The direction to identify the defendant and state the value of the claim was never received: the system recorded that the recipient’s server rejected the email because the account did not exist or was inactive. Under Article 42 of the Ley de Notificaciones Judiciales (Judicial Notices Law), the court should have arranged another notification attempt after the system was restored instead of imposing inadmissibility. Requiring identification of a defendant was also improper because the trees stood on the Municipality’s own property and the proceeding therefore had to be brought against an unknown person (“ignorado”). Although requiring valuation of the claim was justified, the Municipality could not comply without effective notice. Because the matter concerned trees in a protection area, a previously granted amparo proceeding, and protection of human safety, the lower court must process it immediately and as a priority.",

Attorney Hector Granados Ortega, bar registration number twenty-four thousand nine hundred forty-six, acts as special judicial counsel for the Municipality. Heard before the Agrarian Court of Cartago. This Court hears the appeal against judgment N°2026000158, issued at nine hours fifty-seven minutes on 1 June 2026.\n\n Judge Fisher González drafts the opinion; and,\n\nREASONS:\n\nI.- In decision N° 2026000158, issued at nine hours fifty-seven minutes on 1 June 2026, the Agrarian Court of Cartago ruled as follows: “Because the plaintiff failed, within the period granted, to comply with the cure order issued at nine hours forty-seven minutes on 14 May 2026, the complaint is declared inadmissible and this proceeding is ordered terminated. Accordingly, the hearing scheduled for nine hours thirty minutes on 17 June 2026 is canceled. Once this decision becomes final, this proceeding shall be archived. (Article 100, Agrarian Procedural Code)” (order in image 24).\n\nII.- The plaintiff appeals on the following grounds: 1) The appealed decision causes direct prejudice insofar as it declares the complaint inadmissible and orders the proceeding archived on the basis of an alleged failure to comply with a cure order that was never validly brought to the attention of Municipalidad de Cartago, as shown by the documentation incorporated into the case file by the official judicial notification system itself. Because there is no record that the decision was successfully delivered, the period granted to cure the matters identified by the Court could not be deemed to have commenced, much less could this give rise to a procedural consequence as severe as inadmissibility and archiving of the case file. The harm is particularly significant considering that this matter does not arise from an ordinary dispute between private parties, but from actions taken by Municipalidad de Cartago to address a situation previously heard by the Constitutional Chamber (Sala Constitucional) and subsequently submitted for the technical assessment of the competent environmental authority, which concluded that the final determination of the matter should be heard by the Agrarian Jurisdiction. Accordingly, the alleged prejudice consists of the appealed decision preventing the proceeding from continuing to an examination of the merits of a situation requiring a judicial ruling, thereby depriving this party of a genuine opportunity to comply with the cure order, provide the requested clarifications, and participate in the previously scheduled judicial inspection, all as a consequence of a notification that did not validly and effectively produce its legal effects. That decision was processed through electronic notification to the address designated by this party; however, as stated in the notification record issued by the Oficina de Comunicaciones Judiciales de Cartago, the email system rejected delivery of the message, expressly stating that the recipient email account did not exist or was inactive. Consequently, there is no record that Municipalidad de Cartago actually received the cure order, nor is there any basis for finding that the content of that decision validly entered this party’s sphere of knowledge. In that regard, it is clear that any judicial decision imposing serious or final procedural consequences, such as declaring a complaint inadmissible and consequently archiving the case file, requires a heightened standard of reasoning and factual verification within the judicial record itself, because such decisions not only affect the conduct of the proceeding but may also result in the material loss of access to the courts. Specifically with respect to noncompliance with judicial cure orders, the judicial body must have objective and verifiable certainty that the order was actually communicated to the interested party, because compliance with a judicial order within the period granted may be required only after valid and effective notification. Otherwise, when a punitive procedural consequence is imposed without reliable proof that the communication was received, actual knowledge is improperly replaced by a presumption of knowledge, thereby undermining the protective function of notification and upsetting the balance between the parties. 