Integran el Tribunal las juezas Maureen Sancho González, Laura Chinchilla Rojas y el juez Christian Fernández Mora. Se apersonó en sede de apelación la licenciada Ana Laura Sánchez Bertarioni como defensora pública del imputado únicamente.\n\nRESULTANDO\n\nI.- Que mediante sentencia número 52-2026 del Tribunal Penal del Segundo Circuito Judicial de la Zona Sur, Corredores, sección Flagrancia, se dispuso: “P.O.R…..T.A.N.T.O Conforme a lo expuesto, artículos 39 y 41 de la Constitución Política, 8 inciso 2° de la Convención Americana de Derechos Humanos, 14 del Pacto Internacional de Derechos Civiles y Políticos; 1, 11, 18, 20, 30, 31, 45, 50, 51, 71 a 74 del Código Penal, 61 inciso d) de la Ley Forestal, 1, 2, 3, 42, 43, 142 y siguientes, 324 y siguientes, 360, 361, 363, 364, 365 y 367 del Código Procesal Penal, se declara a [Nombre 001] autor único y responsable del delito de Infracción A La Ley Forestal, En La Modalidad De Transporte Ilegal De Recurso Forestal, cometido en perjuicio de Los Recursos Naturales, imponiéndosele por esos hechos la pena de UN MES DE PRISION, que deberá descontar en el lugar y forma que determinen los reglamentos carcelarios. No concede ningún beneficio, ni conmutación, ni arresto domiciliario ni monitoreo electrónico por no ser limpio de antencedentes. Se ordena la devolución definitiva del vehículo automotor color blanco placa [Valor 001] marca HYUNDAI con su gata, respectivos triangulos, llave rana, machetes, llantas de repuestos y documentos todo descrito a folio 19. Firme el fallo, inscríbase en el Registro judicial, al Juez de Ejecución de la Pena, Archivo Criminal. Mediante Lectura Notifíquese” [redacción, ortografía y énfasis se transcriben textualmente de su original].\n\nII.- Que, contra el fallo indicado, la licenciada Ana Laura Sánchez Bertarioni, defensora pública del imputado, interpuso recurso de apelación. \n\nIII.- Mediante resolución de las 07:38 horas del 02 de marzo de 2026, el Tribunal Penal del Segundo Circuito Judicial de la Zona Sur, Corredores, sección Flagrancia Cartago; emplazó a las partes acerca del recurso de apelación interpuesto.\n\nIV.- Realizada la deliberación de ley según lo dispuesto en el numeral 465 del Código Procesal Penal, esta Cámara se planteó las cuestiones formuladas en el recurso.\n\nV.- En los procedimientos se han observado las formalidades y prescripciones de ley.\n\nRedacta la Jueza de Apelación de Sentencia Sancho González;\n\n \n\nCONSIDERANDO\n\nI.- Admisibilidad del recurso. \n\n \n\nAnalizados los parámetros de admisibilidad, el Tribunal verifica que se cumple con los mismos tanto desde la perspectiva objetiva, en virtud de que se trata de un recurso incoado en contra de la sentencia de fondo. Por otro lado, fue interpuesto dentro del plazo de ley —la exposición integral del fallo mediante el dictado de la sentencia de forma oral se llevó a cabo el 29 de enero de 2026 y el libelo de impugnación de la defensora fue presentado el 18 de febrero del mismo año, en el término de quince días hábiles previsto por ley. Además, quien impugna se encuentra legitimada para ello por ser la defensora pública del sindicado, de conformidad con los numerales 458, 459 y 460 del Código Procesal Penal.\n\nII.- Planteamiento del recurso de apelación y resolución.\n\nEn el único motivo de apelación, la recurrente alega “inconformidad con la fundamentación intelectiva y la determinación de los elementos del tipo penal”. Señala que en este proceso se ha discutido la inexistencia de elementos probatorios para la configuración del delito previsto en el artículo 56 de la Ley Forestal, que exige que la madera que se movilice provenga de bosque o de plantación y aduce que, en el sub judice, esa circunstancia no se demostró con prueba documental o testimonial. Agrega que, aunque no se trata de un requerimiento de prueba tasada, se necesitaba —al menos— una certificación de que la madera tenía alguna de esas dos procedencias o que el testigo (a quien no identifica) lo pudiera determinar. Se remite al contenido del canon tercero del mismo cuerpo normativo de cita, que define los conceptos de bosque y plantación, respecto de los cuales señala que es la propia ley la que les otorga una serie de características que hacen que no sea cualquier terreno ni cualquier conjunto de árboles los que se puedan considerar bosque o plantación, sino que cada uno de ellos requiere una serie de requisitos que deben ser determinados, por ejemplo, por una persona experta en ingeniería forestal, con lo que en este proceso no se cuenta. Indica que en el fallo, el a quo además condenó por el delito previsto y sancionado en el numeral 61 de esa misma ley y que, para la defensa, tampoco es posible tenerlo por configurado, pues este sanciona en el inciso d): “a quien sustraiga productos forestales de una propiedad privada o del Estado o transporte productos forestales obtenidos en la misma forma” y que, la jueza de instancia interpretó que ello significaba sin contar con los permisos respectivos; pero en su criterio, más bien alude a que se trate de bienes sustraídos y no a un tema de documentación. Desde su perspectiva, el análisis intelectivo del fallo y el ejercicio de adecuación típica de la conducta no fueron debidamente fundamentados, pues debió examinarse con más detalle todos esos elementos dentro del apartado de valoración jurídica. Solicita que se acoja el recurso de apelación y se disponga del reenvío para una nueva sustanciación. Resolución del recurso. Una vez analizada la sentencia venida en alzada de forma integral como lo preceptúa el numeral 459 del Código Procesal Penal —resolución que fue emitida de forma oral y que consta en el archivo multimedia 250001011262PE-29012026013719-2_Multi que se observa agregado al Escritorio Virtual— es preciso iniciar el análisis de los alegatos recursivos puntualizando que al imputado se le condenó por el hecho segundo de la acusación fiscal, el cual la jueza de instancia calificó como un delito de infracción a la Ley Forestal en la modalidad de transporte ilegal de recurso forestal cometido en perjuicio de los recursos naturales, según la resolución, de conformidad con lo establecido en el artículo 61 inciso d) de ese cuerpo normativo. De los hechos acusados por el Ministerio Público, la juzgadora de mérito, tuvo por acreditado solo uno de ellos, concretamente el segundo, que indica: “El día 09 de febrero del año 2025, al ser aproximadamente las 08:05 horas, en el sector de [...], corrdenadas geográficas [Valor 002], el imputado [Nombre 001], transportó de manera ilegal en el vehículo estilo buseta color blanco, placa [Valor 001], modelo 1996, marca Hyundai, sin contar con la documentación necesaria, contraviniendo lo estipulado conforme se establece en el Decreto Ejecutivo número 30494 y el Reglamento a la Ley Forestal, concretamente, para el caso de la movilización de madera aserrada, se requiere la guía de transporte al día, emitida por la Administración Forestal del Estado, o factura debidamente acreditada de una industria de productos forestales” (la ortografía y redacción se transcriben de manera textual de la minuta de la sentencia oral visible a folio 112 del expediente). La recurrente no cuestiona en modo alguno la conducta del imputado en el sentido de que fue sorprendido en flagrancia conduciendo un vehículo en el que transportaba productos forestales —madera recién aserrada— sin contar con documento alguno de respaldo, sino que, estima que esa acción no se adecua a la tipicidad del artículo 56 ni del numeral 61 inciso d), ambos, de la Ley Forestal, es decir, no cuestiona el hecho histórico (ni su acreditación con base en la prueba), sino que sostiene que el evento