  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 779\n\n                        Reforma Reglamento para la asignación y distribución del \"Fondo de\nAsistencia Económica de Productores en Régimen de Excedentes\"\n\nLIGA\nAGRÍCOLA INDUSTRIAL DE LA CAÑA DE AZÚCAR\n\nLa\nJunta Directiva de la Liga Agrícola Industrial de la Caña de Azúcar, de\nconformidad en el inciso G) del artículo 30 de la Ley N° 7818, Ley Orgánica de\nla Agricultura e Industria de la Caña de Azúcar, del 02 de setiembre de 1989,\nen sesión N. 779 celebrada el 17 de marzo de 2026, acordó aprobar la siguiente\nreforma al Reglamento para la Asignación y Distribución del \"Fondo de\nAsistencia Económica de Productores en Régimen de Excedentes\", publicado\nen La Gaceta N° 215 del 14 de noviembre de 2017, para que a partir de la\npresente publicación se lea de la siguiente forma:\n\nAgréguense\ndos artículos al Reglamento para la Asignación y Distribución del \"Fondo de\nAsistencia Económica de Productores en Régimen de Excedentes\", publicado\nen La Gaceta N.°215 del 14 de noviembre de 2017, que se leen así:\n\n\"Artículo\n5º-Adelantos y ajustes contra el fondo de asistencia económica de\nproductores en régimen de excedentes\n\nA\nefectos de mitigar la diferencia entre el precio de la cuota y el precio de\nexcedentes que puedan tener los pequeños y medianos productores de caña\nindependientes, en adelante \"productores\", durante la zafra, la Junta\nDirectiva de LAICA previa recomendación del Comité de Agrupación, podrá\nautorizar el pago de compensaciones económicas provisionales a los productores\nque califiquen como beneficiarios del Fondo, que tengan entregas de caña en\nrégimen de excedentes durante la zafra correspondiente.\n\nPara emitir\nla recomendación dispuesta en el párrafo anterior, el Comité de Agrupación\nconsiderará, entre otros elementos de juicio que estime convenientes, la\nsiguiente información:\n\na. Una estimación del Departamento Técnico de\nla totalidad de kilogramos de azúcar de productores beneficiarios del Fondo de\nAsistencia, que podrían quedar en régimen de extracuota, en la zafra vigente.\n\nb. El valor de los adelantos y el precio\nestimado de la liquidación en cuota al productor.\n\nc. El valor de los adelantos y el precio\nestimado de la liquidación en régimen de excedentes al productor.\n\nd. El monto total disponible del Fondo de\nAsistencia, así como del Fondo adicional.\n\nCon\nesta información, el Comité estimará el monto económico de la diferencia entre\nel precio por kilogramo en cuota y el precio por kilogramo en extracuota al\nproductor beneficiario del Fondo de Asistencia, así como el porcentaje de dicha\ndiferencia que recomendará a la Junta Directiva de LAICA girar a dichos\nproductores como compensación provisional, a efectos de que todos los\nproductores puedan acceder a la compensación dispuesta en este artículo.\n\nLas\ncompensaciones económicas provisionales a las que se refiere este artículo, no\ndeberán superar el monto total disponible del Fondo de Asistencia y en ningún\ncaso serán mayores a la diferencia entre el precio de adelanto de azúcar en\ncuota y el precio de adelanto en régimen de extracuota, fijado para la fecha en\nque se apliquen.\n\nTales\ncompensaciones tendrán carácter provisional y se reconocerán como pagos a cuenta\nde la distribución final del Fondo.\n\nSi\nel productor que inicialmente entregó azúcar en condición de extracuota, pasa a\nquedar, parcial o totalmente, cubierto dentro del régimen de cuota, debido a\nredistribución de déficits al cierre de la zafra, las compensaciones\nprovisionales que recibió a cuenta del Fondo, serán compensadas contra el valor\nde la liquidación definitiva, en cuota y extracuota, que deba recibir el\nproductor.\n\nEn\nlos supuestos del párrafo anterior y al finalizar la zafra, LAICA retendrá de\nla liquidación final al Ingenio, el monto que se giró del Fondo de Asistencia\nEconómica de Productores en Régimen de Excedentes. Dicho monto retenido será\nrestituido al Fondo, según corresponda.\n\nEl\npago de estas compensaciones provisionales deberán hacerlas los ingenios en el\nmismo plazo indicado en el artículo 4 de este Reglamento.\n\nArtículo\n6º-Distribución del remanente del fondo de asistencia económica de\nproductores en régimen de excedentes\n\nSi luego de cubrir el\ncien por ciento (100%) del diferencial económico entre el precio de liquidación\npor kilogramo de azúcar en cuota y el precio de liquidación por kilogramo de\nazúcar en excedentes, de los productores beneficiarios del Fondo, se determina\nque existen remanentes de dinero asignados al Fondo sin utilizar, dichos\nrecursos podrán ser destinados\npor la Junta Directiva de LAICA, en cada zafra, para incrementar el valor de\nliquidación por kilogramo de azúcar en cuota que reciban estos productores.\n\nLos beneficiarios de la eventual redistribución económica\nde los remantes del Fondo, a la que se refiere el párrafo anterior, serán\naquellos productores independientes de caña reales, pequeños y medianos, con\nentregas en cualquiera de los ingenios del país, que no superen las 1500 toneladas\nmétricas, y que cumplan con los criterios de selección y agrupación definidos\nen el artículo 17 bis de la Ley N° 7818, Ley Orgánica de la Agricultura e\nIndustria de la Caña de Azúcar, y en este Reglamento.\n\nDe conformidad con el artículo 17 bis de\nla Ley N° 7818, Ley Orgánica de la Agricultura e Industria de la Caña de\nAzúcar, deberá excluirse de este beneficio a los productores independientes\nnuevos, indicados en los artículos 56 y 58 de esta ley, así como a cualesquiera\notros productores independientes cuya entrega individual resulte cuestionable,\nsegún criterio de la Junta Directiva.\"\n\nRige a partir de su publicación en el\nDiario Oficial La Gaceta.",
