artículo 2 incisos a), c), d) y e) de la Ley de Protección Fitosanitaria, Nº 7664 del\n08 de abril de 1997; artículos 2, 213, 244, 262, 345 inciso 8) de la Ley General de Salud, N º 5395\ndel 30 de octubre de 1973, y artículos 2 incisos a) y ch) de la Ley Orgánica del Ministerio del\nAmbiente y Energía, Nº 7152 del 05 de junio de 1990.\n\n\n\n\n\nCONSIDERANDO:\n\n\n\n\n\nl. Que de conformidad con el artículo 50 de la Constitución Política, el Estado procurará el mayor\nbienestar a todos los habitantes del país, organizando y estimulando la producción.\n\n\n\n\n\nII. Que el artículo 50 antes referido además otorga el derecho a toda persona de contar con un\nambiente sano y ecológicamente equilibrado, debiendo el Estado garantizar, defender y preservar ese\nderecho.\n\n\n\n\n\nIII. Que adicionalmente, señala la Carta Magna en su artículo cincuenta que toda persona tiene el\nderecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida,\nsiendo el agua un bien de la Nación.\n\n\n\n\n\nIV. Que según lo establece el artículo 33 de la Ley de Fomento a la Producción Agropecuaria FODEA y\nOrgánica del MAG, N º 7064, el Ministerio de Agricultura y Ganadería es el órgano rector del Sector\nAgropecuario.\n\n\n\n\n\nV. Que el artículo 2 de la Ley de Protección Fitosanitaria, N º 7664, designa al Servicio\nFitosanitario del Estado como el órgano encargado de fomentar el manejo integrado de plagas dentro\ndel desarrollo sostenible, así como otras metodologías agrícolas productivas que permitan el control\nde plagas sin deterioro del ambiente, además de regular el uso y manejo de sustancias químicas,\nbiológicas o afines y equipos para aplicarlas en la agricultura; asimismo, su registro, importación,\ncalidad y residuos, procurando al mismo tiempo proteger la salud humana y el ambiente.\n\n\n\n\n\nVI. Que según el artículo 2 de la Ley General de Salud, Nº 5395, es función esencial del Estado\nvelar por la salud de la población, correspondiéndole al Ministerio de Salud la formación,\nplanificación y coordinación de todas las actividades públicas y privadas relativas a la salud, así\ncomo la ejecución de aquellas actividades que le competen conforme a dicha Ley.\n\n\n\n\n\nVII. El artículo 2 de la Ley Orgánica de Ministerio de Ambiente, Energía Ley Nº 7152 del 5 de junio\nde 1990, el artículo 1 de la Ley Orgánica del Ambiente, Ley Nº 7554 del 4 de octubre de 1995, los\nartículos 4, 6 y 7 de la Ley de Conservación de la Vida Silvestre, Ley Nº 7317 del 30 de octubre de\n1992, los artículos 5, 28, 29, 31 y 33 de la Ley de Uso, Manejo y Conservación de Suelos, Ley Nº\n7779 del 30 de abril de 1998, y los artículos 1, 14 y 22 de Ja Ley de Biodiversidad, Nº 7788 del 30\nde abril de 1998, confieren al Ministerio de Ambiente y Energía, la potestad de formular, planificar\ny ejecutar las políticas de protección ambiental del Gobierno de la República, así como competencia\ny legitimidad para participar en el proceso de registro de plaguicidas, con el objetivo de evaluar\nlos potenciales riesgos ambientales de los productos a registrar y propiciar así un desarrollo\nsostenible.\n\n\n\n\n\nVIII. Que los plaguicidas juegan un papel crucial en la protección de los cultivos agrícolas contra\nplagas y enfermedades; sin embargo, un manejo inadecuado de los mismos puede tener efectos\nperjudiciales para la salud humana, así como ocasionar impactos negativos en el ambiente y la\nbiodiversidad.\n\n\n\n\n\nIX. Que el Estado debe buscar la creación de mecanismos que logren minimizar los riesgos asociados\nal uso inadecuado de plaguicidas de uso agrícola, de manera que se garantice la seguridad\nalimentaria al mantener la salud de los cultivos y asegurar una producción agrícola estable y de\nalta calidad, pero a su vez proteger la salud de los agricultores, consumidores y comunidades\ncercanas a las áreas de cultivo, así como establecer medidas para prevenir y reducir la\ncontaminación del suelo, agua y aire, preservando así la biodiversidad y los ecosistemas naturales,\ncontribuyendo con esto a acciones orientadas a mitigar el cambio climático.\n\n\n\n\n\nX. Que la \"Política Pública para los Plaguicidas de Uso Agrícola 2024-2034\", aprobada por el\nMinisterio de Planificación y Política Económica a través del oficio MIDEPLAN-DVM-OF- 0134-2024,\nrefleja el compromiso del país con una gestión responsable en el registro, uso y control de los\nplaguicidas agrícolas, representando un paso significativo hacia un manejo integral y sostenible de\nestas herramientas necesarias para la agricultura, marcando el camino hacia un futuro donde la\nproductividad coexista armoniosamente con la protección de la salud pública y el ambiente.