delito. \n\nAdemás, se omitió el trámite establecido en el inciso c) de la ley citada en que la \n\nembarcación debe mantenerse anotada pues responde por el pago de la multa. \n\nPide se declare la ineficacia de este extremo y se ordene el reenvío, manteniendo \n\nincólume la decisión en lo que no ha sido objeto de impugnación. No hubo \n\nrespuesta de la contraparte. Se debe acoger parcialmente el reclamo. El primer \n\nlugar, no es aceptable la tesis del ente estatal de que el tribunal pudo no cancelar \n\nla licencia de pesca y disponer el comiso de la embarcación, decisión que, a juicio \n\ndel apelante, era “más justa” y proporcional. Tal cosa no es posible pues el juez, \n\nen efecto, aplicó la literalidad de la ley la cual dispone, como imperativo, la \n\ncancelación de ese permiso: «Artículo 153.- Quien autorice o ejerza la actividad de \n\npesca comercial o de pesca deportiva en las áreas silvestres protegidas indicadas en \n\nel primer párrafo del artículo 9 de esta Ley, se sancionará con multa de veinte a sesenta \n\nsalarios base y la cancelación de la respectiva licencia. Si corresponde al funcionario \n\npúblico que autorizó el ejercicio de la pesca en estas áreas, se le aplicarán las sanciones \n\ndisciplinarias, administrativas y penales respectivas, con respeto al debido proceso.» (el \n\ndestacado es agregado). Así, a partir de la secuencia horaria 1:35:33 del archivo \n\nque contiene la grabación de la sentencia oral se determina que el artículo en que \n\nse basó el juez no fue el numeral 152 inciso a) de la Ley de Pesca y Acuicultura, \n\nque cita este recurrente, sino otro y que este último numeral no es aplicable \n\nporque este se refiere a “Omita dar al INCOPESCA el aviso de arribo o la información \n\nde las extracciones, la cosecha o la recolección realizadas, pese a estar obligado a \n\nhacerlo según la normativa correspondiente.” Esta conducta aplica cuando es posible \n\nextraer, pero en este caso el juez fue amplio en su análisis de que en un parque \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 20 \n\nnacional, como el Tortuguero, estaba prohibido todo tipo de pesca y, por ello, la \n\nlicencia no era significativa. Por ello, agrega esta cámara, no podía darse aviso a \n\nINCOPESCA de extracciones, como indica ese tipo, si tal pesca no era lícita. Si \n\nbien el numeral 156 inciso c de la Ley de Pesca y Acuicultura contiene la potestad \n\nde cancelación de licencia como sanción sancionaría para los delitos de esa \n\nsección, en el tipo penal especial la potestad se cambia a obligación y la regla \n\nespecial predomina sobre la general. \n\nPor otro lado, se fijó el monto mínimo de días multa del correcto tipo penal \n\naplicable (no el que menciona, por error evidente, el procurador apelante), pese a \n\nlo cual la sanción fue alta pues la forma de cálculo tampoco es discrecional para el \n\njuez sino que se basa en parámetros establecidos en la propia normativa \n\n(estipulación del monto de cada salario base). De allí que, en lo único que el juez \n\nsí tenía discrecionalidad era en aplicar o no el comiso de la embarcación y el \n\nmotor según lo solicitado, lo que rechazó por considerar excesivo y en tal criterio \n\ncoincide este tribunal. El juzgador se basó en un voto constitucional y si bien no lo \n\nmencionó con datos para su ubicación (estaba emitiendo una sentencia oral \n\ninmediatamente después de cerrado el debate, de modo que era entendible que \n\nno lo recordara de memoria), este sí corresponde a la realidad y al caso al que \n\naludió (el contexto de la conducción de vehículos). El citado pronunciamiento de la \n\nSala Constitucional corresponde al voto número 2011-7783 en donde se evacuó \n\nuna consulta facultativa de constitucionalidad sobre el comiso automático que se \n\nvenía haciendo de los vehículos automotores por la conducción temeraria, ocasión \n\nen que el órgano constitucional analizó la medida de cara a los principios de \n\nproporcionalidad y razonabilidad. Dada la trascendencia del criterio para el caso \n\nque nos ocupa y la vinculatoriedad del criterio al tenor del numeral 13 de la Ley de \n\nla Jurisdicción Constitucional, conviene hacer una transcripción amplia: \n\nIII.- […] la Sala ha indicado que para determinar la validez o justificación \n\nconstitucional de las normas, debe ponderarse si las circunstancias sociales \n\nque motivaron al legislador a sancionar una determinada ley guardan \n\nproporción con los fines perseguidos con ésta y el medio escogido para \n\nalcanzarlos. Así, la Constitución provee al legislador de ciertos contenidos \n\nnormativos enunciados por ella misma, los cuales le permiten crear el resto de \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 21 \n\nla norma legal sobre una base técnica de carácter racional […] la \n\nrazonabilidad hace parte integrante del control constitucional con el fin de \n\nasegurar que las leyes no resulten en un ejercicio arbitrario y sin sentido del \n\npoder público, sino que respondan a necesidades y motivaciones reales \n\n[…] IV.- […] En criterio de los jueces consultantes, la aplicación de manera \n\nautomática del artículo 110 citado, como consecuencia de haberse \n\nconfigurado el ilícito tipificado en el artículo 254 bis del Código Penal, podría \n\nresultar lesivo del principio de proporcionalidad y razonabilidad, por tratarse \n\nde un delito de peligro, que no justifica en todos los casos su aplicación, pues \n\ndependiendo de las circunstancias de cada proceso, podría resultar una pena \n\naccesoria y prácticamente confiscatoria. Sobre el particular, aprecia la \n\nSala que efectivamente la figura del comiso, tal como se define en el artículo \n\n110 del Código Penal, es una consecuencia civil del ilícito penal dirigida a \n\nprevenir la utilización de bienes o instrumentos para fines delictivos, o a la \n\nutilización de los bienes o valores provenientes de la comisión del hecho \n\npunible, precisamente como una medida adicional de carácter civil que más \n\nallá de la sanción de carácter penal, desestimule psico-socialmente la \n\nrealización de hechos delictivos, o imposibilite que esos instrumentos o \n\nbienes puedan ser nuevamente utilizados para la comisión de hechos \n\ndelictivos, dejando en todo caso, a resguardo los derechos que pudieren tener \n\nlos ofendidos o terceras personas. […] la conducción de vehículos \n\nautomotores por las vías terrestres es una actividad que puede válidamente \n\nser ejercida bajo los parámetros autorizados por el legislador y la \n\nadministración, mas existen ciertos supuestos de abuso y ejercicio \n\nirresponsable […] De tal forma, interpretar que debe aplicarse de manera \n\nirrestricta, automática y casi obligada lo dispuesto en el artículo 110 del \n\nCódigo Penal en relación con el artículo 254 bis del mismo Código, sin \n\nvalorar las particularidades de cada caso concreto, ciertamente origina \n\nuna consecuencia de carácter confiscatorio sobre un bien mueble, el \n\nvehículo que se conduce, que puede resultar desproporcionada, y convertirse \n\nasí en una pena accesoria. En efecto, el comiso tiene como objeto privar al \n\nsujeto infractor de los objetos con los cuales produjo una afectación a la \n\nsociedad y lo pretendido es evitar que ello ocurra nuevamente, para ello el \n\npropio 254 bis contempla la inhabilitación, no necesariamente la pérdida del \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 22 \n\nvehículo, aunque también agrava la pena en ciertos casos […] incluso el \n\nmismo legislador contempló que cuando se imponga una pena de prisión de \n\ntres 3 años o menos, el tribunal podrá sustituir la pena privativa de libertad por \n\nuna medida alternativa de prestación de servicio de utilidad pública […] Lo \n\nanterior evidencia, que el artículo 254 bis establece muchos supuestos, en los \n\ncuales sí podría resultar procedente el comiso, pero otros en los que ello se \n\nconvierte en irrazonable y desproporcionado a la conducta sancionada, \n\npor lo cual es el Juez quien debe valorar cada caso concreto. Es en este \n\nsentido, que la automática aplicación integrada de la normativa de \n\nreferencia resulta contraria a los principios de razonabilidad \n\ny proporcionalidad, pues de conformidad con lo establecido, la finalidad \n\nde la norma del artículo 110 del Código Penal es aplicable a otros \n\nsupuestos delictivos distintos a los tipificados en el artículo 254 bis del \n\nmismo Código, mas no de manera automática a los allí definidos; esta \n\nfalta de correspondencia entre la finalidad de una norma y lo tipificado en la \n\notra, determina la irrazonabilidad de una aplicación de ambas de manera \n\nconjunta, automática e irrestricta, pues tal como se ha indicado, se trata de \n\nregulaciones y reconocimientos diferentes. Asimismo, si el artículo 254 bis \n\ndefine la sanción penal a imponer a conductas que por sí mismas no son \n\nobjeto de la finalidad de lo pretendido por el artículo 110, la aplicación \n\nconjunta y automática de ambas normas origina una situación \n\ndesproporcionada, justamente por la coexistencia de unas sanciones \n\nque sí son propias a las conductas reguladas, junto con una sanción \n\nadicional de carácter confiscatorio que no se corresponde ni atiende a la \n\nnaturaleza del ilícito penado. […] sí debe enfatizarse que la aplicación \n\nconjunta como una consecuencia automática e indiscriminada sí \n\ndeviene