  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 44852\n\n                        Deroga Declara de utilidad pública para los intereses del Estado la\nAsociación Administradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón\n\nN°44852-MJP\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nEl MINISTRO DE JUSTICIA Y PAZ\n\nCon fundamento en lo dispuesto en los\nartículos 140, inciso 18) y 146 de la Constitución Política, en los artículos\n25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de\nAdministración Pública N° 6227 del 1O de diciembre de 1978, en el artículo 32\nde la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y los artículos 27 y\nsiguientes del Reglamento a la Ley de Asociaciones N° 29496-J, publicado en La\nGaceta N° 96 del 21 de mayo del 2001.\n\nConsiderando:\n\nI.-El artículo 32 de la Ley de Asociaciones\nN°218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la\npotestad de declarar de utilidad pública a las asociaciones simples, federadas\no confederadas, cuyo desarrollo y actividades sean particularmente útiles para\nlos intereses del Estado, y que por ello contribuyan a solventar una necesidad\nsocial.\n\nII.-Que la Asociación Administradora del\nAcueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón, cédula\njurídica número tres- cero cero dos- seiscientos setenta y ocho mil ciento\ncuarenta y nueve, se inscribió en el Registro de Asociaciones del Registro\nPúblico el veintiséis de diciembre del dos mil doce, al tomo dos mil trece,\nasiento ciento setenta y ocho mil cuatrocientos veinticuatro.\n\nIII.-Que el artículo 32 de la Ley de\nAsociaciones establece: \"... En cualquier momento, el Ministerio de Justicia\ny Paz, revocará este beneficio, si desaparecen los motivos por los cuales fue\nconcedido. (...) \" . Asimismo, el ordinal 33 bis del Reglamento a la Ley de\nAsociaciones, agrega: \"(...) La declaratoria será revocable en cualquier\nmomento, mediante resolución razonada... \".\n\nIV.-Que la Asociación Administradora del\nAcueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón, por medio\nde su representante legal la señora Margarita Araya Campo, portadora de la\ncédula de identidad número tres-cero doscientos- mil doscientos veintidós,\nincumplieron en la presentación de los informes anuales correspondientes a los\nperíodos 2022 y 2023, por lo que, manifestaron su deseo de renunciar al\nbeneficio de la declaratoria de utilidad pública.   "body_en_text": "throughout the entire text\n\n                    -\n\n                        Complete Text of Norm 44852\n\n                        Repeals the Declaration of public utility for the interests of the State of the\nAsociación Administradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón\n\nN°44852-MJP\n\nTHE PRESIDENT OF THE REPUBLIC\n\nTHE MINISTER OF JUSTICE AND PEACE\n\nBased on the provisions set forth in articles 140, subsection 18) and 146 of the Political Constitution, in articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph b) of the General Public Administration Law N° 6227 of December 1O, 1978, in article 32 of the Associations Law N° 218 of August 8, 1939 and articles 27 and following of the Regulation to the Associations Law N° 29496-J, published in La Gaceta N° 96 of May 21, 2001.\n\nConsidering:\n\nI.-Article 32 of the Associations Law N°218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility those simple, federated or confederated associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.\n\nII.-That the Asociación Administradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón, legal identification number three- zero zero two- six hundred seventy-eight thousand one hundred forty-nine, was registered in the Associations Registry of the Public Registry on December twenty-sixth, two thousand twelve, in volume two thousand thirteen, entry one hundred seventy-eight thousand four hundred twenty-four.\n\nIII.-That article 32 of the Associations Law establishes: \"... At any time, the Ministry of Justice and Peace shall revoke this benefit, if the reasons for which it was granted disappear. (...) \". Likewise, ordinal 33 bis of the Regulation to the Associations Law adds: \"(...) The declaration shall be revocable at any time, by means of a reasoned resolution... \".\n\nIV.-That the Asociación Administradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón, through its legal representative Mrs. Margarita Araya Campo, holder of identity card number three-zero two hundred- thousand two hundred twenty-two, failed to submit the annual reports corresponding to the periods 2022 and 2023, and therefore, expressed their desire to renounce the benefit of the declaration of public utility.
