Que el artículo 30 de la Constitución Política de Costa Rica consagra el derecho fundamental de\nacceso a la información sobre asuntos de interés público.\n\n2. Que para\nejercer el derecho a un ambiente sano y ecológicamente equilibrado, establecido\nen la Constitución Política en su artículo 50, se requiere que los habitantes dispongan\nde un acceso eficiente a la información sobre el estado del ambiente, los\nrecursos naturales y la gestión institucional.\n\n3. Que del\nartículo 140 inciso 8) de la Constitución Política, se deriva el Principio de Coordinación\ndel Estado, mismo que engloba la función de Rectoría del Poder Ejecutivo, por la\nque debe vigilar y velar por el buen funcionamiento de los servicios y\ndependencias administrativas, con el fin de lograr la unidad de la actuación\nadministrativa del Estado, en procura de racionalizar y hacer un uso eficiente\nde los recursos públicos disponibles para la ejecución del Plan Nacional de\nDesarrollo.\n\n4. Que el\nartículo 2 de la Ley Orgánica del Ambiente No. 7554, del 4 de octubre de 1995,\nestablece que el Estado propiciará, por medio de sus instituciones, la puesta\nen práctica de un sistema con información con indicadores ambientales,\ndestinados a medir la evolución y la correlación con los indicadores económicos\ny sociales para el país. A su vez, en su artículo 78, inciso h), establece la\nfunción de preparar el Informe Anual sobre el Estado del Ambiente\ncostarricense.\n\n5. Que el\nartículo 4 de la Ley General de la Administración Pública No. 6227, del 2 de mayo\nde 1978, señala que la actividad de los entes públicos deberá estar sujeta en\nsu conjunto a los principios fundamentales del servicio público, para asegurar\nsu continuidad, su eficiencia, su adaptación a todo cambio en el régimen legal\no en la necesidad social que satisfacen y la igualdad en el trato de los\ndestinatarios, usuarios o beneficiarios.\n\n6. Que por\nmedio de la Ley del Sistema de Estadística Nacional No. 9694 del 04 de junio\ndel 2019, las instituciones que componen el Sistema de Estadística Nacional (SEN),\ndeben fijar las normas básicas para su adecuada coordinación y la obtención de información\nque permita el desarrollo estadístico de manera veraz y oportuna. Además, las instituciones\nque lo conforman recopilarán, manejarán y divulgarán datos con fines estadísticos,\nconforme a los principios de confidencialidad estadística, transparencia, especialidad,\nproporcionalidad y de independencia técnica.\n\n7. Que según\nel artículo 1 del Decreto Ejecutivo No. 29540-MINAE, del 11 de mayo de 2001, se\nConstituye el Centro Nacional de Información Geoambiental como un órgano de la\nDirección General de Hidrocarburos del Ministerio de Ambiente y Energía.\n\n8. Que según\nel artículo 3 del Decreto Ejecutivo No. 29540-MINAE del 11 de mayo de 2001, se\nestablece entre otras cosas la función de desarrollar y gestionar el Sistema Nacional\nde Información Ambiental (SINIA), con el objetivo de establecer un sistema oficial\nde estadísticas e indicadores ambientales a nivel nacional, así como de\nconstruir y administrar un sistema integral de información geográfica,\nasegurando la incorporación y difusión de datos geográficos y ambientales\nfundamentales. Además, el CENIGA compilará y distribuirá información ambiental\nrelevante, desarrollará catálogos de datos para los usuarios y brindará apoyo\nen el ordenamiento territorial nacional conforme a la Ley Orgánica del\nAmbiente, facilitando así la toma de decisiones en el sector de Ambiente, y\nelaborando informes nacionales sobre el estado del medio ambiente.\n\n9. Que en\nartículo 1 del Decreto Ejecutivo No. 37658-MINAET del 29 de enero del 2013, se\nestablece Sistema Nacional de Información Ambiental (SINIA) bajo la responsabilidad\ndel Ministerio de Ambiente y Energía, coordinado por el Centro Nacional de\nInformación Geoambiental (CENIGA), y constituyéndose como la plataforma oficial\nde coordinación y vinculación institucional y sectorial del Estado costarricense\npara facilitar la gestión y distribución del conocimiento de la información\nambiental nacional.\n\n10. Que según\nel Decreto Ejecutivo No. 42886-MINAE-MAG-JP del 09 de marzo 2021, denominado\nCreación y Operación del Sistema Nacional de Monitoreo de Cobertura y Uso de la\nTierra y Ecosistemas (SIMOCUTE), en su artículo 1 se indica que dicha\nplataforma estará bajo la responsabilidad del Ministerio de Ambiente y Energía,\nen coordinación con el Ministerio de Agricultura y Ganadería y del Ministerio\nde Justicia y Paz. El SIMOCUTE será liderado por el Centro Nacional de Información\nGeoambiental (CENIGA) y es la plataforma oficial de coordinación. vinculación e\nintegración institucional y sectorial del Estado costarricense, para facilitar\nla gestión y distribución del conocimiento e información en materia de\ncobertura y uso de la tierra y ecosistemas, integrado al Sistema Nacional de Información\nAmbiental (SINIA) del MINAE y vinculado oficialmente con el Sistema Nacional de\nInformación Territorial (SNIT) del IGN del Registro Nacional.\n\n11. Que las\nfunciones y quehacer del CENIGA se encuentran legalmente vinculadas con la\nnecesidad de otros órganos, programas, direcciones, a efecto de dar respuesta a\nrequerimientos preestablecidos en el Reglamento de Creación y Funcionamiento\ndel Programa Nacional de Monitoreo Ecológico (PRONAMEC), Decreto Ejecutivo No.\n39747- MINAE; el Reglamento Operativo de la Secretaría de Planificación\nSecto1ial de Ambiente, Energía, Mares y Ordenamiento Territorial (SEPLASA),\nDecreto Ejecutivo No.40710 MPMINAE- PLAN; la Comisión Interinstitucional para\nla Gestión del Conocimiento y la información sobre Biodiversidad (CIGECIB) y la\nPlataforma Informática para Gestión de Conocimiento e Información Nacional\nsobre la Biodiversidad, Decreto Ejecutivo No. 40725- MINAE-MICITT-MCJ;\nReglamento al inciso h) del artículo 78 de la Ley Orgánica del Ambiente para la\nElaboración del Informe del Estado del Ambiente, Decreto Ejecutivo No. 40952-MINAE;\nReforma Reglamento a la Ley de Biodiversidad y Oficialización del Sistema de\nClasificación de Ecorregiones y Ecosistemas de Costa Rica, Decreto Ejecutivo\nNo. 42450- MINAE y Creación y Operación del Sistema Nacional de Métrica de\nCambio Climático (SINAMECC), Decreto Ejecutivo No.42961-MINAE.