Asimismo, artículos 13, 14, 15, 20, 21 de la Ley de Catastro\nNacional N° 6545 de 25 de marzo de 1981, artículos 7 y 26 de Reglamento a la\nLey de Catastro Nacional, Decreto Ejecutivo N° 34331 de 29 de noviembre de 2007\n(reformado por Decreto Ejecutivo N° 34763 de 16 de setiembre de 2008), Ley N°\n8154 de 27 de noviembre de 2001, \"Convenio de Préstamo N° 1284/0C-CR, Programa\nde Regularización Catastro y Registro\", Decreto Ejecutivo N° 30106-J, de 6 de\ndiciembre de 2001, \"Declara Zona Catastral la Totalidad de los Cantones del\nTerritorio Nacional\" y Decreto Ejecutivo N° 35509-J de 30 de setiembre de 2009,\nNo. 198 del 13 de octubre del 2009 \"Reglamento de Organización del Registro\nInmobiliario\".\n\nConsiderando:\n\nl.-Que mediante Ley N° 8710, publicada en La\nGaceta N° 48 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley N°\n5695, Ley de Creación del Registro Nacional, publicada en el Diario Oficial La\nGaceta No. 106 del 07 de junio de 1975 y sus reformas, indicando que el\nCatastro Nacional pasa a formar parte del Registro Inmobiliario.\n\nll.-Que el Decreto Ejecutivo N° 35509-J de\n30 de setiembre de 2009, Reglamento de Organización del Registro Inmobiliario\npublicado en el Diario Oficial La Gaceta N° 198 del 13 de octubre de\n2009, establece que el Registro Inmobiliario está conformado por la\nSubdirección Catastral y la Subdirección Registral.\n\nIII.-Que el Registro Inmobiliario del\nRegistro Nacional, con fundamento en la Ley de Catastro Nacional N° 6545 de 25\nde marzo de 1981, publicada en el Diario Oficial La Gaceta No. 73 del 15\nde abril de 1981 en su artículo 13 tiene como potestad exclusiva, la ejecución\ny mantenimiento del Catastro, función que puede delegar parcialmente en otras\ninstituciones estatales.\n\nIV.-Que de conformidad con lo que\nestablece el artículo 1° Decreto Ejecutivo N° 30106-J donde se \"Declara Zona\nCatastral la Totalidad de los Cantones del Territorio Nacional\" publicado en La\nGaceta N° 19 de 28 de enero de 2002 y el artículo 7 del Reglamento a la Ley\ndel Catastro Nacional, Decreto Ejecutivo N° 34331, publicado en el Diario\nOficial La Gaceta N° 41 del 27 de febrero del 2008 el cual rige desde el\n27 de setiembre de 2008, la totalidad de los cantones del territorio nacional\nfueron declarados zona catastral.\n\nV.-Que por haber concluido los trabajos de\nlevantamiento catastral del Cantón 07 Oreamuno, distrito 05 Santa Rosa,\nprovincia 03 Cartago, y de conformidad con lo que establece el artículo 19 de\nla Ley de Catastro Nacional y 10 de su reglamento, fueron invitados los\ntitulares de inmuebles de dicho distrito a una exposición pública para conocer\nlos resultados del levantamiento y manifestar su conformidad o disconformidad\nmediante publicación en el Diario Oficial La Gaceta N° 217 de 22 de\nnoviembre del 2023, página 59 y en los diarios de circulación nacional La\nNación del 27 de noviembre del 2023, página 18 y La Teja del 25 de noviembre\ndel 2023, página 6, exposición que se llevó a cabo del 29 de noviembre al 06 de\ndiciembre del 2023.\n\nVI.-Que en resolución de las nueve horas\ncuarenta y cinco minutos del once de setiembre del año dos mil veinticuatro, el\nRegistro Inmobiliario del Registro Nacional declaró firmes los\ndatos catastrales resultantes del levantamiento catastral efectuado en el\ncantón 07 Oreamuno, distrito 05 Santa Rosa, provincia 03 Cartago.\n\nVII.