Que de\nconformidad con lo que establece el artículo 1° del Decreto Ejecutivo N°\n30106-J donde se \"Declara Zona Catastral la Totalidad de los Cantones del\nterritorio Nacional\" publicado en La Gaceta N° 19 de 28 de enero de 2002 y\nel artículo 7 del Reglamento a la Ley del Catastro Nacional, Decreto Ejecutivo\nN° 34331, el cual rige desde el 27 de setiembre de 2008, la totalidad de los\ncantones del territorio nacional fueron declarados zona catastral.\n\nVII.-Que el\nReglamento a la Ley de Catastro Nacional, Decreto Ejecutivo N° 34331 el cual\nrige desde el 27 de setiembre de 2008, establece los requisitos técnicos para\nel levantamiento de planos de agrimensura.\n\nVIII.-Que toda\npersona tiene derecho al respecto de sus derechos fundamentales, concretamente,\nal de la propiedad privada y a la defensa de la misma, a un Hábitat de calidad,\npor lo cual es necesario visualizar la importancia, la confianza y\nposicionamiento del proyecto, promoviendo y fortaleciendo el impacto en la\ninstitucionalidad, la sociedad civil organizada, la comunidad y motivándoles a\nparticipar en las acciones para completar el mapa catastral de Costa Rica, ya\nque será un insumo primordial para el ordenamiento territorial, los proyectos\nmunicipales, la integración de bases de datos, entre otros.\n\nIX.-Que\nmediante lo indicado en los artículos 267, 449, 459 y 460 del Código Civil, Ley\nN° 5695 Ley de Creación del registro Nacional, ley 6545 Ley del Catastro\nNacionales, se establece al Registro Nacional como órgano rector en materia\nregistral y catastral, adscrito al Ministerio e Justica y Paz, encargado de\nvelar por la seguridad jurídica de los bienes inmuebles inscritos y el Proyecto\nde Levantamiento Catastral es una representación gráfica que muestra la\nubicación, identidad y linderos oficiales de los inmuebles.\n\nX.-Que de conformidad con el Reglamento a la Ley de Protección\nal Ciudadano del Exceso de requisitos y Trámites Administrativos, Decreto\nEjecutivo N° 37045-MP-MEIC y sus reformas, se determinó que la presente\npropuesta no establece ni modifica trámites, requisitos o procedimientos, que\nel administrado deba cumplir, situación por la que no se procedió con el\ntrámite de control previo.\n\nPOR TANTO,\n\nDECRETAN.\n\n\"DECLARA\nDE INTRÉS PÚBLICO LA EJECUCIÓN DEL PROYECTO DE\n\nLEVANTAMIENTO\nCATASTRAL DEL REGISTRO NACIONAL\"\n\nArtículo 1.\nDeclaratoria. That in\naccordance with the provisions of article 1 of Executive Decree No.\n30106-J which \"Declares the Entirety of the Cantons of the National Territory a Cadastral Zone\" published in La Gaceta No. 19 of January 28, 2002, and\narticle 7 of the Regulations to the National Cadastre Law, Executive Decree\nNo. 34331, which has been in effect since September 27, 2008, the entirety of the\ncantons of the national territory were declared a cadastral zone.\n\nVII.—That the\nRegulations to the National Cadastre Law, Executive Decree No. 34331, which\nhas been in effect since September 27, 2008, establishes the technical requirements for\nthe surveying of land surveying plans.\n\nVIII.—That every\nperson has the right to respect for their fundamental rights, specifically,\nthat of private property and its defense, to a quality habitat,\nfor which reason it is necessary to visualize the importance, trust, and\npositioning of the project, promoting and strengthening its impact on\ninstitutions, organized civil society, the community, and motivating them to\nparticipate in actions to complete the cadastral map of Costa Rica, since it\nwill be a primary input for land-use planning, municipal\nprojects, the integration of databases, among others.\n\nIX.—That\nby means of what is indicated in articles 267, 449, 459, and 460 of the Civil Code, Law\nNo. 5695 Law Creating the National Registry, Law 6545 National Cadastre Law,\nthe National Registry is established as the governing body in registry\nand cadastral matters, attached to the Ministry of Justice and Peace, responsible for\nensuring the legal certainty of registered real estate, and the Cadastral\nSurvey Project is a graphic representation that shows the\nofficial location, identity, and boundaries of real properties.\n\nX.—That in accordance with the Regulations to the Law for the Protection of Citizens from Excess Administrative Requirements and Procedures,\nExecutive Decree No. 37045-MP-MEIC and its amendments, it was determined that this\nproposal does not establish or modify procedures, requirements, or formalities\nthat the administered party must comply with, a situation for which the\nprior review procedure was not carried out.\n\nTHEREFORE,\n\nTHEY DECREE.\n\n\"DECLARES\nOF PUBLIC INTEREST THE EXECUTION OF THE CADASTRAL\n\nSURVEY\nPROJECT OF THE NATIONAL REGISTRY\"\n\nArticle 1.\nDeclaration.