\n\n12. Que\nmediante el Decreto Ejecutivo No. 37773-JP-H-MINAE-MICITT del 07 de mayo del\n2013, Creación del Sistema Nacional de Información Territorial (SNIT), en su artículo\n1 se establece que el SNIT es el sistema que publicita y publica en forma\nintegral la información territorial\ntemática debidamente georreferenciada, estandarizada y compatibilizada a la\ninformación territorial de base constituida por la cartografía catastral y topográfica\noficial. Además, en su artículo 5 señala que el Poder Ejecutivo deberá publicar\nen el SNIT, toda la información territorial georreferenciable estandarizada que\ngenere, administre y gestione.\n\n13. Que por\nmedio del Decreto Ejecutivo No. 40200-MP-MEIC-MC, del 27 de abril del año 2017,\nTransparencia y Acceso a la Información Pública, en su artículo 1 se tiene por objeto\nque el Estado garantice el cumplimiento efectivo del derecho humano de acceso a\nla información pública, de forma proactiva, oportuna, oficiosa, completa y\naccesible.\n\nEntendiéndose\nel concepto de accesibilidad como disponibilidad de la información pública tanto\nen medios manuales como electrónicos, en formatos accesibles y abiertos para\ntodas las personas, que permite un ejercicio ágil y eficiente del derecho de\nacceso a la información.\n\n14. Que el\nDecreto Ejecutivo No. 40199-MP del 27 de abril del 2017, Apertura de Datos\nPúblicos, Considerando 11, el Estado debe efectuar todas aquellas acciones para\nresguardar el derecho de acceso a la información pública, entendido como un\nderecho democrático esencial para afianzar la gobernanza, el principio de\ntransparencia, la rendición de cuentas, la probidad y la participación\nciudadana. Además de la incorporación de la iniciativa multilateral Alianza\npara el Gobierno Abierto, la cual promueve un estilo de gobernanza basado en la\ntransparencia, la participación ciudadana y el trabajo colaborativo.\n\n15. En consecuencia del Decreto Ejecutivo citado anteriormente, las instituciones del Estado han\nllevado a cabo esfuerzos individuales para producir datos e información relevantes en materia de sus\ncompetencias, así como para el establecimiento de sistemas de información, que permitan y apoyen la\ntoma de decisiones informadas y que promuevan asertivamente el uso racional de los recursos\nnaturales, en procura del fomento de un desarrollo económico sostenible y respetuoso con el\nambiente. Sin embargo, la realidad resulta en la duplicación de recursos y esfuerzos\ninstitucionales, así como en la falta de un mecanismo de divulgación centralizada de la información.\nPor otra parte, considerando el avance tecnológico y la necesidad de actualización continua de la\ninformación, es imperativo fortalecer la función y operatividad del Centro Nacional de Información\nGeoambiental (CENIGA) y los sistemas bajo su responsabilidad, con el objetivo de integrar\neficazmente toda la información ambiental presente y futura del país.\n\n16. Que es\nesencial contar con un órgano técnico especializado en la recopilación y difusión\nde la información geoambiental nacional, que también brinde asesoría a las dependencias\ndel Estado y a la sociedad civil involucrada en la toma de decisiones, en línea\ncon los principios de la Declaración de Río de Janeiro de 1992, especialmente\nel Principio número 1 O que garantiza el acceso adecuado a la información\nambiental. Además, para cumplir con las metas y objetivos de desarrollo\nsostenible establecidos por las Naciones Unidas y con los compromisos\nnacionales e internacionales a los que el país se ha adherido, es crucial que\nel Estado disponga de datos veraces y actualizados del sector ambiental para mejorar\nla calidad de la toma de decisiones y fomentar la participación pública y la rendición\nde cuentas.\n\n1 7. Que, con\nel fin de cumplir los lineamientos expuestos, se hace necesario modernizar y\nactualizar el Centro Nacional de Información Geoambiental (CENIGA) y el Sistema\nNacional de Información Ambiental (SINIA) para que ejerza como la autoridad institucional\npara la gestión y divulgación de información ambiental, se hace necesario derogar\nel Decreto Ejecutivo No. 29540-MINAE del 11 de mayo de 2001, Constituye el Centro\nNacional de Información Geoambiental como un órgano de la Dirección General de\nHidrocarburos del Ministerio de Ambiente y Energía, así como el Decreto\nEjecutivo No. 37658-MINAET del 29 de enero de 2013, Establece Sistema Nacional\nde Información Ambiental (SINIA) y reforma Decreto Ejecutivo Nº 29540 del 11 de\nmayo del 2001.\n\n18. Un\ndirector (a): encargado (a) de planificar, dirigir, coordinar, organizar y\nsupervisar para satisfacer las necesidades de los usuarios y cumplir con los\nobjetivos institucionales.\n\n2.\nCoordinador (a) Área de Geomática: encargado (a) de gestionar los datos, estadísticas,\nindicadores y variables de la información geoespacial.\n\n3.\nCoordinador (a) del Área Gestión de la Información Ambiental: encargado (a) de gestionar\nlos datos, estadísticas, indicadores y variables de la información ambiental nacional.\n\n4.\nCoordinador (a) del Área de Gestión Estratégica e Innovación: encargado (a) de liderar\nprocesos de planificación estratégica y promover la innovación dentro del centro,\nalineando sus actividades con las prioridades nacionales e internacionales en materia\nambiental y de ciencia de datos.\n\n5. Un\nestadístico (a): dar apoyo a las áreas de geomática, gestión ambiental y\ngestión estratégica e innovación, en el análisis y aplicación de los\nlineamientos metodológicos establecidos.\n\n6. Un especialista\nen ingeniería informática y desarrollo de aplicaciones Web (a): dar apoyo a las\nplataformas de información responsabilidad de CENIGA, en coordinación con\nTecnologías de Información de MINAE.\n\n7. Asistente\nAdministrativo (a): dar apoyo a los asuntos administrativos del CENIGA.\n\n8. Además, el\nCENIGA puede contar con el apoyo de consultorías que se estimen relevantes\npara la consecución de sus fines.\n\nArtículo 4.