"summary_en": "By majority, the Criminal Judgment Appeals Court of Cartago denied the appeal of three persons convicted through a special abbreviated procedure (procedimiento especial abreviado) of invading a protection area by moving earth to open a road beside the Térraba River. It affirmed each two-month prison sentence, conditionally suspended for three years, the joint award of ₡1.545.660,00 for environmental damage, and forfeiture of a tractor. The majority found that the recording showed the defendants knowingly and voluntarily accepted the facts, sentence, civil claim, forfeiture, documentary evidence, and waiver of trial; neither ineffective technical defense nor defective consent was established. It held that a culturally conditioned mistake-of-law claim, the cited permits, the existence of the protection area, and the environmental-damage valuation could not be litigated on appeal because those disputes had been relinquished when the abbreviated procedure was accepted. Judge Fernández Mora dissented: he would have set aside the judgment and remanded for trial because he considered use of the abbreviated procedure during the trial phase unlawful.",

"excerpt_en": "During the hearing to approve the special abbreviated procedure, it was established that the amount of the civil claim for environmental damage—₡1.545.660,00, plus the corresponding statutory interest and the costs generated by filing the civil damages action—was clearly stated by the Procuraduría General de la República and accepted individually and expressly by each of the three defendants. At that time, the defense raised no objection concerning either the method used to calculate the amount or the legal basis of the civil action. The claim therefore cannot be entertained at this stage because it formed part of the parties’ negotiated agreement, in which the Court finds no error, as it concerned a matter fully subject to disposition by the parties.\n\nMoreover, if the defendants seek to dispute the existence of a protection area at the place where the earthmoving occurred, that argument likewise has no place at this stage. Whether the location where the accused persons opened the track was in fact a protection area under the Forestry Law is a matter for adversarial litigation. In this case, by their express decision and with proper advice from their public defender, they waived trial and accepted responsibility for the criminally charged facts and the facts underlying the civil claim.\n\nFor the foregoing reasons, the appeal must be denied and the challenged judgment affirmed in all respects. Judge Fernández Mora dissents for reasons different from those asserted by the applicants.",

At 9:49 a.m. on 24 September 2026.\n\nProceedings brought against [Nombre 001], an adult Costa Rican national, identity card number [Valor 001], son of [Nombre 002] and [Nombre 003], resident of Buenos Aires, Puntarenas; [Nombre 009], an adult Costa Rican national, identity card number [Valor 002], son of [Nombre 005] and [Nombre 006], resident of Palmar Norte, Osa, Puntarenas; and [Nombre 005], an adult Costa Rican national, identity card number [Valor 003], son of [Nombre 007] and [Nombre 008], resident of Palmar Norte, Osa, Puntarenas; for the offense of INVASION OF A PROTECTION AREA, to the detriment of NATURAL RESOURCES. Judge Christian Fernández Mora and Judges Maureen Sancho González and Susana Wittmann Stengel issue the decision.\n\nBackground:\n\n1. By judgment number 398-2026, issued at 10:39 a.m. on 16 July 2026, the Trial Court of the First Circuit of the Southern Zone, Pérez Zeledón seat, ruled: “THEREFORE: In accordance with the foregoing, the legal provisions cited, Articles 39 and 41 of the Political Constitution, sections 1, 2, 3, 4, 5, 6, 265, 363, 364, 365, 367, 373, 374, and 375 of the Code of Criminal Procedure; sections 1, 30, 45, 50, 59 through 62, and 71 through 74 of the Criminal Code; and Articles 1, 2, 3, 33, and 58(a) of the Ley Forestal, [Nombre 009], [Nombre 001], and [Nombre 005] are found criminally responsible as perpetrators of one offense of INVASION OF A PROTECTION AREA, to the detriment of NATURAL RESOURCES. Each is therefore sentenced to TWO MONTHS’ IMPRISONMENT, which they shall serve, with credit for time spent in pretrial detention, at the place and in the manner specified by the applicable Penitentiary Regulations. REGARDING THE BENEFIT OF CONDITIONAL EXECUTION OF THE SENTENCE: [Nombre 009], [Nombre 001], and [Nombre 005] are granted the benefit of conditional execution of the sentence for a period of THREE YEARS, subject to compliance with the following conditions: 1) They must not commit a new intentional offense for which a sentence of more than six months’ imprisonment is imposed. 