A las nueve horas con cinco minutos del veintisiete de julio del dos mil veintiséis. \n\nCausa número 26-000131-1262-PE seguida contra [Nombre 001], [...] ; por el delito de INFRACCIÓN A LA LEY DE PESCA Y ACUICULTURA en perjuicio de LOS RECURSOS NATURALES. Integran el Tribunal los jueces Jaime Robleto Gutiérrez, Marco Mairena Navarro, así como la jueza Xiomara Gutiérrez Cruz. Se apersono en sede de apelación el encartado [Nombre 001] y;\n\n \n\n RESULTANDO:\n\n \n\n I.- Que mediante sentencia número 186-2026 del Tribunal de Flagrancia del Segundo Circuito Judicial de la Zona Sur, Sede Corredores de las 13:30 horas del 16 de abril de 2026, se dispuso: \"POR TANTO : En virtud de lo expuesto, artículos 39 y 41 de la Constitución Política, 1, 6, 9, 12, 363, 365, 367, 373, 374, 375 del Código Procesal Penal, 1, 30, 31, 45, 50, 71, 73 , 110, 103 del Código Penal y los artículos 134 y 136 de la La Ley de Pesca y Acuicultura se declara a [Nombre 001], autor responsable del delito de INFRACCIÓN A LA LEY DE PESCA Y ACUICULTURA en perjuicio de LOS RECURSOS NATURALES y en tal carácter se le impone la pena de UN SALARIO BASE, que para el momento de los hechos es de CUATROCIENTOS SESENTA Y DOS MIL COLONES,que deberá depositar en la cuenta del Patronato de Construcción, Instalación y Adquisición de Bienes de la Dirección General de Adaptación Social Cuenta Banco Nacional de Costa Rica 100-01-000-034870-6 cc 15100010010348708,después de la firmeza de la sentencia. El no pago de dicha suma dará lugar a hacer efectiva la misma en sus bienes, los deberá cancelar en el plazo de quince días hábiles posteriores a la firmeza de la sentencia, bajo el apercibimiento que en caso de incumplir injustificadamente deberá aplicarse supletoriamente el Código Penal, porque la ley especial no regula otra consecuencia en caso de incumplimiento . Se deja sin efecto cualquier otra medida cautelar dictada contra el aquí encartado . Son los gastos del proceso penal a cargo del Estado.- Una vez firme esta sentencia se ordena la destrucción de la prueba material. Se declara con lugar la acción civil resarcitoria incoada por la Procuraduría General de la República en contra del demandado civil [Nombre 001], condenándose a cubrir: 1.- A favor del Estado la suma temporal de QUINIENTOS SESENTA Y SEIS MIL NOVECIENTOS NOVENTA Y CINCO COLONES CON DIEZ CENTIMOS por concepto de daño ambiental, más los intereses desde el momento que se interpuso la acción civil resarcitoria. Se condena al señor [Nombre 001] al pago de costas procesales, que deberán ser liquidadas mediante la etapa de ejecución de sentencia y en el caso de no hacerlo deberán las partes interesadas acudir a la vía correspondiente para hacer efectivo lo decidido. Agréguese a los autos la evidencia que forma parte de ese proceso penal ante la condenatoria dictada. Asimismo, de conformidad con el artículo 103 inciso 3), 110 del Código Penal, artículo 134 de la de La Ley de Pesca y Acuicultura, se decreta el COMISO de la embarcación tipo panga, color blanca y celeste, sin matricula, sin bandera, nombre [...], con motor fuera de borda, decomisada mediante el acta SINAC-ACOSA-RNFSG-PPCP-006-2026, a favor de INCOPESCA. Firme el fallo se ordena su inscripción en el Registro Judicial. Confecciónense los testimonios de estilo para ante el Juzgado de Ejecución de la Pena, la Oficina de Cómputo de la Pena de Adaptación Social, el Instituto Nacional de Criminología y comunicación a INCOPESCA. Se le informa a la persona acusada, que puede solicitar el servicio de defensa pública en la etapa de apelación.- La presente sentencia es emitida de forma oral, quedando las partes debidamente notificadas. Únicamente quedará en el expediente físico la parte dispositiva de la sentencia. Dayanna Segura Mena. Jueza de Juicio .\"\n\n II.- Que, contra el fallo indicado, el encartado [Nombre 001] interpuso recurso de apelación. \n\n III.- Mediante resolución de las 14:39 horas del 14 de mayo de 2026, el Tribunal de Flagrancia del Segundo Circuito Judicial de la Zona Sur (sede Corredores), emplazó a las partes acerca del recurso de apelación interpuesto.\n\n IV.