en una vulneración de los principios de razonabilidad \n\ny proporcionalidad, y como tal, resultaría en una interpretación y aplicación \n\ncontrarias al Derecho de la Constitución. Por otra parte, igualmente debe \n\nadvertirse que esta definición en nada prejuzga sobre la naturaleza \n\nconstitucional del artículo 110 del Código Penal, es decir, que este \n\npronunciamiento dista de referirse sobre la constitucionalidad de esta norma \n\nen específico y de su aplicación a otros ilícitos penales en los cuales resultare \n\nprocedente su aplicación irrestricta en todo caso. En definitiva, se evacúa la \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 23 \n\nconsulta en el sentido que es inconstitucional la aplicación automática del \n\nartículo 110 del Código Penal relativo al comiso, respecto del delito \n\nde conducción temeraria establecido en el artículo 254 bis del Código \n\nPenal, comiso que sólo procede cuando el juzgado, en resolución \n\ndebidamente fundamentada, establezca el porqué de su aplicación en el caso \n\nconcreto.» (El destacado es agregado). \n\nComo puede verse, el peso argumentativo del voto se centra no en el tipo de \n\ndelito (en aquella ocasión la conducción temeraria, ahora la pesca ilegal) sino en \n\nla automaticidad o no de la medida de cara a los principios de proporcionalidad, \n\nes decir, de la gravedad de la conducta y del marco sancionatorio restante \n\naplicado. En este caso, fue este último criterio el que usó el juez para rechazar el \n\ncomiso (ver, entre otros, el minutero 1:44:59) al indicar que si bien había \n\naplicado el monto mínimo de multa, este ascendía a varios millones y a ello debía \n\nsumarse la obligatoriedad de la cancelación de la licencia de pesca para una \n\npersona que se dedicaba a esa actividad, lo que era suficiente reproche para la \n\nconducta de pesca en zona protegida de seis mojarras, máxime que estas eran \n\napenas seis, criterio en el que este tribunal coincide plenamente. Como el \n\nprincipio de proporcionalidad tiene base constitucional es superior a la ley que \n\nprevé el comiso y predomina sobre esta, de modo que no se observan yerros \n\ninterpretativos al respecto. En este tema, el recurso, pues, no es aceptable. \n\nEn lo que sí lleva razón el procurador es que el órgano jurisdiccional no \n\naplicó el numeral 155 de la citada Ley de Pesca y Acuicultura que refiere: «Los \n\nbuques o las embarcaciones utilizados para la comisión de los hechos ilícitos tipificados \n\nen la presente Ley, responderán por el pago de las multas impuestas a sus ocupantes o \n\ndueños por la trasgresión de la presente Ley. Para tales efectos, el despacho judicial \n\nque conozca la causa correspondiente ordenará, al Registro de Bienes Muebles del \n\nMinisterio de Justicia, la anotación de un gravamen judicial sobre la embarcación \n\ninvolucrada en los hechos ilícitos. Asimismo, el despacho judicial comunicará \n\ninmediatamente esta circunstancia a las autoridades portuarias respectivas, para \n\nque tomen las previsiones correspondientes en materia de zarpes y otros efectos.» \n\n(El destacado es agregado). En la sentencia no se hizo mención al respecto, de \n\nmodo que se omitió por completo la disposición. Empero, no corresponde ordenar \n\n \n\nExpediente: 26-000102-1263-PE (7) - pág.: 24 \n\nninguna nulidad ni reenvío pues, al tratarse del recurso del querellante (no de la \n\ndefensa) no se afecta el principio de prohibición de reforma en perjuicio. Al ser \n\nesa una disposición imperativa establecida en la ley, en la que no hay ninguna \n\ndiscrecionalidad para concederse o no (nótese la redacción imperativa de la \n\nnorma), efectuar un reenvío solo conduciría a una sola decisión de modo que no \n\nse afectaría el principio de derecho al recurso del encartado que, en todo caso, lo \n\nsigue teniendo en sede de casación. Así las cosas, en atención al principio de \n\neconomía procesal, lo procedente es adicionar lo resuelto ordenando esa \n\nanotación del gravamen sobre la embarcación al Registro de Bienes Muebles del \n\nMinisterio de Justicia y que se haga la comunicación a las autoridades portuarias \n\nrespectivas. Tampoco debe revocarse la orden de devolución de la embarcación, \n\nque dispuso el juez en la sentencia pues dicha devolución no es incompatible con \n\nla anotación de referencia. En efecto, el juzgador concedió tres meses al \n\npropietario registral para que presentara la documentación de titularidad de la \n\nlancha y motor y, transcurrido ese plazo sin hacerlo, conforme a la Ley de Bienes \n\nCaídos en Comiso, sí procedería este, pero el que se entregue la embarcación al \n\npropietario, como se dijo, no es incompatible con la anotación registral del \n\ngravamen ni la comunicación a las autoridades portuarias cuya objetivo es que \n\nestas tomen previsiones en materia de zarpes, lo que supone, la posibilidad de \n\nnavegación en ciertas condiciones. Por ello, desde esta sede, se hará la adición \n\nindicada. \n\nEn definitiva, se adicionará la sentencia 201-2026, de las 15:40 horas del \n\nseis de mayo de 2026 en el sentido de que deberá anotarse la embarcación “[...]” matrícula [Valor 002], motor de 20 hp de cuatro tiempos serie 75818BB en el\n\nRegistro de Bienes Muebles del Ministerio de Justicia como garantía del pago de \n\nla multa aquí dispuesta. The judges participating in the decision on the appeals are Rosaura Chinchilla Calderón, Kathya Jiménez Fernández, and Ivette Carranza Cambronero. Appearing before this court are licenciada Karol Vanessa Delgado Rivas, private defense counsel for the defendant, and licenciado Andrés Alfaro Ramírez in his capacity as Procurador Penal, and,\n\nWHEREAS:\n\nI.- By judgment number 201-2026, issued at 15:40 hours on the sixth of May, two thousand twenty-seven (sic, as written in the official record (minuta)), the Criminal Tribunal of the II Judicial Circuit of the Atlantic Zone, Flagrante Delicto Division, ruled: \"Por tanto: In accordance with the provisions of articles 39 and 41 of the Political Constitution; 1, 4, 11, 12, 16, 18 through 20, 30, 31, 53, 54, 71, 73, and 110 of the Criminal Code; 1, 2, 9, 153, and 154 of the Ley de Pesca y Agricultura; 1 through 15, 142, 180 through 184, 265, 360 through 361, 363 through 365, 367, 422 through 429, and 432 of the Code of Criminal Procedure; 1045–1046 of the Civil Code; 122, 124, 127 of the rules in force on civil liability under the Criminal Code of 1941; [Nombre 001] is declared the criminally responsible author of ONE OFFENSE OF ILLEGAL FISHING, committed to the detriment of NATURAL RESOURCES, and in that capacity is sentenced to a FINE OF TWENTY BASE SALARIES (salarios base), corresponding to the sum of four hundred sixty-two thousand colones, as established by the Superior Council of the Judiciary for the year two thousand twenty-six, for a total amount of NINE MILLION TWO HUNDRED FORTY-FOUR COLONES (sic), payable within fifteen business days from the date this judgment becomes final. The forfeiture (comiso) of all seized goods described in official records ACTo-AASP 1024-2026 and 1025 at folios 12 and 13 is ordered, with the exception of the pipante-type vessel and its corresponding motor, for which a three-month period is granted for the owner to come forward and claim them. Should this period elapse without a claim, forfeiture in favor of the State will proceed. Likewise, the CIVIL DAMAGES ACTION (acción civil resarcitoria) brought by the civil claimant Procuraduría General de la República is declared GRANTED. The civil defendant is ordered to compensate for the DAMAGE caused and the interest accrued from the time of the act until the liquidation of amounts at the enforcement and finality stage, a ruling issued in abstracto in accordance with procedural law. Judge of the Flagrante Delicto Tribunal of Pococí.\" (Sic; the grammatically incorrect use of capitalization appears in the original.)\n\n---\n\nExpediente: 26-000102-1263-PE (7) - pág.: 2\n\nII.- Against the foregoing ruling, appeals were filed by licenciada Karol Vanessa Delgado Rivas, in her capacity as private defense counsel for the defendant, and by licenciado Andrés Alfaro Ramírez as Procurador Penal.\n\nIII.- That, following the corresponding deliberation in accordance with article 465 of the Code of Criminal Procedure, the tribunal addressed the issues raised in the appeals.\n\nIV.- That the relevant legal requirements have been observed throughout the proceedings.\n\nOpinion drafted by Judge Chinchilla Calderón; and,\n\nCONSIDERING:\n\nI.- Admissibility and jurisdiction. Licenciada Karol Vanessa Delgado Rivas, in her capacity as private defense counsel for the defendant, and licenciado Andrés Alfaro Ramírez as Procurador Penal filed appeals against the judgment handed down in these proceedings, a decision that is subject to challenge by this avenue (objective standing) and by such parties (subjective standing). These challenges were presented in reasoned written submissions filed before the court of first instance and within the legal time limit (since the full judgment was issued on May 6, 2026, although a clerical error in the written official record stated 2027, and the appeals were filed on May 22 and 27 of the current year, respectively — that is, before the filing deadline of May 28, taking into account the exclusion of weekends and the public holiday on May 8) and, accordingly, the challenges must be admitted without the need for further formalities, since to hold otherwise would violate the mandate set forth in article 8.2.h of the American Convention on Human Rights and the ruling of the Inter-American Court of Human Rights in the case of Mauricio Herrera Ulloa v. Costa Rica, judgment of July 2, 2014. Defense counsel challenges the judgment in general terms, but all of her arguments relate to the criminal aspect; consequently, the abstract civil ruling on payment of damages has not been expressly challenged and, since it constitutes a civil matter governed by the principle of party disposition (absent a party's initiative no analysis is conducted, as a procedural party may freely dispose of patrimonial assets), that aspect must be deemed final.