así como la totalidad del artículo 5°, del Acuerdo\nAJDIP/280-2014, en razón de que se estaba provocando afectación a las\nactividades de pesca comercial en pequeña escala, turística, así como la pesca\ndeportiva.\n\n4º-Que en razón de lo anterior, se recibe informe por medio del oficio\nINCOPESCA-PE-AJ144-2023, suscrito por la Dirección de Ordenamiento Pesquero y\nAcuícola y la Asesoría Jurídica, en el cual se recomienda modificar el Acuerdo\nde Junta Directiva AJDIP/280-2014, por cuanto de su lectura se desprende que,\nen cuanto a la flota comercial de pequeña escala, ésta ha quedado excluida de\nla posibilidad de realizar la pesca y almacenamiento de carnada viva en viveros\ndentro de las áreas descritas en los incisos a, b y c del artículo 4, situación\nque debe ser clarificada, al igual que las limitaciones en cuanto a la pesca\ncomercial de palangre, turística, así como la pesca deportiva.\n\n5º-Que en razón de evitar un perjuicio a la flota de pesca comercial\npequeña escala, turística, así como a la pesca deportiva y siendo evidente que\nexisten errores en la redacción en el Acuerdo AJDIP/280-2014, el cual se emitió\ncon el propósito de regular la pesca con carnada viva que realizan las flotas\npesqueras que utilizan palangre de superficie, se recomienda por seguridad\njurídica, así como, la necesidad de mantener de manera clara y diáfana la\nregulación del aprovechamiento del pez vela dirigido a la pesca turística y\ndeportiva, y respetar las actividades que desde hace mucho tiempo realizan los\npescadores artesanales de nuestro país, principalmente en la parte interna de\nlos golfos definidos en el artículo 4 de dicho Acuerdo.\n\n6º-Que los criterios técnicos que sirvieron de base para adoptar el\nAcuerdo AJDIP/280-2014 no han\nsufrido lesión que justifique realizar nuevas valoraciones en este sentido\ndado que el objeto del Acuerdo\nde marras es enmendar la redacción del mismo.\n\n7º-Que habiendo recibido las explicaciones por parte de la Dirección de\nOrdenamiento Pesquero y Acuícola y la Asesoría Jurídica Institucional y\nrealizado el análisis y valoración correspondiente, se ha procedido a ajustar y\nclarificar las inconsistencias encontradas en el Acuerdo AJDIP/280-2014,\ncumpliendo con ello el mandato derivado del Acuerdo AJDIP/190-2023 y\ngarantizando el cumplimiento del principio de acceso democrático sostenible a\nlos recursos pesqueros, razón por la cual este último habiendo cumplido sus\nfines y objetivos no tiene razón jurídica de permanecer vigente, por lo que lo\nprocedente es derogarlo.\n\n8º-Que el Incopesca debe procurar que el\nordenamiento jurídico pesquero sea equitativo y facilitador para todas las\nflotas pesqueras del país y en razón de ello con el presente Acuerdo se\npretende garantizar igualdad de oportunidades a todos los sectores por igual,\nen este caso subsanando un perjuicio injustificado en contra de la flota\npesquera artesanal.\n\n9º-Que en cumplimiento de lo que dispone el artículo 50 de la Constitución\nPolítica de Costa Rica, así como de la aplicación de los principios de\ndesarrollo sostenible, precautorio, preventivo y de acceso democrático\nsostenible a los recursos pesqueros y de conformidad con lo dispuesto en la Ley\n7384 Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, Ley\n8436 Ley de Pesca y Acuicultura, luego de analizada la propuesta presentada, la\nJunta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por\ntanto;\n\nACUERDA\n\n1º-Modificar los artículos 4° y 5° del Acuerdo de Junta\nDirectiva AJDIP/280-2014, con el fin de que en adelante se lean en los\nsiguientes términos:\n\n\"Artículo 4. Comuníquese este Acuerdo al Servicio\nNacional de Guardacostas, Servicio Nacional de Salud Animal, Ministerio de\nAmbiente y Ministerio de Seguridad Pública, para lo de sus competencias.\n\n5º-Publíquese en el Diario oficial\nLa Gaceta.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Regulation 252\n\n Reform of Management Measures for the Use of Live Bait by the Commercial Fishing Fleet and Sport Fishing in the Costa Rican Pacific Ocean\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/252-2023.-Puntarenas, on the seventeenth day of the month of October, two thousand twenty-three.\n\nConsidering:\n\n1º-That it is the responsibility of the Costa Rican Institute of Fisheries and Aquaculture, INCOPESCA, to coordinate the fishing sector, as well as to promote and manage the development of fisheries and aquaculture at the national level.