SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diecisiete horas cuatro minutos del veintidós de julio de dos mil veintiséis.-\n\n PROCESO ORDINARIO planteado por LA ASOCIACIÓN CONSERVACIONISTA DE MONTEVERDE, cédula jurídica tres - cero cero dos - cero siete cinco ocho seis cuatro, representado por su apoderado generalísimo sin límite de suma Yúber Rodríguez Santamaría, mayor, casado, ingeniero forestal, cédula de identidad seis - doscientos cincuenta y cuatro - cuatrocientos sesenta y siete; contra [Nombre 006], [...]; [Nombre 002], [...]; SUCESORIO DE [Nombre 001], quien en vida fue [...], representado por su albacea específico [Nombre 002], [...]; SUCESIÓN DE [Nombre 003], [...], representada por su albacea [Nombre 004], [...]; [Nombre 005], [...]; y LA PROCURADURÍA GENERAL DE LA REPÚBLICA, cédula jurídica dos - cien - setecientos setenta y dos mil ciento cinco, representada por su apoderados especiales judiciales Mauricio Castro Lizano, mayor abogado, cédula de identidad uno - setecientos sesenta y siete - trescientos dos; y José Barahona Vargas mayor abogado, vecino de San Ramón, cédula de identidad dos - dos mil novecientos ochenta y siete - mil trescientos sesenta y uno. Interviene como parte interesada EL INSTITUTO DE DESARROLLO RURAL (INDER), cédula jurídica siete - cero cero cero cero - cuarenta y dos mil ciento cuarenta y tres. Asimismo la parte demandada presentó reconvención contra la parte actora. Actúan como apoderados especiales judiciales de la parte actora reconvenida los licenciados José Pablo Valverde Marín carné dieciséis mil ciento cincuenta y cuatro; y Jeffrey Josue Barahona Vargas, colegiado veintisiete mil quinientos setenta; como defensores públicos de los demandados reconventores [Nombre 005] y Sucesión de [Nombre 003], la letrada Ana Cristina Hernández Steller, colegiada veintitrés mil trescientos setenta y cinco; y de los demandados [Nombre 007], ([Nombre 002]) y [Nombre 006]; el licenciado Daniel Araya González, carné veintisiete mil cincuenta y cuatro. Tramitado ante el Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón.\n\nRESULTANDO:\n\n 1.- La parte actora Asociación Conservacionista de Monteverde plantea proceso ordinario, estimado en la suma de diecinueve millones novecientos cincuenta mil colones, para que en sentencia se declare: “Que la Asociación Conservacionista de Monteverde es legítima y exclusiva poseedora, en calidad de propietaria, de los terrenos que pretenden titular los demandados [Nombre 006], ([Nombre 002]) y [Nombre 001], según lo representan gráficamente los planos catastrados número [Valor 001] (sic), [Valor 002] (sic) y [Valor 003], respectivamente. Que igualmente la Asociación Conservacionista de Monteverde es legítima y exclusiva poseedora, en calidad de propietaria, de los terrenos que pretenden poseer los demandados [Nombre 005] y [Nombre 003], según lo declarado en las informaciones ad-perpetúan tramitadas así: la demandada [Nombre 003], bajo el expediente número 319-96, seguido ante el Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda y el demandado [Nombre 005], bajo el expediente número 346-96, seguido ante el Juzgado Primero de lo Contencioso Administrativo y Civil de Hacienda. Subsidiariamente; solicita se declare que a la Asociación Conservacionista de Monteverde le asiste el mejor derecho de posesión sobre esos mismos terrenos, en exclusión de la que pretenden tener los demandados. 2) Que la Asociación Conservacionista de Monteverde ha ejercido tal posesión con todos los requisitos legales, dando a esos terrenos la correspondiente función social al conservar y defender el bosque, toda vez que se encuentran ubicados en su totalidad dentro de la Zona Protectora Arenal- Monteverde, creada mediante Decretos número 6778-A del 2 de febrero de 1977 y número 20172-MIRENEM del 24 de enero de 1991. 3) Que las compraventas privadas según las cuales los demandados [Nombre 006], ([Nombre 002]) y [Nombre 001] adquirieron esos mismos terrenos son nulas, no solo por la forma, al no haber sido otorgadas en escritura pública, sino por el fondo, en virtud del mejor derecho de posesión que asiste a la Asociación Conservacionista de Monteverde; 4) Que se priva de cualquier valor probatorio o efecto jurídico y en consecuencia se declara nula la prueba que se pretendió recabar en las informaciones ad-perpetuán tramitadas así: de la demandada [Nombre 003], la del expediente número 319-96, seguido ante el Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda y del demandado [Nombre 005], la del expediente número 346-96, seguido ante el Juzgado Primero de lo Contencioso Administrativo y Civil de Hacienda. 5) Que, en consecuencia, las diligencias de información posesoria seguidas ante el juzgado mixto de San Ramón, bajo los siguientes expedientes: 491-96 promovido por [Nombre 006]; 492-96 promovido por ([Nombre 002]) y 493-96 promovido por [Nombre 001], deben darse por terminadas en el estado en que fueron suspendidos; 6) Que los demandados deben pagar ambas costas de este proceso.” (Ver el expediente físico folios 42 al 45).\n\n 2.- Los demandados [Nombre 006], ([Nombre 002]) y [Nombre 001], contestaron negativamente la demanda, no opusieron excepciones. (Ver expediente físico folios 58 a la 61,    68 a la 72, 78 a la 82). Asimismo presentaron reconvención contra La Asociación y solicitaron en sentencia se declare: 1) Que soy la única poseedora del terreno que pretendió titular, de acuerdo al plano catastrado [Valor 031] (sic); 2) Que mi posesión ha sido pública, pacífica, continua y en calidad de dueño, configurándose la posesión apta para la usucapión; 3) Que la compraventa privada realizada y los contratos privados de distribución de derechos de posesión son válidos, tanto por la forma como por el fondo; 4) Que se continúe con las diligencias de información posesoria tramitada bajo el expediente Nº A 491-96 del Juzgado Mixto de San Ramón; 5) Que se condene al actor a pagar las costas personales y procesales de este proceso; 6) Que se declare la nulidad de los planos catastrados de la Asociación Conservacionista números [Valor 013], [Valor 024] y [Valor 015]; 7) Que se inicie si su autoridad lo considera, la demanda penal contra el topógrafo Francisco Reyes Rojas, por el delito de falsedad ideológica, artículo 358 del Código Penal; 8) Que se realice reconocimiento judicial sobre la zona para comprobar la inexactitud de los planos de la actora (Ver en el expediente físico folios   57, 62, 63, 72, 73,    72, 82, 83, 572, 573, 574, 575, 576, 577 ,).\n\n 3.- Asimismo la parte actora reconvenida Asociación Conservacionista Monteverde contesta negativamente y no opone excepciones solo pide se declare sin lugar en todos sus extremos. (Ver en el expediente físico folios 146 y 147).\n\n 4.- La parte demandada [Nombre 003] y [Nombre 005] contestaron en forma negativa y opusieron las excepciones de: Falta de Derecho, Falta de Legitimación Activa y Pasiva, Falta de Interés, Caducidad y prescripción positiva a favor de mi representada y negativa a favor de la actora, así como la desacumulación de pretensiones y acciones, ésta última resuelta en forma interlocutoria, y litis consorcio activa necesaria. (Ver en el expediente físico folio 143, 156 a la 163 y de la pagina 329 a la 341, 391 a la 404, 530 y 532).\n\n5.- La Procuraduría General de la República se apersonó al proceso en defensa de los intereses del Estado y solicita no se perjudique el Patrimonio Natural del Estado, ni se reconozca mediante resolución judicial derechos o posesiones indebidas a las partes sobre los mismos (Ver en el expediente físico folios 156 a la 163).\n\n 6.- Por integración de litis consorcio pasivo necesario, así ordenado por el Tribunal Agrario de San José, mediante Voto 815-F-16 de las dieciséis horas con diecisiete minutos del treinta de agosto del año dos mil dieciséis, la Asociación Conservacionista de Monte Verde procede a la integración de litis contra EL ESTADO y dentro de sus pretensiones solicita: 1) \"Que la Asociación Conservacionista de Monte Verde es legítima y exclusiva poseedora, con mejor derecho de posesión, de los terrenos que pretenden titular los también demandados [Nombre 006], ([Nombre 002]) y [Nombre 001], según los representan gráficamente los planos catastrados número [Valor 001], [Valor 009] y [Valor 003], respectivamente. Que ese derecho de posesión lo ejercita legalmente, aun en contra de los eventuales derechos del Estado. 2) Que igualmente Asociación Conservacionista de Monte Verde, es legítima y exclusivamente poseedora, con mejor derecho de posesión, de los terrenos que pretenden poseer los también demandados [Nombre 005] y [Nombre 003], según lo declarado en las Informaciones ad-perpetuam tramitadas así: la demandada [Nombre 003] , bajo el expediente número 319-9, seguido ante el Juzgado Civil de lo Contencioso Administrativo y Civil de Hacienda. Que ese derecho de posesión lo ejercita legalmente, aun en contra de eventuales derechos del Estado. 3) Que la Asociación Conservacionista de Monte Verde ha ejercido tal posesión con todos los requisitos legales, dando a esos terrenos la correspondiente función social, económica y ambiental, al conservar y defender el bosque, toda vez que se encuentran ubicados en su totalidad dentro de la Zona Protectora Arenal-Monteverde creada mediante Decreto número 20172-Mirenem del 24 de enero de 1991. 4) Que las compraventas privadas según las cuales los demandados [Nombre 006], ([Nombre 002]), [Nombre 001] adquirieron esos mismos terrenos son nulas, no solo por la forma, al no haber sido otorgadas en escritura pública, sino por el fondo, en virtud del mejor derecho de posesión que asiste a la Asociación Conservacionista de Monteverde, aun en contra de los eventuales derechos del Estado. 5) Que se priva de cualquier derecho probatorio o efecto jurídico y en consecuencia se declara nula la prueba que se pretendió recabar en las informaciones ad- perpetuam tramitadas así: de la demandada [Nombre 003] la del expediente número 319-96, seguido ante el Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda y del demandado [Nombre 005], la del expediente número 346-96, seguido ante el Juzgado Primero de lo Contencioso Administrativo y Civil de Hacienda, en virtud del mejor derecho de posesión que le asiste a la Asociación Conservacionista de Monteverde, aun en contra de los eventuales derechos del Estado. 6) Que en consecuencia, las diligencias de información posesoria seguidas ante el juzgado mixto de San Ramón, bajo los siguientes expedientes: 491-96 promovido por [Nombre 006]; 492-96 promovido por ([Nombre 002]) y 493-96 promovido por [Nombre 001], deben darse por terminadas en el estado en que fueron suspendidos; 7) Que los demandados deben de pagar ambas costas de este proceso.\" (Ver expediente físico en gestión de integración de litis consorcio pasivo necesario a folios 2222 al 2231 y sentencia segunda instancia en el expediente electrónico bandeja de documentos asociados de fecha 30/08/2016 11:17:05).\n\n 7.- La Procuraduría General de la República en representación del Estado contestó en forma negativa y opuso las excepciones de: Falta de Legitimación Pasiva y Falta de Derecho. (Ver en expediente electrónico, imágenes de la 138 a la145 y bandeja escritos de fecha 10/10/2016)). \n\n 8.