  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 052\n\n                        Decreta veda de pesca de sardina Ophistonema sp con cualquier tipo de red\n\nINSTITUTO\nCOSTARRICENSE DE PESCA  Y ACUICULTURA\n\nAJDIP/052-2024.-Puntarenas,\na los veintisiete días del mes febrero de dos mil veinticuatro.\n\nConsiderando\n\n1º-Que\nmediante Acuerdo de Junta Directiva AJDIP/049-2020, se estableció una veda para\nla pesca semi-industrial sardinera bolichera de Ophistonema sp (cerco), en el\nárea comprendida por una línea imaginaria que va desde Punta Agujas (84°38´57´´\nLongitud Oeste, 09°43´46´´ Latitud Norte) al Faro de la Isla Negritos afuera\n(84°49´35´´ Longitud Oeste, 09°49´14´´ Latitud Norte) y desde ahí hasta la\nparte Este de Punta Cuchillo en la Península de Nicoya (09°50´03\"Latitud Norte,\n084°53´42\" Longitud Oeste) y de estas líneas aguas adentro hasta la\ndesembocadura del río Tempisque; a partir del 01 de marzo hasta el 31 de mayo\nde 2024.\n\n2º-Que\nel Acuerdo de Junta Directiva AJDIP/049-2020, estableció que la captura\nincidental en la pesca de sardina no puede ser superior al 10% de la captura\ntotal de la embarcación.\n\n3º-Que\nla Dirección de Ordenamiento Pesquero y Acuícola, adicionalmente establecerá\nlas medidas correspondientes para efectos de que todas las descargas que se\nrealicen como parte de este acuerdo sean debidamente inspeccionadas por el\nDepartamento de Fiscalización. A su vez el Departamento de Investigación\nrealizará muestreos biológicos de dichas capturas para evaluar el\ncomportamiento reproductivo de las sardinas.\n\n4º-Que la Dirección de Ordenamiento Pesquero y\nAcuícola sostuvo reuniones con los representantes del sector de pesca\nsemi-industrial de sardina bolichera (cerco), en la cual solicitaron se\nreestablezcan las medidas originales que datan del año 2018, permitiendo el\ningreso a faenar un día a la semana al área vedada definida como Tárcoles, a\nefectos que puedan suplir sardina para carnada a la flota pesquera nacional.\n\n5º-Que con la puesta en marcha de esta veda, tal cual\nse ha concebido, se atiende la imperiosa necesidad de proteger el recurso\nsardina en su etapa de reproducción en procura de la sostenibilidad de este\nrecurso pesquero y a la vez solventar los requerimientos de carnada de la flota\npesquera nacional, razón por la cual, la Junta Directiva del Instituto\nCostarricense de Pesca y Acuicultura; POR TANTO.\n\nACUERDA\n\n1º-Decretar la veda de pesca de sardina Ophistonema sp\ncon cualquier tipo de red de pesca a partir del 01 de marzo hasta el 31 de mayo\ndel 2024, en las siguientes zonas del litoral pacífico costarricense. Para\ndichos efectos, el área total definida en el considerando 1, se divide en dos\nzonas: Zona C del Golfo de Nicoya, que para efectos de este acuerdo es aquella\nque está comprendida por una línea imaginaria que inicia en la zona conocida\ncomo el Peñón o Punta Torres (9°53'31\" Latitud Norte y 84°43'52\" Longitud\nOeste) y se extiende hasta el faro de la Punta de Isla Negritos afuera\n(84°49´35´´ Longitud Oeste, 09°49´14´´ Latitud Norte); de ahí otra línea\nimaginaria hasta Punta Cuchillo en la Península de Nicoya (09°50´03\" Latitud\nNorte, 084°53´42\" Longitud Oeste) y desde este punto otra línea imaginaria\nhasta el Faro de Puntarenas (9° 58´ 36.03´´ Latitud Norte 84° 51´\n03.93´´Longitud Oeste). Zona Tárcoles, que para efectos de este acuerdo es\naquella que está comprendida por una línea imaginaria que se extiende desde\nPunta Agujas (84°38´57´´Longitud Oeste, 09°43´46´´ Latitud Norte) hasta el faro\nen la Punta de Isla Negritos afuera (84°49´35´´ Longitud Oeste, 09°49´14´´\nLatitud Norte) y desde este último punto, otra línea imaginaria hasta el Peñón\no Punta Torres (9°53'31\" Latitud Norte y 84°43'52\" Longitud Oeste).