\n\n2º-That by means of Agreement AJDIP/280-2014, the Management Measures for the use of Live Bait by the Commercial Fishing Fleet and Sport Fishing in the Costa Rican Pacific Ocean were established.\n\n3º-That by means of Board of Directors Agreement AJDIP/190-2023, given observations from the National Coast Guard Service and small-scale fishing sectors, the application of Article 4, subsections a, b, and c; as well as the entirety of Article 5, of Agreement AJDIP/280-2014, was temporarily suspended, because it was causing detriment to small-scale commercial fishing activities, tourism-related fishing, and sport fishing.\n\n4º-That due to the foregoing, a report was received through official communication INCOPESCA-PE-AJ144-2023, signed by the Directorate of Fisheries and Aquaculture Management and the Legal Advisory Office, in which it is recommended to modify Board of Directors Agreement AJDIP/280-2014, since its reading shows that the small-scale commercial fleet has been excluded from the possibility of fishing for and storing live bait in live wells within the areas described in subsections a, b, and c of Article 4, a situation that must be clarified, as must the limitations regarding commercial longline fishing, tourism-related fishing, and sport fishing.\n\n5º-That in order to avoid detriment to the small-scale commercial fishing fleet, tourism-related fishing, and sport fishing, and since it is evident that there are drafting errors in Agreement AJDIP/280-2014, which was issued with the purpose of regulating fishing with live bait carried out by fishing fleets using surface longlines, it is recommended, for legal certainty, as well as the need to maintain in a clear and transparent manner the regulation of the exploitation of sailfish for tourism-related and sport fishing, and to respect the activities that artisanal fishers of our country have long carried out, mainly in the inner part of the gulfs defined in Article 4 of said Agreement.\n\n6º-That the technical criteria that served as the basis for adopting Agreement AJDIP/280-2014 have not suffered injury that would justify carrying out new assessments in this regard, given that the purpose of the aforementioned Agreement is to amend its drafting.\n\n7º-That having received the explanations from the Directorate of Fisheries and Aquaculture Management and the Institutional Legal Advisory Office and having carried out the corresponding analysis and assessment, we have proceeded to adjust and clarify the inconsistencies found in Agreement AJDIP/280-2014, thereby fulfilling the mandate derived from Agreement AJDIP/190-2023 and guaranteeing compliance with the principle of sustainable democratic access to fishery resources, which is why the latter, having fulfilled its purposes and objectives, has no legal reason to remain in force, and therefore the appropriate action is to repeal it.\n\n8º-That INCOPESCA must ensure that the fisheries legal system is equitable and facilitative for all the country's fishing fleets, and for this reason, this Agreement aims to guarantee equal opportunities to all sectors alike, in this case rectifying an unjustified detriment against the artisanal fishing fleet.\n\n9º-That in compliance with the provisions of Article 50 of the Political Constitution of Costa Rica, as well as the application of the principles of sustainable development, precautionary principle, preventive principle, and sustainable democratic access to fishery resources, and in accordance with the provisions of Law 7384, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture, and Law 8436, the Law of Fisheries and Aquaculture, after analyzing the proposal presented, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore;\n\nAGREES\n\n1º-To modify Articles 4 and 5 of Board of Directors Agreement AJDIP/280-2014, so that henceforth they shall read as follows:\n\n\"Article 4. A prohibition zone is established for the fishing and storage of live bait in live wells, for the commercial fleet except tourism-related fishing and small-scale fishing; as well as for sport fishing, except in Responsible Fishing Marine Areas that so authorize; according to the following demarcation and characteristics:\n\na. In Golfo Dulce from an imaginary line between Cabo Matapalo (08°22'14\",16 North Latitude, 83°17'43\",01 West Longitude) and Punta Banco (08°21'18\",21 North Latitude, 83°08'41\",05 West Longitude), and from this line inland to the end of Golfo Dulce (towards Rincón de Osa, 08°41'24\",83 North Latitude, 83°29'00\",29 West Longitude), for vessels that do not have the respective valid fishing permits for this purpose.\n\nb.
