Producción\nAgropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y\nGanadería y la Ley Nº 8495 del 06 de abril del 2006, Ley General del Servicio\nNacional de Salud Animal.\n\nCONSIDERANDO:\n\n1º.- Que el Servicio\nNacional de Salud Animal (SENASA) es la autoridad competente en materia de\nsanidad animal y seguridad de los productos de origen animal, conforme a lo establecido\nen la Ley N° 8495 del 6 de abril de 2006, Ley General del Servicio Nacional de Salud\nAnimal, y como órgano de desconcentración mínima del Ministerio de Agricultura\ny Ganadería.\n\n2º.- Que mediante Decreto\nEjecutivo Nº 27763-MAG del 10 de marzo de 1999 y sus reformas, se encuentran\nestablecidas las tarifas de los servicios que el Ministerio de Agricultura y\nGanadería ofrece al Sector Productivo Nacional y en especial al Sector Agropecuario,\ncorrespondiendo las estipuladas en los artículos 3 y 4 bis a las que ofrece a través\ndel Servicio Nacional de Salud Animal (SENASA).\n\n3º.- Que mediante Decreto\nEjecutivo N.° 44336-MAG-S-SP-MOPT del 12 de enero de 2024 se creó el Sistema\nNacional de Identificación Individual y Rastreabilidad del Ganado Bovino, con\nel objetivo de establecer un control efectivo sobre el desplazamiento,\nprocedencia, estado sanitario y trazabilidad de los animales, fortaleciendo así\nla sanidad animal, el comercio nacional e internacional y la seguridad\nalimentaria.\n\n4º.- Que, como parte de la\nimplementación de este sistema de trazabilidad, se requiere aplicar una\nidentificación individual a cada bovino, lo cual implica la prestación de un\nservicio técnico especializado a cargo de SENASA, cuyo costo debe ser fijado y\nregulado mediante las tarifas correspondientes.\n\n5º.- Que conforme a lo\ndispuesto en el artículo 5 del Decreto Ejecutivo Nº 27763-MAG del 10 de marzo\nde 1999 y sus reformas, están exceptuadas del pago de las tarifas, aquellos exámenes\nque el Laboratorio Nacional de Servicios Veterinarios (LANASEVE) realice en cumplimiento\nde los programas de muestreo microbiológico de agentes patógenos y del programa\nde residuos de contaminantes, cuando los mismos se encuentren en su catálogo de\nservicios ofrecidos.\n\n6º.- Que se hace necesario\nincorporar disposición relativa a aquellos casos en que los exámenes de\nlaboratorio no estén implementados en el LANASEVE y deban las muestras remitirse\na laboratorios externos nacionales o extranjeros, estableciéndose que\ncorresponde a los administrados asumir el costo del envío y realizar el proceso\nde pago del costo del examen o exámenes de laboratorio directamente con el\nlaboratorio externo.\n\n7º.- Que conforme a lo\ndispuesto en el artículo 5 bis del Decreto Ejecutivo N.° 27763-MAG del 10 de\nmarzo de 1999 y sus reformas, SENASA podrá establecer convenios para la prestación\nde servicios sanitarios específicos, como la prueba diagnóstica de Brucella. San José, a los veintiséis días del mes de junio del año del dos\nmil veinticinco.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Norm 45118\n\n Reform for Setting tariffs for services of the Ministry of Agriculture and\nLivestock\n\nNo. 45118-MAG\n\nTHE PRESIDENT OF THE\nREPUBLIC AND THE MINISTER\n\nOF AGRICULTURE AND LIVESTOCK\n\nIn exercise of the\npowers granted in Articles 140, subsections 3), 8), 18) and 20) and 146 of\nthe Political Constitution, Articles 25, 27 subsection 1), 28 subsection 2) paragraph\nb) of Law No. 6227 of May 2, 1978, General Law of Public\nAdministration, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural\nProduction, which incorporates the Organic Law of the Ministry of Agriculture and\nLivestock and Law No. 8495 of April 6, 2006, General Law of the National Animal\nHealth Service.\n\nCONSIDERING:\n\n1st.- That the National\nAnimal Health Service (SENASA) is the competent authority in matters of\nanimal health and safety of products of animal origin, in accordance with the provisions\nof Law No. 8495 of April 6, 2006, General Law of the National Animal Health\nService, and as a body of minimal deconcentration of the Ministry of Agriculture\nand Livestock.