\nDe las funciones del CENIGA:\n\nSerán\nfunciones del CENIGA:\n\n1. Consolidar\nla estructura organizacional del CENJGA para atender adecuadamente los alcances\nestablecidos en la legislación vinculante.\n\n2. Coordinar\nla actualización de los instrumentos legales sobre la operación del CENIGA, en\ncaso de ser necesario, con los órganos competentes.\n\n3. Coordinar\ncon los despachos del MINAE, la Dirección de Planificación Institucional, la\nDirección Financiera y la Dirección de Gestión Institucional de Recursos\nHumanos, el fortalecimiento de los recursos presupuestarios, recurso humano,\noperativo, tecnológico, equipo y otros para el funcionamiento CENIGA, que\nasegure la sostenibilidad y mejora continua de los sistemas bajo su\nresponsabilidad.\n\n4. Elaborar,\nactualizar, divulgar y capacitar en el marco metodológico en colaboración con\ninstituciones del MINAE y bajo los lineamientos del INEC e IGN, para asegurar la\ncalidad, confiabilidad, transparencia, accesibilidad y gestión efectiva de los\ndatos estadísticos y geoambientales. Esto incluye facilitar acceso gratuito de\nla información ambiental pública, bajo responsabilidad del MINAE, tanto para\nlos tomadores de decisiones en el desarrollo de política pública como para la\nciudadanía en general.\n\n5. Apoyar el\ndesarrollo de los informes nacionales sobre el medio ambiente, en coordinación\ncon Secretaría de Planificación Sectorial de Ambiental y Energía (SEPLASA).\n\n6. Asesorar a\nlas dependencias de MINAE en materia de gestión de la información para dar\ncumplimiento a los compromisos nacionales e internacionales y representar oficialmente\nal MINAE, tanto a nivel nacional como internacional, en concejos, comités, OCDE,\nODS, F AO, ONU, Convenciones y otros organismos pertinentes, a solicitud de los\njerarcas, así como, garantizar la respuesta oportuna a las solicitudes de\ninformación requeridas por todas estas instancias, incluyendo el asesorar a las\ndependencias de MINAE en materia de gestión de la información para dar cumplimiento\na los compromisos nacionales e internacionales.\n\n7. Atender\nconsultas formales a petición del despacho del ministro, viceministros, direcciones,\nasí como cualquier otra dependencia del MINAE o según se requiera por parte de\nlos jerarcas, ya sean solicitadas mediante oficio o correo electrónico oficial,\nrespecto a la revisión de informes técnicos específicos o bien la redacción de\ninformes especiales, tanto en materia de indicadores como en materia\ngeoespacial. Las mismas deberán ser resueltas mediante oficio formal o por correo\nelectrónico oficial, según sea solicitado.\n\nArtículo 5.\nDel establecimiento del SINIA.\n\nSe establece\nel Sistema Nacional de lnformación Ambiental, en adelante denominado SINIA, bajo\nla responsabilidad del MINAE, y coordinado por el CENIGA. Se constituirá como\nel portal oficial para la publicación de información ambiental estadística y\ngeomática del país.\n\nDiseñado para\nfacilitar la sistematización, acceso y distribución de la misma; funcionando como\nuna red de integración técnica, tecnológica, institucional y sectorial del\nEstado costarricense, que además, promueva la distribución y uso de dicha\ninformación en forma comprensible, accesible, actualizada, integrada,\nestandarizada y validada por los responsables de la generación del dato,\nconforme a los lineamientos metodológicos establecidos por el CENIGA y\nemnarcados en la normativa del INEC y el IGN y con esto apoyar los procesos de\ntoma de decisión, la gestión ambiental y el manejo de los recursos naturales\ndel país.\n\nArtículo 6.\nDel funcionamiento del SINIA.\n\nPara el\nfuncionamiento del SINIA, se requerirá constituir la Red Nacional de Información\nAmbiental, en adelante RENIA, coordinada por el CENIGA y conformada por los\nnodos de información ambiental, entendiéndose como los enlaces técnicos de\naquellas entidades gubernamentales y no gubernamentales, relacionadas con la\ngeneración y uso de información ambiental. Para tal efecto, se deberá\nconsiderar la normativa vigente que dicta la responsabilidad de las diferentes\ndependencias y entidades nacionales ligadas a la información ambiental\nnacional, así como de otros grupos nacionales organizados.\n\nArtículo 7.\nDe las plataformas administradas por CENIGA.\n\nLe corresponderá\nal CENIGA coordinar, gestionar y velar por el desarrollo y funcionamiento tanto,\ndel Sistema Nacional de Información Ambiental (SINIA) como del Sistema Nacional\nde Cobertura y Uso de la Tierra y Ecosistemas (SIMOCUTE), así como de otras\nplataformas ambientales que sean asignadas al CENIGA y acordes a las funciones\nde este Centro, garantizando la disposición de la información a todos los\nusuarios nacionales e internacionales.\n\nArtículo 8.\nDe los nodos de información.\n\nLos nodos de\ninformación se definen como la representación institucional, gubernamental y sectorial\ndentro de la RENIA. Estos nodos de información serán las unidades encargadas de\ngestionar internamente en sus instituciones y enviar la información ambiental\ninstitucional relevante y oficial en materia de sus competencias, para\npublicación en el SINIA como un portal único, así como para cualquier otro uso\nrequerido.\n\nArtículo 9.\nDel nombramiento de un enlace técnico.\n\nLas\ninstituciones de sector ambiente y dependencias de MINAE deben nombrar un\nenlace técnico ante el CENIGA, con el objetivo de proporcionar el mecanismo\nadministrativo apropiado y los insumos necesarios para el óptimo funcionamiento\ndel SINIA.\n\nArtículo 10. De\nlas funciones del enlace técnico:\n\nLos enlaces\ntécnicos tendrán las siguientes funciones:\n\n1. Coordinar con el CENIGA sobre los requerimientos de información para el SINIA, acatando el marco\nmetodológico con el propósito de asegurar calidad y la homologación de los datos estadísticos y\ngeoambientales, y garantizando la comparabilidad de los datos en casos de ajustes metodológicos en\nsus Dependencias.\n\n2. Coordinar\ncon el CENIGA la vinculación y/o publicación en el portal del SINIA, de la\ninformación geoespacial, datos e indicadores que generen, así como de los sistemas\ninstitucionales y /o plataformas interinstitucionales en los que intervenga la\nparticipación del MINAE, de conformidad con el marco metodológico establecido\npor el SINIA y en respeto de las competencias y autonomía institucional de cada\nentidad que administra dicha información y/ o sistema.