  "body_es_text": "EV Generación de Machote: F:\\Gestion-Judicial\\Servidor de Archivos\\Modelos\\Contencioso\\TCRESOL016.dpj\n\n \n\n\n\n \n\nEXPEDIENTE:\n\n22-000670-1027-CA - 4\n\nPROCESO:\n\nConocimiento\n\nACTOR/A:\n\nASOCIACION DE DESARROLLO ESPECIFICA PRO MANTENIMIENTO DEL ACUEDUCTO DEL CACAO DE ALAJUELA\n\nDEMANDADO/A:\n\nAUTORIDAD REGULADORA DE LOS SERVICIOS PUBLICOS\n\n \n\n N° 2026005711\n\nTRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las dieciocho horas con cincuenta minutos del dieciocho de agosto del dos mil veintiseis.-\n\n \n\n Proceso de conocimiento declarado de Puro Derecho, interpuesto por ASOCIACIÓN DE DESARROLLO ESPECÍFICA PRO MANTENIMIENTO DEL ACUEDUCTO DE EL CACAO DE ALAJUELA, cédula jurídica 3-002-263243, representada por su apoderado especial judicial, Licenciado Aarón Ugalde Maxwell, carnet 8322 contra la AUTORIDAD REGULADORA DE LOS SERVICIOS PÚBLICOS -ARESEP-, representada por sus apoderadas especiales judiciales, Licenciadas Melissa Gutiérrez Prendas, carnet 19023 y Katherine Pamela Artavia, carnet 33352.\n\nCONSIDERANDO\n\nI.- ANTECEDENTES PROCESALES.- De relevancia, se tienen los siguientes:\n\n1) Quien acciona, habiendo aclarado en Audiencia Preliminar sus pretensiones, viene solicitando que en sentencia se disponga: “Que en sentencia se declare: 1. Con lugar la presente demanda. 2. Que los actos administrativos del 12 de julio del 2021, mediante la resolución RE-0832-RG-2021, RE-1111-RG-2021, de las 13:30 horas del 27 de setiembre del 2021, resolución RE-0007-DF-2022, de las 13:45 horas del 19 de enero del 2021 y la resolución RE-0298-RG-2024, de las 15:25 horas del 24 de mayo de 2024, emitidos por la ARESEP en el procedimiento administrativo sancionatorio bajo el expediente OT-185-2016, son contrarias al ordenamiento jurídico por violentar los artículos 11, 25, 34, 39, 41 de la Constitución Política de Costa Rica y por ende son absolutamente nulos. 3. Que la ARESEP no puede multar a mi representada en la suma de dos millones ciento veintiún mil colones, bajo la tesitura de que realizó una actividad de manera ilegal, en virtud de que el Instituto Costarricense de Acueductos y Alcantarillados nunca ha indicado la ilegalidad de la actividad realizada. (Lo subrayado se adicionó en la Audiencia Preliminar). 4. Que se obligue a la ARESEP a archivar la causa administrativa seguida en el expediente OT-185-2016, por ser todo un procedimiento absolutamente nulo y se exonere a mi representada de cualquier multa allí impuesta. 5. Se condene a la demandada al pago de ambas costas.” (Imágenes 2 a 10, 169 a 178, 357 a 358 y 383 a 386 del expediente judicial. Respaldo electrónico de la Audiencia Preliminar).\n\n2) Conferido el traslado de ley, la representación de la ARESEP contestó negativamente la demanda y opuso la defensa previa de falta de integración de la litis consorcio necesaria -rechazada interlocutoriamente-, así como la excepción de falta de derecho. (Imágenes 184 a 209, 247 a 273, 280 a 281 y 297 del expediente judicial). \n\n3) La Audiencia Preliminar se llevó en dos tantos, en fechas 10 de junio de 2024 y 15 de enero del 2025. (Imágenes 357 a 358 y 383 a 386 del expediente judicial. Respaldo electrónico de la referida audiencia).\n\n4) Conforme al acuerdo tomado por el Consejo Superior del Poder Judicial, en la Sesión N° 26-2025 del 27 de marzo del 2025, artículo XXXII, se aprobó el llamado plan de descongestionamiento para reducir el rezago judicial en asuntos de puro derecho del Tribunal Contencioso Administrativo y Civil de Hacienda, diseñado por la Dirección de Planificación y contenido en el Informe N° 310-PLA-MNP-2025 del 14 de marzo del 2025. Así las cosas, por cumplir el presente expediente con los criterios establecidos, fue incluido dentro del citado plan y turnado a esta sección para el dictado del fallo correspondiente.\n\n5) Se dicta la presente sentencia previa deliberación y por unanimidad de los integrantes del Tribunal, sin que se observen causales capaces de invalidar lo actuado. Redacta el juez Baltodano Gómez, con el voto afirmativo de las personas juzgadoras Rodríguez Cubero y Córdoba Ramírez. \n\nII.- ARGUMENTOS DE LAS PARTES. Sin perjuicio de la literalidad de sus manifestaciones, las cuales han sido analizadas en su totalidad por esta Cámara, cada una de las partes aduce, en síntesis lo siguiente: ASOCIACIÓN ACTORA.- La demandante divide su línea argumentativa en los apartados que seguidamente se indican. a) Legalidad y origen histórico del acueducto: Señala que la Asociación está legalmente constituida desde diciembre de 1999 bajo la Ley de Desarrollo de la Comunidad (Ley N° 3859). Además, que la misma administra el acueducto desde febrero de 1979 gracias a un traspaso autorizado por el Concejo Municipal de Alajuela, debido a que en ese entonces el Estado, la Municipalidad y el AyA, no podían satisfacer las necesidades de agua de la comunidad. b) Irretroactividad y respeto a derechos adquiridos: Sostiene, que conforme al artículo 34 de la Constitución Política, los reglamentos posteriores emitidos sobre ASADAS (como el Decreto N° 32529-S-MINAE de 2005 y el N° 42582-S-MINAE de 2020) no pueden aplicarse de forma retroactiva ni exigirles de manera forzosa transformarse bajo la Ley de Asociaciones N° 218, ignorando su constitución previa y la rectoría de DINADECO. c) Interpretación correcta del artículo 2 inciso g) de la Ley Constitutiva del AyA: Argumenta que la referida norma no faculta al AyA a imponer de forma automática y obligatoria la constitución de una ASADA. Pues a su juicio, lo que la ley establece es que el AyA está facultado para convenir con los organismos locales, la administración de los servicios según convenga para su mejor prestación. Estima, que considerar lo contrario mediante un reglamento, constituye un exceso de la potestad reglamentaria que contradice la ley y vulnera el principio de jerarquía normativa. d) Violación a la Libertad de Asociación: Obligar a la Asociación a transformarse y firmar un convenio impuesto sin el consentimiento de la Asamblea General, vulnera el derecho de libre asociación consagrado en el artículo 25 de la Constitución Política. e) Desviación de poder: Aduce que la ARESEP tiene competencia sobre los aspectos tarifarios de los acueductos, pero no está autorizada para declarar la ilegalidad en la prestación del servicio y mucho menos para sancionar bajo el argumento de no haberse suscrito un convenio con el AyA. Esto último constituye, afirma, un exceso de poder y vulnera el debido proceso y el derecho de defensa (artículos 39 y 41 de la Constitución), toda vez que corresponde al AyA determinar formalmente tales situaciones. Agrega, que igual existe en la especie ineficacia del AyA al no haber intervenido en los plazos de 8 meses previstos originalmente en los reglamentos transitorios, pretendiendo accionar 20 años después. ARESEP.