\n\nII.- In the first ground of the extensive appeal filed by defense counsel for the defendant — a 24-page submission in which the same arguments are repeated and to which AI-generated search reports are then appended — counsel alleges erroneous evaluation of the testimonial evidence of the two park rangers (guardaparques) and inadequate reasoning in the judgment. She argues that the fact that the witnesses are public officials does not mean that they are, per se, honest or truthful, especially since the principal beneficiary in this type of offense is the Servicio Nacional de Guardaparques, which receives 70% of fine revenues and the penalty amounts to several million colones, a circumstance that facilitates the work of such officials — none of which was taken into account. The appellant was struck by the seizure of several specimens of only one species of fish, of similar size and a single color, caught in approximately 40 minutes — the time the witnesses estimated — whereas it is customary, when casting a line, to catch other species as well, unlike what happens in fish ponds, where only the stocked animal is present and, by reason of the feeding regimen, they tend to fatten or grow to similar sizes, which would explain the uniformity in size. This, she adds, is consistent with the defendant's son's account that the family has a pond of red mojarra and that his father took some of them to give to a friend in Parismina. She also notes that there is no study establishing that only that species exists in that area, which would permit the conclusion that every time the line was cast (a fishing rod was used, not a gill net (trasmallo)) that particular species would be caught. She argues that the witnesses were untruthful because one stated that the defendant was trolling (troleaba) — casting the baited line into the water while the boat moves forward so that the species strikes on the drag — while the other said the boat was stationary. She finds it illogical that, if the defendant knew the park rangers' patrol boat had passed him, he would have been fishing in the area, or that, when signaled to stop, he would not have thrown the mojarra back into the water, especially since four of them were alive, as the witnesses stated typically happened to hinder enforcement action. For the defense, this did not occur because, in his own mind, the defendant knew he was not acting in violation of the prohibition, given that the mojarra came from a pond at his home where he raises them, which is why they were of similar weight and size. She criticizes the judge's questioning of the manner in which the fish were transported — thrown on the floor of the boat rather than in coolers or bags if they were meant for consumption. She states that the officers have personal disputes with her client, and that it is inconsistent for them to have seen the defendant cast the fishing rod without immediately detaining him in the Parque Nacional Tortuguero (especially since, according to them, he acted nonchalantly and concealed the tackle), which could amount to a dereliction of duty, rather than stopping him further along the canal. The defendant provided photographs of the park rangers' boat and therefore could have disposed of the evidence had it been incriminating, yet he did not do so. She indicates that she was not invoking a fixed evidentiary standard, but rather that the use of binoculars is normally referenced in reports to establish that observations were made at certain distances; in this case, however, the defendant was told he was being filmed, not that binoculars were used — these are different objects — and the report does not specify the make or characteristics of the binoculars beyond \"long-range,\" so that the defense could verify, as was done with the GPS (as stated in the appeal). She recounts that the police report mentioned the presence of the defendant's underage son; the officers referred to the presence of two sons; [Nombre 001] stated that on the day of the events he was traveling with a small dog on a boat and submitted a photograph dated the day of the events showing the dog, all of which precluded the tribunal from concluding that witness [Nombre 001] was confusing the incident with another event — without such a finding, they should have credited his account, which would have undermined the officers' testimony. She notes that the exculpatory evidence was held to a higher standard of precision than the inculpatory evidence. For the appellant, the references to the defendant's boat traveling at slow speed constitute a subjective assessment that failed to account for the extremely high power of the official vessel (400 horsepower) compared to the modest engine on the defendant's boat (200 horsepower), which could create the impression of slow movement. She also notes that she asked an artificial intelligence model — which, in her estimation, is more reliable than others — about the location of the coordinates of the stop (which it correctly identified), as well as the distance and travel time from that point to the defendant's home based on the type of engine on his boat, and received the answer of 35 km and 3.5 to 4 hours, which would mean the speed of travel was normal rather than slow, given the time the witness said they left home and the time of the stop. On another matter, she addresses the lifespan of mojarra out of water, the finding that four were alive and two dead since the former were moving their gills and one still had a lure attached, the length of time it takes for them to decompose if not in water and left in the sun, and the court's finding that they had been caught recently because they were still slippery — again relying on a generative AI model, she argues that the defense witness's account is consistent with that of his father, an experienced fisherman, regarding those aspects (the time the species can remain alive if in water or in the shade). She requests that the judgment be annulled. In the second ground of appeal, she raises the existence of a contradictory and inconsistent judgment, since the operative section refers to the cancellation of the license by operation of law, yet none of the recitals address this matter, which should have been done given that it constitutes an accessory penalty. She argues that the operative section is a summary of what was analyzed in the reasoning section but does not replace it, and in this case the matter was mentioned only in the operative section. Furthermore, her client did not testify because his attorney did not allow him to and he was unaware that he could disregard professional advice, which he now does on appeal. Defense counsel introduces an alleged statement from him in which he denies the charges and asserts that he lives outside the Parque Nacional Tortuguero, where he has had a lagoon for about a year in which he raises black and red mojarra, feeding them with tilapia feed, and they have been reproducing. He and a friend conducted an experiment to see whether farmed or wild mojarra tasted better, which is why he was transporting the confiscated fish — all of which were red, uncleaned, and of similar size. He describes the time he left home, the engine and horsepower of his boat, how long the visit to his friend would take and the travel speed, that he was traveling with his two sons, that the park rangers' boat passed them, they took a photograph, and at the entrance to Caño Negro he was stopped. He states that he was a volunteer park ranger for one year, that he was not fishing, that when one fishes the lure is cast and any species may bite rather than only one, that he holds permits to fish in open waters and would not have risked fishing in an area he knows to be prohibited, that it was he who brought his vessel alongside the official boat since the rangers could not manage it, and that had he known he was doing something illegal he would have thrown the mojarra into the water. He states that he submitted photographs and videos of his fish pond and that he has had disputes with [Nombre 008] because his father, an 80-year-old man, won legal proceedings against this person for being disrespectful, and the resulting animosity has extended to the whole family. He stated that this individual refused to allow him to make a call to biologist Renato regarding some turtles that were at his home and were to be fitted with GPS trackers (as stated in the written submission), and that the officer, knowing his property was unoccupied, went and took the turtles and released them almost at the beach, thereby exposing them to predators and nearly causing their death, and that had he not had the proper permits that incident would have given rise to another case against him, as this person persecutes him. He states that he was once sentenced pursuant to a plea agreement (abreviado) and that he conducts his life in accordance with the law, that this time the charges are false, and that the penalty is a fine. He asks that the appeal be granted, and defense counsel requests that the judgment be annulled. There was no response from the opposing party. The complaints must be rejected and, since they share common aspects, will be addressed together. Before doing so, it is appropriate to describe what transpired at the trial stage.