Asimismo, artículos 13, 14, 15, 20, 21 de la Ley de\nCatastro Nacional N° 6545 de 25 de marzo de 1981, artículos 7° y 26 de\nReglamento a la Ley de Catastro Nacional, Decreto Ejecutivo N° 34331 de 29 de\nnoviembre de 2007 (reformado por Decreto Ejecutivo N° 34763 de 16 de setiembre\nde 2008), Ley N° 8154 de 27 de noviembre de 2001, \"Convenio de Préstamo N°\n1284/OC-CR, Programa de Regularización Catastro y Registro\", Decreto Ejecutivo\nN° 30106-J, de 6 de diciembre de 2001, \"Declara Zona Catastral la Totalidad de\nlos Cantones del Territorio Nacional\" y Decreto Ejecutivo N° 35509-J de 30 de\nsetiembre de 2009, N° 198 del 13 de octubre del 2009 \"Reglamento de\nOrganización del Registro Inmobiliario\".\n\nConsiderando:\n\nl.-Que mediante Ley N° 8710, publicada en La\nGaceta N° 48 del 10 de marzo de 2009, se reforma el artículo 2° de la Ley\nN° 5695, Ley de Creación del Registro Nacional, publicada en el Diario Oficial La\nGaceta N° 106 del 07 de junio de 1975 y sus reformas, indicando que el\nCatastro Nacional pasa a formar parte del Registro Inmobiliario.\n\nll.-Que\nel Decreto Ejecutivo N° 35509-J de 30 de setiembre de 2009, Reglamento de\nOrganización del Registro Inmobiliario, publicado en el Diario Oficial La\nGaceta N° 198 del 13 de octubre de 2009, establece que el Registro\nInmobiliario está conformado por la Subdirección Catastral y la Subdirección\nRegistral.\n\nIII.-Que el Registro Inmobiliario del\nRegistro Nacional, con fundamento en la Ley de Catastro Nacional N° 6545 de 25\nde marzo de 1981, publicada en el Diario Oficial La Gaceta N° 73 del 15\nde abril de 1981 en su artículo 13 tiene como potestad exclusiva, la ejecución\ny mantenimiento del Catastro, función que puede delegar parcialmente en otras\ninstituciones estatales.\n\nIV.-Que de conformidad con lo que establece\nel artículo 1° Decreto Ejecutivo N° 30106-J donde se \"Declara Zona Catastral la\nTotalidad de los Cantones del Territorio Nacional\", publicado en La Gaceta N°\n19 de 28 de enero de 2002, y el artículo 7° del Reglamento a la Ley del\nCatastro Nacional, Decreto Ejecutivo N° 34331, publicado en el Diario Oficial La\nGaceta N° 41 del 27 de febrero del 2008 el cual rige desde el 27 de\nsetiembre de 2008, la totalidad de los cantones del territorio nacional fueron\ndeclarados zona catastral.\n\nV.-Que por haber concluido los trabajos de\nlevantamiento catastral del cantón 08 Goicoechea, distrito 03 Calle Blancos,\nprovincia 01 San José, y de conformidad con lo que establece el artículo 19 de\nla Ley de Catastro Nacional y 10 de su reglamento, fueron invitados los titulares\nde inmuebles de dicho distrito a una exposición pública para conocer los\nresultados del levantamiento y manifestar su conformidad o disconformidad\nmediante publicación en el Diario Oficial La Gaceta N° 199 de 27 de\noctubre del 2023, página 73 y en los diarios de circulación nacional La Nación\ndel 30 de octubre del 2023, página 18 y La Teja del 28 de octubre del 2023,\npágina 9, exposición que se llevó a cabo del 30 de octubre al 06 de noviembre\ndel 2023.\n\nVI.-Que en resolución de las diez horas\ndel once de setiembre del año dos mil veinticuatro, el Registro Inmobiliario\ndel Registro Nacional declaró firmes los datos catastrales resultantes del\nlevantamiento catastral efectuado en el cantón 08 Goicoechea, distrito 03 Calle\nBlancos, provincia 01 San José.\n\nVII.