Asimismo, de conformidad\ncon la Ley Nº 59, el IGN es la dependencia científica y técnica rectora de\nla cartografía nacional, destinada a la ejecución del Mapa básico oficial y la\nDescripción básica geográfica de la República de Costa Rica y a los estudios,\nlas investigaciones o labores y el desarrollo de políticas nacionales de\ncarácter cartográfico, geográfico, geodésico, geofísico y de índole similar que\ntenga relación con dichas obras, con el fin de apoyar los procesos de\nplanificación.\n\n2°-Que la Ley Nº 59 constituye al IGN de\nmanera permanente y en representación del Estado, como la autoridad oficial en\nmateria geodésica y de la representación espacial de la geografía de la\nRepública de Costa Rica, extendiéndose su autoridad a las actividades de\ncualquier orden que tengan por origen los trabajos confiados a su cargo.\n\n3°-Que de conformidad con la Ley Nº 59; el\nartículo 62 del Decreto Ejecutivo N° 7841-P Reglamento a la Ley sobre la\nZona Marítimo Terrestre se reconoce la competencia del IGN para la\ndelimitación de la zona pública de la Zona Marítimo Terrestre, y su\noficialización a través de publicación en el Diario Oficial La Gaceta;\nel artículo 63 del Decreto Ejecutivo N° 7841-P señala que El Instituto\nGeográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción\nde la zona marítimo-terrestre en que haya demarcado la zona pública.\n\n4°-Que en el Decreto Ejecutivo N°\n36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de\nla zona pública de la Zona Marítimo Terrestre, se establece según el\nartículo 18 que para la delimitación de la zona pública de la Zona Marítimo\nTerrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican\nen los artículos 19 y 20, correspondientes a la delimitación de la zona pública\nde la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la\ndelimitación digital georreferenciada, esto con el fin de agilizar las\ndelimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\n5°-Que en el Decreto Ejecutivo N°\n33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el\nCR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del\nServicio Internacional de Rotación de la Tierra (IERS) para la época de\nmedición 2005.83, el cual entre otros aspectos determina, a la Red\nGeodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica\nasociada CRTM05, como el sistema oficial al cual deben estar referidas las\ncoordenadas de todos los trabajos geodésicos, cartográficos y catastrales que\nse ejecuten en nuestro país, señalando específicamente en artículo 11 que: \"La\nRed Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección\ncartográfica CRTM05, constituirán el único sistema oficial de coordenadas para\nla República de Costa Rica a partir del cual se debe referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen en el\nTerritorio Nacional toda dependencia pública, persona o entidad privada\nnacional o extranjera.\"; mientras que el artículo 7 indica que \"Conforme\nse produzcan datos cartográficos en el nuevo sistema de proyección cartográfica\nCRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados\naquella información que se ha oficializado.\"\n\n6°-Que el Decreto Ejecutivo Nº 40962-MJP Actualización\ndel Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara\nen su artículo 1 que El sistema geodésico de referencia horizontal oficial para\nCosta Rica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de\nmedición 2014.59, y en adelante, los cambios y su actualización, se regirán de\nacuerdo a las nuevas definiciones del ITRF que se implementen en la red\ncontinental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS)\ndenominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de\nproyección cartográfica CRTM05 seguirá siendo el oficial para la representación\ncartográfica del territorio nacional continental, extendido para efectos de\naplicación de esta proyección cartográfica, hasta la línea de base del mar territorial\nen el océano Pacífico y el mar Caribe, definida esta línea conforme a los\nartículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del\nMar, como punto de partida para el cómputo de la anchura máxima de todas las\náreas marinas jurisdiccionales del Estado costarricense.