San Ramón, al ser las diez horas cincuenta y cuatro minutos del dieciséis de julio de dos mil veintiséis.\n\n RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra [Nombre 001], costarricense, cédula de identidad número [Valor 001], por el delito de INFRACCIÓN A LA LEY FORESTAL en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces José Alejandro Piedra Pérez, José Alberto Rojas Chacón y Adriana Escalante Moncada. Se apersonan en apelación de sentencia, el licenciado Alejandro Marín Pacheco, en calidad de Apoderado Especial Judicial de la Codemandada Civil compañía [Valor 002]. Asimismo, el licenciado Carlos Fernando Rodríguez Villanueve, en condición de Apoderado Especial Judicial del señor imputado [Nombre 001]. Además, la procuradora penal, la licenciada Zaray Chavarría Prado.\n\n RESULTANDO:\n\n 1.- Que mediante sentencia número 40-P-2026 de las ocho horas cinco minutos del cinco de febrero de dos mil veintiséis, el Tribunal Penal de Puntarenas, resolvió: \"POR TANTO: De conformidad con lo expuesto; normas legales citadas y artículos 39, 41 y 50 de la Constitución Política; 8 y 9 de la Convención Americana sobre Derechos Humanos ; 1, 3, 5, 6, 8, 9, 141, 142, 184, 265 a 269, 360 a 366 del Código Procesal Penal ; 1,2,3,4, 103 del Código Penal; artículo 61 inc a en concordancia con el articulo 3 de la ley forestal numero 7575, artículos 122, 123 y 124 de las reglas civiles del Código Penal de 1941, articulo 98, 100, 101 de la Ley Orgánica del ambiente 7554; este Tribunal resuelve: A- Con respecto a la acción penal SE ABSUELVE de toda pena y responsabilidad a [Nombre 001] del delito de INFRACCION A LA LEY FORESTAL en perjuicio de LOS RECURSOS NATURALES. B-SOBRE LA ACCION CIVIL RESARCITORIA: Se declara con lugar la acción civil resarcitoria establecida por la Procuraduría Penal en contra del acusado [Nombre 001] y el tercero demandado civil [Valor 002] Sociedad Anónima, se condena solidariamente al pago por concepto de daño ambiental a la suma de veintisiete mil doscientos setenta y tres mil setecientos setenta y siete millones de colones, más los intereses generados hasta que adquiera firmeza la sentencia. C-SOBRE LA QUERELLA: Se declara sin lugar la querella. D- SOBRE LAS EXCEPCIONES PLANTEADAS POR EL TERCERO DEMANDADO CIVIL Se declara sin lugar las excepciones de falta de acción, falta de legitimación pasiva y de falta de derecho. Se resuelve sin especial condena en costas sobre la acción civil y la querella. Son los gastos del proceso a cargo del Estado Costarricense. Por medio de lectura notifíquese. La lectura integral de la sentencia se fija para el doce de febrero a partir de las dieciséis horas con veinte minutos. Licda Krysia Campos Chacón. Jueza de Tribunal\".\n\n 2.- Que contra el anterior pronunciamiento, los licenciados Alejandro Marín Pacheco, Carlos Fernando Rodríguez Villanueva y la licenciada Zaray Chavarría Prado, han interpuesto recursos de apelación de sentencia.\n\n 3.- Que verificada la deliberación respectiva, de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal de Apelación de Sentencia del III Circuito Judicial de Alajuela, San Ramón, procedió a conocer del recurso.\n\n 4.- Que en los procedimientos se han observado las prescripciones legales pertinentes.\n\n Redacta el juez Piedra Pérez y,\n\nCONSIDERANDO:\n\nI. El licenciado Alejandro Marín Pacheco en su condición de defensor particular de la codemandada civil [Valor 002] Sociedad Anónima; el licenciado Carlos Fernando Rodríguez Villanueva, en su condición de defensor particular del imputado y demandado civil [Nombre 001]; y la licenciada Zaray Chavarría Prado en su condición de Procuradora Penal de la Procuraduría General de la República, mediante memoriales presentados los días 26 de febrero y 6 de marzo de 2026, recurrieron la sentencia del Tribunal Penal de Puntarenas No. 40-P-2026 de las 8:05 horas del 5 de febrero de 2026, en donde el justiciable [Nombre 001] fue absuelto de toda pena y responsabilidad por el delito de infracción a la Ley Forestal que se le venía atribuyendo. Además, se declaró con lugar la acción civil resarcitoria promovida por el Estado en contra del señor [Nombre 001] y la sociedad [Valor 002] S.A., quienes fueron declarados solidariamente responsables al pago del daño ambiental en la suma de veintisiete millones doscientos setenta y tres mil setecientos setenta y siete colones.\n\nII. En fecha 23 de abril de 2026, se llevó a cabo la audiencia oral solicitada por las partes impugnantes. En esa oportunidad, los recurrentes ratificaron los argumentos expuestos en su libelo recursivo, sin que se hubiese hecho ofrecimiento de prueba, así como tampoco se evacuó elemento probatorio alguno previamente admitido en alzada.\n\nLo anterior se indica por cuanto el Juez José Alejandro Piedra Pérez, quien suscribe esta resolución, no estuvo presente en tal audiencia, sin embargo, esa circunstancia no impide que esa persona juzgadora conozca y resuelva el presente asunto, ello de acuerdo con la jurisprudencia de la Sala Constitucional así plasmada en los Votos No. 1739-92 de las 11:45 horas del 1° de julio de 1992 y No. 6681-96 de las 15:30 horas del 10 de diciembre de 1996.\n\nIII.- Recurso de apelación de la Procuraduría General de la República: Luego de realizar una breve introducción señalando los antecedentes del presente caso conforme a los hechos acusados, se formula un primer motivo de agravio, alegando interpretación errónea de la ley sustantiva en cuanto al alcance indebido de los artículos 3 inciso a) y 61 inciso a) de la Ley Forestal. \n\nEn la apelación ensayada se transcribe un pasaje de la sentencia, así como los ordinales invocados supra, para luego argüir que, la interpretación de la normativa sustantiva en este caso fue omisiva y restrictiva, pues el legislador establece que el aprovechamiento puede ser para beneficio de la persona que realiza la acción o para quien lo represente.\n\nA ese respecto, señala cómo el imputado [Nombre 001] declaró haber realizado la corta, mediante motosierra, de los árboles por orden de una persona identificada como [Nombre 027], quien lo contrató para dicha labor, pues los árboles eran peligrosos para el proyecto turístico que se iba a desarrollar. Además, el encartado reconoció haber trabajado por cuatro horas el día de los hechos en dicha tala hasta la llegada al sitio de los funcionarios de SINAC.\n\nPor su parte, refiere la parte impugnante que, la testigo de descargo [Nombre 002] confirmó la versión del acusado. Por otro lado, la funcionaria del SINAC [Nombre 026], explicó cómo al apersonarse a la propiedad en cuestión, sorprendió al acusado cortando los árboles y al advertir su presencia, éste hace a irse del lugar. Adicionalmente, dicha testigo describió la corta de treinta y cinco árboles de distintas especies mediante motosierra decomisada al sindicado. Detalló también la deponente, el daño ambiental causado al ecosistema, así como advirtió que la propiedad estaba loteada al observar la presencia balizas o cintas de color fosforescente propias de labores topográficas para delimitar los terrenos. En un sentido similar, también declaró en juicio el funcionario del SINAC, el señor [Nombre 004].\n\nFustiga la impugnante que, pese a la contundencia de la prueba testimonial descrita líneas atrás, en sentencia se catalogó de atípica la conducta del acusado por no obtener un beneficio al ser únicamente contratado para la tala. No obstante, se demostró que el encartado y el dueño del inmueble obtuvieron un beneficio, ventaja, utilidad y ganancia con el aprovechamiento de los treinta y cinco árboles, integrándose plenamente el tipo penal, máxime que el imputado recibió una paga por su trabajo, la cual le generó una ventana económica. Por su parte, para el titular del terreno también representó una ganancia, al liberarse el terreno de los árboles que le impedían realizar un proyecto turístico.\n\nLa interpretación realizada por la a quo desnaturaliza la Ley Forestal, cuyo fin es proteger el bien jurídico frente a la acción física de degradación, máxime que el justiciable tuvo dominio del hecho, cortó los árboles con motosierra e intentó huir del sitio cuando los personeros del SINAC lo sorprenden en dicha acción. Arguye también cómo la condición de trabajador contratado no constituye una causal de atipicidad a tenor del ordinal 3 de la Ley Forestal, amén que, en delitos ambientales existe un deber de verificación mínima sobre la ilicitud de su actuar. Descarta la recurrente, además, la posibilidad de un error de prohibición invencible por el hecho de ser contratado para la tala.\n\nA partir de lo expuesto, es criterio de la parte recurrente que la tesis de la atipicidad desarrollada en sentencia no tiene razón jurídica y crea impunidad cuando se utilizan peones para eximirlos de responsabilidad pese a mantener el dominio del hecho.\n\nEn su segundo motivo de agravio, la representación legal del Estado alega falta de correlación entre lo peticionado y lo concedido, eso al mediar un vicio en la fijación de los intereses de la acción civil resarcitoria. Estima que la sentencia únicamente reconoció intereses respecto de la condenatoria en lo civil y el monto fijado como indemnización, a partir de que la sentencia adquiera firmeza, pese a que se pidió expresamente que fuera hasta el efectivo pago o cancelación de todas las sumas económicas. \n\nLo anterior causa un perjuicio, en criterio de la impugnante, al violentarse el principio de reparación integral del daño y generarse un detrimento del resarcimiento económico, pues se ocasiona una pérdida monetaria por la devaluación del dinero concedido en sentencia durante el tiempo que los deudores tarden en pagar. Debe ponderarse que, la fase de prevención de pago y la ejecución de sentencia pueden demorar meses o años, mientras tanto, la suma concedida pierde su valor con el paso del tiempo.\n\nEn su tercer motivo de impugnación, se alega falta de fundamentación por violación a los artículos 266 y 367 del Código Procesal Penal, debido a la no condenatoria en costas por la querella y acción civil resarcitoria a la parte vencida. La apelación ensayada transcribe lo resuelto en sentencia respecto de las costas, así como los numerales antes referidos del Código de rito. Fustiga la impugnante que, la única excepción para eximir en costas al vencido lo es por una razón plausible para litigar, aspecto el cual debe estar debidamente fundado y ello no ocurre en la sentencia impugnada.\n\nCita en apoyo de su tesis el voto de la Sala de Casación Penal No. 1028-2005, exponiendo cómo al quedar acreditada la responsabilidad civil de los demandados por el daño ambiental causado, éstos debían ser también condenados al pago de ambas costas, existiendo así una contradicción en el fallo venido en alzada.\n\nRespecto de las costas por el ejercicio de la querella, arguye la impugnante que en concatenación con el primer motivo de la impugnación, es claro que la a quo absolvió de manera errónea al imputado, declarando sin lugar la querella promovida por la Procuraduría General de la República.\n\nSeñala que, al impugnarse la absolutoria en lo penal, el Estado en su condición de querellante mantiene su pretensión punitiva, y por ende, es una razón más para reclamar el pago de las costas personales y procesales.\n\nFinalmente, en su cuarto motivo de apelación, se invoca inaplicación de los ordinales 103 inciso 3) y 110 del Código Penal, en relación con los numerales 58 y 65 de la Ley Forestal. Esto por cuanto omitió el fallo impugnado pronunciarse sobre la solicitud de comiso de la motosierra marca Shindaiwa color roja, modelo 438 Profesional, artículo el cual fue decomisado al acusado el día de los hechos.\n\nLuego de transcribir los artículos antes mencionados, refiere la impugnante que en resulta de interés para el Estado que los bienes incautados pasen a su favor, por haber sido la herramienta utilizada para perpetrar el ilícito en perjuicio del ambiente. Considera que existe un agravio para el Estado al perderse la adquisición del instrumento utilizado para el aprovechamiento forestal sin contar con los permisos respectivos. Solicita se declare con lugar el recurso incoado, se disponga la ineficacia de los extremos impugnados y se ordene un reenvío para una nueva sustanciación. \n\nVI.