\n\n2º-Durante esta veda, en la zona denominada Tárcoles,\nse autoriza el ingreso de una de las tres embarcaciones semi-industrial\nsardineras para faenar un día a la semana, a efectos de que puedan suplir\nsardina para carnada a la flota pesquera nacional. Los excedentes podrán ser\ncomercializados para otros fines según lo establecido en el acuerdo de Junta\nDirectiva AJDIP/100-2021. Este acceso será utilizado en franjas diurnas de 12\nhoras cada una de forma semanal alterna por cada embarcación de modo que no podrán\nestar dentro de dicha zona más de una embarcación en la misma semana y de\nprevio a su ingreso, deberán sus propietarios, armadores o Capitán; coordinar\nla semana en que ingresará cada embarcación y deberán notificar al Departamento\nde Registro y al Departamento de Fiscalización del Incopesca el cronograma con\nla fecha y hora de ingreso de cada embarcación a la zona Tárcoles establecida\nen esta veda.\n\n3º-Que todas las descargas que se realicen por parte\nde la flota semi-industrial bolichera de sardina serán debidamente\ninspeccionadas por parte de los inspectores de la Institución. Dicha inspección\ndebe cubrir no solo las descargas de sardina, sino también la de fauna de\nacompañamiento. A su vez el Departamento de Investigación Pesquera realizará\nmuestreos biológicos de dichas capturas para evaluar el comportamiento\nreproductivo de las sardinas y el cumplimiento de la talla legal de primera\ncaptura.\n\n4º-Para los desembarques la franja horaria establecida\nserá la siguiente: A partir de las 06.00 horas hasta las 20.00 horas.   "body_en_text": "throughout the entire text\n\n-\n\nComplete Text of Norm 052\n\nDeclares a closed season for sardine *Ophistonema sp* fishing with any type of net\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/052-2024.-Puntarenas,\non the twenty-seventh day of February, two thousand twenty-four.\n\nConsidering\n\n1º-That\nthrough Board of Directors Agreement AJDIP/049-2020, a closed season was established for\nthe semi-industrial sardine purse-seine (bolichera) fishery for *Ophistonema sp* (purse seine, cerco), in the\narea comprised by an imaginary line running from Punta Agujas (84°38´57´´\nWest Longitude, 09°43´46´´ North Latitude) to the Lighthouse of Isla Negritos offshore\n(84°49´35´´ West Longitude, 09°49´14´´ North Latitude) and from there to the\neastern part of Punta Cuchillo on the Nicoya Peninsula (09°50´03\" North Latitude,\n084°53´42\" West Longitude) and from these lines seaward to the\nmouth of the Tempisque River; from March 1 through May 31, 2024.\n\n2º-That\nBoard of Directors Agreement AJDIP/049-2020 established that bycatch (captura incidental) in the sardine fishery may not exceed 10% of the vessel's total catch.\n\n3º-That\nthe Directorate of Fisheries and Aquaculture Management (Dirección de Ordenamiento Pesquero y Acuícola), will additionally establish\nthe corresponding measures so that all landings made\nas part of this agreement are duly inspected by the Enforcement Department (Departamento de Fiscalización). In turn, the Research Department (Departamento de Investigación)\nwill conduct biological sampling of said catches to evaluate the\nreproductive behavior of the sardines.\n\n4º-That the Directorate of Fisheries and Aquaculture Management\nheld meetings with representatives of the semi-industrial sardine purse-seine (bolichera) fishery sector, in which they requested that\nthe original measures dating from 2018 be reestablished, allowing\nentry to fish one day a week into the closed area defined as Tárcoles, so\nthat they can supply sardine for bait to the national fishing fleet.\n\n5º-That with the implementation of this closed season, exactly\nas it has been conceived, the urgent need to protect the sardine\nresource during its reproductive stage is addressed in pursuit of the sustainability of this\nfishery resource while simultaneously resolving the bait requirements of the national fishing\nfleet, which is why the Board of Directors of the Costa Rican Institute of\nFisheries and Aquaculture; NOW THEREFORE.