"summary_en": "The Agrarian Court affirmed the judgment rejecting the información posesoria, a non-contentious procedure seeking registration of ownership based on possession, concerning a 5.5-hectare forest property located entirely within the Golfo Dulce Forest Reserve. Under Article 7 of the Ley de Informaciones Posesorias, property inside a protected wilderness area may be titled only if the applicant proves legal rights arising from ten-year possession exercised at least ten years before the area was created. Because the reserve was created in 1978, possession had to be established from at least 1968. The witnesses placed their knowledge of the property or the relevant possessory acts beginning in 1969, 1971, or 1984, while the deed through which the applicant acquired the property likewise described accumulated possession dating only to approximately 1984. The soil study, cadastral plan, and SINAC certification did not replace the required proof or create a right to title because cadastral registration remained without prejudice to the State’s rights.",

(ver expediente electrónico imágenes 1 a 4, y 19 a 22). 2. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At 5:54 p.m. on 25 August 2026.-\n\nPOSSESSORY-INFORMATION PROCEEDING (INFORMACIÓN POSESORIA), a statutory proceeding to obtain title based on possession, filed by SANDRA EUGENIA SALAZAR FERNÁNDEZ, an adult, single, homemaker, resident of La Palma, canton of Puerto Jiménez, Puntarenas, identity card number one - six hundred forty-three - seven hundred sixty-nine. The parties participating are the INSTITUTO DE DESARROLLO RURAL, represented by its general judicial attorney-in-fact Marjorie Mayela Madrigal Muñoz, an adult, married, attorney, resident of San Ramón de Alajuela, identity card number one - five hundred ninety-eight - one hundred one, Bar Association membership number twenty-one thousand three hundred forty-two; and the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Yamileth Monestel Vargas, an adult, single, attorney, resident of San Ramón, identity card number two - five hundred forty-five - six hundred one, Bar Association membership number one thousand seven hundred ninety-nine, acting in her capacity as Procuradora. Attorney Álvaro Rodrigo Mora Salazar, identity card number one - five hundred thirty-six - eight hundred thirty-one, Bar Association membership number two thousand seven hundred forty-one, acts as special judicial attorney-in-fact for the filing party. The matter was processed before the Agrarian Court of the Second Judicial Circuit of the Southern Zone, Corredores.\n\n Judge Fisher González, drafting the decision: and,\n\nREASONS:\n\n I.- DETAILS OF THE PROCEEDINGS: 1. The title claimant filed these proceedings seeking registration in her name, in the Public Property Registry, of the property described as follows: land containing secondary forest, located in the district of Sierpe, fifth canton of Osa, province of Puntarenas, bounded to the north by an agricultural-use easement (servidumbre de uso agrícola) measuring one hundred sixty meters and one centimeter; to the south, by Ramón Steller Jiménez and Alfredo Steller Jiménez; to the east, by Alfredo Steller Jiménez; and to the west, by Raquel Blanco Vargas and Ramón Steller Jiménez; with an area of fifty-five thousand square meters, according to cadastral survey plan number P 6 5118-2024. (See electronic case file, images 1 to 4 and 19 to 22.) 2. The State, through the Procuraduría General de la República, and the Instituto de Desarrollo Rural were admitted as parties and entered appearances in the case (images 92 to 94 and 110 to 112). 3.- Judge Marisel Zamora Arias, in judgment number 2026000221, issued at 9:05 a.m. on 14 May 2026, ruled: «THEREFORE: In accordance with the foregoing, the possessory-information proceeding filed by Ms. Sandra Eugenia Salazar Fernández is DENIED. NOTICE SHALL BE GIVEN.» (See electronic case-file download in PDF format, images 344 to 352).\n\nII.- The Court adopts the findings of proven and unproven facts contained in the challenged judgment, because they reflect the evidence and proceedings contained in the record.\n\n III.- The filing party appeals the judgment on the grounds summarized below: 1) The judgment’s findings of proven fact establish that the land at issue in these proceedings is described in cadastral survey plan P 5118-2024 and is located within the Reserva Forestal Golfo Dulce. It is stated that the SINAC certification was submitted and that the determination of suitable land use establishes that the filing party exercises possession in accordance with the land’s designated use. A certification from the Registro Nacional was also submitted, stating that no properties had previously been titled under the Ley de Informaciones Posesorias, as were notices to all adjoining landowners. Likewise, the inspection established that the INTA determination of suitable land use is consistent with the findings from the visual inspection. 2) The testimonial evidence offered was taken at the site, and the lower court’s assessment that it does not establish public and peaceful possession as owner since 1968 is incorrect. The court thus failed to assess that evidence, violating the rules of sound judicial assessment (sana crítica), experience, logic, and psychology. 3) It is clear that the soil study prepared by INTA contains evidence establishing such possession, but the court below did not analyze that essential evidentiary document; moreover, the witnesses, who were older adults from the area, clearly demonstrated their knowledge of the property and its possession, and the court failed to assess their testimony properly. It is an error of assessment to conclude that there was no ten-year possession when the previous owner and the possession exercised by the title claimant were established. The judgment also states that the witnesses were not consistent regarding possession, yet it does not even cite the witnesses’ names. 4) Regarding the property’s location within the Reserva Forestal Golfo Dulce, it is clear that neither INTA’s land-use report nor SINAC, when the legally required information was requested, ever indicated that the land could not be titled because of that circumstance. The court below did not assess that circumstance as required, because if there had been a legal impediment, SINAC would not have issued the letter containing the stated information. Consequently, if a legal obstacle existed, the court should have rejected the proceeding at the outset instead of creating expectations and causing expenses through its improper handling of the matter under review, thereby causing financial harm to the filing party. In any event, even if the land belongs to the Reserva Forestal Golfo Dulce, that does not preclude titling because registration may be ordered subject to the corresponding encumbrances. 