Únicamente los Estados Contratantes del Protocolo de 1978 relativo al\nConvenio internacional para prevenir la contaminación por los buques, 1973 (en\nadelante llamado \"el Protocolo de 1978\") podrán constituirse en\nPartes en el presente Protocolo mediante:\n\na) firma sin reserva en\ncuanto a ratificación, aceptación o aprobación; o\n\nb) firma a reserva de\nratificación, aceptación o aprobación, seguida de ratificación, aceptación o\naprobación; o\n\nc) adhesión.\n\n2 La ratificación,\naceptación, aprobación o adhesión se efectuará depositando ante el Secretario General\nde la Organización (en adelante llamado \"el Secretario General\") el\ninstrumento que proceda.\n\n Ficha Artículo 5\n\nArticulo 6\n\nEntrada en vigor\n\n1 El presente Protocolo entrará en vigor 12\nmeses después de la fecha en que por lo menos 15 Estados, cuyas flotas\nmercantes combinadas representen no menos del 50% del tonelaje bruto de la\nmarina mercante mundial, se hayan constituido en Partes del mismo de\nconformidad con lo prescrito en el artículo 5 del presente Protocolo.\n\n2 Todo instrumento de ratificación,\naceptación, aprobación o adhesión depositado con posterioridad a la fecha de\nentrada en vigor del presente Protocolo adquirirá efectividad tres meses\ndespués de la fecha en que fue depositado.\n\n3 Después de la fecha en la que se considere\naceptada una enmienda al actual Protocolo de conformidad con lo prescrito en el\nartículo 16 del Convenio, todo instrumento de ratificación, aceptación,\naprobación o adhesión depositado se aplicará al presente Protocolo enmendado.\n\n Ficha Artículo 6\n\nArtículo 7\n\nDenuncia\n\n1 El presente Protocolo podrá ser denunciado\npor una Parte en el presente Protocolo en cualquier momento posterior a la\nexpiración de un plazo de cinco años a contar de la fecha en que el Protocolo\nhaya entrado en vigor para dicha Parte.\n\n2 La denuncia se efectuará depositando un\ninstrumento de denuncia ante el Secretario General.\n\n3 La denuncia surtirá efecto transcurridos\ndoce meses a partir de la recepción de la notificación por el Secretario\nGeneral, o después de la expiración de cualquier otro plazo más largo que se\nfije en la notificación.\n\n4 Se considerará que la denuncia del\nProtocolo de 1978, de conformidad con el articulo VII del mismo, incluye la\ndenuncia del presente Protocolo, de conformidad con el presente artículo.\n\nEsta denuncia surtirá efecto en la fecha en\nque surta efecto la denuncia del Protocolo de 1978, de conformidad con el\nartículo VII de dicho Protocolo.\n\n Ficha Artículo 7\n\nArtículo 8\n\nDepositario\n\n1 El presente Protocolo será depositado ante\nel Secretario General (en adelante llamado \"el Depositario\").\n\n2 El Depositario:\n\na) informará a todos los\nEstados que hayan firmado el presente Protocolo o se hayan adherido al mismo,\nde:\n\ni) toda nueva firma o\ndepósito de un instrumento de ratificación, aceptación, aprobación o adhesión,\nasí como de la fecha en que se produzcan;\n\nii) la fecha de entrada en\nvigor del presente Protocolo; y\n\niii) todo depósito de un\ninstrumento de denuncia del presente Protocolo y de la fecha en que fue\nrecibido dicho instrumento, así como de la fecha en que la denuncia surta\nefecto; y\n\nb) remitirá ejemplares\nauténticos certificados del presente Protocolo a todos los Estados que hayan\nfirmado el Protocolo o se hayan adherido al mismo.\n\n3 Tan pronto como el presente Protocolo entre\nen vigor, el Depositario remitirá a la Secretaria de las Naciones Unidas una\ncopia auténtica certificada del mismo para que se registre y publique, conforme\na lo dispuesto en el artículo 102 de la Carta de las Naciones Unidas.\n\n Ficha Artículo 8\n\nArtículo 9\n\nIdiomas\n\nEl presente Protocolo está\nredactado en un solo ejemplar en los idiomas árabes, chino, español, francés,\ninglés y ruso, y cada uno de los textos tendrá la misma autenticidad:\n\nEN FE DE LO CUAL los\ninfrascritos, debidamente autorizados al efecto por sus respectivos gobiernos,\nhan firmado el presente Protocolo.\n\nHECHO EN LONDRES, el día veintiséis de septiembre\nde mil novecientos noventa y siete.",

The official consolidated version of said Convention reads as follows:\n\n1997 PROTOCOL AMENDING THE INTERNATIONAL CONVENTION FOR THE PREVENTION OF POLLUTION FROM SHIPS, 1973, AS MODIFIED BY THE 1978 PROTOCOL\n\nTHE PARTIES TO THE PRESENT PROTOCOL,\n\nBEING Parties to the 1978 Protocol relating to the International Convention for the Prevention of Pollution from Ships, 1973,\n\nRECOGNIZING the need to prevent and control air pollution (contaminación atmosférica) caused by ships,\n\nRECALLING Principle 15 of the Rio Declaration on Environment and Development in favour of the application of the precautionary approach,\n\nCONSIDERING that the most effective way of achieving this objective is the conclusion of a 1997 Protocol amending the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the 1978 Protocol,\n\nAGREE:\n\nArticle 1\n\nInstrument being amended\n\nThe present Protocol amends the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the 1978 Protocol (hereinafter referred to as \"the Convention\").