- Recurso de apelación promovido por el licenciado Carlos Fernando Rodríguez Villanueva como defensor particular del imputado y demandado civil [Nombre 001]: Se alega, como primer motivo de agravio, menoscabo al principio de accesoriedad de la acción civil dentro del proceso penal. Al respecto, señala el letrado que la sentencia declaró la atipicidad de la conducta de su defendido, por ausencia del elemento normativo previsto en el artículo 61 y 3 de la Ley Forestal, pero mantiene como hechos probados que su patrocinado cortó treinta y cinco árboles de bosque secundario sin permiso.\n\nArguye el recurrente que la acción civil resarcitoria es accesoria al hecho ilícito penal, razón por la cual al no demostrarse el hecho generador del delito hacía imposible la responsabilidad civil de su defendido pues vulnera el principio de legalidad.\n\nEn su segundo motivo de agravio, alega inexistencia de la culpa civil tenida por acreditada. Cita en su apoyo el ordinal 1045 del Código Civil. Reprocha que en sentencia se reconoció como su defendido fue contratado por un tercero, actúo siguiendo instrucciones, sin obtener ningún beneficio económico ni del producto forestal, y tampoco se acreditó intención lucrativa.\n\nLa sentencia es omisa en cuanto a abordar la imprudencia, negligencia, culpa civil autónoma o violación al deber de cuidado. Menciona jurisprudencia de la Sala de Casación Penal sin señalar los números de voto y hace referencia también, del artículo 99 de la Ley Orgánica del Ambiente. Concluye que el trabajador subordinado, sin capacidad decisoria ni provecho económico propio, no es sujeto responsable según la normativa.\n\nEn su tercer motivo de agravio, alega un vicio por contradicción interna en la fundamentación, pues si la sentencia afirma que el imputado fue contratado por un tercero, no hubo aprovechamiento maderable, no obtuvo beneficio económico alguno, y la investigación fue deficiente, no puede bajo esas condiciones atribuirle responsabilidad civil por los hechos acusados, pues no hay un fundamento concreto hacia la culpa civil.\n\nEn su cuarto motivo de agravio, reprocha falta de acreditación individualizada del nexo causal, debido a que la responsabilidad civil requiere de una demostración clara del vínculo entre la conducta atribuida y el daño, el cual fue cuantificado en más de 16.000 metros cuadrados, sin individualizar de forma específica los árboles que fueron cortados exclusivamente por su defendido ni se estableció la proporción del daño que se le sería atribuible.\n\nCalifica la atribución del daño en este caso como genérica al echarse de menos un análisis técnico individualizado que conecte la conducta del acusado con el monto total que se fijó como indemnización, inobservando lo estipulado en el artículo 704 del Código Civil.\n\nFinalmente, en su quinto motivo de agravio, reclama violación al principio de proporcionalidad según el ordinal 11 de la Constitución Política, esto en relación con el ejercicio de la función pública. Alega que la sentencia mantiene una vinculación con el daño ambiental valorado en veintisiete millones doscientos setenta y tres mil setecientos setenta y siete colones, pero reconoce que no hubo explotación comercial ni algún beneficio económico por parte de su defendido, cuya ganancia final fue solo de cuatro horas de trabajo, lo cual implica una condena desproporcionada en lo civil en contra de su patrocinado en su condición de trabajador subordinado.\n\nSolicita se declare con lugar el recurso, anulándose la sentencia impugnada en los extremos civiles del fallo y se establezca la absolución de responsabilidad civil del imputado en este proceso.\n\nV.- Recurso de apelación presentado por el licenciado Alejandro Marín Pacheco en representación de la demandada civil [Valor 002] Sociedad Anónima: El impugnante alega, en su primer motivo de agravio, falta de fundamentación de la sentencia por errónea apreciación de los hechos, violación a las reglas de la sana crítica en relación con la valoración de las pruebas, principio de derivación necesaria y debido proceso.\n\nFustiga la condena en lo civil por daño ambiental que recayó contra su representada. A ese respecto, señala la acreditación en debate de la corta de treinta y seis árboles hecha por el imputado en un área de 1,6 hectáreas, no obstante, de acuerdo con el estudio registral de la finca del Partido de Puntarenas matrícula [Valor 005], consta que la propiedad de su defendida mide únicamente 914 metros cuadrados.\n\nEsto significa, en criterio del recurrente, que la actora civil debía demostrar cuántos de los treinta y seis árboles se ubicaban en dicho inmueble. Sin embargo, se dictaminó responsabilidad civil en un terreno que supera casi en un 1800% la medida de la finca. De este modo califica de ilegal la responsabilidad objetiva de su patrocinada como titular del bien donde ocurren los hechos.\n\nSobre ese particular, considera una falta de fundamentación en el fallo impugnado, pues la a quo se limitó solo a indicar que las coordenadas referidas por el SINAC corresponden con la finca de su representada, pese a la diferencia de 15086 metros cuadrados.\n\nEn criterio del impugnante, la responsabilidad objetiva de la sociedad demandada se limitaría a los daños ambientales ocurridos dentro de su terreno, pero este evento no fue demostrado en debate. A partir de esto, alega violación a las reglas de la lógica, pues no existe sustento legal alguno para derivar la conclusión contenida en el fallo. Además, los hechos probados de la acción civil en el punto tercero, páginas 21 y 22 de la sentencia, no se indica el área abarcada por la corta de los árboles, como tampoco el área de medida de la finca de su representada.\n\nEn el segundo motivo de disconformidad, se alega errónea, insuficiente y contradictora fundamentación de la sentencia, errónea apreciación de los hechos, violación a las reglas de la sana crítica racional en relación con la ponderación de las pruebas, principio de derivación necesaria y el debido proceso.\n\nIndica el impugnante que el Tribunal sentenciador absuelve al imputado por atipicidad, al tener por demostrado que éste no aprovechó los árboles cortados, pues la tala en cuestión fue ordenada o solicitada por un señor identificado como “[Nombre 027]”, debiendo existir aprovechamiento para la configuración del delito. Del mismo modo, explica el recurrente que, la responsabilidad civil objetiva reclamada a su defendida lo es por omitir su obligación de vigilar que no se realizara el aprovechamiento mediante la corta de los árboles, es decir, se imputa responsabilidad objetiva por una conducta de omisión y no por una acción. \n\nSiendo que en sentencia se establece que no hubo aprovechamiento por parte del encartado, y se afirma que éste beneficia al dueño del inmueble, tal razonamiento se estima contradictorio. Lo anterior debido a que, si no hubo aprovechamiento maderable a favor de su representada, no existe omisión alguna de su defendida en su deber de vigilancia, y por ende, no hay responsabilidad alguna qué reclamar. \n\nAl respecto, la concreción de pretensiones de la actora civil fijó el tipo de responsabilidad que se le reclamó a la codemandada civil, y ésta en ejercicio pleno del debido proceso, delimitó su defensa de acuerdo con esa concreción de pretensiones. \n\nConcluye este segundo agravio señalando que, la sentencia tuvo por acreditado que su representada aprovechó la madera, lo cual constituye un hecho diferente y generaría responsabilidad civil subjetiva, existiendo así una evidente contradicción e inconsistencia en el argumento del Tribunal de Juicio.\n\nPor último, se formula un tercer motivo de agravio, el cual refiere el impugnante que es sobre el fondo del asunto por violación de la normativa sustantiva, propiamente los artículos 98, 100 y 101 de la Ley Orgánica del Ambiente, por cuanto omitió el Tribunal de Juicio analizar el daño ambiental desde la perspectiva de la causalidad y atribuibilidad. \n\nExplica el señor defensor cómo entre las páginas 27 y 30 de la sentencia, la a quo concluyó que su patrocinada debía responder por la responsabilidad objetiva, la cual deriva del mero hecho de ser propietaria del terreno donde se dan los hechos, así como que se daban los elementos de causalidad y atribuibilidad que exige la responsabilidad objetiva.\n\nTal razonamiento lo califica el recurrente de errado a la luz de la Ley Orgánica del Ambiente y lo dispuesto por la Sala de Casación Penal en los votos No. 2024-00324 y 2022-00437. Bajo ese orden de ideas, estima el impugnante que no se demostró participación alguna de su representada, ya sea mediante alguno de sus personeros o persona física vinculada con ésta. En ese sentido, la testigo de la defensa en juicio, la señora [Nombre 002] fue clara, junto con el imputado -quien también declaró- en que la corta de árboles fue por instrucciones del señor [Nombre 027], a quien consideraban administrador o curador de la propiedad. Sin embargo, en sentencia no se analiza la participación del señor [Nombre 006], representante legal de la sociedad demandada. \n\nAdemás, reprocha el impugnante que se trató de un hecho tercero ajeno a la demandada civil, omitiendo en sentencia ponderar la relación de causalidad y atribuibilidad entre la conducta omisiva de su defendida y el resultado, condenándose en el extremo civil por el único hecho de ser la propietaria del inmueble. Cataloga el señor defensor de errada la posición asumida en sentencia en relación con que cualquier persona que produzca un daño ambiental en una propiedad que sea ajena a su titular genera responsabilidad civil, pese a la ausencia de conocimiento y consentimiento de su representada en este caso.\n\nEl hecho de un tercero, de conformidad con el artículo 702 del Código Civil y 190 de la Ley General de la Administración Pública, hace que su defendida no tenga responsabilidad alguna en este asunto. Solicita se anule la sentencia, ordenando un reenvío respecto de la condenatoria por la acción civil resarcitoria.\n\nVI.- En virtud de que las impugnaciones ensayadas comprenden aspectos penales y civiles del fallo, para efectos de orden, se abordarán primero aquellos reclamos vinculados a los temas de la responsabilidad penal, los cuales fueron desarrollados únicamente por la Procuraduría General de la República en los motivos primero y cuarto de su apelación. En otro considerando, se conocerán las impugnaciones por los extremos civiles que abarcan los recursos ensayados por las defensas técnicas de los demandados civiles, así como también, lo comprendido en los motivos de agravio segundo y tercero de la impugnación de la representación legal del Estado sobre ese tópico.\n\nVII.- En relación con los extremos penales del asunto: Al respecto, el recurso de apelación promovido por la representación legal del Estado desarrolla dos reproches concretos, contemplados en el motivo primero de agravio y el motivo cuarto de disconformidad, los cuales se analizan de seguido:\n\na) En cuanto a su primer reclamo, la Procuraduría General de la República centra su reproche en una errónea aplicación de la ley sustantiva, específicamente por haberse estimado en sentencia que el proceder del imputado [Nombre 001] resultó atípico del delito de aprovechamiento ilegal de madera según el artículo 61 inciso a) de la Ley Forestal, esto al amparo que dicho encartado no obtuvo beneficio alguno con la tala de los árboles que se le endilgó. El agravio se declara con lugar. Para efectos de contextualizar mejor el pronunciamiento que esta Cámara de apelaciones realizará, conviene transcribir los hechos acusados y querellados en este asunto.