5) In view of the foregoing, the judgment violates the rights of defense and due process enshrined in Article 39 of the Constitución Política and Article 8 of the Convención Americana sobre Derechos Humanos, as well as the provisions of Articles l et seq. of the Ley de Informaciones Posesorias, because, curiously, the decision does not identify the failure to satisfy a single requirement for the possessory-information proceeding to be granted, including the authorization and content of the cadastral survey plan, a plan that the evidentiary portion of the decision does not even cite (appeal brief at images 356 to 359).\n\n IV.- It has been established in the record that the land sought to be registered under cadastral survey plan No. P 5118 -2024 is located entirely within the Reserva Forestal Golfo Dulce, created or designated by Decreto Ejecutivo No. 9388 of 30 November 1978 (SINAC certification at image 267). It is forest land located in the province of Puntarenas, third district of Sierpe, fifth canton of Osa, measuring five hectares and five thousand square meters (cadastral survey plan at image 245, soil study at images 46 to 48, record of judicial inspection at image 317). In this regard, Article 7 of the Ley de Informaciones Posesorias provides for the possibility of obtaining title to real property located within a protected wilderness area, irrespective of its management category, if the claimant proves that they hold the legal rights arising from ten-year possession exercised beginning at least ten years before the effective date of the law or decree that created that wilderness area. That provision requires proof that possession was exercised throughout that entire period. Therefore, because the Reserva Forestal Golfo Dulce was declared part of the public domain in 1978, possession dating back to at least 1968 had to be established. Considering that the evidentiary hearing was held in 2024, the witnesses had to testify to knowledge of the land extending back at least 56 years. However, after analyzing that testimonial evidence and the other documentary evidence discussed below, pursuant to the principle of free assessment of evidence established in Article 54 of the Ley de Jurisdicción Agraria, this Court reaches the same conclusion as the court below. This is because that fundamental substantive requirement was not established. Alfredo Steller Jiménez, Ascensión Jiménez Aguilar, and Abel Fallas Castro testified in this matter (audio recordings included in the electronic case file’s oral-hearing records). Alfredo Steller Jiménez stated that his father, whose name during his lifetime was Agustín Steller, had purchased the property from Álvaro Cubillo 40 years earlier. He could not state how long Álvaro had possessed it, only that he had a survey plan from 1977. Accordingly, considering the date of the testimony, it may be inferred that his knowledge of the property dates from 1984. As to Ascensión Jiménez Aguilar, he stated that he was 81 years old and that, when he was 26, they began to “mark the boundaries of the land” for Álvaro Cubillo, that is, in 1969. Finally, Abel Fallas Castro stated that he was 83 years old and was about 30 when Los Cubillos began making a “clearing” through the forest, that is, in 1971. Moreover, as further support, the document through which the filing party states that she acquired this property is public deed No. 224-8, executed at noon on 7 October 2017 before Notary William Ramírez Ramírez (shown at images 77 and 78). The witness Alfredo Steller Jiménez appeared in that instrument—on that occasion as transferor—and expressly stated: “Both the undersigned and the prior possessors have exercised possessory acts over the property in question quietly, publicly, peacefully, uninterruptedly, in good faith, and as owners, currently totaling more than thirty-four years of possession.” Thus, the transferor himself acknowledged that possession dated from 1984, without specifying any earlier period. In any event, under Article 6 of the Ley de Informaciones Posesorias, possession must be established through three witnesses; in this matter, for the reasons stated, the evidence taken was insufficient to establish the substantive requirement imposed by law for titling property of this nature. Moreover, the appellant does not explain in her appeal brief why she considers the testimonial evidence taken sufficient to establish the required facts; she merely alleges that “it was assessed incorrectly.” The appeal lacks any genuine argument addressing the central basis of the judgment insofar as it concluded that ten-year possession predating the creation of the Reserva Forestal Golfo Dulce had not been established.\n\n VIII. Finally, the grounds of appeal asserting that the soil study established that the filing party possesses the property in accordance with its nature are unavailing. It is true that the study approved the current use, but it must be emphasized that the titling was denied because possession dating back to 1968 was not established. The objection that preparation of a cadastral survey plan for the property and issuance of the corresponding SINAC certification mean that the property may be titled, provided that the encumbrances are indicated to the Registry, meets the same fate. This is because the cadastral registration of that plan is without prejudice to the State’s rights, and that circumstance does not relieve the party of proving conclusively what Article 7 of the Ley de Informaciones Posesorias requires. Furthermore, contrary to what the appellant suggests, the lower court did not create expectations for the title claimant. Instead, in accordance with the legally established procedure, it was required to direct her to satisfy all requirements, then take the evidence to determine whether the substantive requirements had been met, and finally issue judgment. It was therefore the party’s responsibility to prove the requisite facts.\n\nIX.- Accordingly, the grounds of appeal must be rejected and the judgment affirmed.\n\nTHEREFORE\n\nThe judgment is affirmed.\n\n \n\n \n\n \n\n \n\n \n\n \n\n\n43DM58GS56L061\nMARIA VANESSA FISHER GONZALEZ - DECIDING JUDGE\n\n \n\n\nES43MODYZWHO61\nALEXANDRA ALVARADO PANIAGUA - DECIDING JUDGE\n\n \n\n\nEBCPZACRWV061\nMARÍA ROSA CASTRO GARCÍA - DECIDING JUDGE\n\n \n\nCASE FILE: 19-000039-0423-CI\n\nSecond Judicial Circuit of San José, 4th floor, Tribunales de Justicia Building, Calle Blancos de Goicoechea, across from the parking lot of Hospital Hotel La Católica.
