El decreto deroga el anterior decreto 26300-MINAE de 1997 y rige a partir de su publicación.",

  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 45238\n\n                        Creación de la Comisión Técnica Consultiva del Fenómeno Enos\n\nNº 45238 MINAE\n\nEL PRESIDENTE DE LA\nREPUBLICA\n\nY EL MINISTRO DE AMBIENTE Y\nENERGIA\n\nEn ejercicio de las\nfacultades que les confieren los artículos 50. 140 inciso 3) y 18) y el a1tículo\n146 de la Constitución Política: artículos 27 inciso 1) y 28 inciso 2) acápite\nb) de la Ley General de la Administración Pública Nº 6227 del 2 de mayo de\n1978. la Ley de Planificación Nacional No 5525 de 2 de mayo de 1974 y sus\nreformas, la Ley Orgánica del Ambiente Nº 7554 del 4 de octubre de 1995.\n\nCONSIDERANDO:\n\n1º-Que la Constitución\nPolítica de la República de Costa Rica consagra en su numeral 50 el derecho de\ntoda persona a un ambiente sano y ecológicamente equilibrado, así como el deber\ndel Estado de garantizar, defender y preservar ese derecho, lo que obliga a\nestablecer mecanismos que aseguren un ambiente ecológicamente sostenible para\ndesarrollarse.\n\n2º-Que el artículo 2°\ninciso c) de la Ley Orgánica del Ambiente Nº 7554 del 4 de octubre de 1995,\nestablece que el Estado velará por la utilización racional de los elementos\nambientales, con el fin de proteger y mejorar la calidad de vida de los\nhabitantes del país.\n\n3°-Que el Plan Nacional de\nDesarrollo e Inversión Pública 2023-2026 Rogelio Fernández Güell considera al\nciudadano y la búsqueda de su mayor bienestar y prosperidad, como un elemento\ncentral en la planificación estratégica de las distintas intervenciones\npúblicas, las cuales se ajustan a las necesidades actuales y futuras de la sociedad\ncostarricense, así como a las distintas agendas y objetivos internacionales\npara el desarrollo.\n\n4°-Que en el marco del desarrollo\nsostenible las variables ambientales son reconocidas por su gran importancia en\nlos análisis sobre la conducción del desarrollo nacional y contribuyen al\nestablecimiento de parámetros, que en conjunto con las variables sociales y\neconómicas permiten medir el comportamiento de la sostenibilidad del\ndesarrollo.\n\n5°-Que la Ley de\nPlanificación Nacional Nº 5525 del 2 de mayo de 1974 creó el Sistema Nacional\nde Planificación. confiriéndole la función de participar en las tareas\ntendientes a la formulación y adopción de planes y políticas de desarrollo\nnacional y establecer las labores de coordinación de los programas institucionales\nencargados de dichos planes y políticas.\n\n6°-Que Costa Rica es\nafectado por el fenómeno climático El Niño Oscilación del Sur denominado ENOS,\ncon sus fases conocidas como los fenómenos de El Niño y La Niña. Siendo el ENOS\nuna interacción océano-atmósfera que altera el comportamiento de la atmósfera a\nnivel regional y mundial, que produce alteraciones en el régimen de\nprecipitación y, o temperatura en función de cuál de sus fases está activa, lo\nque puede causar, tanto sequías -inclusive severas-. como inundaciones que\nconllevan repercusiones en la sociedad. Daños al ambiente. la producción\nagrícola y pesquera, al turismo, y a la infraestructura, así como a la\ngeneración hidroeléctrica y el abastecimiento de agua para consumo humano y\nriego. Asimismo, las implicaciones sociales se manifiestan en la disminución de\nlas oportunidades de empleo, problemas de salud y el insuficiente\nabastecimiento de alimentos en los lugares que resulten afectados.\n\n7°-Que el ENOS es un\nfenómeno recurrente que podría verse alterado en su periodicidad e intensidad\npor el cambio climático, por lo que sus efectos podrían aumentar gradualmente.\n\n8°-Que corresponde al\nInstituto Meteorológico Nacional (IMN) como ente técnico-científico, adscrito\nal Ministerio de Ambiente y Energía (MINAE), emitir la información oficial correspondiente\na la recopilación y el seguimiento sistemático de la información climática y meteorológica,\nlos informes mensuales de diagnóstico y pronóstico del fenómeno ENOS con el\nobjetivo de apoyar con información científica la toma de decisiones de las\ninstituciones de primera respuesta y gubernamentales además de la ciudadanía en\ngeneral: así como para la definición de la política de desarrollo en este\ncampo.