2) They must refrain from committing further acts of invasion. In the event of noncompliance, the benefit granted shall be revoked and they shall serve the sentence imposed. The civil claim for damages (Acción Civil Resarcitoria) filed by the Procuraduría General de la República against the civil defendants [Nombre 009], [Nombre 001], and [Nombre 005] is granted, and they are ordered to pay ONE MILLION FIVE HUNDRED FORTY-FIVE THOUSAND SIX HUNDRED SIXTY COLONES for Economic, Material, and Social Damage (Environmental Damage). They are also ordered to pay the interest accruing until the amount ordered has been fully paid, at the rates established within the Sistema Bancario Nacional, as well as procedural costs and attorney’s fees. Pursuant to Articles 103(3) and 110 of the Criminal Code, the forfeiture of a yellow Caterpillar backhoe tractor, license plate [Valor 004], CAT0416DCB2D180, is ordered in favor of the State. The provisional custody of the yellow Caterpillar backhoe tractor, license plate [Valor 004], CAT0416DCB2D180, granted to Mr. [Nombre 005] is revoked. He must therefore appear before this Court and surrender the aforementioned property and is granted ten business days after the judgment becomes final to appear and surrender it. He is advised that, in the event of noncompliance, certified records shall be forwarded to the Ministerio Público because of his failure to surrender the property placed in his custody by SINAC, which, as already stated, has been ordered forfeited in favor of the State, and for the possible offense of fraudulent disposal of property subject to another’s rights (estelionato), or any other criminal offense that the prosecuting authority deems applicable. The sentenced person is advised of the right to representation by the Defensa Pública during the sentence-enforcement stage and that this circumstance must be clearly stated in any applications or incidental proceedings filed before the Sentence Enforcement Court. Once the judgment becomes final, its entry in the Judicial Registry and Archive is ordered. The customary certified copies shall be issued to the Sentence Enforcement Court and the Instituto Nacional de Criminología. The State shall bear the expenses of the proceedings. The parties are hereby notified orally at this hearing. ALLAN PÉREZ ARCE. TRIAL JUDGE.”\n\n2. The defendants [Nombre 009], [Nombre 005], and [Nombre 001] filed an appeal against that decision.\n\n3. Following the corresponding deliberation pursuant to Article 466 of the Code of Criminal Procedure, as amended by Ley 8837, published on 9 December 2011 (Creation of the Appeal from Judgment), the Court considered the issues raised in the appeal.\n\n4. The applicable legal requirements have been observed in the proceedings.\n\nReasons:\n\nI.- Because it satisfies the legal requirements, the appeal filed by the defendants [Nombre 009], [Nombre 005], and [Nombre 001] against oral judgment number 398-2026, issued at 10:39 a.m. on 16 July 2026 by the Trial Court of the First Circuit of the Southern Zone, Pérez Zeledón seat, is admitted for consideration on the merits. In this regard, the challenge is objectively appealable because it was filed against a judgment issued by a trial court that terminates the proceedings, within the period prescribed by Article 460 of the Code of Criminal Procedure. The decision was notified when orally delivered on 16 July 2026, and the appeal was filed on 03 August 2026, while that period remained open. In addition, the appeal was filed by participants with standing to challenge the decision, as they are the defendants. Finally, the filing instituting the appeal adequately sets forth its arguments, permitting comprehensive review of the judgment under Article 8.2(h) of the American Convention on Human Rights and Article 459 of the Code of Criminal Procedure.\n\nII.- The appellants raised several grievances under a single ground of challenge, focusing their disagreement on the alleged negligence and ineffectiveness of the legal defense provided by the Defensa Pública. In their view, counsel did not provide genuine and diligent assistance but was merely formally present, thereby giving rise to an absolute defect that violated due process. They maintain that their consent to the abbreviated procedure (procedimiento abreviado) was defective because the public defender pressured, poorly advised, and deceived them into accepting that disposition without understanding its scope and legal consequences. They state that they were never informed of the defense strategy and that the only instruction they received during the trial hearing was to answer affirmatively to every question asked by the judge. They specify that their claim does not concern the facts found proven, but rather absolute defects, defects of consent, and infringement of the right to effective legal defense, which in their view would render the proceedings null and void.