- Realizada la deliberación de ley según lo dispuesto en el numeral 465 del Código Procesal Penal, esta Cámara se planteó las cuestiones formuladas en el recurso.\n\n V.- En los procedimientos se han observado las formalidades y prescripciones de ley.\n\n Informa el Juez de Apelación de Sentencia Robleto Gutiérrez;\n\nCONSIDERANDO\n\n \n\n I.- [Nombre 001], mediante escrito autenticado por el máster Marvin Alvarado Vega, citando el artículo 110 del Código Penal interpone recurso de apelación contra la sentencia número 186-2026 de las 13:30 horas del 16 de abril de 2026 dictada por el Tribunal de Juicio del Segundo Circuito Judicial de la Zona Sur (FLAGRANCIA), Sede Corredores, mediante procedimiento abreviado, por la cual se declaró a [Nombre 001], autor responsable de infracción a la Ley de Pesca y Acuicultura en perjuicio de Los Recursos Naturales, imponiéndole la pena correspondiente a un salario base, que para el momento de los hechos es de CUATROCIENTOS SESENTA Y DOS MIL COLONES, que deberá depositar en la cuenta del Patronato de Construcción, Instalación y Adquisición de Bienes de la Dirección General de Adaptación Social. De igual manera se declaró con lugar la acción civil resarcitoria incoada por la Procuraduría General de la República, condenándolo a cubrir un monto de QUINIENTOS SETENTA Y SEIS MIL NOVECIENTOS NOVENTA Y CINCO COLONES CON DIEZ CÉNTIMOS por concepto de daño ambiental, más los intereses desde el momento que se interpuso la acción civil resarcitoria. De igual manera, de conformidad con los artículos 103 inciso 3 y 110 del Código Penal; 134 de la Ley de Pesca y Acuicultura, se decreta el comiso de la embarcación tipo panga, color blanca y celeste, sin matrícula, sin bandera, nombre “[...]” con motor fuera de borda, decomisada mediante el acta SINAC-ACOSA-RNFSG-PPCP-006-2026, a favor de INCOPESCA. El impugnante, en un único motivo con varios acápites aduce errónea aplicación de derecho en el comiso de la lancha y el motor fuera de borda. Se reclama que el mismo no puede operar de pleno derecho, sino que requiere una valoración concreta sobre su procedencia y para ello se debe realizar una debida fundamentación acerca de la necesidad de esa medida y la relación entre el bien por comisar y el hecho delictivo tenido por probado. Quien impugna, estima que, en el caso concreto, el comiso acordado resulta manifiestamente desproporcionado, siendo que la lancha artesanal y el motor fuera de borda son bienes de un considerable valor económico y constituyen su medio de subsistencia y el de su familia, por lo que ese desbalance convierte al comiso en una medida irracional de carácter confiscatorio. Se alega que los bienes comisados en sí mismos no son ilícitos por naturaleza, por lo que se requiere una justificación reforzada para su comiso, la cual no está presente en el fallo recurrido. También se aduce que la medida atenta directamente contra el derecho al trabajo del apelante porque lo deja sin su medio de subsistencia, lo que afecta sus derechos constitucionales. Se citan los votos número 780-2000 y 848-2000 de la Sala Tercera de la Corte Suprema de Justicia, en cuanto a que el comiso debe estar debidamente fundamentado, de lo contrario ello implicaría la nulidad de ese extremo de la sentencia y la devolución de los bienes. De igual manera debe explicarse el nexo entre el bien y el hecho delictivo, así como la necesidad y proporcionalidad del comiso por parte de la persona juzgadora. Se expone que ese instituto no es una consecuencia automática del delito, sino que requiere el examen y motivación supra citado. Se mencionan los votos número 24-2004, 1554-2011, de la misma Sala de Casación, en apoyo de su tesis. Finaliza indicando que el comiso de una lancha y un motor, frente a un hecho de mínima entidad de veinte mil [sic] colones, resulta manifiestamente desproporcionado y carente de motivación suficiente, lo que es contrario a los criterios jurisprudenciales indicados (pese a lo alegado, consta en el expediente que el monto por daño ambiental fue de ₡576.995,10 colones). Se solicita declarar con lugar el reclamo, revocar la sentencia en cuanto al comiso de la lancha y el motor fuera de borda y pide que se ordene la devolución inmediata de