\n\n9° -Que con la información\nmeteorológica disponible en la actualidad sobre el desarrollo del fenómeno\nENOS. el IMN emitirá pronósticos de corto, mediano y largo plazo que pueden ser\nincorporados en la toma de decisiones. lo que facilita la planificación para la\nmitigación de los impactos que este fenómeno causa a nuestra sociedad y a los\nsectores productivos.\n\n10°-Que con el fin de\nincorporar información sobre las variaciones climáticas producidas por el\nFenómeno ENOS y sus interacciones con otras oscilaciones océano atmosféricas en\nla planificación para el desarrollo. debe establecerse una coordinación\ninterinstitucional tendiente a formalizar mecanismos dirigidos a la\nrecopilación, intercambio e interpretación de esta información. así como informar\nsobre los efectos que el fenómeno está causando a nivel nacional.\n\n11º-. Que conforme a lo\nanterior es necesario derogar el Decreto Ejecutivo Nº 26300-MINAE del 17 de\njunio de 1997. Creación Comisión Técnica Consultiva Nacional del Fenómeno ENOS.\ncon el fin de actualizar su conformación con el propósito de asesorar a los\njerarcas ministeriales o sus designados de alto nivel al Sistema Nacional de\nRiesgo y otras instancias que se vean afectadas por dicho fenómeno climático.\n\n12°- Que el Decreto\nEjecutivo Nº 26827-PLAN del 06 de marzo de 1998 denominado Crea Sistema\nNacional para el Desarrollo Sostenible (SINADES), fue derogado por el artículo\n31 del Decreto Ejecutivo Nº 34582-MP-PLAN del 4 de junio de 2008. Denominado \"Reglamento\nOrgánico del Poder Ejecutivo'', por eso esta Comisión Técnica Consultiva, ya no\nes instancia técnica  del SINADES, y\nrequieren de una nueva creación y conformación, para responsabilidad del\nMinisterio de Ambiente y Energía.\n\n13°-. Que, de conformidad\ncon el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos\ny Trámites Administrativos, Decreto Ejecutivo Nº 37045-M-PMEIC del 22 de\nfebrero del 2012 y sus reformas, se determinó que la presente propuesta no\nestablece ni modifica trámites, requisitos o procedimientos que el administrado\ndeba cumplir, situación por la que no se procedió con el trámite de control\nprevio.\n\nPor tanto;\n\nDECRETAN:\n\nCREACIÓN DE LA COMISIÓN\nTECNICA CONSULT.IVA\n\nDEL FENÓMENO ENOS\n\nArtículo 1º. Constitúyase la Comisión Técnica Consultiva del Fenómeno ENOS. en\nadelante denominada. COENOS como instancia técnico-consultiva ministerial para\nla atención del Fenómeno ENOS y otros fenómenos relevantes vinculados con este.\nademás de la previsión del clima como consecuencia de estos fenómenos.\n\nArtículo 2°.- La COENOS estará integrada por miembros titulares y suplentes con\ncapacidad de toma de decisiones de las siguientes instituciones:\n\na) Instituto Meteorológico\nNacional, en calidad de coordinador,\n\nb) Ministerio de\nAgricultura y Ganadería,\n\nc) Instituto Costarricense\nde Electricidad,\n\nd) Acueductos y Alcantarillados,\n\ne) Ministerio de Obras\nPúblicas y Transportes,\n\nf) Instituto Costarricense\nde Pesca y Acuicultura,\n\ng) Instituto Costarricense\nde Turismo,\n\nh) Ministerio de\nPlanificación Nacional y Política Económica,\n\ni) Comisión Nacional de\nIncendios Forestales del Sistema Nacional de Áreas de Conservación,\n\nj) Comisión Nacional de\nPrevención de Riesgos y Atención de Emergencias.\n\nCada jerarca de la\ninstitución integrante de la Comisión Técnica Consultiva del Fenómeno ENOS,\nnombrará por escrito en forma independiente a dos representantes: un titular,\nel cual deberá tener grado profesional, amplio conocimiento en la actividad\nsustantiva de la institución a la que representa y con autoridad suficiente\npara adoptar decisiones a nombre de su representada: y el representante\nsuplente. con grado profesional de especialidad técnica y manejo de datos de\nlas afectaciones causadas por el fenómeno ENOS y cualquier otro fenómeno\nclimático relevante. Si la representación de la institución estuviera ausente\nsin la debida justificación. durante tres sesiones consecutivas, se le\nsolicitará a su superior jerárquico un reemplazo definitivo. tanto del titular\ncomo del suplente.