- El licenciado Ignacio Rodríguez Sancho, juez del Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón, en sentencia Nº 2025000245, de las nueve horas con once minutos del dieciséis de setiembre del año dos mil veinticinco, resolvió: POR TANTO: \"Con base en los artículos 50 de la Constitución Política de Costa Rica, 8 y 11 de la Ley de Tierra y Colonización Nº 2825 del 14 de Octubre de 1961, Ley Forestal Nº 7575 del 16 de abril de 1996, Ley de Informaciones Posesorias Nº 5257 del 31 de julio de 1973, artículos 1, 2, 5, 6, 15, 23, 26, 53, 54, y 55 de la Ley de Jurisdicción Agraria, 317 del Código Procesal Civil aplicado supletoriamente, Decreto Ejecutivo Nº 20172-MIRENEM del 24 de enero de 1991, se declara lo siguiente: EN CUANTO A LA DEMANDA DE LA ASOCIACIÓN CONSERVACIONISTA MONTEVERDE: Se rechazan las excepciones de caducidad y prescripción positiva y negativa opuestas por los codemandados [Nombre 005] y [Nombre 003], hoy día su Sucesión. Se acogen las excepciones de falta de legitimación activa y falta de derecho opuestas por los codemandados [Nombre 005] y [Nombre 003], hoy día su Sucesión. Se acogen las excepciones de falta de legitimación pasiva y falta de derecho opuestas por el Estado; se declara parcialmente con lugar la demanda en lo que se dirá y se rechaza en todos sus demás extremos las demás pretensiones principal y subsidiaria, de la demanda contra ellos. Asimismo, por asistirle legitimación y derecho, se acoge parcialmente la demanda en lo que se dirán y se rechaza en todos sus demás extremos las demás pretensiones principal y subsidiaria de la demanda de la Asociación Conservacionista Monteverde contra [Nombre 006], ([Nombre 002]), [Nombre 001]. SE ACOGE ÚNICA Y PARCIALMENTE la demanda en cuanto pretende se declare; nula la prueba que se pretendió recabar en las informaciones ad-perpetuam memorian tramitadas así: de la demandada [Nombre 003], la del expediente número 319-96, seguido ante el Juzgado Segundo de lo Contencioso Administrativo y Civil de Hacienda y del demandado [Nombre 005], la del expediente número 346-96, seguido ante el Juzgado Primero de lo Contencioso Administrativo y Civil de Hacienda. Dicho extremo se acoge en el tanto que si tiene legitimación activa la Asociación actora para pretender esas nulidades. Una vez firme la sentencia se comunicará para lo correspondiente. SE ACOGE ÚNICA Y PARCIALMENTE la demanda en cuanto pretende se declare; que las diligencias de información posesoria seguidas ante el Juzgado Mixto de San Ramón, bajo los siguientes expedientes: 491-96 promovido por [Nombre 006]; 492-96 promovido por ([Nombre 002]) y 493-96 promovido por [Nombre 001], deben darse por terminadas en el estado en que fueron suspendidos. Una vez firme la sentencia se comunicará para lo correspondiente. SOBRE LAS CONTRADEMANDAS O RECONVENCIONES: Por falta de legitimación activa y falta de derecho, se declaran sin lugar en todos sus extremos las reconvenciones de [Nombre 006], ([Nombre 002]) y [Nombre 001] HOY DÍA SU SUCESIÓN, contra la Asociación Conservacionista Monteverde. Se resuelve este proceso, tanto la demanda como las reconvenciones, sin especial condenatoria en costas”. (Ver en el expediente electrónico sentencia primera instancia documentos asociados de fecha16/09/2025 09:11:47)\n\n 9.- La parte actora reconvenida por medio de sus apoderados especiales judiciales José Pablo Valverde Marín y Jeffry Josué Barahona Vargas, interpusieron recurso de apelación con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia, (Ver en el expediente electrónico bandeja de escritos de fecha 24/09/2025).\n\n 10.- En la substanciación del proceso se han observado las prescripciones legales, y no se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo.- \n\n Redacta el juez López Barrantes; y,\n\nCONSIDERANDO:\n\n I. PRUEBA PARA MEJOR RESOLVER: De conformidad con el artículo 52 de la Ley de la Jurisdicción Agraria, se admite la prueba para mejor resolver ofrecida por parte de [Nombre 005], visible en el escrito y documento incorporado al expediente digital el 29 de marzo de 2019 (11:50 a.m, visible en imágenes 348 a 361 de la parte electrónica del expediente), consistente en copia de la resolución administrativa emitida por el Registro Inmobiliario, a las 12 horas del 10 de abril de 2018, dentro del expediente administrativo 2017-1129-RIM, así como el informe emitido por el ingeniero Jairo Solís Salazar, del subproceso de Conciliación Catastral, adscrito al Departamento Catastral Técnico del Registro Inmobiliario, al considerar este Tribunal es prueba útil, pertinente, vinculada a los hechos objeto de debate y al validar la justificación brindada por la Defensa Pública de dicho co demandado, en el sentido de que al momento de aportarla se trataba de prueba nueva que no existía cuando contestó la demanda, ni emitidas las sentencias de primera y segunda instancia, así como, la de la Sala Primera de la Corte Suprema de Justicia. \n\n II. HECHOS PROBADOS: Se avalan los hechos probados 1, 2, 3, 4, 5, 6, 7, 8, 9, 11, 13 y 14, al ser fiel reflejo de las pruebas que constan en el expediente.\n\n Se modifica el hecho probado 10, de la siguiente forma: El señor [Nombre 005] tiene un inmueble inscrito en el Registro Público, Partido de Puntarenas, bajo matrícula número [Valor 029], descrito en el plano catastrado [Valor 012], con una medida de 162 hectáreas 769.92 metros cuadrados, la cual tituló el señor [Nombre 005] en el año 1991 mediante diligencias de información posesoria.\n\n Se adiciona por parte de este Tribunal los siguientes hechos: 15- existe un traslape entre el plano [Valor 012], perteneciente a la finca inscrita matrícula [Valor 029], con respecto a los planos para información posesoria: [Valor 013], [Valor 015], [Valor 015], [Valor 016], [Valor 017] y [Valor 018] (ver informe pericial elaborado por el perito Luis Ángel González Alfaro, visible en los folios 938 a 948, del Tomo III, del expediente físico y su ampliación en los folios 985 a 988, del Tomo IV, del expediente físico; así como el informe técnico emitido por el ingeniero Jairo Solís Salazar, del subproceso de Conciliación Catastral, adscrito al Departamento Catastral Técnico del Registro Inmobiliario, visible en las imágenes 363 a 375, del expediente digital, incorporado el 29 de marzo de 2019). 16- El Registro Inmobiliario emitió la resolución de las 12 horas del 10 de abril de 2018, dentro del expediente administrativo 2017-1129-RIM, y en la parte dispositiva dispuso, entre otras cosas, dar aviso catastral a los planos [Valor 013], [Valor 015], [Valor 015], [Valor 016], [Valor 017] y [Valor 018], al existir inconsistencia de traslape con respecto al plano [Valor 012], perteneciente a la finca inscrita matrícula [Valor 029]. Asimismo, consignó aviso catastral sobre el [Valor 012], por contener inconsistencias señaladas en el error de cierre y la diferencia de medida calculada por su derrotero con la del cuerpo del plano (ver copias de la resolución administrativa en escrito agregado al expediente electrónico el 29 de marzo de 2019, visible en imágenes 351 a 361, del expediente digital).\n\n Se omite pronunciamiento sobre el hecho 12 al no estar vinculado con el objeto de la apelación.\n\n III. HECHOS NO PROBADOS: Se prohíjan los hechos 1 y 3 tenidos como no probados al no existir prueba que los respalde. Se omite pronunciamiento sobre el hecho no probado 2, al no haber sido recurrido.\n\n IV. RECURSO DE APELACIÓN: La parte actora formuló recurso de apelación en contra de la sentencia de primera instancia, según consta en el documento agregado al expediente electrónico en fecha 24 de setiembre de 2025 con base en los siguientes agravios: 1- Indebida valoración de la prueba. En este aspecto separa su reclamo de la siguiente forma: una indebida valoración de la prueba en el hecho probado 13; el hecho no probado como 1; en el probado como 8. Sobre el primer agravio, el cual gira alrededor del hecho probado 13, explica que el fallo apelado determinó que los co demandados [Nombre 005], ([Nombre 002]) y [Nombre 001], aproximadamente desde el año de 1984 han realizado actos posesorios ocasionales, sin exclusión de otras personas en el terreno en conflicto, tales como limpieza de carriles (refiere al hecho probado 13). Asimismo, dice que no se tuvo por acreditado que [Nombre 010] haya poseído el terreno de forma exclusiva, ni a título de dueño, mismos que traspasó a la asociación actora (refiere al hecho no probado 1). En su opinión, considera hubo una indebida valoración del hecho probado 13, al explicar que con las declaraciones que se citan en el hecho no se demostró la conclusión a la cual arriba el Juzgado. Cita que el testigo [Nombre 016] manifestó: “no le consta que si ellos (refiriéndose a los codemandados) tenían la posesión de los terrenos”. Además, dicho testigo, dice, en su declaración aceptó que la única fuente de información sobre los terrenos que midió fueron sus propios clientes. Sostiene que debe considerarse que los planos elaborados por el testigo [Nombre 016] son de la década de los 90, por lo tanto, cuestiona que su testimonio no es útil para acreditar la posesión de los co demandados a partir de 1984, como concluyó la pieza apelada; cita que el testigo [Nombre 016] no logró inscribir los planos puesto que se sobreponían con los planos anteriores de su representada, de manera que, señala que su testimonio en lugar de probar la posesión de los co demandados, se muestra el mejor derecho para su patrocinada. Del mismo modo, sostiene que los testimonios de [Nombre 012], [Nombre 023], [Nombre 014] y [Nombre 015] no son útiles ni pertinentes para tener por probada la posesión de los demandados a partir de 1984. Explica que en el caso de [Nombre 012] se contradijo al indicar que no ha visto a nadie de la Asociación en los terrenos hasta el día de la audiencia de este proceso, pero, posteriormente admitió que en ocasiones había pasado la noche en el rancho de la Asociación, lo que evidencia que su testimonio es complaciente para beneficiar a sus familiares, y no concuerda con la realidad de los hechos. Por esa razón, en su juicio no es prueba idónea para acreditar la posesión de los demandados sobre el terreno en litis, por lo tanto, reitera que el hecho probado 13 debe tenerse por no acreditado. Con relación a la declaración de [Nombre 015] refuta que aceptó que solo ha estado en el terreno dos veces, por ello, acusa que su declaración no es suficiente para concluir que los demandados ejercieron actos posesorios en el inmueble. Asimismo, hace notar que el testigo aceptó no conocer los terrenos de [Nombre 005], y les llama la atención que gran parte de su declaración corresponde a información que recibió de terceros y de los demandados, siendo así, afirma que no es una fuente de información fidedigna. Sobre el testimonio de [Nombre 014] reprocha que éste ha ido al terreno solo en tres ocasiones; y refuta que él reconoció que existen terrenos que pertenecieron a los [Nombre 020], no obstante, este aspecto no fue considerado en el hecho probado 1, lo que en su opinión refleja una falta de coherencia en la valoración de la prueba. Sobre el testimonio de [Nombre 023], desde