and the official consolidated version of said Convention reads as follows:\n\nPROTOCOL I\n\nPROVISIONS FOR THE REPORTING OF INCIDENTS INVOLVING HARMFUL SUBSTANCES\n\n(pursuant to Article 8 of the Convention)\n\nArticle I\n\nObligation to Report\n\n1) The master (capitán) or other person in charge of any ship involved in one of the incidents referred to in Article II of this Protocol shall, without delay, send a report providing details of the incident and describing them as fully as possible, in accordance with the provisions of this Protocol.\n\n2) In the event that the ship referred to in paragraph 1) of this Article is abandoned, or in the event that its report is incomplete or impossible to obtain, the owner, charterer (fletador), manager (gestor), or shipowner (armador) of the ship, or their agents, shall, to the greatest extent possible, assume the obligations that the provisions of this Protocol impose upon the master.\n\nArticle 1 Record\n\nArticle II\n\nCases in Which a Report Shall Be Made\n\n1) A report shall be made whenever an incident involves:\n\na) a discharge in excess of the authorized level, or a probable discharge, of oil (hidrocarburos) or noxious liquid substances (sustancias nocivas líquidas), for whatever reason, including discharges made for the purpose of securing the safety of the ship or saving life at sea; or\n\nb) a discharge or probable discharge of harmful substances carried in packaged form (bultos), including those carried in containers, portable tanks, road and rail vehicles, and shipborne barges; or\n\nc) damage, failure, or breakdown of a ship of 15 meters or more in length (eslora) that:\n\ni) affects the safety of the ship, including, without limitation, collision, grounding, fire, explosion, structural failure, flooding, and shifting of cargo; or\n\nii) results in an impairment of the safety of navigation, including, without limitation, failure or breakdown of the steering gear, propulsion machinery, electrical generating system, and essential shipborne navigational aids; or\n\nd) a discharge of oil or noxious liquid substances in the course of ship operations that exceeds the quantity or instantaneous rate of discharge permitted under this Convention.\n\n2) For the purposes of this Protocol:\n\na) Oil referred to in paragraph 1) a) of this Article means oil as defined in regulation 1.1 of Anexo I of the Convention.\n\nb) Noxious liquid substances referred to in paragraph 1) a) of this Article means noxious liquid substances as defined in regulation 1.10 of Anexo II of the Convention.\n\nc) Harmful substances in packaged form referred to in paragraph 1) b) of this Article means substances classified as marine pollutants in the International Maritime Dangerous Goods Code (Código IMDG).\n\nArticle 2 Record\n\nArticle III\n\nContent of the Report\n\nReports shall in all cases include:\n\na) identity of the ships involved;\n\nb) time, type, and geographical location of the incident;\n\nc) quantity and type of harmful substances involved;\n\nd) assistance and salvage measures.\n\nArticle 3 Record\n\nArticle IV\n\nSupplementary Report\n\nAny person who is required under the provisions of this Protocol to send a report shall be obliged, where possible:\n\na) to supplement the initial report, as necessary, to provide information concerning subsequent developments following the incident; and\n\nb) to comply, to the greatest extent possible, with requests for additional information relating to the incident made by affected States.\n\nArticle 4 Record\n\nArticle V\n\nProcedures for Reporting Incidents\n\n1) Reports shall be sent to the nearest coastal State (Estado ribereño) by the fastest telecommunications channels available and with the highest possible priority.\n\n2) In order to comply with the provisions of this Protocol, the Parties to this Convention shall issue, or shall ensure the issuance of, regulations or instructions relating to the procedures to be followed for reporting incidents involving harmful substances, drawing upon the guidelines developed by the Organization."