\n\nEl nombramiento de los\nmiembros de esta Comisión Técnica Consultiva Nacional del Fenómeno ENOS será\npor tres años y podrá ser prorrogado por un periodo igual. Cuando por cualquier\nmotivo fuere necesario sustituir un miembro de la Junta que no hubiere cumplido\nla totalidad de su período, el sustituto se considerará nombrado únicamente por\nel período restante que tenga nombrado el titular.\n\nArtículo 3°.- De las sesiones:\n\na) Las sesiones de la\nCOENOS serán de dos tipos: ordinarias y extraordinarias. En las sesiones\nordinarias se analizarán los asuntos que figuren en el orden del día y en las extraordinarias,\ntodos aquellos que presentan un carácter realmente extraordinario o de\nemergencia.\n\nSe sesionará como mínimo\ntres sesiones al año, las fechas serán definidas anualmente por la COENOS en la\nprimera reunión de cada año y de forma extraordinaria cuando sea convocada por\nla Coordinación, exponiendo las razones de la misma. La Comisión sesionará en\nhoras hábiles, para lo cual cada uno de los miembros que asistan, disfrutará\ndel permiso correspondiente con goce de salario, para cumplir con los fines de\nla misma.\n\nEn caso de que por motivos\nespeciales no se sesione o se suspenda la misma, los miembros deben\nincorporarse a sus labores habituales.\n\nb) El quórum lo conformará\nla mitad más uno de la totalidad de sus miembros titulares (seis). Los miembros\nsuplentes deberán asistir a las sesiones, con voz. pero sin voto, salvo en que\nse encuentren en sustitución de un miembro titular.\n\nLas sesiones se iniciarán\npuntualmente a la hora establecida en la convocatoria respectiva y si treinta\nminutos después no hubiese quórum, se sesionará en carácter de urgencia con la\ntercera parte de los miembros titulares (tres). Las ausencias injustificadas\nque originen la falta de quórum serán comunicadas a las instancias respectivas.\ncon la finalidad que éstas asuman las responsabilidades del caso.\n\nEn los casos en que un\nmiembro propietario no pueda asistir a una sesión, estará en la obligación de\njustificarlo por escrito con antelación a la Coordinación del comité, y\ncomunicar dicha circunstancia al miembro suplente para que lo sustituya, en su ausencia.\n\nCuando por circunstancias\nextraordinarias -que no impliquen la falta de quórum- la sesión no se pueda\nefectuar, esta quedará programada para una fecha posterior de común acuerdo.\n\nc) A la Secretaría\nEjecutiva le corresponde confeccionar un acta por cada sesión que se realice,\nsea ordinaria o extraordinaria, la cual se identificará con un número consecutivo.\ndebiéndose entregar copia de la misma a cada miembro. Para la aprobación. una\nvez concluida la lectura del acta anterior, la Coordinación podrá conceder la\npalabra a cada miembro por una única vez y la someterá a votación con las\nmodificaciones del caso, si las hubiera. Las actas deberán ser firmadas por la Coordinación\ny por la Secretaría Ejecutiva de la comisión, una vez finalizada la sesión.\n\nLa COENOS. podrá autorizar\nla asistencia de invitados o sectores. a fin de tratar asuntos específicos.\n\nArtículo 4º.- En función de la intensidad y de los efectos del fenómeno ENOS, el IMN\ncomo entidad coordinadora. podría convocar a los jerarcas del Ministerio de\nAmbiente y Energía (MINAE). Ministerio de Agricultura y Ganadería (MAG). el\nMinisterio de Obras Públicas y Transportes (MOPT), el Instituto Costarricense\nde Electricidad (ICE). la Comisión Nacional de Prevención de Riesgos y Atención\nde Emergencias (CNE) y otros que se considere necesarios. para informarles\nsobre la situación del evento en cuestión. Esto con el objetivo de que se tomen\nlas medidas pertinentes para prevenir y mitigar los efectos del fenómeno.\n\nArtículo 5°.