DE OBRAS\nPÚBLICAS Y TRANSPORTES\n\nEL MINISTRO DE GOBERNACIÓN,\nPOLICÍA Y SEGURIDAD PÚBLICA\n\nLA MINISTRA DE EDUCACIÓN PÚBLICA\n\nCon fundamento\nen las atribuciones que les confieren los artículos 9, 11, 130, 140 incisos 6,\n8 y 20, 146, 176, 180, 188, 189, de la Constitución Política; los artículos 1,\n4, 11, 21, 25, 26, 27, 98, 100, 107, 113 incisos 2 y 3 de la Ley Nº 6227, Ley\nGeneral de la Administración Pública de 2 de mayo de 1978 y sus reformas, norma\nque regula la facultad de organizar la Administración Pública, según los\nprocesos de planificación que se determinen. Además, en los artículos 4, y 27\ninciso 1) de la propia ley Nº 6227, se regulan las facultades de coordinación y\ndirección del Poder Ejecutivo establecidas en la Carta Magna y que están\ncontenidos en la función de Rectoría, de forma que sean el medio por el cual se\ndé una coordinación y dirección política para orientar la planificación de las\nacciones institucionales que garanticen una unidad de actuación del Estado. Con\neste propósito, el Poder Ejecutivo a través de este instrumento que le permite\ncoordinar y dirigir una actividad económica o a un grupo de instituciones, en\nrazón de las metas o acciones programadas en los instrumentos de planificación\nformalmente establecidos a ejecutar con la mayor eficiencia y eficacia.\n\nCONSIDERANDO:\n\n1 º- El puente\nsobre el río Tempisque denominado \"La Amistad de Taiwán\", en la ruta\nnacional número dieciocho, fue puesto en operación en abril del dos mil tres.\n\n2º- Luego de\ntres años de construcción, y, desde ese momento hasta la fecha, por la\nconstante actividad sísmica en la zona, alrededor de veintiséis eventos\nsísmicos con magnitudes mayores a cuatro punto cinco en un radio de treinta\nkilómetros a su alrededor, incluyendo el Terremoto de Nicoya, con una magnitud\nde siete punto seis, a veintisiete punto seis kilómetros del puente, es que\npuede considerarse su sometimiento al sismo de diseño y cuatro réplicas también\nde considerable magnitud, lo que ha provocado un leve desplazamiento del\npuente, específicamente en la pila número ocho, en el apoyo y la junta de\nexpansión.\n\n3º- Que los\neventos antes expuestos han producido limitaciones de movimiento y un deterioro\nprogresivo de la pila número ocho, en el apoyo y la junta de expansión.\n\n4º- Que la\njunta de expansión además, sufrió un accidente adicional que le ocasionó un\ndaño mayor, cuando un vehículo desconocido, que aparentemente circulaba con una\ncadena con gancho colgante, enganchó uno de los rieles de la junta,\nretorciéndola hacia arriba, lo que obligó a la realización inmediata de una\nreparación temporal, solucionando el problema en cuanto al riesgo para el\ntránsito de vehículos, pero limitando aún más el movimiento a la junta de\nexpansión y provocando que la misma no tenga condiciones óptimas de\nfuncionamiento, por lo que su función de unir dos partes del puente para el\ntránsito de vehículos, y a la vez permitiendo los movimientos a los que el\nmismo se vea  sometido, ya sea por\ncambios de temperatura, vientos, sismos u otras causas se vea limitado,\nrepresentando un gran riesgo para seguridad de la estructura, de los usuarios\nque transitan diariamente por el mismo, por lo que es urgente una intervención\npara devolver la movilidad y óptimo funcionamiento a los elementos de ese punto\ncrítico y de otros elementos importantes del puente.\n\n5º- Que,\naunado a todo ello, la junta de expansión, en el mismo punto de pila ocho, el\npuente presenta un daño en el apoyo, el cual, también contribuye· a la\nlimitación de movilidad e influye en la forma en que los movimientos y\nesfuerzos de puente son transferidos a la sub estructura, lo cual es de urgente\nsolución, e imprescindible si se va a cambiar la junta, ya que puede haber\ncambios de nivel, por lo que debe ser remplazado el apoyo, previo a la\ncolocación de la nueva junta.\n\n6º- También se\ntienen identificados, producto de una inspección visual·, problemas en varios\nelementos como lo son:\n\n6.1. Seguridad\nvial: Faltante de elementos de seguridad vial.\n\n6.2.\nSuperficie de rodamiento, accesorios, accesos y otros: baches, sedimentos,\ndrenajes obstruidos, juntas de expansión sin mantenimiento o daños.