  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 45028\n\n                        Deja sin efecto Declaratoria de utilidad pública para los intereses del\nEstado la Asociación Administradora del Acueducto y Alcantarillado Sanitario del Distrito de Puente\nde Piedra de Grecia de Alajuela\n\nNº 45028-MJP\n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nEl MINISTRO DE JUSTICIA Y\nPAZ\n\nCon fundamento en lo\ndispuesto en los artículos 11, 140, inciso 18) y 146 de la Constitución Política,\nen los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley\nGeneral de Administración Pública Nº 6227 del 02 de mayo de 1978, en el\nartículo 32 de la Ley de Asociaciones Nº 218 del 8 de agosto de 1939 y los\nartículos 27 y siguientes del Reglamento a la Ley de Asociaciones Nº 29496-J,\npublicado en La Gaceta Nº 96 del 21 de mayo del 2001.\n\nCONSIDERANDO\n\nI.- Que el artículo 32 de\nla Ley de Asociaciones N°218 del 8 de agosto de 1939 y sus reformas, confiere\nal Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones\nsimples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente\nútiles para los intereses del Estado, y que por ello contribuyan a solventar una\nnecesidad social.\n\nII.- Que la Asociación\nAdministradora del Acueducto y Alcantarillado Sanitario de Puente de Piedra de\nGrecia de Alajuela, cédula jurídica número tres- cero cero dos-doscientos\ncuatro mil cuarenta y tres, se inscribió en el Registro de Asociaciones del\nRegistro Público Nacional el día quince de mayo de mil novecientos noventa y\nsiete.\n\nIII.- Que el artículo 32 de\nla Ley de Asociaciones establece: \" ... En cualquier momento, el Ministerio\nde Justicia y Paz, revocará este beneficio, si desaparecen los motivos por los cuales\nfue concedido. (. . .)\" . Asimismo, el ordinal 33 bis del Reglamento a\nla Ley de Asociaciones, agrega: \"La declaratoria de utilidad\npública será revocable en cualquier momento, no obstante, en caso de la no\npresentación o presentación incompleta del informe de labores, se prevendrá a\nla asociación, una única vez, por el plazo de diez días hábiles. Asimismo, la\nderogatoria de la utilidad pública se realizará mediante resolución razonada resultante\ndel procedimiento de derogatoria del beneficio de utilidad pública el cual, se regirá\npor lo establecido en la Ley General de Administración Pública (. .. ) \".\nFinalmente, el numeral 33 ter del Reglamento a la Ley de Asociaciones,\nindica: \"En caso de que·. At any time, the Ministry\nof Justice and Peace, shall revoke this benefit, if the reasons for which\nit was granted disappear. (. . .)\" . Likewise, ordinal 33 bis of the Regulation to\nthe Law of Associations, adds: \"The declaration of public utility\nshall be revocable at any time, however, in the event of the non-submission or incomplete submission of the work report, the\nassociation shall be given notice, one single time, for a period of ten business days. Likewise, the\nrepeal of the public utility shall be carried out by means of a reasoned resolution resulting\nfrom the procedure for the repeal of the public utility benefit which shall be governed\nby the provisions of the General Law of Public Administration (. .. ) \".\nFinally, numeral 33 ter of the Regulation to the Law of Associations,\nindicates: \"In the event that any association renounces\nthe declaration of public utility, it must submit the corresponding\ndocumentation before the Legal Advisory Office of the Ministry of Justice and Peace which,\nwithout further procedure, shall proceed with the repeal. \"\n\nIV.-That the Administrative Association of the Aqueduct and Sanitary Sewerage of the District of Puente\nde Piedra de Grecia de Alajuela, legal identification number three-zero zero\ntwo-two hundred four thousand forty-three, was declared of public utility by\nthe Ministry of Justice and Peace through Executive Decree Nº42380-MPJ dated\nMarch sixth, two thousand twenty.\n\nV.- That the Administrative Association of the Aqueduct and Sanitary Sewerage of the District of Puente\nde Piedra de Grecia de Alajuela, legal identification number three-zero zero\ntwo-two hundred four thousand forty-three, through a document submitted by its\nlegal representative, Mr. Jehiner Alfaro Retana on February twentieth, two\nthousand twenty-five, expressed its desire to formally renounce the benefit of the\ndeclaration of public utility\n\nTherefore,\n\nTHEY DECREE\n\nREPEAL OF THE DECLARATION OF PUBLIC\nUTILITY OF THE\n\nADMINISTRATIVE ASSOCIATION\nOF THE AQUEDUCT AND SANITARY SEWERAGE\n\nOF THE DISTRICT OF\nPUENTE DE PIEDRA DE GRECIA DE\n\nALAJUELA\n\nArticle 1.- Render void Executive Decree N°42380-MPJ dated March sixth\nof two thousand twenty, by which the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO\nSANITARIO DEL DISTRITO DE PUENTE DE PIEDRA DE GRECIA DE ALAJUELA, legal identification\nnumber three-zero zero two-two hundred four thousand forty-three, was declared of public utility for the interests\nof the State.\n\nArticle 2.- Once this decree is published, it must be communicated to the Associations Registry of the National Registry for its respective annotation.\n\nArticle 3.- The administration shall notify this act to the Ministry of Finance,\nthe General Directorate of Taxation and the National Property Registry, in\norder that they proceed according to their competence.\n\nArticle 4.- It takes effect from its publication.\n\nIssued at the Presidency of\nthe Republic.