demostrado no configura delito alguno. El artículo 56 que invoca preceptúa: “Movilización de madera. No se podrá movilizar madera en trozas, escuadrada ni aserrada proveniente de bosque ni de plantación, si no se cuenta con la documentación respectiva”. En criterio de la recurrente, en cuanto a la madera que se le decomisó al sindicado, no existe prueba alguna de que procediera de un bosque o una plantación, que se trata de elementos normativos del tipo que define ese mismo cuerpo legal. Sin embargo, quien apela pierde de vista que el análisis que ha de hacerse en un asunto como el que nos ocupa, no se agota en el contenido del numeral 56 de la Ley Forestal, sino que intervienen otras disposiciones legales que son complementarias como parte de un examen sistemático del ordenamiento jurídico. El precepto del 55 de la ley, indica: “La persona física o jurídica que posea madera en troza, escuadrada o aserrada, para realizar sus actividades, deberá comprobar que el producto forestal está amparado por el respectivo permiso de aprovechamiento cuando proceda o bien, demostrar su procedencia, cuando la Administración Forestal del Estado lo solicite”. Por su parte, el Reglamento a la Ley Forestal n° 25721, en el numeral 2 inciso t), establece qué se entiende por producto forestal y lo define como: “toda troza, madera en bloc, enchapados, aglomerados, fósforos, pulpa, paletas, palillos, astillas, muebles, puertas, marcos de ventanas y molduras”. Asimismo, los artículos 30, 31 y 32, regulan todo lo relativo al transporte de manera, y al respecto, indican: 30) “En el certificado de origen a que se refiere el artículo 31 y 55 de la Ley Forestal deberá certificarse la existencia de una plantación forestal o un sistema agroforestal en determinada finca, e indicarse el área plantada, el número de árboles, las especies, la ubicación, el nombre del propietario o propietaria. Este certificado único para cada finca, o área a explotar, será expedido por una única vez previo a la movilización de la madera ya sea en troza o aserrada y deberá entregarse copia a la A.F.E. Para efectos de control en el transporte una vez entregada la copia del Certificado de Origen a la A.F.E., el propietario o propietaria tendrá derecho sin ningún requisito adicional y en el acto, a un número proporcional de guías de transporte de acuerdo al área reforestada ó volumen a extraer que serán llenadas por el propietario o propietaria cada vez que transporte madera, y deberán ser entregadas al centro de industrialización primaria para respaldar la procedencia. La A.F.E. vía resolución administrativa establecerá los requisitos mínimos que deberá contener la guía de transporte. Toda persona física o jurídica que tenga integrada su materia prima proveniente de plantaciones forestales o sistemas agroforestales a una industria forestal, podrá acogerse si lo desea a un sistema alternativo para las guías de transporte. Este sistema consiste en un emblema permanente en forma de triángulo que debe colocarse en la parte trasera de la carga. El Director del A.C. en acuerdo con los productores o productoras, establecerán las características que contendrá y el número de identificación requerido para cada productor o productora. La elaboración y costo del emblema correrá por cuenta del administrado” 31) “Para movilizar madera en troza, en bloc o escuadrada, no comprendidos en el artículo anterior, deberá contarse con un distintivo y una guía de transporte emitida por la A.F.E., por el regente, por el encargado de la Municipalidad o el Consejo Regional Ambiental cuando corresponda. La A.F.E. vía resolución administrativa establecerá los requisitos mínimos que deberá contener la guía. Será responsabilidad del A.C., del Regente, del profesional forestal, del responsable de la municipalidad y del Consejo Regional Ambiental, según corresponda, la edición y entrega al titular del permiso o plan de manejo de las correspondientes guías, al costo. La guía de transporte únicamente determinará el número de permiso o aprobación del plan de manejo según corresponda, nombre del propietario o propietaria de la finca de la cual proviene. El llenado del resto de la información será responsabilidad del titular del permiso. Las guías de transporte deberán ser entregadas en la industria que procesará o empatará las trozas, debiendo tener registro de las guías recibidas y con ello respaldar la madera recibida y procesada. El distintivo para el transporte de madera en troza será un emblema diseñado y confeccionado por la A.F.E., el cual consiste en una bandera de tamaño visible, la que debe adherirse en la parte posterior de la carga, para cada viaje que se realice. En la elaboración del emblema se tomará en consideración elementos que garanticen seguridad en su uso. Para cada A.C. se tendrá designado un color y debe consignarse el nombre del A.C. Este emblema será entregado al costo a los administrados, a los regentes y a los consejos regionales. Las banderas tendrán una numeración para cada A.C. y deberán ser entregadas en la industria que procesará o empatará las trozas. En caso de que no exista disponibilidad de los emblemas a que hace referencia este artículo, no será requisito para el transporte de la madera” 32) “Sin perjuicio de lo establecido en el artículo anterior, cuando se transporte madera aserrada deberá respaldarse con una factura autorizada, de venta o de aserrío. Salvo cuando se aserre directamente por el propietario o propietaria de la madera en cuyo caso deberá aportar el certificado de origen que compruebe su legitimidad. La interpretación armoniosa de todas estas normas permite concluir que toda persona que transporte madera tiene un deber legal de demostrar su origen, ya que existe una presunción pro natura que implica que todo árbol que se transporte (en cualquiera de sus presentaciones) debe contar con un certificado de origen (o documento o factura que garantice la trazabilidad), sea que estén o no relacionados con un bosque o una plantación, dado que la tutela al medio ambiente implica que uno solo de ellos, independientemente de su origen, tienen esa protección. Esto termina de entenderse cuando se analiza el decreto ejecutivo número 30494-MINAE-MOPT-SP que determina los documentos necesarios para el transporte de madera por vías públicas terrestres en el territorio nacional —que es el que contempla la acusación fiscal—, el cual describe en su primer artículo el tipo de documento que se requiere por parte de cualquier transportista para movilizar madera según su procedencia:\n\nOrigen\n\n \n\nTipo\n\n \n\nDocumentación necesaria\n\n \n\nBosque natural*\n\n \n\nMadera en troza\n\n \n\nGuía de transporte y una placa en cada una de las trozas\n\n \n\nPlantaciones forestales\n\n \n\nMadera en troza, escuadrada o aserrada\n\n \n\nCertificado de origen o la respectiva de Guía, de Transporte de madera emitida por el regente forestal (distintivos de los medios de transporte se aplicarán de acuerdo al artículo noveno de este decreto)\n\n \n\nSistemas agroforestales*\n\n \n\nMadera en troza\n\n \n\nGuía de transporte y una placa color anaranjada en cada una de las trozas.\n\n \n\nTerrenos de uso agropecuario y sin bosque*\n\n \n\nMadera en troza\n\n \n\nGuía de transporte y una placa color amarillo en cada una de las trozas.\n\n \n\nCentro de industrialización primaria, aserraderos portátiles. No aplica para la industria de plantaciones.\n\n \n\nMadera en troza escuadrada o aserrada\n\n \n\nFactura de compraventa, o del servicio de aserrío debidamente autorizada por la Dirección General de Tributación Directa y con el detalle del impuesto de ventas. La factura deberá identificar claramente al comprador y al vendedor de la madera.