el artículo 63 del Decreto Ejecutivo N° 7841-P señala que \"El\nInstituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de\ncada porción de la zona marítimo-terrestre en que haya demarcado la zona\npública.\"\n\n4º-Que el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre del 28 de junio del 2011, establece según el artículo 18 que para\nla delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá\nacudir a dos metodologías de ejecución, que se indican en los artículos 19 y\n20, correspondientes a la delimitación de la zona pública de la Zona Marítimo\nTerrestre a través de la colocación de mojones y/o a la delimitación digital\ngeorreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar\nmayor seguridad técnica a los interesados.\n\n5º-Que el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum\nhorizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de\nReferencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la\nTierra (IERS) para la época de medición 2005.83 del 30 de marzo del 2007,\nel cual entre otros aspectos determina, a la Red Geodésica Nacional de\nReferencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como\nel sistema oficial al cual deben estar referidas las coordenadas de todos los\ntrabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro\npaís, señalando específicamente en artículo 11 que: La Red Geodésica\nNacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica\nCRTM05, constituirán el único sistema oficial de coordenadas para la República\nde Costa Rica a partir del cual se debe referenciar todos los levantamientos y\nactividades cartográficos y geodésicos que desarrollen en el Territorio Nacional\ntoda dependencia pública, persona o entidad privada nacional o extranjera.;\nmientras que el artículo 7 indica que Conforme se produzcan datos cartográficos\nen el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico\nNacional publicará por los medios adecuados aquella información que se ha\noficializado.\n\n6º-Que el Decreto Ejecutivo N° 40962-MJP Actualización\ndel Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara\nen su artículo 1 que El sistema geodésico de referencia horizontal oficial\npara Costa Rica, denominado como CR05 y su materialización mediante la Red\nGeodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco Internacional\nde Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y\nen adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas\ndefiniciones del ITRF que se implementen en la red continental del Sistema de\nReferencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON; además\nque el artículo 2 establece que El sistema de proyección cartográfica CRTM05\nseguirá siendo el oficial para la representación cartográfica del territorio\nnacional continental, extendido para efectos de aplicación de esta proyección\ncartográfica, hasta la línea de base del mar territorial en el océano Pacífico\ny el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la\nConvención de las Naciones Unidas sobre el Derecho del Mar, como punto de\npartida para el cómputo de la anchura máxima de todas las áreas marinas\njurisdiccionales del Estado costarricense.Pág 52\n\nPor su parte,\nel artículo 12 del decreto de cita, refuerza la aplicación de la proyección\ncartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual\nse deben referenciar en el territorio continental de nuestro país, al señalar\nque El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica\nasociada CRTM05 para el territorio continental extendido hasta la línea de base\ndel mar territorial y, la proyección cartográfica \"Universal Transversal\nde Mercator\" (UTM), zonas 16 y 17 para las áreas marinas e insulares\njurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único\nsistema oficial de coordenadas para la República de Costa Rica, a partir del\ncual, se deben referenciar todos los levantamientos y actividades cartográficos\ny geodésicos que desarrollen en el territorio nacional toda dependencia\npública, persona o entidad privada, nacional o extranjera, que emprendan o\ncontraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el\ngasto público y obteniendo, por otra parte, información geográfica confiable,\nuniforme y comparable, que sea de utilidad general y que apoye la toma de\ndecisiones en los distintos niveles del Estado.\n\n7º-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8º-Que la información digital georreferenciada sobre delimitación de la\nzona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le\ndenomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico\nNacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).\n\n9º-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el Decreto\nEjecutivo N° 7841-P Reglamento a la Ley N° 6043 sobre la Zona Marítimo\nTerrestre; b) el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum\nhorizontal oficial para Costa Rica, el CR05, y su proyección cartográfica\nasociada, CRTM05; c) el Decreto Ejecutivo N.°36642-MP-MOPT-MINAET Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre; y d) el Decreto Ejecutivo N.