\n\n---\n\nExpediente: 26-000102-1263-PE (7) - pág.: 7\n\n(A) Summary of proceedings. In the present matter, two charges filed by different state agencies attributed to the defendant the offense of illegal fishing set forth in article 153 of the Ley de Pesca y Acuicultura No. 8436, on the basis of the following facts set out in the prosecution's charging document:\n\n\"On March 8, 2026, at approximately 7:40 hours in Limón, Pococí, Cariari, Tortuguero, Parque Nacional Tortuguero, Bocana Caño Negro, the accused [Nombre 007] was present at that location, at which time, knowing that he was within the protected wildlife area of the Parque Nacional Tortuguero, and using a fishing rod, he illegally caught within the boundaries of this national park a quantity of six fish of the mojarra species, whose name is vieja maculicauda (spotted jewelcichlid), each weighing 1.90, for a total weight of 1.95 kilograms of fish, thereby endangering the continuity of species in the riverine ecosystem.\"\n\nFor its part, the Procuraduría General de la República (which also brought the civil damages action on the same factual basis) stated the following:\n\n\"1.- On March 8, 2026, at approximately 16:15 hours, officials of the Parque Nacional Tortuguero, conducting a control and protection patrol in the Parque Nacional Tortuguero, specifically in the main channel of Laguna Tortuguero, coordinates CRttM 0,5 norte 1148721 y este 562953, a site located within the Humedal Caribe Noreste, which is classified as a Ramsar site, on a pipante-type boat identified as [...] with registration [Valor 002], equipped with a 20 hp 4-stroke motor, serial number 075818 BD, knowingly and using fishing gear of the rod type, the accused [Nombre 001] caught 6 individuals of the species mojarra (Vieja maculicauda) with a total weight of 1.95 kg. 2.- The fishing activities carried out by the accused [Nombre 001] within the Parque Nacional Tortuguero caused environmental harm through the impairment of a series of values, including commercial value, defined as the market value of the products or by-products of a wild animal or its domestic equivalent generated from sales on the national market, estimated by adding the value of the meat plus the value of the by-products. Furthermore, with respect to ecological value, each individual, defined as a member of a species, fulfills a function and plays an important role at the ecological level. The ecological value may be classified as immeasurable, temporary, or permanent depending on the location and the degree of impact. The protection value reflects the fact that these actions also threatened other marine habitats. The restoration value (valor de restauración), for its part, seeks to return the affected ecosystem to a state as close as possible to its pre-disturbance structural and functional condition. In the case of wildlife, the restoration value includes the costs of caring for an individual from birth through reproductive maturity. In the case of fish, it would be necessary to have at least one breeding pond, and the catches and accessories also affect the food chain of other species such as seabirds, which is why fishing is not permitted in protected areas given the potentially devastating damage it can cause to marine biodiversity. The economic valuation of the environmental damage caused by the unlawful conduct of the accused was calculated by SINAC at 901,072.75 colones.\"\n\nThe trial was held over two hearings, during which the following documentary evidence was admitted: the SINAC report of March 8 at folios 1 through 11, the seizure record (acta de decomiso) at folios 12 through 14, the final disposition record at folio 15, the complaints at folios 20 through 29, the criminal record certification at folio 32, the SINAC report of March 10, 2026, the economic valuation of environmental damage, copies of the photographs at folios 65 through 71, a copy of the seaworthiness certificate at folio 72, a copy of the license at folio 73, and a USB storage device containing several files: three video files and 20 image files; testimony was also heard from officials [Nombre 008] and [Nombre 009] ([Nombre 010], admitted in the trial opening order (auto de apertura a juicio), was not heard), as well as from the defendant's son, [Nombre 001].\n\nThe judgment was delivered by a single judge, orally, and is recorded in file 260001021263PE-06052026033848-2_Multi, which has a running time of two hours. In the judgment, after describing the content of the testimonial evidence as required by article 143 of the Code of Criminal Procedure, the court proceeded to conduct its intellectual analysis (beginning at timestamp 37:04) and legal analysis of the case. The grounds for the conviction were the following:\n\n---\n\nExpediente: 26-000102-1263-PE (7) - pág.: 9\n\ni. The statements of [Nombre 008] and [Nombre 009] were internally consistent and consistent with the documentary evidence, and there is no record of any motive for them to falsely incriminate the defendant. Although the first officer was previously acquainted with the defendant, there was no hostile relationship between them, and the second officer did not know the defendant at all.\n\nii. Both witnesses recounted that the boat in which the defendant was traveling was in the Parque Nacional Tortuguero, traveling at a slow speed, and that, using binoculars, they observed a person casting a line into the water or trolling, which gave them reason to suspect that person was fishing and prompted them to overtake the vessel (at which point the person in the boat lowered the fishing rod and concealed it, acting nonchalantly). The park rangers stated that they proceeded to set up surveillance further along to confirm their suspicions. Both describe positioning themselves at a safe distance along the edges of the channel, concealed in the undergrowth, from which they observed the boat through binoculars and watched the person cast the line. One of the officers observed the defendant pull fish from the lagoon on three separate occasions (at moments when the boat came to a stop). They decided to wait until the boats were alongside each other. The witnesses identified the defendant and two minors and were emphatic that only the adult was engaged in those activities; they identified him by his clothing and age. At that point, they observed six mojarra on the floor of the boat. The officers concluded that the fish had been caught recently because four of them showed signs of life (they were opening and closing their mouths or moving their gills trying to breathe), were wet, and were slippery. Both witnesses recount that the defendant was told he was to be detained and taken to a police station, at which point the defendant denied having removed the specimens from the lagoon and claimed to have brought them from a pond at his home — an account the officers discounted on the basis of the condition of the fish and their having seen him cast the rod, the fact that one mojarra still had a lure or type of hook on it, and the presence of a tackle box and fishing rod in the vessel. They also stated that the defendant attempted to offer each of them money to make the matter go away. That account, the judge stated, is logical and credible. The officers maintained the same account of events as in the report and the complaints, submitted to cross-examination, and their account remained firm; there was only one discrepancy regarding the surveillance dynamics (one officer said the surveillance was conducted from a single location and the other said from several), but this is not material and, given their daily duties, one of them could have been confused.