\n\nEn ese sentido, el Ministerio Público imputó a [Nombre 001] los siguientes hechos:\n\n“1. El día 7 de abril del 2021, en [...], en las coordenadas [Valor 004], sector de bosque secundario con sucesión de más de 25 años en promedio, se encontraba el imputado [Nombre 001], quien aprovechó producto forestal en propiedad privada sin contar con los permisos de la Administración Forestal del Estado, por cuanto, taló con una motosierra un aproximado de 35 árboles con diámetros promedio de 6centimetros y altura entre 2 a 4 metros las especies [...], [...], [...], [...], [...], [...], [...] y [...] valorándose el daño ambiental en la suma de 27.273.777 millones de colones.” (sic)\n\nPor otro lado, la parte querellante endilgó al justiciable, en lo que interesa, el siguiente marco fáctico:\n\n“PRIMERO: El día 7 de abril del 2021, en la provincia de [...], en la finca [Valor 005] propiamente en las coordenadas [Valor 004], el imputado [Nombre 001], con el fin de obtener un provecho, beneficio, ventaja, utilidad o ganancia para si o para un tercero, aprovechó, adquirió y poseyó recursos forestales de forma ilegal, propiamente cortó 35 árboles con diámetros promedio de 6centimetros y altura entre 2 a 4 metros de diferentes especies entre ellas: [...]. [...], [...], [...], Indio [...], [...], [...], [...], [...], [...] y [...], los cuales se ubicaban en bosque secundario con secesión de más de 26 años en promedio. Lo anterior, lo efectuó mediante la utilización de una motosierra y sin contar con los respectivos permisos de la Administración Forestal del Estado.\n\nSEGUNDO: Es claro que el actuar ilícito perpetrado por el imputado [Nombre 001] produjo un daño ambiental, estimado en la suma de veintisiete millones doscientos setenta y tres mil setecientos setenta y siete colones ($27.273.777) por cuanto al realizar el aprovechamiento y procesamiento ilicito de 35 árboles de diferentes. especies, que se encontraban en bosque secundario con secesión de más de 25 años en promedio, deterioró los recursos naturales y su recuperación, lo que incidió de manera significativa y perjudicial en dicho ecosistema al afectar las condiciones naturales de esa área, ya que eliminó eso recursos naturales existentes y su recuperación, tales como el costo de oportunidad de crecimiento de especies que habitaban en esos árboles aprovechados provocando la pérdida de la biodiversidad al realizar una explotación destructiva, haciendo desaparecer su riqueza biológica: flora, fauna y ecosistemas, aunado a ello, pérdida del carbono y costo de reposición, afectaciones al recurso hídrico y pérdida de belleza escénica, entre otros.” (sic)\n\nA partir de lo anterior, es claro que al señor [Nombre 001] se le imputó la tala de treinta y cinco árboles de distintas especies, ubicadas dentro de un bosque secundario en la finca del Partido de Puntarenas matrícula [Valor 005], esto con el fin de aprovechar el producto maderable obtenido de esta acción. Sobre este particular, el Tribunal sentenciador determinó que, en efecto el imputado taló los árboles en cuestión, a partir de la prueba testimonial de los funcionarios del Sistema de Áreas de Conservación (SINAC), sea los señores [Nombre 026] y [Nombre 004], quienes al arribar al sitio tras una denuncia ciudadana sorprenden al sindicado en la acción de corta de los árboles, e incluso éste intenta huir de la Autoridad Ambiental ante lo cual los agentes en cuestión le indican que debía permanecer en el lugar. \n\nAdicionalmente, los deponentes en cuestión describen la presencia de otros indicios in situ los cuales denotaban que la tala era reciente, tales como la presencia de aserrín, así como que la motosierra utilizada por el imputado estaba aún caliente al momento de su decomiso. Lo anterior, según la prueba documental levantada al efecto, propiamente los informes No. SINAC-ACOPAC-OSRE-PPC-030-2021 y SINAC-ACOPAC-DR-006-2022 (cf. folios 1 a 7 y 15 a 21 del legajo principal).\n\nAdemás, ponderó la Cámara de Juicio la declaración del encartado, respecto a que, él procedió con la labor de tala por contrato de un tercero, propiamente el señor [Nombre 027] (ya fallecido) quien se identificó como encargado del inmueble donde se ubicó la tala, explicando a su vez cómo la corta de los árboles tenía como fin un proyecto turístico en la zona, relato confirmado en juicio por la testigo de descargo [Nombre 002], viuda del señor [Nombre 027].\n\nEmpero, pese a los elementos probatorios que corroboran la acción de la tala, el órgano jurisdiccional de primera instancia determinó la atipicidad de la conducta, esto por ausencia de aprovechamiento del producto de la corta de árboles por parte del imputado [Nombre 001]. Para tales efectos, el Tribunal sentenciador indicó:\n\n“Queda claro de lo transcrito que la persona que se encontraba en el sitio era el acusado, y quien estaba cortando era el acusado, pero según el tipo penal mencionado no basta que la persona este cortando sino que también debe existir un aprovechamiento maderable. En ese sentido, el Ministerio Público le imputó a [Nombre 001] que este aprovecho el producto forestal en propiedad privada sin contar con los permisos de la Administración Forestal. Este aprovechamiento tampoco se desprende de la totalidad del elenco probatorio en el presente proceso. En ese mismo orden de ideas, el testigo [Nombre 004] declaró durante el debate sobre este aspecto mencionando que Soy ingeniero desde 1997, tengo 25 años de trabajar en el Sinac. Yo en abril del 2021, estaba destacado en Esparza, cuando sucedieron estos hechos. Nosotros, la oficina del Sinac en Esparza, recibió una llamada por teléfono de una posible tala de árboles. Mi compañera [Nombre 026] y yo nos apersonamos al lugar para ir a corroborar la situación. En el sitio observamos árboles cortados recientemente, tenía cortes muy frescos, de diferentes diámetros y diferentes especies. Recuerdo que había nances, roble sabana, guarumo, guanacaste, chapernos, algunos espaveles. Esas fueron las que estaban taladas. Eran como treinta a treinta y seis árboles. El imputado era el que estaba, el señor [Nombre 001], viste camiseta café. Lo primero que hacemos es abordar al señor indicándole que paralizara la laborar y que si tenía permiso para hacer esa labor. Lo que estaba era la motosierra en el suelo pero se notaba que estaban haciendo esas labores. De Esparza a Miramar, hay como 20 minutos, la entrada es la del cementerio, creo que fue eso en abril, el día creo que 21. Se notaba que en el sitio había cortes frescos, con aserrín fresco producto del trabajo que estaban realizando. Esa propiedad tuvimos que recorrerla de la entrada como hay pendientes pero fue de cincuenta a sesenta metros. La sierra estaba en el suelo cuando la vimos. La sierra era la parte de espada era pequeña que se uso para cortar árboles. La herramienta era idónea de quince a 20 cm. La totalidad de área era de 1,6 hectáreas. El respondió que fue mandado a hacer esa labor. Se le explico que requería un permiso para eso. Con un permiso de la administración forestal. Ese permiso es un plan de manejo tiene las partes técnicas para el manejo de bosques maduros, primarios o secundarios. Como se desprende de lo transcrito, cuando los funcionarios del Sinac, llegan al sitio quien se encuentra cortando los árboles es el imputado, sin embargo ya desde ese primer momento queda claro que este se encontraba realizando un trabajo que le habían indicado pero no era que el acusado iba a tener un beneficio económico con la corta de dichos árboles. El único beneficio era el pago que se le estaba dando por su trabajo, que dista mucho de lo que se le imputo en la pieza acusatoria cuando se indica que aprovecho el producto forestal en propiedad privada. No se ha acreditado a través de toda la prueba que el imputado aprovecho el producto forestal.” (sic)\n\nAl respecto, esta Cámara de apelaciones estima que sí existe el yerro apuntado por la recurrente respecto a la errónea aplicación de la ley sustantiva- Para tal efecto, es menester hacer un repaso de la normativa aplicable en el caso sub júdice, iniciando con el tipo penal en cuestión contenido en la Ley Forestal:\n\n“ARTICULO 61.- Prisión de un mes a tres años. Se impondrá prisión de un mes a tres años a quien: a) Aproveche uno o varios productos forestales en propiedad privada, sin el permiso de la Administración Forestal del Estado, o a quien, aunque cuente con el permiso, no se ajuste a lo autorizado.”\n\nEs claro que este tipo penal contiene un elemento normativo, el cual corresponde al “aprovechamiento maderable”, cuya definición técnica la brinda el mismo cuerpo legal de comentario en su artículo 3 inciso a), el cual reza: \n\n“ARTICULO 3.- Definiciones. Para los efectos de esta ley, se considera: a) Aprovechamiento maderable: Acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de esta ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa.” \n\nDe la normativa transcrita, se desprende que el beneficio por el aprovechamiento maderable en terrenos privados por la acción de corta se manifiesta a través de múltiples formas, las cuales no conllevan per se una ventaja económica o un aspecto lucrativo strictu sensu, pues el beneficio puede ser de otra índole. A su vez, también se deriva de dicho articulado que la ganancia no necesariamente debe ser personal, pues incluso puede aprovechar a la persona que representa quien materializa la acción de la tala.\n\nBajo ese orden de ideas, todas estas manifestaciones a través de las cuales el sujeto activo puede sacar provecho para sí o para un tercero cuyos intereses representa, deben ser analizadas, a su vez, conforme al principio de legalidad de acuerdo con los alcances del artículo 1 de la Ley Forestal:\n\n“La presente ley establece, como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables. Además, velará por la generación de empleo y el incremento del nivel de vida de la población rural, mediante su efectiva incorporación a las actividades silviculturales. En virtud del interés público y salvo lo estipulado en el artículo 18 de esta ley, se prohíbe la corta o el aprovechamiento de los bosques en parques nacionales, reservas biológicas, manglares, zonas protectoras, refugios de vida silvestre y reservas forestales propiedad del Estado.”\n\nEl fin de esta normativa tiene como norte, la tutela ambiental, con particular énfasis en la regulación del aprovechamiento del recurso forestal, a efectos de combatir, precisamente prácticas de explotación del recurso maderable en la clandestinidad y zonas no permitidas como por ejemplo bosques y áreas de protección de cuerpos de agua. De ahí que, la legislación en cuestión regla de manera concreta planes de manejo forestal y el otorgamiento de los permisos respectivos por parte de la Administración Pública a los administrados que desean realizar algún tipo de actividad que conlleve la tala de árboles o el aprovechamiento de los productos derivados de éstos.\n\nDe acuerdo con lo expuesto, justipreciar el elemento normativo del tipo penal respecto del concepto de aprovechamiento maderable desde una óptica centrada en si el sujeto que realizó la tala obtuvo algún provecho pecuniario directo en lo personal con el producto forestal, dejaría de lado la lectura correcta que debe darse al ordinal 3 inciso a) de la Ley Forestal, en el tanto las ventajas que puede obtener quien materializa la acción de la tala o a quien representa (si es por mandato de otro como parece ser el caso sub júdice), el beneficio puede ser de otra índole, e incluso el aprovechamiento puede ser de carácter potencial sin que sea necesario que se materialice, por ejemplo, en la venta de la madera o su transformación en artículos tales como muebles.