Que, de conformidad con la\nLey Orgánica del Instituto Costarricense de Turismo, Ley N° 1917 del 30 de\njulio de 1955 y sus reformas, el ente rector en materia de turismo es\nelInstituto Costarricense de Turismo, (en adelante ICT), al cual le compete\npromover yvigilar la actividad privada de atención al turismo.\n\nII. Que, la Junta Directiva\ndel ICT ha emitido el actual Plan Nacional de Turismo de CostaRica, actualización\n2022-2027 (en adelante PNT), que se define como el conjunto depolíticas\nsectoriales, estrategias, objetivos y acciones para asegurar que la evolución\nfuturade la actividad turística se apegue al posicionamiento de la \"marca\nturística\" del país ycontribuya con las metas de desarrollo humano que el país\nse ha impuesto, para lo cual,se inspira en los Objetivos de Desarrollo\nSostenible (en adelante ODS) planteados por laagencia de la Organización de las\nNaciones Unidas especializada en turismo (en adelanteONU Turismo) y el Programa\nde Naciones Unidas para el Medio Ambiente (PNUMA).\n\nIII. Que, los elementos clave\nen la estrategia competitiva planteada en el PNT han generadoel posicionamiento\ndeseado con: sostenibilidad, innovación e inclusión, factores clave del modelo,\nesenciales para su continuidad y fortalecimiento y por lo tanto son componentes\nprimarios de la política turística del país. El PNT destaca al Programa para la\nCertificación de la Sostenibilidad Turística (en adelante CST) otorgada por el\nICT como un programa de diferenciación y posicionamiento y una herramienta para\nla promoción de la sostenibilidad en las organizaciones turísticas e\ninstituciones, que opten voluntariamente por obtenerlo, ya que éste ha\ndemostrado ser de fundamental importancia como elemento diferenciador de la\nindustria turística tanto a nivel nacional como internacional.\n\nIV. Que, el Estándar CST se\nactualizó por medio de publicación en el Alcance N° 185 al Diario Oficial La\nGaceta N° 215 del 15 de noviembre del 2024, para que respondiera a las\nnecesidades actuales de su dinámica de gestión, a la integración de nuevos\nsubsectores del sector turístico, a su reconocimiento internacional y a su\nadecuación al Código de Buenas Prácticas de la Alianza Internacional de\nEtiquetado Social y Ambiental (ISEAL por sus siglas en inglés), que promueve\nque las normas deben revisarse y actualizarse al menos cada cinco años para\nasegurar que se mantengan relevantes y efectivas.\n\nV. Que, por su propia\nnaturaleza, a nivel mundial se tiene claramente identificado que el turismo es\nun sector dinámico, resiliente, en constante cambio y de rápida evolución, por\nlo que el ICT responde a las necesidades del sector turístico con un Estándar\nCST innovador, competitivo, inclusivo, eficiente, actualizado y digital.\n\nVI. Que, para la\nactualización y reorganización institucional del CST, se ha identificado la\nnecesidad de modificar el actual Reglamento del Programa de Sostenibilidad\nTurística, Decreto Ejecutivo N° 41415-MINAE-MCJ-MEIC-TUR del 17 de setiembre del\n2018, lo que conlleva para mayor claridad al administrado, la emisión de un\nnuevo reglamento y la derogatoria del decreto vigente hasta hoy, dado que se\nreorganizó el orden lógico de sus capítulos por temas y se actualizaron y\nagregaron definiciones para una mejor comprensión del programa CST.\n\nVII. Que, la presente\nregulación del Programa CST pretende: adaptar el Programa CST a los nuevos\nmodelos de negocios, al Estándar CST vigente y fortalecer y reorganizar su\nestructura administrativa funcional dentro del ICT.\n\nVIII. Que, los cambios\npropuestos por el proyecto de nuevo reglamento del Programa CST, pretenden los\nsiguientes resultados derivados: actualización del Programa CST a los últimos\navances en sostenibilidad turística según su Estándar CST vigente, mayor\nclaridad para el administrado en cuanto al proceso que se sigue para optar por\nla certificación de acuerdo con la Plataforma CST y generar valor agregado en\nposicionamiento y diferenciación de promoción al sector turístico.\n\nIX. Que, la Junta Directiva\ndel ICT aprobó el presente proyecto de decreto, mediante el acuerdo adoptado en\nla Sesión Ordinaria de Junta Directiva, N° 6341, apartado 5, inciso I,\ncelebrada el día 18 de agosto de 2025.\n\nX. Que, de conformidad con lo\nestablecido en los artículos 12 y 12 bis del Reglamento a la Ley de Protección\nal Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto\nEjecutivo N° 37045-MP-MEIC de 22 de febrero del 2012, se procedió a llenar el\nFormulario de Evaluación Costo-Beneficio, en la Sección I denominada \"Control\nPrevio de Mejora Regulatoria\", siendo que el mismo dio resultado negativo y que\nla propuesta no contiene trámites, requisitos y/o procedimientos nuevos que las\npersonas solicitantes deban cumplir para optar por el programa voluntario CST.\n\nXI. Que, en el Sistema de\nControl Previo del Ministerio de Economía, Industria y Comercio, en la\ndirección electrónica: www.tramitescr.meic.go.cr; el proyecto de la nueva\nnormativa fue publicado en consulta pública, previo aviso en el apartado \"Consulta\nPública\" de la página electrónica del ICT, www.ict.go.cr; el día 8 de setiembre\ndel 2025, (inicio de la consulta pública el 9 de setiembre del 2025,\nfinalización de la consulta pública el 23 de setiembre del 2025), lo anterior\nde conformidad con el artículo 361 de la Ley N° 6227 del 2 de mayo de 1978, Ley\nGeneral de la Administración Pública; proceso en el que se recibieron\nobservaciones de la ciudadanía que fueron valoradas y respondidas por el ICT\nsin que ello implicara modificaciones al texto del proyecto normativo que nos\nocupa.\n\nXII. Que, lo anterior fue\nratificado por el Informe DMR-DAR-INF-240-2025 de la Dirección de Mejora\nRegulatoria del Ministerio de Economía, Industria y Comercio del 21 de octubre\ndel 2025, mismo que verificó que el ICT valoró y respondió las observaciones de\nla ciudadanía en el proceso de consulta pública y como resultado concluye que,\ndesde la perspectiva de la mejora regulatoria, la propuesta \"Reglamento del\nPrograma para la Sostenibilidad Turística\", cumple con los principios de mejora\nregulatoria.\n\nPor tanto;\n\nDECRETAN\n\nREGLAMENTO DEL\nPROGRAMA PARA LA\n\nSOSTENIBILIDAD\nTURÍSTICA\n\nCAPÍTULO I\n\nASPECTOS\nGENERALES\n\nArtículo 1. Objeto. Este\nReglamento tiene como objeto regular el otorgamiento de la Certificación de la\nSostenibilidad Turística (en adelante CST), que tiene como fin galardonar\norganizaciones turísticas e instituciones, según el grado en que su operación responda\na un modelo de sostenibilidad. Para esto se dispondrá de una herramienta\ntécnica conocida como \"Estándar\", integrada por un sistema de evaluación en\nlínea, una guía para la implementación del Estándar CST, mecanismos de\nverificación y una estructura organizacional alineada a requisitos\ninternacionales.\n\n Ficha Artículo 1\n\nArtículo 2. Ámbito de\nAplicación. Las disposiciones contenidas en este Reglamento son de cumplimiento\nexclusivo para las organizaciones turísticas e instituciones solicitantes de un\nCertificado de Sostenibilidad Turística, el cual es gratuito y de naturaleza\nestrictamente voluntaria, sin que su obtención sea necesaria para su\nfuncionamiento.\n\n Ficha Artículo 2\n\nArtículo 3. Definiciones.\nPara efectos de este Reglamento, se entenderá por:\n\na) Auditoría: Proceso llevado\na cabo por personas auditoras líderes y asignados por el ICT para determinar el\ncumplimiento de las organizaciones turísticas e instituciones solicitantes,\nbasado en el Estándar CST vigente.\n\nb) Auditor o Auditora:\nPersona funcionaria que cuenta con habilidades avanzadas de auditoría basadas\nen Sistemas Integrados de Gestión ISO 9001 e ISO 14001, ISO 14064, ISO 19011 y\nsus actualizaciones, las cuales desarrolla con el propósito de evaluar un\nsistema de gestión a través de la adecuada planeación, ejecución y fiabilidad\nde la auditoría. En casos excepcionales, se podrá hacer acompañar por otra\npersona auditora con el fin de que incremente la experiencia profesional en\neste tipo de auditorías en CST.\n\nc) Certificado de la CST:\nReconocimiento público y formal otorgado por la \"Comisión Técnica de\nVerificación de CST (CTV-CST)\" a las organizaciones turísticas e instituciones\nsolicitantes que completan el proceso de certificación.\n\nd) Comisión Técnica de\nVerificación de CST (CTV-CST): Órgano colegiado adscrito y con sede en el ICT,\nel cual pondrá a su disposición los recursos económicos, técnicos y humanos\nnecesarios para el adecuado cumplimiento de sus funciones.\n\ne) Estándar CST: Herramienta\ntécnica que evalúa el nivel de sostenibilidad de organizaciones turísticas e\ninstituciones, conformada por dimensiones, criterios e indicadores,\nclasificados en preguntas de carácter obligatorio, mejora continua e impacto\nexterno y bajo las características referenciadas en el Anexo 1 de este\nReglamento, que es parte integral del mismo.\n\nf) Indicador: Los indicadores\nson medidas que permiten evaluar el desempeño de una organización, verificar el\ncumplimiento de sus objetivos y tomar decisiones estratégicas.\n\ng) Plan de Acción: Documento\nque incorpora las actividades que deben llevarse a cabo para lograr los\nobjetivos y metas establecidos por la organización. Incluye la asignación de\nrecursos humanos, fechas límites, resultados esperados e indicadores de éxito.\nEl propósito del Plan de Acción es la mejora continua de las organizaciones\nturísticas e instituciones solicitantes.\n\nh) Plataforma CST: Sistema\ndigital para ejecutar, planificar y gestionar el proceso de auditoría CST\ndisponible para las organizaciones turísticas e instituciones solicitantes,\nconforme a las especificaciones técnicas dadas en el Anexo 2 de este\nReglamento, que es parte integral del mismo.\n\ni) Sistema de Gestión: Un\nconjunto de elementos y actividades relacionados y coordinados que interactúan,\ny que, estableciendo políticas y objetivos, dirigen y controlan la organización\ncon el fin de lograr las metas planteadas.\n\nj) Solicitante: Se refiere a\nlas organizaciones turísticas e instituciones que según lo consignado en el\nAnexo 3 de este Reglamento, pueden optar por el CST.\n\nk) Sostenibilidad turística:\nes un modelo de gestión del turismo que busca reducir los impactos negativos en\nel medio ambiente, la cultura y la sociedad, al mismo tiempo que maximiza los\nbeneficios positivos para las comunidades locales, los ecosistemas y la\neconomía.\n\nl) Taller Técnico del Estándar\nCST: Es un proceso introductorio para orientar a las organizaciones turísticas\ne instituciones sobre la aplicación del Estándar CST.\n\n Ficha Artículo 3\n\nArtículo 4. Fines del\nPrograma CST. El Programa CST tiene los siguientes fines:\n\na) Ser el instrumento a\ntravés del cual Costa Rica logra diferenciarse en el mundo como destino\nturístico sostenible.\n\nb) Identificar indicadores\ndel sistema de la gestión sostenible de las organizaciones turísticas e\ninstituciones en el programa para mejorar su toma de decisiones estratégicas,\nprevio consentimiento informado.\n\nc) Establecer la\nsostenibilidad como un elemento de competitividad dentro del sector turístico\nnacional.\n\nd) Ser un programa\nvoluntario, gratuito, innovador, eficiente y actualizado conforme al contexto\nactual del sector turístico y sus necesidades, y que aporte un valor agregado\nde alto impacto al mercado turístico.\n\ne) Que el Estándar CST\nintegre los criterios del Sistema de Turismo Responsable de ONU Turismo y los\nObjetivos Globales para el Desarrollo Sostenible de la Organización de las\nNaciones Unidas (ONU), según lo incluido en el Anexo 4 de este Reglamento, que\nes parte integral del mismo.\n\n Ficha Artículo 4\n\nCAPÍTULO II\n\nORGANIZACIÓN\nADMINISTRATIVA DEL PROGRAMA CST\n\nArtículo 5. Propiedad del\nPrograma CST y coordinación de competencias institucionales.\n\nEl Programa y el Estándar CST\nson propiedad intelectual del ICT, que se encargará de velar por su\nadministración y promoción en el ámbito de sus competencias legales y de las\npolíticas que dicte su Junta Directiva en materia turística.\n\nDe acuerdo a los fines y\nfunciones legales del ICT establecidos en los capítulos II y III de su Ley\nOrgánica, Ley N° 1917 del 30 de julio de 1955 y sus reformas, la organización\ninstitucional del Programa del CST tendrá las siguientes partes involucradas:\n\na) Unidad técnica CST: a\ncargo del Departamento de Sostenibilidad Turística, que organizará y\nsupervisará todo lo concerniente al funcionamiento del Estándar CST, del\nproceso de auditorías y a las personas que auditarán a los solicitantes de la\nCST.\n\nb) Personas auditoras: a\ncargo de la Unidad Técnica CST que organizará y supervisará todo lo\nconcerniente al desempeño de las personas auditoras y procesos de las\nauditorías asignadas.\n\nc) Capacitación Técnica: a\ncargo del Equipo de Capacitación del CST, que brindará talleres, asesorías,\ncursos, entrenamientos y actualización de contenidos sobre los temas que abarca\nel CST.