Fulica)\n\nN° 44266-MAG\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AGRICULTURA Y GANADERÍA\n\nEn ejercicio de las facultades que les confieren los\nartículos 140, incisos 3), 8), 18) y 20) y 146 de la Constitución Política; los\nartículos 25, 27,1, 28.2 b) de la Ley General de la Administración Pública, Ley\nN° 6227 del 02 de mayo de 1978; los artículos: 2 inciso a), b), c), 5 incisos\na), c), e), h), i), k), m), 8 incisos a), g), h). i), j), 12, 13, 14, 15, 16,\n17, 18, 19 y 20 de la Ley de Protección Fitosanitaria, Ley N° 7664 del 08 de\nabril de 1997 y la Ley de Ejecución de los Acuerdos de la Ronda Uruguay de\nNegociaciones Comerciales Multilaterales y el Acuerdo de Medidas Sanitarias y\nFitosanitarias, Ley N° 7473 del 20 de diciembre de 1994.\n\nConsiderando:\n\nI.-Que es función esencial del Estado proteger la salud y\nla vida de las personas y animales, así como garantizar la protección de los\ncultivos de las plagas que pongan en riesgo o causen daños a la producción\nagrícola.\n\n2.-Que corresponde al Ministerio de Agricultura y Ganadería a través del\nServicio Fitosanitario del Estado, velar por la protección fitosanitaria de los\ncultivos en nuestro país, disponiendo, una vez comprobada la existencia de una\nplaga, las medidas técnicas y de control que eviten la propagación de estas.\n\n3.-Que el caracol gigante africano (Achatina fulica (Bowdich, 1822) es\nconsiderado, una de las plagas más perjudiciales del mundo debido a su alta\nresistencia a variables ambientales, dieta polífaga y a un alto potencial\nreproductivo que favorece su dispersión, lo que causa grandes daños económicos\nen la agricultura y el ambiente.\n\n4.-Que en el año 2021 el Servicio Fitosanitario del Estado confirmó la\nincursión de Caracol Gigante Africano (Achatina fulica (Bowdich, 1822) según\nreporte del laboratorio de Diagnóstico Fitosanitario del Servicio Fitosanitario\ndel Estado N° 89840, en la comunidad de Curubandé,\ndel distrito de Curubandé, cantón de Liberia,\nprovincia de Guanacaste, lo que provocó alerta y ameritó que a esta plaga se le\nbrindara un control adecuado, con la finalidad de que la misma no alcanzara\npoblaciones que generaran riesgo en el agro nacional, la salud pública y el\nambiente.\n\n5.-Que, sobre la base de lo anterior, el Poder Ejecutivo, decretó Estado de\nEmergencia Nacional, mediante el Decreto N° 43001-MAG del 10 de mayo del año\n2021, el cual en su artículo 5, estableció las medidas fitosanitarias técnicas\nnecesarias para la contención y erradicación de la plaga antes mencionada,\nmediante el \"Plan de acción para el caracol gigante africano Achatinafulica (Bowdich,\n1822)\".\n\n6.-Que el plazo dispuesto en el Decreto N° 43001-MAG del 10 de mayo del año\n2021, venció el 10 de mayo del 2023.\n\n7.-Que desde el año 2021 y hasta la fecha de emisión del presente Decreto,\nel Servicio Fitosanitario del Estado, ha implementado las medidas\nfitosanitarias que contiene el \"Plan de acción para el caracol gigante\nafricano Achatina fulica (Bowdich, 1822)\" versión 1 del mes de febrero del año\n2021, diseñado originalmente para la atención de la emergencia.\n\n8.-Que, a la fecha, cada una de las acciones indicadas en el \"Plan de\nacción para el caracol gigante africano Achatina fulica (Bowdich, 1822)\" del\nmes de febrero del 2021, fueron cumplidas en su totalidad, con excepción de las\nactividades de colocación y revisión de trampas, debido a un aspecto de índole\ntécnico, pues la implementación del uso de dichas trampas, no resultó efectiva.\n\n9.-Que, de acuerdo con el informe de situación al mes de junio del 2023, emitido por el Servicio\nFitosanitario del Estado, en el último monitoreo se detectaron dos individuos pequeños vivos y\nalgunos caparazones de adultos vacíos del Caracol Gigante Africano (Achatina fulica (Bowdich, 1822).\n\n10.-Que, a razón de lo anterior, las autoridades del Servicio Fitosanitario\ndel Estado, han actualizado el \"Plan de acción para el Caracol Gigante\nAfricano Achatina fulica (Bowdich, 1822)\", dando origen a una segunda versión\ndel plan, que data del mes de junio del 2023, en el cual se establecen las acciones\na desarrollar en el área de atención definida y el seguimiento, por lo que se\nrequiere ampliar el plazo de atención de la emergencia hasta el año 2025.\n\n11.-Que deben continuarse con las acciones establecidas, para poder\ndecretar la erradicación de la plaga y posterior monitoreo.\n\n12.