- Arguye, que aunque la Asociación esté válidamente constituida bajo la Ley No. 3859 (DINADECO), dicho estatus no la faculta “per se” para explotar un servicio público de suministro de agua potable. Que si bien la actora aduce un traspaso municipal histórico de febrero de 1979, el Instituto Costarricense de Acueductos y Alcantarillados (AyA) reportó que la misma opera como una Asociación Específica y no como una ASADA autorizada, careciendo de un Convenio de Delegación suscrito con dicha entidad -el AyA- y de una concesión de aprovechamiento de agua otorgada por la Dirección de Agua del MINAE, conforme al artículo 121 inciso 14 de la Constitución Política y la Ley No. 7593. Continúa manifestando, que el procedimiento seguido contra la demandante se tramitó bajo el expediente OT-185-2016 y se intimó a la actora con base en el artículo 38 inciso d) de la Ley N.° 7593 (prestación no autorizada del servicio), y no por la Ley de Asociaciones No. 218 como erróneamente lo aduce la misma. Explica, que la utilización de la fecha de corte (12 de octubre de 2016) en la intimación, responde a los reportes probatorios del AyA, sin que signifique que la ARESEP afirme que operaban únicamente desde ese año. Indica, que acepta la cronología respecto de la emisión de la resolución sancionatoria RE-0832-RG-2021 y la interposición del recurso de revocatoria con apelación en subsidio. Respecto a los vicios alegados en la tramitación del recurso por la representación, señala que la Junta Directiva emitió la resolución RE-0014-JD-2022 declarando con lugar una gestión de nulidad de la actora, retrotrayendo el procedimiento para resolver debidamente el recurso pendiente. Aclara, que en cuanto al cobro de la multa (resolución RE-0007-DF-2022), mediante el oficio OF-0162-DF-2022 se suspendió formalmente el mismo, a la espera de sentencia firme de este Tribunal. Expone, que el servicio de acueducto y alcantarillado es un servicio público esencial, titularidad del Estado por disposición constitucional y legal (Ley No 2726 y Ley No. 7593). Que por ende, los particulares no tienen un derecho de libre de explotación. De ahí que -sostiene-, su ejercicio requiere inexcusablemente de un título habilitante de carácter traslativo (concesión o permiso otorgado por el MINAE y el AyA). Añade, que conforme al artículo 9 de la Ley No. 7593, la obtención previa de la concesión o permiso constituye una condición “sine qua non” para operar como prestador, quedando todos sometidos a la fiscalización técnica, financiera y tarifaria de la ARESEP. Explica, que la circunstancia de estar amparados bajo la Ley de Asociaciones de Desarrollo (Ley No. 3859) no exime a la accionante de cumplir con los requisitos sanitarios y de delegación, exigidos para la distribución de agua potable para consumo humano. Concluye, que al constatarse de manera objetiva que la Asociación operaba un sistema de acueducto sin contar con la habilitación ni concesión de agua registrada ante el MINAE, la ARESEP actuó estrictamente dentro del marco de sus competencias al aplicar el régimen sancionatorio previsto en el artículo 38 inciso d) de la Ley No. 7593, garantizando el debido proceso (Ley General de la Administración Pública).\n\nIII.- HECHOS PROBADOS. Se tienen como hechos probados de relevancia, los siguientes: 1) Que el 14 de octubre de 2016, mediante el oficio 3496-DGAU-2016, la Dirección General de Atención al Usuario de la ARESEP -en adelante DGAU-, solicitó al AyA certificar: \"(…) si la Asociación de Desarrollo Específica Pro Mantenimiento de Acueducto de El Cacao, cuenta con el Convenio de Delegación del Instituto Costarricense de Acueductos y Alcantarillados para prestar el servicio como ASADA\". (Folios 21 al 23 del expediente administrativo); 2) Que el 21 de octubre de 2016, mediante el oficio PRE-DJ-2016-03892 del 19 de octubre de 2016, el AyA informó a la DGAU, que la Asociación actora no había suscrito Convenio de Delegación con el AyA, ni presentado documentación para esos efectos. (Folios 13 al 14 del expediente administrativo); 3) Que el 13 de setiembre de 2017, mediante la certificación CE-155-2017, la Dirección de Agua del MINAE certificó que en el Registro Nacional de Concesiones de Agua y Cauces, la Asociación demandante no registraba concesión de aprovechamiento de agua y tampoco autorización para la prestación de servicio público de acueducto. (Folios 24 al 26 del expediente administrativo); 4) Que el 12 de octubre de 2017, mediante el oficio 3432-DGAU-2017, la DGAU rindió el \"Informe valoración inicial para iniciar un procedimiento administrativo ordinario sancionatorio contra la Asociación de Desarrollo Específica Pro Mantenimiento del Acueducto de El Cacao de Alajuela, por la presunta prestación no autorizada del servicio público de acueducto y alcantarillado\". (Folios 27 al 31 del expediente administrativo); 5) Que el 18 de octubre de 2017, mediante la resolución RRG-418-2017, el Regulador General ordenó la apertura de un procedimiento administrativo ordinario sancionatorio contra la Asociación accionante, por la presunta prestación no autorizada del servicio público de acueducto y alcantarillado. (Folios 33 al 38 del expediente administrativo); 6) Que el 27 de noviembre de 2019, mediante la resolución RE-0384-DGAU-2019, el Órgano Director dio inicio al procedimiento administrativo ordinario sancionatorio contra la aquí demandante y la convocó a la comparecencia oral y privada, programada para las 9:30 horas del 17 de febrero de 2020. (Folios 39 al 47 del expediente administrativo); 7) Que el 28 de noviembre de 2019, mediante la guía EZ00097:222CR, Correos de Costa Rica notificó a la actora en su domicilio social, la resolución RE-0384-DGAU-2019 citada en el hecho probado inmediato anterior. (Folio 49 del expediente administrativo); 8) Que el 15 de marzo de 2021 -luego de diversos retrasos-, se celebró la comparecencia oral y privada, a la que asistió el señor Marino Ronaldo Castillo Arce, en su condición de presidente con facultades de apoderado general de la Asociación de Desarrollo Especifica Pro Mantenimiento de Acueducto del Cacao de Alajuela. (Folios 123 al 138 del expediente administrativo); 9) Que el 8 de