  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 45187\n\n                        Deroga Declara de Utilidad Pública para los intereses del Estado la\nAsociación Administrativa del Acueducto de Cot de Oreamuno de Cartago\n\nN°\n45187-MJP\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nEl MINISTRO DE JUSTICIA Y PAZ\n\nCon fundamento en lo dispuesto en los\nartículos 11, 140, inciso 18) y 146 de la Constitución Política, en los\nartículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley\nGeneral de Administración Pública N° 6227 del 1° de diciembre de 1978, en el\nartículo 32 de la Ley de Asociaciones N° 218 del 08 de agosto de 1939 y los\nartículos 27 y siguientes del Reglamento a la Ley de Asociaciones N° 29496-J,\npublicado en La Gaceta N° 96 del 21 de mayo del 2001.\n\nConsiderando:\n\nI.-Que el artículo 32 de la Ley de\nAsociaciones N° 218 del 08 de agosto de 1939 y sus reformas, confiere al Poder\nEjecutivo la potestad de declarar de utilidad pública a las asociaciones\nsimples, federadas o confederadas, cuyo desarrollo y actividades sean\nparticularmente útiles para los intereses del Estado, y que por ello\ncontribuyan a solventar una necesidad social.\n\nII.-Que la Asociación Administradora del\nAcueducto de Cot de Oreamuno, cédula jurídica número tres-cero cero\ndos-doscientos noventa mil setenta y nueve, se inscribió en el Registro de\nAsociaciones del Registro Público el veintinueve de noviembre de dos mil\ncuatro, al tomo cuatrocientos setenta y nueve, asiento once mil trescientos\nseis.\n\nIII.-Que\nel artículo 32 de la Ley de Asociaciones establece: \"(.) En cualquier momento,\nel Ministerio de Justicia y Paz, revocará este beneficio, si desaparecen los\nmotivos por los cuales fue concedido. (...) \". Finalmente, el numeral 33\nter del Reglamento a la \"Ley de Asociaciones, indica: \"En caso de que alguna\nasociación renuncie a la declaratoria de utilidad pública, deberá presentar la\ndocumentación correspondiente ante la Asesoría Jurídica del Ministerio de\nJusticia y Paz quien, sin más trámite, procederá a realizar la derogatoria.\"\n\nIV.-Que la Asociación Administradora del\nAcueducto de Cot de Oreamuno, fue declarada de utilidad pública por el\nMinisterio de Justicia y Paz, mediante Decreto Ejecutivo NO36120J del primero\nde julio de dos mil diez, publicado en el Diario Oficial La Gaceta,\nAlcance N O 157 del trece de agosto de dos mil diez.\n\nV.-Que con oficio ASADA-COT-JD-0095-2024\nde fecha cinco de noviembre de dos mil veinticuatro, el presidente de la junta\ndirectiva de la Asociación Administradora del Acueducto de Cot de Oreamuno,\nseñor Carlos Luis Méndez Méndez, portador de la cédula de identidad número\ntres-cero trescientos treinta y siete-cero trescientos veintinueve, comunicó la\nrenuncia de la asociación al beneficio de la declaratoria de utilidad pública\notorgada por el Ministerio de Justicia y Paz. Finally, numeral 33\nter of the Regulations to the \"Associations Act,\" indicates: \"In the event that any\nassociation renounces the declaration of public utility, it must submit the\ncorresponding documentation to the Legal Advisory Office of the Ministry\nof Justice and Peace, which, without further procedure, shall proceed to carry out the repeal.\"\n\nIV.-That the Administrative Association of the\nCot de Oreamuno Aqueduct was declared of public utility by the\nMinistry of Justice and Peace, through Executive Decree NO36120J of July\nfirst, two thousand ten, published in the Official Gazette La Gaceta,\nSupplement No. 157 of August thirteenth, two thousand ten.\n\nV.-That through official communication ASADA-COT-JD-0095-2024\ndated November fifth, two thousand twenty-four, the president of the board\nof directors of the Administrative Association of the Cot de Oreamuno Aqueduct,\nMr. Carlos Luis Méndez Méndez, holder of identity card number\nthree-zero three hundred thirty-seven-zero three hundred twenty-nine, communicated the\nassociation's renunciation of the benefit of the declaration of public utility\ngranted by the Ministry of Justice and Peace. Therefore,\n\nThey Decree\n\nTO REPEAL THE DECLARATION OF PUBLIC\nUTILITY\n\nOF THE ADMINISTRATIVE ASSOCIATION OF THE AQUEDUCT\n\nOF COT DE OREAMUNO\n\nArticle 1º-To render without effect Executive\nDecree NO36120-J of July first, two thousand ten, published in the\nOfficial Gazette La Gaceta, Supplement No. 157 of August thirteenth, two thousand\nten, through which the Administrative Association of the Cot de Oreamuno Aqueduct, legal\nidentification number three-zero zero two-two hundred ninety thousand seventy-nine, was declared of public utility for the interests of the\nState.\n\nArticle 2º-Once this decree is published,\nit must be communicated to the Registry of Associations of the National Registry\nfor its respective annotation.\n\nArticle 3º-The administration shall notify\nthis act to the Ministry of Finance, the General Directorate of Taxation,\nand the National Property Registry, so that they may proceed according to their\ncompetence.\n\nArticle 4º-It shall be effective as of its\npublication.\n\nGiven\nat the Presidency of the Republic.-San José, on the thirtieth day of June\nof the year two thousand twenty-five."