su perspectiva acredita el mejor derecho de posesión de la entidad actora. En síntesis, afirma que de los testimonios citados, no se puede concluir que los demandados hayan ejercido posesión del terreno en litis desde 1984. Acerca de la indebida valoración en el hecho no probado 1, sostiene que existen sendas declaraciones que determinan la posesión ejercida por [Nombre 010] a título de dueño. Cita a [Nombre 029], [Nombre 014], [Nombre 019] (en su primera declaración), [Nombre 010], [Nombre 020] (de todos los anteriores, trascribe un extracto de sus declaraciones), y a partir de esto, afirma que sí hubo posesión exclusiva por parte del señor [Nombre 010]. Acusa que el tema de la posesión ejercida por la actora sobre los terrenos en disputa fue un aspecto controvertido; no obstante, la sentencia consignó en el hecho probado 8 ese punto de forma muy limitada. En ese sentido, cita los testimonios de [Nombre 020], quien dice trabajó para la actora de 1992 a 1999 (trascribe parte de su declaración que consta en el folio 1593 y lo declarado el 09 de julio de 2019). La declaración de [Nombre 021], del 09 de julio de 2019, quien dice indicó que trabajo para la actora desde el 2001 y hasta el 2022 (trascribe parte de su ponencia). Así también la declaración de [Nombre 022], visible a folio 1606 (trascribe parte de su exposición). Asimismo, afirma que los testigos de los demandados aceptaron la labor de conservación que realiza la Asociación actora, en ese aspecto destaca y trascribe parte de la declaración de [Nombre 023],[Nombre 019] (declaraciones de folio 1429, y la rendida de forma oral el 18 de junio de 2025), y sobre esta declaración en particular destaca que el testigo abordó las acciones de reforestación, mismas que dice fueron obviadas en la valoración de la prueba emitida en el fallo recurrido. A partir de estas declaraciones, y la prueba documental consistente en planos y escrituras, sostiene se acreditó el ejercicio de una posesión real y material procurando la conservación ecológica de los terrenos, mediante patrullajes, mantenimiento, reforestación y presentación de oposiciones a gestiones como las planteadas por los demandados, quienes dice de forma injustificada han intentado titular o reclamar un mejor derecho sobre la zona. Con base en lo anterior, solicita se modifique el hecho probado número 8, a fin de que se aclare que los actos posesorios ejercidos desde 1989, son para conservación. 2- Indebida fundamentación. En relación a este reclamo lo separa así: indebida fundamentación en relación con el acogimiento de la falta de legitimación; y en relación al acogimiento de la falta de derecho. Acerca del primer reclamo en torno a una indebida fundamentación por cuanto acoge una falta de legitimación activa, expresa que resulta clave determinar según explica lo siguiente: que no se acreditó que los demandados [Nombre 005], [Nombre 003], [Nombre 002], [Nombre 001] y [Nombre 006], todos de apellidos [...], ejerzan actos posesorios sobre los terrenos en disputa (refiere a los reclamos sobre la indebida valoración de la prueba en el hecho probado 13); y se ha demostrado que desde 1989 la Asociación ejerce la posesión ecológica sobre la zona objeto del litigio (refiere al hecho probado 8). Afirma que al tomar en consideración esos dos puntos en concreto, es posible determinar la legitimación de la entidad accionante desde dos distintas perspectivas: la primera se deriva de la condición de poseedor sobre los terrenos en disputa, posesión que dice fue adquirida materialmente del antiguo poseedor en el año de 1989, y que posteriormente se formalizó en distintas escrituras públicas de fecha 22 de marzo de 1990. Invoca los cardinales 279 y 284 del Código Civil. Con base en lo anterior, sostiene que se acreditó que la accionante ejerce posesión de los fundos en litis desde 1989, en consecuencia, dice que al transcurrir un año se generó ese derecho a poseer en el año de 1990. Inclusive, dice que esa legitimación cobija a la actora frente al Estado, toda vez que el derecho de posesión se concretó antes de que los terrenos entraran a formar parte de la zona protectora, circunstancia que dice valga señalar fue el resultado de la labor de conservación que ejerce la Asociación, según se reconoce en el considerando del Decreto Ejecutivo número 20172-MIRENEM. A raíz de esos argumentos considera la accionante sí goza de legitimación. Sumado a lo anterior, resalta que el objetivo de la demanda es evitar que terceras personas procuren un reconocimiento de prueba o incluso la titulación para su beneficio particular sobre zonas de terrenos dedicadas a la conservación de recursos naturales. Es decir, la tutela del ambiente. Por esas razones, afirma que cuenta con un interés difuso, en donde su representada puede accionar para que se logre esa protección, máxime existiendo una pasividad del Estado, quien ni siquiera se opuso a las informaciones posesorias. Otro aspecto objeto de reclamo, corresponde a una supuesta indebida fundamentación en relación con el acogimiento de la falta de derecho. Acusa que la sentencia impugnada confundió el objeto de la demanda, por cuanto en las valoraciones aplicó de forma indebida disposiciones sobre la propiedad o usucapión, sin embargo, el objeto de la demanda es simplemente el reconocimiento de un mejor derecho de posesión, sin que ello implique la propiedad o el modo de adquirir la propiedad sobre las áreas en disputa. Señala que se introdujeron aspectos de la posesión civil sin tomar en cuenta la especialidad de la materia que nos ocupa. También, señala que se aplicaron de forma indebida disposiciones sobre la nulidad de los actos jurídicos, aspectos que en todo caso sostiene era ajeno a lo discutido. Acerca de la posesión derivada, afirma que el fallo desmeritó la posesión de la actora que fue transmitida por [Nombre 010], con base en tres aspectos: no se demostró el justo título de la posesión ejercida por el señor [Nombre 020], la posesión de dicha persona y su familia no fue ecológica, y el traspaso de derechos posesorios a favor de la accionante eran nulos, por tratarse de venta de cosa ajena. Sobre el justo título aclara que no está de frente ante un juicio en donde se pretenda adquirir la propiedad, por lo tanto, no era indispensable entrar analizar los presupuestos de la prescripción positiva. Empero, acusa que en materia agraria se ha desarrollado la tesis en cuanto a la usucapión especial agraria que el atributo de la posesión vale por el título en tanto se verifique que se ha cumplido con la función social de la propiedad. En este particular, insiste que con las declaraciones de [Nombre 020] y [Nombre 029], se acreditó que desde la década del setenta el señor [Nombre 010] se dedicó a poseer el terreno en litis. Cita la misma declaración del señor [Nombre 020]. Derivado de ese argumento, sostiene que la posesión se materializó ante actos posesorios como la limpieza de carriles, incluso en algún momento se mantuvo ganado (refiere a la declaración de [Nombre 029]), en otros momentos se realizó repasto y banano para subsistencia (declaración del mismo [Nombre 010]), actos que dice se daban de forma recurrente mensual o quincenalmente; además, de esos actos posesorios se evitaba la cacería y de esos actos se derivó el nombre de quebradas ubicadas en e lugar (declaración de [Nombre 020]). Refiere en ese sentido los testimonios de [Nombre 019] y [Nombre 014], quienes dice reconocen el ejercicio de la posesión a título de dueño por parte de [Nombre 010], lo que, dota de publicidad la posesión ejercida por el señor [Nombre 020]. Asimismo, afirma que deben considerarse las presunciones legales sobre el derecho de posesión que no han sido desvirtuadas, en concreto los artículos 281, 283 y 284 del Código Civil, que reconocen que el derecho de posesión de quien lo ha ejercido de buena fe y en nombre propio, salvo prueba en contrario. Explica que la posesión ejercida por el señor [Nombre 020] fue a través de la conservación y siembra para subsistencia. Además, en torno a los traspasos considera al amparo de los artículos 1063 y 1103 del Código Civil, y por medio del testimonio del señor [Nombre 020], éste ratificó los mismos, por ese motivo son válidos y eficaces desde el punto de vista jurídico. Así las cosas, considera válida la posesión ejercida por el señor [Nombre 020] y su familia, la cual incluso dice fue ejercida durante más de diez años antes de la creación de la zona protectora en el año de 1991 y a través del Decreto Ejecutivo número 20172-MIRENEM de 1991, por consiguiente, considera la sentencia incurrió en una indebida fundamentación, en el tanto no reconoce esa circunstancia. Sumado a lo anterior, reitera que la actora ha ejercido un derecho de posesión ecológica desde 1989, de forma continua, pública y a título de dueña sobre los terrenos en disputa, así como el derecho de poseer desde 1990, según lo reza el artículo 279 del Código Civil. Refiere a ver las declaraciones de [Nombre 029] (folio 1349), [Nombre 019] (folio 1430 y audio del 18 de junio de 2025), [Nombre 020] (folio 1593), [Nombre 022] (folio 1606) y [Nombre 021] (audio del 09 de julio de 2019). La posesión, dice, la ejerce sobre los terrenos graficados en los planos [Valor 013], [Valor 016], [Valor 015], [Valor 025], [Valor 015] y [Valor 036], según fue señalado por el perito nombrado en este proceso, quien afirmó que “Los planos representados por la Asociación Conservacionista si tienen correspondencia con los terrenos poseídos por ella…” (visible a folio 980). Asimismo, indica que esa posesión ha sido pacífica por cuanto no ha mediado violencia. Si bien dice hay personas que alegan un derecho sobre los terrenos, siempre se ha defendido en el marco de la ley. Asimismo sobre este particular, trae a colación los artículos 859 y 860 del Código Civil, los cuales disponen que el poseedor actual que pruebe haberlo sido en una época anterior, tiene a su favor la presunción de haber poseído en el intermedio, asimismo señalan que el derecho a poseer prescribe en un año. Con base en ese aspecto, sostiene que se ha demostrado posesión desde 1989 y los demandados nunca han accionado judicialmente en contra de la actora, por lo tanto, dice que el derecho de posesión de estas personas prescribió. En otro orden de ideas, y sobre la naturaleza demanial de los bienes, dice debe de considerarse lo siguiente: si acreditaron la posesión decenal antes de la afectación creada por el Decreto Ejecutivo, y por otro lado, sostienen que acreditaron el mejor derecho de posesión al poseer el terreno desde 1989, es decir, antes de la afectación referida. Advierte que en el considerando del Decreto Ejecutivo número 20172-MIRENEM de 1991 se reconoció la labor de la Asociación, lo que evidencia que el derecho de posesión procede a la conformación de la zona protectora, y aun de mayor importancia, se acredita que sin la posesión ecológica de los terrenos probablemente la zona protectora no se hubiese ampliado. Como pretensiones de su recurso solicita lo siguiente: “solicito se revoque parcialmente la sentencia número 202500245 de las 09:11 horas del 16 de setiembre del 2025, adicionada por el auto de las 9:05 horas del 18 de setiembre del 2025, a fin de que se rechacen las excepciones de la falta de legitimación y falta de derecho presentadas por los demandados, y en su lugar se declare que: i) la Asociación 19 Conservacionista de Monteverde tiene un mejor derecho de posesión sobre los terrenos que pretenden los demandados [Nombre 006], ([Nombre 002]), [Nombre 030], [Nombre 005] y [Nombre 003], y ii) que ese derecho de posesión lo ejercita legalmente, aún en contra de eventuales derechos del Estado”.