julio de 2021, mediante el oficio IN-0526-DGAU-2021, el órgano director del procedimiento rindió informe ante el Regulador General, con los hallazgos del procedimiento tramitado. (Folios 170 al 198 del expediente administrativo); 10) Que el 12 de julio de 2021, mediante la resolución RE-0832-RG-2021, el Regulador General, entre otras cosas, resolvió: “(…) Declarar que la Asociación de Desarrollo Específica Pro Mantenimiento del Acueducto de El Cacao de Alajuela, cédula jurídica número 3-002-263243, incurrió en la falta establecida en el artículo 38 inciso d) de la Ley 7593, de prestar sin autorización el servicio público de suministro de acueducto. Lo anterior el día 12 de octubre del año 2016, en la comunidad del Cacao de Alajuela. II. Imponer a la Asociación de Desarrollo Específica Pro Mantenimiento del Acueducto de El Cacao de Alajuela, cédula jurídica número 3-002-263243, una multa de cinco salarios base mínimos fijados en el presupuesto ordinario de la República, de acuerdo con la Ley 7337 del 5 de mayo de 1993, lo cual corresponde a la suma 2.121.000,00 (dos millones ciento veintiún\nmil colones exactos). III. Intimar por primera vez a la Asociación de Desarrollo Especifica\nPro Mantenimiento del Acueducto de El Cacao de Alajuela, cédula jurídica número 3-002-263243, para que, dentro del plazo de diez días hábiles contado a partir de la notificación de este acto, cancele la suma de 2.121.000,00 (dos millones ciento veintiún mil colones exactos), correspondientes a una multa impuesta en el inciso anterior, a favor de la Autoridad Reguladora de Servicios Públicos, de conformidad con lo que establecen los artículo 38 inciso d) de la Ley N° 7593 y sus reformas y 150 y 264-1) de la Ley General de la Administración Pública.\" (Folios 199 al 231 y 238, archivo Zip); 11) Que el 14 de julio de 2021, la Asociación de Desarrollo Especifica Pro Mantenimiento del Acueducto del Cacao de Alajuela, interpuso recurso de revocatoria con apelación en subsidio, contra la resolución RE-0832-RG-2021 indicada en el hecho probado inmediato anterior. (Folios 232 al 234 y 236, archivo zip); 12) Que el 27 de setiembre de 2021, mediante la resolución RE-1111-RG-2021, el Regulador General resolvió -entre otras cosas- lo siguiente: \"I. Rechazar por inadmisible, el recurso de revocatoria interpuesto por la Asociación de Desarrollo Pro Mantenimiento del Acueducto de El Cacao de Alajuela, contra la resolución RE-0832-RG-2021, dictada por el Regulador General, el 12 de julio de 2021, por falta de representación del señor Marino Rolando Castillo Arce\", emplazando a la actora ante la Junta Directiva de la ARESEP, en virtud del recurso de apelación subsidiariamente interpuesto. (Folios 241 a 257 del expediente administrativo); 13) Que el 19 de enero de 2022, mediante la resolución RE-0007-DF-2022, notificada el 20 de enero de 2022, la Dirección de Finanzas de la ARESEP intimó por segunda vez a la Asociación actora, para que dentro del plazo de diez días hábiles, contados a partir de su notificación, procediera a cancelar la multa impuesta mediante la resolución RE-0832-RG-2021, más los intereses moratorios respectivos. (Folios 268 al 270 del expediente administrativo y folio 272, archivo zip); 14) Que en fecha 4 de febrero de 2022, la actora solicitó la suspensión del cobro de la multa impuesta, lo cual le fue atendido mediante el oficio OF-0162-DF-2022 del 7 de febrero de 2022, indicándose en lo de interés: “Le informo que, estaremos atentos a la resolución del proceso contencioso, mientras tanto, se suspende el cobro hasta el dictado de la resolución final del proceso judicial.” (Folio 273 del expediente administrativo); 15) Que mediante resolución RE-0014-JD-2022 del 24 de marzo de 2022, notificada el 7 de abril de 2022, la Junta Directiva de la ARESEP declaró la nulidad de la resolución RE-1111-RG-2021, del 27 de setiembre de 2021 emitida por el Regulador General y dispuso retrotraer el procedimiento a la “etapa procesal oportuna”, a efecto de que se conociera por el fondo el recurso de revocatoria que había sido declarado inadmisible. (Folios 282 al 309 del expediente administrativo); 16) Que mediante resolución RE-0298-RG-2024 de las 15 horas con 25 minutos del 24 de mayo de 2024, emitida por el Regulador General, se rechazó el recurso de revocatoria, elevando los autos a la Junta Directiva de la ARESEP a efecto de que la misma conociera la apelación subsidiariamente interpuesta. (Imágenes 336 a 356 del expediente judicial).\n\nIV.- HECHOS NO PROBADOS. Ninguno estimado necesario para fallar el presente asunto.\n\nV.- DE LA VALORACIÓN DE LA DEMANDA POR PARTE DE ESTE TRIBUNAL. Debido a que parte del cuestionamiento realizado por la accionante tiene relación con las potestades de la ARESEP en casos como el que nos ocupa, de relevancia resulta señalar que la Ley No. 7593: “Ley de la Autoridad Reguladora de los Servicios Públicos”, encargó a dicha entidad la función de regular los servicios públicos indicados en el ordinal 5 de dicho cuerpo normativo, dentro de los que destaca en el inciso c), el “suministro del servicio de acueducto y alcantarillado, incluso el agua potable”. De ahí que, entre otras atribuciones, corresponde a la referida Institución Pública, la fijación tarifaria y la fiscalización de la calidad, cantidad y continuidad de los servicios públicos expresamente contenidos en dicha ley. Y es precisamente en ejercicio de ese deber de fiscalización, que la ARESEP debe investigar y sancionar a los prestadores que incurran en faltas tipificadas en la ley, como la \"prestación no autorizada del servicio público\". Por ello, el ordinal 38 inciso d) de la citada Ley No. 7593, establece que dicha entidad pública sancionará con multa a quien suministre un servicio público sin la debida autorización. La referida norma aplica a cualquier \"prestador del servicio público\" y la multa oscila entre cinco y diez veces el valor del daño causado. Pero si no es posible estimar el daño, se aplica una multa de entre cinco y veinte “salarios base mínimos.” Lo hasta aquí señalado evidencia con absoluta claridad, que la ARESEP tiene el deber -como se indicó en líneas precedentes- de investigar y sancionar, la prestación no autorizada de un servicio público. Siendo ello así, el cuestionamiento de la competencia de dicha Institución en temas como el que nos ocupa, no resulta atendible. Ahora bien, siendo que la actora prestaba el servicio de suministro de agua potable y que la misma parece entender que no lo hacía de forma contraria a Derecho, de