  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 45244\n\n                        Reforma Reglamento a la Ley de Protección Fitosanitaria\n\nNº\n45244 -MAG\n\nEL PRESIDENTE DE LA REPÚBLICA,\n\nY EL MINISTRO DE AGRICULTURA Y GANADERÍA\n\nCon fundamento en las\natribuciones y facultades conferidas en los artículos 50, 140 incisos 3) y 18) y\n146 de la Constitución Política; los artículos 27 inciso 1) y artículo 28\ninciso 2) acápite b) de la Ley General de la Administración Pública, Nº 6227\ndel 2 de mayo de 1978; y los artículos 4, 5 inciso b de la Ley de Protección\nFitosanitaria Nº 7664 del 08 de abril de 1997, la Ley de Fomento a la\nProducción Agropecuaria y Orgánica del Ministerio de Agricultura y Ganadería,\nNº 7064 del 29 de abril de 1987 y la Ley de Protección al Ciudadano del Exceso\nde Requisitos y Trámites Administrativos, Ley Nº 8220 del 4 de marzo de 2002.\n\nCONSIDERANDO:\n\n1 º- Que, con el creciente\nintercambio comercial, por la apertura de mercados entre los países, las\nposibilidades de importaciones de equipos de aplicación se han incrementado y\npor ende se requiere de las respectivas regulaciones para garantizar los\nestándares de calidad del equipo.\n\n2°- Que conforme a lo\ndispuesto en la Ley de Protección Fitosanitaria Nº 7664 del 08 de abril de\n1997, es función esencial del Servicio Fitosanitario del Estado (SFE) regular\nel uso y manejo de equipos para aplicar en la agricultura, así mismo su\nregistro, importación, calidad y residuos, procurando al mismo tiempo proteger\nla salud humana y el ambiente, estableciendo los requisitos fitosanitarios y\nlos controles necesarios a las importaciones de muestras de equipos.\n\n3°- Que, conforme al\nartículo Nº 4 de la Ley de Protección al Ciudadano del Exceso de Trámites y\nRequisitos Administrativos, Ley Nº 8220 del 04 de marzo de 2002, todo trámite o\nrequisitos que el administrado debe cumplir deben constar en una ley, un\ndecreto o un reglamento y estar publicado en el diario oficial La Gaceta.\n\n4°- Que se hace conveniente\ny necesario reformar el artículo 93 del Decreto Ejecutivo No. 26921-MAG del 20\nde marzo de 1998 y sus reformas; Reglamento a la Ley de Protección\nFitosanitaria, para ajustarlo lo establecido en la Ley 8220 y así darle\npublicidad al instructivo que el Servicio Fitosanitario del Estado deberá tener\na disposición de los usuarios que pretendan hacer uso de un equipo de\naplicación.\n\n5°- Que, de conformidad con\nlos párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de\nProtección al Ciudadano del Exceso de Requisitos y Trámites Administrativos,\nDecreto Ejecutivo N.º 37045-MP-MEIC del 22 de febrero de 2012, el presente\nDecreto no crea ni modifica trámites, requisitos o procedimientos, por lo que\nno requiere del trámite de mejora regulatoria.\n\nPOR TANTO,\n\nDECRETAN:\n\nReforma del artículo 93 del Decreto\nEjecutivo No. 26921 MAG del 20 de marzo de\n\n1998 denominado \"Reglamento a la\nLey de Protección Fitosanitaria\"\n\nArtículo 1 º - Refórmense el artículo 93 del Decreto\nEjecutivo No. 26921-MAG del 20 de marzo de 1998 denominado: \"Reglamento a\nla Ley de Protección Fitosanitaria\", para que se lea de la siguiente forma:\n\n\"Artículo 93. -De\nla inscripción de equipos.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Standard 45244\n\n                        Reform of the Regulation to the Phytosanitary Protection Law\n\nNo.\n45244 -MAG\n\nTHE PRESIDENT OF THE REPUBLIC,\n\nAND THE MINISTER OF AGRICULTURE AND LIVESTOCK\n\nBased on the\npowers and authorities conferred in articles 50, 140 subsections 3) and 18) and\n146 of the Political Constitution; articles 27 subsection 1) and article 28\nsubsection 2) item b) of the General Law of Public Administration, No. 6227\nof May 2, 1978; and articles 4, 5 subsection b of the Phytosanitary Protection Law\nNo. 7664 of April 8, 1997, the Law for the Promotion of\nAgricultural and Organic Production of the Ministry of Agriculture and Livestock,\nNo. 7064 of April 29, 1987 and the Law for the Protection of Citizens from Excessive\nAdministrative Requirements and Procedures, Law No. 8220 of March 4, 2002.\n\nCONSIDERING:\n\n1 º- That, with the growing\ncommercial exchange, due to the opening of markets among countries, the\npossibilities of importing application equipment (equipos de aplicación) have increased\nand therefore the respective regulations are required to guarantee the\nquality standards of the equipment.\n\n2°- That pursuant to the\nprovisions of the Phytosanitary Protection Law No. 7664 of April 8,\n1997, it is an essential function of the State Phytosanitary Service (SFE) to regulate\nthe use and handling of equipment for application in agriculture, as well as its\nregistration, importation, quality and residues, while simultaneously seeking to protect\nhuman health and the environment, establishing the phytosanitary requirements and\nthe necessary controls on imports of equipment samples.\n\n3°- That, pursuant to\narticle No. 4 of the Law for the Protection of Citizens from Excessive Procedures and\nAdministrative Requirements, Law No. 8220 of March 4, 2002, every procedure or\nrequirement that the administered party must fulfill must be set forth in a law, a\ndecree or a regulation and be published in the official gazette La Gaceta.\n\n4°- That it is convenient\nand necessary to reform article 93 of Executive Decree No. 26921-MAG of March 20,\n1998 and its reforms; Regulation to the Phytosanitary Protection\nLaw, to adjust it to the provisions of Law 8220 and thus give\npublicity to the instructions that the State Phytosanitary Service must have\navailable for users who intend to make use of an application equipment (equipo de aplicación).\n\n5°- That, in accordance with\nthe second and third paragraphs of article 12 of the Regulation to the Law of\nProtection of Citizens from Excessive Administrative Requirements and Procedures,\nExecutive Decree No. 37045-MP-MEIC of February 22, 2012, the present\nDecree does not create or modify procedures, requirements or procedures, and therefore\ndoes not require the regulatory improvement process.\n\nTHEREFORE,\n\nTHEY DECREE:\n\nReform of article 93 of Executive Decree\nNo. 26921 MAG of March 20,\n\n1998 named \"Regulation to the\nPhytosanitary Protection Law\"\n\nArticle 1 º - Reform article 93 of Executive Decree\nNo. 26921-MAG of March 20, 1998 named: \"Regulation to\nthe Phytosanitary Protection Law\", so that it reads as follows:\n\n\"Article 93. -On\nthe registration of equipment.