\n\nAs specific support for those grievances, they state that different public defenders successively participated throughout the proceedings without any opportunity to coordinate a defense strategy, citing the isolated participation of several professionals in the formal notification of the complaint, the notification and examination concerning the civil claim for damages and private prosecution complaint (querella), and the filing of the private prosecution complaint. They further state that, at the hearing on the abbreviated procedure, assigned counsel met them only minutes before it began, did not explain the actual strategy, and had no communication or dialogue with them, merely instructing them to agree with the judge’s questions. They assert that this left them entirely without a defense, notwithstanding their reliance on counsel’s professional competence.\n\nThey add that, although they had no criminal records, they were not advised of the possibility of seeking an alternative resolution or proposing a conciliation agreement, a circumstance of which they learned only later through advice from private counsel.\n\nSeparately, defendant [Nombre 001], in his individual capacity, also invokes his status as an Indigenous person belonging to an original people and the fact that the events occurred within Indigenous territory. He therefore claims the mandatory application of the Poder Judicial’s Policy on Access to Justice for Indigenous Peoples and the principle of self-determination recognized in ILO Convention 169, stating that his counsel failed to request a cultural expert assessment to determine whether Ley Indígena N° 6172 or customary law supported his belief that he was acting lawfully.\n\nAlong the same lines, the appellants question counsel’s failure to assess or invoke the documentary evidence in the case file: authorization from the Instituto Costarricense de Turismo for a tourism enterprise activity (page 118); a health permit from the Ministerio de Salud (page 116); certification of an ancestral-use road issued by the Asociación de Desarrollo Integral de Rey Curré, mentioning a ford used as a landing place for rafts on the Térraba River (page 113); and a certificate of possessory rights related to Decreto Ejecutivo N° 34691-J and the “Eco Aventuras Dicrí” infrastructure project (page 117). According to their arguments, that evidence would have demonstrated an unavoidable mistake as to unlawfulness (error de prohibición invencible) under Article 35 of the Criminal Code, instead of resulting in a conviction through the abbreviated procedure.\n\nFinally, they object that the defense also failed to discuss or challenge the environmental-damage assessment established in the proceedings, which they consider excessive and unsupported—for example, by assigning a value to hauling and transporting soil that, according to them, was deposited in situ and never transported elsewhere—or to refute the citation of Articles 58(b) and 62 of the Ley Forestal in the accusation and civil claim for damages. In their view, those provisions are inapplicable because there was no forest area at the site of the events and no forest harvesting occurred.\n\nThey request that the appeal be granted, that the judgment and the prior hearing at which the defect in consent occurred be declared null and void, and that the proceedings be returned to the stage immediately preceding the alleged violation, with a new hearing at which different defense counsel would be appointed to provide genuine, timely, and effective protection of their procedural rights.\n\nBy majority, the ground is denied for the following reasons:\n\nRegarding the lack of legal advice and defective consent to accept the abbreviated procedure: This Chamber reviewed the contents of the hearing scheduled for the trial, held on 16 July 2026. At that hearing, with the court’s authorization and in accordance with the majority line of precedent permitting the use of this adjudicative mechanism at the trial stage—a position also adopted by this same judicial body, for example, in Voto 279-2024 at 09:00 on 19 July 2024—it was stated:\n\n“Following the decision of the Constitutional Chamber (Sala Constitucional) in Voto n.° 17615 at 14:43 on 21 December 2005, the constitutional court, whose decisions are binding erga omnes and must therefore be followed by the ordinary courts, expressly addressed the issue in response to a constitutional consultation submitted by the then Tribunal de Casación Penal. One of the two specific questions presented was whether it was constitutional to use the abbreviated procedure after the intermediate stage had concluded, which is the issue raised by the appellant in the present case. Specifically, the consulting body requested a ruling from the Constitutional Chamber as follows: ‘The application alleges the following matters as violations of due process: a) the application of the abbreviated procedure and issuance of a conviction at a stage subsequent to the intermediate stage’ (sic; see the Background section of the cited decision, n.