\n\nDe este modo, las consideraciones anteriores debió ponderarlas la Cámara de Juicio a la luz de los elementos objetivos derivados del universo probatorio: i) El imputado obró por órdenes de un tercero; ii) El hecho de que la tala tenía como fin último un proyecto turístico según el propio dicho del justiciable y su testigo de descargo; iii) Sin ánimo de prejuzgar sobre lo resuelto, debió ponderarse si el aprovechamiento en cuestión, estaba vinculado a un beneficio ulterior y mayor, pues impresiona que el bosque otrora talado conllevaba un obstáculo para el desarrollo urbanístico que se pretendía; y iv) Vinculado con lo anterior, tampoco se valoró lo atestiguado por los oficiales del SINAC [Nombre 026] y [Nombre 004], quienes refirieron que el terreno donde fue hallada la corta, estaba ya dividido con cintas, dispositivos reflectivos y otros instrumentos propios de la labor de topografía. A partir de lo anterior, se dejó de lado que el beneficio producto del aprovechamiento maderable no necesariamente debe concretarse ipso facto con la acción de la tala, pasando por alto el fallo impugnado la potencialidad de las ganancias que se podían obtener a futuro, dado el trasfondo que existía detrás de la corta conforme al proyecto turístico que presuntamente se pretendía desarrollar en el inmueble. \n\nLos yerros antes apuntados conducen a que, la tesis recursiva atinente a una aplicación errada de la ley penal sustantiva tiene asidero y a partir de ahí, debe declararse con lugar la impugnación, disponiéndose la ineficacia de la sentencia en cuanto a los extremos penales del fallo, razón por la cual se ordena el reenvío respectivo para una nueva sustanciación de este asunto. \n\nb) En relación con el motivo cuarto de disconformidad, en torno a la omisión en sentencia de pronunciarse sobre la solicitud de comiso de la motosierra decomisada al imputado [Nombre 001], esta Cámara de apelaciones no hará pronunciamiento por innecesario, dada la forma en la cual se ha resuelto la impugnación aquí conocida, al disponerse la nulidad de lo resuelto en torno a los aspectos penales del fallo, los cuales comprenden las consecuencias derivadas del presunto delito objeto de este litigio, incluyéndose así dentro del reenvío ordenado, una nueva discusión sobre el tema del comiso.\n\nVIII.- En cuanto a los extremos civiles del fallo: En este acápite se abordarán primeramente las impugnaciones promovidas por parte de la defensa técnica del imputado y demandado civil [Nombre 001] y la representación letrada de la accionada civil [Valor 002] Sociedad Anónima. \n\nPese a que, en cuanto a la acción penal de este asunto, esta Cámara de apelaciones ha declarado la ineficacia de lo resuelto por la a quo y se ha ordenado la celebración de un juicio de reenvío para una nueva sustanciación de dicho aspecto. Es menester hacer un pronunciamiento aparte en relación con los reproches incoados por los demandados civiles en este asunto, esto en aplicación de lo dispuesto en el artículo 40 in fine del Código Procesal Penal, así como por el hecho de que, el razonamiento contenido en sentencia respecto de la demanda indemnizatoria del Estado presenta falencias importantes en su fundamento intelectivo y jurídico que merecen ser analizadas. \n\nSobre el particular, se abordarán de entrada los motivos primero a cuarto del recurso de apelación de la defensa técnica del accionado [Nombre 001], así como los motivos segundo y tercero de la impugnación incoada por el representante de la sociedad demandada. Esto debido a que, en dichos agravios se reprochan aspectos que guardan conexidad entre sí, vinculado a un supuesto argumento contradictorio e insuficiente en sentencia sobre el nexo de causalidad atribuido a ambos demandados. \n\nSobre este particular, los motivos así descritos deben declararse con lugar. Revisado el considerando de la sentencia impugnada dedicado a la demanda civil incoada en este proceso, resulta contradictorio haber atribuido responsabilidad civil al accionado [Nombre 001] al amparo del ordinal 1045 del Código Civil bajo un criterio de imputación subjetiva. Esto por cuanto, si el Tribunal sentenciador determinó la atipicidad de la conducta de don [Nombre 001] como imputado del delito de aprovechamiento maderable ilegal, tal circunstancia impedía declarar con lugar la demanda civil en su contra teniendo como fuente de responsabilidad civil la comisión de un delito según el numeral 1046 del cuerpo legal de marras. \n\nErgo, la ausencia de delito en el caso del accionado [Nombre 001] impedía declarar con lugar el reclamo indemnizatorio por daño ambiental bajo un criterio de imputación subjetiva. En ese sentido, lleva razón su patrocinio letrado en cuanto a la errónea determinación del nexo de causalidad en el caso de su defendido, toda vez que, más allá de la referencia respecto a que el señor [Nombre 001] causó un daño ambiental con la tala de los árboles, la sentencia no ahonda en las razones por las cuales, pese a considerar previamente la ausencia de delito, posteriormente atribuye responsabilidad civil a don [Nombre 001]. \n\nPor otro lado, en el caso de la demandada civil [Valor 002] S.A., se advierte también un vicio en la fundamentación de la atribución de responsabilidad civil en su caso, pues en la parte considerativa respecto al análisis penal de la causa se indicó expresamente que, el aprovechamiento maderable ilegal le era beneficioso única y directamente a la empresa accionada. Sin embargo, en el acápite dedicado al estudio civil del asunto, la Cámara de Juicio varía tal posición y ampara el vínculo de imputación a partir del ordinal 101 de la Ley Orgánica del Ambiente conforme a un criterio de responsabilidad civil objetiva. Luego, refiere que es aplicable en el caso sub exámine el numeral 1045 del Código Civil por negligencia de la sociedad en cuestión como dueña del terreno, atribuyéndole una responsabilidad civil de índole subjetivo.\n\nLo anteriormente expuesto, revela el defecto invocado por el recurrente, pues la fundamentación jurídica del fallo además de contradictoria no logra explicar adecuadamente el porqué de tales afirmaciones. Además, revisado el memorial de la acción civil resarcitoria interpuesto por la Procuraduría General de la República a folio 3 frente y vuelto del legajo del reclamo civil, consta cómo la parte actora dilucidó su pretensión de indemnización de daño ambiental bajo un criterio de responsabilidad civil extracontractual objetiva conforme a la Ley Orgánica del Ambiente, al establecer que la sociedad accionada como dueña del inmueble donde ocurren supuestamente el menoscabo al ambiente, inobservó su deber de vigilancia respecto de las acciones que se generaban en ese lugar.\n\nA partir de lo anterior, se trabó la litis contra la empresa demandada y bajo ese criterio de imputación es que ésta preparó su defensa, resultando sorpresivo la condena por otro vínculo de atribución de responsabilidad civil de carácter subjetivo según el numeral 1045 tantas veces citado. A mayor abundamiento, es menester precisar que, la jurisprudencia de la Sala Primera de la Corte Suprema de Justicia, conforme al voto No. 1724-2023 de las 9:36 horas del 12 de octubre de 2023, ha señalado violación al debido proceso por conculcación al derecho de defensa del demandado, cuando en sentencia el vínculo de imputación de responsabilidad civil se varía tanto en su modo de atribución (objetiva o subjetiva) como en su fundamento normativo. \n\nLo anterior por cuanto, se genera una modificación sustancial en relación con la causa petendi del accionante, lo cual a su vez provoca un vicio de incongruencia por otorgarse las pretensiones de la demanda a partir de criterios y normativa distinta a la invocada por la parte accionante. En aquella oportunidad dicha Cámara de lo civil indicó:\n\n“Es notoria la implicación que trae consigo modificar la causa de pedir, el destino de las pruebas y las pretensiones, que siempre se basaron en los elementos de la responsabilidad subjetiva, para aplicarse un paradigma diferente con requisitos probatorios distintos, sorprendiendo a la demandada quien planificó su estrategia de defensa sobre el debate definido por la parte actora. Este es el sentido por el cual el casacionista afirma que, en el presente caso, el objeto del proceso y lo debatido se modificó, invirtiéndose la carga probatoria en perjuicio de su representada, porque ejerciendo su defensa en virtud de un reclamo basado en responsabilidad subjetiva por culpa (imprudencia y negligencia), no le correspondía ajustarse a las reglas probatorias del régimen objetivo. Según el planteamiento jurídico de la demanda, era de resorte exclusivo de la actora demostrar, además de la existencia del daño y del nexo causal, los elementos subjetivos de imputación. Sin embargo, al aplicarse la referida legislación e invertirse la carga de la prueba, se sometió a la demandada a las previsiones del artículo 35, en el supuesto de asumir que el daño derivó del servicio prestado, todo, dentro de un terreno jurídico propio de las relaciones de consumo, con conceptos, principios e instituciones que la demandante no planteó ni trajo a discusión, al fundar su pretensión en otro fundamento de Derecho, muy diferente al aplicado. En definitiva, la decisión adoptada por el Ad-quem conculca los principios del debido proceso, de defensa y del contradictorio, que gobierna al proceso civil. Asimismo, la variación entre lo pedido en la demanda y lo resuelto en el fallo, conlleva incumplimiento del principio de congruencia e infracción del numeral 155 del CPC, (…).”\n\n En virtud de lo expuesto, se declaran con lugar los motivos primero a cuarto del recurso incoado por la defensa técnica del demandado civil [Nombre 001], así los motivos segundo y tercero de la apelación promovida por la representación legal de la demandada [Valor 002] Sociedad Anónima. De esta forma se declara la nulidad de la sentencia en cuanto a todos los extremos civiles del fallo, ordenándose un reenvío para una nueva sustanciación.\n\nPor innecesario, se omite pronunciarse sobre el motivo quinto del recurso del licenciado Rodríguez Villanueva, así como del motivo primero de impugnación del licenciado Marín Pacheco, esto vinculado a la discusión sobre la fijación económica y los alcances del daño ambiental en torno a la actuación del señor [Nombre 001] y la cantidad del área presuntamente afectada en relación con las dimensiones del terreno de la sociedad demandada civil. Lo anterior por cuanto se está decretando la nulidad de la sentencia en cuanto al tema de la acción civil, quedando comprendidos las partidas concedidas y su modo de fijación.\n\nIX.- En relación con los motivos segundo y tercero de impugnación de la Procuraduría General de la República, vinculados a los extremos civiles de la sentencia: En cuanto al segundo motivo de agravio formulado por la representación legal del Estado, dedicado a un reclamo por el modo de fijación de los intereses en cuanto a los montos reconocidos por la acción civil resarcitoria, se omite pronunciamiento al respecto. Lo anterior ya que, de acuerdo con lo resuelto en el considerando anterior, se ha dispuesto la ineficacia del fallo en cuanto a la demanda civil promovida por la Procuraduría en este asunto, lo cual abarcó per se los montos concedidos y sus partidas accesorias como lo constituye el rubro atinente a intereses.\n\nRespecto del tercer motivo de disconformidad, vinculado al tema de las costas personales y procesales derivadas del ejercicio de la acción penal y la demanda civil en este asunto, se tiene que, al haberse declarado la nulidad de la sentencia en su totalidad, tanto de la parte penal como de la parte civil, deja insubsistente la resolución sin especial condenatoria en costas que realizó la a quo y por ende, debe también ser objeto de pronunciamiento en el juicio de reenvío que a tales efectos se ha ordenado. \n\nPOR TANTO:\n\nSe resuelve: a) Se declara con lugar el motivo primero del recurso de apelación de la Procuraduría General de la República, por innecesario se omite pronunciarse sobre los motivos segundo, tercero y cuarto de dicha impugnación. b) Se declaran con lugar los motivos primero a cuarto del recurso de apelación presentado por la defensa técnica del demandado civil [Nombre 001], por innecesario se omite pronunciamiento respecto del motivo quinto de dicha impugnación. c) Se declaran con lugar los motivos segundo y tercero del recurso de apelación formulados por la representación legal de la demandada civil [Valor 002] Sociedad Anónima, por la forma en la cual se acoge tal impugnación, se omite pronunciamiento respecto del primer motivo del recurso. d) Se anula la sentencia venida en alzada y se ordena el juicio de reenvío para que, con diferente integración, se sustancien de nuevo todos los extremos penales y civiles del presente asunto, incluyendo lo relativo a las costas. San Ramón, at ten hours and fifty-four minutes on the sixteenth of July, two thousand twenty-six.