\n\n \n\nSi se trata de madera aserrada \"in situ\", deberá aportar la guía de transporte para madera aserrada más la factura de aserrío, salvo que se trate del propietario de la finca, en cuyo caso debe portar la guía de transporte emitida por la AFE.\n\n \n\nSe colige de lo anterior que todo árbol en el territorio nacional se encuentra protegido independientemente de su origen. En este mismo proceso, ya esta Cámara con otra integración (Gutiérrez C.; Mairena N. y Robleto G.), en la resolución 468-2025 de las 11:00 horas del 23 de septiembre de 2025 había indicado que: “[e]n consecuencia, sostener que solo es punible el transporte de madera si se demuestra que procede de un bosque o de una plantación forestal en los términos del artículo 3 es incorrecto. Es claro, conforme todo lo expuesto, que el transporte de madera constituye delito cuando se realiza sin la documentación necesaria, exigencia aplicable con independencia de que el producto provenga de bosque o de una plantación en sentido amplio, incluida la plantación forestal del art. 3, inc. f) o árboles plantados en propiedad privada, incluso individualmente. Esta obligación, fundada en una interpretación sistemática orientada a la tutela integral del recurso forestal, obedece a que el transporte es una fase esencial del aprovechamiento y la comercialización; por ello el Poder Legislativo instauró un control que garantice la procedencia lícita, evitando que una mera afirmación del transportista, que indique que la madera no proviene de bosque o de plantación agroforestal, sea suficiente para excluir el control de lo que se tala”. En consecuencia, el transporte de madera sin contar con los documentos que acrediten su procedencia constituye delito, como bien lo determinó la sentencia venida en alzada, misma que logró acreditar que el justiciable fue detenido en flagrancia cuando trasladaba varias trozas de madera recién aserrada en un vehículo por vía pública. Así lo ha entendido la Sala Tercera de la Corte Suprema de Justicia en la resolución n° 2014-01043 de las 10:13 horas del 27 de junio de 2014: “Considera esta Sala, que, con base en la lectura integrada de estas normas, debe interpretarse que, la madera cortada de plantaciones, como la del presente caso, no requerirán permiso de corta, transporte, industrialización ni exportación, de acuerdo con el artículo 28 de la Ley Forestal. Sin embargo, ello no exime al propietario de la madera y al transportista, de portar consigo los documentos que acrediten el origen de dicha madera, tal como lo ordena el artículo 31 del mismo cuerpo legal, siendo a esa documentación a la que se refiere el artículo 56. Debe tenerse claro que, si bien no se requiere permiso estatal para cortar o trasportar la madera, sí se exige la expedición de un CED1 para que circule de un sitio a otro, ello con el fin, como es lógico suponer, de garantizar la procedencia legítima de la madera y ello es así porque, además de las plantaciones forestales definidas expresamente por la ley, existen otras formas de plantación de especies maderables cuya conservación y protección también están contempladas dentro del ámbito de protección de la ley, que al efecto indica en su artículo primero: “La presente ley establece, como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables”. Ahora, en lo que lleva razón la recurrente es en que la jueza de instancia hizo una incorrecta aplicación de la norma de fondo, pues señaló que el hecho probado se enmarcaba en lo estipulado en el numeral 61 inciso d) de esa regulación legal, por lo que es necesario remitirse al contenido de la norma que dispone: “Se impondrá prisión de un mes a tres años a quien: a) Aproveche uno o varios productos forestales en propiedad privada, sin el permiso de la Administración Forestal del Estado, o a quien, aunque cuente con el permiso, no se ajuste a lo autorizado. b) Adquiera o procese productos forestales sin cumplir con los requisitos establecidos en esta ley. c) Realice actividades que impliquen cambio en el uso de la tierra, en contra de lo estipulado en el artículo 19 de esta ley. En los casos anteriores, los productos serán decomisados y puestos a la orden de la autoridad judicial competente. d) Sustraiga productos forestales de una propiedad privada o del Estado o transporte productos forestales obtenidos en la misma forma”. A la altura del contador 33:41 de la sentencia oral, según se corrobora en el archivo multimedia de cita, al respecto indicó el tribunal: “pues lo que ya en este caso, pues este tribunal está encontrando como una acción puramente probada, circunstanciada, donde efectivamente, ya propiamente el 9 de febrero de este del año 2025, en horas de la mañana, pues efectivamente, ya usted conducía en este caso el vehículo, el vehículo placa [Valor 001], modelo 1966, marca Hyundai, color blanco; esto contraviniendo propiamente, pues, lo que establece la Ley Forestal. ¿Y qué es lo que establece la Ley Forestal? Don Elvin, dice artículo 61 y propiamente nos vamos a ir al inciso, al inciso d, dice: prisión de un mes a 3 años —y viene una serie de incisos—, pero el último dice: “sustraiga productos forestales de una propiedad privada o del Estado o transporte, productos forestales obtenidos en la misma forma”; y ¿cómo es obtenidos en la misma forma?, bueno, obtenidos sin el permiso de la administración forestal del Estado, eso es lo que quiere decir esto” (la transcripción es fiel y el énfasis propio). Según quien apela, la acción no se adecua a la tipicidad de la norma de cita (61 inciso d) porque cuando esta alude al transporte de productos forestales “obtenidos de la misma forma”, debe interpretarse esa expresión con la primera parte del inciso, es decir, que lo que se sanciona es el transporte de productos forestales sustraídos, no su traslado sin permiso o factura. En efecto, debe darse razón a la defensora del sindicado en cuanto a que el inciso d) del artículo 61 lo que sanciona es la sustracción de productos forestales o su transporte a sabiendas de que se trata de tales (es decir, aún si quien los traslada, no participó de su desapoderamiento) y no alude a la existencia o no de los permisos que el Estado debe otorgar para movilizar madera de un lugar a otro de manera legal. Ahora bien, no significa que el hecho probado (que se reitera, no se cuestiona en cuanto a su determinación fáctica), sea impune o atípico, pues la conducta demostrada se encuadra en lo estipulado en el artículo 63 de la Ley Forestal, que sanciona con prisión de un mes a un año a quien: “a) Contravenga lo dispuesto en el artículo 56 de esta ley”. Así las cosas, aunque ciertamente se dio un yerro en la aplicación de la norma de fondo por parte de la jueza de instancia, esta Cámara, con fundamento en lo que dispone el artículo 465 del Código Procesal Penal cuando estipula: “Si el tribunal de apelación estima procedente el recurso, anulará total o parcialmente la resolución impugnada y ordenará la reposición del juicio o de la resolución. Cuando la anulación sea parcial, se indicará el objeto concreto del nuevo juicio o resolución. En los demás casos, enmendará el vicio y resolverá el asunto de acuerdo con la ley aplicable669477839 ”669477839 ; revoca la resolución venida en alzada y recalifica los hechos probados como un delito de transporte ilegal de madera de conformidad con lo establecido en el artículo 63 inciso a) en relación con el 56 de la Ley Forestal. En virtud de que tanto la norma aplicada por la jueza penal de instancia como la que está determinando este tribunal de alzada que es la aplicable al caso concreto contienen el mismo extremo punitivo en su mínimo impositivo, que al imputado se le impuso el extremo menor de la pena contenido en el numeral erróneamente aplicado por la juzgadora de mérito y que solo la defensa apeló (por lo que no podría modificarse la condición del sindicado en virtud del principio de no reforma en perjuicio), se mantiene el quantum sancionatorio impuesto de un mes de prisión, ya que en un juicio de reenvío ese monto se mantendría invariable dadas las circunstancias esbozadas. \n\nIII.