\n\nPor su parte, el artículo 12 del decreto\nde cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el\nsistema nacional de coordenadas oficial a la cual se deben referenciar en el\nterritorio continental de nuestro país, al señalar que El sistema de\nreferencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05\npara el territorio continental extendido hasta la línea de base del mar\nterritorial y, la proyección cartográfica \"Universal Transversal de Mercator\"\n(UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el\nocéano Pacífico y el mar Caribe, constituirán el único sistema oficial de\ncoordenadas para la República de Costa Rica, a partir del cual, se deben referenciar\ntodos los levantamientos y actividades cartográficos y geodésicos que\ndesarrollen en el territorio nacional toda dependencia pública, persona o\nentidad privada, nacional o extranjera, que emprendan o contraten trabajos\ngeodésicos y cartográficos, contribuyéndose a evitar el gasto público y\nobteniendo, por otra parte, información geográfica confiable, uniforme y\ncomparable, que sea de utilidad general y que apoye la toma de decisiones en\nlos distintos niveles del Estado.\n\n7°-Que la georreferenciación al sistema\nnacional de coordenadas como mecanismo para delimitar la zona pública de la\nZona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública\na los efectos de la elaboración de planes reguladores, el visado de planos de\nagrimensura, el otorgamiento de concesiones en la Zona Restringida y otros\naspectos de ordenamiento territorial costero.\n\n8°-Que la información digital\ngeorreferenciada sobre delimitación de la zona pública de la Zona Marítimo\nTerrestre con que cuenta el IGN, se le denomina Geodatabase Digital\nGeorreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona\nMarítimo Terrestre (ZMT).\n\n9°-Que la Geodatabase Digital\nGeorreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona\nMarítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la\nregulación establecida por: a) el Decreto Ejecutivo N° 7841-P Reglamento\na la Ley N° 6043 sobre la Zona Marítimo Terrestre, b) el Decreto\nEjecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa\nRica, el CR05, y su proyección cartográfica asociada, CRTM05 c) el\nDecreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones\npara la Delimitación de la zona pública de la Zona Marítimo Terrestre, y d) el\nDecreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de\nReferencia Horizontal Oficial para Costa Rica.\n\n10.-Que el artículo 16 de la Ley Forestal,\nLey N° 7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente\ny Energía delimitará en el terreno los linderos de las áreas que conforman el\nPatrimonio Natural del Estado.\n\n11.-Que según el\nartículo 11 del CAPÍTULO I, Disposiciones Generales de la Ley N° 6043,\nestablece que la Zona pública es también, sea cual fuere su extensión, la\nocupada por todos los manglares de los litorales continentales e insulares y\nesteros del territorio nacional.\n\n12.-Que el Decreto Ejecutivo N°\n36786-MINAET Manual para la clasificación de tierras dedicadas a la\nconservación de los recursos naturales dentro de la Zona Marítimo Terrestre en\nCosta Rica publicado en La Gaceta Nº 217 del 11 de noviembre del 2011,\nestablece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre\naquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos\nClase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas\ncosteras, pantanos, bosques anegados, salitrales), para certificarlos e\nincorporarlos como parte del Patrimonio Natural del Estado (PNE).\n\n13.-Que el Decreto Ejecutivo N°\n36786-MINAET en el punto III.-Competencias para la delimitación y\ncertificación establece que La clasificación de los terrenos dentro de la ZMT\ncorresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de\nConservación (SINAC) y a profesionales privados debidamente acreditados por los\nColegios Profesionales respectivos para que clasifiquen los bosques, terrenos\nde aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías,\nmarismas, lagunas costeras, pantanos, bosques anegados, salitrales) y\nhumedales.\n\nLa validez de los documentos de\nclasificación emitidos por profesionales privados quedará sujeta a la\naprobación que emita el AC que por competencia territorial le corresponda. A\nlas AC del SINAC con jurisdicción en la ZMT les competerá, además, la\nverificación, fiscalización, deslinde y certificación de las tierras del\nPatrimonio Natural del Estado y las zonas de protección. La ubicación y\ndelimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona\nMarítimo Terrestre, debe realizarse como parte del proceso de aprobación del\nPlan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan\nRegulador Costero es el instrumento de ordenamiento territorial, que define y\nubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de\nésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero\ndebe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en\nel área total a concesionar.\n\n14.-Que el IGN utilizó la metodología de\nDelimitación Digital para delimitar la zona pública de la Zona Marítimo\nTerrestre correspondiente al ecosistema de estero-manglar del sector central en\nQuepos, distrito 01 Quepos, cantón 06 Quepos, provincia 06 Puntarenas.\n\n15.