dichos bienes a su propietario, que indica es un tercero. El reclamo es parcialmente procedente. Al minuto 56,59 segundos del dictado de la sentencia oral, la jueza indicó con relación al comiso, que: “con base en los artículos 103 y 110 del Código Penal y 134 de la Ley de Pesca y Acuicultura; y por tratarse del medio utilizado por parte de la persona imputada [Nombre 001] para llevar a cabo el delito de pesca ilegal en un área de protección en contra o en perjuicio de los Recursos Naturales, en virtud de que fue ubicado precisamente al momento de llevar a cabo los hechos el 9 de marzo del año 2026, a eso de las 4 horas, 10 minutos de la tarde, navegando precisamente sobre el área de protección del Parque Nacional Piedras Blancas, a bordo precisamente de una panga que ha sido descrita dentro de la investigación y que corresponde al instrumento o parte de los instrumentos utilizados para llevar a cabo esa pesca, mediante la cual se le decomisó 13 pescados o 13 peces de la especie pez aguja, que para el momento de los hechos ya se encontraban muertos dentro del bote. Determinando usted de esta manera, que efectivamente esta embarcación tipo panga fue parte de los medios utilizados o de los instrumentos utilizados para llevar a cabo la ilicitud que ha sido determinada como culpable por parte del encartado [Nombre 001]. En razón de lo anterior, se decreta el comiso de la embarcación tipo panga, color blanca y celeste, sin matrícula, sin bandera, de nombre [...], con motor fuera de borda, decomisado mediante el acta SINAC-ACOSA-RNFSG-PPCP-006-2026, a favor de INFOPESCA” [sic]. Lo anterior implica, que la persona juzgadora fundamentó la relación entre los bienes comisados y la delincuencia tenida por demostrada, por lo que no es cierto, como se acusó en el recurso, que se trató de un comiso automático. Adicionalmente, la Ley de Pesca y Acuicultura, en su artículo 134 establece como consecuencia del hecho punible, la pérdida de las artes de pesca utilizadas en la comisión del delito en favor de INCOPESCA; y los numerales 51, 52 y 154, se refieren a la forma en que se distribuyen los productos y bienes comisados. Otro aspecto que se debe tener presente, es que la Sala Constitucional ha considerado el comiso como una consecuencia civil derivada de una infracción, afirmando en lo conducente que: “… la figura del comiso, tal como se define en el artículo 110 del Código Penal, es una consecuencia civil del ilícito penal dirigida a prevenir la utilización de bienes o instrumentos para fines delictivos, o a la utilización de los bienes o valores provenientes de la comisión del hecho punible, precisamente como una medida adicional de carácter civil que más allá de la sanción de carácter penal, desestimule psico-socialmente la realización de hechos delictivos, o imposibilite que esos instrumentos o bienes puedan ser nuevamente utilizados para la comisión de hechos delictivos…” (Voto número 2011-07783 de la Sala Constitucional de las 14:31 horas del 15 de junio de 2011, reiterado en el voto 08508-2016 de las 11:30 horas del 22 de junio de 2016). De lo resuelto por la Sala, se colige que además de la consecuencia civil contenida en el numeral 110 del Código Penal, la figura del comiso también pretende que el objeto con el que se cometió el delito no vuelva a ser utilizado para una nueva infracción penal, por ello, tiene sentido jurídico penal el comiso de la lancha y el motor fuera de borda en este caso, máxime que la persona juzgadora dejó claro que esa panga impulsada por ese motor fue parte de los medios utilizados por el imputado para cometer la infracción en una zona protegida e infringir la Ley de Pesca y Acuicultura. Hasta este momento, es posible establecer que el comiso ordenado en la sentencia bajo estudio está motivado en cuanto explica la relación entre los bienes incautados y la delincuencia tenida por demostrada. Lo primero que debe aclararse es que el recurrente alega que los bienes comisados son propios y que lo están dejando sin su medio de subsistencia lo que atenta contra su derecho al trabajo, pero al final del escrito de apelación insinúa, sin aportar ningún tipo de prueba, que los objetos podrían ser