\n\n3. Recibir\nlas capacitaciones del marco metodológico del SINIA, con el propósito\ngarantizar que la información cumple con los estándares normativos nacionales.\n\n4. Informar\nal CENIGA la necesidad de enmiendas en la información proporcionada, además, de\nlas fallas y mejoras acerca del funcionamiento del portal digital del SINIA.\n\n5. Atender y\ndar respuestas a las consultas técnicas realizadas por el CENIGA y los usuarios\ndel Sistema, como responsable de la información ambiental de la dependencia que\nrepresenta, así como asistir a talleres técnicos en temáticas de su\nresponsabilidad, en caso de ser requerido.\n\nArtículo 11.\nDe la potestad para solicitar información.\n\nEl CENIGA\npodrá solicitar datos, informes, colaboración y asesoramiento a los enlaces técnicos\nde la Red Nacional de Información Ambiental (RENIA) en rnateria de sus competencias,\ncon el propósito de dar rigurosidad científica y calidad al usuario, además\npodrá conformar comisiones ad hoc con asesores expertos para resolver\nsituaciones específicas.\n\nArtículo 12.\nDe la obligatoriedad.\n\nSe instruye e\ninsta a las dependencias del MINAE a acatar la obligatoriedad de la aplicación de\nlas normas técnicas, lineamientos, protocolos, manuales y guías establecidos\npor el CENIGA sobre gestión de datos, estadísticas, indicadores y variables de\nla información geoespacial. Esto tiene como propósito asegurar la calidad,\nconfiabilidad, transparencia, accesibilidad y gestión efectiva de los datos\nestadísticos y geoambientales del país.\nAsimismo, toda plataforma tecnológica o sistema desarrollado de forma\nindependiente por las instituciones del MINAE, o con su participación, que\ngenere información ambiental, estadística o geomática, deberá notificar y\ncoordinar con el CENIGA para hacer velar los lineamientos del INEC y el IGN y\ngarantizar su vinculación y visualización en el Sistema Nacional de Información\nAmbiental (SINIA) y la posterior articulación de los datos geomáticos en el\nSistema Nacional de Información Territorial (SNIT).\n\nArtículo 13.\nDe los proyectos ambientales.\n\nEn cuanto a\nla información ambiental generada en proyectos ambientales no gubernamentales, que\nal efecto manifieste interés en integrarse al SINIA, debe cumplir con normativa\nmetodológica establecida en el CENIGA-SINIA.\n\nArtículo 14.\nDel financiamiento.\n\nEl jerarca\ndel MINAE incorporará en los instrumentos de planificación y distribución del presupuesto\nde la institución vía presupuesto ordinario y/o extraordinario, los recursos financieros\npara que el CENIGA, cumpla con las funciones dadas en este decreto, además, deberá\nasegurar el recurso humano, tecnológico, y logístico, para la sostenibilidad del\nSINIA.\n\nLos jerarcas\nde las diferentes entidades públicas que tengan el mandato legal de generar información\nrelacionada con el ámbito del SINIA, deberán incorporar en sus planes anuales operativos,\nplanes de trabajo y otras estrategias de planificación, el financiamiento de\nlas actividades relacionadas con su participación y apoyo para la operación del\nSistema; incluyendo el fortalecimiento de capacidades en materia tecnológica y\nrecursos humanos para la sostenibilidad y mejora continua del SINIA y del SNIT.\n\nLas entidades\npúblicas y privadas, incluyendo organismos nacionales e internacionales de cooperación,\nprocurarán, en la medida de sus posibilidades y dentro de la normativa jurídica\nvigente, contribuir con el aporte de recursos económicos, logísticos, técnicos\ny/o humanos para el funcionamiento del SINIA.\n\nArtículo 15.\nDel ámbito de aplicación.\n\nLa información\npublicada en las plataformas ambientales gestionadas por CENIGA, es considerada\nde interés nacional y fundamental para fortalecer la toma de decisiones, por lo\ntanto, el sector público está obligado a acatar el presente Decreto.\n\nArtículo 16.\nDe la oficialidad.\n\nLa\noficialidad de los datos es responsabilidad de la institución que genere la\ninformación, la cual debe estar disponible en e1 SINIA.\n\nArtículo 17:\nConvenios y otros mecanismos de publicación\n\nEl CENIGA,\nrealizara convenios con instituciones del sector público, privado, academia y cualquier\notro organismo que considere atinente en la generación de información ambiental\nde interés para el país, los cuales deberán ser firmados por el ministro del\nMINAE y la parte interesada. That Article 30 of the Political Constitution of Costa Rica enshrines the fundamental right of\naccess to information on matters of public interest.\n\n2. That to\nexercise the right to a healthy and ecologically balanced environment, established\nin the Political Constitution in its Article 50, it is required that the inhabitants have\nefficient access to information on the state of the environment,\nnatural resources, and institutional management.\n\n3. That from\nArticle 140 subsection 8) of the Political Constitution, the Principle of State Coordination is derived,\nwhich encompasses the oversight function of the Executive Branch, by which\nit must monitor and ensure the proper functioning of administrative services\nand dependencies, in order to achieve unity of the State's administrative\naction, in pursuit of rationalizing and making efficient use of\navailable public resources for the execution of the National Development Plan.\n\n4. That\nArticle 2 of the Organic Environmental Law No. 7554, of October 4, 1995,\nestablishes that the State shall promote, through its institutions, the implementation\nof a system with information containing environmental indicators,\ndesigned to measure evolution and correlation with economic and social\nindicators for the country. In turn, in its Article 78, subsection h), it establishes the\nfunction of preparing the Annual Report on the State of the Costa Rican\nEnvironment.\n\n5. That\nArticle 4 of the General Public Administration Law No. 6227, of May 2,\n1978, states that the activity of public entities must be subject in\nits entirety to the fundamental principles of public service, to ensure\nits continuity, efficiency, adaptation to any change in the legal regime\nor in the social need it satisfies, and equality in the treatment of\nrecipients, users, or beneficiaries.