\n\niii. The account given by the defendant's son does not even provide certainty that it refers to the same event, though it must be assumed that it does. The young man stated that they took six mojarra from the home pond — a private hatchery — placed them on the floor of the boat, got the food ready, and quickly left to deliver the mojarra to a friend and buy fuel. About two hours after leaving home they were approached by the police, and he heard the argument in which his father said that the fish came from home and that they were being filmed. He stated that at his home there are four ponds, one under construction, containing mojarra, guapotes, and tilapia. Although this, the judge noted, might give rise to a reasonable doubt, the court discounts this account because it cannot be reconciled with what the officers said. [Nombre 001] states that they never stopped, which contradicts the SINAC officers who observed them stop several times while a person cast the rod. There is also a glaring inconsistency regarding the use of the fishing rod, since the young man stated it was not used and was merely on board the vessel. Since both contradictory accounts cannot simultaneously be true, the judge stated it was necessary to consider that the young man is the defendant's son and, while that does not mean he is lying, he has a different interest in the proceedings; he also does not recall many aspects or does not describe them in detail — his is a terse account. The young man falls into internal contradictions because he acknowledges that his father, when he delivers fish from his hatchery to others, places them in a bucket or cooler so they do not spoil, yet on this occasion he did not do so, and they were on the floor of the vessel. Moreover, fishing rods and fishing tackle were on board. That is not logical, whereas the park rangers' account is. Nor is it acceptable that the haste led to placing the fish on the vessel floor, since according to the young man, after taking the fish out of the pond they prepared food, so they were not leaving in such a rush as to have lacked that basic precaution. The officers noted that if the fish are not gutted they spoil quickly, and from departure to the stop two and a half hours had passed with still some distance to travel, so it is not plausible that the animals were transported that way.\n\niv. The rest of the documentary evidence corroborates the prosecution's theory: coordinates are provided that correspond to a national park; the participating officers are identified; the seizure of species (red and black mojarra), a fishing rod, the vessel, and the motor are documented, and there are photographs of the site.\n\nv. There are photographs and videos that are presumed to be from the defendant's home, although he did not testify. The date of the photographs or videos is not established; the images show ponds and the defendant removing fish, with his children visible. The tribunal cannot draw any conclusion from this because there was no statement from the defendant and the tribunal cannot substitute itself for the parties. The date recorded in the metadata of the videos is after the events. The seaworthiness certificate and the fishing license are not relevant because they do not apply in national parks.\n\n---\n\nExpediente: 26-000102-1263-PE (7) - pág.: 11\n\nBeginning at timestamp 1:24:39, the legal analysis is conducted and, in summary, the defendant was convicted as the author of the offense set forth in that article, which provides: \"Article 153.- Anyone who authorizes or engages in commercial fishing or sport fishing in the protected wildlife areas referred to in the first paragraph of article 9 of this Act shall be subject to a fine of twenty to sixty base salaries and cancellation of the corresponding license. Where the offense is committed by a public official who authorized the exercise of fishing in these areas, the applicable disciplinary, administrative, and criminal sanctions shall be imposed, with due process guarantees.\" (Emphasis added.) He was sentenced to \"…twenty base salaries, corresponding to the sum of four hundred sixty-two thousand colones, as established by the Superior Council of the Judiciary for the year two thousand twenty-six, for a total amount of nine million two hundred forty-four thousand colones.\" He was also ordered to have his fishing license cancelled \"by operation of law,\" the civil action was resolved in abstracto given that this was a flagrante delicto proceeding, the forfeiture of the remaining goods was ordered excluding the boat and the outboard motor (i.e., the fish, fishing rods, and fishing tackle), and he was given a period of time to submit documentation of ownership of the vessel and motor for their return, failing which they would be forfeited for lack of a claim. Such is the content of the challenged judgment.\n\n(B) Ruling on the complaints. This tribunal has meticulously examined the content of the evidence admitted at trial and the analysis carried out by the court of first instance and concludes that no errors are apparent that would affect the validity of the ruling. It is true, as the appellant notes, that the fact that the park rangers are public officials does not mean that their accounts are automatically acceptable and credible on that ground alone; but in this case, that was not the evaluative criterion used by the trial judge, who mentioned that fact only to indicate that the witnesses had no direct interest in the matter — the defendant's assertion that he has had disputes with one of them is introduced only in the atypical written \"statement\" inserted in the appeal, but in any event, even if one were to assume hypothetically that there had been prior disputes between one of the witnesses and his father, that does not mean the events are false or that the other officer, who did not know the defendant, is lying and decides to fabricate false entries in official documents merely out of \"solidarity with his colleague\" — an allegation for which there is no evidence whatsoever. It should be noted that the trial judge examines the content of the accounts in depth to assess whether they are internally logical and consistent with the other evidence, whether the account has remained consistent over time, and whether there is consistency among the various pieces of evidence; accordingly, the credibility of the park rangers is not established solely by reason of their status as public officials. The same applies to the account of the defendant's son, whose testimony is denied probative value not because he is a relative of the defendant (a factor mentioned only to indicate that he is not in the same position as the witnesses but rather has a personal interest in the outcome — though this is not considered determinative) but because his account is internally incoherent: it is implausible that if the purpose was to determine whether wild mojarra tastes better than pond-raised mojarra (the version introduced by the defendant in his atypical statement inserted in the appeal) one would catch the wild fish and toss them, with no prior preparation, onto the floor of a boat for a journey of several hours, exposed to sunlight, knowing that under such conditions there is a risk of the meat of the\n\nthe fish to spoil. Furthermore, it is equally illogical that if the defendant was going solely to deliver those fish and purchase fuel, he would have had fishing gear aboard the vessel.\n\nExpediente: 26-000102-1263-PE (7) - pág.: 13\n\nThe judge himself notes that there is no certainty that the son's brief account refers to the same events now before the court, yet proceeds to analyze it nonetheless. In other words, although there are a number of unresolved ambiguities, the judge still assumes, in the defendant's favor, substantive aspects of that statement, without discarding it on formal grounds. On that basis, the trial judge analyzes the evidence as a whole and reaches the guilty verdict that this appellate court upholds.\n\nAccording to the appellant, the fact that 70% of the money collected from fines is earmarked for the Servicio Nacional de Guardaparques, under the special statute governing the matter, would constitute grounds for concluding that the park rangers might lie, since doing so would improve their working conditions. However, even though that possibility exists, it cannot be established as a premise that denies credibility to the statements of those officers in all cases, or as a blanket rule (accepting the counter-argument that, by virtue of that condition, their testimony will always be false); rather, there must be specific indicia making such a possibility plausible, and in this case no such indicia exist. Indeed, if the goal were to obtain resources—no longer for the institution but for personal gain—it would actually have been more advantageous for the park rangers not to pursue this case, since, as they stated, the defendant offered them money to close the matter more quickly, and yet no additional complaint was filed on account of that offer, which further demonstrates that there was no subjective interest in harming the accused.