  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 44851\n\n                        Deroga Declaratoria de utilidad pública para los intereses del Estado la\nAsociación Administradora del acueducto y alcantarillado sanitario de Matapalo Santa Cruz,\nGuanacaste\n\nN°\n44851-MJP\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE JUSTICIA Y PAZ\n\nCon fundamento en lo dispuesto en los\nartículos 140, inciso 18) y 146 de la Constitución Política, en los artículos\n25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de\nAdministración Pública N° 6227 del 1° de diciembre de 1978, en el artículo 32\nde la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y los artículos 27 y\nsiguientes del Reglamento a la Ley de Asociaciones N° 29496-J, publicado en La\nGaceta N° 96 del 21 de mayo del 2001.\n\nConsiderando:\n\nI.-Que el artículo 32 de la Ley de\nAsociaciones N° 218 del 8 de agosto de 1939 y sus reformas, confiere al Poder\nEjecutivo la potestad de declarar de utilidad pública a las asociaciones\nsimples, federadas o confederadas, cuyo desarrollo y actividades sean\nparticularmente útiles para los intereses del Estado, y que por ello\ncontribuyan a solventar una necesidad social.\n\nII.-Que la Asociación Administradora del\nAcueducto y Alcantarillado Sanitario de Matapalo Santa Cruz Guanacaste, cédula\njurídica número tres-cero cero dos-trescientos cuarenta y nueve mil trescientos\nveinticinco, se inscribió en el Registro de Asociaciones del Registro Público\nel seis de setiembre del dos mil, al tomo quinientos diez, asiento catorce mil\ntrescientos cincuenta y dos.\n\nIII.-Que el artículo 32 de la Ley de Asociaciones\nestablece: \". En cualquier momento, el Ministerio de Justicia y Paz,\nrevocará este beneficio, si desaparecen los motivos por los cuales fue\nconcedido. (...)\". Asimismo, el ordinal 33 bis del Reglamento a la Ley de\nAsociaciones, agrega: \"(...) La declaratoria será revocable en cualquier\nmomento, mediante resolución razonada...\n\nIV.-Que la Asociación Administradora del\nAcueducto y Alcantarillado Sanitario de Matapalo Santa Cruz Guanacaste, por\nmedio de su representante legal el señor Efraín Milanés Obando Álvarez,\nportador de la cédula de identidad cinco-cero ciento cincuenta y cuatro-cero\ncuatrocientos sesenta y cuatro, manifestaron su deseo de renunciar al beneficio\nde la declaratoria de utilidad pública.