\n\n6. That by\nmeans of the National Statistics System Law No. 9694 of June 4,\n2019, the institutions comprising the National Statistics System (Sistema de Estadística Nacional, SEN),\nmust establish the basic norms for its adequate coordination and the obtaining of information\nthat allows for statistical development in a truthful and timely manner. Furthermore, the institutions\nthat comprise it shall collect, manage, and disseminate data for statistical purposes,\nin accordance with the principles of statistical confidentiality, transparency, specialty,\nproportionality, and technical independence.\n\n7. That according to\nArticle 1 of Executive Decree No. 29540-MINAE, of May 11, 2001,\nthe National Geo-Environmental Information Center is constituted as an organ of the\nGeneral Directorate of Hydrocarbons of the Ministry of Environment and Energy.\n\n8. That according to\nArticle 3 of Executive Decree No. 29540-MINAE of May 11, 2001,\nthe function of developing and managing the National Environmental Information System (SINIA) is established, among other things, with the objective of establishing an official system\nof environmental statistics and indicators at the national level, as well as\nbuilding and managing a comprehensive geographic information system,\nensuring the incorporation and dissemination of fundamental geographic and environmental\ndata. Furthermore, CENIGA shall compile and distribute relevant environmental\ninformation, develop data catalogs for users, and provide support\nin national land-use planning (ordenamiento territorial) in accordance with the Organic Environmental\nLaw, thereby facilitating decision-making in the Environment sector, and\npreparing national reports on the state of the environment.\n\n9. That in\nArticle 1 of Executive Decree No. 37658-MINAET of January 29, 2013, the\nNational Environmental Information System (SINIA) is established under the responsibility\nof the Ministry of Environment and Energy, coordinated by the National Center for\nGeo-Environmental Information (CENIGA), and constituted as the official platform\nfor institutional and sectoral coordination and linkage of the Costa Rican State\nto facilitate the management and distribution of national environmental\ninformation knowledge.\n\n10. That according to\nExecutive Decree No. 42886-MINAE-MAG-JP of March 9, 2021, titled\nCreation and Operation of the National System for Monitoring Land Cover and Use and Ecosystems (SIMOCUTE), in its Article 1 it is indicated that said\nplatform shall be under the responsibility of the Ministry of Environment and Energy,\nin coordination with the Ministry of Agriculture and Livestock and the Ministry\nof Justice and Peace. SIMOCUTE shall be led by the National Center for Geo-Environmental Information\n(CENIGA) and is the official platform for coordination, linkage, and\nintegration, institutional and sectoral, of the Costa Rican State, to facilitate\nthe management and distribution of knowledge and information regarding\nland cover (cobertura) and use (uso de la tierra) and ecosystems, integrated into the National Environmental Information System\n(SINIA) of MINAE and officially linked with the National Territorial Information System (SNIT) of the IGN of the National Registry.\n\n11. That the\nfunctions and tasks of CENIGA are legally linked with the\nneeds of other organs, programs, directorates, in order to respond to\nrequirements pre-established in the Regulation for the Creation and Operation\nof the National Ecological Monitoring Program (PRONAMEC), Executive Decree No.\n39747-MINAE; the Operational Regulation of the Sectoral Planning Secretariat\nfor Environment, Energy, Seas, and Land-Use Planning (Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial, SEPLASA),\nExecutive Decree No. 40710 MPMINAE-PLAN; the Inter-institutional Commission for\nthe Management of Knowledge and Information on Biodiversity (Comisión Interinstitucional para la Gestión del Conocimiento y la Información sobre Biodiversidad, CIGECIB) and the\nInformatics Platform for the Management of National Knowledge and Information\non Biodiversity, Executive Decree No. 40725-MINAE-MICITT-MCJ;\nRegulation for subsection h) of Article 78 of the Organic Environmental Law for the\nPreparation of the State of the Environment Report, Executive Decree No. 40952-MINAE;\nReform Regulation to the Biodiversity Law and Officialization of the Classification System\nof Ecoregions and Ecosystems of Costa Rica, Executive Decree\nNo. 42450-MINAE and Creation and Operation of the National Climate Change Metrics System (Sistema Nacional de Métrica de Cambio Climático, SINAMECC), Executive Decree No. 42961-MINAE.\n\n12. That\nby means of Executive Decree No. 37773-JP-H-MINAE-MICITT of May 7,\n2013, Creation of the National Territorial Information System (SNIT), in its Article\n1 it is established that SNIT is the system that publicizes and publishes in a\ncomprehensive manner the thematic territorial information\nduly georeferenced, standardized, and made compatible with the\nbase territorial information constituted by the official cadastral and topographic\ncartography. Furthermore, in its Article 5 it states that the Executive Branch must publish\nin SNIT all the standardized, georeferenceable territorial information that it\ngenerates, administers, and manages.\n\n13. That by\nmeans of Executive Decree No. 40200-MP-MEIC-MC, of April 27, 2017,\nTransparency and Access to Public Information, in its Article 1 the purpose is\nthat the State guarantees the effective fulfillment of the human right of access to\npublic information, in a proactive, timely, ex officio, complete, and\naccessible manner.\n\nUnderstanding\nthe concept of accessibility as the availability of public information both\nin manual and electronic media, in accessible and open formats for\nall persons, allowing an agile and efficient exercise of the right of\naccess to information.