° 17615-2005; emphasis added).\n\n“This clarification is made to emphasize that the ratio decidendi of the Constitutional Chamber’s decision in the referenced ruling directly and specifically concerns the procedural point at which the special abbreviated procedure may be selected and, more precisely, the constitutionality of doing so after the intermediate stage has concluded. This means that, because its decision concerned this issue as the basis for the ruling, it is binding under Article 13 of the Ley de la Jurisdicción Constitucional.\n\n“In response to the consulting court’s submission, the Constitutional Chamber ruled as follows: ‘Accordingly, the appropriate disposition is to answer this aspect of the consultation by stating that it does not constitute a violation of due process for the abbreviated procedure to be conducted before the Trial Court if—as in this case—the members of the sentencing Court had no prior contact with the case and instead that involvement becomes relevant precisely within the abbreviated procedure that concluded with the appealed judgment’ (sic).\n\n“This means that, in addition to determining that use of the abbreviated procedure at the trial stage was a valid practice, the Constitutional Chamber expressly established that the matter the ordinary criminal courts must safeguard when an application of this kind is made is observance of the principle of impartiality forming part of due process. They must ensure that the court hearing and authorizing the parties’ request—if appropriate and if the legal requirements established in Articles 373 through 375 of the Code of Criminal Procedure are satisfied—is not the same court that issues the judgment on the merits.\n\n“The Constitutional Chamber has not subsequently modified that position since issuing the decision cited here, and the precedent therefore remains binding.\n\n“In addition, there is a strictly procedural consideration: when Article 373 of the Code of Criminal Procedure limits the application of the special abbreviated procedure by providing that ‘the application of the abbreviated procedure may be proposed at any time before the order sending the case to trial is entered,’ it establishes a directory rather than a mandatory deadline. The distinction between the two is that the latter category provides for a procedural sanction if the deadline is not observed. This occurs, for example, when section 360 of the same Code provides that the trial must be annulled if judgment is not issued after the maximum deliberation period. The regulations governing the special abbreviated procedure contain no such provision, leaving open the possibility of applying it beyond the temporal limit marked by the issuance of the order sending the case to trial, provided that, as already stated, the procedures are adapted to ensure respect for due process in its application.”\n\nIn this matter, the parties negotiated a special abbreviated procedure under which the judge presiding over the hearing advised all three defendants of both its advantages and its consequences: the possibility of negotiating a reduction of up to one-third of the lower limit of the penalty—which in this case resulted in a reduction from the statutory minimum of three months to two months’ imprisonment—and, in return, the waiver of trial and acceptance of the facts, the agreed penalty, and the evidence offered. All of this had to be done voluntarily and without any threat or coercion.\n\nThe appellants’ claim that they were not told that they could pursue an alternative measure overlooks the fact that the procedural stage for doing so was the intermediate stage, during which, also by their express decision, the defendants did not pursue other mechanisms permitted by criminal procedural law (see page 334 of the electronic case file). As was to be expected immediately before the trial began, the accusing parties were willing to agree only to a disposition through a judgment issued under a special abbreviated procedure. This does not establish any defect in the court’s conduct.\n\nThe record also shows that, following the judge’s explanation, each of the three defendants was asked individually whether he had understood what was explained, and each separately answered in the affirmative. The same individual questioning method was used later in the hearing to verify: i) whether each defendant heard and understood the facts alleged by the Ministerio Público and the Procuraduría General de la República; ii) whether he accepted them as true; iii) whether he accepted the agreed sentence of two months’ imprisonment; iv) whether he accepted the relief sought in the civil claim for damages in the amount of ₡1.545.660,00, plus statutory interest and costs; v) whether he accepted the forfeiture of the retained vehicle; vi) whether he accepted that the documentary evidence offered by the Ministerio Público and the Procuraduría General de la República would be considered in the judgment; and vii) whether he waived a public trial and did all of the foregoing freely and voluntarily.