\n\nd) Promoción y Mercadeo de la\nCST: a cargo de la Dirección de Mercadeo del ICT, que desarrollará la\nestrategia del Programa CST para sus diferentes audiencias.\n\ne) Asesoría Legal: a cargo de\nla Asesoría Legal, que asesora en materia jurídica al Programa CST.\n\nf) Secretaría de Actas: quien\nse encargará de preparar las actas, levantar los expedientes respectivos de\ncada sesión, comunicar los acuerdos tomados, mantener el control y cumplimiento\nde los mismos, firmar las actas oficiales, así como desempeñar todos aquellos\nactos que la CTV-CST le haya delegado y que tengan como finalidad preparar y\nfacilitar el ejercicio de las funciones propias de la Comisión Técnica de\nVerificación de la CST.\n\n Ficha Artículo 5\n\nArtículo 6. Funciones de la\nJunta Directiva del ICT en el Programa CST.\n\nCorresponderá a la Junta Directiva del\nICT en ejercicio de la atribución establecida en el inciso b) del artículo 26\nde la Ley Orgánica del ICT, Ley N° 1917 del 30 de julio de 1955 y sus reformas:\n\na) Aprobar el Estándar CST y\nsus eventuales reformas y actualizaciones.\n\nb) Dictar y promulgar las\nreglamentaciones internas que sean necesarias para la implementación y\nfuncionamiento del programa CST.\n\nc) Velar por el estricto\ncumplimiento de la reglamentación relacionada con el turismo sostenible.\n\n Ficha Artículo 6\n\nArtículo 7. Funciones de la\nGerencia General del ICT en el Programa CST.\n\nCorresponderá a la Gerencia\nGeneral del ICT en ejercicio de las atribuciones establecidas en el artículo 32\nde la Ley Orgánica del ICT, Ley N° 1917 del 30 de julio de 1955 y sus reformas:\n\na) Garantizar que todas las\nacciones del Instituto estén en línea con las leyes y regulaciones de\nsostenibilidad y turismo del país.\n\nb) Establecer alianzas\nestratégicas con otras entidades gubernamentales, organismos internacionales,\nasociaciones empresariales y organizaciones de la sociedad civil para\nfortalecer el impacto de la CST en la industria turística.\n\nc) Presentar ante la Junta\nDirectiva la aprobación del Estándar CST correspondiente a cada actividad\nturística -incluyendo el uso de nuevas normas técnicas de sostenibilidad-, sus\nreformas o actualizaciones, en concordancia con las recomendaciones de la\nunidad técnica.\n\nd) Organizar, coordinar y\nsupervisar en calidad de administración general y jefatura superior del ICT a\nlas unidades técnicas y dependencias institucionales que designe como\nresponsables de ejecutar acciones relativas al Programa CST, para lo cual podrá\ndesignar o constituir de entre ellas, unidades responsables, equipos de trabajo\no comités técnicos de ejecución.\n\ne) Recomendar y proponer\niniciativas a la Junta Directiva del ICT, cuando corresponda, para la organización,\nfuncionamiento y fortalecimiento del Programa CST.\n\nf) Supervisar las acciones de\npromoción y mercadeo nacional e internacional del Programa CST que realice la\nDirección de Mercadeo, la Unidad Técnica del Programa CST y las unidades\ninstitucionales que estime conveniente y oportuno a los intereses\ninstitucionales.\n\n Ficha Artículo 7\n\nArtículo 8. Funciones de la\nDirección de Competitividad y Sostenibilidad Turística en el Programa CST.\nCorresponderá a la Dirección en ejercicio:\n\na) Supervisar la ejecución de\nlas acciones relativas al Programa CST, para lo cual podrá designar o\nconstituir de entre ellas, unidades responsables, equipos de trabajo o comités\ntécnicos de ejecución.\n\nb) Proponer a la Gerencia\nGeneral para elevarlo a la Junta Directiva, el Estándar CST correspondiente a\ncada actividad turística -incluyendo el uso de nuevas normas técnicas de\nsostenibilidad-, sus reformas o actualizaciones u otras iniciativas cuando\ncorresponda, para la organización, funcionamiento y fortalecimiento del\nPrograma CST.\n\nc) Coordinar con direcciones,\ndepartamentos y las unidades necesarias que estime conveniente y oportuno a los\nintereses institucionales, la planificación y concertación de acciones de\nfortalecimiento, promoción y mercadeo, nacional e internacional del Programa CST.\n\nd) Proponer a la Gerencia\nGeneral para conocimiento de la Junta Directiva, la realización de convenios\ncon organizaciones nacionales e internacionales legalmente constituidas en\nmaterias afines al Programa CST.\n\ne) Diseñar y procurar\nesquemas de incentivos para fomentar la adopción de la CST por parte de más\nempresas turísticas, tales como beneficios, acceso a financiamiento o inclusión\nprioritaria en estrategias de mercadeo del ICT.\n\n Ficha Artículo 8\n\nArtículo 9. Unidad Técnica\ndel Programa CST. El Departamento de Sostenibilidad Turística del ICT será la\nUnidad Técnica del Programa CST, misma que estará a cargo de la Jefatura de\ndicho departamento. Sus funciones se especifican a continuación:\n\na) Desarrollo de Normas y\nProcedimientos: Crear y actualizar los estándares y procedimientos que deben\nseguirse para la certificación.\n\nb) Organizar y ejecutar todos\nlos trámites y procesos relativos al otorgamiento, recertificación, suspensión\ny revocación del certificado CST.\n\nc) Capacitar y supervisar a\nlas personas auditoras.\n\nd) Administrar la Plataforma\nCST, incluyendo acciones relativas a la disposición y acceso de herramientas\ntécnicas, actualización de normativa y de bibliografía.\n\ne) Organizar y coordinar con\nlas solicitantes el proceso de certificación.\n\nf) Organizar y coordinar con\nlas solicitantes el proceso de recertificación de CST, el cual se deberá de\nhacer 6 meses antes del vencimiento de la certificación.\n\ng) Verificar el cumplimiento\nde los requerimientos necesarios de las solicitantes, para iniciar el proceso\nde registro, asesorías, auditoría, certificación y recertificación.\n\nh) Enviar informes, fichas\ntécnicas y documentos requeridos a la CTV-CST.\n\ni) Coordinar el apoyo con la\nSecretaría de Actas del ICT para la convocatoria de sesiones, el levantamiento\nde las actas de las sesiones y mantener en custodia los documentos de la\nCTV-CST.\n\nj) Proporcionar la\ninformación necesaria para mantener actualizada la página web del Programa CST\ny sitios web del ICT.\n\nk) Realizar los trámites\nadministrativos, presupuestarios, operativos y logísticos de apoyo a los\nobjetivos del Programa CST.\n\nl) Brindar información al\nempresariado turístico y público en general sobre los avances del Programa CST\ny guardar la confidencialidad en asuntos que competen estrictamente a las\norganizaciones turísticas e instituciones certificadas.\n\nm) Supervisar y monitorear\ncontinuamente el cumplimiento de los estándares por parte de las solicitantes.\n\nn) Comunicar a quiénes hayan\nobtenido la CST, el vencimiento de su certificación, junto con el efecto de que\nse dejará de percibir los beneficios del Programa.\n\no) Mantener y gestionar toda\nla documentación relacionada con el proceso de certificación, incluyendo\ninformes de auditoría y registros de cumplimiento.\n\n Ficha Artículo 9\n\nArtículo 10. Estructura de la\nUnidad Técnica del Programa CST.\n\nLa siguiente será la\nestructura de la Unidad Técnica del Programa CST:\n\na) Equipo auditor: Equipo\nintegrado por personas funcionarias del ICT certificadas como Auditoras o\nAuditores Líderes en Sistemas Integrados de Gestión Calidad ISO 9001:2015 y\nAmbiental ISO 14001:2015 -o su versión más actualizada y validada por el\nInstituto de Normas Técnicas de Costa Rica (INTECO)- y asignados para realizar\nuna auditoría, equipo que está constituido por un auditor o una auditora líder,\nquien podrá estar acompañado de profesionales en auditoría, personal experto\ntécnico o personas auditoras en fase de entrenamiento.\n\nEl equipo auditor de CST\ntendrá las siguientes funciones:\n\ni. Realizar las auditorías en\nla Plataforma CST de las solicitantes admitidas en el Programa CST, con el\npropósito de generar un informe que incluya el cumplimiento y recomendaciones.\n\nii. Planificar la auditoría y\nla reunión inicial con la solicitante.\n\niii. Realizar una visita de\ncampo a las solicitantes generando un informe técnico de la visita.\n\niv. Darle seguimiento a las\norganizaciones turísticas e instituciones certificadas en el proceso de\nrecertificación.\n\nv. Guardar la\nconfidencialidad en asuntos que competen estrictamente a las organizaciones\nturísticas e instituciones certificadas participantes del Programa CST.\n\nvi. Sugerir cambios\nnecesarios o de mejora sobre los criterios e indicadores propuestos en el\nEstándar CST.\n\nvii. Otras funciones que le\nsean asignadas por la jefatura del Departamento de Sostenibilidad Turística.\n\nb) Equipo capacitador: equipo\nintegrado por personas funcionarias del ICT, asignadas para generar contenido,\nherramientas, talleres y apoyo a las organizaciones turísticas e instituciones\ninteresadas en participar en el proceso del CST. Las personas integrantes del\nequipo capacitador no podrán simultáneamente, auditar a solicitantes del\nPrograma CST.\n\nEl equipo capacitador del CST\ntendrá las siguientes funciones:\n\ni. Establecer una programación\nanual de capacitaciones para las solicitantes interesadas en la CST\n\nii. Capacitar a través de\ntalleres grupales a las solicitantes sobre Estándar CST.\n\niii. Atender consultas\ngrupales e individuales de solicitantes.\n\niv. Capacitar a los\ndiferentes públicos de interés del sector turístico sobre temas relacionados en\nsostenibilidad.\n\nv. Desarrollar herramientas\nmetodológicas de apoyo para la implementación del Estándar CST.\n\n Ficha Artículo 10\n\nCAPÍTULO III\n\nSOBRE\nLA COMISIÓN TÉCNICA DE VERIFICACIÓN DEL CST (CTV-CST)\n\nArtículo 11. Creación. Se\ncrea la Comisión Técnica de Verificación del Programa CST (CTV-CST) como un\nórgano adscrito y con sede en el ICT, el cual pondrá a su disposición los\nrecursos económicos, técnicos y humanos, necesarios para el adecuado\ncumplimiento de sus funciones.\n\n Ficha Artículo 11\n\nArtículo 12. Integración. La\nComisión Técnica de Verificación del Programa CST (CTV-CST), estará integrada\npor una representación titular y una suplencia de cada una de las siguientes\nentidades:\n\na) Una persona representante\ndel ICT, nombrada por acto administrativo de su Gerencia General, representante\nque presidirá la CTV-CST y tendrá voto de calidad en caso de empate.\n\nb) Una persona representante\ndel Ministerio del Ambiente y Energía (MINAE), nombrada por acto administrativo\nde su jerarca ministerial.\n\nc) Una persona representante\ndel Ministerio de Cultura y Juventud (MCJ), nombrada por acto administrativo de\nsu jerarca ministerial.\n\nd) Una persona representante\ndesignada en forma conjunta y por acuerdo de las Juntas Directivas de la Cámara\nNacional de Turismo (CANATUR) y de la Cámara Nacional de Ecoturismo y Turismo\nSostenible (CANAECO).\n\ne) Una persona representante\ndesignada en forma conjunta y por nombramiento de las rectorías de la Universidad\nde Costa Rica (UCR) y del Instituto Centroamericano de Administración de\nEmpresas (INCAE).\n\nf) Una persona representante\ndesignada en forma conjunta por nombramiento de la Dirección General del\nInstituto Nacional de Biodiversidad (lNBIO) y de la Dirección Regional de la\nUnión Internacional para la Conservación de la Naturaleza (UICN).\n\nLas personas integrantes de\nla Comisión Técnica de Verificación del CST (CTV-CST) desempeñarán sus\nfunciones ad honorem y se entenderán nombradas por un plazo de dos años a\npartir de su juramentación por parte del ICT, los cuales podrán ser\nprorrogables por períodos iguales. Entre sus representantes se designará una\nvicepresidencia quién presidirá las sesiones en ausencia de la presidencia.\n\n Ficha Artículo 12\n\nArtículo 13. Funciones. Las\nfunciones de la Comisión Técnica de Verificación del Programa CST (CTV-CST)\nserán las siguientes:\n\na) Otorgar la Certificación\nde la Sostenibilidad Turística (CST) a organizaciones turísticas e\ninstituciones.\n\nb) Acordar la suspensión o\nbien la revocación de la CST a las organizaciones turísticas e instituciones\ncertificadas que incurran en las causales establecidas en el artículo 25 de\neste Reglamento.\n\nc) Proponer a la Junta\nDirectiva del ICT, la realización de convenios con organizaciones nacionales e\ninternacionales legalmente constituidas en materias afines al programa CST.\n\nd) Velar por la correcta\naplicación del procedimiento de otorgamiento de la CST.\n\ne) Asesorar y promover el\ndesarrollo de mejoras técnicas y estratégicas para el fortalecimiento y\noptimización del Programa para la Certificación de la Sostenibilidad Turística\n(CST), garantizando su alineación con las mejores prácticas nacionales e internacionales\nen el ámbito de la sostenibilidad turística.\n\nf) Denegar en forma motivada\nlas solicitudes del Programa CST que no obtengan el nivel mínimo de\ncalificación, para lo cual se otorgará a la solicitante un plazo de tres días\nhábiles posteriores al día de notificación de la resolución de denegatoria,\npara la interposición del recurso establecido en el artículo 15 de este\nreglamento.