  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 084\n\n                        Reforma Reglamento para la gestión integral de residuos sólidos\n\nMUNICIPALIDAD DE SAN JOSÈ\n\nModificación al Artículo\n130 del Reglamento para la Gestión Integral de Residuos Sólidos\n\nAcuerdo 1, Artículo IV de\nla Sesión Ordinaria No. 084, celebrada por la Corporación Municipal del Cantón\nCentral de San José, el 09 de diciembre del año Dos mil veinticinco.\n\nCONSIDERANDO\n\nPRIMERO: Los Artículos 169 y 170 de la Constitución Política establecen que la\nadministración de los intereses y servicios locales en cada cantón estará a\ncargo del Gobierno Municipal y que las corporaciones municipales son autónomas,\nrazón por la cual corresponde a las Municipalidades la adopción de las políticas\npúblicas y las reglamentaciones necesarias para la prestación efectiva de los\nservicios y para la satisfacción de las necesidades de las personas habitantes\ndel Cantón.\n\nSEGUNDO: Mediante el Acuerdo 2, Artículo IV, Sesión Ordinaria No. 052, celebrada\npor la Corporación Municipal del Cantón Central de San José, el 29 de abril del\naño 2025 se acordó realizar la segunda y última publicación en El Diario\nOficial La Gaceta para su entrada en vigor, de conformidad con lo dispuesto en\nel Artículo 43 del Código Municipal.\n\nTERCERO: El REGLAMENTO PARA LA GESTIÓN INTEGRAL DE RESIDUOS SÓLIDOS DEL\n\nCANTÓN CENTRAL DE SAN JOSÉ entró en vigencia\nel día miércoles 21 de mayo del 2025 al publicarse por segunda vez en Alcance\nNo 64 a la Gaceta No 91.\n\nCUARTO: Habiendo sido presentada la modificación del Artículo 130 en la Comisión\nde Asuntos Ambientales para conocimiento de las diferentes fracciones que\nintegran el Concejo Municipal, y al remitirse la información a todas las\nregidurías vía correo electrónico, se solicita la aprobación de la presente\nmodificación al Reglamento de Gestión Integral de Residuos Sólidos para una\nmejor gestión de cobro, la administración solicita realizar una modificación al\nArtículo 130 sobre el cálculo de infracciones leves.\n\nQUINTO: Que la primera publicación de lo dispuesto en el Acuerdo N° 15, Artículo\nIV, Sesión ordinaria No. 079, celebrada por el Concejo Municipal el 03 de\nnoviembre 2025, que propuso la reforma del texto del Artículo 130 del RGIRS de\nla Municipalidad del Cantón Central de San José, se realizó en la Gaceta N° 217\ndel 18 de noviembre 2025 y que, transcurrido el plazo de ley, no se han\nrecibido observaciones en la Administración Municipal.\n\nPOR TANTO\n\nPRIMERO: El Concejo de la Municipalidad de San José con sustento en la normativa\nque rige la materia, emite el presente acuerdo de modificación al Artículo 130\ndel Reglamento para la Gestión Integral de Residuos Sólidos de la Municipalidad\ndel Cantón Central de San José:\n\n \n\nReglamento de Gestión Integral de Residuos Sólidos\n\nModificación Reglamento de Gestión Integral de Residuos\n  Sólidos\n\nArtículo 130: Cálculo de\n  las Infracciones Leves.\n\n \n\nLas Infracciones Leves\n  serán sancionadas, con cinco veces la tarifa que corresponda, de acuerdo con\n  la categoría asignada por la Municipalidad.\n\nLas multas se calcularán\n  de acuerdo a la categoría asignada y la siguiente\n  fórmula:\n\n \n\nFÓRMULA SECTOR\n  RESIDENCIAL PÚBLICO Y RELIGIOSO:\n\n \n\nMLVR=TAR*MLP*F\n\n.  MLVR= Monto de la multa por falta leve sector\n  residencial público y religioso.\n\n.   TAR= R*4 o TAR: Tasa anualizada residencial\n  público y religioso por metro lineal de frente de propiedad vigente al\n  momento de la infracción o R: monto al cobro en periodo trimestral o 4:\n  trimestres del año\n\n.   MLP: Metros lineales de frente de\n\npropiedad\n\n.   F=5: Factor a aplicar para multa\n\nleve: 5\n\n \n\nFÓRMULA SECTOR COMERCIAL\n  PERIFERIA: MLVR=TAP*MLP*F\n\n \n\n.  