\n\n\n\n\n\nXI. Que la \"Política Pública para los Plaguicidas de Uso Agrícola 2024-2034\" tiene como propósito,\nademás, generar mecanismos de coordinación y de articulación interinstitucional entre las\nautoridades competentes, a los efectos de direccionar su actuar hacia un propósito común, haciendo\nun uso eficiente de los recursos públicos y garantizando la protección del interés público que se\nbusca proteger a través de dicha Política.\n\n\n\n\n\nXII. Que de conformidad con el párrafo segundo y tercero del artículo 12 y artículo 12 bis del\nReglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos,\nDecreto Ejecutivo Nº 37045-MP-MEIC de 22 de febrero de 2012, no se procedió a llenar la Sección I,\ndenominada \"Control Previo de Mejora Regulatoria\" del \"Formulario de Evaluación Costo-Beneficio\",\ndado que esta propuesta no establece ni modifica trámites, requisitos y/o procedimientos vinculados\na la persona administrada.\n\n\n\n\n\nPor tanto;\n\n\n\n\n\nDECRETAN\n\n\n\n\n\nOFICIALIZACIÓN DE LA POLÍTIC1\\ PÚBLICA PARA LOS PLAGUICIDAS DE\n\n\n\n\n\nUSO AGRÍCOLA 2024-2034 Y SU PLAN DE ACCIÓN 2024-2028\n\n\n\n\n\nArtículo 1.- Oficialización. El primero se encuentra incorporado como apartado en la Política Pública y\ncomprende el periodo del año 2024 al año 2028 inclusive. El segundo Plan de Acción comprenderá el\nperiodo del año 2029 al año 2034, . el cual deberá ser elaborado por la Mesa Técnica\nInterinstitucional establecida en el Apartado de Modelo de Gestión de la Política Pública, y\noficializado antes del año 2029 .v\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 7.- Responsabilidades de las personas jerarcas de las instituciones públicas. Corresponde a\nlas personas jerarcas de los Ministerios de Agricultura y Ganadería, Ambiente y Energía, y Salud,\nsegún su naturaleza y ámbito de competencia, girar instrucciones a quien corresponda para que la\ninstitución a su cargo garantice la realización de las acciones que la normativa vigente estipula\npara la implementación y cumplimiento de la \"Política Pública para los Plaguicidas de Uso Agrícola\n2024-2034\" y su Plan de Acción, entre estas:\n\n\n\n\n\n1. Garantizar que el proceso de gestión de políticas públicas y los Planes Sectoriales que les\natañen, sus políticas internas, planes, programas, proyectos y servicios incluyan los enfoques y\nprincipios orientadores establecidos en la Política Pública.\n\n\n\n\n\n2. Formular, de acuerdo con los ejes de la \"Política Pública para los Plaguicidas de Uso Agrícola\n2024-2034\", acciones estratégicas que deben ser anualizadas en los planes operativos y\npresupuestarios, de manera tal que se garantice la disposición de recursos del tipo necesario,\nclaramente identificables, así como las acciones puntuales y a los responsables de su cumplimiento.\n\n\n\n\n\n3. That in accordance with Article 50 of the Political Constitution, the State shall seek the greatest well-being for all inhabitants of the country, organizing and stimulating production.\n\nII. That Article 50 referred to above also grants every person the right to a healthy and ecologically balanced environment, the State being obliged to guarantee, defend, and preserve that right.\n\nIII. That additionally, the Magna Carta states in its Article fifty that every person has the human, basic, and inalienable right of access to potable water, as an essential good for life, water being a good of the Nation.\n\nIV. That as established by Article 33 of the Law for the Promotion of Agricultural Production FODEA and Organic Law of the MAG, No. 7064, the Ministry of Agriculture and Livestock is the governing body of the Agricultural Sector.\n\nV. That Article 2 of the Phytosanitary Protection Law, No. 7664, designates the State Phytosanitary Service (Servicio Fitosanitario del Estado) as the body responsible for promoting integrated pest management (manejo integrado de plagas) within sustainable development (desarrollo sostenible), as well as other productive agricultural methodologies that allow pest control without environmental deterioration, in addition to regulating the use and management of chemical, biological, or related substances and equipment for their application in agriculture; likewise, their registration (registro), importation, quality, and residues (residuos), while simultaneously seeking to protect human health and the environment.\n\nVI. That according to Article 2 of the General Health Law, No. 5395, it is an essential function of the State to ensure the health of the population, with the Ministry of Health being responsible for the formation, planning, and coordination of all public and private activities related to health, as well as the execution of those activities that fall within its competence under said Law.