\n\n Ficha Artículo 13\n\nArtículo 14. Sesiones. La\nComisión Técnica de Verificación del CST (CTV-CST) sesionará ordinariamente\ncomo mínimo una vez al mes y extraordinariamente cuando sea necesario. Habrá\ncuórum con la asistencia de cuatro integrantes.\n\nSus acuerdos se tomarán por\nmayoría absoluta de las representaciones asistentes, acuerdos que quedarán\nfirmes en la sesión siguiente a menos que las personas integrantes presentes\nacuerden su firmeza por votación de dos tercios de la totalidad de la\nintegración de la Comisión Técnica de Verificación del CST (CTV-CST), de\nconformidad con el artículo 56, inciso 3) de la Ley General de la Administración\nPública, Ley Nº 6227 del 2 de mayo de 1978 y sus reformas. En los casos de\nempate en las votaciones, la persona que preside tendrá doble voto (voto de\ncalidad).\n\nLo no dispuesto se regirá por\nlas disposiciones que regulan a los Órganos Colegiados, contenidas en la Ley\nGeneral de la Administración Pública, Título Segundo, Capítulo Tercero.\n\n Ficha Artículo 14\n\nArtículo 15. Recurso. Las\ndecisiones de la Comisión Técnica de Verificación del Programa CST (CTV-CST)\ntendrán únicamente el recurso de revocatoria o reposición, el cual deberá\ninterponerse ante ella misma, en el plazo de los tres días hábiles siguientes a\nsu notificación, de conformidad con el artículo 346 y siguientes de la Ley\nGeneral de la Administración Pública. Una vez declarados en firme, los actos\nfinales de la Comisión Técnica de Verificación del CST (CTV-CST) tendrán la\nfacultad de agotar la vía administrativa.\n\n Ficha Artículo 15\n\nCAPÍTULO IV\n\nDE LOS\nREQUISITOS DEL PROGRAMA CST Y DE LAS AUDITORÍAS DE EVALUACIÓN INICIAL, PROCESO\nDE SEGUIMIENTO Y MEJORA CONTINUA Y RECERTIFICACIÓN A LOS SOLICITANTES\n\nArtículo 16. Implementación\ndel Estándar CST. Para la obtención de la CST se deberá utilizar la plataforma\nCST y seguir el procedimiento establecido y detallado en los Anexos 2, 3 y 5,\nque son parte integral de este Reglamento.\n\n Ficha Artículo 16\n\nArtículo 17. Requisitos\ngenerales del trámite de inscripción para la participación en el Programa CST.\nLas solicitantes de la CST deberán:\n\na) Registrarse en el\nformulario de la plataforma del CST cuyo acceso se facilitará en la dirección\nelectrónica: https://cst.turismo-sostenible.co.cr . Esta solicitud en línea\ndeberá ser llenada por la representación legal de la solicitante, tendrá\ncarácter de declaración jurada e incluirá su compromiso ante el ICT de estar al\ndía con los aspectos legales aplicables a su categoría y actividad.\n\nb) Estar al día con las\nverificaciones de oficio a realizar por el ICT según el detalle del Anexo 6 de\neste Reglamento, que es parte integral del mismo.\n\nc) Cumplir desde la\nPlataforma del CST con los requisitos y el procedimiento de obtención de la\nCST, según lo detallado en los anexos 2, 3 y 5 de este Reglamento, que son\nparte integral del mismo.\n\nd) Cumplir con lo señalado\npor el Estándar CST correspondiente a su actividad, según lo que se detalla en\nel Anexo 1, que es parte integral de este Reglamento.\n\n Ficha Artículo 17\n\nArtículo 18. Niveles del\nPrograma CST. A la solicitante que cumpla con el estándar CST y su trámite,\nsegún lo indicado en el artículo 17 de este Reglamento, se le otorgará el\nCertificado CST, el cual tendrá los siguientes niveles:\n\na) Mínimo: requiere el\ncumplimiento por parte de la solicitante del cien por ciento de los criterios e\nindicadores obligatorios estipulados en el Estándar del CST.\n\nb) Máximo: requiere que la\nsolicitante demuestre la mejora y continuidad del proceso de gestión en un\nmínimo de cincuenta por ciento y un impacto externo en un setenta por ciento en\nlos criterios e indicadores del Estándar del CST.\n\n Ficha Artículo 18\n\nArtículo 19. Solicitud de\nAuditorías. Las organizaciones turísticas e instituciones podrán solicitar\nauditorías a través de la Plataforma CST, siguiendo los pasos establecidos en\nella y en los siguientes casos:\n\na) Auditoría (primera vez,\npara solicitantes que aún no cuentan con la CST): La solicitud debe presentarse\n90 días después del registro en la Plataforma CST al concluir el proceso de\ninclusión de evidencias.\n\nb) Auditoría para mejorar el\nnivel de la CST obtenido: Si una empresa certificada desea mejorar el nivel\nobtenido, podrá hacerlo una vez hayan transcurridos 6 meses calendario desde la\nfecha de otorgamiento del nivel mínimo. En caso de no alcanzar un nivel mayor,\nmantendrá el nivel de la certificación vigente.\n\nc) Auditoría para\nRecertificación: La solicitud debe presentarse al menos 90 días antes del\nvencimiento de la certificación vigente.\n\n Ficha Artículo 19\n\nArtículo 20. Información a\npresentar en las Auditorías.\n\nLas solicitantes de\nAuditorías, presentarán en la Plataforma CST la información documental para evidencia,\nsegún lo que establezca el Estándar CST aplicable a su actividad, la cual\nconformará el expediente de su solicitud. Esta información se aporta a fin de\nser verificada por parte del equipo auditor y las personas integrantes de la\nCTV-CST, quiénes la tratarán de forma confidencial. La evidencia documental\ndebe presentarse preferiblemente en idioma español y en caso de estar en otro\nidioma, se deberá acompañar de su traducción simple al español.\n\nLa información general de\nquiénes obtengan la CST, con exclusión de datos sensibles o privados y con base\nen su previo consentimiento informado, será divulgada por el ICT para fines\ninstitucionales y según lo establecido en este Reglamento.\n\n Ficha Artículo 20\n\nArtículo 21. Vigencia de la\nCST. La CST tendrá una vigencia de tres años calendario a partir de la fecha de\nla notificación de su otorgamiento.\n\n Ficha Artículo 21\n\nCAPÍTULO V\n\nDEL LOGOTIPO\nDEL PROGRAMA CST\n\nArtículo 22. Uso del logotipo\ndel CST. Las organizaciones turísticas e instituciones certificadas con la CST\nrecibirán un logotipo de identificación, exclusivo e intransferible, que deberá\ncolocarse en un lugar visible del establecimiento o lugar de operaciones,\nmientras la certificación esté vigente. Además, podrán utilizar el logotipo en\nsu material promocional, siempre que cumplan con el manual de marca y las\ndirectrices establecidas por el Programa CST.\n\n Ficha Artículo 22\n\nCAPÍTULO VI\n\nDE LOS\nBENEFICIOS DEL PROGRAMA CST\n\nArtículo 23. Beneficios. Las\norganizaciones turísticas e instituciones titulares de la CST vigente, tendrán\nlos siguientes beneficios:\n\na) Prioridad en los programas\nde capacitación del ICT en temas sociales, culturales y ambientales.\n\nb) Acompañamiento y soporte\ntécnico en temas de sostenibilidad en oficinas centrales y\n\nregionales del ICT.\n\nc) Promoción y exposición\ndiferenciada en actividades y ferias turísticas a nivel nacional e\ninternacional y apoyo técnico institucional prioritario para su participación\nen estas.\n\nd) Oportunidad de exposición\nen medios internacionales mediante la atención de periodistas y personas\ninfluenciadoras internacionales, con base en el criterio técnico y la\ndisponibilidad del ICT.\n\ne) Prioridad para participar\nen eventos del ICT para compartir y discutir alcances del Programa CST.\n\nf) Descuento en tarifa de\nparticipación en las ferias internacionales con el ICT para titulares\ncertificadas: nivel mínimo: 60% de descuento y nivel máximo: 100% de descuento.\n\ng) Presencia diferenciada de\nla organización turística o institución en las páginas promocionales del ICT.\n\nh) Autorización para utilizar\nen su promoción el enlace del sitio electrónico del programa CST.\n\ni) Otros beneficios que el\nICT pueda gestionar ante otros organismos nacionales e internacionales.\n\nCon el vencimiento de la\ncertificación CST, se suspenden los beneficios del programa, incluyendo la\npromoción como organizaciones turísticas o instituciones certificadas.\n\n Ficha Artículo 23\n\nCAPÍTULO VII\n\nDE LAS\nOBLIGACIONES DE LAS ORGANIZACIONES TURÍSTICAS E INSTITUCIONES QUE OBTENGAN LA\nCST\n\nArtículo 24. Obligaciones. Las\norganizaciones turísticas e instituciones que obtengan la CST tendrán las\nsiguientes obligaciones:\n\na) Cumplir con lo dispuesto\nen este Reglamento y con la legislación vigente que regule su actividad\ncomercial en lo que le sea aplicable de conformidad con el Estándar CST.\n\nb) Cumplir con las medidas\nambientales, sociales, económicas y culturales según las disposiciones del\nEstándar CST aplicables a su actividad y durante su vigencia.\n\nc) El logotipo de la CST debe\nutilizarse sin modificaciones y únicamente durante el período de vigencia de la\ncertificación.\n\nd) Proporcionar información\nrequerida sobre su operación y cumplimiento de los criterios e indicadores del\nEstándar CST para efectos del proceso de auditoría de la CST. Esta información\npodrá además ser utilizada por el programa CST para efectos de: la evaluación\ndel Estándar CST, la definición de indicadores del sistema de la gestión\nsostenible, la creación de contenido promocional institucional y la elaboración\nde informes institucionales.\n\nEsto con el objetivo de\npromover la importancia y los beneficios de la Certificación de Sostenibilidad\nTurística (CST), previo consentimiento informado de la solicitante o\ncertificada.\n\ne) Divulgar los beneficios en\nlos medios de comunicación que han obtenido al implementar un Sistema de\nGestión de Sostenibilidad en su operación.\n\nf) Cada vez que se produzca\nun cambio en la persona responsable o en el equipo de implementación del\nproceso CST, se deberá informar a la Unidad Técnica CST. Las nuevas personas\nintegrantes deberán participar en el Taller Técnico CST correspondiente a su\nactividad.\n\ng) Cumplir con la auditoría\nde acuerdo con lo establecido en este Reglamento.\n\n Ficha Artículo 24\n\nCAPÍTULO VIII\n\nDE LA\nSUSPENSIÓN, REVOCACIÓN Y VENCIMIENTO DE LA CST\n\nArtículo 25. Causales. Se\nsuspenderá el disfrute o bien se revocará la CST según el procedimiento\nestablecido en el artículo 26 de este Reglamento, a las organizaciones\nturísticas e instituciones certificadas en los siguientes casos:\n\na) Causal de Suspensión:\nCuando no presente evidencia del trabajo continuo solicitado por la auditoría\nen su plan de mejora.\n\nb) Causales de revocatoria:\n\ni. Cuando no\nlogren mantenerse en el nivel mínimo del CST.\n\nii. Cuando incumplan con lo\ndispuesto en este Reglamento, el Estándar CST y con la legislación vigente que\nregule su actividad en lo que le sea aplicable de conformidad con dicho\nEstándar CST; lo anterior con base en resolución en firme emitida por la\ninstancia legalmente competente y previo respeto al debido proceso.\n\niii. Cuando utilicen el\nlogotipo o el vínculo con el sitio electrónico del Programa CST para fines\ndistintos para los cuales les fue otorgado o en establecimientos o actividades\ncomerciales distintas a las auditadas o incluidas en el programa CST\ncorrespondiente.\n\niv. Cuando realicen\npublicidad engañosa sobre el CST obtenido, induciendo a error a la persona\nusuaria del servicio turístico.\n\n Ficha Artículo 25\n\nArtículo 26. Procedimiento.\nPara suspender o revocar la CST a una organización turística o institución\ncertificada, deberá seguirse el procedimiento ordinario contenido en el Libro\nSegundo, Título VI, Capítulo I, artículos del 308 al 319 de la Ley General de\nla Administración Pública, con el propósito de garantizar el debido proceso y\nderecho de defensa de la parte afectada.\n\nCuando se suspenda la CST por\nhaberse incurrido en la causal contemplada en el inciso a) del artículo\nanterior, el período de suspensión será de hasta seis meses, que empezará a\ncorrer a partir del día siguiente al de la notificación de la resolución en\nfirme acordada por parte de la Comisión Técnica de Verificación del CST\n(CTV-CST). Durante el período de suspensión de la CST, la organización\nturística o institución afectada será excluida del Programa.\n\nCuando por haber incurrido en\nlas causales del inciso b), acápites ii, iii y iv del artículo anterior se\nrevoque la CST a una organización turística o institución, ésta no podrá\naplicar nuevamente al programa CST, sino hasta que haya transcurrido un período\nde un año a partir del día siguiente al de notificación de la resolución en\nfirme acordada por parte de la Comisión Técnica de Verificación del CST\n(CTV-CST). Además, para su eventual reincorporación al Programa CST la\norganización turística o institución con el CST revocado, deberá iniciar una\nnueva solicitud de registro en la Plataforma CST. Esto una vez cumplido el\nperíodo de un año supra indicado.\n\nCuando la revocatoria de la\nCST se disponga por haber incurrido en la causal del inciso b), acápite i, la\nsancionada no podrá aplicar nuevamente al programa CST, sino hasta que haya\ntranscurrido un período de seis meses a partir del día siguiente al de\nnotificación de la resolución en firme acordada por parte de la Comisión\nTécnica de Verificación del CST (CTV-CST) y deberá para ello iniciar una nueva\nsolicitud de registro en la Plataforma CST.