\n\nIn every instance, the recording documents individual affirmative answers, with no objection, doubt, or expression of disagreement by any of the three defendants at that procedural stage.\n\nThe defendants’ conduct in answering the adjudicating body’s questions, together with the statements made by public defender José Adolfo Vargas Hernández when explaining the agreement he had obtained with the representatives of the accusing parties, does not support a finding of professional negligence by the public defender representing the defendants. He remained attentive at all times to what was occurring, and there is no indication that the defendants expressed any displeasure or experienced any communication problem with the person defending them.\n\nOn the contrary, all three defendants stated that they understood the nature of the special abbreviated procedure and the consequences of their decision to waive the oral and public trial that was to be conducted that day, as well as their acceptance of the facts alleged by the Ministerio Público and the Procuraduría General de la República, the negotiated sentence, and the civil consequences of the acts attributed to them.\n\nConsequently, the argument raised at this stage is merely an assertion unsupported by any evidence and a futile attempt by the defendants to obtain an improper benefit, given that a ceiling had been established for the sentence that could be imposed upon them in a judgment if the matter were remanded. The record, however, discloses no defect that infringed due process or could give rise to a due-process violation.\n\nFurthermore, the fact that the defendants were represented by different Defensa Pública professionals during the various proceedings in which they were required to participate reflects the circumstance that this institution provides a public service governed by the principles of continuity and efficiency (Article 4 of the Ley de la Administración Pública). Accordingly, when an appointed professional is unable to attend a proceeding for any reason, every effort is made to ensure that another person can replace that professional, including for a specific proceeding.\n\nThis occurred with the examinations of Mr. [Nombre 005] and Mr. [Nombre 009]. For the specific acts consisting of their examinations regarding the facts investigated by the Ministerio Público, they were represented by public defender Ericka Durán, who handled only that particular proceeding. They were subsequently represented by public defender Felicia Acevedo Silesky, who handled the examinations relating to the private prosecution complaint. This was because those proceedings had to be conducted on commission at the Fiscalía de Osa, a location closer to the defendants’ residences, and not because of administrative disorder or a failure by the Defensa Pública to discharge its representational duties (see pages 166-171 and 263).\n\nThe matter was later assigned to the professional who would ultimately represent them, attorney Andrey Fuentes Gamboa (see page 305 of the electronic case file). Beginning with the preliminary hearing, he was replaced by attorney Adolfo Vargas Hernández, who was also present at the hearing at which the trial was to be conducted.\n\nThis issue has been addressed by the Constitutional Chamber, which stated in decision 13746-2003 at 15:16 on 21 December 2003:\n\n“This Chamber considers that the public defense, as a body within criminal proceedings, cannot be limited to the physical identity of a single public defender. Doing so would instead place the defendant at a potential disadvantage and could even leave the defendant without a defense. On the one hand, the defendant has the power to change counsel whenever the defendant deems it appropriate and the law permits. On the other hand, counsel may, for various reasons, face a manifest impediment to attending a particular act within the criminal proceedings, including incapacity, vacation, or authorized leave from work.\n\n“All such situations may in one way or another make it impossible for that same person to be physically present at some of those acts, evidently—as has been stated—within the guidelines and powers previously established by law. This does not mean that those situations violate the applicant’s fundamental rights, because the cited impediment preventing the public defender from appearing in no way means that the defendant will be left adrift in conducting the defense or unable to make it effective. If this occurs, the individual public defender will be replaced by another person acting in the same capacity, so that the latter may undertake the corresponding actions within the criminal proceedings on the applicant’s behalf, always with a view to respecting the applicant’s right of defense and due process.”