- Voto salvado del juez Fernández Mora: En el presente asunto debo manifestar mi disenso con la mayoría en virtud de que estimo que debe dársele la razón a la recurrente en relación con que los hechos acusados por el Ministerio Público son penalmente atípicos. Ello obedece a que el tipo penal de transporte o movilización ilegal de madera, previsto en los artículos 63 inciso a) y 56 de la Ley Forestal, supedita la configuración de la tipicidad únicamente a aquellos supuestos en que pueda acreditarse que la madera transportada proviene de un bosque o de una plantación forestal. En ese sentido, el delito en cuestión se encuentra regulado mediante un tipo penal abierto, pues el artículo 63 inciso a) sanciona con pena de prisión de un mes a un año a quien: “a) Contravenga lo dispuesto en el artículo 56 de esta ley…”, mientras que dicho numeral 56 dispone: “No se podrá movilizar madera en trozas, escuadrada ni aserrada provenientes de bosque ni de plantación, si no se cuenta con la documentación respectiva”. De ello se desprende que la configuración del ilícito únicamente puede producirse cuando se moviliza, sin la documentación exigida por la Administración Forestal del Estado, madera proveniente de un bosque o de una plantación forestal, mas no cuando la madera tiene un origen distinto, como podría ser un sistema agroforestal, una finca de repasto, árboles plantados individualmente, un aserradero, un establecimiento comercial o cualquier otra fuente lícita, como la venta o donación realizada por un particular. Tales supuestos constituyen conductas penalmente atípicas debido a una deficiente técnica legislativa que transformó “…una de las armas más eficientes que existían para el control de la deforestación y que resultó en un rotundo fracaso por un problema de redacción, que fue inadvertido o deliberado” (González Montero, José Pablo (2007). Manual de delitos ambientales. San José, C.R.: Litografía e Imprenta LIL, S.A., p. 294). En efecto, la remisión expresa efectuada por el artículo 63 de la Ley Forestal a las exigencias contenidas en el artículo 56 impide apartarse de la descripción normativa allí prevista, la cual sanciona únicamente la contravención de la prohibición de movilizar, sin la documentación correspondiente, madera proveniente de bosque o de plantación, conceptos que constituyen categorías normativas definidas por la propia Ley Forestal. Así, el artículo 3 de dicho cuerpo legal define el bosque como un: “Ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del setenta por ciento (70%) de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro medido a la altura del pecho (DAP)”, mientras que respecto de la plantación forestal dispone que consiste en un: “Terreno de una o más hectáreas, cultivado de una o más especies forestales cuyo objetivo principal, aunque no único, será la producción de madera”. En igual sentido, la doctrina nacional ha señalado que: “El delito de movilización ilegal de productos forestales se aplica únicamente a los árboles provenientes de bosque o plantación. En efecto, en el análisis de tipicidad se concluyó que el legislador, consciente o inconscientemente, despenalizó el transporte de madera proveniente de cualquier terreno que no sea bosque o plantación. Por tanto, quedan excluidos de la aplicación de este delito los árboles transportados provenientes de fincas de repasto, de potreros o de cualquier otro terreno. Lo anterior no significa que no se puedan perseguir los delitos de tala ilegal de los árboles que se transportan, aunque no se pueda perseguir el delito de transporte” (González Montero, José Pablo (2007). Manual de delitos ambientales. San José, C.R.: Litografía e Imprenta LIL, S.A., p. 300). En consecuencia, la determinación del lugar de procedencia de la madera constituye un requisito indispensable para establecer la tipicidad del delito previsto en el artículo 63 inciso a) de la Ley Forestal, pues solo de esa manera puede verificarse el cumplimiento del elemento normativo consistente en que la madera movilizada sin la documentación exigida por la Administración Forestal del Estado provenga de un bosque o de una plantación forestal, circunstancia que en el presente caso no logró acreditarse en la sentencia recurrida de forma alguna. Estimo, además, que resulta equivocado el criterio sostenido por la Sección Segunda de esta Cámara en el voto n.° 2025-468 de las 11:00 horas del 23 de septiembre de 2025, mediante el cual se ordenó el juicio de reenvío en esta causa, pues no es jurídicamente admisible interpretar que el término “plantación”, empleado por el artículo 56 de la Ley Forestal, comprenda incluso “un solo árbol plantado”. Una interpretación de esa naturaleza vaciaría de contenido las definiciones establecidas en el artículo 3 de la propia ley, tornando superflua la diferenciación efectuada por el legislador entre las distintas categorías de protección del recurso forestal, tales como bosque, plantación forestal, plan de manejo, régimen forestal, área silvestre protegida o áreas de recarga acuífera, entre otras. Asimismo, supondría una expansión del ámbito de persecución penal incompatible con el principio de mínima intervención del Derecho Penal, pues si “plantación” se entendiera como un término genérico y no como un concepto técnico-jurídico, incluso la persona que poda las ramas de un árbol sembrado individualmente en el patio de su casa y posteriormente las transporta para desecharlas podría ser responsabilizada por el delito de movilización ilegal de madera. Ello porque, si conforme al inciso a) del artículo 3 de la Ley Forestal el aprovechamiento maderable comprende toda utilización de árboles susceptible de generar un provecho, beneficio, utilidad o ventaja, incluso la leña obtenida de dichas ramas podría ser considerada «madera» y, por ende, requerir documentación para su transporte, conclusión que resulta manifiestamente absurda. Es evidente que el error legislativo antes señalado, reconocido además por la doctrina especializada, genera consecuencias que frustran los fines perseguidos por la Ley Forestal en la protección del patrimonio natural del Estado. Sin embargo, no resulta jurídicamente admisible que ese defecto normativo pretenda ser corregido mediante la jurisprudencia, pues tanto la responsabilidad de subsanarlo como la potestad para hacerlo corresponden exclusivamente al Poder Legislativo y no al Poder Judicial, al que únicamente compete aplicar el ordenamiento jurídico vigente al resolver los asuntos sometidos a su conocimiento, conforme a los principios de legalidad, separación de poderes y reserva de ley consagrados en los artículos 1, 9, 105 y 153 de la Constitución Política. Por tales razones, considero que lo procedente es acoger el recurso interpuesto por la defensora pública del justiciable y, por razones de economía procesal, revocar la sentencia impugnada, absolver al encartado de toda pena y responsabilidad por los hechos que se le atribuyen en este proceso y ordenar la devolución del vehículo decomisado a quien demuestre tener mejor derecho sobre este.\n\nPOR TANTO\n\n1.- Se admite para su estudio el recurso de apelación interpuesto por la licenciada Ana Laura Sánchez Bertarioni, defensora pública del imputado.\n\n2.