\n\nAPPEAL OF JUDGMENT filed in the present case brought against [Nombre 001], Costa Rican national, national identification number [Valor 001], for the offense of VIOLATION OF THE Ley Forestal to the detriment of NATURAL RESOURCES. Participating in the decision of the appeal are judges José Alejandro Piedra Pérez, José Alberto Rojas Chacón, and Adriana Escalante Moncada. Appearing on appeal is attorney Alejandro Marín Pacheco, acting as Special Judicial Attorney (Apoderado Especial Judicial) of the civil co-defendant (codemandada civil) company [Valor 002], as well as attorney Carlos Fernando Rodríguez Villanueve, acting as Special Judicial Attorney of the defendant [Nombre 001], and criminal prosecutor attorney Zaray Chavarría Prado.\n\nWHEREAS:\n\n1.- By judgment No. 40-P-2026 of eight hours and five minutes on the fifth of February, two thousand twenty-six, the Criminal Court (Tribunal Penal) of Puntarenas ruled: \"THEREFORE: In accordance with the foregoing; the cited legal provisions and Articles 39, 41, and 50 of the Political Constitution; 8 and 9 of the American Convention on Human Rights; 1, 3, 5, 6, 8, 9, 141, 142, 184, 265 through 269, 360 through 366 of the Code of Criminal Procedure; 1, 2, 3, 4, 103 of the Criminal Code; Art. 61 subsection a) in conjunction with Art. 3 of the Ley Forestal No. 7575, Articles 122, 123, and 124 of the civil rules of the Criminal Code of 1941, Articles 98, 100, 101 of the Organic Environmental Law 7554; this Court rules: A- With respect to the criminal action, [Nombre 001] IS ACQUITTED of all punishment and responsibility for the offense of VIOLATION OF THE Ley Forestal to the detriment of NATURAL RESOURCES. The case is resolved without a special order of court costs (costas) regarding the civil damages action and the criminal complaint. The costs of the proceedings are to be borne by the Costa Rican State. Notification shall be made by reading. Trial Judge.\"\n\n2.- Against the foregoing ruling, attorneys Alejandro Marín Pacheco, Carlos Fernando Rodríguez Villanueva, and attorney Zaray Chavarría Prado have filed appeals of judgment.\n\n3.- The relevant deliberation having been conducted, in accordance with Article 465 of the Code of Criminal Procedure, the Court of Appeal of the III Judicial Circuit of Alajuela, San Ramón, proceeded to consider the appeal.\n\n4.- The relevant legal requirements have been observed in these proceedings.\n\nThe opinion is drafted by Judge Piedra Pérez, and\n\nCONSIDERING:\n\nI. Attorney Alejandro Marín Pacheco, acting as private defense counsel for the civil co-defendant [Valor 002] Sociedad Anónima; attorney Carlos Fernando Rodríguez Villanueva, acting as private defense counsel for the defendant and civil defendant [Nombre 001]; and attorney Zaray Chavarría Prado, acting as Criminal Prosecutor for the Attorney General's Office (Procuraduría General de la República), through briefs filed on February 26 and March 6, 2026, appealed judgment No. 40-P-2026 of the Criminal Court of Puntarenas, issued at 8:05 hours on February 5, 2026, in which defendant [Nombre 001] was acquitted of all punishment and responsibility for the offense of violation of the Ley Forestal attributed to him. Furthermore, the civil damages action brought by the State against [Nombre 001] and the company [Valor 002] S.A. was granted, and they were declared jointly and severally liable for payment of environmental damage in the sum of twenty-seven million two hundred seventy-three thousand seven hundred seventy-seven colones.\n\nII. On April 23, 2026, the oral hearing requested by the appealing parties was held. At that hearing, the appellants ratified the arguments set forth in their appeal briefs, without offering any new evidence, and no previously admitted appellate evidence was introduced.\n\nThe foregoing is noted because Judge José Alejandro Piedra Pérez, who signs this resolution, was not present at that hearing; however, this circumstance does not prevent that judge from hearing and deciding the present matter, in accordance with the jurisprudence of the Constitutional Chamber as expressed in Decisions No. 1739-92 of 11:45 hours of July 1, 1992, and No. 6681-96 of 15:30 hours of December 10, 1996.\n\nIII.- Appeal filed by the Attorney General's Office: After a brief introduction setting out the background of this case in accordance with the charged facts, a first ground of appeal (motivo de agravio) is raised, alleging erroneous interpretation of the substantive law regarding the undue scope given to Art. 61 subsection a) and Art. 3 subsection a) of the Ley Forestal.\n\nThe appeal transcribes a passage from the judgment, as well as the aforementioned provisions, and then argues that the interpretation of the substantive rules in this case was both incomplete and unduly restrictive, given that the legislature provides that the exploitation may benefit the person who performs the action or whoever that person represents.\n\nIn this regard, the brief notes how the defendant [Nombre 001] stated that he had cut the trees using a chainsaw on the orders of a person identified as [Nombre 027], who hired him for that work because the trees were dangerous for the tourist project to be developed. Furthermore, the accused acknowledged having worked for four hours on the day of the events until SINAC officers arrived at the site.\n\nThe appealing party further notes that defense witness [Nombre 002] confirmed the accused's account. Meanwhile, SINAC officer [Nombre 026] explained how, upon arriving at the property in question, she caught the accused cutting the trees and observed that upon noticing her presence he began to leave the scene. In addition, this witness described the cutting of thirty-five trees of various species using a chainsaw seized from the accused. The witness also detailed the environmental damage caused to the ecosystem, and noted that the property appeared to have been parceled out (loteada), as evidenced by the presence of fluorescent survey markers or tapes used in topographic work to demarcate the lots. SINAC officer [Nombre 004] also gave similar testimony at trial.\n\nThe appellant criticizes the fact that, despite the weight of the testimonial evidence described above, the judgment classified the accused's conduct as not constituting a criminal offense on the grounds that he obtained no benefit since he was merely hired to carry out the logging. However, it was demonstrated that the accused and the property owner both obtained a benefit, advantage, utility, and gain from the forest harvesting (aprovechamiento) of the thirty-five trees, fully satisfying the elements of the criminal offense (tipo penal), especially since the defendant received payment for his work, which generated an economic advantage for him. As for the landowner, he also stood to gain by clearing the property of the trees that prevented him from carrying out a tourist project.\n\nThe interpretation adopted by the lower court distorts the Ley Forestal, whose purpose is to protect the legally protected interest (bien jurídico) against the physical act of degradation, especially since the defendant controlled the act (dominio del hecho), cut the trees with a chainsaw, and attempted to flee the scene when SINAC officers caught him in the act. The brief also argues that the status of a hired worker does not constitute a ground for absence of a criminal offense under Art. 3 of the Ley Forestal, and that, in addition, in environmental crimes there is a minimum duty to verify the unlawfulness of one's own conduct. The appellant also dismisses the possibility of an unavoidable mistake of law (error de prohibición invencible) based on having been hired to do the logging.\n\nBased on the foregoing, the appealing party maintains that the theory of absence of a criminal offense developed in the judgment has no legal basis and creates impunity when laborers are used to shield others from responsibility despite those laborers retaining control over the act.\n\nIn its second ground of appeal, the State's legal representative alleges a lack of correlation between what was requested and what was granted, due to a defect in the determination of interest on the civil damages action. It argues that the judgment only recognized interest on the civil award and the compensation amount set from the date on which the judgment becomes final, even though it was expressly requested that interest run until the actual payment or full cancellation of all monetary sums.\n\nThis causes harm, in the appellant's view, by violating the principle of full reparation of damages and producing a reduction in the economic compensation, since the money awarded in the judgment loses value due to monetary devaluation during the time it takes the debtors to pay. It must be borne in mind that the pre-payment notice phase and the enforcement of the judgment may take months or years, throughout which the awarded sum loses its value over time.\n\nIn its third ground of appeal, it alleges lack of reasoning for violation of Articles 266 and 367 of the Code of Criminal Procedure, due to the failure to order court costs against the losing party with respect to the criminal complaint and the civil damages action. The appeal transcribes the ruling on costs as well as the aforementioned articles of the procedural code. The appellant criticizes the fact that the only exception for excusing a losing party from court costs is a plausible reason to litigate, which must be duly reasoned, and that this did not occur in the challenged judgment.\n\nIn support of this position, the appellant cites the ruling of the Criminal Court of Cassation No. 1028-2005, arguing that since the civil liability of the defendants for the environmental damage caused was established, they should also have been ordered to pay both court costs, there being a contradiction in the judgment on appeal.\n\nRegarding court costs for the exercise of the criminal complaint, the appellant argues that, in connection with the first ground of appeal, it is clear that the lower court wrongly acquitted the defendant, thereby denying the criminal complaint filed by the Attorney General's Office.\n\nThe appellant notes that, since the criminal acquittal is being challenged on appeal, the State in its capacity as complainant maintains its punitive claim, and this is yet another reason to seek payment of personal and procedural court costs.\n\nFinally, in its fourth ground of appeal, the appellant invokes the non-application of Art. 103 subsection 3) and Art. 110 of the Criminal Code, in relation to Articles 58 and 65 of the Ley Forestal. This is because the challenged judgment failed to rule on the request for forfeiture (comiso) of the Shindaiwa brand red chainsaw, model 438 Professional, which was seized from the accused on the day of the events.\n\nAfter transcribing the aforementioned articles, the appellant states that it is in the State's interest for the seized items to be transferred to it, having been the tool used to commit the offense to the detriment of the environment. It considers that there is harm to the State in losing the instrument used for forest harvesting without the required permits. The brief requests that the appeal be granted, that the challenged portions be declared ineffective, and that the matter be remanded for new adjudication.\n\nVI.- Appeal filed by attorney Carlos Fernando Rodríguez Villanueva as private defense counsel for the defendant and civil defendant [Nombre 001]: As a first ground of appeal, harm to the principle of accessoriness (accesoriedad) of the civil action within the criminal proceeding is alleged. In this regard, the attorney notes that the judgment declared the absence of a criminal offense in his client's conduct, for lack of the normative element provided in Arts. 61 and 3 of the Ley Forestal, while still maintaining as a proven fact (hecho probado) that his client cut thirty-five trees from secondary forest (bosque secundario) without a permit.