MLVP= Monto de la multa por falta\n\nleve sector comercial periferia\n\nTAP= P*4 o TAP: Tasa anualizada comercial periferia por metro\n  lineal\n\nde frente de propiedad\n  vigente al\n\nmomento de la infracción\n  o P: monto\n\nal cobro en período\n  trimestral o 4:\n\ntrimestres del año\n\n.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 084\n\n                        Amendment to the Regulation for the Comprehensive Management of Solid Waste\n\nMUNICIPALITY OF SAN JOSÉ\n\nAmendment to Article\n130 of the Regulation for the Comprehensive Management of Solid Waste\n\nAgreement 1, Article IV of\nOrdinary Session No. 084, held by the Municipal Council of the Central\nCanton of San José, on 09 December, Two Thousand Twenty-Five.\n\nCONSIDERING\n\nFIRST: Articles 169 and 170 of the Political Constitution establish that the\nadministration of local interests and services in each canton shall be\nthe responsibility of the Municipal Government and that municipal corporations are autonomous,\nwhich is why it corresponds to the Municipalities to adopt public\npolicies and the regulations necessary for the effective provision of\nservices and for satisfying the needs of the inhabitants\nof the Canton.\n\nSECOND: Through Agreement 2, Article IV, Ordinary Session No. 052, held\nby the Municipal Council of the Central Canton of San José, on 29 April,\n2025, it was agreed to carry out the second and final publication in The Official\nGazette La Gaceta for its entry into force, in accordance with the provisions of\nArticle 43 of the Municipal Code.\n\nTHIRD: THE REGULATION FOR THE COMPREHENSIVE MANAGEMENT OF SOLID WASTE OF THE\n\nCENTRAL CANTON OF SAN JOSÉ entered into force\non Wednesday, 21 May 2025, upon its second publication in Supplement\nNo. 64 to Gazette No. 91.\n\nFOURTH: The amendment to Article 130 having been presented to the Commission\non Environmental Affairs for the knowledge of the different factions that\nmake up the Municipal Council, and upon sending the information to all\ncouncil members' offices via email, the approval of this\namendment to the Regulation for the Comprehensive Management of Solid Waste is requested for\nbetter charge management; the administration requests an amendment to\nArticle 130 regarding the calculation of minor infractions (infracciones leves).\n\nFIFTH: That the first publication of the provisions in Agreement No. 15, Article\nIV, Ordinary Session No. 079, held by the Municipal Council on 03\nNovember 2025, which proposed the reform of the text of Article 130 of the RGIRS of\nthe Municipality of the Central Canton of San José, was carried out in Gazette No. 217\nof 18 November 2025, and that, the legal period having elapsed, no\nobservations have been received by the Municipal Administration.\n\nTHEREFORE\n\nFIRST: The Council of the Municipality of San José, based on the regulations\ngoverning the matter, issues this agreement amending Article 130\nof the Regulation for the Comprehensive Management of Solid Waste of the Municipality\nof the Central Canton of San José:\n\n \n\nRegulation for the Comprehensive Management of Solid Waste\n\nAmendment to the Regulation for the Comprehensive Management of Solid\n  Waste\n\nArticle 130: Calculation of\n  Minor Infractions.\n\n \n\nMinor Infractions\n  shall be sanctioned with five times the corresponding rate, in accordance with\n  the category assigned by the Municipality.\n\nFines shall be calculated\n  according to the assigned category and the following\n  formula:\n\n \n\nFORMULA PUBLIC AND RELIGIOUS RESIDENTIAL\n  SECTOR:\n\n \n\nMLVR=TAR*MLP*F\n\n. During the consultation\nperiod, published in Gazette No. 217 of 18 November 2025, no\nobservations were received.\n\nTHIRD: The proposed reform to Article 130 of the RGIRS of the\nMunicipality of the Central Canton of San José is approved, and in accordance with the preceding normative\nprovision of the Municipal Code, its referral to a second publication\nis ordered so that this reform may enter into application.\n\nSan José, 15 December 2025."