\n\nAl suspenderse o revocarse la\nCST la interesada podrá interponer recurso de revocatoria o reposición ante la\nComisión Técnica de Verificación del Programa CST (CTV-CST), dentro del término\nde tres días hábiles contados a partir de la comunicación del acuerdo de\n\nresolución. En caso de que la Comisión\nTécnica de Verificación del Programa CST (CTV-CST) declare sin lugar la\nrevocatoria o reposición, esta resolución dará por agotada la vía administrativa.\n\n Ficha Artículo 26\n\nArtículo 27. Vencimiento del\nCST. Para volver a optar por la certificación CST una vez vencida ésta, se\ndeberá cumplir nuevamente con el proceso de Auditoría, para optar por la\nrecertificación. La CST tendrá una vigencia de un plazo de tres años calendario\na partir de la fecha de la notificación de su otorgamiento.\n\n Ficha Artículo 27\n\nArtículo 28. Derogatoria.\nDeróguese el Reglamento del Programa de Sostenibilidad Turística, Decreto\nEjecutivo N° 41415-MINAE-MCJ-MEIC-TUR del 17 de setiembre del 2018, publicado\nen el Alcance N° 203 al Diario Oficial La Gaceta Nº 228 del 7 de diciembre de\n2018.\n\n Ficha Artículo 28\n\nTransitorio único. Tiene un mínimo impacto\nambiental, ya que se da un uso óptimo a los recursos medioambientales,\nmanteniendo los procesos ecológicos esenciales y ayudando a conservar los\nrecursos naturales y la diversidad biológica.\n\n2. Se respeta la autenticidad\nsociocultural de las comunidades locales conservando sus activos culturales y\narquitectónicos, así como sus valores tradicionales y se contribuye al entendimiento\ny a la tolerancia intercultural.\n\n3. Integra las comunidades\nlocales a las actividades turísticas.\n\n4. Genera empleo local, tanto\ndirecta como indirectamente. En concreto, por cada empleo directo generado se\nproducen tres indirectos.\n\n5. Estimula el desarrollo de\nempresas turísticas (tales como agencias de viajes, transportes, alojamiento,\nalimentación, recreativas y complementarias), así como también de empresas\ndedicadas a actividades suplidoras (tales como ganadería, agricultura y\ncomunicaciones).\n\n6. Genera divisas al Estado y\nsuministra capitales a la economía local.\n\n7. El beneficio económico se\ndestina a la conservación o al desarrollo local, distribuyéndose entre todos\nlos agentes locales y contribuyendo así, a la reducción de la pobreza.\n\n8. Induce a la planificación\nregional, beneficiando un desarrollo armónico e integral de todos los sectores\nde la economía.\n\n9. Genera consciencia de los\nproblemas políticos, sociales y ambientales locales, favoreciendo el consumo\nresponsable y el respeto al medioambiente.\n\n10. Para los turistas es una\nexperiencia significativa que enriquece y fomenta unas prácticas turísticas\nsostenibles en su propio entorno.\n\n11. Requiere un seguimiento\nconstante de sus incidencias para introducir las medidas o acciones correctivas\nque resulten necesarias. De esta manera, estimula la mejoría de las\ninfraestructuras de servicio al turismo (tales como vías de comunicación,\ntelecomunicaciones, agua potable, alcantarillado sanitario, recolección y\ndeposición final de sólidos y aeropuertos).\n\n12. Promueve la restauración,\nconservación y uso de los yacimientos arqueológicos, monumentos arquitectónicos\ny cualquier obra física de interés colectivo y nacional.\n\n13. Destina parte de los\nbeneficios a la construcción de obras de interés comunitario como escuelas,\ncentros médicos, instalaciones deportivas, centros culturales, entre otros.\n\n14. Promueve y valora las\nmanifestaciones culturales locales, regionales y nacionales (tales como bailes,\nartesanía y gastronomía).\n\n15. Logra un desarrollo\nequilibrado con el medio ambiente, a través de los estudios de impactos\nambientales y el monitoreo ambiental.\n\n16. Promueve la autoestima\ncomunitaria.\n\n17. Oferta, valora, preserva\ny genera beneficios económicos de los recursos de flora y fauna, en beneficio\nde las comunidades locales.\n\n18. Vigila, evalúa y gestiona\nlos impactos que genera, desarrollando modelos de perpetuidad de su propio\ndesarrollo.\n\n19. Reactiva las zonas\nrurales: relanza directa e indirectamente la economía local y aporta vida a estas\nzonas, cuyos habitantes se benefician de una mayor oferta de actividades y de\nvisitantes más responsables y respetuosos con su cultura y entorno.\n\n20. Apoya los derechos\nhumanos y los derechos del trabajador, pues se basa en el respeto a las\ncomunidades de acogida y crea empleo de calidad.\n\n21. Mejora la calidad de vida\nde la población local, tanto económica como socio-culturalmente.\n\n22. Por último, el turismo\nsostenible potencia el consumo de productos autóctonos y naturales de las zonas\nen que se realiza.\n\n Ficha Artículo 4 Anexo\n\nAnexo 5 - Procedimiento de Obtención de\nla CST\n\nA) Para solicitantes por primera vez, se\ndebe:\n\n1- Registro en el Programa\nCST\n\n1.1 Participar\nen taller Técnico del Estándar CST.\n\n1.2 Solicitar\ncódigo de registro a la Unidad Técnica CST.\n\n1.3 Completar\nregistro en la Plataforma CST https://cst.turismo-sostenible.co.cr\n\n2- Implementación del\nEstándar CST\n\n2.1 Ingresar evidencias\ndocumentales en Plataforma. Plazo máximo: 90 días naturales. (autoevaluación)\n\n2.2 Responder con evidencia\ndocumental cada una de las preguntas del Estándar CST.\n\n2.3 Solicitar auditoría a la\nUnidad Técnica del CST dentro de la Plataforma CST.\n\n3. Auditoría\n\nAsignación de Persona\nAuditora.\n\n3.1 La Unidad Técnica CST\nasigna una persona auditora para la revisión y verificación de las evidencias\nen un plazo de 3 días hábiles.\n\n3.2 Llevar a cabo la reunión\ninicial.\n\nRevisión y evaluación. Plazo máximo: 15 días hábiles\n\n3.3 Revisión y verificación\ndocumental por parte de la persona auditora de todas las evidencias para emitir\nun Informe Preliminar. (Plazo máximo: 15 días hábiles)\n\n3.4 Envío de Informe\nPreliminar al solicitante a través de Plataforma CST.\n\nPeríodo de subsanes. Plazo máximo: 15 días\nhábiles.\n\n3.5 La solicitante revisa el\nInforme Preliminar con las no conformidades y observaciones subsanables en cada\nuna de las preguntas realizadas por la persona auditora.\n\n3.6. Recibir la visita in\nsitu de la persona auditora, a criterio de la persona auditora.\n\n3.7. Ingresar nueva evidencia\nen la Plataforma CST para subsanar las no conformidades en respuesta al Informe\nPreliminar.\n\n3.8. Presentar el Plan de\nMejora en la Plataforma CST.\n\nInforme de Auditoría (final).\nPlazo: 15 días hábiles.\n\n3.9. Revisión de subsanes por\nparte de la persona auditora.\n\n3.10. Revisión de Plan de\nMejora.\n\n3.11. Elaboración de Ficha\nTécnica.\n\n4. Certificación por parte\ndel CTV-CST.\n\n4.1 Revisión de expediente de\nla auditoría.\n\n4.2 Emisión del comunicado de\nacuerdo de la CTV-CST con el resultado final del proceso de auditoría y de\ncertificación.\n\n5. Seguimiento y Mejora\nContinua\n\n5.1 Revisión de la\nimplementación del plan de mejora.\n\n5.2 Visita in situ, a\ncriterio de la Unidad Técnica.\n\nIMPORTANTE: En caso de que una empresa\nsolicitante cambie de razón social, deberá aplicar como solicitante por primera\nvez.\n\nB) Para solicitantes por\nrecertificación, se debe:\n\n1. Registro\n\n1.1 Participar en taller\nTécnico de Recertificación del Estándar CST.\n\n1.2 Actualizar el perfil en\nla Plataforma CST https://cst.turismo-sostenible.co.cr\n\n2. Implementación del\nEstándar CST\n\n2.1 Ingresar evidencias\ndocumentales en Plataforma. Plazo máximo: 90 días naturales.\n\n2.2 Responder con evidencia\ndocumental cada una de las preguntas del Estándar CST.\n\n2.3 Solicitar la auditoría a\nla Unidad Técnica del CST dentro de la Plataforma CST.\n\n3. Auditoría\n\nAsignación de Persona Auditora.\n\n3.1 La Unidad Técnica CST\nasigna una persona auditora para la revisión y verificación de las evidencias\nen un plazo máximo de 3 días hábiles.\n\n3.2 Llevar a cabo la reunión\ninicial.\n\nRevisión y evaluación. Plazo máximo: 15 días hábiles.\n\n3.3 Revisión y verificación\ndocumental por parte de la persona auditora de todas las evidencias para emitir\nun Informe Preliminar.\n\n3.4 La persona auditora envía\nel Informe Preliminar al solicitante a través de Plataforma CST.\n\nPeríodo de subsanes. Plazo máximo: 15 días\nhábiles.\n\n3.5 La solicitante revisa el\nInforme Preliminar con las no conformidades y observaciones subsanables en cada\nuna de las preguntas realizadas por la persona auditora.\n\n3.6. Recibir la visita in\nsitu de la persona auditora si fuese necesario, a criterio de la persona\nauditora.\n\n3.7. Ingresar nueva evidencia\nen la Plataforma CST para subsanar las no conformidades en respuesta al Informe\nPreliminar.\n\n3.8. Presentar el Plan de\nMejora en la Plataforma CST.\n\nInforme de Auditoría (final).\nPlazo máximo: 15 días hábiles.\n\n3.9. La persona auditora\nrevisa los subsanes.\n\n3.10. La persona auditora\nrevisa el Plan de Mejora.\n\n3.11. La persona auditora\nelabora la Ficha Técnica.\n\n4. Certificación por parte\ndel CTV-CST.\n\n4.1 Revisión de expediente de\nla auditoría.\n\n4.2 Emisión del comunicado de\nacuerdo de la CTV-CST con el resultado final del proceso de auditoría y de\ncertificación.\n\n5. Seguimiento y Mejora\nContinua\n\n5.1 Revisión de la\nimplementación del plan de mejora.\n\n5.2 Visita in situ, a\ncriterio de la Unidad Técnica.\n\n Ficha Artículo 5 Anexo\n\nAnexo 6 - Verificaciones de oficio para\nla inscripción en el CST.\n\nRequisitos generales a\nverificar por el ICT al momento de su registro en la Plataforma CST: La\nsolicitante deberá estar al día con las siguientes obligaciones en lo que le\nsea legalmente aplicable, lo cual será verificado de oficio por el ICT, según\nel siguiente detalle:\n\na) Verificación por parte del\nICT, que la solicitante está al día con el pago de las cuotas obreros\npatronales ante la Caja Costarricense de Seguro Social. Si la empresa aparece\ncomo \"Patrono Inactivo al día\" la empresa solicitante deberá pronunciarse en\nlos próximos 10 días hábiles contados a partir de la presentación de esta\nsolicitud, indicando las razones por las que se indica que es un \"patrono\ninactivo\".\n\nb) Verificación por parte del\nICT, que la solicitante está al día con las cuotas del pago al Fondo de\nDesarrollo Social y Asignaciones Familiares (FODESAF) de un 5% sobre el total\nde sueldos y salarios que paguen mensualmente a su personal trabajador según la\nLey de Desarrollo Social y Asignaciones Familiares, Ley N° 5662 del 23 de diciembre\nde 1974.\n\nc) Verificación por parte del\nICT, que la solicitante está al día con las cuotas del pago del impuesto a las\nPersonas Jurídicas de la Ley N° 9428 del 21 de marzo de 2017. Whereas, in accordance with the Organic Law of the Instituto Costarricense de Turismo, Ley N° 1917 of July 30, 1955, and its amendments, the governing body in tourism matters is the Instituto Costarricense de Turismo (hereinafter ICT), which is responsible for promoting and overseeing private tourism-related activities.\n\nII. Whereas, the Board of Directors of ICT has issued the current National Tourism Plan of Costa Rica, 2022–2027 update (hereinafter PNT), defined as the set of sectoral policies, strategies, objectives, and actions to ensure that the future development of tourism activity aligns with the country's \"tourism brand\" positioning and contributes to the human development goals the country has set for itself; and which draws inspiration from the Sustainable Development Goals (hereinafter ODS) put forward by the specialized United Nations tourism agency (hereinafter ONU Turismo) and the United Nations Environment Programme (PNUMA).\n\nIII. Whereas, the key elements in the competitive strategy set forth in the PNT have generated the desired positioning through: sustainability, innovation, and inclusion — key factors of the model that are essential to its continuity and strengthening and are therefore primary components of the country's tourism policy. The PNT highlights the Tourism Sustainability Certification Program (hereinafter CST), awarded by ICT, as a differentiation and positioning program and as a tool for promoting sustainability in tourism organizations and institutions that voluntarily choose to obtain it, given that it has proven to be of fundamental importance as a differentiating element of the tourism industry both nationally and internationally.\n\nIV. Whereas, the CST Standard (Estándar CST) was updated through publication in Supplement N° 185 to Official Gazette La Gaceta N° 215 of November 15, 2024, in order to respond to the current needs of its management dynamics, to the integration of new sub-sectors of the tourism sector, to its international recognition, and to its alignment with the Code of Good Practice of the International Social and Environmental Labelling Alliance (ISEAL), which promotes that standards must be reviewed and updated at least every five years to ensure they remain relevant and effective.