8710, publicada en La Gaceta\nN° 48 del 10 de marzo de 2009, se reforma el artículo 2° de la Ley N° 5695,\nLey de Creación del Registro Nacional, publicada en el Diario Oficial La\nGaceta N° 106 del 07 de junio de 1975 y sus reformas, indicando que el\nCatastro Nacional pasa a formar parte del Registro Inmobiliario.\n\nII.-Que el Decreto Ejecutivo N° 35509-J de 30 de\nsetiembre de 2009, Reglamento de Organización del Registro Inmobiliario\npublicado en el Diario Oficial La Gaceta N° 198 del 13 de octubre de\n2009, establece que el Registro Inmobiliario está conformado por la\nSubdirección Catastral y la Subdirección Registral.\n\nIII.-Que el Registro Inmobiliario del Registro\nNacional, con fundamento en la Ley de Catastro Nacional N° 6545 de 25 de marzo\nde 1981, publicada en el Diario Oficial La Gaceta N° 73 del 15 de abril\nde 1981, en su artículo 13 tiene como potestad exclusiva, la ejecución y\nmantenimiento del Catastro, función que puede delegar parcialmente en otras\ninstituciones estatales.\n\nIV.-Que la Asamblea Legislativa, el 27 de noviembre de\n2001, aprobó la Ley N° 8154, \"Convenio de Préstamo N° 1284/OC-CR, Programa de\nRegularización del Catastro y Registro\", suscrito entre el Gobierno de la\nRepública y el Banco Interamericano de Desarrollo (BID), publicada en el Diario\nOficial La Gaceta N° 237 del 10 de diciembre del 2001 para la ejecución\ndel Programa de Regularización del Catastro y Registro Nacional, que por\ndisposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita al\nMinisterio de Hacienda como órgano desconcentrado.\n\nV.-Que el Programa de Regularización del Catastro y\nRegistro Nacional, tuvo como tarea el levantamiento catastral con el objetivo\nde formar el catastro nacional y compatibilizar la información catastral y\nregistral de los inmuebles, en aplicación de lo que dispone la Ley de Catastro\nN° 6545 de 25 de marzo de 1981, publicada en el Diario Oficial La Gaceta N°\n73 el 15 de abril de 1981, función que culminó el 07 de mayo de 2014.\n\nVI.-Que de conformidad con lo que establece el\nartículo 1° Decreto Ejecutivo N° 30106-J donde se \"Declara Zona Catastral la\nTotalidad de los Cantones del Territorio Nacional\" publicado en La Gaceta N°\n19 de 28 de enero de 2002 y el artículo 7° del Reglamento a la Ley del Catastro\nNacional, Decreto Ejecutivo N° 34331, publicado en el Diario Oficial La\nGaceta N° 41 del 27 de febrero del 2008, el cual rige desde el 27 de\nsetiembre de 2008, la totalidad de los cantones del territorio nacional fueron\ndeclarados zona catastral.\n\nVII.-Que el Reglamento a la Ley de Catastro Nacional,\nDecreto Ejecutivo N° 34331 el cual rige desde el 27 de setiembre de 2008 y que\nfue publicado en el Diario Oficial La Gaceta N° 41 del 27 de febrero del\n2008, establece los requerimientos técnicos para el levantamiento de planos de\nagrimensura.\n\nVIII.-Que por haber concluido los trabajos de\nlevantamiento catastral del cantón 05 Osa, distrito 06 Bahía Drake, provincia\n06 Puntarenas, y de conformidad con lo que establece el artículo 19 de la Ley\nde Catastro Nacional y 10 de su reglamento, fueron invitados los titulares de\ninmuebles de dicho distrito a una exposición pública para conocer los\nresultados del levantamiento y manifestar su conformidad o disconformidad,\nexposición que se llevó a cabo del 15 al 22 de noviembre del 2021.\n\nIX.-Que la invitación a la exposición pública de los\nresultados del levantamiento catastral del cantón 05 Osa, distrito 06 Bahía\nDrake, provincia de Puntarenas, fue publicada en La Gaceta N° 215 del 08\nde noviembre del 2021, páginas 68 y 69, y en los diarios de Circulación\nNacional La Nación del 11 de noviembre del 2021, página 7 y La Teja del 10 de\nnoviembre del 2021, página 5.