publicada en La Gaceta\nN° 48 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley N° 5695,\nLey de Creación del Registro Nacional, publicada en el Diario Oficial La\nGaceta N° 106 del 07 de junio de 1975 y sus reformas, indicando que el\nCatastro Nacional pasa, a formar parte del Registro Inmobiliario.\n\nII.-Que el Decreto Ejecutivo N° 35509-J de 30 de\nsetiembre de 2009, Reglamento de Organización del Registro Inmobiliario\npublicado en el Diario Oficial La Gaceta N° 198 del 13 de octubre de\n2009, establece que el Registro Inmobiliario está conformado por la\nSubdirección Catastral y la Subdirección Registral.\n\nIII.-Que el Registro Inmobiliario del Registro\nNacional, con fundamento en la Ley de Catastro Nacional N° 6545 de 25 de marzo\nde 1981, publicada en el Diario Oficial La Gaceta N° 73 del 15 de abril\nde 1981 en su artículo 13 tiene como potestad exclusiva, la ejecución y\nmantenimiento del Catastro, función que puede delegar parcialmente en otras\ninstituciones estatales.\n\nIV.-Que la Asamblea Legislativa, el 27 de noviembre de\n2001, aprobó la Ley N° 8154, \"Convenio de Préstamo N° 1284/OC-CR, Programa de\nRegularización del Catastro y Registro\", suscrito entre el Gobierno de la\nRepública y el Banco Interamericano de Desarrollo (BID), publicada en el Diario\nOficial La Gaceta N° 237 del 10 de diciembre del 2001 para la ejecución\ndel Programa de Regularización del Catastro y Registro Nacional, que por\ndisposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita al\nMinisterio de Hacienda como órgano desconcentrado.\n\nV.-Que el Programa de Regularización del Catastro y\nRegistro Nacional, tuvo como tarea el levantamiento catastral con el objetivo\nde formar el catastro nacional y compatibilizar la información catastral y\nregistral de los inmuebles, en aplicación de lo que dispone la Ley de Catastro\nN° 6545 de 25 de marzo de 1981 publicada en el Diario Oficial La Gaceta N°\n73 el 15 de abril de 1981, función que culminó el 07 de mayo de 2014.\n\nVI.-Que de conformidad con lo que establece el\nartículo 1° Decreto Ejecutivo N° 30106-J donde se \"Declara Zona Catastral la\nTotalidad de los Cantones del Territorio Nacional\" publicado en La Gaceta N° 19\nde 28 de enero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro\nNacional, Decreto Ejecutivo N° 34331, publicado en el Diario Oficial La\nGaceta N° 41 del 27 de febrero del 2008 el cual rige desde el 27 de\nsetiembre de 2008, la totalidad de los cantones del territorio nacional fueron\ndeclarados zona catastral.\n\nVII.-Que el Reglamento a la Ley de Catastro Nacional,\nDecreto Ejecutivo N° 34331 el cual rige desde el 27 de setiembre de 2008 y que\nfue publicado en el Diario Oficial La Gaceta N ° 41 del 27 de febrero\ndel 2008, establece los requerimientos técnicos para el levantamiento de planos\nde agrimensura.\n\nVIII.-Que por haber concluido los trabajos de\nlevantamiento catastral del Cantón 02 Pococí, Distrito 04 Roxana, Provincia 07\nLimón, y de conformidad con lo que establece el artículo 19 de la Ley de\nCatastro Nacional y 10 de su reglamento, fueron invitados los titulares de\ninmuebles de dicho distrito a una exposición pública para conocer los\nresultados del levantamiento y manifestar su conformidad o disconformidad,\nexposición que se llevó a cabo del 31 de octubre al 12 de noviembre del 2014.\n\nIX.-Que la invitación a la exposición pública de los\nresultados del levantamiento catastral del Cantón 02 Pococí, Distrito 04\nRoxana, Provincia de Limón, fue publicada en La Gaceta N° 196 del 13 de\noctubre del 2014, página 2 y en los diarios de Circulación Nacional La Nación\ndel 20 de octubre del 2014, página 58 A y La Teja del 21 de octubre del 2014,\npágina 11.\n\nX.-Que en resolución de las quince horas treinta\nminutos del trece de setiembre del año dos mil veintidós, el Registro\nInmobiliario del Registro Nacional declaró firmes los datos catastrales\nresultantes del levantamiento catastral efectuado en el Cantón 02 Pococí,\nDistrito 04 Roxana, Provincia de Limón.