de un tercero, aspecto que no se adujo en las etapas anteriores del proceso y que además contradice su propia argumentación. Es evidente, que, si se hubiese alegado en tiempo una tercería, tendría que haberse dado la audiencia correspondiente previo a ordenarse el comiso, lo que no sucedió en este proceso porque no se aludió a ello antes. En consecuencia, se parte de que la panga color blanca y celeste, sin matrícula, sin bandera, de nombre “[...]” y el motor fuera de borda que la impulsa pertenecen a [Nombre 001]. Sin embargo, el artículo 118 de la Ley de Pesca y Acuicultura dispone que tanto el propietario de la embarcación como el armador (entendido este como la persona que realiza por cuenta propia el aprestamiento de un barco para su navegación en su avituallamiento y contratación de pescadores, según el artículo 2, inciso 8 y 116 de la misma ley), serán solidariamente responsables por el incumplimiento de la legislación pesquera, cuando se cause un daño efectivo. Lo que abre la posibilidad de que un tercero pueda ser solidariamente responsable en lo civil por una infracción como la presente y ser también comisado. Omisión de fundamentación en cuanto a la proporcionalidad del comiso. El Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, mediante el voto número 164-2012, de las diez horas treinta y seis minutos del tres de febrero de dos mil doce, asentó que: “La proporcionalidad, en especial, es un juicio que debe hacerse a partir de la necesidad (prohibición de exceso) a la hora de determinar el comiso” [sic]. En ese mismo sentido, la Sala Constitucional, al evacuar una consulta de constitucionalidad referente a una directriz emanada de la Fiscalía Adjunta de Alajuela según la cual, en los procesos por conducción temeraria, como plan reparador se debía requerir la donación del vehículo al Estado, resolvió mediante el voto número 2010-8296 de las 14:44 horas del 5 de mayo de 2010, que dicha directriz resultaba contraria al Derecho de la Constitución, particularmente a los principios de proporcionalidad y razonabilidad. Así como las penas deben estar suficientemente fundadas, el comiso también, porque no tendría sentido, no sería racional, ni proporcional, que el sujeto activo sufra la pérdida de bienes de valor muy superior al daño social que causa o al enriquecimiento obtenido por el hecho punible, por ello es necesario que en el comiso se haga un ejercicio de ponderación por parte de la persona juzgadora. En el caso concreto, de la transcripción supra citada se advierte que no se efectuó el análisis de proporcionalidad de la medida del comiso por parte de la juzgadora, dejando ayuno el fallo de ese aspecto fundamental para justificar su decisión. La jueza se limitó a establecer que los objetos comisados fueron utilizados para la comisión del ilícito por parte del imputado, pero no utilizó ningún baremo de proporcionalidad para tomar la decisión. En consecuencia, por falta de fundamentación, se acoge el único reclamo de [Nombre 001], mediante escrito autenticado por el máster Marvin Alvarado Vega. At nine hours and five minutes on the twenty-seventh of July, two thousand twenty-six.\n\nCase number 26-000131-1262-PE brought against [Name 001], [...]; for the offense of VIOLATION OF THE FISHING AND AQUACULTURE ACT to the detriment of NATURAL RESOURCES. The Court is composed of judges Jaime Robleto Gutiérrez, Marco Mairena Navarro, and judge Xiomara Gutiérrez Cruz. The defendant [Name 001] appeared in the appellate proceedings, and;\n\n\nBACKGROUND:\n\n\nI.- By judgment number 186-2026 of the Flagrancy Court of the Second Judicial Circuit of the Southern Zone, Corredores Branch, issued at 13:30 hours on April 16, 2026, the following was ordered: \"POR TANTO: In light of the foregoing, articles 39 and 41 of the Political Constitution, 1, 6, 9, 12, 363, 365, 367, 373, 374, 375 of the Code of Criminal Procedure, 1, 30, 31, 45, 50, 71, 73, 110, 103 of the Penal Code, and articles 134 and 136 of the Fishing and Aquaculture Act, [Name 001] is declared the criminally responsible perpetrator of the offense of VIOLATION OF THE FISHING AND AQUACULTURE ACT to the detriment of NATURAL RESOURCES, and in such