- Se declara parcialmente con lugar el recurso. En consecuencia, se recalifican los hechos probados de la sentencia como un delito de transporte ilegal de madera de conformidad con lo establecido en el artículo 63 inciso a) en relación con el 56 de la Ley Forestal. \n\n3.- Se mantiene el quantum sancionatorio de un mes de prisión por tratarse del mínimo legal imponible y en aplicación del principio de no reforma en perjuicio.\n\n4.- En lo demás, permanece incólume el fallo. \n\n5.- El juez Fernández Mora salva el voto. Notification by reading.\" [Spelling, grammar, and emphasis are transcribed verbatim from the original].\n\nII.- Against the aforementioned judgment, Attorney Ana Laura Sánchez Bertarioni, public defender of the defendant, filed an appeal (recurso de apelación).\n\nIII.- By resolution issued at 07:38 hours on March 2, 2026, the Criminal Court of the Second Judicial Circuit of the Southern Zone, Corredores, Flagrante Delicto Section, Cartago, notified the parties regarding the appeal filed.\n\nIV.- Following the deliberation required by law pursuant to article 465 of the Code of Criminal Procedure, this Chamber considered the issues raised in the appeal.\n\nV.- All legally required formalities and requirements have been observed in these proceedings.\n\nDrafted by Appellate Judge Sancho González;\n\nCONSIDERING\n\nI.- Admissibility of the appeal.\n\nHaving reviewed the admissibility criteria, the Court finds that they are met both from an objective standpoint — given that this is an appeal filed against a final judgment on the merits — and from a subjective standpoint. The appeal was filed within the statutory time limit: the full oral delivery of the judgment took place on January 29, 2026, and the appellant's brief was submitted on February 18 of the same year, within the fifteen business days provided by law. Furthermore, the appellant has standing to appeal as the public defender of the accused, in accordance with articles 458, 459, and 460 of the Code of Criminal Procedure.\n\nII.- Statement of the appeal and resolution.\n\nIn the sole ground of appeal, the appellant alleges \"disagreement with the intellectual reasoning (fundamentación intelectiva) and the determination of the elements of the criminal offense (tipo penal).\" She argues that this case has involved a dispute over the absence of evidentiary elements needed to establish the offense set forth in article 56 of the Ley Forestal, which requires that the timber being transported originate from a forest (bosque) or a plantation (plantación), and contends that, in the matter sub judice, that circumstance was not proven by documentary or testimonial evidence. She adds that, while this is not a case requiring formally prescribed proof, at minimum a certification was needed establishing that the timber had one of those two origins, or that a witness (whom she does not identify) could make that determination. She refers to the content of the third provision of that same statute, which defines the concepts of forest and plantation, noting that the law itself attributes to them a series of characteristics such that not just any plot of land or any group of trees may be considered a forest or a plantation — each requires a set of criteria to be established, for example, by an expert in forest engineering, which was not available in this case. She notes that in the judgment the trial judge also convicted the defendant of the offense set forth in article 61 of that same statute, and argues that for the defense this offense also cannot be found established, since its paragraph d) penalizes: \"whoever removes (sustraiga) forest products from private property or from the State, or transports forest products obtained in the same manner\"; and that the trial judge interpreted this as meaning without the requisite permits, whereas in her view the provision instead refers to stolen goods and not to a matter of documentation. In her opinion, the intellectual reasoning of the judgment and the exercise of matching the conduct to the elements of the offense were not adequately reasoned, since all of those elements should have been examined in greater detail within the legal analysis section. She requests that the appeal be granted and a remand (reenvío) ordered for new proceedings.\n\nResolution of the appeal. Having reviewed the appealed judgment in its entirety as required by article 459 of the Code of Criminal Procedure — a judgment delivered orally and contained in the multimedia file 250001011262PE-29012026013719-2_Multi attached to the Virtual Desktop (Escritorio Virtual) — it is necessary to begin the analysis of the appellate arguments by noting that the defendant was convicted on the second count of the prosecution's indictment, which the trial judge characterized as an offense of infringement of the Ley Forestal in the modality of illegal transport of forest resources committed to the detriment of natural resources, pursuant, according to the judgment, to Art. 61 inciso d) of that statute. Of the acts charged by the Public Prosecutor's Office (Ministerio Público), the trial judge found only one proven — specifically the second — which states: \"On February 9, 2025, at approximately 08:05 hours, in the area of [...], geographic coordinates [Valor 002], the defendant [Nombre 001] illegally transported, in a white minibus-style vehicle, license plate [Valor 001], 1996 model, Hyundai brand, without the necessary documentation, in contravention of the provisions of Executive Decree number 30494 and the Reglamento a la Ley Forestal, specifically, in the case of the transportation of sawn timber (madera aserrada), a current transport permit (guía de transporte) issued by the State Forest Administration (Administración Forestal del Estado), or an invoice duly accredited from a forest products industry, is required\" (spelling and grammar transcribed verbatim from the minutes of the oral judgment visible at folio 112 of the case file). The appellant does not in any way challenge the defendant's conduct — namely, that he was caught in flagrante delicto (flagrancia) driving a vehicle in which he was transporting forest products (freshly sawn timber) without any supporting documentation — but rather contends that this conduct does not meet the elements of the offense under article 56 or article 61, paragraph d), both of the Ley Forestal. That is, she does not challenge the historical facts (nor their establishment based on the evidence), but rather maintains that the proven event does not constitute any criminal offense. Article 56, which she invokes, provides: \"Transportation of timber. No timber in logs (madera en trozas), squared (escuadrada), or sawn, originating from a forest or plantation, may be transported without the corresponding documentation.\" In the appellant's view, with respect to the timber seized from the defendant, there is no evidence whatsoever that it originated from a forest or a plantation — elements she characterizes as normative elements of the offense as defined by that same statute. However, the appellant overlooks the fact that the analysis required in a case such as this does not end with the content of article 56 of the Ley Forestal, but is complemented by other legal provisions that form part of a systematic reading of the legal framework. Article 55 of the statute provides: \"Any natural or legal person who possesses timber in logs, squared, or sawn, for use in their activities, must demonstrate that the forest product (producto forestal) is covered by the corresponding harvesting permit (permiso de aprovechamiento) where applicable, or alternatively demonstrate its origin when the State Forest Administration so requests.