Asimismo, artículos 13, 14, 15, 20, 21\nde la Ley de Catastro Nacional Nº 6545 de 25 de marzo de 1981, publicada en el\nDiario Oficial La Gaceta No. 73 el 15 de abril de 1981, artículos 7 y 26 de\nReglamento a la Ley de Catastro Nacional, Decreto Ejecutivo Nº 34331 de 29 de\nnoviembre de 2007 publicado en el Diario Oficial La Gaceta No. 41 del 27 de\nfebrero del 2008 (reformado por Decreto Ejecutivo Nº 34763 de 16 de\nsetiembre de 2008 Publicado en el diario oficial la Gaceta N º 186 del\n26 de septiembre de 2008.), Ley N º 8154 de 27 de noviembre de 2001,\n\"Convenio de Préstamo Nº 1284/OC-CR, Programa de Regularización\nCatastro y Registro\", publicada en el Diario Oficial La Gaceta No. 237 del\n10 de diciembre del 2001, Decreto Ejecutivo Nº 30106-J, de 6 de\ndiciembre de 2001 publicada en el Diario Oficial La Gaceta No. 19 del 28 de\nenero del 2002, \"Declara Zona Catastral la Totalidad de los Cantones del\nTerritorio Nacional\" y Decreto Ejecutivo Nº 35509-J de 30 de\nsetiembre de 2009, publicada en el Diario Oficial La Gaceta No. 198 del 13 de\noctubre del 2009 \"Reglamento de Organización del Registro\nInmobiliario\".\n\nConsiderando:\n\nI.-Que\nmediante Ley Nº 8710, publicada en La Gaceta Nº 48 del 10 de marzo de 2009 se\nreforma el artículo 2 de la Ley Nº 5695, Ley de Creación del Registro\nNacional, publicada en el Diario Oficial La Gaceta No. 106 del 07 de junio de\n1975 y sus reformas, indicando que el Catastro Nacional pasa a formar parte del\nRegistro Inmobiliario.\n\nII.-Que el\nDecreto Ejecutivo Nº 35509-J de 30 de setiembre de 2009, Reglamento de Organización\ndel Registro Inmobiliario publicado en el Diario Oficial La Gaceta Nº 198 del 13 de octubre de\n2009, establece que el Registro Inmobiliario está conformado por la\nSubdirección Catastral y la Subdirección Registral.\n\nIII.-Que el\nRegistro Inmobiliario del Registro Nacional, con fundamento en la Ley de\nCatastro Nacional Nº 6545 de 25 de marzo de 1981, publicada en el Diario\nOficial La Gaceta No. 73 del 15 de abril de 1981 en su artículo 13 tiene como\npotestad exclusiva, la ejecución y mantenimiento del Catastro, función que\npuede delegar parcialmente en otras instituciones estatales.\n\nIV.-Que la\nAsamblea Legislativa, el 27 de noviembre de 2001, aprobó la Ley Nº 8154,\n\"Convenio de Préstamo N º 1284/OC-CR, Programa de Regularización del\nCatastro y Registro\", suscrito entre el Gobierno de la República y el\nBanco Interamericano de Desarrollo (BID), publicada en el Diario Oficial La\nGaceta No. 237 del 10 de diciembre del 2001 para la ejecución del Programa de\nRegularización del Catastro y Registro Nacional, que por disposición de la\nmisma ley, está a cargo de una Unidad Ejecutora adscrita al Ministerio de\nHacienda como órgano desconcentrado.\n\nV.-Que el Programa de Regularización del Catastro y Registro Nacional,\ntuvo como tarea el levantamiento catastral con el objetivo de formar el\ncatastro nacional y compatibilizar la información catastral y registra!\nde los inmuebles, en aplicación de lo que dispone la Ley de Catastro Nº 6545 de\n25 de marzo de 1981 publicada en el Diario Oficial La Gaceta No. 73 el 15 de\nabril de 1981, función que culminó el 07 de mayo de 2014.\n\nVI.-Que de\nconformidad con lo que establece el artículo 1 º Decreto Ejecutivo Nº 30106-J\ndonde se \"Declara Zona Catastral la Totalidad de los Cantones del\nTerritorio Nacional\" publicado en La Gaceta Nº 19 de 28 de enero de 2002 y\nel artículo 7 del Reglamento a la Ley del Catastro Nacional, Decreto Ejecutivo\nNº 34331, publicado en el Diario Oficial La Gaceta No. 41 del 27 de febrero del\n2008 el cual rige desde el 27 de setiembre de 2008, la totalidad de los\ncantones del territorio nacional fueron declarados zona catastral.\n\nVII.-Que el\nReglamento a la Ley de Catastro Nacional, Decreto Ejecutivo Nº 34331 el cual\nrige desde el 27 de setiembre de 2008 y que fue publicado en el Diario Oficial\nLa Gaceta No. 41 del 27 de febrero del 2008, establece los requerimientos\ntécnicos para el levantamiento de planos de agrimensura.\n\nVIII.-Que por\nhaber concluido los trabajos de levantamiento catastral del Cantón 01 San José,\nDistrito 05 Zapote, Provincia 01 San José, y de conformidad con lo que\nestablece el artículo 19 de la Ley de Catastro Nacional y 10 de su reglamento,\nfueron invitados los titulares de inmuebles de dicho distrito a una exposición\npública para conocer los resultados del levantamiento y manifestar su conformidad\no disconformidad, exposición que se llevó a cabo del 10 al 17 de octubre del\n2023.\n\nIX.