\n\n V. SOBRE LO PRETENDIDO EN LA DEMANDA: Esta Cámara de Apelación al hacer una lectura de la demanda (folios 42 a 47, del Tomo I, del expediente físico), así como su integración de litis (folios 2222 a 2227, del Tomo V, del expediente físico), logra comprender que lo peticionado por la parte accionante es una acción de mejor derecho de posesión conocida también como acción publiciana. Lo anterior, tomando en cuenta que el conflicto escala a la vía judicial en el momento en que las personas demandadas pretendían inscribir mediante información posesoria los terrenos en litis, así como, la instauración de procesos de perpetua memoria y las oposiciones que presentó la actora en dichos expedientes (ver hechos 1, 2, 3, 4, 5, 9, 10, según folios 42 a 45, del Tomo I, del expediente físico). La accionante reclamó que es ella quien ha ejercido la posesión derivada y propia del terreno en disputa a través de actos de conservación del ambiente (hechos 6, 7 y 9, del Tomo I del expediente físico). Por otro lado, acusa que las personas demandadas [Nombre 005] y [Nombre 003] levantaron planos para informaciones de perpetua memoria que se sobreponen con los planos de los otros co demandados y demandada que estaban siendo utilizados para las informaciones posesorias que se opuso (ver hecho 11, del Tomo I, del expediente físico). Como parte del elenco de pretensiones se solicitó se les declarara como poseedora legítima, en calidad de propietaria, de los terrenos que pretenden titular los demandados [Nombre 006], [Nombre 002] y [Nombre 001], de apellidos Badilla.; y sobre los terrenos que don [Nombre 005] y doña [Nombre 003], tramitaron la información de perpetua memoria. Gestionaron que se les declare que a dicha actora le asiste el mejor derecho de posesión sobre esos terrenos, con exclusión a los que pretenden los y las demandadas. A partir de ahí, peticionan que se anulen las compraventas por medio de las cuales los y la accionada de apellidos [...], son nulas; y se anule la prueba que se pretendió recabar en las informaciones de perpetua memoria gestionada por [Nombre 005] y [Nombre 003]; y se ordene el archivo de las informaciones posesorias promovidas por los y la demandada de apellidos [...]. Como se puede desprender de esas petitorias la acción principal de la demanda versa sobre una de mejor derecho de posesión, conocida también como acción publiciana. Este Tribunal se ha referido en múltiples ocasiones sobre este tipo de acción, explicando que “La acción publiciana o de mejor derecho de posesión encuentra su fundamento en nuestro ordenamiento jurídico en los artículos 317, 318, 319 y 322, 277 y 286 del Código Civil. Tiende a tutelar a la persona poseedora legítima frente a la ilegítima, con el objeto de que logre la restitución de la posesión de la que ha sido indebi­damente despojada, dado que se reconoce su derecho preferen­te respecto de una poseedora anterior (Sala Primera de la Corte Suprema de Justicia, voto 168 de 06.06.1990). De acuerdo con el criterio de la Sala, esa acción procede cuando se trata de restituir un bien inmueble no inscrito, del cual se ha sido indebidamente despojado y sobre el cual quien pretende ser restituida ostenta un derecho de posesión” (ver votos 31 de 21.05.1993 y 13 de 25.03.1994. También de este Tribunal, el precedente 708 de 15.11.1997). (Lo subrayado, no corresponde a su original). Es decir, ese tipo de acción procede solo para el reclamo de bienes no inscritos. Además, los presupuestos que deben validarse para su procedencia son los siguientes: la legitimación activa, legitimación pasiva e identidad del bien. Respecto al primero consiste en acreditar el actor tener el mejor derecho de posesión que se pretende reivindicar (ver Voto 710- F- 2006 del 27 de setiembre del 2009, Sala Primera). Sobre la legitimación pasiva surge cuando se prueba que la persona demandada posee de forma ilegítima el bien inmueble. La identidad del bien corresponde a la perfecta identidad entre el bien ocupado ilegítimamente y el que reclama la parte accionante. Además, debe valorarse el interés actual y el derecho como presupuestos que deben abordarse en cualquier sentencia.\n\n VI. SOBRE EL CASO EN CONCRETO: Después de valorada la prueba por parte de esta Cámara de Apelación al tenor del artículo 54 de la Ley de la Jurisdicción Agraria se resuelve lo siguiente: como se explicó en el considerando anterior la acción promovida por la accionante es una de mejor derecho de posesión, la cual, también se indicó procede solo para el reclamo de terrenos no inscritos. Así las cosas, uno de los puntos medulares de la demanda y de los reclamos de las partes lo era justamente la ubicación de los terrenos en litis. En ese sentido, el Juzgado a través de la resolución del 16 de julio de 2005 (folio 917, del Tomo III, del expediente físico), nombró al perito Luis Ángel González Alfaro con el fin de elaborar una prueba pericial que se ofreció en el proceso. El perito aceptó el cargo y posteriormente aportó el respectivo informe según se desprende de los folios 938 a 944 del tomo III, de la parte física del expediente. En dicho informe se hizo una investigación de campo, así como un historial documental. En este punto se precisó que en 1987 el señor [Nombre 005], obtuvo un plano catastrado de su propiedad, registrado ante el Catastro Nacional, con el número [Valor 012], con un área de 162 hectáreas, 769.92 metros cuadrados, que luego dio pie a registrar la propiedad con el folio real 6[Valor 029]. Dicha parcela se localizó en el sector B, denominado Bosque Eterno de los niños. Explica que en 1989 se realizaron varios catastros a nombre de personas físicas, a las que la Asociación Conservacionista de Monteverde les compró. Esos planos son los siguientes: [Valor 024], [Valor 025], [Valor 015], [Valor 015], [Valor 013], [Valor 016], [Valor 027], y [Valor 028]. Continúa explicando que todos se localizan en el sector B, según el mosaico de parcelas incorporados en el informe. Por ese motivo, se indica que existe un traslape sobre el plano [Valor 012] (finca inscrita a nombre de [Nombre 005], folio real [Valor 029]), por parte de los planos [Valor 016], [Valor 015], [Valor 013] y [Valor 015] (casi en su totalidad); y con respecto a los planos [Valor 013] y [Valor 015], traslapan la finca de don Roy en áreas muy pequeñas. Luego, explicó que en el año de 1995 se registraron nuevos catastros en la zona, lo que en su opinión viene agravar más la situación, por cuanto ocasionan traslapes a las propiedades adquiridas por la accionante en 1989, los planos en cuestión son los inscritos a nombre de ([Nombre 002]) (plano [Valor 018]), [Nombre 001] ([Valor 003]) y [Nombre 006] ([Valor 031]). Y estos tres planos se ven afectados por el traslape que hacen dos planos más, e inscritos a nombre de [Nombre 005] ([Valor 032]) y [Nombre 003] ([Valor 033]). En el apartado de conclusiones lo siguiente: “ …. Como se ha explicado, a través de todos los documentos catastrales que intervienen dentro del proceso, lo que ha sucedido con el pasar del tiempo, es que ha existido mucho desorden, pareciera que los parceleros no se conocen entre sí, o por lo menos no conocen, no saben, hasta donde llegan sus propios linderos, y el de los demás … Es muy probable que alguno de ellos se ubique dentro de la zona propiedad del señor [Nombre 005], cuando el GPS, nos indicó las coordenadas, siendo estas, [Valor 034]”. El Juzgado dio audiencia de este informe pericial según consta en la resolución del 22 de setiembre de 2005 (folio 949, Tomo III, del expediente físico), y el abogado Álvaro Meza Lazarús solicitó adición al mismo (escrito de folios 963 a 965, Tomo III, del expediente físico). El perito aporta el escrito de aclaración según se observa en los folios 985 a 987, del Tomo IV, del expediente físico. Sin embargo, la adición al informe se enfoca en temas de carriles y calles públicas, pero, el perito reitera el traslape existente con respecto al plano de [Nombre 005], [Valor 035]. El Juzgado confiere audiencia de esa ampliación según auto del 29 de noviembre de 2005 (folio 988, Tomo IV, del expediente físico). Por su parte, el abogado Meza muestra su inconformidad con el informe según se desprende del escrito agregado en los folios 1000 y 1001 del Tomo IV, de la carpeta física. Acorde a esa probanza se concluye que los terrenos reclamados por la parte actora y descritos en los planos [Valor 013], [Valor 016], [Valor 015], [Valor 015], [Valor 025] y [Valor 015], traslapan con el terreno inscrito de la parte demandada [Nombre 005] representado por el plano [Valor 012], con un área de 162 hectáreas, 769.92 metros cuadrados, cuyo folio real es el [Valor 029]. Esa prueba no fue refutada por la parte accionante quien tenía la carga de la prueba en cuanto a que los fundos objeto de su reclamo no estaban inmersos dentro de un inmueble inscrito (artículo 317 del Código Procesal Civil, aplicado supletoriamente de acuerdo a los numerales 6 y 26 de la Ley de la Jurisdicción Agraria). Por lo tanto, su acción carece de derecho. Sumado a esa probanza, existe otra que fue presentada por el mismo co accionado [Nombre 005] y que fue admitida por este Tribunal como prueba para mejor resolver consistente en una copia de la resolución administrativa emitida por el Registro Inmobiliario, a las 12 horas del 10 de abril de 2018, dentro del expediente administrativo 2017-1129-RIM, así como el informe emitido por el ingeniero Jairo Solís Salazar, del subproceso de Conciliación Catastral, adscrito al Departamento Catastral Técnico del Registro Inmobiliario visible en el escrito y documento incorporado al expediente digital el 29 de marzo de 2019 (11:50 a.m, visible en imágenes 348 a 361 de la parte electrónica del expediente). El informe técnico fue elaborado el 2 de abril de 2018 por el ingeniero Solís Salazar. En éste se consignó que, se elaboró un montaje de planos a partir de la ortofoto escala 1:5000, el dibujo de planos fue realizado a partir de la digitación del derrotero excepto por el plano [Valor 012], el cual afirma presenta un error de cierre lineal en su derrotero, por lo cual fue vectorizado. Explica que los planos fueron ubicados según sus colindancias, ubicación geográfica y referencias. Se analizó el montaje aportado por el agrimensor Lyonel Tamayo Rivas, y se determinó que éste incumple con lo estipulado en la circular REM-002-2014. Hace un estudio sobre la finca [Valor 029], la cual establece que nació en mayo gracias a un proceso de información posesoria cuyo plano objeto del trámite fue el [Valor 012]. En el mismo informe se realizó un análisis sobre los planos [Valor 013], [Valor 016], [Valor 015], [Valor 015], [Valor 018] y [Valor 017]. En el apartado final determinó lo siguiente: Según lo observado en el montaje denominado “Lámina 