\" For its part, Reglamento a la Ley Forestal n° 25721, in article 2, paragraph t), defines what is understood by forest product as: \"any log, block timber, veneers, particleboard, matches, pulp, pallets, toothpicks, wood chips, furniture, doors, window frames, and moldings.\" Likewise, articles 30, 31, and 32 regulate all matters relating to timber transport, and state, respectively: 30) \"The certificate of origin (certificado de origen) referred to in articles 31 and 55 of the Ley Forestal must certify the existence of a forest plantation or an agroforestry system (sistema agroforestal) on a given property and must indicate the planted area, the number of trees, the species, the location, and the name of the owner. This certificate, which is unique to each property or area to be exploited, shall be issued only once, prior to the transportation of the timber whether in logs or sawn, and a copy must be delivered to the A.F.E. For transport control purposes, once a copy of the Certificate of Origin has been delivered to the A.F.E., the owner shall be entitled, without any additional requirement and on the spot, to a proportional number of transport permits according to the reforested area or volume to be extracted; these shall be completed by the owner each time timber is transported and must be delivered to the primary processing facility to document the origin of the timber received and processed. The A.F.E., by administrative resolution, shall establish the minimum requirements that the transport permit must contain. Any natural or legal person whose raw material from forest plantations or agroforestry systems is integrated into a forest industry may, if they so choose, opt for an alternative system for transport permits. This system consists of a permanent triangular emblem to be placed at the rear of the load. The Director of the A.C., in agreement with producers, shall establish the characteristics it shall contain and the identification number required for each producer. The production cost of the emblem shall be borne by the regulated party.\" 31) \"To transport timber in logs, block, or squared form not covered by the preceding article, a distinctive marking and a transport permit issued by the A.F.E., the registered forestry professional (regente), the person in charge at the Municipality, or the Regional Environmental Council, as applicable, must be obtained. The A.F.E., by administrative resolution, shall establish the minimum requirements that the permit must contain. The A.C., the forestry professional, the forestry engineer, the person responsible at the municipality, and the Regional Environmental Council, as applicable, shall be responsible for issuing and delivering the corresponding permits to the permit or forest management plan holder, at cost. The transport permit shall specify only the permit number or forest management plan approval number as applicable, and the name of the owner of the property from which the timber originates. Completion of the remaining information shall be the responsibility of the permit holder. Transport permits must be delivered to the industry that will process or join the logs, which must keep a record of the permits received, thereby documenting the timber received and processed. The distinctive marking for log transport shall be an emblem designed and produced by the A.F.E., consisting of a visible-sized flag to be attached to the rear of the load for each trip made. In the production of the emblem, elements ensuring safe use shall be taken into consideration. Each A.C. shall be assigned a color, and the name of the A.C. must appear on the emblem. This emblem shall be delivered at cost to regulated parties, forestry professionals, and regional councils. The flags shall bear a number assigned to each A.C. and must be delivered to the industry that will process or join the logs. In the event that the emblems referred to in this article are unavailable, they shall not constitute a requirement for timber transport.\" 32) \"Without prejudice to the provisions of the preceding article, when sawn timber is transported it must be supported by an authorized bill of sale or sawmill service invoice. Except where the timber is sawn directly by the timber owner, in which case the owner must provide the certificate of origin demonstrating its legitimacy.\"\n\nThe consistent reading of all these provisions leads to the conclusion that every person who transports timber has a legal duty to demonstrate its origin, since a pro natura presumption applies — meaning that any tree transported (in any of its forms) must be accompanied by a certificate of origin (or a document or invoice establishing traceability), regardless of whether it is associated with a forest or a plantation, given that environmental protection means that even a single tree, irrespective of its origin, carries that protection. This conclusion becomes fully apparent when one examines Executive Decree number 30494-MINAE-MOPT-SP, which sets out the documents required for the transport of timber on public roads in the national territory — the decree referenced in the prosecution's indictment — and which describes in its first article the type of documentation required from any timber carrier according to the origin of the timber:\n\n| Origin | Type | Required Documentation |\n| --- | --- | --- |\n| Natural forest* | Timber in logs | Transport permit and one plate on each log |\n| Forest plantations | Timber in logs, squared, or sawn | Certificate of origin or the corresponding timber Transport Permit issued by the registered forestry professional (distinctive markings on means of transport shall apply in accordance with article nine of this decree) |\n| Agroforestry systems* | Timber in logs | Transport permit and one orange-colored plate on each log |\n| Agricultural land and land without forest* | Timber in logs | Transport permit and one yellow-colored plate on each log |\n| Primary processing facilities, portable sawmills. If the timber is sawn \"in situ,\" a transport permit for sawn timber plus a sawmill service invoice must be provided, unless the party is the property owner, in which case a transport permit issued by the AFE must be carried. |\n\nIt follows from the foregoing that every tree in the national territory is protected regardless of its origin. In this same case, this Chamber with a different composition (Gutiérrez C.; Mairena N. and Robleto G.), in resolution 468-2025 issued at 11:00 hours on September 23, 2025, had stated that: \"[i]n consequence, maintaining that the transport of timber is only punishable if it is shown to originate from a forest or a forest plantation within the meaning of article 3 is incorrect. It is clear, from all of the foregoing, that the transport of timber constitutes a criminal offense when carried out without the necessary documentation, a requirement that applies regardless of whether the product originates from a forest or a plantation in the broad sense, including the forest plantation of Art. 3, paragraph f), or trees planted on private property, even individually. This obligation, grounded in a systematic interpretation oriented toward the comprehensive protection of forest resources, is rooted in the fact that transport is an essential phase of harvesting and commercialization; it is for this reason that the Legislature established a control mechanism to guarantee lawful origin, preventing a mere assertion by the carrier that the timber does not come from a forest or an agroforestry plantation from being sufficient to exempt the timber from oversight over what is being felled.