\n\nV. Whereas, by its very nature, tourism has been clearly identified worldwide as a dynamic, resilient, constantly changing, and rapidly evolving sector; and for this reason, ICT responds to the needs of the tourism sector with an innovative, competitive, inclusive, efficient, updated, and digital CST Standard.\n\nVI. Whereas, for the update and institutional reorganization of the CST, the need has been identified to modify the current Regulations of the Tourism Sustainability Program, Decreto Ejecutivo N° 41415-MINAE-MCJ-MEIC-TUR of September 17, 2018, which — for greater clarity to the regulated party — entails the issuance of a new set of regulations and the repeal of the decree currently in force, given that the logical order of its chapters was reorganized by subject matter and definitions were updated and added for a better understanding of the CST program.\n\nVII. Whereas, the present regulation of the CST Program aims to: adapt the CST Program to new business models and to the current CST Standard, and to strengthen and reorganize its functional administrative structure within ICT.\n\nVIII. Whereas, the changes proposed by the draft new regulations for the CST Program seek the following derived outcomes: updating the CST Program to the latest advances in tourism sustainability according to the current CST Standard, greater clarity for the regulated party regarding the process followed to apply for certification in accordance with the CST Platform, and generating added value in positioning and differentiation for the promotion of the tourism sector.\n\nIX. Whereas, the Board of Directors of ICT approved the draft decree in question by means of the resolution adopted at Ordinary Board of Directors Session N° 6341, item 5, subsection I, held on August 18, 2025.\n\nX. Whereas, in accordance with Articles 12 and 12 bis of the Regulations to the Law on Citizen Protection from Excessive Requirements and Administrative Procedures, Decreto Ejecutivo N° 37045-MP-MEIC of February 22, 2012, the Cost-Benefit Assessment Form was duly completed under Section I, titled \"Prior Regulatory Improvement Review,\" yielding a negative result, and confirming that the proposal contains no new procedures, requirements, and/or administrative steps that applicants must fulfill in order to participate in the voluntary CST program.\n\nXI. Whereas, in the Prior Review System of the Ministry of Economy, Industry and Commerce, at the electronic address: www.tramitescr.meic.go.cr, the draft of the new regulation was published for public consultation, with prior notice in the \"Public Consultation\" section of ICT's website, www.ict.go.cr; on September 8, 2025 (public consultation opened September 9, 2025; public consultation closed September 23, 2025), all in accordance with Article 361 of Ley N° 6227 of May 2, 1978, General Administrative Law; a process in which comments from the public were received, assessed, and answered by ICT without resulting in any modifications to the text of the draft regulation at hand.\n\nXII. Whereas, the foregoing was confirmed by Report DMR-DAR-INF-240-2025 from the Regulatory Improvement Directorate of the Ministry of Economy, Industry and Commerce, dated October 21, 2025, which verified that ICT assessed and responded to the public's comments in the public consultation process and, as a result, concluded that, from a regulatory improvement perspective, the proposal \"Reglamento del Programa para la Sostenibilidad Turística\" complies with the principles of regulatory improvement.\n\nPor tanto;\n\nDECREE\n\nREGULATIONS FOR THE TOURISM SUSTAINABILITY PROGRAM\n\nCHAPTER I\n\nGENERAL PROVISIONS\n\nArticle 1. Purpose. The purpose of these Regulations is to govern the award of the Tourism Sustainability Certification (Certificación de la Sostenibilidad Turística, hereinafter CST), which aims to recognize tourism organizations and institutions according to the degree to which their operation conforms to a sustainability model. To this end, a technical tool known as the \"Standard\" (Estándar) will be made available, consisting of an online assessment system, an implementation guide for the CST Standard, verification mechanisms, and an organizational structure aligned with international requirements.\n\nArticle Record 1\n\nArticle 2. Scope of Application. The provisions contained in these Regulations apply exclusively to tourism organizations and institutions applying for a Tourism Sustainability Certificate, which is free of charge and strictly voluntary in nature, and whose obtainment is not required for the applicant's operation.\n\nArticle Record 2\n\nArticle 3. Definitions. For the purposes of these Regulations, the following terms shall be understood as:\n\na) Audit (auditoría): A process carried out by lead auditors assigned by ICT to determine the degree of compliance of applying tourism organizations and institutions with the current CST Standard.\n\nb) Auditor (Auditor or Auditora): A staff member who possesses advanced auditing skills based on Integrated Management Systems ISO 9001 and ISO 14001, ISO 14064, ISO 19011, and their updates, skills which are applied for the purpose of evaluating a management system through proper planning, execution, and audit reliability. In exceptional cases, the auditor may be accompanied by another auditor in order to build professional experience in this type of CST audit.\n\nc) CST Certificate: A public and formal recognition awarded by the \"Technical Verification Commission of the CST (CTV-CST)\" to applying tourism organizations and institutions that complete the certification process.\n\nd) Technical Verification Commission of the CST (CTV-CST): A collegiate body attached to and headquartered at ICT, which shall make available to it the economic, technical, and human resources necessary for the adequate fulfillment of its functions.\n\ne) CST Standard (Estándar CST): A technical tool that evaluates the sustainability level of tourism organizations and institutions, comprised of dimensions, criteria, and indicators, classified as mandatory, continuous improvement, and external impact questions, and governed by the characteristics referenced in Anexo 1 of these Regulations, which forms an integral part thereof.\n\nf) Indicator (Indicador): Indicators are measures that allow for the evaluation of an organization's performance, the verification of compliance with its objectives, and the making of strategic decisions.\n\ng) Action Plan (Plan de Acción): A document that incorporates the activities to be carried out to achieve the objectives and goals established by the organization. It includes the allocation of human resources, deadlines, expected outcomes, and success indicators. The purpose of the Action Plan is the continuous improvement of applying tourism organizations and institutions.\n\nh) CST Platform (Plataforma CST): A digital system for executing, planning, and managing the CST audit process, available to applying tourism organizations and institutions in accordance with the technical specifications set out in Anexo 2 of these Regulations, which forms an integral part thereof.\n\ni) Management System (Sistema de Gestión): A set of interrelated and coordinated elements and activities that, by establishing policies and objectives, direct and control an organization in order to achieve its stated goals.\n\nj) Applicant (Solicitante): Refers to tourism organizations and institutions that, as set out in Anexo 3 of these Regulations, are eligible to apply for the CST.\n\nk) Tourism sustainability (sostenibilidad turística): A tourism management model that seeks to reduce negative impacts on the environment, culture, and society, while at the same time maximizing positive benefits for local communities, ecosystems, and the economy.\n\nl) CST Standard Technical Workshop (Taller Técnico del Estándar CST): An introductory process designed to guide tourism organizations and institutions on the application of the CST Standard.\n\nArticle Record 3\n\nArticle 4. Purposes of the CST Program. The CST Program has the following purposes:\n\na) To serve as the instrument through which Costa Rica achieves differentiation on the world stage as a sustainable tourism destination.\n\nb) To identify indicators of the sustainable management system of tourism organizations and institutions participating in the program in order to improve their strategic decision-making, with prior informed consent.\n\nc) To establish sustainability as a competitiveness element within the national tourism sector.\n\nd) To be a voluntary, free, innovative, efficient, and updated program aligned with the current context of the tourism sector and its needs, and one that delivers high-impact added value to the tourism market.\n\ne) To ensure that the CST Standard integrates the criteria of ONU Turismo's Responsible Tourism System and the Global Goals for Sustainable Development of the United Nations (ONU), as included in Anexo 4 of these Regulations, which forms an integral part thereof.\n\nArticle Record 4\n\nCHAPTER II\n\nADMINISTRATIVE ORGANIZATION OF THE CST PROGRAM\n\nArticle 5. Ownership of the CST Program and coordination of institutional responsibilities.\n\nThe CST Program and CST Standard are the intellectual property of ICT, which shall be responsible for overseeing their administration and promotion within the scope of its legal competencies and the policies dictated by its Board of Directors in tourism matters.\n\nIn accordance with the purposes and legal functions of ICT established in Chapters II and III of its Organic Law, Ley N° 1917 of July 30, 1955, and its amendments, the institutional organization of the CST Program shall involve the following parties:\n\na) CST Technical Unit (Unidad técnica CST): under the responsibility of the Department of Tourism Sustainability, which shall organize and oversee all matters relating to the operation of the CST Standard, the audit process, and the auditors who will assess CST applicants.\n\nb) Auditors: under the responsibility of the CST Technical Unit, which shall organize and oversee all matters relating to the performance of auditors and the processes of assigned audits.\n\nc) Technical Training: under the responsibility of the CST Training Team, which shall provide workshops, advisory services, courses, training sessions, and content updates on the topics covered by the CST.\n\nd) CST Promotion and Marketing: under the responsibility of ICT's Marketing Directorate, which shall develop the CST Program strategy for its various target audiences.\n\ne) Legal Advisory: under the responsibility of the Legal Advisory Office, which shall provide legal counsel to the CST Program.\n\nf) Records Secretariat (Secretaría de Actas): responsible for preparing minutes, maintaining the respective records for each session, communicating the resolutions adopted, monitoring and ensuring compliance with those resolutions, signing official minutes, and carrying out all other acts delegated by the CTV-CST whose purpose is to prepare and facilitate the exercise of the Technical Verification Commission's own functions.\n\nArticle Record 5\n\nArticle 6. Functions of the ICT Board of Directors in the CST Program.\n\nThe Board of Directors of ICT, in the exercise of the authority established in subsection b) of Article 26 of the Organic Law of ICT, Ley N° 1917 of July 30, 1955, and its amendments, shall be responsible for:\n\na) Approving the CST Standard and any eventual amendments and updates thereto.\n\nb) Issuing and promulgating the internal regulations necessary for the implementation and operation of the CST program.\n\nc) Ensuring strict compliance with the regulations relating to sustainable tourism.\n\nArticle Record 6\n\nArticle 7. Functions of the General Management of ICT in the CST Program.\n\nThe General Management of ICT, in the exercise of the powers established in Article 32 of the Organic Law of ICT, Ley N° 1917 of July 30, 1955, and its amendments, shall be responsible for:\n\na) Ensuring that all actions of the Institute are in line with the country's sustainability and tourism laws and regulations.\n\nb) Establishing strategic alliances with other government entities, international organizations, business associations, and civil society organizations to strengthen the impact of the CST in the tourism industry.\n\nc) Presenting to the Board of Directors for approval the CST Standard corresponding to each tourism activity — including the use of new technical sustainability standards — its amendments or updates, in accordance with the recommendations of the technical unit.\n\nd) Organizing, coordinating, and supervising, in the capacity of general administration and senior management of ICT, the technical units and institutional departments designated as responsible for carrying out actions related to the CST Program; for this purpose, the General Management may designate or establish responsible units, working groups, or technical execution committees from among them.