\n\nArticle 1 Record\n\nArticle 2\n\nAddition of Annex VI to the Convention\n\nAnnex VI, entitled \"Regulations for the Prevention of Air Pollution from Ships\", the text of which is set out in the Annex to the present Protocol, is hereby added.\n\nArticle 2 Record\n\nArticle 3\n\nGeneral obligations\n\n1 The Convention and the present Protocol shall, as between the Parties to the present Protocol, be read and interpreted together as a single instrument.\n\n2 Every reference to the present Protocol shall also constitute a reference to the Annex.\n\nArticle 3 Record\n\nArticle 4\n\nAmendment procedure\n\nWhenever Article 16 of the Convention is applied in respect of an amendment to Annex VI and its Appendices, the reference to \"a Party to the Convention\" shall be deemed to mean a Party bound by that Annex.\n\nArticle 4 Record\n\nFINAL CLAUSES\n\nArticle 5\n\nSignature, ratification, acceptance, approval and accession\n\n1 The present Protocol shall be open for signature at the headquarters of the International Maritime Organization (hereinafter referred to as \"the Organization\") from 1 January 1998 to 31 December 1998 and shall thereafter remain open for accession. Only Contracting States to the 1978 Protocol relating to the International Convention for the Prevention of Pollution from Ships, 1973 (hereinafter referred to as \"the 1978 Protocol\") may become Parties to the present Protocol through:\n\na) signature without reservation as to ratification, acceptance or approval; or\n\nb) signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval; or\n\nc) accession.\n\n2 Ratification, acceptance, approval or accession shall be effected by depositing the relevant instrument with the Secretary-General of the Organization (hereinafter referred to as \"the Secretary-General\").\n\nArticle 5 Record\n\nArticle 6\n\nEntry into force\n\n1 The present Protocol shall enter into force 12 months after the date on which at least 15 States, the combined merchant fleets of which constitute not less than 50% of the gross tonnage of the world's merchant shipping, have become Parties thereto in accordance with Article 5 of the present Protocol.\n\n2 Any instrument of ratification, acceptance, approval or accession deposited after the date on which the present Protocol enters into force shall take effect three months after the date on which it was deposited.\n\n3 After the date on which an amendment to the present Protocol is deemed to have been accepted in accordance with Article 16 of the Convention, any instrument of ratification, acceptance, approval or accession deposited shall apply to the present Protocol as amended.\n\nArticle 6 Record\n\nArticle 7\n\nDenunciation\n\n1 The present Protocol may be denounced by any Party thereto at any time after the expiry of five years from the date on which the Protocol enters into force for that Party.\n\n2 Denunciation shall be effected by depositing an instrument of denunciation with the Secretary-General.\n\n3 Denunciation shall take effect twelve months after receipt of notification by the Secretary-General, or after the expiry of any longer period specified in the notification.\n\n4 Denunciation of the 1978 Protocol in accordance with Article VII thereof shall be deemed to include denunciation of the present Protocol in accordance with the present Article.\n\nSuch denunciation shall take effect on the date on which denunciation of the 1978 Protocol takes effect in accordance with Article VII of that Protocol.\n\nArticle 7 Record\n\nArticle 8\n\nDepositary\n\n1 The present Protocol shall be deposited with the Secretary-General (hereinafter referred to as \"the Depositary\").\n\n2 The Depositary shall:\n\na) inform all States which have signed the present Protocol or acceded thereto of:\n\ni) each new signature and each deposit of an instrument of ratification, acceptance, approval or accession, together with the date thereof;\n\nii) the date of entry into force of the present Protocol; and\n\niii) the deposit of any instrument of denunciation of the present Protocol, the date on which such instrument was received, and the date on which the denunciation takes effect; and\n\nb) transmit certified true copies of the present Protocol to all States which have signed the Protocol or acceded thereto.\n\n3 As soon as the present Protocol enters into force, the Depositary shall transmit a certified true copy thereof to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.\n\nArticle 8 Record\n\nArticle 9\n\nLanguages\n\nThe present Protocol is established in a single original in the Arabic, Chinese, English, French, Russian and Spanish languages, each text being equally authentic.\n\nIN WITNESS WHEREOF the undersigned, being duly authorized by their respective Governments for that purpose, have signed the present Protocol.\n\nDONE AT LONDON this twenty-sixth day of September nineteen hundred and ninety-seven."