\n\nThere is consequently no evidence that the defendants were ever left without a defense, that effective communication between that professional and the defendants failed to occur during the proceedings, or, much less, that counsel pressured them into accepting the special abbreviated procedure.\n\nAs may be seen, the defendants are merely speculating in an attempt to have a judgment declared ineffective even though they voluntarily agreed that it should be issued. Without any form of pressure, they consented to resolution of the matter through a special abbreviated procedure in which they waived litigation over the evidence and instead agreed to accept responsibility for the acts and the negotiated sentence. They benefited considerably from that agreement by obtaining a one-third reduction from the minimum penalty applicable to the offense found proven.\n\nRegarding the alleged failure to consider [Nombre 001]’s Indigenous status, the application of ILO Convention 169, the documentary evidence concerning the permits and certifications invoked by the defense, and the alleged unavoidable mistake as to unlawfulness.\n\nThe argument made specifically with respect to defendant [Nombre 001] warrants particular consideration. He asserts that one circumstance demonstrating the negligence of his assigned public defender is that counsel made no argument on his behalf concerning his status as an Indigenous person or the law applicable to that population, through which the existence of a culturally conditioned mistake as to unlawfulness would have been demonstrated.\n\nThe appellant overlooks, however, that this issue could not have been litigated in a special abbreviated procedure, not only because none of the parties raised the need to do so when the defendant voluntarily accepted responsibility for the acts, but also because, had such a matter been alleged, the abbreviated procedure necessarily would have been rejected and the trial conducted.\n\nIn this regard, when expressly questioned by the judge who conducted the hearing, defense counsel Vargas Hernández decided to dispense with the evidence through which that issue might at some point have been introduced for discussion. This demonstrates that a defense strategy on the matter did in fact exist, but that, by the time of trial, counsel determined that resolution through a special abbreviated procedure would be more advantageous to the defendants’ interests. This specific argument must therefore be rejected.\n\nSimilarly, it would have made no sense for the defense to request a cultural expert assessment when no issue relating to the existence of any mistake was to be litigated and when there was no information indicating that the defendant had any condition preventing him from understanding the rules of social coexistence established by our legal system. Indeed, the defendant himself stated that he spoke Spanish and required no interpretation to understand others or make himself understood. The argument is therefore irrelevant to the resolution of this matter.\n\nRegarding the assessment of environmental damage and the citation of Articles 58(b) and 62 of the Ley Forestal.\n\nDuring the hearing approving the special abbreviated procedure, the amount sought in the civil claim for environmental damage—₡1.545.660,00, plus the corresponding statutory interest and the costs arising from the filing of the civil claim for damages—was clearly stated by the representative of the Procuraduría General de la República and individually and expressly accepted by each of the three defendants. At that time, the defense raised no objection either to the method used to calculate the amount or to the legal basis of the civil claim. This claim cannot therefore be entertained at this stage, because it formed part of the agreement reached by the parties, no impropriety in which is apparent, as it concerned a matter entirely subject to disposition by agreement.\n\nFurthermore, although the accusations mentioned Articles 58(b) and 62 of the Ley Forestal, at the aforementioned hearing both the representative of the Ministerio Público and the representative of the Procuraduría General de la República explained that this was merely a clerical error. What was attributed to the defendants was the offense of invading a protection area, provided for in Articles 58(a), in relation to section 33, of the Ley Forestal. The accusatory pleadings described the defendants as having performed earthworks (movimientos de tierra) on the bank of the Térraba River to open a road at that location.