\n\n6.3.\nSuperestructura tipo atirantada: mantenimiento necesario a los cables,\ndeterioro en los sistemas de protección, pintura deteriorada.\n\n6.4.\nSuperestructura viga continúa tipo cajón: deterioro en los sistemas de\nprotección, pintura deteriorada.\n\n6.5.\nSubestructura: visualmente apoyo en la pila número ocho dañada, acumulación de\nsedimentos en los bastiones, insuficiente recubrimiento y corrosión al acero en\nalgunos puntos.\n\n7º- Que todo\nlo antes expuesto guarda relación con los antecedentes que:\n\n7.1. Mediante\noficio DCA-3742 de fecha 08 de octubre de 2020, la Contraloría General\nde la República otorga autorización al Consejo Nacional de Vialidad para\nrealizar una contratación directa concursada para atención del puente sobre el\nrío Tempisque \"La Amistad de Taiwán\", en la ruta nacional número\ndieciocho.\n\n7.2. Mediante\noficio GCTT 28-2023-0206 de fecha 29 de agosto de 2023, la Gerencia de\nContratación de Vías y Puentes, en vista de lo informado por el Contratista\nposterior a la elaboración de la investigación correspondiente a la estructura\ndel puente, de la cual se concluye que es necesario realizar obras adicionales\nimprescindibles para garantizar la seguridad y durabilidad del puente.\n\n7.3. Mediante\noficio ACA-01-2023-0527 (582) de fecha 03 de octubre de 2023, el Consejo\nde Administración autoriza a la Administración a realizar la ampliación al\ncontrato con el fin de que el contratista concrete la importación de los\nmateriales necesarios para la atención del proyecto.\n\n7.4 Mediante\noficio DIE-01-2023-1094 (0102) de fecha 09 de octubre de 2023, la Dirección Ejecutiva\nremite al contratista el oficio ACA-01-2023-0527 ( 582) indicando proceder con\nla compra de los repuestos requeridos para los trabajos de intervención en el\npuente.\n\n7.5. Que el 15\nde diciembre de 2023 el contratista presenta el Informe número tres de la\ncontratación, en el cual contiene los resultados de la investigación de campo,\nresultados estructurales, y la justificación de las acciones que se realzarían\ny las soluciones correspondientes.\n\n7.6. Mediante\noficio DVP-38-2024-0018 de fecha 15 de enero de 2024, la Dirección de\nDiseño de Vías y Puentes remite la revisión del informe número tres.\n\n7.7. Mediante\noficio DCVP 37-2024-0011 de fecha 16 de enero de 2024, la Dirección de\nCostos de Vías y Puentes realiza la revisión de las memorias de cálculo de los\nprecios unitarios, los cuales se utilizarían en la presente orden de\nmodificación.\n\n7.8. Mediante\ncorreo electrónico de fecha 23 de enero de 2024, el contratista remitió la\ndocumentación correspondí.ente\na lo indicado en el oficio DCVP 37- 2024-0011.\n\n8 º- Que la\nejecución del proceso de contratación indicado, y por ende la intervención y\nreparación del Puente sobre el río Tempisque denominado \"La Amistad de\nTaiwán\", se empezará a ejecutar a lo que implica el cierre del paso por el\npuente por un período que va del primero de abril de dos mil veinticuatro y\nhasta el primero de agosto de dos mil veinticuatro, con posibilidad de que\npuedan existir prórrogas este plazo.\n\n9º- Que el\ncierre del paso por el Puente sobre el río Tempisque denominado \"La\nAmistad de Taiwán\", implica un impacto para el traslado de las personas de\nla zona del Pacífico Central a la Península de Nicoya con una especial\nafectación a los estudiantes de la zona, trabajadores y funcionarios públicos.\n\nEn el fiel\ncumplimiento y satisfacción del Interés Público y bajo los principios\nconstitucionales de discrecionalidad, razonabilidad, proporcionalidad,\nracionabilidad y necesidad, cada Jerarca deberá velar por la coordinación y el\ncumplimiento de las medidas de contención del gasto para colaborar con el logro\nde los objetivos contenidos en esta directriz. Por tanto,\n\nEmiten la\nsiguiente Directriz\n\nDIRIGIDA A LAS INSTITUCIONES\nDEL SECTOR PUBLICO:\n\nArtículo 1 º- El Ministerio de Obras\nPúblicas y Transportes, a través de la Dirección de Obras Públicas, se hará\ncargo de acondicionar para el uso de personas usuarias, los embarcaderos a\nambas márgenes del Río Tempisque en las cercanías del puente La Amistad.