º40962- MJP Actualización del Sistema\nGeodésico de Referencia Horizontal Oficial para Costa Rica.\n\n10.-Que el artículo 16 de la Ley N° 7575, Ley Forestal del 13 de\nfebrero de 1996 y sus reformas, establece que el Ministerio del Ambiente y\nEnergía (MINAE) delimitará en el terreno los linderos de las áreas que\nconforman el Patrimonio Natural del Estado.\n\n11.-Que el artículo 11 del Capítulo I, Disposiciones Generales de la Ley N°\n6043, establece que la Zona pública es también, sea cual fuere su extensión,\nla ocupada por todos los manglares de los litorales continentales e insulares y\nesteros del territorio nacional.\n\n12.-Que el Decreto Ejecutivo N° 36786-MINAET Manual para la\nclasificación de tierras dedicadas a la conservación de los recursos naturales\ndentro de la Zona Marítimo Terrestre en Costa Rica publicado en La\nGaceta Nº 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar\ndentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como\nbosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares,\nesteros, rías, marismas, lagunas costeras, pantanos, bosques anegados,\nsalitrales), para certificarlos e incorporarlos como parte del Patrimonio\nNatural del Estado (PNE).\n\n13.-Que el Decreto Ejecutivo N° 36786-MINAET en el punto III.-Competencias\npara la delimitación y certificación establece que La clasificación de\nlos terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC)\ndel Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales\nprivados debidamente acreditados por los Colegios Profesionales respectivos\npara que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase\nVII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos,\nbosques anegados, salitrales) y humedales.\n\nLa validez de los documentos de clasificación emitidos por profesionales\nprivados quedará sujeta a la aprobación que emita el AC que por competencia\nterritorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les\ncompeterá, además, la verificación, fiscalización, deslinde y certificación de\nlas tierras del Patrimonio Natural del Estado y las zonas de protección.\n\nLa ubicación y delimitación de las áreas del Patrimonio Natural del Estado\ndentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de\naprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que\nel Plan Regulador Costero es el instrumento de ordenamiento territorial, que\ndefine y ubica todas las zonas a concesionar dentro de la ZMT y para la\nclasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan\nRegulador Costero debe indicar clara y expresamente, las áreas del PNE para no\ncontabilizarlas en el área total a concesionar.\n\n14.-Que el IGN utilizó la metodología de Delimitación Digital\nGeorreferenciada, para delimitar la zona pública de la Zona Marítima Terrestre\nen un sector de manglar situado en Playa Papaturro, en el distrito 01º La Cruz,\ncantón 01º La Cruz, provincia 05º Guanacaste.\n\n15.-Que la Sra. Estefanía Barquero Alvarado, mayor de edad, con cédula\nnúmero 4-0219-0051, Apoderada Especial de la empresa 3-102-778851 S.R.L.,\ncédula jurídica N° 3-102- 778851, solicitó en fecha 02 de enero del 2025\nmediante correo electrónico remitido a la Secretaría del IGN, ejecutar la\ndelimitación de un sector de manglar situado en Playa Papaturro, en el distrito\n01º La Cruz, cantón 01º La Cruz, provincia 05º Guanacaste, relativo al plano de\ncatastro N° G-1711215-2013.\n\n16.-Que mediante los informes SINAC-ACG-DRFVS-IT-007-2024 de fecha 10 de\njunio del 2024 y SINAC-ACG-DRFVS-IT-013-2024 de fecha 15 de diciembre de 2024,\nambos suscritos por el Ingeniero Francisco Javier Ramírez Noguera, jefe de la\nDirección de Recursos Forestales y Vida Silvestre del Área de Conservación\nGuanacaste del Sistema Nacional de Áreas de Conservación del Ministerio de\nAmbiente y Energía, certificó su participación en cuanto a la definición de un\nsector de manglar ubicado en Playa Papaturro, en el distrito 01º La Cruz,\ncantón 01º La Cruz, provincia 05º Guanacaste.\n\n17.-Que mediante informe denominado Informe de Delimitación de Manglar\nen Playa Papaturro, La Cruz, Guanacaste ante el Instituto Geográfico Nacional,\nde fecha 20 de diciembre de 2024, elaborado por el Ingeniero Alexander Rojas\nÁlvarez, carné de colegiado IT-28776, se presentó el procedimiento técnico 1975, and its amendments.\n\nWhereas:\n\n1°—That pursuant to Law N° 8905, IGN was established as a dependency of the Registro Nacional, which shall enter into the contracts and agreements necessary for the exercise of its functions. Furthermore, in accordance with Law N° 59, IGN is the leading scientific and technical authority on national cartography, tasked with executing the Official Base Map and the Basic Geographic Description of the Republic of Costa Rica, and with conducting studies, research, work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature relating to such works, with the aim of supporting planning processes.\n\n2°—That Law N° 59 permanently establishes IGN, on behalf of the State, as the official authority on geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, with its authority extending to all activities of any nature originating from the work entrusted to it.