\n\ne) Recommending and proposing initiatives to the Board of Directors of ICT, as appropriate, for the organization, operation, and strengthening of the CST Program.\n\nf) Overseeing the national and international promotion and marketing activities of the CST Program carried out by the Marketing Directorate, the CST Program Technical Unit, and any other institutional units deemed appropriate and in the institutional interest.\n\nArticle Record 7\n\nArticle 8. Functions of the Directorate of Tourism Competitiveness and Sustainability in the CST Program. The Directorate, in the exercise of its authority, shall be responsible for:\n\na) Overseeing the implementation of actions related to the CST Program, for which purpose it may designate or establish responsible units, working groups, or technical execution committees from among the participating entities.\n\nb) Proposing to the General Management, for submission to the Board of Directors, the CST Standard corresponding to each tourism activity — including the use of new technical sustainability standards — its amendments or updates, or other initiatives as appropriate, for the organization, operation, and strengthening of the CST Program.\n\nc) Coordinating with the directorates, departments, and units deemed appropriate and in the institutional interest, the planning and agreement of strengthening, promotion, and marketing actions, both nationally and internationally, for the CST Program.\n\nd) Proposing to the General Management, for the Board of Directors' consideration, the execution of agreements with legally established national and international organizations in matters related to the CST Program.\n\ne) Designing and pursuing incentive schemes to encourage the adoption of the CST by more tourism businesses, such as benefits, access to financing, or priority inclusion in ICT's marketing strategies.\n\nArticle Record 8\n\nArticle 9. Technical Unit of the CST Program. The Department of Tourism Sustainability of ICT shall serve as the Technical Unit of the CST Program, which shall be headed by the department chief. Its functions are specified below:\n\na) Development of Standards and Procedures: Creating and updating the standards and procedures to be followed for certification.\n\nb) Organizing and carrying out all administrative processes related to the granting, recertification, suspension, and revocation of the CST certificate.\n\nc) Training and supervising auditors.\n\nd) Administering the CST Platform, including actions related to the provision of and access to technical tools, updating of regulations, and updating of bibliographic resources.\n\ne) Organizing and coordinating the certification process with applicants.\n\nf) Organizing and coordinating the CST recertification process with applicants, which must be initiated 6 months before the expiration of the certification.\n\ng) Verifying that applicants meet the necessary requirements to initiate the registration, advisory, audit, certification, and recertification process.\n\nh) Sending reports, technical data sheets, and required documents to the CTV-CST.\n\ni) Coordinating support with ICT's Records Secretariat for the convening of sessions, the drafting of session minutes, and the custody of CTV-CST documents.\n\nj) Providing the information necessary to keep the CST Program website and ICT's websites up to date.\n\nk) Carrying out the administrative, budgetary, operational, and logistical tasks in support of the CST Program's objectives.\n\nl) Providing information to the tourism business community and the general public on the progress of the CST Program and maintaining confidentiality on matters that strictly concern certified tourism organizations and institutions.\n\nm) Continuously supervising and monitoring compliance with standards by applicants.\n\nn) Notifying those who have obtained the CST of the expiration of their certification, together with notice that they will cease to receive the Program's benefits.\n\no) Maintaining and managing all documentation related to the certification process, including audit reports and compliance records.\n\nArticle Record 9\n\nArticle 10. Structure of the Technical Unit of the CST Program.\n\nThe following shall be the structure of the CST Program Technical Unit:\n\na) Audit team (Equipo auditor): A team made up of ICT staff members certified as Lead Auditors in Integrated Quality Management Systems ISO 9001:2015 and Environmental Management Systems ISO 14001:2015 — or the most current version validated by the Instituto de Normas Técnicas de Costa Rica (INTECO) — assigned to carry out an audit; the team consists of a lead auditor, who may be accompanied by audit professionals, technical experts, or auditors in training.\n\nThe CST audit team shall have the following functions:\n\ni. Conducting audits on the CST Platform of applicants admitted to the CST Program, for the purpose of generating a report that includes compliance findings and recommendations.\n\nii. Planning the audit and the opening meeting with the applicant.\n\niii. Conducting a field visit to applicants and generating a technical field visit report.\n\niv. Following up with certified tourism organizations and institutions throughout the recertification process.\n\nv. Maintaining confidentiality on matters that strictly concern certified tourism organizations and institutions participating in the CST Program.\n\nvi. Suggesting necessary changes or improvements to the criteria and indicators proposed in the CST Standard.\n\nvii. Other functions assigned by the head of the Department of Tourism Sustainability.\n\nb) Training team (Equipo capacitador): A team made up of ICT staff members assigned to generate content, tools, workshops, and support for tourism organizations and institutions interested in participating in the CST process. Members of the training team may not simultaneously audit CST Program applicants.\n\nThe CST training team shall have the following functions:\n\ni. Establishing an annual training schedule for applicants interested in the CST.\n\nii. Training applicants on the CST Standard through group workshops.\n\niii. Attending to group and individual inquiries from applicants.\n\niv. Training different tourism sector stakeholders on topics related to sustainability.\n\nv. Developing methodological support tools for the implementation of the CST Standard.\n\nArticle Record 10\n\nCHAPTER III\n\nON THE TECHNICAL VERIFICATION COMMISSION OF THE CST (CTV-CST)\n\nArticle 11. Creation. The Technical Verification Commission of the CST Program (CTV-CST) is hereby created as a body attached to and headquartered at ICT, which shall place at its disposal the economic, technical, and human resources necessary for the adequate fulfillment of its functions.\n\nArticle Record 11\n\nArticle 12. Composition. The Technical Verification Commission of the CST Program (CTV-CST) shall be composed of one full representative and one alternate representative from each of the following entities:\n\na) One representative of ICT, appointed by administrative act of its General Management, who shall preside over the CTV-CST and shall have a casting vote (voto de calidad) in the event of a tie.\n\nb) One representative of MINAE, appointed by administrative act of its ministerial head.\n\nc) One representative of MCJ, appointed by administrative act of its ministerial head.\n\nd) One representative jointly designated by agreement of the Boards of Directors of the Cámara Nacional de Turismo (CANATUR) and the Cámara Nacional de Ecoturismo y Turismo Sostenible (CANAECO).\n\ne) One representative jointly designated by appointment of the rectorates of the Universidad de Costa Rica (UCR) and the Instituto Centroamericano de Administración de Empresas (INCAE).\n\nf) One representative jointly designated by appointment of the Office of the Director General of the Instituto Nacional de Biodiversidad (INBIO) and the Regional Office of the International Union for Conservation of Nature (UICN).\n\nThe members of the Technical Verification Commission of the CST (CTV-CST) shall serve on an ad honorem basis and shall be deemed appointed for a term of two years from the date of their swearing-in before ICT, renewable for equal periods. A vice-presidency shall be designated from among the members, who shall preside over sessions in the absence of the president.\n\nArticle Record 12\n\nArticle 13. Functions. The functions of the Technical Verification Commission of the CST Program (CTV-CST) shall be as follows:\n\na) Awarding the Tourism Sustainability Certification (CST) to tourism organizations and institutions.\n\nb) Resolving the suspension or revocation of the CST for certified tourism organizations and institutions that incur in the grounds established in Article 25 of these Regulations.\n\nc) Proposing to the Board of Directors of ICT the execution of agreements with legally established national and international organizations in matters related to the CST program.\n\nd) Ensuring the correct application of the CST award procedure.\n\ne) Advising on and promoting the development of technical and strategic improvements for the strengthening and optimization of the Tourism Sustainability Certification Program (CST), guaranteeing its alignment with best national and international practices in the field of tourism sustainability.\n\nf) Denying, with a statement of reasons, CST Program applications that do not attain the minimum qualifying score, for which purpose the applicant shall be granted a period of three business days following the day of notification of the denial decision to file the appeal provided for in Article 15 of these Regulations.\n\nArticle Record 13\n\nArticle 14. Sessions. The Technical Verification Commission of the CST (CTV-CST) shall hold ordinary sessions at least once a month and extraordinary sessions whenever necessary. A quorum shall be constituted by the attendance of four members.\n\nResolutions shall be adopted by an absolute majority (mayoría absoluta) of the attending representatives; such resolutions shall become final at the following session unless the members present agree to their immediate finality by a vote of two thirds of the full membership of the Technical Verification Commission of the CST (CTV-CST), in accordance with Article 56, subsection 3) of the General Administrative Law, Ley Nº 6227 of May 2, 1978, and its amendments. In the event of a tie in voting, the presiding member shall have a double vote (casting vote).\n\nMatters not provided for herein shall be governed by the provisions regulating Collegiate Bodies contained in the General Administrative Law, Title Two, Chapter Three.\n\nArticle Record 14\n\nArticle 15. Appeal. Decisions of the Technical Verification Commission of the CST Program (CTV-CST) shall be subject solely to the motion for reconsideration (recurso de revocatoria o reposición), which must be filed before the Commission itself within the three business days following notification thereof, in accordance with Article 346 and subsequent articles of the General Administrative Law. Once declared final, the concluding acts of the Technical Verification Commission of the CST (CTV-CST) shall have the effect of exhausting administrative remedies.\n\nArticle Record 15\n\nCHAPTER IV\n\nON THE REQUIREMENTS OF THE CST PROGRAM AND THE INITIAL ASSESSMENT AUDITS, THE MONITORING AND CONTINUOUS IMPROVEMENT PROCESS, AND RECERTIFICATION OF APPLICANTS\n\nArticle 16. Implementation of the CST Standard. In order to obtain the CST, the CST Platform must be used and the procedure established and detailed in Anexos 2, 3 and 5, which form an integral part of these Regulations, must be followed.\n\nArticle Record 16\n\nArticle 17. General requirements for the enrollment procedure to participate in the CST Program. CST applicants shall:\n\na) Register through the CST Platform form, accessible at the electronic address: https://cst.turismo-sostenible.co.cr. This online application must be completed by the applicant's legal representative, shall constitute a sworn statement (declaración jurada), and shall include the applicant's commitment to ICT to be in compliance with all legal requirements applicable to its category and activity.\n\nb) Be in compliance with the ex officio verifications to be carried out by ICT in accordance with the detail set out in Anexo 6 of these Regulations, which forms an integral part thereof.\n\nc) Comply, through the CST Platform, with the requirements and procedure for obtaining the CST, as detailed in Anexos 2, 3 and 5 of these Regulations, which form an integral part thereof.\n\nd) Comply with the requirements of the CST Standard corresponding to their activity, as detailed in Anexo 1, which forms an integral part of these Regulations.