  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 45030\n\n                        Deja sin efecto Declara de Utilidad Pública para los intereses del Estado la\nAsociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo\n\nNº 45030-MJP\n\nEL PRESIDENTE\nDE LA REPÚBLICA\n\nEl MINISTRO\nDE JUSTICIA Y PAZ\n\nCon\nfundamento en lo dispuesto en los artículos 11, 140, inciso 18) y 146 de la Constitución\nPolítica, en los artículos 25 inciso 1), 27 inciso 1), y 28 inciso 2) acápite\nb) de la Ley General de Administración Pública Nº 6627 del 02 de mayo de 1978,\nen el artículo 32 de la Ley de Asociaciones Nº 218 del 8 de agosto de 1939 y\nlos artículos 27 y siguientes del Reglamento a la Ley de Asociaciones Nº\n29496-J, publicado en La Gaceta Nº 96 del 21 de mayo del 2001.\n\nCONSIDERANDO\n\nI.- Que el\nartículo 32 de la Ley de Asociaciones Nº 218 del 8 de agosto de 1939 y sus reformas,\nconfiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones\nsimples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente\nútiles para los intereses del Estado, y que por ello contribuyan a solventar una\nnecesidad social.\n\nIl.- Que la\nAsociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo\nDistrito Savegre Cantón Quepos Provincia Puntarenas, cédula jurídica número tres-cero\ncero dos- trescientos cincuenta y siete mil quinientos noventa y siete, se\ninscribió en el Registro de Asociaciones del Registro Público el día trece de\nenero del dos mil seis, expediente 15891, tomo 524 y asiento 32.\n\nIII.- Que el\nartículo 32 de la Ley de Asociaciones establece: \" ... En cualquier\nmomento, el Ministerio de Justicia y Paz, revocará este beneficio, si desaparecen\nlos motivos por los cuales fue concedido. (. . .)\" . Asimismo, el\nordinal 33 bis del Reglamento a la Ley de Asociaciones, agrega: \"La\ndeclaratoria de utilidad pública será revocable en cualquier momento, no\nobstante, en caso de la no representación o presentación incompleta del informe\nde labores, se prevendrá a la asociación, una única vez, por el pla;o de dieZ¡\ndías hábiles. At any\ntime, the Ministry of Justice and Peace, will revoke this benefit, if the\nreasons for which it was granted disappear. (. . .)\". Likewise,\nordinal 33 bis of the Regulations to the Associations Law, adds: \"The\ndeclaration of public utility will be revocable at any moment,\nnotwithstanding, in the event of non-representation or incomplete presentation of the work\nreport, the association will be warned, a single time, for a period of ten\nbusiness days. Likewise, the repeal of public utility will be carried out\nby means of a reasoned resolution resulting from the procedure for the repeal\nof the public utility benefit which, will be governed by the provisions\nof the General Public Administration Law (. . .)\".\n\nIV.- That the\nAdministrative Association for the Aqueduct and Sanitary Sewer of Matapalo\nSavegre District Quepos Canton Puntarenas Province, was declared of public utility\nby the Ministry of Justice and Peace by means of Executive Decree No. 36773-JP,\ndated August fourth, two thousand eleven, published in the Official Gazette La\nGaceta number 185, dated September twenty-seventh, two thousand eleven.\n\nV.- That the\nAdministrative Association for the Aqueduct and Sanitary Sewer of Matapalo\nSavegre District Quepos Canton Puntarenas Province, legal identification number three-zero\nzero two- three hundred fifty-seven thousand five hundred ninety-seven, through\nits legal representative Mr. Alexander Chinchilla Madrigal, identity\ncard number one·-thousand two hundred ninety-one-zero three hundred\nthirty-two, failed to comply with the presentation of the annual work report\ncorresponding to the year 2023 and without any elements of value being presented to\njustify said non-compliance.\n\nTherefore,\n\nTHEY DECREE\n\nREPEAL THE\nDECLARATION OF PUBLIC UTILITY OF THE\n\nADMINISTRATIVE\nASSOCIATION FOR THE AQUEDUCT AND\n\nSANITARY\nSEWER OF MATAPALO SAVEGRE DISTRICT\n\nQUEPOS CANTON\nPUNTARENAS PROVINCE\n\nArticle\n1.- Render without effect Executive Decree No. 36773-JP, dated August fourth\nof two thousand eleven, by which the Administrative Association for the Aqueduct and\nSanitary Sewer of Matapalo Savegre District Quepos Canton Puntarenas\nProvince, legal identification number three-zero zero two-three hundred fifty and\nseven thousand five hundred ninety-seven, was declared of public utility for the interests\nof the State.\n\nArticle 2.- Once\nthis decree is published, it must be communicated to the Associations Registry of\nthe National Registry for its respective annotation.\n\nArticle\n3.- The administration will notify the present act to the Ministry of Finance, the General\nTaxation Directorate and the National Property Registry, in order that they proceed\naccording to their competence.\n\nArticle\n4.- It comes into effect upon its publication.\n\nGiven at the\nPresidency of the Republic.