trascendencia resulta recordar los requisitos que deben cumplirse para brindar el servicio público, en este caso, de Acueducto y Alcantarillado. Al respecto, como bien lo aduce la representación legal de ARESEP, a luz del artículo 121 inciso 14) de la Constitución Política, las aguas son un bien de dominio público que solo puede ser explotado por la Administración o por particulares mediante concesión otorgada conforme a la ley -en este caso por el Ministerio de Ambiente y Energía-. Así, los numerales 17 y 18 de la Ley de Aguas (No. 276 del 27 de agosto de 1942) y el artículo 5 de la Ley No. 7593 antes citada, establecen la necesidad de contar con una concesión del MINAE para el aprovechamiento de aguas y la prestación del servicio público de acueducto. Siendo una excepción y vía complementaria, la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, No. 2726 del 14 de abril de 1961, en tanto establece que el AyA puede delegar la administración de los sistemas a organismos locales. Ahora bien, la forma en que debían operar esas Organizaciones Comunales, se encontraba regulada en el Decreto No. 32529-S-MINAE vigente desde el 5 de agosto de 2005 hasta su derogatoria por el artículo 108 del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados comunales, aprobado mediante Decreto Ejecutivo N° 42582 del 11 de agosto del 2020. En el Decreto hoy derogado, aplicable a la especie en razón de la fecha en que acaecieron los hechos, se establecía (artículo 60) que las mismas debían constituirse legalmente como Asociaciones Administradoras de Acueductos y Alcantarillados Comunales (ASADAS) y que para operar legalmente una ASADA, debía: i) Estar inscrita en el Registro de Asociaciones. ii) Suscribir un Convenio de Delegación con el AyA. iii) Y obviamente, por tratarse de un mandato constitucional y legal, contar con la concesión de aprovechamiento de agua otorgada por el MINAE. En la especie, la entidad accionada logró acreditar en sede administrativa, que al 12 desde octubre de 2016, la Asociación de Desarrollo accionante se encontraba prestando el servicio de suministro de acueducto, sin cumplir con los requisitos previstos en el ordenamiento jurídico para ello. En tal sentido, la misma: a) No contaba con una concesión de agua otorgada por el MINAE. b) No había suscrito un Convenio de Delegación con el AyA. c) Su figura legal (Asociación de Desarrollo), no era la prevista en la normativa (ASADA) para la prestación de ese servicio. Requisitos los anteriores, que había sido analizados años atrás por la Procuraduría General de la República en el Dictamen C-236-2008 y en la Opinión Jurídica OJ-091-2008, ambos invocados por la ARESEP como parte del fundamento de su Teoría del Caso. Así, en criterio del Órgano Procurador -el cual comparte esta Cámara-, conforme a la normativa vigente en aquel momento: 1) Un particular no estaba autorizado para prestar el servicio de agua potable, a excepción de las ASADAS. 2) El MINAE no podía otorgar una concesión de aguas para la prestación del servicio público si el particular no contaba antes con el acto delegatorio del AyA. 3) No existían dos vías para autorizar la prestación de tal servicio, sino una vía complementaria que exige la autorización del AyA (a través del Convenio de Delegación) y la concesión del MINAE. Así las cosas, siendo que la Asociación actora no cumplió los requisitos recién indicados, sin duda alguna incurrió en la falta: \"prestación no autorizada del servicio público\", tipificada en el artículo 38 inciso d) de la Ley No. 7593, como lo concluyó en su momento, en sede administrativa, la entidad accionada. De ahí que, conforme a lo hasta aquí señalado, no aprecia esta Cámara que la ARESEP: i) Haya actuado en detrimento de los derechos adquiridos de la Asociación, pues en tanto la misma prestaba un servicio público sin contar con la autorización respectiva, sobra decir, que ningún derecho adquirido tenía a continuar prestando ilegalmente el mismo. ii) Como fundamento esencial de la decisión adoptada que aquí se cuestiona, haya aplicado retroactivamente en perjuicio de la actora, normas jurídicas emitidas con posterioridad a los hechos que dieron origen al presente diferendo. Toda vez que, contrario a ello, acudió a la normativa imperante en el momento en que acaecieron los hechos, incluidos criterios de la Procuraduría General de la República -compartidos por este Tribunal-, que respaldaban su proceder. iii) Haya interpretado de forma incorrecta, uno o varios artículos de la Ley Constitutiva del AyA, a efecto de justificar su actuación. Ello así, por cuanto la propia Ley de ARESEP, según se explicó líneas atrás, justificaba la intervención de la misma. Aunado a que, tal y como lo señaló el Órgano Procurador en el Dictamen y Opinión Jurídica supra indicados, no existían dos vías para autorizar la prestación de tal servicio, sino una vía complementaria que exige la autorización del AyA (a través del Convenio de Delegación) y la concesión del MINAE. Con lo cual, no cumplía la accionante. iv) Haya lesionado la libertad de Asociación. Pues la imposición de una determinada estructura formal de persona jurídica -ASADA- para prestar el mencionado servicio, no fue obra de la entidad accionada en el acto final que se cuestiona. v) Haya incurrido en desviación de poder. Ello así, por cuanto la misma dio cumplimiento a su deber de velar por la “calidad, cantidad, confiabilidad, continuidad, oportunidad y prestación óptima” del servicio, tal y como lo señala el ordinal 5 de su Ley, sin buscar un fin más allá de ese. Llegado a este punto, estimamos necesario aclarar, que la forma en que hemos redactado el presente Fallo, esto es, utilizando en los análisis jurídicos tiempos verbales en pasado, obedece a la necesidad de dotar de claridad a las partes, respecto a que la normativa y criterios como los de la Procuraduría General de la República aplicados en la especie, eran los imperantes cuando se desarrolló toda la situación que dio origen al diferendo entre ellas. Con tal proceder, pretendemos evitar que la accionante insista en que se le han aplicado retroactivamente en su perjuicio, normas jurídicas de fecha posterior a la del acaecimiento de los hechos que aquí se han tenido por acreditados.\n\nVI.- DE LAS EXCEPCIONES OPUESTAS: Tal y como fue indicado en el punto 2) de los “Antecedentes Procesales”, la representación de la ARESEP, opuso además de la defensa previa de falta de integración de la litis consorcio necesaria -rechazada interlocutoriamente-, la excepción de falta de Derecho. Al respecto, siendo que conforme a lo señalado a lo largo de la presente sentencia, el ordenamiento jurídico no ampara lo argumentado y pedido por quien demanda, lo procedente es acoger la excepción dicha, como en efecto se dispone.