\" Accordingly, the transport of timber without documents certifying its origin constitutes a criminal offense, as the appealed judgment correctly determined, having established that the defendant was caught in flagrante delicto transporting several freshly sawn logs in a vehicle on a public road. This has been the understanding of the Sala Tercera of the Supreme Court of Justice in resolution n° 2014-01043 issued at 10:13 hours on June 27, 2014: \"This Chamber considers that, based on a comprehensive reading of these provisions, timber cut from plantations, as in the present case, will not require a permit for felling, transport, industrialization, or export, in accordance with article 28 of the Ley Forestal. However, this does not exempt the timber owner and the carrier from carrying documents certifying the origin of that timber, as ordered by article 31 of that same statute — and it is to that documentation that article 56 refers. It must be understood that, although no state permit is required to cut or transport timber, a CED1 is required for it to circulate from one place to another, in order — as is logically to be assumed — to guarantee the legitimate origin of the timber; and this is so because, in addition to the forest plantations expressly defined by law, there are other forms of plantation of timber species whose conservation and protection are also encompassed within the protective scope of the statute, which states in its first article: 'This law establishes, as an essential and priority function of the State, to ensure the conservation, protection, and administration of natural forests and the production, harvesting, industrialization, and promotion of the country's forest resources designated for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources.'\"\n\nNow, the appellant is correct that the trial judge misapplied the substantive law, since she held that the proven facts fell within the scope of article 61, paragraph d) of that statute; it is therefore necessary to examine the content of that provision, which reads: \"Imprisonment of one month to three years shall be imposed on whoever: a) Harvests one or more forest products on private property without a permit from the State Forest Administration, or who, even holding a permit, does not comply with what was authorized. b) Acquires or processes forest products without meeting the requirements established by this law. c) Carries out activities entailing a land-use change (cambio de uso del suelo), in contravention of the provisions of Art. 19 of this law. In the preceding cases, the products shall be seized and placed at the disposal of the competent judicial authority. d) Removes forest products from private property or from the State, or transports forest products obtained in the same manner.\" At the timestamp 33:41 of the oral judgment, as verified in the aforementioned multimedia file, the trial court stated: \"well, what in this case, this tribunal is finding as a purely proven, circumstantiated action, where effectively, already properly on February 9 of this year 2025, in the morning hours, well effectively, you were driving in this case the vehicle, the vehicle with license plate [Valor 001], 1996 model, Hyundai brand, white; this in contravention properly of what the Ley Forestal establishes. And what does the Ley Forestal establish? Mr. Elvin, it says article 61 and properly we go to the paragraph, paragraph d, it says: imprisonment of one month to 3 years — and there are a series of paragraphs — but the last one says: 'removes forest products from private property or from the State or transports forest products obtained in the same manner'; and how is 'obtained in the same manner'? Well, obtained without the permit of the State Forest Administration, that is what this means\" (the transcription is faithful and the emphasis is the Court's own). According to the appellant, the conduct does not meet the elements of the offense under the cited provision (Art. 61 paragraph d)) because when it refers to the transport of forest products \"obtained in the same manner,\" that expression must be interpreted in light of the first part of the paragraph — that is, what is penalized is the transport of stolen forest products, not their movement without a permit or invoice. Indeed, the public defender of the defendant must be agreed with insofar as paragraph d) of article 61 penalizes the removal of forest products or their transport with knowledge that they were obtained in that manner (that is, even if the carrier did not participate in their unlawful taking (desapoderamiento)) — and does not refer to the existence or absence of the state permits required to lawfully transport timber from one place to another. However, this does not mean that the proven facts (which, it bears repeating, are not challenged as to their factual determination) are unpunishable or non-criminal, since the demonstrated conduct falls squarely within the provisions of article 63 of the Ley Forestal, which imposes imprisonment of one month to one year on whoever: \"a) Contravenes the provisions of article 56 of this law.\" That being so, while there was indeed an error in the application of the substantive law by the trial judge, this Chamber, relying on the provisions of article 465 of the Code of Criminal Procedure — which stipulates: \"If the appellate court finds the appeal meritorious, it shall annul the challenged decision in whole or in part and shall order a new trial or new decision. Where the annulment is partial, the specific subject of the new trial or decision shall be indicated. In all other cases, it shall correct the defect and resolve the matter in accordance with the applicable law669477839 \"669477839 — revokes the appealed judgment and reclassifies the proven facts as the offense of illegal timber transport in accordance with article 63, paragraph a) in relation to article 56 of the Ley Forestal. Given that both the provision applied by the trial judge and the provision that this appellate court determines to be applicable to the specific case carry the same minimum penalty; that the defendant was sentenced to the minimum penalty contained in the provision erroneously applied by the trial judge; and that only the defense appealed (meaning the defendant's situation cannot be worsened by virtue of the principle of non-reformatio in peius (no reforma en perjuicio)), the sentence of one month of imprisonment is maintained, since in a retrial that amount would remain unchanged given the circumstances outlined.\n\nIII.- Dissenting vote (voto salvado) of Judge Fernández Mora: In the present matter, I must express my dissent from the majority, as I am of the view that the appellant should prevail on the ground that the facts charged by the Ministerio Público do not constitute criminal offenses (son penalmente atípicos). This is because the criminal provision (tipo penal) governing the illegal transport or movement of timber, set forth in Article 63, paragraph a), and Article 56 of the Ley Forestal, conditions the fulfillment of the statutory elements of the offense (tipicidad) exclusively upon those circumstances in which it can be established that the timber transported originates from a forest (bosque) or a forest plantation (plantación forestal). In this regard, the offense in question is governed by an open-ended criminal provision (tipo penal abierto), since Article 63, paragraph a) imposes a prison sentence of one month to one year on anyone who: \"a) Contravenes the provisions of Article 56 of this law…\", while said Article 56 provides: \"Timber in the form of logs (trozas), squared (escuadrada), or sawn (aserrada) originating from a forest or plantation may not be moved without the corresponding documentation.