\n\nArtículo 2º- El Ministerio de Obras Públicas y Transportes, a\ntravés de la División Marítimo Portuaria, gestionará la adquisición de cuarenta\nchalecos salvavidas para adultos y diez chalecos salvavidas para niños, para el\nuso en las embarcaciones de las personas usuarias que utilicen el servicio de los embarcaderos a\nambas márgenes del Río Tempisque en las cercanías del puente La Amistad. Así\ncomo proveerá el combustible para las embarcaciones que brindarán el servicio\nde cabotaje a ambas márgenes del Río Tempisque en las cercanías del puente La\nAmistad que pondrá en disposición el Instituto Nacional de Aprendizaje.\n\nArtículo 3º-\nEl Ministerio de Obras\nPúblicas y Transportes, a través de la Dirección General de Policía de\nTránsito, dispondrá de ciento veinte Oficiales de Tránsito, distribuido en tres\nturnos, los cuales serán ubicados en carretera, desde la ruta nacional número\n1, iniciando en la Provincia de Puntarenas, Barranca, hasta la. Provincia de\nGuanacaste, Liberia, ruta nacional número 18 en la Provincia de Guanacaste\ndesde Limonal y hasta el entronque de Pueblo Viejo de Nicoya, toda la ruta\nnacional número 21, y demás carreteras principales de la península de Nicoya,\nesto con la finalidad de mejorar el tránsito de vehículos y de personas.\n\nArtículo 4°- El Ministerio de Gobernación, Policía y Seguridad\nPública y el Servicio Nacional de Guardacostas, prestará el servicio de\nseguridad y vigilancia hacia y para las personas usuarias del servicio de\ncabotaje que se habilitará en las márgenes del Río Tempisque en las cercanías\ndel puente La Amistad, así mismo prestará seguridad y vigilancia· en puerto\nNíspero de las embarcaciones y sus implementos, que pondrá en disposición el _Instituto\nNacional de Aprendizaje, para el cabotaje, durante horas de la noche y fines de\nsemana.\n\nArtículo 5º- El Instituto Nacional de Aprendizaje, pondrá a\ndisposición, dos embarcaciones con capacidad máxima de veinte personas y su\nrespectiva tripulación debidamente certificada, con seguros al día y vigentes,\nen un horario de lunes a viernes de 05:00 am a las 05:30 pm. Así mismo proveerá\nde al menos 1 vehículo tipo buseta con su respectivo operador móvil y seguros\nal día, para el transporte de las personas usuarias del servicio de cabotaje\ndesde y hacia los embarcaderos a ambas márgenes del Río Tempisque en las\ncercanías del puente La Amistad.\n\nArtículo 6º- El Ministerio de Educación Pública, ante el cierre\ndel Puente de la Amistad velará por la continuidad del proceso educativo de las\npersonas estudiantes afectadas por este evento, por medio de las Orientaciones\npara el Aprendizaje y Trabajo Autónomo en centros educativos por situaciones de\nriesgo o caso fortuito, como alternativa a la mediación pedagógica presencial.\nAsimismo, facilitará hasta tres vehículos tipo buseta y vehículos oficiales en\ncaso de ser necesario, con sus respectivos operadores con la documentación y\nseguros vigentes y al día para trasladar, personas usuarias, recurso humano\ndocente y administrativo del Ministerio de Educación Pública y del servicio de\ncabotaje, todas debidamente identificadas con su carné institucional, desde y\nhacia los embarcaderos a ambas márgenes del Río Tempisque en las cercanías del\npuente La Amistad a puntos estratégicos cercanos a sus lugares de trabajo. Se\ninstruye a la señora Ministra de Educación para que durante el periodo de\nvigencia de la presente directriz, proceda de manera excepcional, valorar la\nposibilidad de realizar movimientos de personal a los colaboradores afectados,\nsea de manera interina o en propiedad, con sustento en el bloque de legalidad\nque rige la gestión del talento humano dentro del Régimen de Servicio\nCivil.\n\nArtículo 7º- De ser necesario se habilitará el paso de manera\npública de personas y vehículos livianos, carga liviana y de carga no\narticulados a través de caminos que se encuentran en propiedades privadas, con\nla respectiva autorización de sus propietarios.\n\nArtículo\n8º-Se autoriza a todas las\ninstituciones de la Administración Pública, centralizada y descentrc;1lizada, a\nfin de que aporten los recursos logísticos, económicos y recurso humano\nsuficientes para implementar la presente directriz.