-Que la delimitación del ecosistema de\nestero-manglar del sector central de Quepos, se delimitó con los polígonos\ndenominados Sector 2, Sector 3 y Sector 4, localizados en los sitios conocidos\ncomo Los Alfaro, Junta Naranjo y Cementerio.\n\n16.-Que la delimitación de los sectores de\nla zona pública en la parte central de Quepos corresponde a los ecosistemas\nubicados en el cantón de Quepos, de acuerdo a lo indicado por la Sala\nConstitucional según Resolución N° 2021002741 de las 09:15 horas del 12 de\nfebrero de 2021, la cual ordena al Área de Conservación Pacífico Central\n(ACOPAC) y al Instituto Geográfico Nacional (IGN) lo siguiente: que de\nmanera conjunta y coordinada realicen las actuaciones correspondientes para\nque, delimiten el ecosistema de manglar de la zona de Quepos.\"\n\n17.-Que la\ndelimitación digital del ecosistema de estero-manglar del Sector Central de\nQuepos corresponde al Informe Técnico N° DIG-TOT-INF-104-2023 y SINAC-ACOPAC-OSRP-PNE-0058-2023\nde fecha 19 de mayo de 2023, generado en conjunto por el Subproceso de\nLímites Oficiales del Departamento Topográfico y Observación del Territorio del\nIGN y la Oficina Sub-Regional Aguirre Parrita, ACOPAC.\n\n18.-Que el artículo 140 de la Ley N° 6227 Ley\nGeneral de la Administración Pública señala que \"el acto administrativo producirá\nsu efecto después de Likewise, in accordance\nwith Law Nº 59, the IGN is the scientific and technical dependency governing\nnational cartography, intended for the execution of the official Basic Map and the\nbasic geographic Description of the Republic of Costa Rica, and for the studies,\nresearch, or work, and the development of national policies of a\ncartographic, geographic, geodetic, geophysical, and similar nature that\nare related to said works, in order to support planning\nprocesses.\n\n2°-That Law Nº 59 constitutes the IGN\npermanently and on behalf of the State, as the official authority in\ngeodetic matters and in the spatial representation of the geography of the\nRepublic of Costa Rica, its authority extending to activities of\nany order originating from the work entrusted to its charge.\n\n3°-That in accordance with Law Nº 59;\narticle 62 of Executive Decree N° 7841-P, Regulation to the Law on the\nMaritime Terrestrial Zone, recognizes the competence of the IGN for the\ndelimitation of the public zone of the Maritime Terrestrial Zone, and its\nofficialization through publication in the Official Gazette La Gaceta;\narticle 63 of Executive Decree N° 7841-P indicates that the National Geographic\nInstitute shall publish a notice in the Official Gazette for each portion\nof the maritime-terrestrial zone in which it has demarcated the public zone.\n\n4°-That in Executive Decree N°\n36642-MP-MOPT-MINAET, Regulation of Specifications for the Delimitation of\nthe public zone of the Maritime Terrestrial Zone, it is established according to\narticle 18 that for the delimitation of the public zone of the Maritime Terrestrial\nZone, the IGN may resort to two execution methodologies, as indicated\nin articles 19 and 20, corresponding to the delimitation of the public zone\nof the Maritime Terrestrial Zone through the placement of landmarks (mojones) and/or the\ngeoreferenced digital delimitation, this with the purpose of streamlining the\ndelimitations and providing greater technical security to interested parties.\n\n5°-That in Executive Decree N°\n33797-MJ-MOPT, Declaring as the official horizontal datum for Costa Rica\nCR05, linked to the International Terrestrial Reference Framework (ITRF2000) of the\nInternational Earth Rotation Service (IERS) for the measurement epoch\n2005.83, which among other aspects determines the National Geodetic\nNetwork of Horizontal Reference CR05, and its associated cartographic projection\nCRTM05, as the official system to which the coordinates of all geodetic,\ncartographic, and cadastral work executed in our country must be referenced,\nspecifically stating in article 11 that: \"The\nNational Geodetic Network of Horizontal Reference CR05 and the cartographic projection\nsystem CRTM05 shall constitute the only official coordinate system for\nthe Republic of Costa Rica, from which all surveys and cartographic and geodetic\nactivities developed in the National Territory by any public dependency, person,\nor national or foreign private entity must be referenced.\"; while article 7 indicates that \"As\ncartographic data is produced in the new CRTM05 cartographic projection\nsystem, the National Geographic Institute shall publish through appropriate means\nthat information which has been officialized.