\n\n14. That\nExecutive Decree No. 40199-MP of April 27, 2017, Opening of Public\nData, Considering 11, the State must carry out all those actions to\nsafeguard the right of access to public information, understood as an\nessential democratic right to strengthen governance, the principle of\ntransparency, accountability, probity, and citizen\nparticipation. Additionally, the incorporation of the multilateral initiative\nOpen Government Partnership, which promotes a style of governance based on\ntransparency, citizen participation, and collaborative work.\n\n15. As a consequence of the Executive Decree cited above, State institutions have\ncarried out individual efforts to produce relevant data and information in matters of their\ncompetencies, as well as for the establishment of information systems, that allow and support\ninformed decision-making and that assertively promote the rational use of natural\nresources, in pursuit of fostering sustainable economic development respectful of the\nenvironment. However, the reality results in the duplication of institutional resources and\nefforts, as well as the lack of a centralized information dissemination mechanism.\nOn the other hand, considering technological advancement and the need for continuous updating of\ninformation, it is imperative to strengthen the function and operability of the National Center for Geo-Environmental Information\n(CENIGA) and the systems under its responsibility, with the objective of effectively integrating\nall present and future environmental information of the country.\n\n16. That it is\nessential to have a specialized technical organ for the compilation and dissemination\nof national geo-environmental information, which also provides advice to State\ndependencies and to civil society involved in decision-making, in line\nwith the principles of the Rio de Janeiro Declaration of 1992, especially\nPrinciple number 10 which guarantees adequate access to environmental\ninformation. Furthermore, to meet the sustainable development goals and objectives\nestablished by the United Nations and the\nnational and international commitments to which the country has adhered, it is crucial that\nthe State has accurate and updated data from the environmental sector to improve\nthe quality of decision-making and foster public participation and accountability.\n\n17. That, with\nthe aim of fulfilling the outlined guidelines, it is necessary to modernize and\nupdate the National Center for Geo-Environmental Information (CENIGA) and the National\nEnvironmental Information System (SINIA) so that it acts as the institutional authority\nfor the management and dissemination of environmental information, it is necessary to repeal\nExecutive Decree No. 29540-MINAE of May 11, 2001, Constitutes the National Center\nfor Geo-Environmental Information as an organ of the General Directorate of\nHydrocarbons of the Ministry of Environment and Energy, as well as Executive\nDecree No. 37658-MINAET of January 29, 2013, Establishes National Environmental\nInformation System (SINIA) and reforms Executive Decree No. 29540 of May 11,\n2001.\n\n18. That, in\naccordance with the Regulation to the Law for the Protection of Citizens from the Excess of\nRequirements and Administrative Procedures, Executive Decree No. 37045-MP-MEIC and its\nreforms, the Cost-Benefit Evaluation Form was completed in\nSection I called Prior Control of Regulatory Improvement and it was determined that\nthe result thereof was negative since the proposal does not contain procedures or\nrequirements.\n\nTherefore,\n\nTHEY DECREE\n\nCREATION OF THE\nNATIONAL CENTER FOR GEO-ENVIRONMENTAL INFORMATION\n\n(CENIGA) AND\nESTABLISHMENT OF THE NATIONAL\n\nENVIRONMENTAL\nINFORMATION SYSTEM (SINIA), DECLARATION OF PUBLIC\n\nINTEREST, AND\nREPEAL OF EXECUTIVE DECREE No. 29540-MINAE\n\nOF MAY 11,\n2001 CONSTITUTING THE NATIONAL CENTER FOR\n\nGEO-ENVIRONMENTAL\nINFORMATION AND, EXECUTIVE DECREE No. 37658-\n\nMINAET OF JANUARY 29, 2013 ESTABLISHMENT OF THE NATIONAL\n\nENVIRONMENTAL\nINFORMATION SYSTEM (SINIA) AND REFORM OF\n\nARTICLE 3\nOF EXECUTIVE DECREE No. 29540-MINAE OF MAY 11,\n\n2001.\n\nArticle 1.\nOf the constitution of CENIGA.\n\nThe National Center for Geo-Environmental Information (CENIGA) is constituted as an entity attached\nto the Office of the Minister, which shall act as the institutional authority for the\nmanagement and dissemination of environmental information.\n\nArticle 2.\nAbbreviations:\n\nBelow are the abbreviations used in this decree:\n\nCENIGA: National Center for Geo-Environmental Information (Centro Nacional Información Geoambiental).\n\nIDE: Spatial Data Infrastructure (Infraestructura de datos espaciales).\n\nIGN: National Geographic Institute (Instituto Geográfico Nacional)\n\nINEC: National Institute of Statistics and Censuses (Instituto Nacional de Estadísticas y Censos)\n\nFAO: Food and Agriculture Organization of the United Nations\n\nMINAE: Ministry of Environment and Energy\n\nOECD: Organisation for Economic Co-operation and Development\n\nSDGs: Sustainable Development Goals\n\nUN: United Nations\n\nRENIA: National Environmental Information Network (Red Nacional de Información Ambiental).\n\nSEPLASA: Sectoral Planning Secretariat for Environment and Energy (Secretaría de Planificación Sectorial de Ambiente y Energía)\n\nSIMOCUTE: National System for Land Cover and Use and Ecosystems (Sistema Nacional de Cobertura y Uso de la Tierra y Ecosistemas)\n\nSINIA: National Environmental Information System.\n\nSNIT: National Territorial Information System\n\nArticle 3.\nOf the organizational structure:\n\nThe organizational structure of the National Center for Geo-Environmental Information (CENIGA),\n\nis established below:\n\n1. A Director: responsible for planning, directing, coordinating, organizing, and supervising to satisfy user needs and fulfill institutional objectives.\n\n2. Coordinator of the Geomatics Area (Área de Geomática): responsible for managing data, statistics, indicators, and variables of geospatial information.\n\n3. Coordinator of the Environmental Information Management Area (Área Gestión de la Información Ambiental): responsible for managing data, statistics, indicators, and variables of national environmental information.