Que la\nexistencia de la actividad bananera y de las empresas productoras nacionales,\nes materia de interés público, porque dicha actividad es de las más importantes\ndentro de la estructura productiva costarricense. al ser el banano el primer\nproducto de exportación agrícola y generar en los últimos años alrededor de USD\n1 220 millones en divisas y constituir una de las ramas productivas que más\nmano de obra utiliza por hectárea, generando en la actualidad empleo para más\nde 100 000 personas. de los cuales 42 200 son empleos directos, a los que se\npaga el más alto nivel de salarios agrícolas, además. de que se desarrolla en\nzonas del país que no han contado por muchos años con otro tipo de actividades\nproductivas que como la actividad bananera, coadyuven\nen forma tan determinante en su desarrollo.\n\n3. Que por\nLey No. 5515 se autoriza que parte de lo recaudado por el impuesto de exportación\nde banano sea destinado a los productores independientes de banano. quienes lo\nreciben a través de fondos que administra la Corporación Bananera Nacional,\nconforme a su objetivo legal de impulsar el desarrollo bananero nacional\nmediante la ejecución de planes de fomento bananero que implica no solo\naspectos relativos a la producción bananera sino también a la creación de\ninfraestructura. Así como la atención de asuntos sociales y ambientales con el\nfin de promover una agricultura sostenible.\n\n4. Que en\nconsecuencia la Corporación Bananera Nacional es el único ente público técnico\nespecializado en materia bananera, que tiene corno misión fundamental el\ndesarrollo bananero, nacional, lo cual implica que tiene la responsabilidad de\npotenciar la actividad bananera de una forma integral, considerando aspectos\neconómicos, productivos, sociales y ambientales, por lo que le corresponde\norientar al sector bananero al desarrollo de políticas de responsabilidad\nsocial corporativa.\n\n5. Que\nalrededor de las plantaciones bananeras se concentran importantes centros de\npoblación (estimada en 347 700 personas, que representa el 80% de la población\ntotal de la provincia), cuya actividad laboral y económica y su desarrollo\nhumano, familiar y comunitario está ligado a las unidades productivas, por lo\nque resulta de interés nacional mantener la actividad bananera, dado los\nempleos formales que general y las divisas que ingresan al país.\n\n6. Que\nmediante Decreto Ejecutivo Nº 42037-MAG-H \"Creación del Fondo de\nprevención, exclusión y combate contra el fusarium oxysporum\nf.sp cubense\nraza 4 tropical y de otras plagas y enfermedades que afecten el cultivo de\nbanano y derogatoria del fondo de contingencias bananeras\" se destinaron\nrecursos para dos propósitos:\n\na) Para\nacciones de prevención, exclusión y combate del Fusarium oxysporum\nf sp cubense raza 4\ntropical, hongo causante de la marchitez de las plantas de banano que está\nprovocando abandono de plantaciones con grandes pérdidas económicas y sociales\nen otros países de Latinoamérica. Los recursos de este fondo se destinaron al\nobjetivo de apoyar al Estado en las acciones de prevención en puertos,\naeropuertos, fronteras, carreteras nacionales, compra de materiales para la\nprevención y eventual contención de la enfermedad, entrenamiento o capacitación\nde funcionarios, además de apoyar la realización de actividades nacionales e\ninternacionales de coordinación o capacitación para realizar acciones en\nconjunto con otros gobiernos o con organismos internacionales. De igual forma,\nlos recursos se destinaron para apoyar las investigaciones estratégicas para\nprevención, exclusión y combate del Fusarium, oxysporum\nf sp cubense raza 4\ntropical.\n\nb)\nSolicitar los créditos reembolsables ante las entidades financieras públicas y\nprivadas, debidamente autorizadas por la normativa vigente, con el propósito de\nfinanciar proyectos productivos agropecuarios, pesqueros y de desarrollo rural.\nDichos créditos estarán destinados a fortalecer la seguridad alimentaria,\nfomentar la producción sostenible y mejorar la competitividad del sector\nagropecuario, en concordancia con los lineamientos establecidos en el Decreto\nEjecutivo 42037-MAG-H.\n\n7. Que en\nla coyuntura actual resulta prioritario redoblar acciones para la prevención y\nexclusión de la enfermedad en los puestos fronterizos y muelles de ingreso de\nmercaderías, y utilizar la totalidad de estos recursos para apoyo al Estado,\nparticularmente al Servicio Nacional de Salud Animal y al Servicio\nFitosanitario del Estado, órganos del Ministerio de Agricultura y Ganadería, en\ntodo el esquema de prevención, exclusión y combate de ingreso del patógeno al\nterritorio nacional que amenaza la producción y desarrollo de la actividad y el\npaís. Siendo que este fondo se constituyó y se dividió según dos objetivos, se\nhace necesario unificarlo.\n\n8. That the\nbanana activity is carried out in the Caribbean zone of the country, mostly in the\nProvince of Limón, where the greatest number of production units are established\nand where the largest volume of fruit is produced.\n\n2. That the\nexistence of the banana activity and of the national producing companies\nis a matter of public interest, because said activity is one of the most important\nwithin the Costa Rican productive structure, as banana is the primary\nagricultural export product and has generated, in recent years, around USD\n1.22 billion in foreign currency, and constitutes one of the productive branches that\nuses the most labor per hectare, currently generating employment for more\nthan 100,000 people, of which 42,200 are direct jobs, which pay the highest level of agricultural wages, and, furthermore, it is developed in\nareas of the country that for many years have not had other types of productive\nactivities that, like the banana activity, contribute\nin such a decisive way to their development.