\n\nArtículo 9º- Debido a la necesidad imperante que afectará a las\npoblaciones cercanas, se les invita a los diferentes sujetos de Derecho\nPrivado, que puedan aportar recursos logísticos que facilite el traslado de las\npersonas y vehículos de transporte público remunerado, que se acerquen al\nMinisterio de Obras Públicas y Transportes para realizar las coordinaciones\npertinentes.\n\nArtículo\n10º-Todo lo anterior desde el primero de abril de dos mil veinticuatro y hasta el\nprimero de agosto de dos mil veinticuatro o hasta que las reparaciones al\npuente la Amistad sobre el río Tempisque hayan finalizado y habilitado el\ntránsito sobre dicha obra.\n\nArtículo 11\nº-Rige a partir de su publicación.\n\nDada en la\nPresidencia de la República, a los veinte días del mes de marzo del dos. mil veinticuatro", "body_en_text": "DIRECTIVE No.\n038-P-MOPT-MSP-MEP\n\nTHE PRESIDENT OF THE REPUBLIC\n\nTHE MINISTER OF PUBLIC WORKS AND TRANSPORT\n\nTHE MINISTER OF GOVERNANCE, POLICE, AND PUBLIC SECURITY\n\nTHE MINISTER OF PUBLIC EDUCATION\n\nBased on the powers conferred upon them by Articles 9, 11, 130, 140 subsections 6, 8 and 20, 146, 176, 180, 188, 189 of the Political Constitution; Articles 1, 4, 11, 21, 25, 26, 27, 98, 100, 107, 113 subsections 2 and 3 of Law No. 6227, the General Public Administration Law of May 2, 1978, and its amendments, which regulates the power to organize the Public Administration according to the planning processes determined. For this purpose, the Executive Branch, through this instrument that allows it to coordinate and direct an economic activity or a group of institutions, based on the goals or actions programmed in formally established planning instruments, aims for execution with the greatest efficiency and effectiveness.\n\nCONSIDERING:\n\n1º- The bridge over the Tempisque River called \"La Amistad de Taiwán,\" on National Route 18, was put into operation in April 2003.\n\n2º- After three years of construction, and from that moment to date, due to constant seismic activity in the area—around twenty-six seismic events with magnitudes greater than 4.5 within a 30-kilometer radius, including the Nicoya Earthquake with a magnitude of 7.6, 27.6 kilometers from the bridge—it can be considered that it has been subjected to the design earthquake and four aftershocks, also of considerable magnitude. This has caused a slight displacement of the bridge, specifically at pier number eight, at the bearing and the expansion joint.\n\n3º- The aforementioned events have caused movement limitations and progressive deterioration at pier number eight, at the bearing and the expansion joint.\n\n4º- The expansion joint also suffered an additional accident causing major damage when an unknown vehicle, apparently traveling with a chain with a dangling hook, snagged one of the joint's rails, twisting it upward. This required an immediate temporary repair, solving the problem regarding the risk to vehicle traffic but further limiting the movement of the expansion joint. As a result, it does not have optimal operating conditions. Its function of joining two parts of the bridge for vehicle traffic while allowing the movements to which the bridge is subjected—whether due to temperature changes, winds, earthquakes, or other causes—is limited, representing a great risk to the safety of the structure and of the users who travel over it daily. Therefore, urgent intervention is needed to restore mobility and optimal functioning to the elements of this critical point and other important bridge elements.\n\n5º- Added to all this, at the same point as pier number eight, the bridge presents damage at the bearing, which also contributes to the mobility limitation and influences how the bridge's movements and stresses are transferred to the substructure. This is of urgent resolution and essential if the joint is to be replaced, as there may be level changes. Therefore, the bearing must be replaced prior to the installation of the new joint.\n\n6º- Also identified through a visual inspection are problems in several elements, such as:\n\n6.1. Road safety: Missing road safety elements.