  "body_en_text": "in the entirety of the text\n\n—\n\nFull Text of Norm 779\n\nAmendment to the Regulation for the allocation and distribution of the \"Economic Assistance Fund for Producers under the Surplus Regime\"\n\nLIGA AGRÍCOLA INDUSTRIAL DE LA CAÑA DE AZÚCAR\n\nThe Board of Directors of the Liga Agrícola Industrial de la Caña de Azúcar, in accordance with subsection G) of Article 30 of Law No. 7818, Organic Law of the Sugar Cane Agriculture and Industry, of September 2, 1989, in session No. 779 held on March 17, 2026, agreed to approve the following amendment to the Regulation for the Allocation and Distribution of the \"Economic Assistance Fund for Producers under the Surplus Regime,\" published in La Gaceta No. 215 of November 14, 2017, so that upon this publication it shall read as follows:\n\nTwo articles are added to the Regulation for the Allocation and Distribution of the \"Economic Assistance Fund for Producers under the Surplus Regime,\" published in La Gaceta No. 215 of November 14, 2017, which read as follows:\n\n\"Article 5—Advances and adjustments against the economic assistance fund for producers under the surplus regime\n\nFor the purpose of mitigating the difference between the quota price and the surplus price that small and medium-sized independent cane producers, hereinafter 'producers,' may experience during the harvest (zafra), the Board of Directors of LAICA, upon prior recommendation of the Grouping Committee (Comité de Agrupación), may authorize the payment of provisional economic compensations to producers who qualify as beneficiaries of the Fund and who have sugarcane deliveries under the surplus regime during the corresponding harvest.\n\nTo issue the recommendation set forth in the preceding paragraph, the Grouping Committee shall consider, among other elements of judgment it deems appropriate, the following information:\n\na. An estimate from the Technical Department of the total kilograms of sugar of producers who are beneficiaries of the Assistance Fund that could fall under the surplus (extracuota) regime in the current harvest.\n\nb. The value of the advances and the estimated settlement price in the quota regime to the producer.\n\nc. The value of the advances and the estimated settlement price in the surplus regime to the producer.\n\nd. The total available amount of the Assistance Fund, as well as the additional Fund.\n\nWith this information, the Committee shall estimate the economic amount of the difference between the price per kilogram in the quota regime and the price per kilogram in the surplus regime for the producer who is a beneficiary of the Assistance Fund, as well as the percentage of said difference that it will recommend the Board of Directors of LAICA to disburse to said producers as provisional compensation, so that all producers may access the compensation provided for in this article.\n\nThe provisional economic compensations referred to in this article shall not exceed the total available amount of the Assistance Fund and in no case shall they be greater than the difference between the advance price of sugar in the quota regime and the advance price in the surplus regime, set for the date on which they are applied.\n\nSuch compensations shall be provisional in nature and shall be recognized as payments on account of the final distribution of the Fund.\n\nIf the producer who initially delivered sugar under surplus status becomes, partially or totally, covered within the quota regime due to redistribution of deficits at the close of the harvest, the provisional compensations received on account of the Fund shall be offset against the value of the final settlement, in both quota and surplus regimes, that the producer must receive.\n\nIn the cases of the preceding paragraph and upon the conclusion of the harvest, LAICA shall withhold from the final settlement to the sugar mill (Ingenio) the amount that was disbursed from the Economic Assistance Fund for Producers under the Surplus Regime. Said withheld amount shall be reimbursed to the Fund, as applicable.\n\nThe payment of these provisional compensations must be made by the sugar mills within the same period indicated in Article 4 of this Regulation.\n\nArticle 6—Distribution of the remainder of the economic assistance fund for producers under the surplus regime\n\nIf, after covering one hundred percent (100%) of the economic differential between the settlement price per kilogram of sugar in the quota regime and the settlement price per kilogram of sugar in the surplus regime for the producers who are beneficiaries of the Fund, it is determined that there are remaining monies allocated to the Fund that are unused, said resources may be allocated by the Board of Directors of LAICA, in each harvest, to increase the settlement value per kilogram of sugar in the quota regime received by these producers.\n\nThe beneficiaries of the eventual economic redistribution of the Fund's remainder, referred to in the preceding paragraph, shall be those real independent cane producers, small and medium-sized, with deliveries to any of the country's sugar mills, which do not exceed 1,500 metric tons, and who meet the selection and grouping criteria defined in Article 17 bis of Law No. 7818, Organic Law of the Sugar Cane Agriculture and Industry, and in this Regulation.\n\nIn accordance with Article 17 bis of Law No. 7818, Organic Law of the Sugar Cane Agriculture and Industry, new independent producers, as indicated in Articles 56 and 58 of said law, must be excluded from this benefit, as well as any other independent producers whose individual delivery is questionable, according to the criteria of the Board of Directors.\"\n\nIt shall take effect upon its publication in the Official Gazette La Gaceta."