1” , existe traslape entre el plano [Valor 012] (finca [Valor 029]) con los planos para información posesoria [Valor 013], [Valor 016], [Valor 015], [Valor 015], [Valor 018] y [Valor 017]. A partir de ese informe técnico el Registro Nacional mediante resolución administrativa emitida por el Registro Inmobiliario, a las 12 horas del 10 de abril de 2018, dentro del expediente administrativo 2017-1129-RIM, en su parte dispositiva ordenó, entre otras cosas, dar aviso catastral a los planos [Valor 013], [Valor 015], [Valor 015], [Valor 016], [Valor 017] y [Valor 018], al existir inconsistencia de traslape con respecto al plano [Valor 012], perteneciente a la finca inscrita matrícula [Valor 029]. Asimismo, consignó aviso catastral sobre el [Valor 012], por contener inconsistencias señaladas en el error de cierre y la diferencia de medida calculada por su derrotero con la del cuerpo del plano. Con base en lo anterior, no existe duda que los terrenos objeto de reclamo por la Asociación actora están inmersos dentro del inmueble inscrito matrícula [Valor 029], cuyo dueño registral es el señor [Nombre 005]. Así las cosas, la acción de mejor derecho de posesión instaurada por la accionante goza de una falta de derecho al interponerse en contra de una persona propietaria registral. Como se explicó en el considerando anterior, esta acción no es viable para reclamar terrenos inscritos al existir una protección constitucional derivada del artículo 45 de la Constitución Política que consagra el derecho de propiedad, y al ser la posesión un atributo del dominio de acuerdo a lo establecido en el cardinal 264 del Código Civil. Por ese motivo, existe una falta de derecho en la demanda al no prosperar un mejor derecho de posesión sobre terrenos inscritos y cuya demanda se dirigió en contra del titular de ese derecho; y también porque existe una falta de legitimación pasiva al no ser el co accionado [Nombre 005] poseedor ilegítimo de las zonas reclamadas, por el contrario es el propietario de esos inmuebles objeto de esta disputa judicial. Si bien es cierto, la accionante ha ejercido posesión en esos inmuebles, la cual ha sido ampliamente cuestionada por todas las personas demandadas, lo cierto, es que tal ejercicio de posesión no le alcanza para reclamarle a un propietario registral, por ese motivo, carece de legitimación activa (artículo 317 del Código Civil). Es importante mencionar que la actora reclama también el mejor derecho de posesión sobre el plano [Valor 036], el cual no consta que tenga problemas de traslape según el informe pericial y técnico objeto de análisis; no obstante, no existe prueba que demuestre específicamente si ejerció o no posesión sobre este sector en particular, en virtud de que reclamó, pese a que ofreció varios planos para describir el terreno en disputa, la posesión se ejerció sobre la totalidad del inmueble. Por esas razones, la sentencia deberá de ser confirmada, pero, por las razones dadas en esta Instancia y no por las emitidas por el Juzgado. Por la forma en que se resuelve, se omite pronunciamiento sobre los agravios de apelación que giran en torno a una indebida valoración de la prueba y en donde la actora pretendía el reconocimiento pleno del derecho de posesión, y producto de esto obtener legitimación activa y derecho para revocar la sentencia impugnada.\n\n VII. DECISIÓN DEL TRIBUNAL: De conformidad con los artículos 45 de la Constitución Política, 264, 317, 318, 319 y 322, 277 y 286 del Código Civil, 6, 26, 52 y 54 de la Ley de la Jurisdicción Agraria y 317 del Código Procesal Civil, se admite la prueba para mejor resolver ofrecida por [Nombre 005] incorporado al expediente digital el 29 de marzo de 2019. The defendant also filed a counterclaim against the plaintiff. The plaintiff and counterclaim defendant is represented by special judicial attorneys José Pablo Valverde Marín, bar registration number sixteen thousand one hundred fifty-four, and Jeffrey Josue Barahona Vargas, bar registration number twenty-seven thousand five hundred seventy. Public defender Ana Cristina Hernández Steller, bar registration number twenty-three thousand three hundred seventy-five, represents the counterclaimants [Nombre 005] and Estate of [Nombre 003]; and attorney Daniel Araya González, bar registration number twenty-seven thousand fifty-four, represents defendants [Nombre 007] ([Nombre 002]) and [Nombre 006]. The case was heard before the Agrarian Court of the Third Judicial Circuit of Alajuela, San Ramón.\n\nBACKGROUND:\n\n1.- The plaintiff, Asociación Conservacionista de Monteverde, filed an ordinary proceeding, valued at nineteen million nine hundred fifty thousand colones, seeking a judgment declaring: “That Asociación Conservacionista de Monteverde is the lawful and exclusive possessor, as owner, of the lands that defendants [Nombre 006] ([Nombre 002]) and [Nombre 001] seek to register in their names, as graphically represented by cadastral plans number [Valor 001] (sic), [Valor 002] (sic), and [Valor 003], respectively. That Asociación Conservacionista de Monteverde is likewise the lawful and exclusive possessor, as owner, of the lands that defendants [Nombre 005] and [Nombre 003] seek to possess, as declared in the proceedings for perpetuation of testimony conducted as follows: defendant [Nombre 003], under case file number 319-96, before the Second Court of Administrative Litigation and Civil Treasury Matters; and defendant [Nombre 005], under case file number 346-96, before the First Court of Administrative Litigation and Civil Treasury Matters. In the alternative, it requests a declaration that Asociación Conservacionista de Monteverde has the better right of possession over those same lands, to the exclusion of the rights the defendants claim to hold. 2) That Asociación Conservacionista de Monteverde has exercised that possession in compliance with all legal requirements, giving those lands their corresponding social function by conserving and protecting the forest, since they are located entirely within the Arenal-Monteverde Protected Zone, created by Decrees number 6778-A of 2 February 1977 and number 20172-MIRENEM of 24 January 1991. 3) That the private sales agreements under which defendants [Nombre 006] ([Nombre 002]) and [Nombre 001] acquired those same lands are null, not only as to form, because they were not executed in a public deed, but also as to substance, in view of Asociación Conservacionista de Monteverde’s better right of possession; 4) That any evidentiary value or legal effect be denied and, consequently, the evidence that the defendants sought to obtain in the proceedings for perpetuation of testimony conducted as follows be declared null: that of defendant [Nombre 003], under case file number 319-96, before the Second Court of Administrative Litigation and Civil Treasury Matters; and that of defendant [Nombre 005], under case file number 346-96, before the First Court of Administrative Litigation and Civil Treasury Matters. 5) That, consequently, the possessory-information proceedings before the mixed court of San Ramón under the following case files be terminated in the state in which they were suspended: 491-96, filed by [Nombre 006]; 492-96, filed by ([Nombre 002]); and 493-96, filed by [Nombre 001]; 6) That the defendants be ordered to pay both sets of costs of this proceeding.” (See physical case file, pages 42 to 45.)\n\n2.- Defendants [Nombre 006], ([Nombre 002]) and [Nombre 001] answered the complaint denying its allegations and raised no defenses. They also filed a counterclaim against the Association and requested that the judgment declare: 1) That I am the sole possessor of the land I sought to register, according to cadastral plan [Valor 031] (sic); 2) That my possession has been public, peaceful, continuous, and as owner, thereby constituting possession suitable for acquisitive prescription; 3) That the private sale and the private agreements distributing possessory rights are valid as to both form and substance; 4) That the possessory-information proceedings conducted under case file No. A 491-96 of the Mixed Court of San Ramón continue; 5) That the plaintiff be ordered to pay the personal and procedural costs of this proceeding; 6) That the Asociación Conservacionista cadastral plans numbered [Valor 013], [Valor 024] and [Valor 015] be declared null; 7) That, if the Court considers it appropriate, criminal proceedings be initiated against surveyor Francisco Reyes Rojas for the offense of ideological falsehood under Article 358 of the Penal Code; 8) That a judicial inspection of the area be conducted to verify the inaccuracy of the plaintiff’s plans. (See physical case file, pages 57, 62, 63, 72, 73, 72, 82, 83, 572, 573, 574, 575, 576, 577.)\n\n3.- The plaintiff and counterclaim defendant, Asociación Conservacionista Monteverde, also answered denying the allegations and raised no defenses, requesting only that the counterclaim be dismissed in its entirety. (See physical case file, pages 146 and 147.)\n\n4.- Defendants [Nombre 003] and [Nombre 005] answered in the negative and raised the following defenses: lack of right, lack of active and passive standing, lack of interest, lapse and positive acquisitive prescription in favor of my client and negative prescription in favor of the plaintiff, as well as severance of claims and causes of action, the latter having been resolved by interlocutory ruling, and necessary active joinder of parties. (See physical case file, page 143, pages 156 to 163, pages 329 to 341, pages 391 to 404, and pages 530 and 532.)\n\n5.- The Procuraduría General de la República appeared in the proceeding to defend the interests of the State and requested that the State’s Natural Heritage not be harmed and that no improper rights or possessory rights over the lands at issue be recognized to the parties by judicial ruling. (See physical case file, pages 156 to 163.)\n\n6.- Following the necessary joinder of defendants ordered by the Agrarian Court of San José in Ruling 815-F-16, issued at sixteen hours and seventeen minutes on 30 August 2016, Asociación Conservacionista de Monte Verde proceeded to join the STATE as a party and included the following claims: 1) “That Asociación Conservacionista de Monte Verde is the lawful and exclusive possessor, with the better right of possession, of the lands that the co-defendants [Nombre 006] ([Nombre 002]) and [Nombre 001] also seek to register in their names, as graphically represented by cadastral plans number [Valor 001], [Valor 009] and [Valor 003], respectively. It exercises that right of possession lawfully, even against any rights the State may have. 2) That Asociación Conservacionista de Monte Verde is likewise the lawful and exclusive possessor, with the better right of possession, of the lands that co-defendants [Nombre 005] and [Nombre 003] also seek to possess, as declared in the proceedings for perpetuation of testimony conducted as follows: defendant [Nombre 003], under case file number 319-9, before the Civil Court of Administrative Litigation and Civil Treasury Matters. (See electronic case file, images 138 to 145 and the pleadings folder, filing dated 10/10/2016.)\n\n8.