2) Regarding the nature of this proceeding, it is important to establish clearly that this is not traditional litigation between parties in conflict, but rather an application brought by Municipalidad de Cartago in the exercise of its legal authority and, in particular, in compliance with the order issued by the Constitutional Chamber of the Supreme Court of Justice itself within the previously conducted amparo proceeding. In this respect, this Administration’s intervention is not directed against any particular person and is not intended to generate a dispute in traditionally adversarial terms; rather, it responds to the need to pursue the matter through agrarian judicial proceedings as the appropriate legal mechanism for the competent judicial body to determine, based on technical and legal criteria, whether any intervention involving the property in question is warranted. In essence, this is a matter of public interest connected with environmental protection and risk prevention, which must be resolved under standards of legality, objectivity, and protection of the general interest. It would be improper to understand this proceeding as one brought “against someone,” because the property involved is municipal in nature, that is, it belongs to the public patrimony. With respect to the cure order issued by this Court at nine hours forty-seven minutes on 14 May 2026, this representative hereby fully and specifically addresses each matter identified therein, in order to cure any formal issue noted and allow the proceeding to continue normally, pursuant to the principle of procedural economy. Accordingly, it states: a) That the plaintiff is Municipalidad de Cartago, duly represented by its Municipal Mayor, acting within the scope of its legal and constitutional authority. b) That the amount in controversy in this proceeding should be deemed unquantifiable, because there is no claim involving property rights or any direct monetary claim; rather, the relief sought is a judicial determination concerning the technical and legal propriety of a potential intervention involving property of a public and environmental nature, the economic valuation of which is not the subject matter of this proceeding. c) To ensure proper management of the proceeding and the availability of the technical information necessary for an appropriate resolution of the case, the court is respectfully requested, once the identified matters have been cured and the normal course of the proceeding restored, to reschedule the on-site judicial inspection (appeal brief in images 27 to 40).\n\nIII.- The record shows that, in a decision issued at nine hours forty-seven minutes on 14 May 2026, the court ordered the party instituting the proceeding to cure the following matters: “... A) REGARDING THE REQUIREMENTS OF THE COMPLAINT: 1) State against whom this complaint is directed; 2) State the amount in controversy based on the value of the property that is the subject of the dispute. A period of FIVE DAYS is granted for compliance with the foregoing, with notice that, until the identified matters are cured, the complaint will be declared INADMISSIBLE (Article 100 of the Agrarian Procedural Code).” The electronic address designated for notification was: [...]; however, although the notification record indicates that notification was directed to that address, the fact is that the Notification System produced the following result: “SERVED: NO. the recipient’s mail server rejected delivery of the email because the account does not exist or is inactive” (record in image 23). The appellant is therefore correct that the notification was not received, and automatic notification consequently did not apply. In this regard, Article 42 of the Judicial Notifications Act provides: “System interruption. When the electronic notification transmission system or the receiving server is interrupted for any reason, notification shall be made once the system has been restored. The responsible server shall verify the communications that were not transmitted and send them immediately.” Accordingly, the court should have requested that the Oficina de Comunicaciones Judiciales attempt notification again instead of declaring the complaint inadmissible. It should be noted that this was not an error in the address provided by the party, as demonstrated by the fact that both the decision now on appeal and the decision allowing the appeal were successfully served at that address, showing that the public entity’s account was registered and active (see records in images 26 and 44). \n\nIV.- Furthermore, this Court notes that ordering the party to identify the defendant was wholly improper because the initial filing clearly stated that the trees were located on land owned by the Municipality itself, which requires the proceeding to be brought against “unknown.” Judicial intervention is also necessary because the specimens are located in a protected area. The only justified cure order concerned the statement of the amount in controversy (applicable to summary felling proceedings under Article 97(6) of the Agrarian Procedural Code), but, as indicated, the party could not comply because it did not receive notification, and the court was unwilling to revoke or reconsider its decision. Consequently, the appealed decision is reversed. The court shall process this matter immediately and as a priority, given the allegations in the initial filing concerning the precedent established by the amparo proceeding granted by the Constitutional Chamber and the protection of human safety itself. \n\nTHEREFORE\n\nThe appealed decision is reversed.
