  "body_es_text": "Recuerde que Control F es una opción que le permite buscar en la totalidad del texto\n\n\nIr al final del documento\n\n- Usted está en la última versión de la norma -\n\nReglamento de la audiencia pública del plan regulador del Cantón de Pérez Zeledón\n\n\n\n\n\n\nMUNICIPALIDAD DE PÉREZ ZELEDÓN\n\n\n\n\n\nCONCEJO MUNICIPAL\n\n\n\n\n\nLa Municipalidad de Pérez Zeledón comunica que, mediante acuerdo tomado por el Concejo Municipal, en\nSesión Ordinaria N° 209-2024, Acuerdo número 03), celebrada el 02 de enero del 2024, se aprobó el\nsiguiente Reglamento: RAM-0005-2023 Reglamento de la Audiencia Pública del Plan Regulador del Cantón\nde Pérez Zeledón\n\n\n\n\n\nConsiderando:\n\n\n\n\n\nI.-Que la Municipalidad de Pérez Zeledón, en aplicación del precepto del artículo 169\nConstitucional, es la encargada de administrar los intereses y servicios locales.\n\n\n\n\n\nII.-Que el Código Municipal establece en el artículo 5 que las municipalidades fomentarán la\nparticipación activa, consciente y democrática del pueblo en las decisiones del gobierno local.\n\n\n\n\n\nIII.-Que el inciso 1 del artículo 17 de la Ley de Planificación Urbana dispone que previo a\nimplantar un plan regulador o alguna de sus partes, la municipalidad debe convocar a una audiencia\npública para dar a conocer el proyecto y recibir observaciones verbales o escritas que tengan a bien\nformular las personas interesadas.\n\n\n\n\n\nIV.-Que la Municipalidad de Pérez Zeledón, debe considerar la mejor forma de propiciar la\nparticipación de la ciudadanía para la toma de decisiones en beneficio del Cantón.\n\n\n\n\n\nCAPÍTULO I\n\n\n\n\n\nLineamientos generales\n\n\n\n\n\nArtículo 1°-Objetivo. El objeto del presente reglamento es establecer el procedimiento para la\nrealización de la audiencia pública del Plan de Ordenamiento Territorial para el Cantón de Pérez\nZeledón. Las reglas establecidas en esta norma podrán ser utilizadas por la Municipalidad, previo\nacuerdo del Concejo Municipal, para cualquier otra audiencia o mecanismo de participación ciudadana.\n\n\n\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 2°-Principios. La audiencia pública se rige por el principio de publicidad y de\nparticipación ciudadana, procurando que los munícipes puedan conocer del proyecto de instrumento de\nordenamiento territorial que regirá en el cantón que habitan, y realizar las observaciones escritas\nu orales que consideren pertinentes.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 3°-Sesión extraordinaria. La audiencia se llevará a cabo durante una sesión extraordinaria\ndel Concejo Municipal con las formalidades que para ello dispone el artículo 47 del Código\nMunicipal. En el acta quedará constancia de las preguntas y observaciones planteadas por el público,\nasí como el nombre completo y número de cédula de quien lo expresó.\n\n\n\n\n\nEl video de la sesión será conservado en la Secretaria del Concejo Municipal.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 4°-Convocatoria. El Concejo Municipal convocará a la audiencia pública, conforme lo dispone\nel artículo 17 de la Ley de Planificación Urbana, la convocatoria debe ser publicada en el Diario\nOficial La Gaceta y otros medios de divulgación; así como también en la página web y en el Facebook\noficial de la Municipalidad de Pérez Zeledón, con la indicación de lugar, fecha, hora, las etapas\nque la conforman y su duración, establecer que el tiempo máximo de intervención de las personas\nparticipantes será acordado por la Presidencia Municipal de acuerdo a la cantidad de participantes,\nasí como cualquier otro aspecto referente a la participación en la audiencia. Que la convocatoria\ndebe publicarse con antelación no menor de quince días hábiles.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 5°-Disponibilidad de la documentación. Los documentos que componen la propuesta del Plan\nRegulador estarán disponibles para el público en el sitio web de la Municipalidad al menos con un\nplazo de 15 días hábiles de previo a la realización de la audiencia pública. La Municipalidad dará\ndifusión de este hecho junto con la convocatoria a la audiencia.\n\n\n\n\nFicha articulo\n\n\n\n\n\n\n\n\n\nCAPÍTULO II\n\n\n\n\n\nDel Procedimiento\n\n\n\n\n\nArtículo 6°.-Inscripción. Para efectos de participar en la audiencia pública, las personas deberán\nenviar un correo a la dirección que oportunamente se habilitará y publicará en medios oficiales de\nla Municipalidad de Pérez Zeledón, indicando su nombre, número de identificación e información de\ncontacto. En caso de imposibilidad de acceso a medios tecnológicos, las personas podrán remitir\ncarta a la Dependencia de Planificación Territorial de la Municipalidad con los mismos datos\nindicados en el párrafo anterior, señalando medio para recibir notificaciones. En caso de no\nrealizar la inscripción previa, la misma podrá realizarse el día de la audiencia llenando el\nformulario de inscripción que se le será suministrado a la entrada del local.\n\n\n\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 7°.-Acceso al evento. El ingreso al local será permitido con una hora de anterioridad. La\npersona deberá mostrar su identificación para comprobar que está inscrita. Asimismo, la sesión de\naudiencia pública será transmitida en vivo por el canal oficial en Youtube de la Municipalidad de\nPérez Zeledón.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 8°.-Hora de inicio. Conforme lo establece el artículo 38 del Código Municipal; la sesión\niniciará dentro de los 15 minutos siguientes de la hora señalada.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 9°.-Comunicación de reglas. La Presidencia del Concejo expondrá las reglas de cómo se\nllevará a cabo la actividad, indicando las etapas que la componen y el momento en el cual se abrirá\nel periodo de preguntas.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 10.-Exposición del proyecto. El Equipo Planificador expondrá el proyecto del Plan de\nOrdenamiento Territorial, compartiendo la pantalla de su computadora, la cual será proyectada para\nque los asistentes puedan observarla así como en las redes sociales, en el video se mostrará la\npantalla compartida.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 11.