\n\n3. That by\nLaw No. 5515, it is authorized that part of what is collected from the banana export\ntax be destined for independent banana producers, who receive\nit through funds administered by the Corporación Bananera Nacional,\nin accordance with its legal objective of promoting national banana development\nthrough the execution of banana development plans that involve not only\naspects related to banana production but also the creation of\ninfrastructure, as well as addressing social and environmental matters with the\npurpose of promoting sustainable agriculture.\n\n4. That\nconsequently, the Corporación Bananera Nacional is the sole specialized technical public entity\nin banana matters, whose fundamental mission is national banana\ndevelopment, which implies that it has the responsibility of\nenhancing the banana activity in a comprehensive manner, considering\neconomic, productive, social, and environmental aspects, and therefore it is its responsibility\nto guide the banana sector in developing corporate social\nresponsibility policies.\n\n5. That\nimportant population centers are concentrated around the banana plantations (estimated at 347,700 people, representing 80% of the total\npopulation of the province), whose work and economic activity and their human, family,\nand community development are linked to the production units, which is why\nmaintaining the banana activity is of national interest, given\nthe formal jobs it generates and the foreign currency entering the country.\n\n6. The resources of this fund were allocated to the\nobjective of supporting the State in prevention actions at ports,\nairports, borders, national highways, the purchase of materials for\nprevention and eventual containment of the disease, training or instruction\nof officials, in addition to supporting the carrying out of national and international\ncoordination or training activities to carry out actions\njointly with other governments or international organizations. Likewise,\nthe resources were allocated to support strategic investigations for the\nprevention, exclusion, and combat of Fusarium oxysporum\nf sp cubense tropical race\n4.\n\nb)\nTo request reimbursable loans from public and private financial entities,\nduly authorized by current regulations, with the purpose of\nfinancing agricultural, livestock, fisheries, and rural development productive projects.\nSaid loans shall be destined to strengthen food security,\npromote sustainable production, and improve the competitiveness of the\nagricultural sector, in accordance with the guidelines established in Executive\nDecree 42037-MAG-H.\n\n7. That in\nthe current situation, it is a priority to redouble actions for the prevention and\nexclusion of the disease at border posts and merchandise entry docks,\nand to use all of these resources to support the State,\nparticularly the Servicio Nacional de Salud Animal and the Servicio\nFitosanitario del Estado, organs of the Ministry of Agriculture and Livestock, in\nthe entire scheme of prevention, exclusion, and combat of the pathogen's entry into\nthe national territory that threatens the production and development of the activity and the\ncountry. This fund shall have the objective of supporting the State in the\nconstruction of infrastructure, its maintenance, the purchase of materials,\nequipment, and supplies, and the training or instruction of officials; at ports,\nairports, borders, and national highways, for the prevention and eventual\ncontainment of Fusarium oxysporum f.sp.\ncubense tropical race 4.\n\nThe resources of this fund may also\nbe used to support the undertaking of national and international\ncoordination or training activities for the purpose of carrying out coordinated actions with other governments or with international\norganizations.\n\nLikewise,\nresources may be used to support strategic investigations for\nthe prevention, exclusion, and combat of Fusarium oxysporum\nf.sp. cubense tropical race\n4.\n\nIn the event\nthat Fusarium oxysporum f.sp.\ncubense tropical race 4 reaches national territory,\nthe fund may be allocated to pest combat activities.\n\nCORBANA is also authorized\nto use part of these resources for attending to\nemergencies caused by other pests and diseases related to the\nbanana cultivation, according to the reasoned opinion of the Board of Directors of said\nentity.\n\nThe\nresources of this fund may be used to increase the diagnostic capacity of the laboratories of the SFE and CORBANA.\n\nThe Servicio\nFitosanitario del Estado, the Servicio Nacional de Salud Animal, or any\nState agency may request resources to fulfill the\nobjectives of this decree, for which purpose they shall direct a request to CORBANA, which\nincludes a technical study of the project and its costs, based on which\nCORBANA, taking into account the available resources, shall proceed when\nappropriate to its execution.\n\n100% of\nthe resources of this fund shall be used for the activities described in this\narticle, which CORBANA shall apply to needs that must be addressed to\nfulfill the objectives of this fund.\n\nArticle 2 - It shall become effective upon\nits publication.\n\nIssued at the Presidency of\nthe Republic.