- Las instituciones que forman parte de esta Comisión deben presentar ante\nCOENOS. en forma periódica según acuerdo, los informes sobre las afectaciones\ncausadas por el fenómeno ENOS y cualquier otro fenómeno climático relevante.\n\nArtículo 6.° La coordinación de la COENOS estará a cargo del representante\nque designe el Instituto Meteorológico Nacional.\n\nArtículo 7.° La COENOS elegirá por mayoría simple entre los miembros\nintegrantes de la Comisión a quien ostente el cargo de la Secretaría Ejecutiva,\npor el periodo establecido en el artículo 2.\n\nArtículo 8.° La COENOS tendrá como objetivos generales los siguientes:\n\na) Promover la generación y\nutilización de la información relativa al Fenómeno ENOS a nivel\ninterinstitucional y civil, de manera que, con antelación, permita a los diferentes\nsectores de la sociedad costarricense efectuar la toma de decisiones oportuna\nen sus actividades con el objetivo de prevenir y mitigar los impactos provocados\npor este y otros fenómenos relevantes vinculados al mismo.\n\nb) Apoyar acciones que permitan\nmejorar la calidad de la información relativa al Fenómeno ENOS y sus impactos.\n\nc) Propiciar el\nestablecimiento de mecanismos de coordinación entre los usuarios y la información\nproveniente del IMN referente al Fenómeno ENOS.\n\nd) Promover que la\ninformación generada y demandada por los diferentes sectores responda a las\nprioridades nacionales en lo concerniente a la prevención y mitigación de los\nefectos climáticos y meteorológicos.\n\ne) Promover el acceso de\ntodos los sectores de la sociedad costarricense a la información relativa al\nFenómeno ENOS. con el objetivo de apoyar el desarrollo de acciones y programas\nque ejecuten estos sectores en el marco del desarrollo sostenible.\n\nArtículo 9.° La COENOS tendrá las siguientes funciones:\n\na) Asesorar a órganos,\nentes y empresas del Estado y a organizaciones privadas en asuntos referentes a\nla utilización de información sobre el Fenómeno ENOS, para sustentar y apoyar\nel desarrollo de políticas generales y áreas de interés nacional.\n\nb) Recomendar a los\ndiferentes sectores la ejecución de programas y proyectos dirigidos a\ndesarrollar o mejorar mecanismos de recolección y procesamiento de la\ninformación referida en el artículo N° 8 inciso a). de este decreto.\n\nc) Generar condiciones que\ncontribuyan a fortalecer la capacidad técnica del Instituto Meteorológico\nNacional (IMN) en predicción climática, a fin de apoyar a la sociedad en la\nmitigación de los impactos del Fenómeno ENOS.\n\nd) Proponer mecanismos para\nla utilización y aprovechamiento conjunto de la información climática y\nmeteorológica en la planificación nacional.\n\ne) Coordinar el\nestablecimiento y consolidación de un Sistema Nacional de Información sobre el\nFenómeno ENOS.\n\nArtículo 10.º Se insta a los Ministerios y demás instituciones del Estado a cooperar\nen el suministro la información que requiera la COENOS. para el estudio.\nanálisis y elaboración de propuestas técnicas de producción. procesamiento.\nmanejo y sistematización de la información referente al Fenómeno ENOS.\n\nArtículo 11.° La COENOS gestionará la obtención de recursos financieros y asistencia técnica\nque permitan realizar actividades de investigación. promoción. capacitación y difusión\nen materia de comunicación y producción de información sobre el Fenómeno ENOS.\n\nArtículo 12.º Los integrantes de la COENOS le brindarán el apoyo logístico necesario\npara su funcionamiento y cumplimiento de sus objetivos.\n\nArtículo 13.º Las instituciones de acuerdo con el artículo 2 °, una vez publicado el\npresente Decreto Ejecutivo tendrán un mes de tiempo para designar sus\nrepresentantes, titular y suplente. los cuales durarán en sus funciones tres\naños, pudiendo ser prorrogada su designación por las instituciones, de acuerdo\ncon el desarrollo de las funciones de COENOS.\n\nArtículo 14.º Deróguese el Decreto Ejecutivo Nº 26300-MINAE del 17 de junio de 1997, denominado\nCreación Comisión Técnica Consultiva Nacional del Fenómeno ENOS, publicado en\nel periódico oficial La Gaceta Nº 183 del 24 de setiembre de 1997.