\n\n3°—That pursuant to Article 62 of Executive Decree N° 7841-P, Regulations to the Law on the Maritime-Terrestrial Zone, dated December 16, 1977, and its amendments, IGN's competence to delimit the public zone of the Maritime-Terrestrial Zone is recognized, along with its official publication in the Official Gazette La Gaceta; Article 63 of Executive Decree N° 7841-P states that \"The National Geographic Institute shall publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\n4°—That Executive Decree N° 36642-MP-MOPT-MINAET, the Regulations on Specifications for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone, dated June 28, 2011, establishes in Article 18 that for the delimitation of the public zone of the Maritime-Terrestrial Zone, IGN may use two execution methodologies, described in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation (delimitación digital georreferenciada), with the aim of expediting delimitations and providing greater technical certainty to interested parties.\n\n5°—That Executive Decree N° 33797-MJ-MOPT declares CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for measurement epoch 2005.83, dated March 30, 2007, as the official horizontal datum for Costa Rica; this decree, among other aspects, establishes the National Geodetic Reference Network (Red Geodésica Nacional de Referencia Horizontal) CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work performed in the country must be referenced, specifically stating in Article 11 that: The National Geodetic Reference Network CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica from which all cartographic and geodetic surveys and activities conducted in the National Territory by any public agency, national or foreign private individual or entity, must be referenced.; while Article 7 states that As cartographic data are produced in the new cartographic projection system CRTM05, IGN shall publish through appropriate means the information that has been made official.\n\n6°—That Executive Decree N° 40962-MJP, Updating the Official Horizontal Geodetic Reference System for Costa Rica, declares in Article 1 that The official horizontal geodetic reference system for Costa Rica, known as CR05 and materialized through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for measurement epoch 2014.59, and henceforth, changes and updates shall be governed in accordance with the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS), called SIRGAS-CON; furthermore, Article 2 establishes that The cartographic projection system CRTM05 shall remain official for the cartographic representation of the continental national territory, extended for the purposes of applying this cartographic projection up to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, said baseline defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum breadth of all marine jurisdictional areas of the Costa Rican State. Page 52\n\nFurthermore, Article 12 of the referenced decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which references in the continental territory of the country must be made, by stating that The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea, and the cartographic projection \"Universal Transverse Mercator\" (UTM), zones 16 and 17 for the marine and insular jurisdictional areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities conducted in the national territory by any public agency, national or foreign private individual or entity undertaking or contracting geodetic and cartographic work must be referenced, thereby contributing to the avoidance of public expenditure and, on the other hand, yielding reliable, uniform, and comparable geographic information that is of general utility and supports decision-making at the various levels of the State.\n\n7°—That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime-Terrestrial Zone enables the correct delimitation of the public zone for the purposes of developing regulatory plans (planes reguladores), the endorsement of surveying plans (planos de agrimensura), the granting of concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal territorial planning (ordenamiento territorial costero).\n\n8°—That the georeferenced digital information on the delimitation of the public zone of the Maritime-Terrestrial Zone held by IGN is referred to as the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of IGN on the Maritime-Terrestrial Zone (ZMT).\n\n9°—That the Georeferenced Digital Geodatabase (GDG) of IGN on the ZMT is technically grounded in the application of the regulations established by: a) Executive Decree N° 7841-P, Regulations to Law N° 6043 on the Maritime-Terrestrial Zone; b) Executive Decree N° 33797-MJ-MOPT, declaring CR05 as the official horizontal datum for Costa Rica and its associated cartographic projection CRTM05; c) Executive Decree N° 36642-MP-MOPT-MINAET, Regulations on Specifications for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone; and d) Executive Decree N° 40962-MJP, Updating the Official Horizontal Geodetic Reference System for Costa Rica.