\n\nIt is therefore clear that the defense had nothing to object to in that clarification, particularly because it was understood that the offense for which the defendants were accepting responsibility and negotiating a sentence was the offense provided for in the aforementioned Article 58(a) of the Ley Forestal, carrying penalties of between three months’ and three years’ imprisonment. A sentence of two months’ imprisonment was agreed for that single offense.\n\nFurthermore, if the defendants seek to dispute the existence of a protection area at the site where the earthworks were performed, that argument likewise has no place at this stage. Whether the location where the accused persons constructed the track was in fact a protection area under the Ley Forestal is an issue that properly belongs to adversarial litigation. In this case, by their express decision and with proper advice from their public defender, they waived the trial and accepted responsibility for the acts alleged in both the criminal accusation and the civil claim.\n\nIn view of the foregoing, the appeal must be rejected and the challenged decision affirmed in all respects. Judge Fernández Mora files a dissenting opinion for reasons different from those asserted by the appellants.\n\nIII.- Dissenting opinion of Judge Fernández Mora: I must depart from the majority’s decision because, as I have consistently maintained, the principle of the tribunal established by law (juez natural) is violated when a special abbreviated procedure is approved at the trial stage without satisfaction of the statutory requirements.\n\nAs may be seen, this is an absolute defect insofar as the defendant is deprived of adjudication by the person who, under the law, was responsible for resolving the matter through an oral and public trial. By this point, it had already been decided that the dispute would be submitted to this method of resolution, governed by the adversarial principle, rather than to consensual methods of disposition established by the legislature for stages preceding the plenary trial.\n\nI have advanced many arguments in opposing this type of practice, which is not contemplated by the legal system and which the Sala de Casación Penal has continued to endorse. The most pertinent argument in this particular case, however, concerns the fact that situations of this kind place undue pressure on the defendant. Within a matter of minutes, the defendant must decide whether to avoid trial in the face of the threat of an allegedly imminent conviction or to accept a reduced sentence offered as an act of State leniency, precisely when everything is ready for trial to begin and for a determination to be made as to whether the presumption of innocence protecting the defendant can be overcome.\n\nThat circumstance was especially relevant in this matter, in which it has been alleged that the defendants were pressured by the public defender representing them to accept the abbreviated procedure. From my perspective, this is an issue that must not be treated lightly. Although it could not be said that counsel coerced them into making the decision, a person facing prosecution experiences substantial pressure upon knowing that the witnesses who will testify against that person are waiting outside the courtroom and that, if their testimony is credited together with the remaining evidence, a sentence substantially greater than the one offered under an abbreviated procedure may be imminent. Having to decide this within only a few minutes creates great pressure and may produce defects of consent, because the decision is not made with the calm deliberation that it should entail.\n\nThat opportunity for proper reflection and for making a free and informed decision is precisely what underlies the legislature’s provision that the abbreviated procedure must be selected before the order sending the case to trial is issued (Article 373 of the Code of Criminal Procedure). By the trial stage, the parties are presumed to have decided to exercise the right to contest the evidence and to resolve the matter under the rules governing trial.\n\nIn other words, I consider this type of judicial practice, which precedent has authorized for predominantly efficiency-driven purposes, wholly inappropriate and violative of the defendant’s most elementary fundamental rights, including the right of defense, the right not to be subjected to methods that induce or alter the defendant’s will, and the right to contest the evidence. I therefore consider that the judgment must be declared ineffective and the matter remanded for the trial that should have been conducted from the outset.\n\nTherefore:\n\n1.- The appeal filed by defendants [Nombre 009], [Nombre 005], and [Nombre 001] is admitted for consideration on the merits. 2.- On the merits, the appeal is denied by majority, and the challenged judgment is affirmed in all respects.