\n\nArtículo 15°- Rige a partir de su publicación en el Diario Oficial La Gaceta.\n\nDado en la Presidencia de la República. a los 28\ndías del mes de julio del dos mil veinticinco",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 45238\n\n                        Creation of the Technical Advisory Commission for the Enso Phenomenon\n\nNo. 45238 MINAE\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND\nENERGY\n\nExercising the\npowers conferred upon them by Articles 50, 140 subsections 3) and 18), and Article\n146 of the Political Constitution; Articles 27 subsection 1) and 28 subsection 2) paragraph\nb) of the General Law on Public Administration No. 6227 of May 2,\n1978, the National Planning Law No. 5525 of May 2, 1974 and its\namendments, the Organic Law of the Environment No. 7554 of October 4, 1995.\n\nCONSIDERING:\n\n1º-That the Political\nConstitution of the Republic of Costa Rica enshrines in its numeral 50 the right\nof every person to a healthy and ecologically balanced environment, as well as the duty\nof the State to guarantee, defend, and preserve that right, which requires\nestablishing mechanisms to ensure an ecologically sustainable environment for\ndevelopment.\n\n2º-That Article 2°,\nsubsection c) of the Organic Law of the Environment No. 7554 of October 4, 1995,\nestablishes that the State shall ensure the rational use of environmental\nelements, in order to protect and improve the quality of life of the\ninhabitants of the country.\n\n3°-That the National Development\nand Public Investment Plan 2023-2026 Rogelio Fernández Güell considers the\ncitizen and the pursuit of their greater well-being and prosperity as a central\nelement in the strategic planning of the various public\ninterventions, which are adjusted to the current and future needs of Costa Rican\nsociety, as well as to the various international agendas and objectives\nfor development.\n\n4°-That within the framework of sustainable\ndevelopment, environmental variables are recognized for their great importance in\nanalyses regarding the direction of national development and contribute to the\nestablishment of parameters, which, together with social and economic variables,\nallow for measuring the performance of development\nsustainability.\n\n5°-That the National\nPlanning Law No. 5525 of May 2, 1974 created the National\nPlanning System, conferring upon it the function of participating in tasks\naimed at the formulation and adoption of national development plans and policies\nand establishing the coordination tasks of the institutional programs\nin charge of said plans and policies.\n\n6°-That Costa Rica is\naffected by the climatic phenomenon El Niño Southern Oscillation called ENOS,\nwith its phases known as the El Niño and La Niña phenomena. ENOS being\nan ocean-atmosphere interaction that alters atmospheric behavior at a\nregional and global level, which produces alterations in the precipitation\nand/or temperature regime depending on which of its phases is active,\nwhich can cause both droughts—including severe ones—and floods that\nentail repercussions for society, damage to the environment,\nagricultural and fishing production, tourism, and infrastructure, as well as\nhydroelectric generation and the supply of water for human consumption and\nirrigation. Likewise, the social implications are manifested in the reduction of\nemployment opportunities, health problems, and insufficient\nfood supply in the affected places.\n\n7°-That ENOS is a\nrecurrent phenomenon that could see its periodicity and intensity altered\nby climate change, meaning its effects could gradually increase.\n\n8°-That it is the responsibility of the\nInstituto Meteorológico Nacional (IMN) as a technical-scientific entity, attached\nto the Ministerio de Ambiente y Energía (MINAE), to issue the official information corresponding\nto the systematic compilation and monitoring of climatic and meteorological information,\nthe monthly diagnostic and forecast reports of the ENOS phenomenon with the\nobjective of supporting, with scientific information, the decision-making of\nfirst-response and governmental institutions as well as the general\npublic; also for the definition of development policy in this\nfield.