\n\n6.2. Bearing surface, accessories, accesses, and others: potholes, sediments, clogged drains, expansion joints without maintenance or with damage.\n\n6.3. Cable-stayed superstructure: necessary maintenance to the cables, deterioration in the protection systems, deteriorated paint.\n\n6.4. Continuous box-girder superstructure: deterioration in the protection systems, deteriorated paint.\n\n6.5. Substructure: visually, the bearing at pier number eight is damaged, sediment accumulation in the abutments, insufficient cover, and steel corrosion at some points.\n\n7º- All of the foregoing is related to the following background:\n\n7.1. By official letter DCA-3742 dated October 8, 2020, the Comptroller General of the Republic granted authorization to the National Road Council to conduct a competitive direct contracting process for servicing the bridge over the Tempisque River, \"La Amistad de Taiwán,\" on National Route 18.\n\n7.2. By official letter GCTT 28-2023-0206 dated August 29, 2023, the Road and Bridge Contracting Management Office, in view of the information reported by the Contractor following the investigation of the bridge structure—which concluded that additional essential works are necessary to guarantee the bridge's safety and durability.\n\n7.3. By official letter ACA-01-2023-0527 (582) dated October 3, 2023, the Board of Directors authorized the Administration to execute the contract extension for the contractor to finalize the import of the materials necessary for project servicing.\n\n7.4. By official letter DIE-01-2023-1094 (0102) dated October 9, 2023, the Executive Directorate sent official letter ACA-01-2023-0527 (582) to the contractor, instructing them to proceed with the purchase of the spare parts required for the intervention works on the bridge.\n\n7.5. On December 15, 2023, the contractor submitted Report No. 3 of the contracting process, containing the results of the field investigation, structural results, and the justification for the actions to be taken and the corresponding solutions.\n\n7.6. By official letter DVP-38-2024-0018 dated January 15, 2024, the Road and Bridge Design Directorate sent the review of Report No. 3.\n\n7.7. By official letter DCVP 37-2024-0011 dated January 16, 2024, the Road and Bridge Cost Directorate conducted the review of the calculation memos for the unit prices to be used in the present change order.\n\n7.8. By email dated January 23, 2024, the contractor sent the documentation corresponding to what was indicated in official letter DCVP 37-2024-0011.\n\n8º- The execution of the indicated contracting process, and therefore the intervention and repair of the Bridge over the Tempisque River called \"La Amistad de Taiwán,\" will begin to be executed, implying the closure of passage over the bridge for a period from April 1, 2024, until August 1, 2024, with the possibility that this term may be extended.\n\n9º- The closure of passage over the Bridge over the Tempisque River called \"La Amistad de Taiwán\" implies an impact on the movement of people from the Central Pacific zone to the Nicoya Peninsula, with a special effect on students in the area, workers, and public officials.\n\nIn faithful fulfillment and satisfaction of the Public Interest and under the constitutional principles of discretion, reasonableness, proportionality, rationality, and necessity, each Hierarch must ensure coordination and compliance with spending containment measures to help achieve the objectives contained in this directive. Therefore,\n\nThey issue the following Directive\n\nADDRESSED TO PUBLIC SECTOR INSTITUTIONS:\n\nArticle 1º- The Ministry of Public Works and Transport, through the Public Works Directorate, will be responsible for conditioning, for the use of users, the embarkation points on both banks of the Tempisque River near the La Amistad Bridge.\n\nArticle 2º- The Ministry of Public Works and Transport, through the Maritime Port Division, will manage the acquisition of forty adult life jackets and ten children's life jackets for use on the vessels by users utilizing the service of the embarkation points on both banks of the Tempisque River near the La Amistad Bridge. It will also provide the fuel for the vessels that will provide the cabotage service on both banks of the Tempisque River near the La Amistad Bridge, which will be made available by the National Learning Institute.