- Attorney Ignacio Rodríguez Sancho, judge of the Agrarian Court of the Third Judicial Circuit of Alajuela, San Ramón, in Judgment No. 2025000245, issued at nine hours and eleven minutes on 16 September 2025, ruled as follows: THEREFORE: “Pursuant to Articles 50 of the Political Constitution of Costa Rica; 8 and 11 of the Land and Colonization Law No. 2825 of 14 October 1961; Forest Law No. 7575 of 16 April 1996; Possessory Information Law No. 5257 of 31 July 1973; Articles 1, 2, 5, 6, 15, 23, 26, 53, 54, and 55 of the Agrarian Jurisdiction Law; 317 of the Civil Procedure Code, applied supplementally; and Executive Decree No. 20172-MIRENEM of 24 January 1991, the following is declared: AS TO THE COMPLAINT OF ASOCIACIÓN CONSERVACIONISTA MONTEVERDE: The defenses of lapse and positive and negative prescription raised by co-defendants [Nombre 005] and [Nombre 003], now deceased and represented by their Estate, are dismissed. The defenses of lack of active standing and lack of right raised by co-defendants [Nombre 005] and [Nombre 003], now represented by their Estate, are upheld. The defenses of lack of passive standing and lack of right raised by the State are upheld. The complaint is partially granted as set out below and all other principal and alternative claims against them are dismissed. Likewise, because the Association has standing and a right to sue, the complaint against [Nombre 006], ([Nombre 002]) and [Nombre 001] is partially granted as set out below, and all other principal and alternative claims are dismissed. This proceeding, including both the complaint and the counterclaims, is resolved without a special order as to costs.” (See first-instance judgment in the electronic case file, associated documents, dated 16/09/2025 09:11:47.)\n\n9.- The plaintiff and counterclaim defendant, through its special judicial attorneys José Pablo Valverde Marín and Jeffry Josué Barahona Vargas, filed an appeal expressly stating the grounds relied on to challenge the trial court’s position. (See electronic case file, pleadings folder, dated 24/09/2025.)\n\n10.- The legal requirements have been observed in the conduct of the proceeding, and no errors or omissions capable of invalidating the judgment are apparent.\n\nDrafted by Judge López Barrantes; and,\n\nREASONS:\n\nI. EVIDENCE FOR A BETTER-INFORMED DECISION: Pursuant to Article 52 of the Agrarian Jurisdiction Law, the evidence for a better-informed decision offered by [Nombre 005] is admitted. It appears in the pleading and document added to the digital case file on 29 March 2019 (11:50 a.m., visible in images 348 to 361 of the electronic portion of the case file) and consists of a copy of the administrative decision issued by the Real Estate Registry at 12:00 on 10 April 2018 in administrative case file 2017-1129-RIM, as well as the report issued by engineer Jairo Solís Salazar of the Cadastral Reconciliation subprocess, under the Technical Cadastral Department of the Real Estate Registry. This Court considers it useful, relevant evidence connected to the facts in dispute and accepts the justification provided by the Public Defender’s Office for that co-defendant: when it was submitted, the evidence was new and did not exist when the complaint was answered or when the first- and second-instance judgments, or the judgment of the First Chamber of the Supreme Court of Justice, were issued.\n\nII. FACTS PROVEN: Proven facts 1, 2, 3, 4, 5, 6, 7, 8, 9, 11, 13 and 14 are upheld, as they faithfully reflect the evidence in the case file.\n\nProven fact 10 is amended as follows: Mr. [Nombre 005] owns a property registered in the Public Registry, Puntarenas District, under registration number [Valor 029], described in cadastral plan [Valor 012], measuring 162 hectares and 769.92 square meters. Mr. [Nombre 005] registered title to it in 1991 through possessory-information proceedings.\n\nThis Court adds the following facts: 15- There is an overlap between plan [Valor 012], pertaining to property registered under number [Valor 029], and the plans for possessory information: [Valor 013], [Valor 015], [Valor 015], [Valor 016], [Valor 017] and [Valor 018] (see expert report prepared by expert Luis Ángel González Alfaro, appearing at pages 938 to 948 of Volume III of the physical case file and its supplement at pages 985 to 988 of Volume IV of the physical case file; and the technical report issued by engineer Jairo Solís Salazar of the Cadastral Reconciliation subprocess, under the Technical Cadastral Department of the Real Estate Registry, visible in images 363 to 375 of the digital case file, added on 29 March 2019). 16- The Real Estate Registry issued a decision at 12:00 on 10 April 2018 in administrative case file 2017-1129-RIM. In its operative part, among other things, it ordered a cadastral notice be placed on plans [Valor 013], [Valor 015], [Valor 015], [Valor 016], [Valor 017] and [Valor 018] because of an inconsistency arising from overlap with plan [Valor 012], pertaining to property registered under number [Valor 029]. It also recorded a cadastral notice on [Valor 012] because it contained inconsistencies involving a closure error and the difference between the measurement calculated from its traverse and the measurement stated in the plan body (see copies of the administrative decision in the pleading added to the electronic case file on 29 March 2019, visible in images 351 to 361 of the digital case file).\n\nNo ruling is made on fact 12 because it is not connected to the subject of the appeal.\n\nIII. FACTS NOT PROVEN: Facts 1 and 3, deemed not proven, are upheld because no evidence supports them. No ruling is made on fact 2, as it was not appealed.\n\nIV. APPEAL: The plaintiff appealed the first-instance judgment, as shown in the document added to the electronic case file on 24 September 2025, on the following grounds: 1- Improper assessment of the evidence. The plaintiff divides this complaint as follows: improper assessment of the evidence concerning proven fact 13, fact 1 deemed not proven, and proven fact 8. As to the first ground, concerning proven fact 13, the plaintiff explains that the appealed judgment determined that the co-defendants [Nombre 005], ([Nombre 002]) and [Nombre 001] had, approximately since 1984, occasionally carried out acts of possession, without excluding other people from the disputed land, such as clearing paths (referring to proven fact 13). The plaintiff also says it was not established that [Nombre 010] had possessed the land exclusively or as owner, and that he transferred it to the plaintiff Association (referring to fact 1 deemed not proven). In its view, proven fact 13 was improperly assessed because the cited testimony did not establish the conclusion reached by the Court. It cites witness [Nombre 016], who stated: “I cannot say whether they (referring to the co-defendants) possessed the lands.” The plaintiff also says that the witness acknowledged in his testimony that his only source of information about the lands he surveyed was his own clients. It argues that the plans prepared by witness [Nombre 016] date from the 1990s and therefore questions whether his testimony can establish the co-defendants’ possession from 1984, as the appealed judgment concluded. It notes that witness [Nombre 016] was unable to register the plans because they overlapped with earlier plans belonging to its client, and argues that his testimony therefore demonstrates its client’s better right rather than proving the co-defendants’ possession. It likewise argues that the testimony of [Nombre 012], [Nombre 023], [Nombre 014] and [Nombre 015] is neither useful nor relevant to establish the defendants’ possession from 1984. It explains that [Nombre 012] contradicted himself by saying he had never seen anyone from the Association on the lands before the hearing in this proceeding, but later admitted that he had sometimes spent the night at the Association’s ranch. This shows, the plaintiff says, that his testimony was tailored to benefit his relatives and does not accord with the facts. For that reason, in its view, the testimony is not suitable to establish the defendants’ possession of the land in dispute, and it reiterates that proven fact 13 should be deemed unproven. As to the testimony of [Nombre 015], the plaintiff points out that he acknowledged having been on the land only twice and argues that his testimony is insufficient to conclude that the defendants carried out acts of possession on the property. It also notes that the witness admitted he did not know [Nombre 005]’s lands, and says it is striking that much of his testimony consisted of information received from third parties and the defendants, so he is not a reliable source of information. As to the testimony of [Nombre 014], the plaintiff objects that he had been to the land only three times. It also points out that he acknowledged there were lands belonging to the [Nombre 020], an aspect not addressed in proven fact 1, which in its view reflects an inconsistency in the assessment of the evidence. In the plaintiff’s view, the testimony of [Nombre 023] establishes the plaintiff entity’s better right of possession. In short, it argues that the cited testimony does not support the conclusion that the defendants possessed the land in dispute from 1984. Regarding the improper assessment of fact 1 deemed not proven, the plaintiff argues there is extensive testimony establishing that [Nombre 010] possessed the land as owner. It cites [Nombre 029], [Nombre 014], [Nombre 019] (in his first testimony), [Nombre 010], and [Nombre 020] (transcribing an excerpt from each of their testimony), and on that basis argues that Mr. [Nombre 010] did have exclusive possession. It objects that the plaintiff’s possession of the disputed lands was a contested issue, yet the judgment addressed it only very narrowly in proven fact 8. In that connection, it cites the testimony of [Nombre 020], who says he worked for the plaintiff from 1992 to 1999 (transcribing part of his testimony appearing at page 1593 and what he stated on 9 July 2019). It also cites the testimony of [Nombre 021] on 9 July 2019, who said he worked for the plaintiff from 2001 to 2022 (transcribing part of his testimony), as well as the testimony of [Nombre 022], appearing at page 1606 (transcribing part of his account). The plaintiff also argues that the defendants’ witnesses acknowledged the conservation work carried out by the plaintiff Association. In this regard, it highlights and transcribes part of the testimony of [Nombre 023] and [Nombre 019] (testimony at page 1429 and the oral testimony given on 18 June 2025). In particular, it highlights that this witness addressed reforestation efforts, which it says were omitted from the assessment of the evidence in the appealed judgment. Based on that testimony and documentary evidence consisting of plans and deeds, the plaintiff argues that it established actual, material possession aimed at ecological conservation of the lands, through patrols, maintenance, reforestation, and objections to applications such as those filed by the defendants, who, it says, have unjustifiably attempted to register title to the area or claim a better right to it. On that basis, it requests that proven fact 8 be amended to clarify that the acts of possession exercised from 1989 were for conservation purposes. 