\" From this it follows that the offense can only be constituted when timber originating from a forest or a forest plantation is moved without the documentation required by the State Forestry Administration (Administración Forestal del Estado), but not when the timber has a different origin, such as an agroforestry system (sistema agroforestal), a grazing farm (finca de repasto), individually planted trees, a sawmill (aserradero), a commercial establishment, or any other lawful source, such as a sale or donation made by a private individual. Such circumstances constitute conduct that lacks the statutory elements of a criminal offense, owing to deficient legislative drafting (técnica legislativa) that transformed \"…one of the most effective tools that existed for controlling deforestation, which resulted in a complete failure due to a drafting problem that was either inadvertent or deliberate\" (González Montero, José Pablo (2007). Environmental Crimes Manual [Manual de delitos ambientales]. San José, C.R.: Litografía e Imprenta LIL, S.A., p. 294). Indeed, the express cross-reference made by Article 63 of the Ley Forestal to the requirements set forth in Article 56 precludes any departure from the statutory description therein, which punishes only the violation of the prohibition against moving, without the corresponding documentation, timber originating from a forest or a forest plantation — concepts that constitute normative categories defined by the Ley Forestal itself. Thus, Article 3 of that body of law defines a forest as: \"A native or indigenous ecosystem, whether intervened or not, regenerated through natural succession or other forestry techniques, covering an area of two or more hectares, characterized by the presence of mature trees of different ages, species, and varying stature, with one or more canopy layers (doseles) covering more than seventy percent (70%) of that area and where more than sixty trees per hectare exist with a diameter of fifteen or more centimeters measured at breast height (DAP)\", while regarding a forest plantation it provides that it consists of: \"Land of one or more hectares, cultivated with one or more forest species whose primary objective, though not the only one, shall be the production of timber.\" In the same vein, national legal scholarship has noted that: \"The offense of illegal movement of forest products applies only to trees originating from a forest or plantation. Indeed, in the analysis of the statutory elements it was concluded that the legislature, consciously or unconsciously, decriminalized the transport of timber originating from any land that is not a forest or plantation. Therefore, trees transported from grazing farms (fincas de repasto), pastures (potreros), or any other type of land are excluded from the application of this offense. This does not mean that the offenses of illegal felling (tala ilegal) of the trees being transported cannot be prosecuted, even though the transport offense cannot be prosecuted\" (González Montero, José Pablo (2007). Environmental Crimes Manual [Manual de delitos ambientales]. San José, C.R.: Litografía e Imprenta LIL, S.A., p. 300). Consequently, determining the place of origin of the timber constitutes an indispensable requirement for establishing the statutory elements of the offense set forth in Article 63, paragraph a) of the Ley Forestal, since only in that manner can the normative element be verified — namely, that the timber moved without the documentation required by the State Forestry Administration originates from a forest or a forest plantation — a circumstance that in the present case was not established in any way in the judgment under appeal. I further consider it erroneous to adopt the position taken by the Second Section of this Chamber in vote n.° 2025-468 of 11:00 hours of 23 de septiembre de 2025, by which a retrial (juicio de reenvío) was ordered in this case, since it is not legally admissible to interpret the term \"plantation,\" as used by Article 56 of the Ley Forestal, as encompassing even \"a single planted tree.\" An interpretation of this nature would hollow out the definitions established in Article 3 of the law itself, rendering superfluous the distinction drawn by the legislature among the various categories for the protection of the forest resource, such as forest, forest plantation, forest management plan (plan de manejo), forestry regime (régimen forestal), protected wildlife area (área silvestre protegida), or aquifer recharge areas (áreas de recarga acuífera), among others. It would likewise entail an expansion of the scope of criminal prosecution that is incompatible with the principle of minimum intervention (principio de mínima intervención) in Criminal Law, since if \"plantation\" were understood as a generic term rather than a technical legal concept, even a person who prunes the branches of a single tree planted in his or her backyard and subsequently transports them for disposal could be held liable for the offense of illegal timber transport. This is because, if pursuant to Article 3, paragraph a) of the Ley Forestal, timber harvesting (aprovechamiento maderable) encompasses any use of trees capable of generating a profit, benefit, utility, or advantage, even the firewood obtained from such branches could be considered \"timber\" and, consequently, require documentation for its transport — a conclusion that is manifestly absurd. It is evident that the aforementioned legislative error, also acknowledged by specialized legal scholarship, produces consequences that frustrate the purposes pursued by the Ley Forestal in protecting the natural heritage of the State. However, it is not legally admissible for this normative defect to be corrected through case law, since both the responsibility for remedying it and the authority to do so belong exclusively to the Legislative Branch (Poder Legislativo) and not to the Judicial Branch (Poder Judicial), which is solely competent to apply the existing legal order when resolving the matters submitted to its jurisdiction, in accordance with the principles of legality (principio de legalidad), separation of powers (separación de poderes), and legal reservation (reserva de ley) enshrined in Articles 1, 9, 105, and 153 of the Constitución Política. For these reasons, I am of the view that the appropriate course of action is to grant the appeal filed by the public defender (defensora pública) of the defendant (justiciable) and, on grounds of judicial economy (economía procesal), to overturn the impugned judgment, acquit the accused (encartado) of all penalty and liability for the facts attributed to him in these proceedings, and order the return of the seized (decomisado) vehicle to whoever can demonstrate a superior right thereto.\n\nPOR TANTO\n\n1.- The appeal (recurso de apelación) filed by Licenciada Ana Laura Sánchez Bertarioni, public defender of the accused, is admitted for consideration.\n\n2.- The appeal is partially granted. Consequently, the proven facts of the judgment are reclassified as the offense of illegal timber transport pursuant to the provisions of Article 63, paragraph a), in relation to Article 56 of the Ley Forestal.\n\n3.- The sentencing quantum (quantum sancionatorio) of one month of imprisonment is maintained, as it represents the minimum legally imposable penalty and in application of the principle of non-aggravation (principio de no reforma en perjuicio).\n\n4.- In all other respects, the judgment remains unaltered.\n\n5.- Judge Fernández Mora files a dissenting vote.