\n\nVII.- SOBRE LAS COSTAS: De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales son impuestas al vencido por el solo hecho de serlo, pronunciamiento que debe hacerse incluso de oficio, al tenor de lo dispuesto en esa misma norma, en concordancia con el numeral 119.2 ibídem. La dispensa de esta condena sólo es viable: a) cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar; b) cuando la sentencia se dicte en virtud de pruebas que desconociera la parte contraria; o bien, c) cuando se incurra en plus petitio, esto es, cuando la diferencia entre lo reclamado y lo obtenido en definitiva sea de un quince por ciento (15%) o más, a no ser que las bases de la demanda sean expresamente consideradas provisionales o su determinación dependa del arbitrio judicial o dictamen de peritos (ordinal 194 ibídem). En la especie, no aprecia este Tribunal que estemos frente alguno de los presupuestos dichos, que permitan quebrar el postulado de condenatoria en costas al vencido. Siendo ello así, se estima que en la especie, lo procedente es condenar a la sociedad actora al pago de ambas costas del presente Proceso. Quantum de las mismas que se determinará en la Fase de Ejecución de sentencia a instancia de la Administración Pública vencedora. Por haberlo solicitado así expresamente la representación de la ARESEP, sobre el monto que en firme llegare a determinarse por concepto de ambas costas, se pagarán los intereses legales respectivos, computados a partir de la firmeza dicha y hasta su efectivo pago.\n\nPOR TANTO \n\nSe acoge la excepción de falta de derecho y en consecuencia, se declara sin lugar en todos sus extremos, la demanda incoada. Son ambas costas a cargo de la parte actora, quantum de las mismas que se determinará en la Fase de Ejecución de sentencia a instancia de la Institución vencedora. Sobre el monto que en firme llegare a determinarse por concepto de ambas costas, se pagarán los intereses legales respectivos, computados a partir de la firmeza dicha y hasta su efectivo pago. That this claim is granted. 2. That the administrative acts of 12 July 2021, through resolutions RE-0832-RG-2021 and RE-1111-RG-2021, issued at 1:30 p.m. on 27 September 2021, resolution RE-0007-DF-2022, issued at 1:45 p.m. on 19 January 2021, and resolution RE-0298-RG-2024, issued at 3:25 p.m. on 24 May 2024, issued by ARESEP in the administrative sanctioning proceeding under case file OT-185-2016, are contrary to the legal system because they violate Articles 11, 25, 34, 39, and 41 of the Political Constitution of Costa Rica and are therefore absolutely null. 3. That ARESEP may not fine my client in the amount of two million one hundred twenty-one thousand colones on the grounds that it carried out an activity unlawfully, since the Instituto Costarricense de Acueductos y Alcantarillados has never indicated that the activity carried out was unlawful. That ARESEP be ordered to archive the administrative case pursued under case file OT-185-2016, because the entire proceeding is absolutely null, and that my client be exempted from any fine imposed therein. 5. Electronic recording of the preliminary hearing.)\n\n2) After service of process, ARESEP’s representatives answered the claim in the negative and raised the preliminary defense of failure to join a necessary party, which was denied by interlocutory ruling, as well as the defense of lack of right. (Images 184 to 209, 247 to 273, 280 to 281, and 297 of the judicial case file).\n\n3) The preliminary hearing was held in two sessions, on 10 June 2024 and 15 January 2025. (Images 357 to 358 and 383 to 386 of the judicial case file. Electronic recording of said hearing.)\n\n4) Under the agreement adopted by the Superior Council of the Judiciary at Session No. 26-2025 of 27 March 2025, Article XXXII, the so-called decongestion plan was approved to reduce the judicial backlog in matters purely of law before the Administrative-Litigation and Civil Treasury Court. The plan was designed by the Planning Directorate and set out in Report No. 310-PLA-MNP-2025 of 14 March 2025. Accordingly, because this case file met the established criteria, it was included in that plan and assigned to this section for the corresponding judgment.\n\n5) This judgment is issued after deliberation and unanimously by the members of the Court, with no grounds observed that could invalidate the proceedings. Judge Baltodano Gómez drafted it, with the affirmative vote of judges Rodríguez Cubero and Córdoba Ramírez.\n\nII.- THE PARTIES’ ARGUMENTS. Without prejudice to the full wording of their statements, all of which have been reviewed in their entirety by this Court, each party argues, in summary, as follows: PLAINTIFF ASSOCIATION.- The plaintiff divides its arguments into the sections listed below. a) Legality and historical origin of the aqueduct: It states that the Association has been legally constituted since December 1999 under the Community Development Law (Law No. 3859). It also states that it has administered the aqueduct since February 1979 pursuant to a transfer authorized by the Municipal Council of Alajuela, because at that time the State, the Municipality, and AyA could not meet the community’s water needs. b) Nonretroactivity and respect for acquired rights: It argues that under Article 34 of the Political Constitution, later regulations concerning ASADAS (such as Decree No. 32529-S-MINAE of 2005 and No. 42582-S-MINAE of 2020) may not be applied retroactively or require it to transform into an association under the Associations Law No. 218, disregarding its prior constitution and DINADECO’s oversight. c) Proper interpretation of Article 2(g) of the AyA Constitutive Law: It argues that the cited provision does not empower AyA to automatically and mandatorily require the formation of an ASADA. In its view, the law provides that AyA is authorized to agree with local organizations on the administration of services as appropriate for their better provision. It considers that holding otherwise by regulation would exceed regulatory authority, contradict the law, and violate the principle of hierarchical norms. d) Violation of freedom of association: Requiring the Association to transform and sign an imposed agreement without the consent of the General Assembly violates the right to freedom of association established in Article 25 of the Political Constitution. e) Abuse of power: It asserts that ARESEP has jurisdiction over the tariff aspects of aqueducts but is not authorized to declare service provision unlawful, much less to impose sanctions on the grounds that no agreement was signed with AyA. It asserts that the latter constitutes an excess of power and violates due process and the right of defense (Articles 39 and 41 of the Constitution), since AyA is responsible for formally determining such matters. It adds that AyA was also ineffective because it did not intervene within the 8-month periods originally provided for in the transitional regulations, and seeks to act 20 years later. ARESEP.