\"\n\n6°-That Executive Decree Nº 40962-MJP, Update\nof the Official Horizontal Geodetic Reference System for Costa Rica, declares\nin its article 1 that the official horizontal geodetic reference system for\nCosta Rica, named as CR05 and its materialization through the National Geodetic\nNetwork, changes its acronym to CRSIRGAS, as the official horizontal reference\nsystem for the Republic of Costa Rica, linked to the International Terrestrial\nReference Framework ITRF2008 (IGb08), for the measurement epoch\n2014.59, and henceforth, changes and their updates shall be governed in\naccordance with the new ITRF definitions implemented in the continental\nnetwork of the Geocentric Reference System for the Americas (SIRGAS)\nnamed SIRGAS-CON, while article 2 establishes that the\nCRTM05 cartographic projection system shall remain official for the cartographic representation\nof the continental national territory, extended for the purposes of\napplying this cartographic projection to the baseline of the territorial sea\nin the Pacific Ocean and the Caribbean Sea, this line being defined in accordance with\narticles 5, 6, and 7 of the United Nations Convention on the Law of the\nSea, as the starting point for calculating the maximum width of all\njurisdictional marine areas of the Costa Rican State.\n\nFor its part, article 12 of the cited decree\nreinforces the application of the CRTM05 cartographic projection as the\nofficial national coordinate system to which work must be referenced in the\ncontinental territory of our country, by stating that the horizontal reference\nsystem CRSIRGAS and its associated cartographic projection CRTM05\nfor the continental territory extended to the baseline of the territorial\nsea, and the \"Universal Transverse Mercator\" (UTM) cartographic projection,\nzones 16 and 17 for the jurisdictional marine and insular areas in the\nPacific Ocean and the Caribbean Sea, shall constitute the only official\ncoordinate system for the Republic of Costa Rica, from which all\nsurveys and cartographic and geodetic activities developed in the national territory\nby any public dependency, person, or private entity, national or foreign,\nthat undertake or contract geodetic and cartographic work must be referenced,\ncontributing to avoiding public spending and\nobtaining, on the other hand, reliable, uniform, and comparable geographic information,\nwhich is of general utility and supports decision-making at\nthe different levels of the State.\n\n7°-That georeferencing to the national\ncoordinate system as a mechanism to delimit the public zone of the\nMaritime Terrestrial Zone enables the correct delimitation of the public zone\nfor the purposes of preparing regulatory plans (planes reguladores), the approval of surveying plans (visado de planos de agrimensura), the granting of concessions in the Restricted Zone, and other\naspects of coastal land-use planning.\n\n8°-That the georeferenced digital\ninformation on the delimitation of the public zone of the Maritime Terrestrial\nZone held by the IGN is called the Georeferenced Digital Geodatabase (GDG) of the National Geographic\nInstitute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n9°-That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime\nTerrestrial Zone (ZMT) is technically based on the application of the\nregulation established by: a) Executive Decree N° 7841-P, Regulation\nto Law N° 6043 on the Maritime Terrestrial Zone, b) Executive\nDecree N° 33797-MJ-MOPT, Declaring as the official horizontal datum for Costa\nRica CR05, and its associated cartographic projection CRTM05, c)\nExecutive Decree N° 36642-MP-MOPT-MINAET, Regulation of Specifications\nfor the Delimitation of the public zone of the Maritime Terrestrial Zone, and d)\nExecutive Decree Nº 40962-MJP, Update of the Official Horizontal\nGeodetic Reference System for Costa Rica.\n\n10.-That article 16 of the Forest Law (Ley Forestal),\nLaw N° 7575 of February 13, 1996, establishes that the Ministry of Environment\nand Energy shall delimit on the ground the boundaries of the areas that form the\nNatural Heritage of the State (Patrimonio Natural del Estado).\n\n11.-That according to\narticle 11 of CHAPTER I, General Provisions of Law N° 6043,\nit establishes that the public zone is also, whatever its extension, that\noccupied by all mangroves of the continental and insular coastlines and\nestuaries (esteros) of the national territory.\n\n12.-That Executive Decree N°\n36786-MINAET, Manual for the classification of lands dedicated to the\nconservation of natural resources within the Maritime Terrestrial Zone in\nCosta Rica, published in La Gaceta Nº 217 of November 11, 2011,\nestablishes among its objectives to identify within the Maritime Terrestrial Zone\nthose lands that classify as forests, of forest aptitude (suelos\nClase VII y VIII), wetlands (mangroves, estuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons (lagunas costeras),\nswamps (pantanos), flooded forests (bosques anegados), salt flats (salitrales)), to certify them and\nincorporate them as part of the Natural Heritage of the State (PNE).