\n\n9°-That with the meteorological\ninformation currently available on the development of the ENOS\nphenomenon, the IMN will issue short, medium, and long-term forecasts that can be\nincorporated into decision-making, which facilitates planning for the\nmitigation of the impacts that this phenomenon causes to our society and to the\nproductive sectors.\n\n10°-That in order to\nincorporate information on the climatic variations produced by the\nENOS Phenomenon and its interactions with other ocean-atmospheric oscillations into\ndevelopment planning, inter-institutional coordination must be established\naimed at formalizing mechanisms directed at the\ncompilation, exchange, and interpretation of this information, as well as reporting\non the effects that the phenomenon is causing at the national level.\n\n11º-. That in accordance with the\nforegoing, it is necessary to repeal Decreto Ejecutivo No. 26300-MINAE of June 17,\n1997, Creation of the National Technical Advisory Commission for the ENOS Phenomenon,\nin order to update its composition with the purpose of advising the\nministerial heads or their high-level designees, the National\nRisk System, and other instances affected by said climatic phenomenon.\n\n12°- That Decreto Ejecutivo\nNo. 26827-PLAN of March 6, 1998, called Crea Sistema\nNacional para el Desarrollo Sostenible (SINADES), was repealed by Article\n31 of Decreto Ejecutivo No. 34582-MP-PLAN of June 4, 2008, called \"Reglamento\nOrgánico del Poder Ejecutivo,\" therefore this Technical Advisory Commission is no\nlonger a technical body of SINADES, and requires a new creation and\ncomposition, under the responsibility of the Ministerio de Ambiente y Energía.\n\n13°-. That, in accordance\nwith the Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos\ny Trámites Administrativos, Decreto Ejecutivo No. 37045-M-PMEIC of February 22,\n2012 and its amendments, it was determined that this proposal does\nnot establish or modify procedures, requirements, or processes that the administered party\nmust comply with, a situation for which the prior control procedure was not carried out.\n\nPor tanto;\n\nDECREE:\n\nCREATION OF THE TECHNICAL ADVISORY COMMISSION\nFOR THE ENOS PHENOMENON\n\nArticle 1º. The Technical Advisory Commission for the ENOS Phenomenon is hereby constituted, hereinafter\ncalled, COENOS, as a ministerial technical-advisory body for\naddressing the ENOS Phenomenon and other relevant phenomena linked to it,\nin addition to climate forecasting as a consequence of these phenomena.\n\nArticle 2°.- COENOS shall be composed of titular and alternate members with\ndecision-making capacity from the following institutions:\n\na) Instituto Meteorológico\nNacional, in the capacity of coordinator,\n\nb) Ministry of\nAgriculture and Livestock,\n\nc) Instituto Costarricense\nde Electricidad,\n\nd) Acueductos y Alcantarillados,\n\ne) Ministry of Public\nWorks and Transport,\n\nf) Instituto Costarricense\nde Pesca y Acuicultura,\n\ng) Instituto Costarricense\nde Turismo,\n\nh) Ministry of\nNational Planning and Economic Policy,\n\ni) Comisión Nacional de\nIncendios Forestales of the Sistema Nacional de Áreas de Conservación,\n\nj) Comisión Nacional de\nPrevención de Riesgos y Atención de Emergencias.\n\nEach head of the\ninstitution that is a member of the Technical Advisory Commission for the ENOS Phenomenon\nshall independently appoint in writing two representatives: a titular member,\nwho must have a professional degree, extensive knowledge of the substantive\nactivity of the institution they represent, and sufficient authority\nto adopt decisions on behalf of their represented entity; and the alternate\nrepresentative, with a professional degree in a technical specialty and data management concerning the\nimpacts caused by the ENOS phenomenon and any other relevant\nclimatic phenomenon. If the representative of the institution is absent\nwithout due justification for three consecutive sessions, their\nhierarchical superior shall be requested to provide a definitive replacement, for both the titular\nand the alternate members.