- It argues that although the Association is validly constituted under Law No. 3859 (DINADECO), that status does not in itself authorize it to operate a public drinking-water supply service. Although the plaintiff alleges a historical municipal transfer in February 1979, the Instituto Costarricense de Acueductos y Alcantarillados (AyA) reported that it operates as a Specific Development Association and not as an authorized ASADA, and that it lacks a Delegation Agreement with AyA and a water-use concession granted by the MINAE Water Directorate, pursuant to Article 121(14) of the Political Constitution and Law No. 7593. It further states that the proceeding against the plaintiff was handled under case file OT-185-2016, and that the plaintiff was charged under Article 38(d) of Law No. 7593 (unauthorized service provision), not under Associations Law No. 218, as the plaintiff mistakenly alleges. It explains that the cutoff date used in the charge (12 October 2016) reflects AyA’s evidentiary reports and does not mean ARESEP claims the Association began operating only that year. It states that it accepts the chronology concerning the issuance of resolution RE-0832-RG-2021 and the filing of the reconsideration motion with an appeal in the alternative. As to the alleged defects in the handling of the motion by the Association’s representative, it states that the Board of Directors issued resolution RE-0014-JD-2022, granting the plaintiff’s nullity request and remanding the proceeding so that the pending motion could be properly resolved. It clarifies that, as to collection of the fine (resolution RE-0007-DF-2022), collection was formally suspended by letter OF-0162-DF-2022 pending a final judgment by this Court. It explains that water supply and sewer service is an essential public service owned by the State under the Constitution and laws (Law No. 2726 and Law No. 7593). Accordingly, private parties have no unrestricted right to operate it. It maintains that operating such a service therefore requires a transfer-of-authority instrument (a concession or permit granted by MINAE and AyA). It adds that under Article 9 of Law No. 7593, obtaining the concession or permit in advance is a “sine qua non” condition for operating as a provider, and all providers are subject to ARESEP’s technical, financial, and tariff oversight. It explains that being covered by the Development Associations Law (Law No. 3859) does not exempt the plaintiff from meeting the health and delegation requirements for distributing drinking water for human consumption. It concludes that, upon objectively establishing that the Association operated an aqueduct system without the authorization or water concession registered with MINAE, ARESEP acted strictly within its authority by applying the sanctions regime under Article 38(d) of Law No. 7593 and guaranteeing due process under the General Law of Public Administration.\n\nIII.- FINDINGS OF FACT. The following relevant facts are established: 1) On 14 October 2016, by letter 3496-DGAU-2016, ARESEP’s General Directorate for User Assistance (hereinafter DGAU) asked AyA to certify “(…) whether the Asociación de Desarrollo Específica Pro Mantenimiento de Acueducto de El Cacao has a Delegation Agreement with the Instituto Costarricense de Acueductos y Alcantarillados to provide the service as an ASADA.” (Pages 21 to 23 of the administrative case file); 2) On 21 October 2016, by letter PRE-DJ-2016-03892 of 19 October 2016, AyA informed DGAU that the plaintiff Association had not signed a Delegation Agreement with AyA or submitted documentation for that purpose. (Pages 13 to 14 of the administrative case file); 3) On 13 September 2017, by certification CE-155-2017, MINAE’s Water Directorate certified that the National Registry of Water and Watercourse Concessions showed no water-use concession or authorization to provide a public aqueduct service registered to the plaintiff Association. (Pages 24 to 26 of the administrative case file); 4) On 12 October 2017, by letter 3432-DGAU-2017, DGAU issued the “Initial assessment report to initiate an ordinary administrative sanctioning proceeding against the Asociación de Desarrollo Específica Pro Mantenimiento del Acueducto de El Cacao de Alajuela for the alleged unauthorized provision of the public aqueduct and sewer service.” (Pages 27 to 31 of the administrative case file); 5) On 18 October 2017, by resolution RRG-418-2017, the General Regulator ordered the opening of an ordinary administrative sanctioning proceeding against the applicant Association for the alleged unauthorized provision of the public aqueduct and sewer service. (Pages 33 to 38 of the administrative case file); 6) On 27 November 2019, by resolution RE-0384-DGAU-2019, the Proceeding Directorate initiated an ordinary administrative sanctioning proceeding against the plaintiff and summoned it to the oral and private hearing scheduled for 9:30 a.m. on 17 February 2020. (Pages 39 to 47 of the administrative case file); 7) On 28 November 2019, by delivery guide EZ00097:222CR, Correos de Costa Rica served the plaintiff at its registered office with resolution RE-0384-DGAU-2019, cited in the immediately preceding finding of fact. (Page 49 of the administrative case file); 8) On 15 March 2021, after various delays, the oral and private hearing was held, attended by Marino Ronaldo Castillo Arce as president with powers of general agent of the Asociación de Desarrollo Específica Pro Mantenimiento de Acueducto del Cacao de Alajuela. (Pages 123 to 138 of the administrative case file); 9) On 8 July 2021, by letter IN-0526-DGAU-2021, the proceeding directorate submitted a report to the General Regulator setting out the findings of the proceeding. (Pages 170 to 198 of the administrative