\n\n13.-That Executive Decree N°\n36786-MINAET in point III.-Competencies for delimitation and\ncertification establishes that the classification of lands within the ZMT\nshall correspond to the Conservation Areas (AC) of the National System of Conservation Areas (SINAC) and to duly accredited private professionals from the\nrespective Professional Associations (Colegios Profesionales) to classify forests,\nlands of forest aptitude (suelos Clase VII y VIII), (mangroves, estuaries (esteros), rias (rías),\nsalt marshes (marismas), coastal lagoons (lagunas costeras), swamps (pantanos), flooded forests (bosques anegados), salt flats (salitrales)), and\nwetlands.\n\nThe validity of the classification documents\nissued by private professionals shall be subject to the\napproval issued by the AC with corresponding territorial competence. The\nACs of SINAC with jurisdiction in the ZMT shall also be responsible for\nthe verification, oversight, demarcation (deslinde), and certification of the lands of the\nNatural Heritage of the State and the protection zones. The location and\ndelimitation of the areas of the Natural Heritage of the State within the\nMaritime Terrestrial Zone must be carried out as part of the approval process for the\nCoastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the\nCoastal Regulatory Plan is the land-use planning instrument that defines and\nlocates all the zones to be concessioned within the ZMT and for the classification\nthereof at the level of cadastral plans (planos de catastro). Therefore, the Coastal Regulatory Plan\nmust clearly and expressly indicate the areas of the PNE so as not to count them in\nthe total area to be concessioned.\n\n14.-That the IGN used the methodology of\nDigital Delimitation to delimit the public zone of the Maritime Terrestrial\nZone corresponding to the estuary-mangrove (estero-manglar) ecosystem of the central sector in\nQuepos, district 01 Quepos, canton 06 Quepos, province 06 Puntarenas.\n\n15.-That the delimitation of the estuary-mangrove (estero-manglar) ecosystem of the central sector of Quepos was delimited with the polygons (polígonos)\nnamed Sector 2, Sector 3, and Sector 4, located at the sites known\nas Los Alfaro, Junta Naranjo, and Cementerio.\n\n16.-That the delimitation of the sectors of\nthe public zone in the central part of Quepos corresponds to the ecosystems\nlocated in the canton of Quepos, in accordance with what was indicated by the Constitutional Chamber (Sala Constitucional)\naccording to Resolution N° 2021002741 of 09:15 hours on February 12,\n2021, which orders the Central Pacific Conservation Area (ACOPAC) and the National Geographic Institute (IGN) the following: \"that\njointly and coordinately carry out the corresponding actions so that\nthey delimit the mangrove ecosystem of the Quepos area.\"\n\n17.-That the\ndigital delimitation of the estuary-mangrove (estero-manglar) ecosystem of the Central Sector of\nQuepos corresponds to Technical Report N° DIG-TOT-INF-104-2023 and SINAC-ACOPAC-OSRP-PNE-0058-2023\ndated May 19, 2023, generated jointly by the Subprocess of\nOfficial Limits of the Topographic and Territory Observation Department of the\nIGN and the Aguirre Parrita Sub-Regional Office, ACOPAC.\n\n18.-That article 140 of Law N° 6227, General\nLaw of Public Administration, indicates that \"the administrative act shall produce\nits effect after being communicated to the administered party, except if it grants\nonly rights, in which case it shall produce them from the moment it is adopted,\"\na provision that must necessarily be related to numeral 204 subsection 1) of\nthat regulatory body, which defines the suitable instrument for communicating\nacts of a generic nature by stating that: \"General acts shall be communicated by publication\nand specific acts by notification.\"\n\nCOMMUNICATES:\n\n1º-That, during the month of February 2022,\njoint fieldwork was carried out between the IGN and ACOPAC to delimit the\nestuary-mangrove (estero-manglar) ecosystem belonging to the public zone of the Central Sector\nof Quepos, district 1° Quepos, canton 6° Quepos, province 6°\nPuntarenas.\n\n2º-The National Geographic Institute\npublishes the georeferenced digital delimitation of the public zone of the Central Sector\nof Quepos, comprised between the sites Cementerio, Junta Naranjo, and Los\nAlfaro, which forms part of the estuary-mangrove (estero-manglar) ecosystem located in\ndistrict 1° Quepos, canton 6° Quepos, province 6° Puntarenas, based on the\nRegulation of Specifications for the Delimitation of the public zone of the\nMaritime Terrestrial Zone and the methodology used and validated by the\nCentral
