  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 44702\n\n                        Declaratoria de interés público para la construcción de embarcaderos\npúblicos vecinales en las provincias de Puntarenas, Guanacaste y Limón\n\nN° 44702-MOPT\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE OBRAS PÚBLICAS Y TRANSPORTES\n\nEn el ejercicio de las facultades y prerrogativas\nconferidas en los artículos 140 inciso 3) y 146 de la Constitución Política;\ncon fundamento en los artículos 1°, 2° y 4° de la Ley N° 3155, del 5 de agosto\nde 1963, Ley de Creación del Ministerio de Obras Públicas y Transportes en\nsustitución del Ministerio de Obras Públicas; los artículos 22 y 23 de la Ley N°\n6043, del 2 de marzo de 1977, Ley sobre la Zona Marítimo Terrestre; y los\nartículos 25 inciso 1), 27 inciso 1) y 28 inciso 2.b) de la Ley N° 6227, del 2\nde mayo de 1978, Ley General de la Administración Pública, y el artículo 7°\ninciso k) del Decreto Ejecutivo N° 43580-MP-PLAN, del 01 de junio de 2022,\nReglamento Orgánico del Poder Ejecutivo.\n\nConsiderando:\n\nI.-Que el artículo 2° inciso c) de la Ley N° 3155 de 5 de\nagosto de 1963 y sus reformas, confiere al Ministerio de Obras Públicas y\nTransportes la competencia para planificar, construir, mejorar y mantener los\npuertos de altura y cabotaje, las vías y terminales de navegación interior y\nlos sistemas de transbordadores.\n\nll.-Que, en cuanto\nal transporte marítimo, la infraestructura portuaria en las costas permite las\nadecuadas labores y maniobras de embarque y desembarque con el adecuado\nresguardo y medidas preventivas para la seguridad de las personas, las\nembarcaciones y otros bienes materiales y naturales.\n\nIII.-Que, para el caso de las comunidades costeras, la construcción de infraestructura portuaria\nmenor permite que éstas cuenten con las condiciones mínimas aptas para la realización de labores de\nembarque y desembarque, de forma cómoda, segura y con la adecuada prevención de riesgos, para la\nintermodalidad de transporte marítimo-terrestre y viceversa con la que conviven diariamente las\npersonas habitantes de estos territorios, dado su ineludible ligamen al mar.\n\nIV.-Que diversas comunidades costeras tanto en el Pacífico como en el\nCaribe no cuentan con infraestructura portuaria menor que permita el transporte\nmarítimo de manera segura y adecuada.\n\nV.-Que la ausencia de infraestructura\nportuaria menor en las comunidades costeras del litoral\nPacífico como Caribe pone en riesgo la vida,\nintegridad física y seguridad de las personas, habitantes\nde estas zonas, turistas,\nque utilizan embarcaciones\npara transportarse, lo cual\ncompromete la seguridad y\nel orden público.\n\nVI.-Que es necesaria, conveniente y oportuna para el interés\npúblico, la construcción de varios embarcaderos públicos vecinales en las\nprovincias de Puntarenas, Guanacaste y Limón, con los cuales se proteja la vida\ny seguridad de las personas.\n\nVII.-Que, en virtud de las anteriores consideraciones, por razones\nde oportunidad y conveniencia para la seguridad pública y el orden público, en\nmateria de tránsito y transporte mediante embarcaciones, es necesario declarar\nde interés público la construcción de embarcaderos públicos vecinales en los\nlitorales Pacífico y Caribe costarricense.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 44702\n\n                        Declaration of public interest for the construction of neighborhood\npublic piers in the provinces of Puntarenas, Guanacaste and Limón\n\nN° 44702-MOPT\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF PUBLIC WORKS AND TRANSPORT\n\nIn the exercise of the powers and prerogatives\nconferred in articles 140 subsection 3) and 146 of the Political Constitution;\nbased on articles 1, 2 and 4 of Law No. 3155 of August 5,\n1963, Law Creating the Ministry of Public Works and Transport in\nsubstitution of the Ministry of Public Works; articles 22 and 23 of Law No.\n6043 of March 2, 1977, Law on the Maritime Terrestrial Zone; and\narticles 25 subsection 1), 27 subsection 1) and 28 subsection 2.b) of Law No. 6227 of May\n2, 1978, General Law of Public Administration, and article 7\nsubsection k) of Executive Decree No. 43580-MP-PLAN of June 1, 2022,\nOrganic Regulation of the Executive Branch.\n\nConsidering:\n\nI.-That article 2 subsection c) of Law No. 3155 of August 5,\n1963 and its amendments, confers upon the Ministry of Public Works and\nTransport the competence to plan, build, improve and maintain\ndeep-water and cabotage ports, inland navigation waterways and terminals, and\nferry systems.\n\nII.-That, regarding\nmaritime transport, port infrastructure on the coasts allows for\nadequate loading and unloading work and maneuvers with suitable\nprotection and preventive measures for the safety of persons,\nvessels, and other material and natural assets.\n\nIII.-That, in the case of coastal communities, the construction of minor port\ninfrastructure allows them to have the minimum conditions suitable for carrying out loading and\nunloading work, in a comfortable, safe manner and with adequate risk prevention, for the\nintermodality of maritime-land transport and vice versa with which the inhabitants of these territories live daily,\ngiven their inescapable link to the sea.\n\nIV.-That various coastal communities on both the Pacific and the\nCaribbean lack minor port infrastructure that would allow maritime\ntransport in a safe and adequate manner.\n\nV.-That the absence of minor port\ninfrastructure in the coastal communities of the Pacific\nand Caribbean littoral puts at risk the life,\nphysical integrity and safety of the people, inhabitants\nof these areas, tourists,\nwho use vessels\nto transport themselves, which\ncompromises public safety and\norder.\n\nVI.-That the construction of several neighborhood public piers in the\nprovinces of Puntarenas, Guanacaste and Limón, through which the life\nand safety of the people would be protected, is necessary, convenient and timely for the public\ninterest.\n\nVII.-That, by virtue of the foregoing considerations, for reasons\nof timeliness and convenience for public safety and public order, in\nmatters of transit and transport via vessels, it is necessary to declare\nof public interest the construction of neighborhood public piers on the\nCosta Rican Pacific and Caribbean littorals. Therefore,\n\nThey Decree:\n\nThe following:\n\n\"DECLARATION OF PUBLIC INTEREST FOR THE\n\nCONSTRUCTION OF NEIGHBORHOOD PUBLIC\n\nPIERS IN THE PROVINCES OF\n\nPUNTARENAS, GUANACASTE AND LIMÓN\"\n\nArticle 1.-The construction of neighborhood public piers in the following\nareas of the country is hereby declared of public interest:\n\n. Costa de\nPájaros, Puntarenas, Puntarenas.\n\n. Chomes,\nPuntarenas, Puntarenas.\n\n. Mal País, Cóbano,\nPuntarenas.\n\n. Cabuya, Cóbano,\nPuntarenas.\n\n. Drake, Osa, Puntarenas.\n\n.