\n\nThe defense theory has rested on the claim that the defendant has lagoons (lagunas) on his property containing this type of fish, and to that end the appeal introduces a statement by the defendant to that effect (a statement that was not subjected to the principles of orality, immediacy, or adversarial examination, yet will nonetheless be assessed for the purpose of showing that it does not alter the outcome) and photographs and videos to that effect were submitted during the trial phase. This court has reviewed that material and, indeed, the footage shows lagoons on a private property that the defendant says is where he lives; the defendant is seen casting a cast net (atarraya) and pulling out fish that he identifies as black and red mojarras (mojarras negras y rojas); a GPS (Global Positioning System) device displays coordinates placing the site within the national park (although that location differs from the site where he was apprehended—what he asserted is that he does have lagoons containing this type of fish inside the park); and in another clip, the vessel is seen traveling with a child at the bow accompanied by a dog and fish lying on the floor of the boat. The video and photographic material was analyzed in the judgment, and the judge, while noting that it was not accompanied by any statement from the defendant giving meaning to what was observed therein (an omission now remedied in the appeal), nonetheless found that it still did not exonerate the defendant, for several reasons: i. the photos and videos lacked a date, and the date reflected in their storage metadata on the device was subsequent to the events in question; ii. the navigation video cannot be associated with this incident because only a child and a dog are visible, whereas the officers stated that on the day of the events the defendant was accompanied by his two sons. This analysis is consistent with the rules of sound judicial reasoning (sana crítica), particularly given that, as shown in the defendant's criminal record, if the defendant has previously been convicted—as he himself acknowledged in his statement—of similar offenses involving illegal fishing, the images of the vessel with fish need not correspond to the date of the events now being adjudicated. In any event, what is essential and what resolves the case is that the conviction stems not only from the seizure of fish found aboard the vessel, but also from the officers' testimony that they witnessed the defendant cast a fishing rod into the water, at which point the vessel would come to a stop, having previously been moving slowly while he was observed \"trolling\" (troleando)—that is, casting the hook in various locations with the vessel in motion. In other words, even if one were to accept hypothetically, solely for analytical purposes, that some fish had been taken from the private lagoon at the defendant's home and were being transported in that atypical manner (on the floor of the vessel, uncleaned, exposed to the sun, without a bag, bucket, or cooler), the offense would still subsist, since the defendant was observed casting a fishing rod in the waters of Tortuguero, a national park in which such activity is prohibited. The officers further indicated that keeping this type of fish in private tanks within the national park would also be prohibited—a point noted merely for added context, as it was not the subject of adjudication, nor of debate or adversarial proceedings. Building on the defense theory that was rejected at first instance—and in the exercise of which this court observes compliance with the rules of argumentation—\n\nExpediente: 26-000102-1263-PE (7) - pág.: 15\n\nthe appellant offers a series of speculations as to whether the specimens are of the same size and weight, which would purportedly indicate they came from tanks. This too is unacceptable. First, because it proceeds from the appellant's own theory of the case and does not challenge the reasoning of the trial court that rejected it. Second, because even accepting that version hypothetically, the very video submitted by the defendant shows that when he casts the cast net in his tanks he draws out specimens of varying sizes, thus refuting the theory that their size is attributable to their diet. In any case, the seizure report and record refer to approximate, not exact, sizes and weights; it describes both black and red mojarras (not a single type); and nothing prevents the possibility that, during fishing activities, any specimens that are not the ones sought (by species or size) are returned to, or discarded in, the waters from which they were taken, so that the similar characteristics of what was found in the vessel are indicative of nothing beyond the illegal fishing itself—given that there were animals still alive, gasping, slippery, and another with part of a fish hook still in its body, none of which would be explained by the transport of specimens from the defendant's home after a two-hour journey.\n\nAll of the foregoing establishes that the appellant not only carries out an individual analysis of each element (rather than a joint analysis as required by Article 184 of the Código Procesal Penal) but also demands a form of legal or fixed-weight proof (prueba legal o tasada) by asserting that a technical study identifying the type of fish in the area, their size, etc., was necessary—when in fact the existence of the species is established by their seizure aboard the vessel, still with part of the hook and gasping. Nor was it necessary to describe the type of binoculars, since the rules of common experience establish that regardless of brand or type, binoculars allow one to observe what is happening at a distance, a matter governed by the principle of free evidentiary assessment pursuant to Article 182 of the Código Procesal Penal. Likewise, it is irrelevant that the report did not describe the brand or type of binoculars while it did describe the GPS (Global Positioning System) device, or that the defendant was told he was being recorded when he had \"only\" been observed through binoculars, since the officers' reference to recording could well have been made in order to assess the defendant's verbal or physical demeanor\n\nExpediente: 26-000102-1263-PE (7) - pág.: 16\n\n(and indeed he proceeded to offer the park rangers money to close the case more quickly, as he himself acknowledged when questioned by them about why he was offering each of them one hundred thousand colones if he was not fishing).\n\nOn a separate matter, the appellant argues that it is illogical that, if the park rangers saw the defendant fishing, they did not detain him at that very moment but instead moved their vessel ahead and waited for him further along; she likewise characterizes as illogical the defendant's behavior of continuing the illegal activity even after having seen the police. This reasoning, however, is not persuasive. The officers explained that they wanted to make certain that the defendant was in fact engaged in fishing, since, although it initially appeared to them that he was, that initial observation was made from a distance as they were approaching, and they did not yet have certainty. This speaks to the objectivity of their work, not to a failure to perform their duties as the appellant contends. It was for that reason that they passed nearby—at which point they noticed the subjective indication that the defendant threw the fishing rod to the floor of the vessel, as if concealing it—and decided to position themselves further ahead on the shore and use binoculars to verify what was happening, whereupon they observed him cast the rod at least three times. As for the defendant's behavior, logic in fact suggests that, since the official vessel moved on, he may have believed the danger had passed and never expected the officers to stop further ahead to observe him, which explains why he continued pursuing the objective he had set for himself that morning. It is equally unreasonable to argue that, as the vessel approached, the defendant would have disposed of the fish (or that he did not do so because he believed their possession to be lawful given that they came from his home tank), since not only was there some element of surprise in the intervention, but the number of specimens obtained (six at that point) made disposal difficult in the short time available. In other words, there are various possible explanations for why the evidence was not disposed of, and not only the one proposed in the appeal. In any event, the officers had already observed the activity and had detected the presence of the fishing rod, line, and gear aboard the vessel.\n\nExpediente: 26-000102-1263-PE (7) - pág.: 17\n\nNor does this court find that there was a double standard in the evaluation of the prosecution evidence as compared with the defense evidence. It is not true that the defense evidence was held to a standard of precision that the other evidence was not. The judge was very broad in his assessment, noting that the only discrepancy between the park rangers' accounts related to the number of observations they each made from fixed positions, which could have been attributable to a misunderstanding or to confusion with other incidents of the same type in which they had been involved; whereas, in the case of the young man, even starting from a greater number of formal inconsistencies (the date on the photos, whether or not the brother was present, etc.), the judge assumed that his account referred to this incident and delved into the substance of his narrative, assessing it on its merits as illogical. It is also unacceptable to argue that the perception of speed of the vessels depends on the greater engine capacity of their motors, since, while the official vessel may well have been far more powerful, both park rangers were clear that the defendant sometimes brought his vessel to a complete stop, which coincided with certain casts of the line.