\n\nArticle 3º- The Ministry of Public Works and Transport, through the General Directorate of Traffic Police, will deploy one hundred and twenty Traffic Officers, distributed across three shifts, who will be stationed on the highway, from National Route No. 1, starting in the Province of Puntarenas, Barranca, to the Province of Guanacaste, Liberia; National Route No. 18 in the Province of Guanacaste from Limonal to the Pueblo Viejo de Nicoya junction; all of National Route No. 21; and other main roads of the Nicoya Peninsula, for the purpose of improving the flow of vehicles and people.\n\nArticle 4°- The Ministry of Governance, Police, and Public Security and the National Coast Guard Service will provide security and surveillance service for the users of the cabotage service that will be enabled on the banks of the Tempisque River near the La Amistad Bridge. It will also provide security and surveillance at Puerto Níspero for the vessels and their implements, which will be made available by the National Learning Institute for the cabotage service, during nighttime hours and weekends.\n\nArticle 5º- The National Learning Institute will make available two vessels with a maximum capacity of twenty people and their respective duly certified crew, with current and valid insurance, on a schedule of Monday to Friday from 5:00 a.m. to 5:30 p.m. It will also provide at least 1 bus-type vehicle with its respective mobile operator and current insurance, for the transportation of users of the cabotage service to and from the embarkation points on both banks of the Tempisque River near the La Amistad Bridge.\n\nArticle 6º- The Ministry of Public Education, given the closure of the La Amistad Bridge, will ensure the continuity of the educational process for students affected by this event, through the Guidance for Autonomous Learning and Work in educational centers due to risk situations or force majeure, as an alternative to in-person pedagogical mediation. It will also facilitate up to three bus-type vehicles and official vehicles, if necessary, with their respective operators with current and valid documentation and insurance, to transport users and the teaching and administrative human resources of the Ministry of Public Education and the cabotage service—all duly identified with their institutional ID card—to and from the embarkation points on both banks of the Tempisque River near the La Amistad Bridge to strategic points close to their workplaces. The Minister of Education is instructed, during the effective period of this directive, to exceptionally consider the possibility of relocating affected employees, whether on an interim or permanent basis, based on the legal framework governing human talent management within the Civil Service Regime.\n\nArticle 7º- If necessary, public passage of people and light vehicles, light cargo, and non-articulated cargo vehicles will be enabled through roads located on private properties, with the respective authorization of their owners.\n\nArticle 8º- All centralized and decentralized Public Administration institutions are authorized to contribute sufficient logistical, economic, and human resources to implement this directive.\n\nArticle 9º- Due to the imperative need that will affect nearby populations, an invitation is extended to the various subjects of Private Law who may be able to contribute logistical resources that facilitate the movement of people and compensated public transport vehicles, to approach the Ministry of Public Works and Transport to make the relevant arrangements.\n\nArticle 10º- All of the foregoing applies from April 1, 2024, until August 1, 2024, or until the repairs to the La Amistad Bridge over the Tempisque River have been completed and traffic over said work is enabled.\n\nArticle 11º- It is effective upon its publication.\n\nGiven at the Presidency of the Republic, on the twentieth day of March, two thousand twenty-four." }
