Reforma a los\nartículos 2, artículo 16 inciso 7), articulo 22 y articulo 38 Reglamento de\nParques Y Zonas Verdes de la Municipalidad de Puriscal\n\n(Nota de Sinalevi: El presente reglamento se extrajo del sitio Web del Municipalidad de Puriscal,\npor lo que se transcribe a continuación:)\n\nMUNICIPALIDAD\nDE PURISCAL\n\nPROYECTO SOBRE REFORMA A\nLOS ARTÍCULOS 2, ARTÍCULO 16 INCISO 7),\n\nARTICULO 22 Y ARTICULO 38\nREGLAMENTO DE PARQUES\nY\n\nZONAS VERDES DE LA MUNICIPALIDAD DE PURISCAL.\n\n          Antecedentes\n\n          El parque del cantón de Puriscal, tiene más de 50 años desde su creación, esta área\nverde dentro del cantón de Puriscal reviste de gran\nimportancia ya que es un espacio de esparcimiento que aumenta la esperanza de\nvida, mejora las relaciones sociales entre los ciudadanos y visitantes del\ncantón, aparte de que embellece el casco central del distrito de Santiago.\n\n          Desde la entrada en función de nuestra\ngestión el parque el agricultor ha sido uno de los espacios en los cuales no\nhemos venido enfocando, en darle una versión mas\nrejuvenecida, con muchos más espacios de esparcimiento, que sirva para la\npoblación infantil, mediana edad e incluso para adultos mayores. Trayendo\nconsigo la idea además de atraer el interés turístico por nuestro cantón\nconocido a nivel país por su chicharrón, por ello y al no contar con un espacio\nlibre dentro del cantón es que se ha pretendido que el parque además sea el\nepicentro de emprendedores y artesanos para que tengan un espacio familiar\ndonde poder exhibir y vender sus productos, así como cuando este municipio\nplanee actividades pueda haber un sitio de reunión y esparcimiento para las\nfamilias Puriscaleñas y aquellas que nos visiten.\n\n          En razón de lo anterior en el año\n2023, nos vimos en la necesidad de actualizar y dar una reforma integral al\nReglamento de Parques y Zonas verdes de la Municipalidad de Puriscal,\nya que la versión anterior que data del año 2009, y se centraba a un solo\nparque; si bien es cierto en la actualidad en nuestro cantón solo existe un\nparque, desde este gobierno local se ha venido trabajando en conjunto con las\nasociaciones de desarrollo para propiciar espacios verdes e interactivos (como\nlo son los parques infantiles) para el esparcimiento de las familias.\n\n          Con la practica y puesto en funcionamiento del nuevo reglamento hemos ido notando aun mas\ndentro de las solicitudes de uso para arrendamiento que existen grupos de acción social, los cuales\nson los encargados de realizar programas y ayudas que buscando satisfacer necesidades básicas de la\npoblación, por lo que se ve como una necesidad e interés publico que desde la Municipalidad se les\nde un apoyo extra a este tipo de organizaciones dándoles la oportunidad de participar dentro del\nparque con actividades o estand de venta de productos sin cancelar el canon del que habla el\nreglamento, generándoles así más utilidades a las actividades o productos que vendan dentro del\nparque, esto siempre comprobándose el objetivo social de estas agrupaciones, esto además en\ncumplimiento de nuestras atribuciones (artículo 4 inciso h) del código municipal) y obligaciones\n(artículo 5 del código municipal).\n\n          Con fundamento en las razones\nantes expuestas, se somete a consideración de las señoras y los señores\nregidores del Concejo Municipal, el siguiente proyecto\nsobre reforma a los artículos 2, artículo 16 inciso 7), articulo 22 y articulo\n38 reglamento de parques y zonas verdes de la municipalidad\nde Puriscal.\n\nPROYECTO SOBRE REFORMA A\nLOS ARTÍCULOS 2, ARTÍCULO 16 INCISO 7),\n\nARTICULO 22 Y ARTICULO 38\nREGLAMENTO DE PARQUES\nY\n\nZONAS VERDES DE LA MUNICIPALIDAD DE PURISCAL.\n\nARTICULO 1: Agréguese a el articulo 2 la siguiente\ndefinición:\n\n.Artículo 2.- Definiciones: Para los efectos de este reglamento se entiende\npor: \n\nGrupos de acción social: Son aquellas personas jurídicas que se dedican a realizar programas y\nayudas que buscan satisfacer necesidades básicas de la población\n\nARTICULO\n2: Modifíquese el artículo 16 inciso 7) del reglamento de parques y zonas\nverdes de la Municipalidad de Puriscal:\n\nArticulo 16.- Los requisitos para la autorización de uso de las\ninstalaciones de los parques municipales y espacios públicos son los siguientes:\n\n7. Reform of Articles 2, Article 16 subsection 7), Article 22 and Article 38 of the Parks and Green Zones Regulation of the Municipality of Puriscal\n\n(Sinalevi note: This regulation was extracted from the website of the Municipality of Puriscal, therefore it is transcribed below:)\n\nMUNICIPALITY OF PURISCAL\n\nPROJECT FOR THE REFORM OF ARTICLES 2, ARTICLE 16 SUBSECTION 7),\n\nARTICLE 22 AND ARTICLE 38 OF THE PARKS AND GREEN ZONES REGULATION OF THE MUNICIPALITY OF PURISCAL.\n\n          Background\n\n          The park of the canton of Puriscal is more than 50 years old since its creation; this green area within the canton of Puriscal is of great importance since it is a recreational space that increases life expectancy, improves social relations among citizens and visitors of the canton, besides beautifying the central core of the district of Santiago.\n\n          Since the beginning of our administration, the Parque El Agricultor has been one of the spaces on which we have been focusing, to give it a more rejuvenated version, with many more recreational spaces that serve the child population, middle-aged people and even older adults. Bringing with it the idea, in addition, of attracting tourist interest to our canton, known nationwide for its chicharrón. For this reason, and due to the lack of a free space within the canton, the park is also intended to be the epicenter for entrepreneurs and artisans so that they have a family-friendly space where they can exhibit and sell their products, as well as a meeting and recreational site for Puriscal families and those who visit us when this municipality plans activities.