"summary_en": "The Agrarian Tribunal declared improperly admitted the appeal filed by the Municipality of Liberia against a provisionalissima precautionary measure issued without a prior hearing in summary tree-removal proceedings. The first-instance order had directed the Sistema Nacional de Áreas de Conservación (SINAC) to cut down, within fewer than five days, a Carao tree considered dangerous; protect people and surrounding vegetation; prevent debris from entering the right-of-way or the protection area of the Liberia River; and keep machinery out of the channel unless coordinated with MINAE’s Dirección de Aguas. It had also ordered the Municipality to prepare, together with the community, a reforestation plan involving at least fifteen native-species trees. Without reviewing the merits of those directions, the Tribunal applied Article 250 of the Código Procesal Agrario (Agrarian Procedure Code): a decision on a provisionalissima precautionary measure is subject only to revocatoria, a request for reconsideration by the issuing court, and not to appeal. The Tribunal therefore confined its disposition to declaring the appeal incorrectly admitted.",

Proceedings were conducted before the Agrarian Court of the First Judicial Circuit of Guanacaste. This Court hears the appeal against resolution n° 2026000242 issued at 2:03 p.m. on 11 June 2026.\n\nJudge Picado Vargas drafts the decision; and,\n\nREASONS:\n\nI.- The Agrarian Court of the First Judicial Circuit of Guanacaste, by resolution n° 2026000242 issued at 2:03 p.m. on 11 June 2026, ruled: “THEREFORE In accordance with the foregoing, as a safety measure: the Sistema Nacional de Áreas de Conservación (SINAC) is ordered to completely fell the tree known as Carao, located at CRTM05 coordinates: 342975E-1176790N, within FEWER THAN FIVE DAYS after service of the resolution, because it poses a latent danger, and to proceed with the corresponding felling, with notice that failure to comply may result in prosecution for the offense of disobedience of authority. The expenses shall be borne by it (Article 276 of the Agrarian Procedural Code), because it is the entity responsible for administering the area where the tree is located; it is hereby authorized to perform that act and must also adopt all safety and technical measures necessary to prevent harm to third parties and safeguard the physical integrity of both the parties and the persons performing the felling work. When the tree is felled, care must be taken not to affect the surrounding vegetation; likewise, it must be ensured that no debris remains within the right-of-way or is expelled into the protection area of the Liberia River once the felling work has been completed. Machinery is prohibited from entering the riverbed for the felling work; if such entry is required, coordination must be undertaken with the Dirección de Aguas of MINAE so that it may authorize and supervise the entry. For implementation, the entity may request the assistance of the Ministerio de Ambiente y Energía, as well as the Comisión Nacional de Emergencias and the Municipalidad de Liberia. The Municipalidad de Liberia is also ordered to carry out a reforestation plan together with the community, involving at least 15 native tree species; to determine which species are to be planted, it shall contact the Oficina Subregional de Liberia (SINAC). If the forest product can be disposed of, the person legally authorized to do so must obtain the necessary permits from the respective administrative authority and bear the costs.” (images 107 to 113).-\n\nII.- The defendant Municipalidad filed an appeal on the terms shown in images 117 to 122).-\n\nIII.- The challenged resolution orders an urgent provisional precautionary measure without a prior hearing. Regarding the possibility of an appeal against resolutions deciding precautionary measures without a prior hearing, or urgent provisional precautionary measures, this Court has stated: “IV.- The appeal was improperly admitted, since Article 250 of the Agrarian Procedural Code provides that a resolution deciding an urgent provisional precautionary measure may be challenged only by a motion for reconsideration (recurso de revocatoria). In this case, an application for an urgent provisional precautionary measure was summarily denied; therefore, no appeal lies.” AGRARIAN COURT, Voto No. 2025001187 issued at 10:51 a.m. on 11 December 2025.