capacity is sentenced to ONE BASE SALARY (salario base), which at the time of the events amounted to FOUR HUNDRED SIXTY-TWO THOUSAND COLONES, to be deposited in the account of the Patronato de Construcción, Instalación y Adquisición de Bienes de la Dirección General de Adaptación Social, Banco Nacional de Costa Rica account 100-01-000-034870-6 cc 15100010010348708, after the judgment becomes final. Once the judgment is final, its registration with the Judicial Registry is ordered. The customary certified copies shall be prepared for the Court of Sentence Enforcement, the Sentence Computation Office of Adaptación Social, the Instituto Nacional de Criminología, and notice shall be given to INCOPESCA. The accused person is informed that they may request the services of the Public Defender's Office at the appellate stage. This judgment is issued orally, and the parties are hereby duly notified. Trial Judge.\"\n\nII.- Against the aforementioned judgment, the defendant [Name 001] filed an appeal.\n\nIII.- By ruling issued at 14:39 hours on May 14, 2026, the Flagrancy Court of the Second Judicial Circuit of the Southern Zone (Corredores Branch) notified the parties regarding the appeal that had been filed.\n\nIV.- Having completed the deliberation required by law pursuant to article 465 of the Code of Criminal Procedure, this Court considered the issues raised in the appeal.\n\nV.- All procedural formalities and statutory requirements have been observed in these proceedings.\n\nThe report is presented by Sentencing Appeals Judge Robleto Gutiérrez;\n\nCONSIDERANDO\n\n\nI.- [Name 001], by means of a brief authenticated by Master Marvin Alvarado Vega, citing article 110 of the Penal Code, filed an appeal against judgment number 186-2026 issued at 13:30 hours on April 16, 2026 by the Trial Court of the Second Judicial Circuit of the Southern Zone (FLAGRANCY), Corredores Branch, rendered through an abbreviated procedure (procedimiento abreviado), by which [Name 001] was declared the criminally responsible perpetrator of a violation of the Fishing and Aquaculture Act to the detriment of Natural Resources, and was sentenced to the equivalent of one base salary, which at the time of the events amounted to FOUR HUNDRED SIXTY-TWO THOUSAND COLONES, to be deposited in the account of the Patronato de Construcción, Instalación y Adquisición de Bienes de la Dirección General de Adaptación Social. The appellant, in a single ground of appeal with several sub-points, alleges erroneous application of law regarding the forfeiture of the boat and the outboard motor. It is argued that forfeiture cannot operate automatically by operation of law, but rather requires a concrete assessment of its merits, which demands adequate reasoning as to the necessity of the measure and the relationship between the property to be forfeited and the proven criminal act. The appellant contends that, in the specific case at hand, the ordered forfeiture is manifestly disproportionate, given that the artisanal boat and the outboard motor are assets of considerable economic value and constitute his means of livelihood and that of his family, so that this imbalance renders the forfeiture an irrational, confiscatory measure. It is alleged that the forfeited assets are not inherently illicit in themselves, and therefore a heightened justification is required for their forfeiture, which is absent from the appealed judgment. It is also argued that the measure directly infringes upon the appellant's right to work, as it deprives him of his means of subsistence, thereby affecting his constitutional rights. Reference is made to rulings number 780-2000 and 848-2000 of the Sala Tercera of the Supreme Court of Justice, to the effect that forfeiture must be duly reasoned; otherwise, this would entail the nullity of that portion of the judgment and the return of the assets. Likewise, the connection between the property and the criminal act must be explained, along with the necessity and proportionality of the forfeiture, by the presiding judge. It is argued that this legal institution is not an automatic consequence of the offense, but rather requires the examination