\n\nThe appointment of the\nmembers of this National Technical Advisory Commission for the ENOS Phenomenon shall\nbe for three years and may be extended for an equal period. When for any\nreason it is necessary to substitute a member of the Commission who has not completed\ntheir entire term, the substitute shall be considered appointed only for\nthe remaining period that the titular member had been appointed for.\n\nArticle 3°.- Regarding sessions:\n\na) COENOS sessions\nshall be of two types: ordinary and extraordinary. In ordinary\nsessions, matters appearing on the agenda shall be analyzed, and in extraordinary sessions,\nall those matters that are of a truly extraordinary or emergency nature.\n\nSessions shall be held at least\nthree times per year; the dates shall be defined annually by COENOS at the\nfirst meeting of each year, and extraordinarily when convened by\nthe Coordinator, stating the reasons for doing so. The Commission shall meet during\nbusiness hours, for which each of the attending members shall enjoy\nthe corresponding leave with pay to fulfill its purposes.\n\nIn the event that for special\nreasons it does not meet or the session is suspended, the members\nmust return to their regular duties.\n\nb) The quorum shall be constituted by\nhalf plus one of the total of its titular members (six). Alternate\nmembers must attend the sessions, with voice but no vote, except when\nthey are substituting for a titular member.\n\nSessions shall begin\npunctually at the time established in the respective notice, and if thirty\nminutes later there is no quorum, the session shall be held on an urgent basis with\none-third of the titular members (three). Unjustified absences\nthat cause a lack of quorum shall be communicated to the respective authorities,\nso that they may assume the corresponding responsibilities.\n\nIn cases where a\nprincipal member cannot attend a session, they shall be obliged to\njustify it in writing in advance to the committee's Coordinator, and\nto communicate said circumstance to the alternate member so that they may substitute for them, in their absence.\n\nWhen due to extraordinary\ncircumstances —which do not imply a lack of quorum— the session cannot be\nheld, it shall be scheduled for a later date by mutual agreement.\n\nc) The Executive Secretary\nis responsible for preparing minutes for each session held,\nwhether ordinary or extraordinary, which shall be identified with a consecutive number,\nand a copy must be delivered to each member. For approval, once\nthe reading of the previous minutes is concluded, the Coordinator may grant the\nfloor to each member once and shall submit it to a vote with\nany relevant modifications, if any. The minutes must be signed by the Coordinator\nand by the Executive Secretary of the commission, once the session is concluded.\n\nCOENOS may authorize\nthe attendance of guests or sectors in order to address specific matters.\n\nArticle 4º.- Depending on the intensity and effects of the ENOS phenomenon, the IMN,\nas the coordinating entity, may convene the heads of the Ministerio de\nAmbiente y Energía (MINAE), the Ministry of Agriculture and Livestock (MAG),\nthe Ministry of Public Works and Transport (MOPT), the Instituto Costarricense\nde Electricidad (ICE), the Comisión Nacional de Prevención de Riesgos y Atención\nde Emergencias (CNE), and others deemed necessary, to inform them\nabout the situation of the event in question. This is for the purpose of ensuring that\nthe pertinent measures are taken to prevent and mitigate the effects of the phenomenon.\n\nArticle 5°.- The institutions that form part of this Commission must periodically present to COENOS,\nas agreed, reports on the impacts\ncaused by the ENOS phenomenon and any other relevant climatic phenomenon.