  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 44397\n\n                        Declara de utilidad pública para los intereses del Estado la Asociación\nAmigos del Río Torres\n\nN° 44397-MJP\n\nEL PRESDENTE DE LA\nREPÚBLICA\n\nY EL MINISTRO DE JUSTICIA Y\nPAZ\n\nCon fundamento en lo\ndispuesto en los artículos 140, inciso 18) y 146 de la Constitución Política,\nen el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y\nlos artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N°\n29496-J, publicado en La Gaceta N° 96 del 21 de mayo del 2001, así como\nlo establecido en el artículo 3, inciso ch) de la Ley de Impuesto sobre la\nRenta N° 7092 y en los artículos 103 y 104 de Código de Normas y Procedimientos\nTributarios N° 4755.\n\nConsiderando:\n\n1º-Que el artículo 32 de la\nLey de Asociaciones N° 218 de 8 de agosto de 1939 y sus reformas, confiere al Poder\nEjecutivo la potestad de declarar de utilidad pública a las asociaciones\nsimples, federadas o confederadas, cuyo desarrollo y actividades sean\nparticularmente útiles para los intereses del Estado, y que por ello\ncontribuyan a solventar una necesidad social.\n\nII.-Que la Asociación\nAmigos del Río Torres, cédula de persona jurídica número 3-002-684122, se\ninscribió en el Registro de Asociaciones del Registro Público Nacional desde el\ndía 9 de julio del 2014, tomo dos mil catorce, asiento cincuenta y cinco mil\nseiscientos noventa y cuatro.\n\nIII.-Que los fines que\npersigue la Asociación, según sus estatutos son: \"(.) Promover iniciativas\nde recuperación y protección de la microcuenca del Río Torres y sus riberas,\nasí como apoyar la investigación ambiental, social, económica, científica y\ncultural, enfocada en la conservación del Río. Dichas iniciativas incluyen,\nentre otros, la recuperación, limpieza y protección del río y sus alrededores,\nasí como, la preservación del corredor biológico Interurbano del Río Torres, a\ntravés del mapeo y contención de las fuentes de contaminación que afectan el\nrío. La Asociación velará por educar y concientizar a la población sobre la\nsituación actual del Río Torres, con el fin de generar cambios en el estilo de\nvida de los pobladores que impacten directamente en la sanación del río, en\nbeneficio de las generaciones presentes y futuras (...) aprovechar de manera\nresponsable y sostenible el recurso ecosistemático del Río Torres. La\nAsociación inculcará valores que incluyen el respeto por la naturaleza, la\nsostenibilidad socioambiental, la restauración y preservación del medio\nambiente, la inclusión de diversos sectores de la sociedad, el fomento del\narte, la cultura y la educación entre otros. Asimismo, la Asociación podrá promover\nel desarrollo de emprendimientos que contribuyan a la recuperación y\nsostenibilidad socioambiental de la microcuenca, que fomenten la visita a\nmuseos, centro de conferencias, galerías de arte, anfiteatros, cafés y otros centros\nrecreativos en sus alrededores (...)\"\n\nIV.-Que tales fines\nsolventan una necesidad social de primer orden, por lo cual merecen el apoyo\ndel Estado costarricense. Said initiatives include,\namong others, the recovery, cleanup and protection of the river and its surroundings,\nas well as the preservation of the Río Torres Interurban biological corridor (corredor biológico),\nthrough the mapping and containment of the pollution sources that affect the\nriver. The Association will ensure the education and awareness of the population about the\ncurrent situation of the Río Torres, in order to generate changes in the\nlifestyle of the inhabitants that directly impact the healing of the river, for\nthe benefit of present and future generations (…) responsibly and sustainably\nutilize the ecosystem resource of the Río Torres. The\nAssociation will instill values that include respect for nature,\nsocio-environmental sustainability, the restoration and preservation of the environment,\nthe inclusion of diverse sectors of society, the promotion of\nart, culture, and education, among others. Likewise, the Association may promote\nthe development of enterprises that contribute to the recovery and\nsocio-environmental sustainability of the micro-watershed, that encourage visits to\nmuseums, conference centers, art galleries, amphitheaters, cafés, and other\nrecreational centers in its surroundings (…)\"\n\nIV.—That such purposes\nsolve a social need of the first order, for which they deserve the support\nof the Costa Rican State. Therefore,\n\nThey decree:\n\nDECLARATION OF PUBLIC\nUTILITY\n\nOF THE ASSOCIATION FRIENDS OF THE\nRÍO TORRES\n\nArticle 1.—Declare of public\nutility for the interests of the State the Association Friends of the Río Torres,\nlegal identification number 3-002-684122.\n\nArticle 2.—It is the duty of the\nAssociation to annually submit a management report to the Ministry of\nJustice and Peace, in accordance with the provisions of article 32 of the Regulation\nto the Law of Associations.\n\nArticle 3.—The income and\nthe assets of the association that are allocated entirely and\nexclusively for public purposes, environmental protection, or charity and\nthat under no circumstances are distributed directly or indirectly among its\nmembers, shall be exempt from income tax; on\nthe contrary, that part that does not have this purpose, or that is distributed in any\nway among its associates, shall be subject to the imposition of this tax.\n\nArticle 4.—It is the responsibility\nof the Tax Administration to control and oversee the correct fulfillment\nof the tax obligations of the association, in accordance with the provisions\nof articles 103 and 104 of the Code of Tax Norms and Procedures.\n\nArticle 5.—Once\nthis decree is published, the interested parties must formalize and present the\nrespective certified copy before the Registry of Associations of the National Registry,\nfor its respective registration.\n\nArticle 6.—It becomes effective upon\nits publication.\n\nGiven at the Presidency of\nthe Republic.—San José, the twelfth of February of two thousand twenty-four."