case file); 10) On 12 July 2021, by resolution RE-0832-RG-2021, the General Regulator, among other things, ruled: “(…) Declare that the Asociación de Desarrollo Específica Pro Mantenimiento del Acueducto de El Cacao de Alajuela, legal entity identification number 3-002-263243, committed the violation set out in Article 38(d) of Law 7593 by providing the public aqueduct supply service without authorization. This occurred on 12 October 2016, in the community of El Cacao de Alajuela. II. Impose on the Asociación de Desarrollo Específica Pro Mantenimiento del Acueducto de El Cacao de Alajuela, legal entity identification number 3-002-263243, a fine of five minimum base salaries set in the ordinary budget of the Republic, pursuant to Law 7337 of 5 May 1993, corresponding to the sum of 2.121.000,00 (two million one hundred twenty-one thousand colones exactly). III. For the first time, notify the Asociación de Desarrollo Específica Pro Mantenimiento del Acueducto de El Cacao de Alajuela, legal entity identification number 3-002-263243, that within ten business days from service of this act it must pay the sum of 2.121.000,00 (two million one hundred twenty-one thousand colones exactly), corresponding to the fine imposed in the preceding subsection, to the Autoridad Reguladora de Servicios Públicos, in accordance with Articles 38(d) of Law No. 7593, as amended, and 150 and 264(1) of the General Law of Public Administration.” (Pages 199 to 231 and 238, Zip file); 11) On 14 July 2021, the Asociación de Desarrollo Específica Pro Mantenimiento del Acueducto del Cacao de Alajuela filed a reconsideration motion with an appeal in the alternative against resolution RE-0832-RG-2021 identified in the immediately preceding finding of fact. (Pages 232 to 234 and 236, zip file); 12) On 27 September 2021, by resolution RE-1111-RG-2021, the General Regulator ruled, among other things, as follows: “I. Dismiss as inadmissible the reconsideration motion filed by the Asociación de Desarrollo Pro Mantenimiento del Acueducto de El Cacao de Alajuela against resolution RE-0832-RG-2021, issued by the General Regulator on 12 July 2021, due to lack of representation by Marino Rolando Castillo Arce,” and referred the plaintiff to the ARESEP Board of Directors pursuant to the appeal filed in the alternative. (Pages 241 to 257 of the administrative case file); 13) On 19 January 2022, by resolution RE-0007-DF-2022, served on 20 January 2022, ARESEP’s Finance Directorate notified the plaintiff Association for the second time that within ten business days from service it was to pay the fine imposed by resolution RE-0832-RG-2021, plus the applicable default interest. (Pages 268 to 270 of the administrative case file and page 272, zip file); 14) On 4 February 2022, the plaintiff requested suspension of collection of the fine imposed. This request was addressed by letter OF-0162-DF-2022 of 7 February 2022, which stated, as relevant: “I inform you that we will await the resolution of the administrative-litigation proceeding; in the meantime, collection is suspended until the final judgment in the judicial proceeding is issued.” (Page 273 of the administrative case file); 15) By resolution RE-0014-JD-2022 of 24 March 2022, served on 7 April 2022, the ARESEP Board of Directors declared resolution RE-1111-RG-2021 of 27 September 2021, issued by the General Regulator, null and ordered the proceeding returned to the “appropriate procedural stage” so that the reconsideration motion previously declared inadmissible could be decided on its merits. (Pages 282 to 309 of the administrative case file); 16) By resolution RE-0298-RG-2024 issued by the General Regulator at 3:25 p.m. on 24 May 2024, the reconsideration motion was denied and the record was referred to the ARESEP Board of Directors so that it could hear the appeal filed in the alternative. (Images 336 to 356 of the judicial case file).\n\nIV.- FINDINGS OF FACT NOT ESTABLISHED. None deemed necessary to decide this matter.\n\nV.- THE COURT’S ASSESSMENT OF THE CLAIM. Because part of the plaintiff’s challenge concerns ARESEP’s powers in cases such as this one, it is relevant to note that Law No. 7593, the “Law of the Public Services Regulatory Authority,” assigned that entity the function of regulating the public services listed in Article 5 of that law, including, in subsection (c), the “supply of aqueduct and sewer services, including drinking water.” Among other responsibilities, that Public Institution therefore sets tariffs and oversees the quality, quantity, and continuity of the public services expressly listed in the law. In exercising that oversight duty, ARESEP must investigate and sanction providers that commit violations defined by law, such as the “unauthorized provision of a public service.” Accordingly, Article 38(d) of Law No. 7593 provides that the public entity shall impose a fine on anyone who supplies a public service without due authorization. The provision applies to any “public service provider,” and the fine ranges from five to ten times the value of the damage caused. If the damage cannot be estimated, a fine of between five and twenty “minimum base salaries” applies. What has been explained thus far makes clear that ARESEP has a duty, as stated above, to investigate and sanction the unauthorized provision of a public service. The challenge to that Institution’s authority over matters such as this one is therefore unpersuasive. Now, since the plaintiff provided a drinking-water supply service and appears to believe that it did not do so unlawfully, it is important to recall the requirements for providing a public service, in this case, aqueduct and sewer service. As ARESEP’s legal representatives correctly argue, under Article 121(14) of the Political Constitution, water is public property that may be exploited only by the Administration or by private parties under a concession granted in accordance with the law—in this case, by the Ministry of Environment and Energy. Articles 17 and 18 of the Water Law (No. 276 of 27 August 1942) and Article 5 of Law No. 7593, cited above, establish the need for a MINAE concession to use water and provide a public aqueduct service. As an exception and complementary route, the Constitutive Law of the Instituto Costarricense de Acueductos y Alcantarillados, No. 2726 of 14 April 1961, provides that AyA may delegate administration of the systems to local organizations. The operation of those Community Organizations was governed by Decree No. 