\n\ntext-align:\njustify;text-indent:36.0pt'>XI-Que ya transcurrieron los\ntérminos de los plazos establecidos en el artículo 20 de la Ley del Catastro\nNacional y fueron resueltos, por la Dirección del Registro Inmobiliario del\nRegistro Nacional, los reclamos presentados por los propietarios. No. 48 of March 10, 2009, article 2 of Law No. 5695, the National Registry Creation Act, published in the Official Gazette La Gaceta No. 106 of June 7, 1975, and its amendments, is reformed, indicating that the National Cadastre becomes part of the Real Estate Registry.\n\nII.-That Executive Decree No. 35509-J of September 30, 2009, Real Estate Registry Organization Regulation, published in the Official Gazette La Gaceta No. 198 of October 13, 2009, establishes that the Real Estate Registry is composed of the Cadastral Sub-Directorate (Subdirección Catastral) and the Registry Sub-Directorate (Subdirección Registral).\n\nIII.-That the Real Estate Registry of the National Registry, based on the National Cadastre Act No. 6545 of March 25, 1981, published in the Official Gazette La Gaceta No. 73 of April 15, 1981, in its article 13, has the exclusive power for the execution and maintenance of the Cadastre, a function that it may partially delegate to other state institutions.\n\nIV.-That the Legislative Assembly, on November 27, 2001, approved Law No. 8154, \"Loan Agreement No. 1284/OC-CR, Cadastre and Registry Regularization Program,\" entered into between the Government of the Republic and the Inter-American Development Bank (IDB), published in the Official Gazette La Gaceta No. 237 of December 10, 2001, for the execution of the Cadastre and National Registry Regularization Program, which, by provision of the same law, is in charge of an Executing Unit assigned to the Ministry of Finance as a deconcentrated body.\n\nV.-That the Cadastre and National Registry Regularization Program had the task of cadastral surveying (levantamiento catastral) with the objective of forming the national cadastre and making cadastral and registry information on properties compatible, in application of what is provided in the Cadastre Act No. 6545 of March 25, 1981, published in the Official Gazette La Gaceta No. 73 on April 15, 1981, a function that concluded on May 7, 2014.\n\nVI.-That in accordance with what is established in article 1 of Executive Decree No. 30106-J, where \"Declares the Entirety of the Cantons of the National Territory a Cadastral Zone,\" published in La Gaceta No. 19 of January 28, 2002, and article 7 of the Regulation to the National Cadastre Act, Executive Decree No. 34331, published in the Official Gazette La Gaceta No. 41 of February 27, 2008, which has been in effect since September 27, 2008, the entirety of the cantons of the national territory were declared a cadastral zone (zona catastral).\n\nVII.-That the Regulation to the National Cadastre Act, Executive Decree No. 34331, which has been in effect since September 27, 2008, and was published in the Official Gazette La Gaceta No. 41 of February 27, 2008, establishes the technical requirements for the surveying of surveying plans (planos de agrimensura).\n\nVIII.-That because the cadastral surveying works for Canton 02 Pococí, District 04 Roxana, Province 07 Limón have concluded, and in accordance with what is established in article 19 of the National Cadastre Act and 10 of its regulation, the holders of properties (inmuebles) in said district were invited to a public exhibition (exposición pública) to learn the results of the surveying and express their agreement or disagreement, an exhibition that took place from October 31 to November 12, 2014.\n\nIX.-That the invitation to the public exhibition of the cadastral surveying results for Canton 02 Pococí, District 04 Roxana, Province of Limón, was published in La Gaceta No. 196 of October 13, 2014, page 2, and in the national circulation newspapers La Nación of October 20, 2014, page 58 A, and La Teja of October 21, 2014, page 11.\n\nX.-That in a resolution at fifteen hours thirty minutes on September thirteenth of the year two thousand twenty-two, the Real Estate Registry of the National Registry declared final (firmes) the resulting cadastral data from the cadastral surveying carried out in Canton 02 Pococí, District 04 Roxana, Province of Limón.\n\nXI.-That the terms of the deadlines established in article 20 of the National Cadastre Act have now elapsed, and the complaints (reclamos) filed by the owners were resolved by the Directorate of the Real Estate Registry of the National Registry.