\n\nX.-Que en resolución de las ocho horas del quince de\nsetiembre del año dos mil veintidós, el Registro Inmobiliario del Registro\nNacional declaró firmes los datos catastrales resultantes del levantamiento\ncatastral efectuado en el cantón 05 Osa, distrito 06 Bahía Drake, provincia de\nPuntarenas.\n\nXI.-Que ya the\nNational Cadastre becomes part of the Real Property Registry.\n\nII.-That Executive Decree N° 35509-J of September 30,\n2009, Regulation for the Organization of the Real Property Registry\npublished in the Official Gazette La Gaceta N° 198 of October 13,\n2009, establishes that the Real Property Registry is comprised of the\nCadastral Subdirectorate and the Registry Subdirectorate.\n\nIII.-That the Real Property Registry of the National\nRegistry, based on the National Cadastre Law N° 6545 of March 25,\n1981, published in the Official Gazette La Gaceta N° 73 of April 15,\n1981, in its article 13 has the exclusive authority for the execution and\nmaintenance of the Cadastre, a function that it may partially delegate to other\nstate institutions.\n\nIV.-That the Legislative Assembly, on November 27,\n2001, approved Law N° 8154, \"Loan Agreement N° 1284/OC-CR, Program for\nthe Regularization of Cadastre and Registry\", subscribed between the Government of the\nRepublic and the Inter-American Development Bank (IDB), published in the Official\nGazette La Gaceta N° 237 of December 10, 2001 for the execution\nof the Program for the Regularization of Cadastre and National Registry, which by\nprovision of the same law, is the responsibility of an Executing Unit attached to the\nMinistry of Finance as a deconcentrated body.\n\nV.-That the Program for the Regularization of Cadastre and\nNational Registry had the task of carrying out the cadastral survey with the objective\nof forming the national cadastre and making the cadastral and registry information\nof the properties compatible, in application of the provisions of the Cadastre Law\nN° 6545 of March 25, 1981, published in the Official Gazette La Gaceta N°\n73 on April 15, 1981, a function that concluded on May 7, 2014.\n\nVI.-That in accordance with the provisions of\narticle 1 of Executive Decree N° 30106-J which \"Declares the Entirety of the\nCantons of the National Territory a Cadastral Zone\" published in La Gaceta N°\n19 of January 28, 2002 and article 7 of the Regulation to the National Cadastre\nLaw, Executive Decree N° 34331, published in the Official Gazette La\nGaceta N° 41 of February 27, 2008, which is in force since September 27,\n2008, the entirety of the cantons of the national territory were\ndeclared a cadastral zone.\n\nVII.-That the Regulation to the National Cadastre Law,\nExecutive Decree N° 34331 which is in force since September 27, 2008 and was\npublished in the Official Gazette La Gaceta N° 41 of February 27,\n2008, establishes the technical requirements for the survey of\ncadastral plans (planos de agrimensura).\n\nVIII.-That, having concluded the cadastral survey\nwork of canton 05 Osa, district 06 Bahía Drake, province\n06 Puntarenas, and in accordance with the provisions of article 19 of the Law\nof the National Cadastre and 10 of its regulation, the property owners\nof said district were invited to a public exhibition to learn of the\nresults of the survey and express their conformity or non-conformity,\nan exhibition that took place from November 15 to 22, 2021.\n\nIX.-That the invitation to the public exhibition of the\nresults of the cadastral survey of canton 05 Osa, district 06 Bahía\nDrake, province of Puntarenas, was published in La Gaceta N° 215 of November 8,\n2021, pages 68 and 69,