32529-S-MINAE, in force from 5 August 2005 until its repeal by Article 108 of the Regulations for Associations Administering Community Aqueduct and Sewer Systems, approved by Executive Decree No. 42582 of 11 August 2020. The now-repealed decree, which applies here because of the date of the events, provided (Article 60) that such organizations had to be legally constituted as Community Aqueduct and Sewer Administrators Associations (ASADAS), and that an ASADA had to: i) Be registered in the Registry of Associations. ii) Sign a Delegation Agreement with AyA. iii) And, naturally, because this is required by the Constitution and law, hold a water-use concession granted by MINAE. In this case, the defendant established in the administrative proceeding that, as of 12 October 2016, the plaintiff Development Association was providing the aqueduct supply service without meeting the legal requirements. Specifically, it: a) Had no water concession granted by MINAE. b) Had not signed a Delegation Agreement with AyA. c) Had a legal form (Development Association) other than the one required by the regulations (ASADA) to provide that service. The Procuraduría General de la República had analyzed these requirements years earlier in Opinion C-236-2008 and Legal Opinion OJ-091-2008, both cited by ARESEP in support of its case theory. In the Procuraduría’s view, which this Court shares, under the regulations in force at that time: 1) A private party was not authorized to provide drinking-water service, except for ASADAS. 2) MINAE could not grant a water concession to provide a public service unless the private party first had the delegating act from AyA. 3) There were not two routes for authorizing provision of that service, but one complementary route requiring authorization by AyA (through the Delegation Agreement) and a MINAE concession. Accordingly, because the plaintiff Association did not meet the requirements just listed, it unquestionably committed the violation of “unauthorized provision of a public service” established in Article 38(d) of Law No. 7593, as the defendant had concluded in the administrative proceeding. In light of the foregoing, this Court does not find that ARESEP: i) Acted to the detriment of the Association’s acquired rights, since, insofar as it provided a public service without the required authorization, it goes without saying that it had no acquired right to continue providing that service unlawfully. ii) Applied, as an essential basis for the challenged decision, legal rules issued after the events that gave rise to this dispute retroactively to the plaintiff’s detriment. On the contrary, it relied on the rules in force when the events occurred, including opinions of the Procuraduría General de la República, which this Court shares and which supported its actions. iii) Incorrectly interpreted one or more provisions of the AyA Constitutive Law to justify its actions. This is because ARESEP’s own law, as explained above, justified its intervention. In addition, as the Procuraduría stated in the above-mentioned Opinion and Legal Opinion, there were not two routes for authorizing provision of that service, but one complementary route requiring authorization by AyA (through the Delegation Agreement) and a MINAE concession—requirements the plaintiff did not meet. iv) Violated freedom of association. The defendant did not impose the formal legal structure of an ASADA for provision of the service in the final act challenged here. v) Abused its power. It fulfilled its duty to safeguard the “quality, quantity, reliability, continuity, timeliness, and optimal provision” of the service, as provided in Article 5 of its law, without pursuing any further purpose. At this point, we consider it necessary to clarify that we drafted this judgment using past-tense verbs in the legal analysis to make clear to the parties that the regulations and opinions, such as those of the Procuraduría General de la República, applied here were those in force when the events that gave rise to their dispute took place. We have done so to avoid the plaintiff insisting that legal rules dated after the events established here were applied retroactively to its detriment.\n\nVI.- THE DEFENSES RAISED: As stated in item 2) of the “Procedural Background,” ARESEP’s representatives raised, in addition to the preliminary defense of failure to join a necessary party, which was denied by interlocutory ruling, the defense of lack of right. Since, as explained throughout this judgment, the legal system does not support the plaintiff’s arguments and requests, the proper course is to uphold that defense, as is hereby ordered.\n\nVII.- COSTS: Under Article 193 of the Administrative Litigation Procedure Code, procedural and personal costs are imposed on the losing party solely because it lost. This ruling must also be made on the Court’s own initiative under that same provision, in conjunction with Article 119.2 thereof. Waiver of this award is permitted only: a) when, in the Court’s judgment, there was sufficient reason to litigate; b) when the judgment is based on evidence unknown to the opposing party; or c) when there is a plus petitio, that is, when the difference between the amount claimed and the amount ultimately awarded is fifteen percent (15%) or more, unless the claim expressly states that its basis is provisional or its determination depends on judicial discretion or expert opinion (Article 194 thereof). The Court does not find that any of those circumstances permitting departure from the rule requiring costs to be awarded against the losing party applies here. Accordingly, the Court finds that the plaintiff Association must pay both sets of costs in this proceeding. The amount will be determined in the judgment-enforcement phase at the request of the prevailing Public Administration. Since ARESEP’s representatives expressly requested it, statutory interest will be paid on the amount ultimately fixed for both sets of costs, calculated from the date the judgment becomes final until payment in full.\n\nTHEREFORE\n\nThe defense of lack of right is upheld and, consequently, the claim brought is denied in its entirety. Both sets of costs are charged to the plaintiff, and their amount will be determined in the judgment-enforcement phase at the request of the prevailing Institution. Statutory interest will be paid on the amount ultimately fixed for both sets of costs, calculated from the date the judgment becomes final until payment in full.