-Que de conformidad con los párrafos segundo y tercero del artículo 12\ndel Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y\nTrámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero\nde 2012, el presente Decreto no crea ni modifica trámites, requisitos o\nprocedimientos por lo que no requiere del Trámite de Mejora Regulatoria. Por\ntanto,\n\nDecretan:\n\nDECLARACIÓN DE ESTADO DE EMERGENCIA\n\nFITOSANITARIA NACIONAL, PARA LA PREVENCIÓN\n\nY CONTROL DEL CARACOL GIGANTE AFRICANO\n\n(ACHATINA FULICÁ)\n\nArtículo 1°-Se declara estado de Emergencia Fitosanitaria\nNacional, por la plaga Achatina fulica\n(A. LIVESTOCK\n\nIn exercise of the powers conferred upon them by\narticles 140, subsections 3), 8), 18), and 20) and 146 of the Political Constitution; articles\n25, 27.1, 28.2 b) of the General Public Administration Law (Ley General de la Administración Pública), Law\nN° 6227 of May 2, 1978; articles: 2 subsection a), b), c), 5 subsections\na), c), e), h), i), k), m), 8 subsections a), g), h), i), j), 12, 13, 14, 15, 16,\n17, 18, 19, and 20 of the Phytosanitary Protection Law (Ley de Protección Fitosanitaria), Law N° 7664 of April 8,\n1997, and the Law on the Implementation of the Uruguay Round Agreements of Multilateral Trade Negotiations and the Agreement on Sanitary and Phytosanitary Measures, Law N° 7473 of December 20, 1994.\n\nConsidering:\n\nI.—That it is an essential function of the State to protect the health and\nlife of people and animals, as well as to guarantee the protection of\ncrops from pests that endanger or cause damage to agricultural\nproduction.\n\n2.—That it is the responsibility of the Ministry of Agriculture and Livestock (Ministerio de Agricultura y Ganadería), through the State Phytosanitary Service (Servicio Fitosanitario del Estado), to ensure the phytosanitary protection of\ncrops in our country, ordering, once the existence of a\npest is verified, the technical and control measures that prevent its spread.\n\n3.—That the giant African snail (Achatina fulica (Bowdich, 1822)) is considered one of the most damaging pests in the world due to its high\nresistance to environmental variables, polyphagous diet, and high reproductive\npotential that favors its dispersal, causing great economic damage\nto agriculture and the environment.\n\n4.—That in the year 2021, the State Phytosanitary Service (Servicio Fitosanitario del Estado) confirmed the incursion of the Giant African Snail (Achatina fulica (Bowdich, 1822)) according to\nreport N° 89840 from the Phytosanitary Diagnostic Laboratory of the State Phytosanitary Service (Laboratorio de Diagnóstico Fitosanitario del Servicio Fitosanitario del Estado), in the community of Curubandé,\nCurubandé district, Liberia canton,\nGuanacaste province, which triggered an alert and warranted that this pest be\ngiven adequate control, with the aim of preventing it from reaching\npopulations that would generate risk to national agriculture, public health, and\nthe environment.\n\n5.—That, based on the foregoing, the Executive Branch decreed a National\nEmergency Status, by means of Decree N° 43001-MAG of May 10, 2021,\nwhich in its Article 5 established the necessary technical phytosanitary measures\nfor the containment and eradication of the aforementioned pest,\nthrough the \"Action Plan for the Giant African Snail Achatina fulica (Bowdich,\n1822)\" (Plan de acción para el caracol gigante africano Achatina fulica (Bowdich, 1822)).\n\n6.—That the term set forth in Decree N° 43001-MAG of May 10, 2021,\nexpired on May 10, 2023.\n\n7.—That from the year 2021 to the date of issuance of this Decree,\nthe State Phytosanitary Service (Servicio Fitosanitario del Estado) has implemented the phytosanitary measures\ncontained in the \"Action Plan for the Giant African Snail Achatina fulica (Bowdich, 1822)\" (Plan de acción para el caracol gigante africano Achatina fulica (Bowdich, 1822)) version 1 of February 2021,\noriginally designed for emergency response.\n\n8.—That, to date, each of the actions indicated in the \"Action Plan for the giant African snail Achatina fulica (Bowdich, 1822)\" (Plan de acción para el caracol gigante africano Achatina fulica (Bowdich, 1822)) of\nFebruary 2021, has been fully completed, with the exception of the\nactivities of placing and checking traps, due to a technical\naspect, since the implementation of the use of said traps was not effective.\n\n9.—That, according to the situation report as of June 2023, issued by the State\nPhytosanitary Service (Servicio Fitosanitario del Estado), in the last monitoring, two small live individuals and\nsome empty adult shells of the Giant African Snail (Achatina fulica (Bowdich, 1822)) were detected.\n\n10.