-Que la\ninvitación a la exposición pública de los resultados del levantamiento\ncatastral del Cantón 01 San José, Distrito 05 Zapote, Provincia 01 San José, fue\npublicada en el Diario Oficial La Gaceta # Likewise, Articles 13, 14, 15, 20, 21\nof the National Cadastre Law No. 6545 of March 25, 1981, published in the\nOfficial Gazette La Gaceta No. 73 on April 15, 1981, Articles 7 and 26 of\nthe Regulation to the National Cadastre Law, Executive Decree No. 34331 of November 29,\n2007, published in the Official Gazette La Gaceta No. 41 of February 27,\n2008 (amended by Executive Decree No. 34763 of September 16,\n2008, Published in the official gazette La Gaceta No. 186 of\nSeptember 26, 2008.), Law No. 8154 of November 27, 2001,\n\"Loan Agreement No. 1284/OC-CR, Cadastre and Registry Regularization\nProgram\", published in the Official Gazette La Gaceta No. 237 of\nDecember 10, 2001, Executive Decree No. 30106-J of December 6,\n2001, published in the Official Gazette La Gaceta No. 19 of January 28,\n2002, \"Declares the Entirety of the Cantons of the National Territory a Cadastral Zone\" and Executive Decree No. 35509-J of September 30,\n2009, published in the Official Gazette La Gaceta No. 198 of October 13,\n2009, \"Organizational Regulation of the Immovable Property Registry (Registro Inmobiliario)\".\n\nWhereas:\n\nI.—That\nthrough Law No. 8710, published in La Gaceta No. 48 of March 10, 2009,\nArticle 2 of Law No. 5695, Law on the Creation of the National Registry,\npublished in the Official Gazette La Gaceta No. 106 of June 7,\n1975, and its amendments, is reformed, indicating that the National Cadastre becomes part of the\nImmovable Property Registry (Registro Inmobiliario).\n\nII.—That\nExecutive Decree No. 35509-J of September 30, 2009, Organizational Regulation\nof the Immovable Property Registry (Registro Inmobiliario), published in the Official Gazette La Gaceta No. 198 of October 13,\n2009, establishes that the Registro Inmobiliario is composed of the\nCadastral Sub-directorate (Subdirección Catastral) and the Registry Sub-directorate (Subdirección Registral).\n\nIII.—That the\nRegistro Inmobiliario of the National Registry, based on the National Cadastre\nLaw No. 6545 of March 25, 1981, published in the Official\nGazette La Gaceta No. 73 of April 15, 1981, in its Article 13, has as its\nexclusive power the execution and maintenance of the Cadastre, a function\nthat it may partially delegate to other state institutions.\n\nIV.—That the\nLegislative Assembly, on November 27, 2001, approved Law No. 8154,\n\"Loan Agreement No. 1284/OC-CR, Cadastre and Registry Regularization\nProgram\", signed between the Government of the Republic and the\nInter-American Development Bank (IDB), published in the Official Gazette La\nGaceta No. 237 of December 10, 2001, for the execution of the\nCadastre and National Registry Regularization Program, which, by provision of the\nsame law, is under the charge of an Executing Unit attached to the Ministry of\nFinance as a deconcentrated organ.\n\nV.—That the Cadastre and National Registry Regularization Program\nhad as its task the cadastral survey (levantamiento catastral) with the objective of forming\nthe national cadastre and making compatible the cadastral and registry\ninformation of the properties, in application of the provisions of the Cadastre Law No. 6545 of\nMarch 25, 1981, published in the Official Gazette La Gaceta No. 73 on April\n15, 1981, a function that culminated on May 7, 2014.\n\nVI.—That in\naccordance with what is established in Article 1 of Executive Decree No. 30106-J\nwhich \"Declares the Entirety of the Cantons of the National Territory a Cadastral Zone,\" published in La Gaceta No. 19 of January 28, 2002, and\nArticle 7 of the Regulation to the National Cadastre Law, Executive Decree\nNo. 34331, published in the Official Gazette La Gaceta No. 41 of February 27,\n2008, which has been in effect since September 27, 2008, the entirety of the\ncantons of the national territory were declared a cadastral zone (zona catastral).\n\nVII.—That the\nRegulation to the National Cadastre Law, Executive Decree No. 34331, which\nhas been in effect since September 27, 2008, and which was published in the Official Gazette\nLa Gaceta No. 41 of February 27, 2008, establishes the technical\nrequirements for the survey of land surveying plans (planos de agrimensura).\n\nVIII.—That because\nthe cadastral survey (levantamiento catastral) work for Canton 01 San José,\nDistrict 05 Zapote, Province 01 San José, has concluded, and in accordance with what\nArticle 19 of the National Cadastre Law and 10 of its regulation establish,\nthe titleholders of properties in said district were invited to a public\nexhibition to learn about the survey results and express their conformity\nor non-conformity, an exhibition that was held from October 10 to 17,\n2023.\n\nIX.—That the\ninvitation to the public exhibition of the cadastral survey results for Canton 01 San José, District 05 Zapote, Province 01 San José, was\npublished in the Official Gazette La Gaceta #