-Que ya transcurrieron los términos de\nlos plazos establecidos en el artículo 20 de la Ley del Catastro Nacional y\nfueron resueltos, por la Dirección del Registro Inmobiliario del Registro\nNacional, los reclamos presentados por los propietarios. Likewise, articles 13, 14, 15, 20, 21 of the National Cadastre Law\nNo. 6545 of March 25, 1981, articles 7 and 26 of the Regulation to the\nNational Cadastre Law, Executive Decree No. 34331 of November 29, 2007\n(amended by Executive Decree No. 34763 of September 16, 2008), Law No.\n8154 of November 27, 2001, \"Loan Agreement No. 1284/0C-CR, Program\nfor Cadastre and Registry Regularization\", Executive Decree No. 30106-J, of December 6,\n2001, \"Declares the Entirety of the Cantons of the\nNational Territory a Cadastral Zone\" and Executive Decree No. 35509-J of September 30, 2009,\nNo. 198 of October 13, 2009 \"Organization Regulation of the Real Estate\nRegistry\".\n\nConsidering:\n\nI.-That through Law No. 8710, published in La\nGaceta No. 48 of March 10, 2009, article 2 of Law No.\n5695, Law Creating the National Registry, published in the Official Gazette La\nGaceta No. 106 of June 7, 1975 and its amendments, is reformed, indicating that the\nNational Cadastre becomes part of the Real Estate Registry.\n\nII.-That Executive Decree No. 35509-J of\nSeptember 30, 2009, Organization Regulation of the Real Estate Registry\npublished in the Official Gazette La Gaceta No. 198 of October 13,\n2009, establishes that the Real Estate Registry is composed of the\nCadastral Subdirectorate and the Registry Subdirectorate.\n\nIII.-That the Real Estate Registry of the\nNational Registry, based on the National Cadastre Law No. 6545 of\nMarch 25, 1981, published in the Official Gazette La Gaceta No. 73 of April\n15, 1981 in its article 13 has as its exclusive power, the execution\nand maintenance of the Cadastre, a function that it may partially delegate to other\nstate institutions.\n\nIV.-That in accordance with what is\nestablished in article 1 of Executive Decree No. 30106-J where the \"Entirety of the\nCantons of the National Territory is Declared a Cadastral Zone\" published in La\nGaceta No. 19 of January 28, 2002 and article 7 of the Regulation to the\nNational Cadastre Law, Executive Decree No. 34331, published in the Official\nGazette La Gaceta No. 41 of February 27, 2008 which is in effect since\nSeptember 27, 2008, the entirety of the cantons of the national territory\nwere declared a cadastral zone.\n\nV.-That because the cadastral survey (levantamiento catastral) work for Canton 07 Oreamuno, district 05 Santa Rosa,\nprovince 03 Cartago, has concluded, and in accordance with what is established in article 19 of\nthe National Cadastre Law and 10 of its regulation, the\nproperty owners of said district were invited to a public exhibition to know\nthe survey results and express their agreement or disagreement\nby publication in the Official Gazette La Gaceta No. 217 of November\n22, 2023, page 59 and in the nationally circulated newspapers La\nNación of November 27, 2023, page 18 and La Teja of November 25,\n2023, page 6, an exhibition that took place from November 29 to December 6,\n2023.\n\nVI.-That in a resolution issued at nine forty-five hours\non September eleven of the year two thousand twenty-four, the\nReal Estate Registry of the National Registry declared the cadastral data resulting from the cadastral survey conducted in\ncanton 07 Oreamuno, district 05 Santa Rosa, province 03 Cartago to be final.\n\nVII.-That the terms of the deadlines\nestablished in article 20 of the National Cadastre Law have now elapsed and\nthe claims presented by the owners were resolved by the Directorate of the Real Estate Registry of the National\nRegistry.