\n\n4. Coordinator of the Strategic Management and Innovation Area (Área de Gestión Estratégica e Innovación): responsible for leading strategic planning processes and promoting innovation within the center, aligning its activities with national and international priorities in environmental matters and data science.\n\n5. A Statistician: to provide support to the geomatics, environmental management, and strategic management and innovation areas, in the analysis and application of established methodological guidelines.\n\n6. A Specialist in informatics engineering and web application development: to provide support to the information platforms under CENIGA's responsibility, in coordination with MINAE's Information Technologies.\n\n7. Administrative Assistant: to provide support for the administrative affairs of CENIGA.\n\n8. Furthermore, CENIGA may have the support of consultancies deemed relevant for the achievement of its purposes.\n\nArticle 4.\nOf the functions of CENIGA:\n\nThe functions of CENIGA shall be:\n\n1. Consolidate the organizational structure of CENIGA to adequately address the scopes established in binding legislation.\n\n2. Coordinate the updating of legal instruments concerning the operation of CENIGA, if necessary, with the competent organs.\n\n3. Coordinate with the offices of MINAE, the Institutional Planning Directorate, the Financial Directorate, and the Institutional Human Resources Management Directorate, the strengthening of budgetary resources, human resources, operational, technological, equipment, and other resources for the functioning of CENIGA, ensuring the sustainability and continuous improvement of the systems under its responsibility.\n\n4. Develop, update, disseminate, and provide training on the methodological framework in collaboration with MINAE institutions and under the guidelines of INEC and IGN, to ensure the quality, reliability, transparency, accessibility, and effective management of statistical and geo-environmental data. This includes facilitating free access to public environmental information, under MINAE's responsibility, both for decision-makers in public policy development and for the general citizenry.\n\n5. Support the development of national reports on the environment, in coordination with the Sectoral Planning Secretariat for Environment and Energy (SEPLASA).\n\n6. Advise MINAE dependencies on information management matters to fulfill national and international commitments and officially represent MINAE, both nationally and internationally, in councils, committees, OECD, SDGs, FAO, UN, Conventions, and other pertinent bodies, at the request of the heads, as well as ensure timely response to information requests required by all these instances, including advising MINAE dependencies on information management matters to fulfill national and international commitments.\n\n7. Attend formal consultations at the request of the office of the minister, vice-ministers, directorates, as well as any other MINAE dependency or as required by the heads, whether requested via official letter or official email, regarding the review of specific technical reports or the drafting of special reports, both regarding indicators and geospatial matters. These must be resolved via formal official letter or by official email, as requested.\n\nArticle 5.\nOf the establishment of SINIA.\n\nThe National Environmental Information System, hereinafter referred to as SINIA, is established under the responsibility of MINAE, and coordinated by CENIGA. It shall be constituted as the official portal for the publication of statistical and geomatic environmental information of the country.\n\nDesigned to facilitate its systematization, access, and distribution; functioning as a network for technical, technological, institutional, and sectoral integration of the Costa Rican State, which, furthermore, promotes the distribution and use of said information in a comprehensible, accessible, updated, integrated, standardized, and validated form by those responsible for generating the data, in accordance with the methodological guidelines established by CENIGA and framed within the regulations of INEC and IGN, and thereby support decision-making processes, environmental management, and the management of the country's natural resources.\n\nArticle 6.\nOf the operation of SINIA.\n\nFor the operation of SINIA, it will be required to constitute the National Environmental Information Network, hereinafter RENIA, coordinated by CENIGA and comprised of environmental information nodes, understood as the technical liaisons of those governmental and non-governmental entities related to the generation and use of environmental information. For this purpose, the current regulations dictating the responsibility of the different national dependencies and entities linked to national environmental information, as well as other organized national groups, must be considered.\n\nArticle 7.\nOf the platforms administered by CENIGA.\n\nCENIGA shall be responsible for coordinating, managing, and overseeing the development and operation of both the National Environmental Information System (SINIA) and the National System for Land Cover and Use and Ecosystems (SIMOCUTE), as well as other environmental platforms assigned to CENIGA and consistent with the functions of this Center, guaranteeing the availability of information to all national and international users.\n\nArticle 8.\nOf the information nodes.\n\nInformation nodes are defined as the institutional, governmental, and sectoral representation within RENIA. These information nodes shall be the units responsible for internally managing within their institutions and sending the relevant and official institutional environmental information regarding their competencies, for publication in SINIA as a single portal, as well as for any other required use.\n\nArticle 9.\nOf the appointment of a technical liaison.\n\nThe institutions of the environment sector and dependencies of MINAE must appoint a technical liaison before CENIGA, with the objective of providing the appropriate administrative mechanism and the necessary inputs for the optimal operation of SINIA.