\n\nVII. Article 2 of the Organic Law of the Ministry of Environment, Energy Law No. 7152 of June 5, 1990, Article 1 of the Organic Environmental Law, Law No. 7554 of October 4, 1995, Articles 4, 6, and 7 of the Wildlife Conservation Law, Law No. 7317 of October 30, 1992, Articles 5, 28, 29, 31, and 33 of the Law on Use, Management, and Conservation of Soils, Law No. 7779 of April 30, 1998, and Articles 1, 14, and 22 of the Biodiversity Law, No. 7788 of April 30, 1998, confer upon the Ministry of Environment and Energy the power to formulate, plan, and execute the environmental protection policies of the Government of the Republic, as well as the competence and standing to participate in the pesticide registration process, with the objective of evaluating the potential environmental risks of the products to be registered and thus promoting sustainable development.\n\nVIII. That pesticides (plaguicidas) play a crucial role in protecting agricultural crops against pests and diseases; however, inadequate management of them can have harmful effects on human health, as well as cause negative impacts on the environment and biodiversity.\n\nIX. That the State must seek the creation of mechanisms that minimize the risks associated with the improper use of agricultural-use pesticides, in such a way as to guarantee food security by maintaining crop health and ensuring a stable and high-quality agricultural production, while at the same time protecting the health of farmers, consumers, and communities near cultivation areas, as well as establishing measures to prevent and reduce soil, water, and air contamination, thereby preserving biodiversity and natural ecosystems, thus contributing to actions aimed at mitigating climate change.\n\nX. That the \"Public Policy for Agricultural-Use Pesticides 2024-2034\" (Política Pública para los Plaguicidas de Uso Agrícola 2024-2034), approved by the Ministry of Planning and Economic Policy through official communication MIDEPLAN-DVM-OF-0134-2024, reflects the country's commitment to responsible management in the registration, use, and control of agricultural pesticides, representing a significant step toward integral and sustainable management of these tools necessary for agriculture, paving the way toward a future where productivity coexists harmoniously with the protection of public health and the environment.\n\nXI. That the \"Public Policy for Agricultural-Use Pesticides 2024-2034\" also has the purpose of generating mechanisms for inter-institutional coordination and linkage among the competent authorities, in order to direct their actions toward a common purpose, making efficient use of public resources and guaranteeing the protection of the public interest that is sought to be protected through said Policy.\n\nXII. That in accordance with the second and third paragraphs of Article 12 and Article 12 bis of the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, Section I, called \"Prior Control of Regulatory Improvement\" of the \"Cost-Benefit Evaluation Form\" was not filled out, given that this proposal does not establish or modify procedures, requirements, and/or processes linked to the administered person.\n\nTherefore;\n\nDECREE\n\nOFFICIALIZATION OF THE PUBLIC POLICY FOR AGRICULTURAL-USE PESTICIDES 2024-2034 AND ITS ACTION PLAN 2024-2028\n\nArticle 1.- Officialization. The \"Public Policy for Agricultural-Use Pesticides 2024-2034\" is hereby officialized, which shall be executed in the period between the years 2024 and 2034 inclusive, as well as its Action Plan 2024-2028, which shall be of mandatory compliance for the Public Sector, particularly for the institutions that make up the Agricultural Sector, Environment Sector, and Health Sector.\n\nThe full text of the Policy will be available on the electronic pages of the Ministries of Agriculture and Livestock, Environment and Energy, and Health.\n\n(Note from Sinalevi: Due to the length of its content, the Public Policy for Agricultural-Use Pesticides 2024-2034 can be consulted at the following Link)\n\nArticle 2.- Scope of application.\n\nAll public institutions that make up the Agricultural Sector, Environment, and Health, and those that due to their work develop programs, projects, or actions corresponding to the needs set forth in said Public Policy, shall be responsible for the application of the \"Public Policy for Agricultural-Use Pesticides 2024-2034.\"\n\nArticle 3.- Competence.\n\nFor the purpose of executing the \"Public Policy for Agricultural-Use Pesticides 2024-2034,\" it is particularly the responsibility of:\n\na) The State as a whole, to define enabling institutional frameworks and take responsibility for its actions.