\n\nArticle Record 17\n\nArticle 18. CST Program Levels. An applicant that meets the CST standard and its associated procedural requirements, as set forth in Article 17 of this Regulation, shall be awarded the CST Certificate, which shall have the following levels:\n\na) Minimum: requires the applicant to comply with one hundred percent of the mandatory criteria and indicators stipulated in the CST Standard.\n\nb) Maximum: requires the applicant to demonstrate improvement and continuity in the management process at a minimum of fifty percent and an external impact of seventy percent across the criteria and indicators of the CST Standard.\n\nArticle 18 Record\n\nArticle 19. Request for Audits. Tourism organizations and institutions may request audits through the CST Platform, following the steps established therein, in the following cases:\n\na) Audit (first time, for applicants who do not yet hold the CST): The request must be submitted 90 days after registration on the CST Platform, upon completion of the evidence submission process.\n\nb) Audit to improve the CST level obtained: If a certified company wishes to improve its current level, it may do so once 6 calendar months have elapsed from the date on which the minimum level was granted. If a higher level is not achieved, the current certification level shall be maintained.\n\nc) Audit for Recertification: The request must be submitted at least 90 days before the expiration of the current certification.\n\nArticle 19 Record\n\nArticle 20. Information to Be Submitted for Audits.\n\nAudit applicants shall submit documentary evidence (evidencia documental) in the CST Platform in accordance with the requirements established in the CST Standard applicable to their activity; this documentation shall constitute the file (expediente) for their application. This information is submitted for verification by the audit team and the members of the CTV-CST, who shall treat it as confidential. Documentary evidence must be submitted preferably in Spanish, and if it is in another language, a simple translation into Spanish must be provided.\n\nGeneral information concerning those who obtain the CST, excluding sensitive or private data and based on their prior informed consent, shall be disclosed by ICT for institutional purposes and in accordance with the provisions of this Regulation.\n\nArticle 20 Record\n\nArticle 21. Validity of the CST. The CST shall be valid for three calendar years from the date of notification of its award.\n\nArticle 21 Record\n\nCHAPTER V\n\nTHE CST PROGRAM LOGO\n\nArticle 22. Use of the CST Logo. Tourism organizations and institutions certified under the CST shall receive an exclusive and non-transferable identification logo, which must be displayed in a visible location at the establishment or place of operations for as long as the certification remains valid. In addition, they may use the logo in their promotional materials, provided they comply with the brand manual and the guidelines established by the CST Program.\n\nArticle 22 Record\n\nCHAPTER VI\n\nBENEFITS OF THE CST PROGRAM\n\nArticle 23. Benefits. Tourism organizations and institutions holding a valid CST shall be entitled to the following benefits:\n\na) Priority access to ICT training programs on social, cultural, and environmental topics.\n\nb) Accompaniment and technical support on sustainability matters at ICT central and regional offices.\n\nc) Differentiated promotion and visibility at national and international tourism activities and trade fairs, along with priority institutional technical support for participation in these events.\n\nd) Opportunity for exposure in international media through the hosting of international journalists and social-media influencers, based on ICT's technical judgment and availability.\n\ne) Priority to participate in ICT events for sharing and discussing the scope of the CST Program.\n\nf) Discounted registration fees for international trade fairs with ICT for certified holders: minimum level: 60% discount; maximum level: 100% discount.\n\ng) Differentiated presence of the tourism organization or institution on ICT's promotional web pages.\n\nh) Authorization to use the link to the CST program's official website in their promotional materials.\n\ni) Other benefits that ICT may arrange with other national and international organizations.\n\nUpon expiration of the CST certification, program benefits are suspended, including promotion as certified tourism organizations or institutions.\n\nArticle 23 Record\n\nCHAPTER VII\n\nOBLIGATIONS OF TOURISM ORGANIZATIONS AND INSTITUTIONS THAT OBTAIN THE CST\n\nArticle 24. Obligations. Tourism organizations and institutions that obtain the CST shall have the following obligations:\n\na) Comply with the provisions of this Regulation and with the applicable legislation governing their commercial activity, insofar as applicable in accordance with the CST Standard.\n\nb) Comply with the environmental, social, economic, and cultural measures set forth in the CST Standard applicable to their activity and throughout the period of validity.\n\nc) The CST logo must be used without modifications and only during the valid period of the certification.\n\nd) Provide required information regarding their operation and compliance with the criteria and indicators of the CST Standard for the purposes of the CST audit process. This information may also be used by the CST program for the following purposes: evaluation of the CST Standard, definition of indicators for the sustainable management system, creation of institutional promotional content, and preparation of institutional reports.\n\nThis is done with the objective of promoting the importance and benefits of the Tourism Sustainability Certification (Certificación de Sostenibilidad Turística, CST), subject to the prior informed consent of the applicant or certified entity.\n\ne) Disseminate through communications media the benefits obtained from implementing a Sustainability Management System (Sistema de Gestión de Sostenibilidad) in their operations.\n\nf) Whenever a change occurs in the person responsible for or the implementation team of the CST process, the CST Technical Unit must be notified. New team members must attend the CST Technical Workshop corresponding to their activity.\n\ng) Comply with the audit process in accordance with the provisions of this Regulation.\n\nArticle 24 Record\n\nCHAPTER VIII\n\nSUSPENSION, REVOCATION, AND EXPIRATION OF THE CST\n\nArticle 25. Grounds. The enjoyment of the CST shall be suspended, or the CST shall be revoked, pursuant to the procedure established in Article 26 of this Regulation, with respect to certified tourism organizations and institutions in the following cases:\n\na) Ground for Suspension: When the certified entity fails to submit evidence of the ongoing work required by the audit in its improvement plan.\n\nb) Grounds for Revocation:\n\ni. When they fail to maintain the minimum CST level.\n\nii. When they fail to comply with the provisions of this Regulation, the CST Standard, and the applicable legislation governing their activity, insofar as applicable in accordance with said CST Standard; the foregoing based on a final resolution issued by the legally competent authority and subject to prior observance of due process (debido proceso).\n\niii. When they use the logo or the link to the CST Program's official website for purposes other than those for which it was granted, or in establishments or commercial activities other than those audited or included in the corresponding CST program.\n\niv. When they engage in false advertising (publicidad engañosa) regarding the CST obtained, thereby misleading users of the tourism service.\n\nArticle 25 Record\n\nArticle 26. Procedure. To suspend or revoke the CST of a certified tourism organization or institution, the ordinary procedure contained in Book Two, Title VI, Chapter I, Articles 308 through 319 of the Ley General de la Administración Pública shall be followed, in order to guarantee due process and the right of defense of the affected party.\n\nWhen the CST is suspended for having incurred in the ground set forth in subsection a) of the preceding article, the suspension period shall be up to six months, running from the day following notification of the final resolution agreed upon by the CST Technical Verification Commission (Comisión Técnica de Verificación del CST, CTV-CST). During the period of CST suspension, the affected tourism organization or institution shall be excluded from the Program.\n\nWhen the CST is revoked from a tourism organization or institution for having incurred in the grounds set forth in subsection b), items ii, iii, and iv of the preceding article, that entity may not reapply to the CST program until one year has elapsed from the day following notification of the final resolution agreed upon by the CTV-CST. Furthermore, for its eventual reinstatement in the CST Program, the tourism organization or institution whose CST has been revoked must initiate a new registration request on the CST Platform, after the aforementioned one-year period has expired.\n\nWhen the revocation of the CST is ordered for having incurred in the ground of subsection b), item i, the sanctioned entity may not reapply to the CST program until six months have elapsed from the day following notification of the final resolution agreed upon by the CTV-CST, and must initiate a new registration request on the CST Platform.\n\nUpon suspension or revocation of the CST, the affected party may file a motion for reversal or reinstatement (recurso de revocatoria o reposición) before the CTV-CST, within three business days counted from the date of communication of the resolution agreement. If the CTV-CST denies the motion for reversal or reinstatement, that resolution shall be deemed to exhaust the administrative channel.\n\nArticle 26 Record\n\nArticle 27. Expiration of the CST. To reapply for CST certification once it has expired, the applicant must once again complete the Audit process in order to obtain recertification. The CST shall be valid for three calendar years from the date of notification of its award.\n\nArticle 27 Record\n\nArticle 28. Repeal. The Reglamento del Programa de Sostenibilidad Turística, Decreto Ejecutivo N° 41415-MINAE-MCJ-MEIC-TUR of September 17, 2018, published in Supplement N° 203 to the Diario Oficial La Gaceta Nº 228 of December 7, 2018, is hereby repealed.\n\nArticle 28 Record\n\nSole Transitory Provision. From the effective date of this Regulation, all active certifications under the CST Program in the CST platform shall have their validity extended until they reach a total of three years.\n\nTransitory Provision 1 Record\n\nArticle 29. Each of the dimensions of the CST Standard is divided into Criteria and Indicators with questions classified as:\n\nMandatory.\n\nThese are the indicators that must be mandatorily met in order to demonstrate sustainable operations.\n\nThey are the pillars of the CST Standard; when fulfilled at 100% in each of the four dimensions, certification may be obtained.\n\nImprovement and Continuity\n\nSeeks to measure the impact on internal and external stakeholders directly related to the company, organization, or protected area.\n\nThey demonstrate progress and advancement in sustainable management.\n\nA compliance percentage of at least 50% in each of the four dimensions is required.\n\nExternal Impact:\n\nSeeks to demonstrate the results of the company, organization, or protected area in benefit of the immediate communities or beyond their surroundings.\n\nThese are questions focused on responsibility toward the communities in which the entity operates.\n\nA compliance percentage of at least 70% in each of the four dimensions is required.\n\nThe current CST Standard for each activity and its updates may be consulted at the following link: https://cst.turismo-sostenible.co.cr\n\nAnnex 1 Record\n\nAnexo 2 - CST Platform.\n\nThe link to access the platform is: https://cst.turismo-sostenible.co.cr, where the applicant is presented with a description of all the processes that must be followed:\n\na) Registration.\n\nb) Account Activation\n\nc) Profile Management\n\nd) Self-Assessment and Implementation Panel\n\ne) Audit Process\n\nf) Certification Process\n\ng) Recertification\n\nh) Use of the CST Platform is the only means by which to participate in the CST Program.\n\ni) The CST Program Technical Unit is responsible for the proper functioning of the platform.\n\nj) Two roles exist within the CST Platform for its administration:\n\n- Administrator: Responsible for assigning tasks.\n\n- Auditors: Responsible for conducting online audits.\n\nAnnex 2 Record\n\nAnexo 3 - Applicant.\n\nThe term \"applicant\" (solicitante) refers to the tourism organizations and institutions that may apply for the CST, in accordance with the current CST Standard and its updates, available at the following link: https://cst.turismo-sostenible.co.cr\n\nApplicants must be current with their employer-employee and social obligations, tax obligations, and must comply with their applicable legal obligations according to their category.