\n\nArticle 10. Of the functions of the technical liaison:\n\nThe technical liaisons shall have the following functions:\n\n1. Coordinate with CENIGA on information requirements for SINIA, abiding by the methodological framework for the purpose of ensuring quality and the homologation of statistical and geo-environmental data, and guaranteeing data comparability in cases of methodological adjustments in their Dependencies.\n\n2. Coordinate with CENIGA the linking and/or publication on the SINIA portal of the geospatial information, data, and indicators they generate, as well as the institutional systems and/or inter-institutional platforms in which MINAE participates, in accordance with the methodological framework established by SINIA and respecting the competencies and institutional autonomy of each entity that administers said information and/or system.\n\n3. Receive training on the SINIA methodological framework, for the purpose of guaranteeing that the information complies with national regulatory standards.\n\n4. Inform CENIGA of the need for amendments to the information provided, in addition to failures and improvements regarding the operation of the SINIA digital portal.\n\n5. Attend and respond to technical consultations made by CENIGA and the System's users, as the person responsible for the environmental information of the dependency they represent, as well as attend technical workshops on topics within their responsibility, if required.\n\nArticle 11.\nOf the power to request information.\n\nCENIGA may request data, reports, collaboration, and advice from the technical liaisons of the National Environmental Information Network (RENIA) regarding their competencies, for the purpose of providing scientific rigor and quality to the user; additionally, it may form ad hoc commissions with expert advisors to resolve specific situations.\n\nArticle 12.\nOf the obligatoriness.\n\nThe dependencies of MINAE are instructed and urged to abide by the obligatory application of the technical standards, guidelines, protocols, manuals, and guides established by CENIGA on data management, statistics, indicators, and variables of geospatial information. This aims to ensure the quality, reliability, transparency, accessibility, and effective management of the country's statistical and geo-environmental data.\nLikewise, any technological platform or system independently developed by MINAE institutions, or with their participation, that generates environmental, statistical, or geomatic information, must notify and coordinate with CENIGA to enforce the guidelines of INEC and IGN and guarantee its linkage and visualization in the National Environmental Information System (SINIA) and the subsequent articulation of geomatic data in the National Territorial Information System (SNIT).\n\nArticle 13.\nOf environmental projects.\n\nRegarding environmental information generated in non-governmental environmental projects, which for this purpose expresses interest in joining SINIA, it must comply with the methodological regulations established in CENIGA-SINIA.\n\nArticle 14.\nOf financing.\n\nThe head of MINAE shall incorporate into the institution's planning and budget distribution instruments, via ordinary and/or extraordinary budget, the financial resources for CENIGA to fulfill the functions given in this decree; additionally, they must ensure the human, technological, and logistical resources for the sustainability of SINIA.\n\nThe heads of the different public entities that have the legal mandate to generate information related to the scope of SINIA must incorporate into their annual operational plans, work plans, and other planning strategies, the financing of activities related to their participation and support for the operation of the System; including the strengthening of capacities in technological matters and human resources for the sustainability and continuous improvement of SINIA and SNIT.\n\nPublic and private entities, including national and international cooperation organizations, shall endeavor, to the extent of their possibilities and within the current legal regulations, to contribute with the provision of economic, logistical, technical, and/or human resources for the operation of SINIA.\n\nArticle 15.\nOf the scope of application.\n\nThe information published on the environmental platforms managed by CENIGA is considered of national interest and fundamental to strengthen decision-making; therefore, the public sector is obliged to comply with this Decree.\n\nArticle 16.\nOf the official nature.\n\nThe official nature of the data is the responsibility of the institution that generates the information, which must be available in SINIA.\n\nArticle 17:\nAgreements and other publication mechanisms\n\nCENIGA shall enter into agreements with institutions from the public sector, private sector, academia, and any other body it deems pertinent in the generation of environmental information of interest to the country, which must be signed by the minister of MINAE and the interested party. Furthermore, letters of understanding or authorization forms or other instruments for the publication of information through SINIA may also be established, which must be signed between the parties responsible for managing or administering the information or related systems, and which support collaboration between the parties responsible for the management, administration, or maintenance of the information.\n\nArticle 18.\nDeclaration of Public Interest.\n\nThe establishment and operation of SINIA is declared to be of public interest.\n\nArticle 19.\nRepeal.\n\nExecutive Decree No. 29540-MINAE of May 11, 2001, Constitutes the National Geo-Environmental Information Center as an Organ of the General Directorate of Hydrocarbons of the Ministry of Environment and Energy, published in La Gaceta No. 105 of June 1, 2001, and Executive Decree No. 37658-MINAET of January 29, 2013, Establishment of the National Environmental Information System (SINIA) and Reform of Article 3 of Executive Decree No. 29540-MINAE of May 11, 2001, published in La Gaceta No. 93 of May 16, 2013, are hereby repealed.\n\nArticle 20.