—That, by reason of the foregoing, the authorities of the State Phytosanitary Service (Servicio Fitosanitario\ndel Estado) have updated the \"Action Plan for the Giant African Snail Achatina fulica (Bowdich, 1822)\" (Plan de acción para el Caracol Gigante Africano Achatina fulica (Bowdich, 1822)), giving rise to a second version\nof the plan, dating from June 2023, which establishes the actions\nto be carried out in the defined attention area and the follow-up, for which reason it is\nnecessary to extend the emergency response period until the year 2025.\n\n11.—That the established actions must be continued in order to be able\nto decree the eradication of the pest and subsequent monitoring.\n\n12.—That in accordance with the second and third paragraphs of Article 12\nof the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures (Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos), Executive Decree N° 37045-MP-MEIC of February 22,\n2012, this Decree does not create or modify procedures, requirements, or\nprocedures, therefore it does not require the Regulatory Improvement Procedure (Trámite de Mejora Regulatoria). Therefore,\n\nThey decree:\n\nDECLARATION OF A NATIONAL PHYTOSANITARY EMERGENCY STATUS\n\nFOR THE PREVENTION AND CONTROL OF THE GIANT AFRICAN SNAIL\n\n(ACHATINA FULICA)\n\nArticle 1°—A national phytosanitary emergency status (estado de Emergencia Fitosanitaria Nacional) is declared for the pest Achatina fulica\n(A. fulica), due to the effects it causes on\nagricultural production, public health, and the environment.\n\nArticle 2°—Every owner or occupant of\nland, by any title, is obliged to report the presence of the pest\nto the State Phytosanitary Service (Servicio Fitosanitario del Estado), as provided in Article 14\nof Law N° 7664, Phytosanitary Protection Law (Ley de Protección Fitosanitaria).\n\nArticle 3°—The owners or occupants\nof land, by any title, in areas where the pest is detected, must\ncooperate with the officials of the State Phytosanitary Service (Servicio Fitosanitario del Estado) or whomever it\ndesignates, for the application of officially recommended control measures.\n\nArticle 4°—The owners of farms,\nlands, and private properties, or occupants by any title in general, with the\npresence of the pest, must allow free access to the officials of the\nMinistry of Agriculture and Livestock (Ministerio de Agricultura y Ganadería) and of the State Phytosanitary Service (Servicio Fitosanitario del Estado),\nas well as bear all legal easements (servidumbres legales) necessary to execute\nthe phytosanitary actions (inspections, evaluation, sampling,\nelimination of plant material) and the works carried out by public\nentities in response to the emergency, provided that this is\nabsolutely indispensable for its timely attention.\n\nArticle 5°—The owners or occupants\nof land, by any title, in areas where the pest is detected, are obliged\nto comply with the phytosanitary control measures for the containment and\neradication of the pest, established in the second version of the \"Action Plan for the giant African snail Achatina fulica (Bowdich, 1822)\" (Plan de\nacción para el caracol gigante africano Achatina fulica (Bowdich, 1822)) of\nJune 2023, which may be adjusted by the State Phytosanitary Service (Servicio Fitosanitario del\nEstado), according to the technical needs that arise in addressing\nthe pest.\n\nArticle\n6°—The State Phytosanitary Service (Servicio Fitosanitario del Estado) will promote the training of\nproducers and technicians on phytosanitary and health issues\nrelated to the aforementioned pest, and will also provide support in\nsample analysis at official laboratories.\n\nArticle 7°—For the execution of the Action Plan\nestablished in Article 5 of this Executive Decree, the State\nPhytosanitary Service (Servicio Fitosanitario del Estado) will have funds from the ordinary budget during\nthe periods 2023, 2024, and 2025.\n\nArticle 8°—Public or private, autonomous, or semi-autonomous institutions are urged to make donations and\neconomic contributions, as well as to provide all types of collaboration to the State\nPhytosanitary Service (Servicio Fitosanitario del Estado), to address this phytosanitary emergency.\n\nArticle 9°—The phytosanitary emergency status (Estado de emergencia fitosanitaria) will be maintained for a period of two years from the publication\nof this Decree. If necessary, the emergency period may\nbe extendable until the pest is eradicated.\n\nArticle 10.—It becomes effective upon its publication.\n\nGiven at the Presidency of the Republic.—San\nJosé, on the sixth day of the month\nof September of the year two\nthousand twenty-three." }