\n\n          By reason of the foregoing, in the year 2023, we found ourselves in need of updating and providing an integral reform to the Parks and Green Zones Regulation of the Municipality of Puriscal, since the previous version dates back to the year 2009 and focused on a single park; although it is true that currently in our canton there is only one park, this local government has been working together with development associations to promote green and interactive spaces (such as children's playgrounds) for family recreation.\n\n          With the implementation and enforcement of the new regulation, we have further noticed, within the lease use requests, that there are social action groups (grupos de acción social), which are responsible for carrying out programs and aids seeking to satisfy basic needs of the population. Therefore, it is seen as a necessity and public interest that the Municipality provide extra support to this type of organization, giving them the opportunity to participate within the park with activities or product sales stands without paying the rent fee (canon de arrendamiento) mentioned in the regulation, thus generating more profits for the activities or products they sell within the park. This is always verified by the social purpose of these groups, also in compliance with our powers (Article 4 subsection h) of the Municipal Code) and obligations (Article 5 of the Municipal Code).\n\n          Based on the reasons set forth above, the following project for the reform of Articles 2, Article 16 subsection 7), Article 22 and Article 38 of the Parks and Green Zones regulation of the Municipality of Puriscal is submitted for consideration to the councilwomen and councilmen of the Municipal Council.\n\nPROJECT FOR THE REFORM OF ARTICLES 2, ARTICLE 16 SUBSECTION 7),\n\nARTICLE 22 AND ARTICLE 38 OF THE PARKS AND GREEN ZONES REGULATION OF THE MUNICIPALITY OF PURISCAL.\n\nARTICLE 1: Add the following definition to Article 2:\n\nArticle 2.- Definitions: For the purposes of this regulation, the following shall be understood by: \n\nSocial action groups (Grupos de acción social): Those legal entities dedicated to carrying out programs and aids that seek to satisfy basic needs of the population.\n\nARTICLE 2: Amend Article 16 subsection 7) of the Parks and Green Zones regulation of the Municipality of Puriscal:\n\nArticle 16.- The requirements for the authorization of use of the facilities of municipal parks and public spaces are the following:\n\n7. Payment of the rent fee, except for social action groups, which must submit within their request the social purpose of the activity, so that it can be analyzed by the Public Services office for the payment or non-payment of the rent fee.\n\nARTICLE 3: Amend Article 22 as follows:\n\nArticle 22.- For any activity to be carried out within the Municipal parks and green zones, a rent fee shall be charged for the use of the facilities, except for those indicated in Article 16 subsection 7) of this regulation. Said fee shall be calculated by the Public Services department using the following formula:\n\nDaily fee (Canon diario): ((Value of the real estate * 3%) / 365)) * Number of days to be used.\n\nThe purpose of this fee shall be for the maintenance, improvements, expansion or creation of public spaces; this may be invested throughout the canton.\n\nARTICLE 4: Amend Article 38 of this regulation as follows:\n\nArticle 38.- The Municipality of Puriscal may, as stipulated in this regulation, lease spaces for the commercialization of products (that have the corresponding permits and patents) in parks and public areas, provided that compliance is met with what is established for the care of public spaces, whether this is within the framework of activities and/or fairs organized by the Municipality or by third parties.\n\nWhen the Municipality is the organizer, according to the type of trade and associated product, it shall invite the commercial licensees (patent holders) via email, granting the temporary lease conditions, the space to be provided and all pertinent information. Interested parties must complete the established requirements, and they will be completed according to the order of application submission and the quantity allowed for the established activity or fair, paying the temporary lease and temporary license, except in those cases of social interest groups (grupos de interés social) established in Article 16 subsection 7 of this regulation.\n\nThe cost of said temporary lease shall be stipulated according to the number of days of the activity under the formula:\n\nDaily fee: ((Value of the real estate * 1.5%) / 365)) * Number of days to be used.\n\nThe cost of the commercial license shall be stipulated by the Commercial Licenses department and shall be sent along with the other information to the interested parties. When the activity is organized by a third party, it shall be governed under Chapter IV of this regulation, in terms of procedures and costs.\n\n            Effective from its publication.\n\nSubmitted to non-binding public consultation in La Gaceta No. 113 of June 21, 2024, with no comments or objections; it was approved according to Municipal Council Agreement No. 013-06-2024.
