  "body_en_text": "throughout the entire text\n\n                    -\n\n                        Complete Text of Regulation 41\n\n                        Regulation for determining the concession fee in the Maritime-Terrestrial Zone for the current regulatory plan of Playa San Miguel\n\nMUNICIPALITY OF NANDAYURE\n\nThe Municipality of Nandayure, through subsection 1) of the single Article of the single point, Extraordinary Session No. E41-2025 held on October 24, 2025, definitively approved the Regulation for determining the concession fee in the Maritime-Terrestrial Zone for the current regulatory plan of Playa San Miguel.\n\nREGULATION FOR DETERMINING THE FEE\n\nFOR CONCESSION\nIN THE MARITIME-TERRESTRIAL ZONE\n\nFOR THE CURRENT\nREGULATORY PLAN\n\nPLAYA SAN\nMIGUEL\n\nArticle 1—The purpose of this regulation is to determine the percentage to be applied for the annual calculation of the fee arising from a concession in the maritime-terrestrial zone.\n\nArticle 2—This regulation shall form an integral part of the Regulatory Plan of Playa San Miguel, as established by Article 49 of the Regulation to the Maritime-Terrestrial Zone Law.\n\nArticle 3—The collection of the concession fee in the maritime-terrestrial zone shall be made annually in accordance with Article 51 bis of the Regulation to the Maritime-Terrestrial Zone Law.\n\nArticle 4—In the event of delay or non-payment of the concession fee in the maritime-terrestrial zone, the Municipality, based on the rate calculated for this purpose, shall charge the corresponding interest, without prejudice to applying the penalty provided for in subsection a) of Article 53 of the Maritime-Terrestrial Zone Law.\n\nArticle 5—The annual fees to be paid by the concession holders (concesionarios) and/or permit holders (permisionarios) of the maritime-terrestrial zone shall be regulated by applying the following percentages:\n\nUse Tourism Accommodation 1.50%\n\nResidential Use 1.25%\n\nTourist or Recreational Residential Use\n1.50%\n\nCommercial, Industrial, Mining or Extractive Use\n1.75%\n\nInstitutional Zone 1.50%\n\nArticle 6—In the case of persons of limited means who reside permanently in the zone and only when it concerns concessions intended exclusively for housing for local residents, the Municipality may calculate the fee based on 0.25% of the appraisal value in accordance with Article 52 of the Regulation to the Maritime-Terrestrial Zone Law.\n\nArticle 7—The fee percentage set forth in Article 5 of this regulation shall apply only to appraisals that become final as of the publication of this regulation.\n\nArticle 8—The fee may be adjusted each time the values in the homogeneous zones in the planned zone are adjusted, guaranteeing attractiveness for private investment while protecting the balance and strength of municipal finances.\n\nResponsible signature: Mr. Teddy Osvaldo Zúñiga Sánchez, Mayor of Nandayure."