\n\nState institutions, attached bodies, and civil society organizations with legal standing (personería jurídica) may participate in the CST Program in accordance with their legal mandates and through an agreement or cooperation accord with ICT.\n\nAnnex 3 Record\n\nAnexo 4 - International Criteria and Requirements.\n\nThe Certificado para la Sostenibilidad Turística Program aligns with the following criteria:\n\n1) Global Goals for Sustainable Development (2015) of the United Nations Organization:\n\nØ Goal 1: End poverty in all its forms everywhere.\n\nØ Goal 2: End hunger, achieve food security and improved nutrition, and promote sustainable agriculture.\n\nØ Goal 3: Ensure healthy lives and promote well-being for all at all ages.\n\nØ Goal 4: Ensure inclusive, equitable, and quality education and promote lifelong learning opportunities for all.\n\nØ Goal 5: Achieve gender equality and empower all women and girls.\n\nØ Goal 6: Ensure availability and sustainable management of water and sanitation for all.\n\nØ Goal 7: Ensure access to affordable, reliable, sustainable, and modern energy for all.\n\nØ Goal 8: Promote sustained, inclusive, and sustainable economic growth, full and productive employment, and decent work for all.\n\nØ Goal 9: Build resilient infrastructure, promote inclusive and sustainable industrialization, and foster innovation.\n\nØ Goal 10: Reduce inequality within and among countries.\n\nØ Goal 11: Make cities and human settlements inclusive, safe, resilient, and sustainable.\n\nØ Goal 12: Ensure sustainable consumption and production patterns.\n\nØ Goal 13: Take urgent action to combat climate change and its impacts.\n\nØ Goal 14: Conserve and sustainably use the oceans, seas, and marine resources for sustainable development.\n\nØ Goal 15: Protect, restore, and promote the sustainable use of terrestrial ecosystems, sustainably manage forests, combat desertification, and halt and reverse land degradation and halt biodiversity loss.\n\nØ Goal 16: Promote peaceful and inclusive societies for sustainable development, provide access to justice for all, and build effective, accountable, and inclusive institutions at all levels.\n\nØ Goal 17: Strengthen the means of implementation and revitalize the Global Partnership for Sustainable Development.\n\n2) Responsible Tourism System, according to UN Tourism, with the endorsement of the Biosphere certification:\n\n1. The sociocultural authenticity of local communities is respected, conserving their cultural and architectural assets as well as their traditional values, and contributing to intercultural understanding and tolerance.\n\n3. It integrates local communities into tourism activities.\n\n4. It generates local employment, both directly and indirectly. Specifically, for every direct job created, three indirect jobs are produced.\n\n5. It stimulates the development of tourism businesses (such as travel agencies, transportation, accommodation, food, recreational, and complementary services), as well as businesses engaged in supplier activities (such as livestock, agriculture, and communications).\n\n6. It generates foreign exchange for the State and supplies capital to the local economy.\n\n7. The economic benefit is directed toward conservation or local development, being distributed among all local stakeholders and thereby contributing to poverty reduction.\n\n8. It promotes regional planning, benefiting a harmonious and comprehensive development of all sectors of the economy.\n\n9. It raises awareness of local political, social, and environmental issues, encouraging responsible consumption and respect for the environment.\n\n10. For tourists, it is a meaningful experience that enriches and fosters sustainable tourism practices in their own settings.\n\n11. It requires constant monitoring of its impacts in order to introduce corrective measures or actions as necessary. In this way, it stimulates improvements to tourism service infrastructure (such as communication routes, telecommunications, drinking water, sanitary sewers, collection and final disposal of solid waste, and airports).\n\n12. It promotes the restoration, conservation, and use of archaeological sites, architectural monuments, and any physical work of collective and national interest.\n\n13. It allocates a portion of the profits to the construction of works of community interest such as schools, health centers, sports facilities, cultural centers, and others.\n\n14. It promotes and values local, regional, and national cultural expressions (such as dances, handicrafts, and gastronomy).\n\n15. It achieves balanced development with the environment through environmental impact studies and environmental monitoring.\n\n16. It promotes community self-esteem.\n\n17. It offers, values, preserves, and generates economic benefits from flora and fauna resources, for the benefit of local communities.\n\n18. It monitors, evaluates, and manages the impacts it generates, developing models for the perpetuation of its own development.\n\n19. It reactivates rural areas: it directly and indirectly relaunches the local economy and brings life to these areas, whose inhabitants benefit from a greater range of activities and from visitors who are more responsible and respectful of their culture and surroundings.\n\n20. It supports human rights and workers' rights, as it is based on respect for host communities and creates quality employment.\n\n21. It improves the quality of life of the local population, both economically and socioculturally.\n\n22. Finally, sustainable tourism boosts the consumption of locally produced and natural products from the areas in which it operates.\n\nAnnex 4 Record\n\nAnexo 5 - Procedure for Obtaining the CST\n\nA) For first-time applicants, the following must be completed:\n\n1- Registration in the CST Program\n\n1.1 Participate in the CST Standard Technical Workshop.\n\n1.2 Request a registration code from the CST Technical Unit.\n\n1.3 Complete registration on the CST Platform https://cst.turismo-sostenible.co.cr\n\n2- Implementation of the CST Standard\n\n2.1 Upload documentary evidence to the Platform. Maximum period: 90 calendar days. (self-assessment)\n\n2.2 Respond with documentary evidence to each of the questions in the CST Standard.\n\n2.3 Request an audit from the CST Technical Unit within the CST Platform.\n\n3. Audit\n\nAssignment of Auditor.\n\n3.1 The CST Technical Unit assigns an auditor for the review and verification of evidence within a period of 3 business days.\n\n3.2 Hold the initial meeting.\n\nReview and evaluation. Maximum period: 15 business days.\n\n3.3 Documentary review and verification by the auditor of all evidence to issue a Preliminary Report. (Maximum period: 15 business days)\n\n3.4 Submission of the Preliminary Report to the applicant through the CST Platform.\n\nRemediation period (período de subsanes). Maximum period: 15 business days.\n\n3.5 The applicant reviews the Preliminary Report with the non-conformities (no conformidades) and remediable observations for each of the questions raised by the auditor.\n\n3.6. Receive the on-site (in situ) visit by the auditor, at the auditor's discretion.\n\n3.7. Upload new evidence to the CST Platform to remedy the non-conformities in response to the Preliminary Report.\n\n3.8. Submit the Improvement Plan (Plan de Mejora) to the CST Platform.\n\nAudit Report (final). Period: 15 business days.\n\n3.9. Review of the remediation by the auditor.\n\n3.10. Review of the Improvement Plan.\n\n3.11. Preparation of the Technical Summary Form (Ficha Técnica).\n\n4. Certification by the CTV-CST.\n\n4.1 Review of the audit file.\n\n4.2 Issuance of the CTV-CST agreement communiqué with the final result of the audit and certification process.\n\n5. Monitoring and Continuous Improvement\n\n5.1 Review of implementation of the improvement plan.\n\n5.2 On-site visit, at the Technical Unit's discretion.\n\nIMPORTANT: In the event that an applicant company changes its corporate name (razón social), it must apply as a first-time applicant.\n\nB) For applicants seeking recertification, the following must be completed:\n\n1. Registration\n\n1.1 Participate in the CST Standard Recertification Technical Workshop.\n\n1.2 Update the profile on the CST Platform https://cst.turismo-sostenible.co.cr\n\n2. Implementation of the CST Standard\n\n2.1 Upload documentary evidence to the Platform. Maximum period: 90 calendar days.\n\n2.2 Respond with documentary evidence to each of the questions in the CST Standard.\n\n2.3 Request the audit from the CST Technical Unit within the CST Platform.\n\n3. Audit\n\nAssignment of Auditor.\n\n3.1 The CST Technical Unit assigns an auditor for the review and verification of evidence within a maximum period of 3 business days.\n\n3.2 Hold the initial meeting.\n\nReview and evaluation. Maximum period: 15 business days.\n\n3.3 Documentary review and verification by the auditor of all evidence to issue a Preliminary Report.\n\n3.4 The auditor sends the Preliminary Report to the applicant through the CST Platform.\n\nRemediation period. Maximum period: 15 business days.\n\n3.5 The applicant reviews the Preliminary Report with the non-conformities and remediable observations for each of the questions raised by the auditor.\n\n3.6. Receive the on-site visit by the auditor if necessary, at the auditor's discretion.\n\n3.7. Upload new evidence to the CST Platform to remedy the non-conformities in response to the Preliminary Report.\n\n3.8. Submit the Improvement Plan to the CST Platform.\n\nAudit Report (final). Maximum period: 15 business days.\n\n3.9. The auditor reviews the remediation.\n\n3.10. The auditor reviews the Improvement Plan.\n\n3.11. The auditor prepares the Technical Summary Form.\n\n4. Certification by the CTV-CST.\n\n4.1 Review of the audit file.\n\n4.2 Issuance of the CTV-CST agreement communiqué with the final result of the audit and certification process.\n\n5. Monitoring and Continuous Improvement\n\n5.1 Review of implementation of the improvement plan.\n\n5.2 On-site visit, at the Technical Unit's discretion.\n\nAnnex 5 Record\n\nAnexo 6 - Ex Officio Verifications for Registration in the CST.\n\nGeneral requirements to be verified by ICT at the time of registration on the CST Platform: The applicant must be current with the following obligations, to the extent legally applicable, which shall be verified ex officio by ICT, as detailed below:\n\na) Verification by ICT that the applicant is current with payment of employer-employee social security contributions (cuotas obrero patronales) to the Caja Costarricense de Seguro Social. If the company appears with the status \"Patrono Inactivo al día,\" the applicant company must provide a statement within the next 10 business days counted from the submission of this application, indicating the reasons for its designation as a \"patrono inactivo.\"\n\nb) Verification by ICT that the applicant is current with contribution payments to the Fondo de Desarrollo Social y Asignaciones Familiares (FODESAF) of 5% of the total wages and salaries paid monthly to its personnel, in accordance with the Ley de Desarrollo Social y Asignaciones Familiares, Ley N° 5662 of December 23, 1974.\n\nc) Verification by ICT that the applicant is current with payments of the legal entity tax (impuesto a las Personas Jurídicas) under Ley N° 9428 of March 21, 2017. The legal entity tax is mandatory for commercial companies, as well as for every branch of a foreign company or its representative, and for individually owned limited-liability enterprises (empresas individuales de responsabilidad limitada) that are registered or that may hereafter be registered in the Registro de Personas Jurídicas of the Registro Nacional.\n\nd) Verification by ICT that the company is current with its monetary, technical, and legal obligations to this Institution, in accordance with the provisions of Article 46 of the Ley Orgánica del ICT, Ley Nº 1917 of July 29, 1955, and its amendments, and Article 2 of Ley Nº 8694 of December 11, 2008, Ley de Fortalecimiento del Desarrollo de la Industria Turística Nacional.\n\ne) Verification by ICT that the applicant is current with its tax obligations, as shown in the online public query tool of the Ministerio de Hacienda known as \"Morosidad Tributaria,\" available at www.hacienda.go.cr.\n\nThe applicant may not be in arrears with any of the aforementioned institutions, to the extent legally applicable, in order to apply for the CST. Should this occur and the non-compliance persist at the time the ten-business-day warning period established in Article 264 of the Ley General de la Administración Pública has elapsed, the application shall be rejected in accordance with the second paragraph of that same provision.
