  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 312\n\n                        Reforma Reglamento para el seguimiento, control y vigilancia de\nembarcaciones pesqueras de las flotas nacional y extranjera (AJDIP/076-2022.)\n\nINSTITUTO COSTARRICENSE\nDE PESCA Y ACUICULTURA\n\n(Así derogada esta norma mediante acuerdo N° AJDIP/162-2024 del 2 de julio del 2024)\n\nAJDIP/312-2023.-Puntarenas,\na los diecinueve días del mes diciembre de dos mil veintitrés.\n\nConsiderando:\n\n1°-Que por\nmedio de los Acuerdos de Junta Directiva AJDIP/077-2020, AJDIP/076-2022,\nAJDIP/247-2022, AJDIP/030-2023 y AJDIP/031-2023, respectivamente, se estableció\nel \"Reglamento para el Seguimiento, Control y Vigilancia de Embarcaciones\nPesqueras de las Flotas Nacional y Extranjera\", mismo que conlleva la\nobligatoriedad para las embarcaciones de la flota pesquera nacional y\nextranjera de contar debidamente instalada y en uso un sistema de radio baliza\nenlazada con el Centro de Control, Monitoreo y Vigilancia del INCOPESCA.\n\n2°-Que en\nesas disposiciones reglamentarias no sólo se contempló la obligatoriedad dicha;\nsino que comprenden plazos diferenciados de entrada en vigencia para las\ndiversas flotas pesqueras; entre las cuales se encuentran las embarcaciones\npertenecientes a la flota de pesca deportiva y turística de mediana escala,\núltima de las cuales ha sido incorporada y para la cual se tenía en principio\nsu entrada en vigencia a partir del 01 de enero del 2024.\n\n3°-Que con\nel fin de avanzar en el proceso de implementación de lo señalado, desde la\nPresidencia Ejecutiva se estableció contacto directo con representantes de la\npesca deportiva y turística, en la cual se presentó el Acuerdo AJDIP/076 2022,\ncon el fin que se pudiera complementar con una redacción más amplia para ese\nsector pesquero.\n\n4°-Que en\nbase a dicho proceso se estableció la creación de una Comisión de trabajo de\nrepresentantes de la pesca deportiva y turística con el propósito que se\nhicieran las valoraciones y recomendaciones de un texto alternativo de\nreglamentación exclusiva para la pesca deportiva y turística.\n\n5°-Que por\nparte del señor Guillermo Ramírez Gätgens.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 312\n\n                        Reform of the Regulation for the monitoring, control and surveillance of\nfishing vessels of the national and foreign fleets (AJDIP/076-2022.)\n\nCOSTA RICAN INSTITUTE\nOF FISHERIES AND AQUACULTURE\n\n(Thus repealed this norm by agreement N° AJDIP/162-2024 of July 2, 2024)\n\nAJDIP/312-2023.-Puntarenas,\non the nineteenth day of the month of December of two thousand twenty-three.\n\nConsidering:\n\n1°-That by\nmeans of Board of Directors Agreements AJDIP/077-2020, AJDIP/076-2022,\nAJDIP/247-2022, AJDIP/030-2023 and AJDIP/031-2023, respectively, the\n\"Regulation for the Monitoring, Control and Surveillance of Fishing\nVessels of the National and Foreign Fleets\" was established, which entails the\nobligation for vessels of the national and foreign fishing fleet to have duly installed and in use a radio beacon system\nlinked to the INCOPESCA Control, Monitoring and Surveillance Center.\n\n2°-That in\nthose regulatory provisions, not only was said obligation contemplated;\nbut they also comprise differentiated effective dates for\nthe various fishing fleets; among which are vessels\nbelonging to the medium-scale sport and tourist fishing fleet,\nthe last of which has been incorporated and for which its effective date was initially\nset as of January 1, 2024.\n\n3°-That with\nthe aim of advancing in the implementation process of the aforementioned, from the\nExecutive Presidency direct contact was established with representatives of\nsport and tourist fishing, in which Agreement AJDIP/076 2022 was presented,\nso that it could be complemented with a broader wording for that\nfishing sector.\n\n4°-That based\non said process, the creation of a Working Committee of\nrepresentatives of sport and tourist fishing was established for the purpose of conducting\nthe assessments and recommendations of an alternative text of\nregulation exclusively for sport and tourist fishing.\n\n5°-That on\nthe part of Mr. Guillermo Ramírez Gätgens, Head of the\nInstitutional Legal Advisory Office, and Miguel Durán Delgado, Director of\nFisheries and Aquaculture Management, an opinion is issued by means of which it is\nrecommended to request the referred Committee to present the input no\nlater than the month of March 2024, in order to carry out the respective\nsocialization process.\n\n6°-That\nlikewise, on the part of Messrs. Ramírez Gätgens and\nDurán Delgado, a recommendation is presented in order to extend the\neffective date of Agreement AJDIP/076-2022 to July 1 of the year 2024.\n\n7°-That,\nhaving duly analyzed the proposed modification and considering it appropriate,\nthe Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore;\n\nAGREES:\n\n1°-To approve\nthe requested extension recommended and modify Board of Directors agreement\nAJDIP/076-2022, in its Transitory Provision II, so that henceforth it shall read in the\nfollowing manner:\n\nTransitory Provision\nII: \"For medium-scale Sport and Tourist Fishing vessels, this regulation shall be applicable as of July 1 of the year\n2024\".\n\n2°-To render\nvoid Board of Directors Agreement AJDIP/116-2023.\n\n3°-To request\nthe Working Committee established for the follow-up of the matter, the\npresentation of the alternative text of regulation exclusively for sport\nand tourist fishing no later than the month of March of the year 2024.\n\n4°-Final\nAgreement.