\n\nb) The Ministry of Agriculture and Livestock, the Ministry of Environment and Energy, and the Ministry of Health, to direct their actions toward a common purpose in a coordinated manner that serves as a guiding framework for the registration, use, and control of agricultural-use pesticides.\n\nc) Civil society in general and the identified strategic actors, to participate, deliberate, and commit to the decisions adopted.\n\nArticle 4.- Objective.\n\nThe general objective of the \"Public Policy for Agricultural-Use Pesticides 2024-2034\" is to reduce the impacts on agriculture, the environment, and public health through integral management of the registration, use, and control of agricultural pesticides in Costa Rica, fostering sustainable productivity, protection of public health, conservation of the environment, biodiversity, and adaptation to climate change.\n\nArticle 5.- Strategic Axes.\n\nThe \"Public Policy for Agricultural-Use Pesticides 2024-2034\" defines three strategic axes, which are:\n\nAxis 1: Inter-institutional Regulatory Framework\n\nAxis 2: Safety and Sustainability in the management of agricultural-use pesticides\n\nAxis 3: Digital transformation and traceability (trazabilidad) of agricultural-use pesticides.\n\nArticle 6.- Guidelines for the action plan.\n\nThe \"Public Policy for Agricultural-Use Pesticides 2024-2034\" shall be operationalized through two Action Plans. The first is incorporated as a section in the Public Policy and covers the period from the year 2024 to the year 2028 inclusive. The second Action Plan shall cover the period from the year 2029 to the year 2034, which must be prepared by the Inter-institutional Technical Board (Mesa Técnica Interinstitucional) established in the Management Model Section of the Public Policy, and officialized before the year 2029.\n\nArticle 7.- Responsibilities of the heads of public institutions. It is the responsibility of the heads of the Ministries of Agriculture and Livestock, Environment and Energy, and Health, according to their nature and scope of competence, to issue instructions to the corresponding parties so that the institution under their charge guarantees the execution of the actions that the current regulations stipulate for the implementation and fulfillment of the \"Public Policy for Agricultural-Use Pesticides 2024-2034\" and its Action Plan, among these:\n\n1. Ensure that the process of managing public policies and the Sectoral Plans that concern them, their internal policies, plans, programs, projects, and services include the guiding approaches and principles established in the Public Policy.\n\n2. Formulate, in accordance with the axes of the \"Public Policy for Agricultural-Use Pesticides 2024-2034,\" strategic actions that must be annualized in the operational and budgetary plans, in such a way as to guarantee the provision of the necessary type of resources, clearly identifiable, as well as specific actions and those responsible for their fulfillment.\n\n3. Create the Inter-institutional Technical Board established in the Management Model Section of the Public Policy and designate the representatives of each Ministry, as well as establish the functions that it will perform.\n\nArticle 8.- Term and compliance.\n\nThe \"Public Policy for Agricultural-Use Pesticides 2024-2034\" has a term of ten years from the entry into force of this decree and shall be of mandatory compliance for the public institutions that make up the Agricultural Sector, Environment, and Health, and those that due to their work develop programs, projects, or actions corresponding to the needs set forth in said Public Policy.\n\nIt is the responsibility of the Institutional Planning Offices of the Ministries of Agriculture and Livestock, Environment and Energy, and Health to evaluate the execution of the Public Policy in coordination with the Ministry of National Planning and Economic Policy.\n\nArticle 9.- Inter-institutional coordination and use of public resources.\n\nWithout prejudice to the legal competencies they possess, the institutions obligated to implement the \"Public Policy for Agricultural-Use Pesticides 2024-2034\" must apply intra-institutional and inter-institutional coordination and employ actions that ensure efficiency and effectiveness and the achievement of the goals and objectives set forth in the Policy, promoting the best use and austerity of public resources.\n\nArticle 10.- Effective date.\n\nIt shall take effect the day after its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic.
