  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 45492\n\n                        Deroga Norma RTCR 321:1998 Registro y Examinación de Equipos de Aplicación\nde Sustancias Químicas, Biológicas, Bioquímicas o Afines a cualquiera de los anteriores de uso\nagrícola\n\nN°\n45492-MAG-MEIC\n\nEL PRESIDENTE DE LA REPÚBLICA,\n\nEL MINISTRO DE AGRICULTURA Y GANADERÍA,\n\nY LA MINISTRA DE ECONOMÍA, INDUSTRIA\n\nY COMERCIO\n\nCon fundamento en las atribuciones y facultades conferidas\nen los artículos 140, incisos 3) y 18), y 146 de la Constitución Política; los\nartículos 27, inciso 1) y 28 inciso 2), acápite b) de la Ley General de la\nAdministración Pública, N° 6227 del 2 de mayo de 1978; los artículos 2° inciso\ne), 5°, incisos d) y o), concordantes de la Ley de Protección Fitosanitaria, N°\n7664 del 8 de abril de 1997; artículo 35, inciso a) de la Ley de Fomento a la\nProducción Agropecuaria FODEA y Orgánica del Ministerio de Agricultura y\nGanadería (MAG), N° 7064 del 29 de 1987.\n\nConsiderando:\n\nI.-Que, con el creciente intercambio comercial, por la\napertura de mercados entre los países, las posibilidades de importaciones de\nequipos de aplicación se han incrementado y por ende se requiere de las\nrespectivas regulaciones para garantizar los estándares de calidad del equipo.\n\nII.-Que conforme a lo dispuesto en el artículo 23 la Ley de Protección\nFitosanitaria, N° 7664 del 08 de abril de 1997, es función esencial del\nServicio Fitosanitario del Estado (SFE) regular el uso y manejo de equipos para\naplicar en la agricultura, así mismo su registro, importación, calidad y\nresiduos, procurando al mismo tiempo proteger la salud humana y el ambiente,\nestableciendo los requisitos fitosanitarios y los controles necesarios a las\nimportaciones de muestras de equipos.\n\nIII.-Que el Decreto Ejecutivo N° 27037-MAG-MEIC del 05 de enero de 1998,\ndenominado, Norma RTCR 321:1998 Registro y Examinación de Equipos de Aplicación\nde Sustancias Químicas, Biológicas, Bioquímicas o Afines a cualquiera de los anteriores\nde uso agrícola, Reglamento, publicado en el Alcance N° 59A del Diario Oficial La\nGaceta N° 174 del 07 de setiembre de 1998; ha sido tácitamente derogado por\nel Decreto Ejecutivo N° 45244-MAG del 30 de setiembre del 2025, publicado en el\nAlcance N° 137 del Diario Oficial La Gaceta N° 200 del 24 de octubre de\n2025, por lo que es necesario realizar su derogación expresa a fin de evitar la\nconfusión jurídica en su aplicación.\n\nIV.-Que conforme al artículo 65 del Decreto Ejecutivo N° 44908-MEIC del 21 de\nenero de 2025, Reglamento a los Capítulos I y II, Sección I del Capítulo V de\nla Ley del Sistema Nacional para la Calidad, mediante oficio\nCARTA-MAG-DM-1221-2025 de 02 de diciembre de 2025, se notificó a la Secretaria\nTécnica del Consejo Nacional de Reglamentación Técnica (ST-Conart) el presente\nDecreto previo a su firma, dando respuesta la Secretaria Técnica mediante el\noficio CARTA-MEIC-STCONART-0024-2025 de 11 de diciembre de 2025, en el cual\nacusaron el recibido de la notificación de dicha propuesta de derogatoria, sin\ncontemplar recomendaciones al respecto.\n\nV.-Que de conformidad con los párrafos segundo y tercero del artículo 12\ndel Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y\nTrámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero\nde 2012; el presente Decreto no crea ni modifica trámites, requisitos o\nprocedimientos por lo que no requiere del Trámite de Mejora Regulatoria.