\n\nThe appellant argues that the civil damages action is accessory to the criminal unlawful act, and therefore, since the generating act of the offense was not proven, civil liability on the part of his client was impossible, as it would violate the principle of legality.\n\nIn its second ground of appeal, it alleges the non-existence of the civil fault held as established. The appellant cites Art. 1045 of the Civil Code in support. The brief criticizes the fact that the judgment acknowledged how his client was hired by a third party, acted under instructions, obtained no economic benefit from the timber products, and that no profit motive was established.\n\nThe judgment fails to address negligence, carelessness, autonomous civil fault, or breach of the duty of care. The appellant references jurisprudence of the Criminal Court of Cassation without specifying ruling numbers and also refers to Art. 99 of the Organic Environmental Law. The brief concludes that a subordinate worker, without decision-making capacity or personal economic gain, is not a liable party under the applicable law.\n\nIn its third ground of appeal, it alleges a defect due to internal contradiction in the reasoning, since if the judgment affirms that the defendant was hired by a third party, that there was no timber exploitation, that he obtained no economic benefit whatsoever, and that the investigation was deficient, it cannot, under those circumstances, attribute civil liability for the charged acts to him, as there is no concrete basis for a finding of civil fault.\n\nIn its fourth ground of appeal, it criticizes the lack of individualized establishment of the causal link (nexo causal), on the grounds that civil liability requires a clear demonstration of the connection between the attributed conduct and the harm, which was quantified as covering more than 16,000 square meters, without specifically identifying the trees cut exclusively by his client or establishing the proportion of the damage attributable to him.\n\nThe attribution of damage in this case is characterized as generic, given the absence of an individualized technical analysis connecting the accused's conduct to the total compensation amount set, in disregard of Art. 704 of the Civil Code.\n\nFinally, in its fifth ground of appeal, it claims a violation of the principle of proportionality under Art. 11 of the Political Constitution, in relation to the exercise of public authority. It argues that the judgment maintains a connection to the environmental damage valued at twenty-seven million two hundred seventy-three thousand seven hundred seventy-seven colones, while acknowledging that there was no commercial exploitation nor any economic benefit for his client, whose total gain amounted only to four hours of work, which implies a disproportionate civil judgment against his client in his capacity as a subordinate worker.\n\nThe brief requests that the appeal be granted, that the judgment be annulled with respect to the civil portions of the ruling, and that the civil liability of the defendant in these proceedings be discharged.\n\nV.- Appeal filed by attorney Alejandro Marín Pacheco on behalf of civil defendant [Valor 002] Sociedad Anónima: In its first ground of appeal, the appellant alleges lack of reasoning in the judgment due to erroneous assessment of the facts, violation of the rules of sound critical evaluation (sana crítica racional) regarding the weighing of evidence, the principle of necessary derivation, and due process.\n\nThe civil judgment for environmental damage entered against his client is challenged. In this regard, the brief notes the establishment at trial of the cutting of thirty-six trees by the defendant over an area of 1.6 hectares; however, according to the property registry study of the Puntarenas Partido estate registered under folio real [Valor 005], the property owned by his client measures only 914 square meters.\n\nThis means, in the appellant's view, that the civil plaintiff had to demonstrate how many of the thirty-six trees were located on that parcel. However, civil liability was imposed for an area that exceeds the measured size of the property by nearly 1,800%. The appellant accordingly characterizes as unlawful the strict liability (responsabilidad objetiva) of his client as titleholder of the property where the events took place.\n\nOn that point, the brief identifies a lack of reasoning in the challenged judgment, since the lower court merely indicated that the coordinates referenced by SINAC correspond to his client's property, despite a discrepancy of 15,086 square meters.\n\nIn the appellant's view, the strict liability of the defendant company would be limited to the environmental damage that occurred within its parcel, but this was not demonstrated at trial. The brief accordingly alleges a violation of the rules of logic, since there is no legal basis to support the conclusion contained in the judgment. Furthermore, the proven facts of the civil action at point three, pages 21 and 22 of the judgment, do not indicate the area covered by the tree cutting, nor the measured area of his client's property.\n\nIn the second ground of appeal, erroneous, insufficient, and contradictory reasoning of the judgment is alleged, along with erroneous assessment of the facts, violation of the rules of sound critical evaluation regarding the weighing of evidence, the principle of necessary derivation, and due process.\n\nThe appellant notes that the trial court acquitted the defendant for absence of a criminal offense, having found it established that he did not exploit the cut trees, since the logging in question was ordered or requested by a person identified as \"[Nombre 027],\" and that exploitation was a necessary element for the offense to be made out. Similarly, the appellant explains that the strict liability claimed against his client is based on his client's failure to fulfill her obligation to ensure that exploitation did not take place through the cutting of the trees — that is, strict liability is attributed for an omission rather than an act.\n\nGiven that the judgment establishes that there was no exploitation on the part of the accused, and states that the latter benefited the landowner, that reasoning is deemed contradictory. This is because, if there was no timber exploitation in favor of his client, there was no omission on his client's part of a duty of oversight, and therefore there is no liability whatsoever to be claimed.\n\nIn this regard, the civil plaintiff's specification of claims defined the type of liability claimed against the civil co-defendant, and the latter, in full exercise of due process, shaped its defense in accordance with that specification.\n\nThis second ground of appeal concludes by noting that the judgment found it established that his client exploited the timber, which constitutes a different fact and would give rise to subjective civil liability (responsabilidad civil subjetiva), thus creating an evident contradiction and inconsistency in the Trial Court's reasoning.\n\nFinally, a third ground of appeal is raised, which the appellant identifies as going to the merits for violation of substantive law, specifically Articles 98, 100, and 101 of the Organic Environmental Law, because the Trial Court failed to analyze the environmental damage from the perspective of causality and attributability.\n\nDefense counsel explains how, between pages 27 and 30 of the judgment, the lower court concluded that his client had to answer under strict liability, which derives from the mere fact of being the owner of the land where the events took place, and that the elements of causality and attributability required for strict liability were present.\n\nThe appellant characterizes that reasoning as erroneous in light of the Organic Environmental Law and the holdings of the Criminal Court of Cassation in rulings No. 2024-00324 and 2022-00437. On that basis, the appellant argues that no participation by his client was demonstrated, whether through any of its officers or any natural person connected to it. In this regard, defense witness [Nombre 002] was clear at trial, together with the defendant — who also testified — that the tree cutting was carried out on the instructions of [Nombre 027], whom they considered to be the manager or caretaker of the property. However, the judgment does not analyze the participation of [Nombre 006], the legal representative of the defendant company.\n\nFurthermore, the appellant criticizes the fact that the events involved a third party wholly unrelated to the civil defendant, while the judgment failed to weigh the causal link and attributability between the omissive conduct of his client and the outcome, condemning the civil defendant solely on account of being the owner of the property. Defense counsel characterizes as erroneous the position adopted in the judgment that any person who causes environmental damage on a property belonging to someone other than its titleholder generates civil liability for that titleholder, notwithstanding the absence of knowledge or consent on the part of his client in this case.\n\nThe act of a third party, in accordance with Art. 702 of the Civil Code and Art. 190 of the General Administrative Law, means that his client bears no liability whatsoever in this matter. The brief requests that the judgment be annulled and the matter remanded with respect to the civil damages award.\n\nVI.- Given that the challenges raised address both the criminal and civil aspects of the judgment, for the sake of order, the claims related to criminal liability will be addressed first; these were raised exclusively by the Attorney General's Office in the first and fourth grounds of its appeal. A subsequent section will address the challenges to the civil portions, which encompass the appeals filed by the technical defense counsel for the civil defendants, as well as the second and third grounds of appeal of the State's legal representative on that subject.\n\nVII.- With regard to the criminal aspects of the matter: The appeal filed by the State's legal representative raises two specific objections, set out in the first and fourth grounds of appeal, which are analyzed below:\n\na) With respect to the first objection, the Attorney General's Office centers its criticism on an erroneous application of substantive law, specifically the fact that the judgment found the conduct of the defendant [Nombre 001] to not constitute the criminal offense of illegal timber harvesting under Art. 61 subsection a) of the Ley Forestal, on the basis that said defendant obtained no benefit from the logging attributed to him. This ground of appeal is granted. In order to better contextualize the ruling this Court of Appeal will issue, it is appropriate to transcribe the charged and complained-of facts in this matter.\n\nIn this regard, the Public Prosecutor's Office charged [Nombre 001] with the following facts:\n\n\"1. On April 7, 2021, at [...], at coordinates [Valor 004], in a sector of secondary forest with succession of more than 25 years on average, the defendant [Nombre 001] was found exploiting forest products on private property without the permits of the State Forest Administration, having cut with a chainsaw approximately 35 trees with average diameters of 6 centimeters and heights of between 2 and 4 meters of the species [...], [...], [...], [...], [...], [...], [...], and [...], with the environmental damage valued at the sum of 27,273,777 million colones.