and reasoning described above. Rulings number 24-2004 and 1554-2011 of the same Sala de Casación are cited in support of the appellant's position. The brief concludes by stating that the forfeiture of a boat and a motor, in the face of a minimally harmful act valued at twenty thousand [sic] colones, is manifestly disproportionate and lacks sufficient reasoning, which is contrary to the case-law criteria cited (notwithstanding the foregoing, the case file shows that the amount for environmental damage was ₡576.995,10 colones). The appellant requests that the ground of appeal be granted, that the judgment be reversed with respect to the forfeiture of the boat and the outboard motor, and that the immediate return of said assets to their owner — stated to be a third party — be ordered. The ground of appeal is partially meritorious. At minute 56, 59 seconds of the oral judgment, the judge stated with respect to the forfeiture that: \"based on articles 103 and 110 of the Penal Code and 134 of the Fishing and Aquaculture Act; and because it constitutes the means used by the defendant [Name 001] to carry out the offense of illegal fishing in a protected area against or to the detriment of Natural Resources, given that he was found precisely at the moment of committing the acts on March 9, 2026, at approximately 4:10 in the afternoon, navigating precisely over the protected area of Parque Nacional Piedras Blancas, aboard what was precisely a panga that has been described within the investigation and that corresponds to the instrument or part of the instruments used to carry out said fishing, in the course of which 13 fish or 13 specimens of the species needlefish (pez aguja), which at the time of the events were already dead inside the boat, were seized from him. You thereby determined that this panga-type vessel was in fact part of the means or instruments used to carry out the unlawful conduct for which the defendant [Name 001] has been found guilty. For the foregoing reasons, the forfeiture of the panga-type vessel, white and light-blue in color, without registration, without flag, named [...], with an outboard motor, seized pursuant to record SINAC-ACOSA-RNFSG-PPCP-006-2026, in favor of INFOPESCA [sic], is hereby decreed.\" The foregoing means that the presiding judge provided reasoning for the connection between the forfeited assets and the proven criminal conduct; therefore, it is not true, as alleged in the appeal, that this was an automatic forfeiture. Additionally, the Fishing and Aquaculture Act, in article 134, establishes as a consequence of the punishable act the loss of the fishing gear (artes de pesca) used in the commission of the offense in favor of INCOPESCA; and articles 51, 52, and 154 address the manner in which forfeited products and assets are distributed. Another aspect to bear in mind is that the Sala Constitucional has regarded forfeiture as a civil consequence derived from an infringement, affirming in relevant part that: \"… the institution of forfeiture, as defined in article 110 of the Penal Code, is a civil consequence of the criminal offense aimed at preventing the use of assets or instruments for criminal purposes, or the use of assets or proceeds derived from the commission of the punishable act, precisely as an additional civil measure that, beyond the criminal sanction, psychosocially discourages the commission of criminal acts, or prevents those instruments or assets from being used again in the commission of criminal acts…\" (Ruling number 2011-07783 of the Sala Constitucional, issued at 14:31 hours on June 15, 2011, reiterated in ruling 08508-2016, issued at 11:30 hours on June 22, 2016). From what the Sala resolved, it follows that in addition to the civil consequence set forth in article 110 of the Penal Code, the institution of forfeiture also aims to ensure that the object used to commit the offense is not used again in a new criminal infraction; accordingly, the forfeiture of the boat and the outboard motor is legally and penally justified in this case, especially since the presiding judge made clear that the panga propelled by that motor was part of the means used