\n\n10.—That Article 16 of Ley 7575, the Ley Forestal, dated February 13, 1996, and its amendments, establishes that MINAE shall demarcate on the ground the boundaries of the areas comprising the State Natural Heritage (Patrimonio Natural del Estado).\n\n11.—That Article 11 of Chapter I, General Provisions, of Law N° 6043, establishes that the public zone also includes, regardless of its extent, all mangrove areas along the continental and insular coastlines and tidal inlets (esteros) of the national territory.\n\n12.—That Executive Decree N° 36786-MINAET, the Manual for the Classification of Lands Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, published in La Gaceta N° 217 on November 11, 2011, establishes among its objectives the identification, within the Maritime-Terrestrial Zone, of those lands that qualify as forests, lands of forestry aptitude (Class VII and VIII soils), and wetlands (mangroves, tidal inlets, coastal inlets (rías), salt marshes (marismas), coastal lagoons, swamps, flooded forests, salt flats (salitrales)), in order to certify them and incorporate them as part of the State Natural Heritage (PNE).\n\n13.—That Executive Decree N° 36786-MINAET, under Section III—Competences for Delimitation and Certification, establishes that The classification of lands within the ZMT shall be the responsibility of the Conservation Areas (Áreas de Conservación, AC) of SINAC and of private professionals duly accredited by the respective Professional Associations to classify forests, lands of forestry aptitude (Class VII and VIII soils), (mangroves, tidal inlets, coastal inlets, salt marshes, coastal lagoons, swamps, flooded forests, salt flats) and wetlands.\n\nThe validity of classification documents issued by private professionals shall be subject to the approval of the AC with corresponding territorial jurisdiction. The ACs of SINAC with jurisdiction over the ZMT shall also be responsible for the verification, oversight, demarcation (deslinde), and certification of lands belonging to the State Natural Heritage and protection zones.\n\nThe location and delimitation of State Natural Heritage areas within the Maritime-Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), as defined by Ley 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all zones to be granted as concessions within the ZMT, and that governs the classification of the ZMT at the level of cadastral plans (planos de catastro). Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so that they are not counted toward the total area eligible for concession.\n\n14.—That IGN used the georeferenced digital delimitation methodology to delimit the public zone of the Maritime-Terrestrial Zone in a mangrove sector located at Playa Papaturro, in District 01° La Cruz, Canton 01° La Cruz, Province 05° Guanacaste.\n\n15.—That Ms. Estefanía Barquero Alvarado, of legal age, holding identification number 4-0219-0051, Special Attorney-in-Fact (Apoderada Especial) of the company 3-102-778851 S.R.L., legal identification N° 3-102-778851, requested on January 2, 2025, via email addressed to the IGN Secretariat, the execution of the delimitation of a mangrove sector located at Playa Papaturro, in District 01° La Cruz, Canton 01° La Cruz, Province 05° Guanacaste, relating to cadastral plan (plano de catastro) N° G-1711215-2013.\n\n16.—That through reports SINAC-ACG-DRFVS-IT-007-2024, dated June 10, 2024, and SINAC-ACG-DRFVS-IT-013-2024, dated December 15, 2024, both signed by Engineer Francisco Javier Ramírez Noguera, Head of the Directorate of Forest Resources and Wildlife of the Área de Conservación Guanacaste of SINAC of MINAE, his participation was certified with respect to the definition of a mangrove sector located at Playa Papaturro, in District 01° La Cruz, Canton 01° La Cruz, Province 05° Guanacaste.\n\n17.—That through the report entitled Informe de Delimitación de Manglar en Playa Papaturro, La Cruz, Guanacaste ante el Instituto Geográfico Nacional, dated December 20, 2024, prepared by Engineer Alexander Rojas Álvarez, professional membership number IT-28776, the technical delimitation procedure for a mangrove sector located at Playa Papaturro, in District 01° La Cruz, Canton 01° La Cruz, Province 05° Guanacaste was presented.\n\n18.—That through report DIG-GDF-010-2025-PU-INF, dated March 18, 2025, generated by the Topography Sub-process of IGN's Department of Geodesy and Geophysics, the technical review report for the georeferenced digital delimitation publication of the public zone corresponding to a mangrove sector located at Playa Papaturro, in District 01° La Cruz, Canton 01° La Cruz, Province 05° Guanacaste was issued.\n\n19.—That Article 140 of Law N° 6227, the General Law of Public Administration, states that an administrative act shall take effect after being communicated to the person administered, except where it grants rights exclusively, in which case it shall take effect from the time it is adopted;