\" (sic)\n\nThe complainant, for its part, charged the defendant with the following factual framework, in the relevant part:\n\n\"FIRST: On April 7, 2021, in the province of [...], on estate [Valor 005], specifically at coordinates [Valor 004], the defendant [Nombre 001], with the intent to obtain a benefit, advantage, utility, or gain for himself or for a third party, illegally exploited, acquired, and possessed forest resources, specifically cutting 35 trees with average diameters of 6 centimeters and heights of between 2 and 4 meters of various species including: [...], [...], [...], [...], Indio [...], [...], [...], [...], [...], [...], and [...], which were located in secondary forest with succession of more than 26 years on average. This was accomplished through the use of a chainsaw and without the required permits from the State Forest Administration.\n\nSECOND: It is clear that the unlawful conduct carried out by the defendant [Nombre 001] caused environmental damage, estimated at twenty-seven million two hundred seventy-three thousand seven hundred seventy-seven colones ($27,273,777), given that by illegally exploiting and processing 35 trees of various species located in secondary forest with succession of more than 25 years on average, he deteriorated the natural resources and their recovery, which had a significant and harmful impact on that ecosystem by affecting the natural conditions of that area, since it eliminated those existing natural resources and their recovery capacity, including the opportunity cost of growth of species inhabiting those exploited trees, causing loss of biodiversity through destructive exploitation and causing the disappearance of biological wealth: flora, fauna, and ecosystems, in addition to carbon losses and replacement costs, impacts on water resources, and loss of scenic beauty, among others.\" (sic)\n\nBased on the foregoing, it is clear that [Nombre 001] was charged with the logging of thirty-five trees of various species located within a secondary forest on the Puntarenas Partido estate registered under folio real [Valor 005], with the intent to exploit the timber product obtained from that action. On this point, the trial court found that the defendant did in fact cut the trees in question, based on the testimonial evidence of SINAC officers [Nombre 026] and [Nombre 004], who, upon arriving at the scene following a citizen complaint, caught the accused in the act of cutting the trees, and observed that he attempted to flee from the Environmental Authority, whereupon the officers told him he had to remain at the scene.\n\nIn addition, the witnesses described the presence of other on-site indicators showing that the logging was recent, such as the presence of sawdust, and the fact that the chainsaw used by the defendant was still warm at the time of its seizure. This is supported by the documentary evidence prepared accordingly, specifically reports No. SINAC-ACOPAC-OSRE-PPC-030-2021 and SINAC-ACOPAC-DR-006-2022 (cf. folios 1 to 7 and 15 to 21 of the main case file).\n\nFurthermore, the Trial Court weighed the defendant's own statement that he proceeded with the logging pursuant to a contract with a third party, specifically [Nombre 027] (now deceased), who identified himself as the manager of the property where the logging took place, and explained that the tree cutting was intended to facilitate a tourist project in the area — an account confirmed at trial by defense witness [Nombre 002], the widow of [Nombre 027].\n\nHowever, despite the evidentiary elements corroborating the act of logging, the trial court found the conduct to not constitute a criminal offense, on the basis of a lack of exploitation of the cut timber by the defendant [Nombre 001]. To that end, the trial court stated:\n\nIt is clear from the foregoing that the person present at the scene was the accused, and the person doing the cutting was the accused; however, under the criminal offense (tipo penal) in question, it is not enough that a person be engaged in cutting — there must also be timber harvesting (aprovechamiento maderable). In that regard, the Public Prosecutor's Office (Ministerio Público) charged [Nombre 001] with having harvested timber on private property without holding the required permits from the State Forest Administration (Administración Forestal del Estado). This harvesting is likewise not established by the totality of the evidentiary record (elenco probatorio) in the present proceedings. Along the same lines, witness [Nombre 004] testified during trial on this point, stating: \"I have been an engineer since 1997 and have worked at SINAC for 25 years. In April 2021, I was posted in Esparza when these events occurred. Our SINAC office in Esparza received a telephone call about a possible tree felling. My colleague [Nombre 026] and I went to the location to verify the situation. At the site we observed recently felled trees with very fresh cuts, of different diameters and different species. I recall there were nance trees, savanna oak (roble sabana), guarumo, guanacaste, chaperno, and some espavel trees. Those were the ones that had been felled. There were about thirty to thirty-six trees. The accused — Mr. [Nombre 001], wearing a brown T-shirt — was the one who was there. The first thing we did was approach the man and tell him to stop the work and ask whether he had a permit for that activity. What was there was the chainsaw on the ground, but it was clear that work had been carried out. From Esparza to Miramar it is about 20 minutes; the entrance is at the cemetery. I believe it was in April, I think on the 21st. It was evident at the site that there were fresh cuts, with fresh sawdust produced by the work being done. We had to walk through the property from the entrance — which has slopes — about fifty to sixty meters. The saw was on the ground when we saw it. The blade of the saw was small, the type used to cut trees. The tool was suitable — fifteen to 20 cm. The total area was 1.6 hectares. He replied that he had been hired to do that work. He was told that a permit was required for it — a permit from the forest administration. Such a permit is a management plan (plan de manejo) and includes the technical components for the management of mature, primary, or secondary forests.\" As is clear from the foregoing, when SINAC officers arrived at the site, the person cutting the trees was the accused; however, from that very first moment it was clear that he was performing work he had been instructed to carry out, and that the accused was not going to obtain an economic benefit from the felling of those trees. The only benefit was the payment he was receiving for his work, which is far removed from what was charged against him in the charging document (pieza acusatoria) — namely, that he had harvested timber on private property. It has not been established through any of the evidence that the accused harvested timber.\" (sic)\n\nWith regard to this matter, this Appellate Chamber (Cámara de apelaciones) finds that the error identified by the appellant does in fact exist, concerning the incorrect application of substantive law. To that end, it is necessary to review the applicable legal framework in the case sub judice, beginning with the criminal offense at issue as set forth in the Ley Forestal:\n\n\"ARTICLE 61.- Imprisonment of one month to three years. A prison term of one month to three years shall be imposed on anyone who: a) Harvests one or more forest products on private property without the permit of the State Forest Administration, or on anyone who, even though holding the permit, does not comply with what has been authorized.\"\n\nIt is clear that this criminal offense contains a normative element (elemento normativo), which corresponds to \"timber harvesting,\" the technical definition of which is provided by the same statutory body under its Article 3, subsection a), which reads:\n\n\"ARTICLE 3.- Definitions. For the purposes of this law, the following are considered: a) Timber harvesting (aprovechamiento maderable): The act of felling or eliminating standing timber trees, or utilizing fallen trees, carried out on private land not included within Article 1 of this law, which generates or may generate some benefit, advantage, profit, utility, or gain for the person who performs it or for whom that person represents.\"\n\nFrom the foregoing statutory provisions, it follows that the benefit derived from timber harvesting on private land through the act of felling manifests itself in multiple forms, which do not in themselves entail an economic advantage or a lucrative aspect strictu sensu, since the benefit may be of another nature. Likewise, it also follows from said provisions that the gain need not necessarily be personal, as it may even accrue to the person represented by whoever carries out the act of felling.\n\nUnder that framework, all of these forms through which the active subject may derive benefit — for themselves or for a third party whose interests they represent — must in turn be analyzed in accordance with the principle of legality and within the scope of Article 1 of the Ley Forestal:\n\n\"This law establishes, as an essential and priority function of the State, to oversee the conservation, protection, and administration of natural forests and the production, harvesting, processing, and promotion of the country's forest resources designated for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources. It shall also oversee the generation of employment and the improvement of the standard of living of the rural population through their effective incorporation into silvicultural activities. By virtue of the public interest and except as provided in Article 18 of this law, the felling or harvesting of forests in national parks, biological reserves, mangroves, protected zones (zonas protectoras), wildlife refuges, and state-owned forest reserves is prohibited.\"\n\nThe purpose of this legislation is aimed at environmental protection (tutela ambiental), with particular emphasis on regulating the harvesting of forest resources, in order to combat precisely the clandestine exploitation of timber resources in prohibited zones — such as forests and riparian buffer zones (áreas de protección de cuerpos de agua). For that reason, the legislation in question specifically governs forest management plans and the granting of the corresponding permits by the Public Administration to those individuals who wish to engage in any type of activity that involves the felling of trees or the use of products derived therefrom.\n\nIn light of the foregoing, assessing the normative element of the criminal offense with respect to the concept of timber harvesting solely from the perspective of whether the person who performed the felling obtained a direct personal pecuniary benefit from the forest product would overlook the correct reading that must be given to Article 3, subsection a) of the Ley Forestal. This is because the advantages that may be obtained by whoever carries out the act of felling — or by the person they represent (if acting under another's orders, as appears to be the case sub judice) — may be of another nature; moreover, the harvesting may be of a potential character, without it being necessary for it to materialize, for example, in the sale of the timber or its transformation into goods such as furniture.\n\nAccordingly, the Trial Chamber (Cámara de Juicio) should have weighed the foregoing considerations in light of the objective elements derived from the body of evidence: i) The accused acted on the orders of a third party; ii) The fact that the felling was ultimately aimed at a tourism development project, according to the defendant himself and his defense witness; iii) Without prejudging the outcome, consideration should have been given to whether the harvesting in question was linked to a subsequent and greater benefit, given that it appears the forest that had been felled constituted an obstacle to the real estate development that was intended; and iv) Related to the foregoing, no weight was given to the testimony of SINAC officers [Nombre 026] and [Nombre 004], who stated that the land where the felling was discovered had already been divided with tape, reflective markers, and other instruments characteristic of topographic surveying work. From all of the above, sight was lost of the fact that the benefit resulting from timber harvesting does not necessarily have to materialize ipso facto at the time of the felling, and the contested judgment overlooked the potential gains that could be obtained in the future, given the background behind the felling in connection with the tourism project allegedly being planned for the property.