\n\nFinally, the remaining arguments raised by the appellant concerning the use of output from an artificial intelligence chat model, submitted in printed form, not only constitute evidence extraneous to the adversarial proceedings (it was not offered as evidence, the opposing parties have not had an opportunity to argue in response, etc.), but even if assessed hypothetically, would not alter the outcome. On the one hand, those arguments rest on the defense theory that was already rejected on the basis of various direct and circumstantial elements of evidence (the defendant had no reason to be carrying fishing rods and gear in his vessel if he was going solely to deliver fish to a friend and take on fuel, and both items were seized from him; he was observed by two park rangers casting the line; he became nervous and threw the line onto the floor of the vessel when the officers drew alongside him on a first occasion; there were species still alive, one with the remnant of a fish hook, that could not have survived a two-hour journey exposed to the sun and lying on the floor of the vessel). On the other hand, logic dictates that any fish, removed from the water from which it obtains oxygen and thrown onto the floor of a vessel exposed to the sun, dies quickly and cannot survive two hours; so that however much effort is made to establish different journey times (based on the speed of the vessel), it was\n\nExpediente: 26-000102-1263-PE (7) - pág.: 18\n\nthe defendant's own son who stated the departure time from the home, the estimated time until they were stopped, and the purpose of the trip—details used to calculate the journey at two hours or two and a half hours.\n\nThe last of the complaints concerns the fact that the cancellation of the license was stated in the operative part (parte dispositiva) of the judgment rather than in the reasoning section (considerativa); although that was indeed the case, it does not affect the validity of the decision, since the judge made clear that it was an addition to what had been decided immediately beforehand, in an oral judgment that is by its nature more spontaneous or less rigid than a written one, and that in any event the decision arose as a matter of legal obligation, as will be seen in the following section, and therefore required no further elaboration beyond the application of the relevant provision.\n\nThat being the case, even assessing hypothetically the atypical statement introduced in the appeal and the material not subjected to adversarial examination (responses from an artificial intelligence chat), the findings of fact as determined at first instance must stand, and the arguments must be rejected.\n\nIII.- The sole ground of appeal raised by the Procuraduría General de la República challenges the failure to apply Article 110 of the Código Penal and the erroneous reasoning underlying the trial court's refusal to order the forfeiture (comiso) of the flat-bottomed boat (pipante) registered in the name of \"[...]\" with registration number [Valor 002], 20 hp four-stroke engine, serial number 75818BB, which was used by the defendant to navigate the waterways (Canales) of the Parque Nacional Tortuguero, where he was apprehended carrying out fishing activities, and which items were seized from him; the judgment ordered the return of the vessel to the defendant (the registered owner) without having ordered the registration of a judicial notation for the present proceedings. The appellant argues that the court considered the fine imposed and the cancellation of the license to render the measure disproportionate, and that the court stated it was relying on a decision of the Sala Constitucional concerning the forfeiture of vehicles in reckless driving cases. The appellant notes that no identifying details were given for any decision on forfeiture from any court, and that, in his view, this vitiates the reasoning since the line of thought cannot be reconstructed. He recounts that the court held that, pursuant to Article 152(a) of the Ley de Pesca y Acuicultura, the cancellation of the fishing license was a mandatory legal requirement and that obligation precluded ordering forfeiture given the severity of the penalty—a conclusion that the appellant considers erroneous, since that provision imposes no such obligation but merely confers a discretionary power that could well have gone unexercised in order to allow forfeiture to be ordered. He argues that the judgment is contradictory in that it invokes, as a reason for rejecting forfeiture, that the defendant would lose his usual means of work, yet at the same time cancelled his fishing license, which is the activity he is engaged in. He contends that if concern for the defendant's situation was so great, it would have been preferable to order forfeiture of the vessel while leaving him his fishing license, since that way he could have borrowed or rented another vessel, whereas fishing without a license is a criminal offense. Furthermore, the procedure set forth in subsection (c) of the cited statute was omitted, under which the vessel must remain subject to a notation because it stands as security for payment of the fine. He requests that this aspect be declared ineffective and that a remand be ordered, leaving undisturbed the decision on all matters that have not been challenged. No response was filed by the opposing party. The ground of appeal must be partially upheld. First, the position of the state body that the court could have chosen not to cancel the fishing license and instead order forfeiture of the vessel—a decision that the appellant considers \"fairer\" and more proportionate—is not acceptable. That is not possible because the judge did in fact apply the plain text of the statute, which mandates, as an obligation, the cancellation of that license: «Article 153.- Any person who authorizes or engages in commercial fishing or sport fishing activities in the protected wildlife areas (áreas silvestres protegidas) referred to in the first paragraph of Article 9 of this Law shall be subject to a fine of twenty to sixty base salaries and the cancellation of the respective license. Where the offense is attributable to a public official who authorized the exercise of fishing in those areas, the applicable disciplinary, administrative, and criminal sanctions shall be imposed, with due process guaranteed.» (emphasis added). Thus, from time marker 1:35:33 of the file containing the recording of the oral judgment, it is established that the article relied upon by the judge was not Article 152(a) of the Ley de Pesca y Acuicultura, as cited by the appellant, but a different provision, and that Article 152(a) is inapplicable because it refers to conduct involving failure to notify INCOPESCA of the vessel's arrival or of the extractions, harvest, or collection carried out, despite being required to do so under the applicable regulations. That conduct applies when extraction is permitted, but in this case the judge was thorough in his analysis, finding that in a national park\n\nExpediente: 26-000102-1263-PE (7) - pág.: 20\n\nsuch as Tortuguero, all types of fishing are prohibited and the license was therefore immaterial. For that reason, this court adds, it was not possible to notify INCOPESCA of any extractions, as that provision contemplates, if such fishing was not lawful. While Article 156(c) of the Ley de Pesca y Acuicultura provides for cancellation of a license as a discretionary sanction for the offenses under that section, the specific criminal provision converts that discretionary power into a mandatory obligation, and the special rule prevails over the general.\n\nFurthermore, the minimum number of fine-days (días multa) was imposed under the correct criminal provision applicable (not the one erroneously cited by the appellant attorney general), yet the sanction was nonetheless substantial, since the method of calculation is not discretionary for the judge either but is based on parameters established in the legislation itself (the stipulation of the amount of each base salary). Consequently, the only matter in which the judge did have discretion was whether or not to order forfeiture of the vessel and engine as requested, which he declined to do on the ground that it was excessive—a view with which this court concurs. The trial judge relied on a constitutional court decision, and although he did not cite it with the data needed to locate it (he was delivering an oral judgment immediately after the close of the trial, so it was understandable that he could not recall it from memory), the decision does exist and corresponds to the case he referred to (the context of vehicle operation). The constitutional court decision in question is vote number 2011-7783, in which the Sala Constitucional resolved an optional constitutionality referral concerning the automatic forfeiture that had been ordered of motor vehicles in reckless driving cases, and in which the constitutional court analyzed the measure against the principles of proportionality and reasonableness. Given the significance of that ruling to the case at hand, and the binding force of the constitutional court's doctrine pursuant to Article 13 of the Ley de la Jurisdicción Constitucional, an extended quotation is warranted:\n\nIII.- […] the Sala has indicated that, in order to determine the constitutional validity or justification of legal provisions, it must be weighed whether the social circumstances that led the legislature to enact a given statute are proportionate to the objectives pursued by that statute and to the means chosen to achieve them. Thus, the Constitution provides the legislature with certain normative content that it itself enunciates, which allows the legislature to construct the remainder of\n\nExpediente: 26-000102-1263-PE (7) - pág.: 21\n\nthe statutory rule on a rational technical basis […] reasonableness forms an integral part of constitutional review in order to ensure that laws do not result in an arbitrary and senseless exercise of public power, but rather respond to genuine needs and motivations […] IV.