\n\n2nd.- That through Executive\nDecree No. 27763-MAG of March 10, 1999 and its reforms, the tariffs for the services that the Ministry of Agriculture and\nLivestock offers to the National Productive Sector and especially to the Agricultural Sector are established,\nthose stipulated in articles 3 and 4 bis corresponding to those offered through\nthe National Animal Health Service (SENASA).\n\n3rd.- That through Executive\nDecree No. 44336-MAG-S-SP-MOPT of January 12, 2024, the National\nSystem for Individual Identification and Traceability of Bovine Cattle was created, with\nthe objective of establishing effective control over the movement,\norigin, health status, and traceability of the animals, thus strengthening\nanimal health, national and international trade, and food\nsafety.\n\n4th.- That, as part of the\nimplementation of this traceability (rastreabilidad) system, it is necessary to apply\nindividual identification to each bovine, which implies the provision of a\nspecialized technical service under the responsibility of SENASA, whose cost must be fixed and\nregulated through the corresponding tariffs.\n\n5th.- That in accordance with\nthe provisions of article 5 of Executive Decree No. 27763-MAG of March 10,\n1999 and its reforms, those examinations\nthat the National Veterinary Services Laboratory (LANASEVE) performs in fulfillment\nof the microbiological sampling programs for pathogenic agents and the\ncontaminant residue program are exempt from the payment of tariffs, when these are in its catalog of\nservices offered.\n\n6th.- That it is necessary\nto incorporate a provision related to those cases in which the laboratory\nexaminations are not implemented at LANASEVE and the samples must be sent\nto external national or foreign laboratories, establishing that\nit is the responsibility of the administered parties to assume the cost of shipping and carry out the\npayment process for the cost of the laboratory examination(s) directly with the\nexternal laboratory.\n\n7th.- That in accordance with\nthe provisions of article 5 bis of Executive Decree No. 27763-MAG of March 10,\n1999 and its reforms, SENASA may establish agreements for the provision\nof specific sanitary services, such as the diagnostic test for Brucella. In\nthis context, the creation of a budget code is required that allows\nfor the correct invoicing and collection for said service, in accordance with\nthe principles of legality and transparency in the use of public funds.\n\n8th.- That by virtue of the\nprinciple of service at cost established in article 6 of Law No. 8495\nof April 6, 2006, General Law of the National Animal Health Service, it is appropriate to\nset new tariffs and make adjustments to existing ones, that reflect the\nreal costs of service provision, guaranteeing their sustainability and\neffectiveness.\n\n9th.- That in accordance with\nthe provisions of article 12 of Executive Decree No. 37045-MP-MEIC of February 22,\n2012 and its reform \"Regulation to the Law for the Protection of Citizens\nfrom Excessive Requirements and Administrative Procedures\", the present\nregulation complies with the principles of regulatory improvement, in accordance with\nreport DMR-DAR-INF-166-2025 dated June 16, 2025 issued by the Directorate\nof Regulatory Improvement of the Ministry of Economy, Industry, and Commerce.\n\nTherefore,\n\nTHEY DECREE\n\nCREATION OF CODES\nG.08.01 AND KF.02.01 IN ARTICLE 3° AND\n\nMODIFICATION OF SUBSECTION C)\nAND D) OF ARTICLE 5 OF EXECUTIVE\n\nDECREE No. 27763-MAG OF\nMARCH 10, 1999, PUBLISHED IN\n\nALCANCE No. 26 TO LA GACETA\nNo. 68 OF APRIL 9, 1999 AND ITS\n\nREFORMS \"FIJACIÓN DE\nTARIFAS DE LOS SERVICIOS DEL MINISTERIO\n\nDE AGRICULTURA Y\nGANADERÍA\".\n\nArticle 1.