-Que ya transcurrieron los términos de\nlos plazos establecidos en el artículo 20 de la Ley del Catastro Nacional y\nfueron resueltos, por la Dirección del Registro Inmobiliario del Registro\nNacional, los reclamos presentados por los propietarios. Likewise, articles 13, 14, 15, 20, 21 of the Law of\nNational Cadastre (Catastro Nacional) No. 6545 of March 25, 1981, articles 7 and 26 of the\nRegulation to the Law of National Cadastre, Executive Decree No. 34331 of November\n29, 2007 (reformed by Executive Decree No. 34763 of September 16, 2008), Law No. 8154\nof November 27, 2001, \"Loan Agreement No.\n1284/OC-CR, Cadastre and Registry Regularization Program\", Executive Decree\nNo. 30106-J, of December 6, 2001, \"Declares the Entirety of\nthe Cantons of the National Territory a Cadastral Zone (Zona Catastral)\" and Executive Decree No. 35509-J of\nSeptember 30, 2009, No. 198 of October 13, 2009 \"Regulation of\nOrganization of the Real Property Registry (Registro Inmobiliario)\".\n\nConsidering (Considerando):\n\nI.-That through Law No. 8710, published in La\nGaceta No. 48 of March 10, 2009, article 2 of Law\nNo. 5695, Law for the Creation of the National Registry, published in the Official Gazette La\nGaceta No. 106 of June 7, 1975 and its reforms, is reformed, indicating that the\nNational Cadastre becomes part of the Real Property Registry.\n\nII.-That\nExecutive Decree No. 35509-J of September 30, 2009, Regulation of\nOrganization of the Real Property Registry, published in the Official Gazette La\nGaceta No. 198 of October 13, 2009, establishes that the Real Property\nRegistry is composed of the Cadastral Sub-directorate (Subdirección Catastral) and the Registry\nSub-directorate (Subdirección Registral).\n\nIII.-That the Real Property Registry of the\nNational Registry, based on the Law of National Cadastre No. 6545 of\nMarch 25, 1981, published in the Official Gazette La Gaceta No. 73 of April\n15, 1981 in its article 13 has as its exclusive power, the execution\nand maintenance of the Cadastre, a function that may be partially delegated to other\nstate institutions.\n\nIV.-That in accordance with the provisions of\narticle 1 of Executive Decree No. 30106-J, which \"Declares the Entirety of\nthe Cantons of the National Territory a Cadastral Zone\", published in La Gaceta No.\n19 of January 28, 2002, and article 7 of the Regulation to the Law of\nthe National Cadastre, Executive Decree No. 34331, published in the Official Gazette La\nGaceta No. 41 of February 27, 2008, which has been in effect since September\n27, 2008, the entirety of the cantons of the national territory were\ndeclared a cadastral zone.\n\nV.-That the cadastral survey (levantamiento catastral) works having concluded for canton 08 Goicoechea, district 03 Calle Blancos,\nprovince 01 San José, and in accordance with the provisions of article 19 of\nthe Law of National Cadastre and article 10 of its regulation, the holders\nof real estate in said district were invited to a public exhibition to learn\nthe results of the survey (levantamiento) and express their agreement or disagreement\nthrough publication in the Official Gazette La Gaceta No. 199 of October\n27, 2023, page 73 and in the national circulation newspapers La Nación\nof October 30, 2023, page 18 and La Teja of October 28, 2023,\npage 9, an exhibition that took place from October 30 to November 06,\n2023.\n\nVI.-That in a resolution issued at ten o'clock\non September eleventh, two thousand twenty-four, the Real Property Registry\nof the National Registry declared firm the cadastral data resulting from the\ncadastral survey (levantamiento catastral) carried out in canton 08 Goicoechea, district 03 Calle\nBlancos, province 01 San José.\n\nVII.-That the terms of the deadlines established in article 20 of the Law of the National Cadastre have now elapsed, and\nthe claims presented by the owners were resolved by the Directorate of the Real Property Registry of the National\nRegistry.