\n\nRESOLVES\n\n1º-To declare a closed season for sardine *Ophistonema sp* fishing\nwith any type of fishing net from March 1 through May 31,\n2024, in the following zones of the Costa Rican Pacific coast. For\nthese purposes, the total area defined in considering clause 1 is divided into two\nzones: Zone C of the Gulf of Nicoya, which for the purposes of this agreement is that\nwhich is comprised by an imaginary line that starts at the area known as\nPeñón or Punta Torres (9°53'31\" North Latitude and 84°43'52\" West Longitude)\nand extends to the lighthouse at Punta Isla Negritos offshore\n(84°49´35´´ West Longitude, 09°49´14´´ North Latitude); from there another imaginary\nline to Punta Cuchillo on the Nicoya Peninsula (09°50´03\" North\nLatitude, 084°53´42\" West Longitude) and from this point another imaginary line\nto the Puntarenas Lighthouse (9° 58´ 36.03´´ North Latitude 84° 51´\n03.93´´ West Longitude). Tárcoles Zone, which for the purposes of this agreement is\nthat which is comprised by an imaginary line extending from\nPunta Agujas (84°38´57´´ West Longitude, 09°43´46´´ North Latitude) to the lighthouse\non Punta Isla Negritos offshore (84°49´35´´ West Longitude, 09°49´14´´\nNorth Latitude) and from this last point, another imaginary line to Peñón\nor Punta Torres (9°53'31\" North Latitude and 84°43'52\" West Longitude).\n\n2º-During this closed season, in the zone called Tárcoles,\nthe entry of one of the three semi-industrial sardine\nvessels is authorized to fish one day a week, so that they can supply\nsardine for bait to the national fishing fleet. Surpluses may be\ncommercialized for other purposes as established in Board of Directors\nAgreement AJDIP/100-2021. This access will be utilized in 12-hour\ndaytime blocks each, on an alternating weekly basis by each vessel, such that no more\nthan one vessel may be within said zone in the same week, and\nprior to their entry, their owners, shipowners (armadores), or Captain must; coordinate\nthe week in which each vessel will enter and must notify the\nRegistration Department (Departamento de Registro) and the Enforcement Department (Departamento de Fiscalización) of Incopesca of the schedule with\nthe date and time of entry of each vessel into the Tárcoles zone established\nin this closed season.\n\n3º-That all landings made by\nthe semi-industrial sardine purse-seine (bolichera) fleet will be duly\ninspected by the inspectors of the Institution. Said inspection\nmust cover not only the sardine landings, but also that of the bycatch (fauna de acompañamiento).\nIn turn, the Fisheries Research Department (Departamento de Investigación Pesquera) will conduct\nbiological sampling of said catches to evaluate the reproductive\nbehavior of the sardines and compliance with the legal minimum size at first capture (talla legal de primera captura).\n\n4º-For the landings, the established time slot\nwill be as follows: From 06.00 hours to 20.00 hours. Those\nlandings made under the protection of this agreement without institutional\npresence due to situations attributable to the shipowner (armador) will result in the loss of the\nbenefit of fishing in the closed Tárcoles zone under the terms of\nthis agreement.\n\n5º-That Board of Directors Agreement AJDIP/049-2020\nestablished that bycatch (captura incidental) in the sardine fishery may not be\ngreater than 10% of the vessel's total catch.\n\n6º-As long as new research is not available,\nthe sardine closed season is maintained under the conditions established in Agreement AJDIP/049-2020.\n\n7º-The National Coast Guard Service (Servicio Nacional de Guardacostas) in\ncoordination with the Enforcement Department (Departamento de Fiscalización) of INCOPESCA, will carry out the\npertinent actions under the protection of what is established in this agreement, in\norder to control and monitor illegal fishing activities in the closed\nzone, especially the Tárcoles zone.\n\nline-height:107%'>8º-The map attached below is to be considered\nan integral part of this Agreement:\n\n9º-Final Agreement (Acuerdo Firme).