\n\nThe errors identified above lead to the conclusion that the appellate argument concerning an erroneous application of substantive criminal law has merit, and on that basis the appeal must be granted; the judgment is declared ineffective with respect to the criminal aspects of the ruling, and accordingly the case is remanded (reenvío) for new proceedings on this matter.\n\nb) With regard to the fourth ground of appeal, concerning the failure of the judgment to rule on the request for the forfeiture (comiso) of the chainsaw seized from the accused [Nombre 001], this Appellate Chamber will not issue a ruling on this point, as it is unnecessary given the manner in which the present appeal has been resolved — the nullity of the decision with respect to the criminal aspects of the judgment has been declared, which encompasses the consequences flowing from the alleged offense that is the subject of this litigation, thereby including within the ordered remand a new discussion on the issue of forfeiture.\n\nVIII.- Regarding the civil aspects of the judgment: This section will first address the appeals filed by defense counsel for the accused and civil defendant [Nombre 001] and by the legal representative of civil defendant [Valor 002] Sociedad Anónima.\n\nAlthough, with respect to the criminal action in this case, this Appellate Chamber has declared the ineffectiveness of the decision rendered by the court a quo and has ordered a remand trial for new proceedings on that aspect, it is necessary to issue a separate ruling on the objections raised by the civil defendants in this case. This is done pursuant to the provisions of Article 40, in fine, of the Code of Criminal Procedure (Código Procesal Penal), as well as due to the fact that the reasoning in the judgment regarding the State's indemnification claim presents significant shortcomings in its intellectual and legal foundations that merit analysis.\n\nOn this matter, the first through fourth grounds of the appeal filed by defense counsel for civil defendant [Nombre 001] will be addressed at the outset, along with the second and third grounds of the appeal filed by the representative of the defendant company. This is because those grounds raise matters that are interconnected, relating to an allegedly contradictory and insufficient argument in the judgment regarding the causal link (nexo de causalidad) attributed to both defendants.\n\nOn this point, the grounds so described must be granted. Upon reviewing the section of the contested judgment dedicated to the civil action brought in these proceedings, it is contradictory to have attributed civil liability to civil defendant [Nombre 001] under Article 1045 of the Civil Code (Código Civil) on the basis of a subjective imputation standard. This is because, given that the Trial Chamber determined the conduct of [Nombre 001] as accused of the offense of illegal timber harvesting to be atypical — that is, not constituting a criminal offense — that finding precluded granting the civil action against him on the ground that the commission of an offense was the source of civil liability under Article 1046 of the said code.\n\nAccordingly, the absence of a criminal offense in the case of civil defendant [Nombre 001] precluded granting the indemnification claim for environmental damage (daño ambiental) on the basis of a subjective imputation standard. In that regard, his defense counsel is correct in arguing that the causal link in the case of his client was erroneously determined, inasmuch as, beyond a reference to the fact that [Nombre 001] caused environmental damage by felling the trees, the judgment does not elaborate on the reasons why, having previously found the absence of a criminal offense, it subsequently attributed civil liability to [Nombre 001].\n\nOn the other hand, in the case of civil defendant [Valor 002] S.A., a defect is also observed in the reasoning underlying the attribution of civil liability, since the section on the criminal analysis of the case expressly stated that the illegal timber harvesting was beneficial solely and directly to the defendant company. However, in the section dedicated to the civil analysis, the Trial Chamber reversed that position and grounded the imputation link in Article 101 of the Organic Environmental Law (Ley Orgánica del Ambiente) pursuant to an objective civil liability standard. It then stated that Article 1045 of the Civil Code was applicable in the case sub examine on account of the company's negligence as the owner of the land, attributing subjective civil liability to it.\n\nThe foregoing reveals the defect invoked by the appellant, since the legal reasoning of the judgment is not only contradictory but also fails to adequately explain the basis for such assertions. Furthermore, upon reviewing the pleading of the civil damages action (acción civil resarcitoria) filed by the Attorney General's Office (Procuraduría General de la República) at folio 3, recto and verso, of the civil claim file, it is evident that the plaintiff party set out its indemnification claim for environmental damage on the basis of an objective extracontractual civil liability standard pursuant to the Ley Orgánica del Ambiente, establishing that the defendant company, as the owner of the property where the alleged environmental harm occurred, failed to fulfill its duty of oversight with respect to the activities taking place thereon.\n\nOn the basis of the foregoing, the dispute was joined (se trabó la litis) against the defendant company under that imputation standard, and it was on that basis that the company prepared its defense — making it a surprise to be condemned on the basis of a different, subjective civil liability link under the oft-cited Article 1045. Furthermore, it must be noted that the case law of the First Chamber of the Supreme Court of Justice (Sala Primera de la Corte Suprema de Justicia), in accordance with vote No. 1724-2023 of 9:36 a.m. on October 12, 2023, has held that there is a violation of due process through breach of the defendant's right to a defense when a judgment alters the civil liability imputation link both in its mode of attribution (objective or subjective) and in its normative basis.\n\nThis is because a material modification is generated with respect to the cause of action (causa petendi) of the claimant, which in turn gives rise to a defect of incongruence by granting the relief sought in the claim on the basis of criteria and legal provisions different from those invoked by the plaintiff. On that occasion, that Chamber stated:\n\n\"The implication of modifying the cause of action, the purpose of the evidence, and the claims — which were always based on the elements of subjective liability — in order to apply a different paradigm with different evidentiary requirements is evident, thereby catching the defendant off guard, as it had planned its defense strategy on the basis of the terms of the debate as defined by the plaintiff. This is the sense in which the appellant asserts that, in the present case, the subject matter of the proceedings and what was debated were modified, reversing the burden of proof to the detriment of its client — because, in mounting its defense against a claim based on subjective liability for fault (recklessness and negligence), it was not required to conform to the evidentiary rules of the objective liability regime. Under the legal framing of the claim, it was the exclusive responsibility of the plaintiff to demonstrate, in addition to the existence of the damage and the causal link, the subjective elements of imputation. However, by applying the said legislation and reversing the burden of proof, the defendant was subjected to the provisions of Article 35, on the assumption that the damage arose from the service provided — all within a legal framework proper to consumer relations, with concepts, principles, and institutions that the plaintiff neither raised nor brought into discussion, having founded its claim on a different legal basis, entirely distinct from the one applied. In sum, the decision adopted by the Ad-quem violates the principles of due process, of defense, and of the adversarial system that govern civil proceedings. Likewise, the variation between what was sought in the claim and what was decided in the judgment entails a breach of the principle of congruence and an infringement of Article 155 of the CPC, (…).\"\n\nBy virtue of the foregoing, the first through fourth grounds of the appeal filed by defense counsel for civil defendant [Nombre 001] are granted, as are the second and third grounds of the appeal filed by the legal representative of civil defendant [Valor 002] Sociedad Anónima. Accordingly, the judgment is declared null and void with respect to all civil aspects of the ruling, and a remand is ordered for new proceedings.\n\nAs it is unnecessary, no ruling is made on the fifth ground of the appeal filed by Licenciado Rodríguez Villanueva, nor on the first ground of the appeal filed by Licenciado Marín Pacheco, relating to the discussion concerning the monetary assessment and the scope of environmental damage with respect to the conduct of [Nombre 001] and the extent of the area allegedly affected in relation to the dimensions of the land belonging to the civil defendant company. This is because the nullity of the judgment is being declared with respect to the civil action, which encompasses the amounts awarded and the manner in which they were assessed.\n\nIX.- Regarding the second and third grounds of appeal of the Attorney General's Office (Procuraduría General de la República) pertaining to the civil aspects of the judgment: With regard to the second ground of grievance filed by the State's legal representative, relating to a claim concerning the manner in which interest was assessed on the amounts recognized by the civil damages action, no ruling is made on this point. This is because, in accordance with what was decided in the preceding section, the judgment has been declared ineffective with respect to the civil action brought by the Procuraduría in this case, which encompassed per se the amounts awarded and their accessory components, including the interest item.\n\nWith regard to the third ground of disagreement, relating to the issue of attorney's fees and court costs (costas personales y procesales) arising from the criminal action and the civil claim in this case, given that the judgment has been declared null and void in its entirety — both as to the criminal and civil portions — the ruling with no special costs order issued by the court a quo is rendered ineffective, and accordingly must also be addressed in the remand trial ordered for that purpose.\n\nTHEREFORE:\n\nThe following is resolved: a) The first ground of the appeal filed by the Attorney General's Office (Procuraduría General de la República) is granted; as it is unnecessary, no ruling is made on the second, third, and fourth grounds of that appeal. b) The first through fourth grounds of the appeal filed by defense counsel for civil defendant [Nombre 001] are granted; as it is unnecessary, no ruling is made on the fifth ground of that appeal. c) The second and third grounds of the appeal filed by the legal representative of civil defendant [Valor 002] Sociedad Anónima are granted; in light of how that appeal has been resolved, no ruling is made on the first ground of the appeal. d) The judgment under appeal is annulled and a remand trial is ordered so that, with a different panel, all criminal and civil aspects of the present case may be newly adjudicated, including the matter of costs.