\n\nArticle 6.° The coordination of COENOS shall be in charge of the representative\ndesignated by the Instituto Meteorológico Nacional.\n\nArticle 7.° COENOS shall elect by simple majority from among the\nmember institutions of the Commission the person who holds the position of Executive Secretary,\nfor the period established in Article 2.\n\nArticle 8.° COENOS shall have the following general objectives:\n\na) To promote the generation and\nuse of information relating to the ENOS Phenomenon at the\ninter-institutional and civil levels, so that, in advance, it allows the different\nsectors of Costa Rican society to make timely decisions\nin their activities with the objective of preventing and mitigating the impacts caused\nby this and other relevant phenomena linked to it.\n\nb) To support actions that allow\nfor improving the quality of information relating to the ENOS Phenomenon and its impacts.\n\nc) To promote the\nestablishment of coordination mechanisms between users and the\ninformation from the IMN concerning the ENOS Phenomenon.\n\nd) To promote that the\ninformation generated and demanded by the different sectors responds to\nnational priorities regarding the prevention and mitigation of\nclimatic and meteorological effects.\n\ne) To promote access for\nall sectors of Costa Rican society to information relating to the\nENOS Phenomenon, with the objective of supporting the development of actions and programs\ncarried out by these sectors within the framework of sustainable development.\n\nArticle 9.° COENOS shall have the following functions:\n\na) To advise organs,\nentities, and state companies and private organizations on matters concerning\nthe use of information on the ENOS Phenomenon, to sustain and support\nthe development of general policies and areas of national interest.\n\nb) To recommend to the\ndifferent sectors the execution of programs and projects aimed at\ndeveloping or improving mechanisms for collecting and processing the\ninformation referred to in Article No. 8, subsection a), of this decree.\n\nc) To generate conditions that\ncontribute to strengthening the technical capacity of the Instituto Meteorológico\nNacional (IMN) in climate prediction, in order to support society in\nmitigating the impacts of the ENOS Phenomenon.\n\nd) To propose mechanisms for\nthe joint use and harnessing of climatic and meteorological\ninformation in national planning.\n\ne) To coordinate the\nestablishment and consolidation of a National Information System on the\nENOS Phenomenon.\n\nArticle 10.º Ministries and other State institutions are urged to cooperate\nin supplying the information required by COENOS for the study,\nanalysis, and preparation of technical proposals for the production, processing,\nmanagement, and systematization of information concerning the ENOS Phenomenon.\n\nArticle 11.° COENOS shall manage the procurement of financial resources and technical assistance\nthat allow for carrying out activities of research, promotion, training, and dissemination\nin the area of communication and production of information on the ENOS Phenomenon.\n\nArticle 12.º The members of COENOS shall provide the logistical support necessary\nfor its operation and fulfillment of its objectives.\n\nArticle 13.º The institutions in accordance with Article 2°, once this\nDecreto Ejecutivo is published, shall have one month to designate their\nrepresentatives, titular and alternate, who shall serve in their functions for three\nyears, and their designation may be extended by the institutions, in accordance\nwith the development of COENOS's functions.\n\nArticle 14.º Decreto Ejecutivo No. 26300-MINAE of June 17, 1997, called\nCreación Comisión Técnica Consultiva Nacional del Fenómeno ENOS, published in\nthe official newspaper La Gaceta No. 183 of September 24, 1997, is hereby repealed.\n\nArticle 15°- It shall become effective upon its publication in the Official Gazette La Gaceta.\n\nDone at the Presidency of the Republic, on the 28th\nday of the month of July, two thousand twenty-five."