-Periodo de preguntas. AI finalizar la exposición del Equipo Planificador, se abrirá el\nperiodo de preguntas, respetando el orden y los lineamientos en cuanto al uso de la palabra,\ndeterminado por la Presidencia del Concejo Municipal. Previo a formular la pregunta, cada persona\ndebe indicar el nombre completo y número de cédula de identidad, el DIMEX o pasaporte,\ngarantizándose de esta forma la participación ciudadana.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 12.-Intervención de los integrantes del Concejo Municipal. Los miembros del Concejo\nMunicipal podrán formular preguntas u observaciones concretas sobre el proyecto, una sola vez, en un\ntiempo máximo de 5 minutos.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 13.-Periodo de respuestas. El equipo Equipo Planificador responderá, las preguntas que se\nrequieran para facilitar la comprensión del proyecto. Pero aquellas preguntas de contenido técnico\nserán contestadas en el informe final de la audiencia.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 14.-Facultades de orden. The purpose of this regulation is to establish the procedure for\nholding the public hearing (audiencia pública) for the Land-Use Plan (Plan de Ordenamiento Territorial) for the Canton of Pérez\nZeledón. The rules established in this regulation may be used by the Municipality, with prior\nagreement of the Municipal Council, for any other hearing or citizen participation mechanism.\n\n\n\n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 2—Principles. The public hearing (audiencia pública) is governed by the principles of publicity and\ncitizen participation, ensuring that residents can learn about the proposed land-use planning (ordenamiento territorial) instrument\nthat will govern the canton where they live, and make written\nor oral observations they deem pertinent.\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 3—Extraordinary session. The hearing shall be held during an extraordinary session\nof the Municipal Council with the formalities established for such purpose in Article 47 of the Municipal Code\n(Código Municipal). The minutes shall record the questions and observations raised by the public,\nas well as the full name and identification number of the person who expressed them.\n\n\n\n\n\nThe video of the session shall be kept in the Secretariat of the Municipal Council.\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 4—Call to hearing. The Municipal Council shall call the public hearing (audiencia pública), as provided\nin Article 17 of the Urban Planning Law (Ley de Planificación Urbana). The call to hearing must be published in the\nOfficial Gazette La Gaceta and other dissemination media; as well as on the website and the official\nFacebook page of the Municipality of Pérez Zeledón, with an indication of the place, date, time, the stages\nthat comprise it and their duration, and shall establish that the maximum speaking time for\nparticipants shall be agreed upon by the Municipal Presidency according to the number of participants,\nas well as any other aspect regarding participation in the hearing. The call to hearing\nmust be published at least fifteen business days in advance.\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 5—Availability of documentation. The documents that comprise the proposed Regulatory Plan\n(Plan Regulador) shall be available to the public on the Municipality's website at least\n15 business days prior to the holding of the public hearing (audiencia pública). The Municipality shall\npublicize this fact along with the call to hearing.\n\n\n\n\nArticle file\n\n\n\n\n\n\n\n\n\nCHAPTER II\n\n\n\n\n\nOn Procedure\n\n\n\n\n\nArticle 6.—Registration. For purposes of participating in the public hearing (audiencia pública), persons must\nsend an email to the address that will be opportunely enabled and published on official media of\nthe Municipality of Pérez Zeledón, indicating their name, identification number, and contact\ninformation. If access to technological means is impossible, persons may send\na letter to the Territorial Planning Department of the Municipality with the same data\nindicated in the preceding paragraph, specifying a means for receiving notifications. If\nprior registration is not completed, it may be done on the day of the hearing by filling out the\nregistration form that will be provided at the entrance to the venue.\n\n\n\n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 7.—Access to the event. Entry to the venue shall be permitted one hour in advance. The\nperson must show identification to verify that they are registered. Likewise, the public hearing session\n(audiencia pública) shall be streamed live on the official YouTube channel of the Municipality of\nPérez Zeledón.\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 8.—Start time. As established in Article 38 of the Municipal Code (Código Municipal), the session\nshall begin within 15 minutes after the scheduled time.\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 9.—Communication of rules. The Presidency of the Council shall state the rules for how\nthe activity will be conducted, indicating the stages that comprise it and the moment when\nthe question period will open.\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 10.—Project presentation. The Planning Team shall present the Land-Use Plan\n(Plan de Ordenamiento Territorial) project, sharing their computer screen, which shall be projected so\nthat attendees can view it, as well as on social media; the video shall show the\nshared screen.\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 11.—Question period. Upon conclusion of the presentation by the Planning Team, the\nquestion period shall open, respecting the order and guidelines regarding speaking,\nas determined by the Presidency of the Municipal Council. Before asking a question, each person\nmust state their full name and identity card number, DIMEX, or passport, thereby guaranteeing citizen participation.\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 12.—Participation by members of the Municipal Council. The members of the Municipal Council\nmay pose specific questions or make observations about the project, only once, with a\nmaximum speaking time of 5 minutes.\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 13.—Response period. The Planning Team shall answer questions\nneeded to facilitate understanding of the project.