- […] In the view of the referring judges, the automatic application of the cited Article 110, as a consequence of the commission of the offense typified in Article 254 bis of the Código Penal, could be injurious to the principle of proportionality and reasonableness, since it involves an offense of endangerment that does not justify such application in all cases, as, depending on the circumstances of each proceeding, it could amount to an accessory and practically confiscatory penalty. On this point, the Sala observes that the figure of forfeiture, as defined in Article 110 of the Código Penal, is a civil consequence of the criminal offense aimed at preventing the use of property or instruments for criminal purposes, or the use of property or value derived from the commission of the punishable act, precisely as an additional civil measure that, beyond the criminal sanction itself, serves to psychosocially deter the commission of criminal acts, or to prevent those instruments or assets from being used again in the commission of criminal acts, while in all events preserving the rights that victims or third parties may have. […] the operation of motor vehicles on public roads is an activity that may validly be carried out within the parameters authorized by the legislature and the administration, but there are certain cases of abuse and irresponsible exercise […] Consequently, to interpret Article 110 of the Código Penal as requiring its unrestricted, automatic, and near-mandatory application in conjunction with Article 254 bis of the same Code, without weighing the particularities of each specific case, would certainly produce a confiscatory effect on a movable asset, the vehicle being operated, that may be disproportionate and thereby become an accessory penalty. Indeed, the purpose of forfeiture is to deprive the offending party of the objects with which he caused harm to society, and the intent is to prevent that from happening again; to that end, Article 254 bis itself provides for disqualification, not necessarily the loss of\n\nExpediente: 26-000102-1263-PE (7) - pág.: 22\n\nthe vehicle, while also aggravating the penalty in certain cases […] the legislature itself contemplated that when a prison sentence of three (3) years or less is imposed, the court may substitute the custodial sentence with an alternative measure of public service […] This demonstrates that Article 254 bis establishes many scenarios in which forfeiture could indeed be appropriate, but others in which it becomes unreasonable and disproportionate to the conduct sanctioned, and it is therefore for the Judge to assess each specific case. It is in this sense that the automatic integrated application of the legislation in question is contrary to the principles of reasonableness and proportionality, since, as established, the purpose of Article 110 of the Código Penal is applicable to other criminal offenses distinct from those typified in Article 254 bis of the same Code, but not automatically to those defined therein; this lack of correspondence between the purpose of one provision and what is typified in the other renders unreasonable any application of both provisions jointly, automatically, and without restriction, since, as stated, they involve different regulations and recognitions. Moreover, if Article 254 bis defines the criminal sanction to be imposed for conduct that is not in itself the subject of the purpose intended by Article 110, the joint and automatic application of both provisions produces a disproportionate outcome, precisely because of the coexistence of sanctions that are appropriate to the regulated conduct alongside an additional sanction of a confiscatory nature that neither corresponds to nor addresses the nature of the offense penalized. […] it must be emphasized that the joint application as an automatic and indiscriminate consequence does constitute a violation of the principles of reasonableness and proportionality, and as such would amount to an interpretation and application contrary to Constitutional Law. Furthermore, it must equally be noted that this determination in no way prejudges the constitutional nature of Article 110 of the Código Penal—that is, this ruling is far from addressing the constitutionality of that provision specifically and its application to other criminal offenses in which its unrestricted application in all cases would be appropriate. In sum, the referral is resolved\n\nExpediente: 26-000102-1263-PE (7) - pág.: 23\n\nby finding that the automatic application of Article 110 of the Código Penal concerning forfeiture, with respect to the offense of reckless driving established in Article 254 bis of the Código Penal, is unconstitutional; forfeiture is appropriate only when the court, in a duly reasoned decision, sets out the reasons for its application in the specific case.» (emphasis added).\n\nAs can be seen, the weight of the reasoning in that decision rests not on the type of offense (in that case reckless driving, and here illegal fishing) but on whether or not the measure is automatic, viewed against the principles of proportionality—that is, the gravity of the conduct and the remaining sanction framework applied. In the present case, it was precisely that latter criterion that the trial judge used to reject forfeiture (see, among other points, time marker 1:44:59), noting that while he had imposed the minimum fine, it amounted to several million colones, to which must be added the mandatory cancellation of the fishing license for a person who earned his livelihood from that activity, which constituted sufficient reproach for the conduct of fishing in a protected area for six mojarras—particularly given that there were only six of them—a view with which this court fully concurs. Since the principle of proportionality has constitutional standing, it supersedes the statutory provision providing for forfeiture and takes precedence over it, so that no interpretive errors are identified in that regard. On this point, therefore, the appeal is not well-founded.\n\nWhere the attorney general is correct is in noting that the court did not apply Article 155 of the cited Ley de Pesca y Acuicultura, which provides: «Vessels or boats used in the commission of the unlawful acts typified in this Law shall be liable for the payment of the fines imposed on their occupants or owners for violations of this Law. For those purposes, the judicial office (despacho judicial) hearing the relevant case shall order the Registro de Bienes Muebles of the Ministerio de Justicia to enter a judicial lien (gravamen judicial) on the vessel involved in the unlawful acts. The judicial office shall likewise immediately notify the relevant port authorities of this circumstance so that they may take the corresponding precautions regarding departures (zarpes) and other effects.» (emphasis added). The judgment made no mention of this matter, so the provision was entirely omitted. However, no nullity or remand is appropriate here, since, as this is an appeal by the public prosecutor (querellante) rather than by the defense, the principle prohibiting reformatio in peius is not implicated. Since that provision is a mandatory statutory requirement in which there is no discretion as to whether or not to apply it (note the mandatory language of the rule), a remand could lead to only one outcome and would not affect the defendant's right to a remedy, which he in any event retains before the cassation court. Accordingly, in observance of the principle of procedural economy (economía procesal), the proper course is to supplement the judgment by ordering that lien on the vessel to be entered with the Registro de Bienes Muebles of the Ministerio de Justicia and that the relevant port authorities be notified. Nor should the order for return of the vessel, which the trial judge included in the judgment, be revoked, since such return is not incompatible with the registration of the notation in question. Indeed, the trial judge allowed the registered owner three months to produce documentation evidencing title to the vessel and engine, and if that period were to elapse without his doing so, forfeiture would then proceed pursuant to the Ley de Bienes Caídos en Comiso; but the delivery of the vessel to its owner, as stated, is not incompatible with the registration entry\n\n...encumbrance (gravamen), nor does the notification to the port authorities—whose purpose is for those authorities to take precautionary measures regarding vessel departures (zarpes), which entails the possibility of navigation under certain conditions—constitute one. Therefore, from this court, the addition indicated shall be made.\n\nIn conclusion, sentencia 201-2026, handed down at 15:40 hours on the sixth of May 2026, shall be supplemented to provide that the vessel \"[...]\" bearing registration number [Valor 002], fitted with a 20 hp four-stroke engine serial number 75818BB, shall be recorded in the Registry of Movable Property (Registro de Bienes Muebles) of the Ministry of Justice as security for payment of the fine imposed herein. To that end, notice shall be given to the respective port authorities so that they may take the corresponding measures with respect to vessel departures and other matters. Once the fine has been paid, the annotation and said notice shall cease.