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Standard 45492\n\n                        Repeals Standard RTCR 321:1998 Registration and Examination of Equipment for the Application\nof Chemical, Biological, Biochemical Substances or Similar to Any of the Foregoing for Agricultural\nUse\n\nN°\n45492-MAG-MEIC\n\nTHE PRESIDENT OF THE REPUBLIC,\n\nTHE MINISTER OF AGRICULTURE AND LIVESTOCK,\n\nAND THE MINISTRESS OF ECONOMY, INDUSTRY\n\nAND COMMERCE\n\nPursuant to the powers and authorities conferred\nin Articles 140, subsections 3) and 18), and 146 of the Political Constitution;\nArticles 27, subsection 1) and 28, subsection 2), subparagraph b) of the General Law of\nPublic Administration, N° 6227 of May 2, 1978; Articles 2, subsection\ne), 5, subsections d) and o), and related articles of the Plant Protection Law, N°\n7664 of April 8, 1997; Article 35, subsection a) of the Law for the Promotion of\nAgricultural Production FODEA and Organic Law of the Ministry of Agriculture and\nLivestock (MAG), N° 7064 of April 29, 1987.\n\nConsidering:\n\nI.-That, with the growing commercial exchange, due to the\nopening of markets among countries, the possibilities for imports of\napplication equipment have increased and therefore the respective regulations are required to guarantee the quality standards of the equipment.\n\nII.-That pursuant to the provisions of Article 23 of the Plant Protection\nLaw, N° 7664 of April 8, 1997, it is an essential function of the\nState Phytosanitary Service (SFE) to regulate the use and handling of equipment for\napplication in agriculture, as well as its registration, importation, quality, and\nresidues, while seeking to protect human health and the environment,\nestablishing the phytosanitary requirements and the necessary controls for\nimports of equipment samples.\n\nIII.-That Executive Decree N° 27037-MAG-MEIC of January 5, 1998,\nnamed, Standard RTCR 321:1998 Registration and Examination of Equipment for the Application\nof Chemical, Biological, Biochemical Substances or Similar to Any of the Foregoing\nfor Agricultural Use, Regulation, published in Supplement N° 59A to the Official Gazette\nLa Gaceta N° 174 of September 7, 1998; has been tacitly repealed by\nExecutive Decree N° 45244-MAG of September 30, 2025, published in\nSupplement N° 137 to the Official Gazette La Gaceta N° 200 of October 24,\n2025, therefore it is necessary to carry out its express repeal in order to avoid\nlegal confusion in its application.\n\nIV.-That pursuant to Article 65 of Executive Decree N° 44908-MEIC of January 21,\n2025, Regulation to Chapters I and II, Section I of Chapter V of\nthe Law of the National System for Quality, by means of official letter\nCARTA-MAG-DM-1221-2025 of December 2, 2025, the Technical\nSecretariat of the National Council for Technical Regulation (ST-Conart) was notified of the present\nDecree prior to its signing, the Technical Secretariat responding by means of\nofficial letter CARTA-MEIC-STCONART-0024-2025 of December 11, 2025, in which\nthey acknowledged receipt of the notification of said repeal proposal, without\nincluding recommendations in this regard.\n\nV.-That in accordance with the second and third paragraphs of Article 12\nof the Regulation to the Law for the Protection of Citizens from Excessive\nAdministrative Requirements and Procedures, Executive Decree N° 37045-MP-MEIC of February 22,\n2012; the present Decree does not create or modify procedures, requirements, or\nformalities, therefore it does not require the Regulatory Improvement Process. Therefore,\n\nThey Decree:\n\nREPEAL OF EXECUTIVE DECREE\n\nN° 27037-MAG-MEIC OF JANUARY 5, 1998,\n\nSTANDARD RTCR 321:1998 REGISTRATION AND EXAMINATION\n\nOF EQUIPMENT FOR THE APPLICATION OF\n\nCHEMICAL, BIOLOGICAL, BIOCHEMICAL\n\nSUBSTANCES OR SIMILAR TO ANY OF THE\n\nFOREGOING FOR AGRICULTURAL USE.\n\nREGULATION\n\nArticle 1-Executive Decree N° 27037-\nMAG-MEIC of January 5, 1998, named, Standard RTCR 321:1998 Registration and\nExamination of Equipment for the Application of Chemical, Biological,\nBiochemical Substances or Similar to Any of the Foregoing for Agricultural Use.\nRegulation, which was published in Supplement N° 59a to the Official Gazette La\nGaceta N° 174 of September 7, 1998, is repealed.\n\nArticle 2-It shall enter into force upon its\npublication.\n\nIssued at the\nPresidency of the Republic.-San José, on the sixth day of January of the year\ntwo thousand twenty-six."