2- Inadequate reasoning. The plaintiff divides this complaint as follows: inadequate reasoning for upholding the defense of lack of standing, and inadequate reasoning for upholding the defense of lack of right. As to the first complaint, concerning the allegedly inadequate reasoning for upholding lack of active standing, the plaintiff says it is essential to determine the following: that it was not established that defendants [Nombre 005], [Nombre 003], [Nombre 002], [Nombre 001] and [Nombre 006], all with the surname [...], carried out acts of possession over the disputed lands (referring to its complaints about the improper assessment of evidence concerning proven fact 13); and that since 1989 the Association has exercised ecological possession over the area in dispute (referring to proven fact 8). It argues that these two points make it possible to establish the plaintiff entity’s standing from two distinct perspectives. The first arises from its status as possessor of the disputed lands, which it says it physically acquired from the former possessor in 1989 and later formalized in several public deeds dated 22 March 1990. It invokes Articles 279 and 284 of the Civil Code. On that basis, it argues that it established possession of the lands in dispute from 1989 and, after one year, acquired the right to possess in 1990. It also says that this standing applies against the State, since the right of possession was established before the lands became part of the protected zone, which, it notes, resulted from the Association’s conservation work, as recognized in the preamble to Executive Decree number 20172-MIRENEM. Based on these arguments, the plaintiff considers that it does have standing. In addition, it emphasizes that the purpose of the complaint is to prevent third parties from obtaining recognition of evidence or even title for their own benefit over areas dedicated to conserving natural resources—in other words, to protect the environment. For those reasons, it argues that it has a diffuse interest that allows it to bring an action to obtain that protection, particularly given the State’s inaction, as it did not even oppose the possessory-information proceedings. Another issue raised is the allegedly inadequate reasoning for upholding the defense of lack of right. The plaintiff argues that the challenged judgment confused the subject of the complaint because its analysis improperly applied provisions on ownership or acquisitive prescription, whereas the complaint seeks only recognition of a better right of possession, without implying ownership or a means of acquiring ownership of the disputed areas. It says the judgment introduced issues concerning civil possession without taking into account the specialized nature of the matter before the Court. It also says the judgment improperly applied provisions on nullity of legal acts, an issue which, in any event, it argues was unrelated to the dispute. As to derivative possession, the plaintiff argues that the judgment discounted the plaintiff’s possession transferred by [Nombre 010] on three grounds: just title for the possession exercised by Mr. [Nombre 020] was not proven; that person and his family did not possess the land for ecological purposes; and the transfer of possessory rights to the plaintiff was null because it involved the sale of property belonging to another. Regarding just title, the plaintiff clarifies that this is not an action seeking to acquire ownership, and therefore it was not necessary to analyze the requirements for positive prescription. Nevertheless, it argues that agrarian law has developed the position that, under special agrarian acquisitive prescription, possession itself serves as title when the social function of property has been fulfilled. In this regard, it reiterates that the testimony of [Nombre 020] and [Nombre 029] established that, since the 1970s, Mr. [Nombre 010] had possessed the land in dispute. It cites the same testimony of Mr. [Nombre 020]. On this basis, it argues that possession was manifested through acts such as clearing paths; at one point there was also livestock (referring to the testimony of [Nombre 029]); at other times the land was used for pasture and bananas for subsistence (testimony of [Nombre 010]). It says these acts occurred regularly, monthly or every two weeks, and that the acts also prevented hunting and gave rise to the names of streams located in the area (testimony of [Nombre 020]). It refers in this regard to the testimony of [Nombre 019] and [Nombre 014], who, it says, acknowledge that [Nombre 010] possessed the land as owner, thereby making Mr. [Nombre 020]’s possession public. It also argues that the legal presumptions concerning the right of possession have not been rebutted, specifically those in Articles 281, 283 and 284 of the Civil Code, which recognize the right of possession of a person who has possessed in good faith and in their own name, unless there is evidence to the contrary. It explains that Mr. [Nombre 020] possessed the land through conservation and planting for subsistence. Further, regarding the transfers, it considers them valid and effective as a matter of law under Articles 1063 and 1103 of the Civil Code, and because Mr. [Nombre 020] confirmed them in his testimony. Accordingly, it considers the possession exercised by Mr. [Nombre 020] and his family valid, and says it was exercised for more than ten years before the protected zone was created in 1991 by Executive Decree number 20172-MIRENEM of 1991. It therefore considers that the judgment was inadequately reasoned because it failed to recognize this circumstance. In addition, the plaintiff reiterates that since 1989 it has continuously and publicly exercised an ecological right of possession over the disputed lands as owner, as well as the right to possess since 1990 under Article 279 of the Civil Code. It refers to the testimony of [Nombre 029] (page 1349), [Nombre 019] (page 1430 and audio recording of 18 June 2025), [Nombre 020] (page 1593), [Nombre 022] (page 1606), and [Nombre 021] (audio recording of 9 July 2019). It says its possession covers the lands shown in plans [Valor 013], [Valor 016], [Valor 015], [Valor 025], [Valor 015] and [Valor 036], as indicated by the expert appointed in this proceeding, who stated that “The plans represented by Asociación Conservacionista do correspond to the lands it possesses…” (appearing at page 980). It also says that possession has been peaceful because no violence was involved. Although some people claim rights over the lands, the plaintiff says it has always defended its rights within the law. On this point, it also cites Articles 859 and 860 of the Civil Code, which provide that a current possessor who proves having possessed at an earlier time is presumed to have possessed in the intervening period, and that the right to possess prescribes in one year. On that basis, it argues that possession since 1989 has been established and the defendants have never brought a judicial action against the plaintiff, so their right of possession has prescribed. Separately, as to the public-domain nature of the property, the plaintiff says the following must be considered: it established possession for ten years before the effect created by the Executive Decree, and it also established a better right of possession by possessing the land since 1989, before that designation. It notes that the preamble to Executive Decree number 20172-MIRENEM of 1991 recognized the Association’s work, demonstrating that the right of possession predates the establishment of the protected zone. More importantly, it says this establishes that without ecological possession of the lands, the protected zone probably would not have been expanded. The plaintiff requests the following relief in its appeal: “I request that judgment number 202500245, issued at 09:11 hours on 16 September 2025 and supplemented by the order issued at 9:05 hours on 18 September 2025, be partially reversed so that the defenses of lack of standing and lack of right raised by the defendants are dismissed and, instead, it be declared that: i) Asociación Conservacionista de Monteverde has a better right of possession over the lands claimed by defendants [Nombre 006], ([Nombre 002]), [Nombre 030], [Nombre 005] and [Nombre 003]; and ii) it exercises that right of possession lawfully, even against any rights the State may have.”\n\nV. AS TO THE RELIEF SOUGHT IN THE COMPLAINT: Upon reviewing the complaint (pages 42 to 47 of Volume I of the physical case file), as well as the joinder of parties (pages 2222 to 2227 of Volume V of the physical case file), this Court of Appeal understands that the plaintiff brought an action for a better right of possession, also known as a possessory action. This is so because the dispute entered the judicial system when the defendants sought to register title to the lands in dispute through possessory-information proceedings, as well as through proceedings for perpetuation of testimony, and the objections the plaintiff filed in those cases (see facts 1, 2, 3, 4, 5, 9 and 10, pages 42 to 45 of Volume I of the physical case file). The plaintiff claimed that it had exercised both derivative and original possession of the land in dispute through acts of environmental conservation (facts 6, 7 and 9, Volume I of the physical case file). It also alleges that defendants [Nombre 005] and [Nombre 003] prepared plans for proceedings for perpetuation of testimony that overlap with the plans of the other co-defendants and defendant, which were being used in the possessory-information proceedings that the plaintiff opposed (see fact 11, Volume I of the physical case file). Among the claims, the plaintiff requested a declaration that it is the lawful possessor, as owner, of the lands defendants [Nombre 006], [Nombre 002] and [Nombre 001], surnamed Badilla, seek to register; and of the lands for which Mr. [Nombre 005] and Ms. [Nombre 003] pursued proceedings for perpetuation of testimony. It requested a declaration that it has the better right of possession over those lands, to the exclusion of the rights claimed by the defendants. It therefore seeks to have the sales agreements by which the defendants surnamed [...] acquired the lands declared null; to have the evidence sought in the proceedings for perpetuation of testimony pursued by [Nombre 005] and [Nombre 003] declared null; and to have the possessory-information proceedings brought by the defendants surnamed [...] closed. As can be seen from these claims, the principal action in the complaint concerns a better right of possession, also known as a possessory action. This Court has addressed this type of action on numerous occasions, explaining that “The possessory action, or action for a better right of possession, is grounded in our legal system in Articles 317, 318, 319 and 322, and 277 and 286 of the Civil Code. It protects the lawful possessor against the unlawful possessor, with the aim of securing restitution of possession from which the former was improperly dispossessed, since the lawful possessor’s preferential right over that of a prior possessor is recognized (First Chamber of the Supreme Court of Justice, ruling 168 of 06.06.1990). According to the Chamber’s position, this action is available to recover unregistered real property from which a person has been improperly dispossessed and over which the person seeking restitution holds a right of possession” (see rulings 31 of 21.05.1993 and 13 of 25.03.1994. See also this Court’s precedent 708 of 15.11.1997). (Emphasis not in the original.) In other words, this type of action is available only to claim unregistered property. In addition, the requirements for granting it are: active standing, passive standing, and identity of the property. As to the first requirement, the plaintiff must establish that it has the better right of possession it seeks to vindicate (see Ruling 710-F-2006 of 27 September 2009, First Chamber). Passive standing arises when it is proven that the defendant unlawfully possesses the real property. Identity of the property requires that the unlawfully occupied property and the property claimed by the plaintiff be exactly the same. The Court must also assess current interest and right as requirements to be addressed in every judgment.