by the defendant to commit the infraction in a protected zone and to violate the Fishing and Aquaculture Act. Up to this point, it is possible to establish that the forfeiture ordered in the judgment under review is adequately reasoned insofar as it explains the connection between the seized assets and the proven criminal conduct. The first thing to clarify is that the appellant claims the forfeited assets are his own and that their loss deprives him of his means of livelihood, infringing upon his right to work, yet at the end of the appellate brief he insinuates, without providing any evidence, that the items might belong to a third party — an argument that was not raised in any prior stage of the proceedings and that, moreover, contradicts his own reasoning. It is clear that, had a third-party claim (tercería) been raised in a timely manner, the corresponding hearing would have had to be held prior to ordering the forfeiture, which did not occur in these proceedings because no such claim was raised beforehand. Accordingly, the court proceeds on the basis that the white and light-blue panga, without registration, without flag, named \"[...]\", and the outboard motor that powers it, belong to [Name 001]. Nevertheless, article 118 of the Fishing and Aquaculture Act provides that both the vessel owner and the vessel operator (armador) — understood as the person who, on their own account, prepares and equips a vessel for navigation, provisions it, and contracts fishermen, pursuant to article 2, paragraph 8, and article 116 of the same law — shall be jointly and severally liable for any violation of fishing legislation when actual damage is caused. This opens the possibility that a third party may be jointly and severally liable in civil law for an infraction such as the present one and may likewise be subject to forfeiture. Omission of reasoning as to the proportionality of the forfeiture. The Criminal Sentencing Appeals Court of the Second Judicial Circuit of San José, by ruling number 164-2012 issued at ten hours thirty-six minutes on February 3, 2012, held that: \"Proportionality, in particular, is a judgment that must be made based on necessity (prohibition of excess) when determining forfeiture\" [sic]. In the same vein, the Sala Constitucional, when resolving a constitutional review concerning a directive issued by the Deputy Prosecutor's Office of Alajuela, under which, in cases of reckless driving, the reparation plan was required to include the donation of the vehicle to the State, ruled through ruling number 2010-8296 issued at 14:44 hours on May 5, 2010, that said directive was contrary to constitutional law, particularly to the principles of proportionality and reasonableness. Just as criminal sentences must be sufficiently reasoned, so must forfeiture orders, because it would make no sense — nor would it be rational or proportionate — for the perpetrator to suffer the loss of assets of a value far exceeding the social harm caused or the enrichment obtained through the punishable act; therefore, it is necessary for the presiding judge to engage in a balancing exercise when ordering forfeiture. In the present case, from the above-quoted transcription, it is evident that no proportionality analysis of the forfeiture measure was carried out by the presiding judge, leaving the ruling devoid of that fundamental aspect required to justify the decision. The judge limited herself to establishing that the forfeited items were used in the commission of the offense by the defendant, but applied no proportionality standard in reaching her decision. Consequently, due to lack of reasoning, the sole ground of appeal filed by [Name 001] through a brief authenticated by Master Marvin Alvarado Vega is hereby granted. The judgment is partially annulled, solely with respect to the forfeiture of the panga-type vessel, white and light-blue in color, without registration, without flag, named \"[...]\", with an outboard motor, seized pursuant to record SINAC-ACOSA-RNFSG-PPCP-006-2026, in favor of INCOPESCA. The case is remanded to the court of origin, so that, with a new composition, it may resolve that point alone.