\n\nVI. THE SPECIFIC CASE: After assessing the evidence under Article 54 of the Ley de la Jurisdicción Agraria, this Court of Appeal rules as follows: As explained in the preceding section of the reasons, the claimant’s action is one for a better right of possession (mejor derecho de posesión), which, as also indicated, is available only to claim unregistered land. Accordingly, one of the central issues in the complaint and the parties’ claims was the location of the land in dispute. In that regard, by order of 16 July 2005 (folio 917, Volume III of the physical case file), the court appointed expert Luis Ángel González Alfaro to prepare an expert report offered as evidence in the proceedings. The expert accepted the appointment and later submitted the corresponding report, as shown at folios 938 to 944 of Volume III of the physical case file. The report included a field investigation as well as a documentary history. It specified that in 1987 Mr. [Nombre 005] obtained a cadastral survey plan for his property, registered with the National Cadastre under number [Valor 012], covering 162 hectares, 769.92 square meters, which later led to registration of the property under folio real 6[Valor 029]. That parcel was located in Sector B, known as Bosque Eterno de los niños. The report explains that in 1989 several cadastral plans were prepared in the names of individuals, from whom the Asociación Conservacionista de Monteverde purchased land. Those plans are: [Valor 024], [Valor 025], [Valor 015], [Valor 015], [Valor 013], [Valor 016], [Valor 027], and [Valor 028]. It goes on to explain that all are located in Sector B, according to the parcel mosaic included in the report. For that reason, it states that there is an overlap with plan [Valor 012] (the property registered in the name of [Nombre 005], folio real [Valor 029]) by plans [Valor 016], [Valor 015], [Valor 013], and [Valor 015] (almost in their entirety); and that plans [Valor 013] and [Valor 015] overlap Mr. Roy’s property in very small areas. The report then explains that new cadastral plans were registered in the area in 1995, which in the expert’s opinion further aggravates the situation because they overlap properties acquired by the claimant in 1989. The plans in question are those registered in the names of ([Nombre 002]) (plan [Valor 018]), [Nombre 001] ([Valor 003]), and [Nombre 006] ([Valor 031]). These three plans are affected by the overlap of two additional plans registered in the names of [Nombre 005] ([Valor 032]) and [Nombre 003] ([Valor 033]). The conclusions section states: “…. As explained, across all the cadastral documents involved in the proceedings, what has happened over time is that there has been considerable disorder. It appears that the parcel holders do not know one another, or at least do not know where their own boundaries and those of others end … It is very likely that some of them are located within the area owned by Mr. [Nombre 005], where the GPS gave us the following coordinates: [Valor 034].”\n\nThe court gave notice of this expert report, as shown in the order of 22 September 2005 (folio 949, Volume III of the physical case file), and attorney Álvaro Meza Lazarús requested that it be supplemented (filing at folios 963 to 965, Volume III of the physical case file). The expert submitted a written clarification, as shown at folios 985 to 987 of Volume IV of the physical case file. However, the supplement to the report focuses on lanes and public roads, while the expert reiterates the existing overlap with plan [Nombre 005], [Valor 035]. The court gave notice of that supplement under the order of 29 November 2005 (folio 988, Volume IV of the physical case file). Attorney Meza, for his part, expressed disagreement with the report, as shown in the filing at folios 1000 and 1001 of Volume IV of the physical file.\n\nOn the basis of that evidence, it is concluded that the land claimed by the claimant and described in plans [Valor 013], [Valor 016], [Valor 015], [Valor 015], [Valor 025], and [Valor 015] overlaps the defendant [Nombre 005]’s registered property, represented by plan [Valor 012], covering 162 hectares, 769.92 square meters, whose folio real is [Valor 029]. The claimant did not refute that evidence, despite bearing the burden of proof to show that the properties at issue in its claim were not part of a registered property (Article 317 of the Código Procesal Civil, applied supplementally pursuant to Articles 6 and 26 of the Ley de la Jurisdicción Agraria). Therefore, its action has no legal basis.\n\nIn addition to that evidence, there is other evidence submitted by co-defendant [Nombre 005] and admitted by this Court as evidence for further consideration: a copy of the administrative decision issued by the Registro Inmobiliario at 12:00 on 10 April 2018 in administrative file 2017-1129-RIM, and the report issued by engineer Jairo Solís Salazar of the Cadastral Reconciliation sub-process, under the Technical Cadastral Department of the Registro Inmobiliario, appearing in the filing and document added to the digital case file on 29 March 2019 (11:50 a.m., visible in images 348 to 361 of the electronic case file). Engineer Solís Salazar prepared the technical report on 2 April 2018. It records that a composite of plans was prepared using the 1:5000-scale orthophoto; the plans were drawn by digitizing their traverse data, except for plan [Valor 012], which, the report states, has a linear closure error in its traverse and was therefore vectorized. It explains that the plans were positioned according to their adjoining properties, geographic location, and references. The composite submitted by surveyor Lyonel Tamayo Rivas was analyzed and found not to comply with circular REM-002-2014. The report examines property [Valor 029] and states that it originated in May through possessory information proceedings, for which the plan involved was [Valor 012]. The same report analyzes plans [Valor 013], [Valor 016], [Valor 015], [Valor 015], [Valor 018], and [Valor 017]. In its final section, it determined the following: According to what was observed in the composite entitled “Sheet 1,” plan [Valor 012] (property [Valor 029]) overlaps the plans for possessory information proceedings [Valor 013], [Valor 016], [Valor 015], [Valor 015], [Valor 018], and [Valor 017].\n\nBased on that technical report, the Registro Nacional, by administrative decision issued by the Registro Inmobiliario at 12:00 on 10 April 2018 in administrative file 2017-1129-RIM, ordered, among other things, that cadastral notices be placed on plans [Valor 013], [Valor 015], [Valor 015], [Valor 016], [Valor 017], and [Valor 018], due to an overlap inconsistency with plan [Valor 012], belonging to registered property matrícula [Valor 029]. It also ordered a cadastral notice on [Valor 012] because it contains inconsistencies identified in the closure error and in the difference between the measurement calculated from its traverse and the measurement shown in the body of the plan. Based on the foregoing, there is no doubt that the land claimed by the claimant Association forms part of registered property matrícula [Valor 029], whose registered owner is Mr. [Nombre 005].\n\nAccordingly, the claimant’s action for a better right of possession lacks a legal basis because it was brought against a registered property owner. As explained in the preceding section of the reasons, this action is not available to claim registered land, which is protected under Article 45 of the Constitución Política, which enshrines the right to property, and possession is an attribute of ownership under Article 264 of the Código Civil. For that reason, the complaint lacks a legal basis: a better right of possession cannot be established over registered land when the complaint was brought against the holder of that right. There is also a lack of passive standing because co-defendant [Nombre 005] is not an unlawful possessor of the claimed areas; on the contrary, he is the owner of the properties at issue in this judicial dispute.\n\nAlthough the claimant has exercised possession over those properties, which all the defendants have extensively disputed, that exercise of possession is insufficient to assert a claim against a registered property owner. For that reason, the claimant lacks active standing (Article 317 of the Código Civil). It is important to mention that the claimant also seeks a better right of possession over plan [Valor 036], which the expert and technical reports under review do not show to have overlap issues. Nevertheless, there is no evidence specifically establishing whether the claimant exercised possession over this particular area, because although it offered several plans to describe the disputed land, it claimed that possession was exercised over the property as a whole. For those reasons, the judgment must be affirmed, but on the grounds given by this Chamber and not those given by the court below. Given the basis for this decision, the Court does not rule on the appellate grounds concerning improper assessment of the evidence, through which the claimant sought full recognition of its right of possession and, as a result, active standing and a right to have the challenged judgment reversed.\n\nVII. THE COURT’S DECISION: Pursuant to Articles 45 of the Constitución Política; 264, 317, 318, 319, 322, 277, and 286 of the Código Civil; Articles 6, 26, 52, and 54 of the Ley de la Jurisdicción Agraria; and Article 317 of the Código Procesal Civil, the evidence for further consideration submitted by [Nombre 005] and added to the digital case file on 29 March 2019 is admitted. The appealed judgment is affirmed for the reasons given by this Court.\n\nTHEREFORE:\n\nThe evidence for further consideration submitted by [Nombre 005] and added to the digital case file on 29 March 2019 is admitted.
