El Prestatario gestionará ante el Banco Mundial recursos de ciento quince\nmillones y quinientos mil Euro hasta ciento veinte millones de dólares de los\nEstados Unidos de América (?115 500 000 equivalente) a través de un acuerdo de\ncofinanciación entre el Prestatario y el BM (el \"Acuerdo de\nCofinanciación\") para la financiación al Programa;\n\nEl\nPrestatario se ha comprometido a proporcionar el apoyo adicional, financiero o\nen especie, que pueda ser necesario para el Programa;\n\nEl\nFIDA acuerda conceder un préstamo (Préstamo) y Por lo\ntanto, las Partes acuerdan además lo siguiente:\n\nSección\nA\n\n1.\nEste Convenio incluye lo siguiente: el Documento Principal (Encabezados y\nSecciones A-E), la Descripción y las Disposiciones de ejecución del Proyecto\n(Anexo 1) el Cuadro de asignaciones (Anexo 2), y Compromisos Especiales (Anexo\n3).\n\n2.\nLas Condiciones Generales para la Financiación del Desarrollo Agrícola de\nfecha 29 de abril de 2009, modificadas en diciembre de 2022 (las \"Condiciones\nGenerales\"), salvo que se indique lo contrario, a excepción de las\ndisposiciones que se refieren a la financiación de préstamos que no se\naplicarán a este Convenio. A los efectos del presente Convenio, los términos\ndefinidos en las Condiciones Generales tendrán el significado en ellas\nindicado.\n\n3.\nA los efectos de este Convenio:\n\nConvenio de\nFinanciación\n\n\"Desembolso\nVinculado al Indicador\" o \"DLI\" significa, con respecto a una\nCategoría determinada, el indicador que se utilizará para activar el desembolso\nde fondos, y como se establece en las tablas del Anexo 2 de este Acuerdo y\nsegún se especificará más detalladamente en el Manual de Operaciones del\nPrograma (MOP).\n\n\"Desembolso\nVinculado al Resultado\" o \"DLR\" significa con respecto a una\nCategoría determinada, el resultado que se utilizará para activar el desembolso\nde fondos, como se establece en las tablas del Anexo 2 de este Acuerdo, y como\nse especificará con más detalle en el Manual de Operaciones del Programa (MOP),\nen cuya consecución se podría retirar el importe del Financiamiento destinado a\ndicho resultado.\n\n4.\nA raíz del presente convenio el Fondo proporcionará al Prestatario un Préstamo\n(la \"Financiación\"), que éste utilizará para ejecutar el Programa de\nconformidad con los términos y condiciones del presente Convenio.\n\nSección\nB\n\n1.\nLa Financiación estará compuesta por un Préstamo en euros de diecinueve\nmillones con doscientos diez mil cuatrocientos cincuenta (EUR 19 210 450).\n\n2.\nEl Préstamo se concede en condiciones ordinarias y estará sujeto a intereses\nsobre el monto principal pendiente del Préstamo a una tasa igual a la Tasa de\nInterés de Referencia del FIDA, incluido un diferencial variable, pagaderos\nsemestralmente en la Moneda de Pago del Servicio del Préstamo, y tendrá un\nperiodo de vencimiento de dieciocho (18)años, incluido un periodo de gracia de\ntres (3)años, a partir de la fecha en que el Fondo haya determinado que se han\ncumplido todas las condiciones previos para el retiro de fondos.\n\n3.\nLa Moneda de Pago del Servicio del Préstamo será en Euros.\n\n4.\nEl ejercicio fiscal aplicable será del 1ro de enero al 31 de diciembre.\n\n5.\nLos pagos del capital y los intereses/cargos por servicio del Préstamo serán pagaderos\ncada seis meses los días 15 de mayo y 15 de noviembre.\n\n6.\nTodos los desembolsos de la cuenta del préstamo serán hechos a la cuenta única del\ntesoro de Costa Rica en dólares. El Prestatario informará al Fondo los detalles\nde esta cuenta bancaria y los desembolsos serán realizados de conformidad con\nla carta de desembolsos del Banco Mundial.\n\n7.\nEl Prestatario proporcionará financiación de contrapartida para el Programa por\nun importe equivalente al presupuesto del Plan Sectorial Agropecuario del\nMinisterio de Agricultura y Ganadería vigente.\n\nSección\nC\n\n1.\nEl Organismo Responsable del Programa es el Ministerio de Agricultura y\nGanadería (MAG) quien a través de la coordinación de la Secretaría Ejecutiva de\nPlanificación Sectorial Agropecuaria (SEPSA) será el responsable de la gestión\ny supervisión del Programa.\n\n2.\nLos siguientes son designados como Partes del Programa: Dirección Nacional de Extensión\nAgropecuaria (DNEA); Servicio Fitosanitario del Estado (SFE); Servicio Nacional\nde Aguas Sanitarias, Riego y Avenamiento (SENARA); Servicio Nacional de Salud\nAnimal (SENASA); Instituto Nacional de Innovación y Transferencia en Tecnología\nAgropecuaria (INTA); Instituto Costarricense de Pesca y Acuicultura\n(INCOPESCA); Programa Integral de Mercadeo Agropecuario (PIMA); y Sistema Banca\npara el Desarrollo (SBD).\n\n3.\nSe llevará a cabo la Revisión de Medio Término como se especifica en la Sección\n8.03 b) y c) de las Condiciones Generales, pudiendo las Partes acordar otra\nfecha para llevar a cabo la Revisión de Medio Término de la ejecución del\nPrograma, en coordinación con el Banco Mundial.\n\n4.\nLa Fecha de cierre del Proyecto será el 27 de mayo de 2031 o cualquier otra\nfecha que el Fondo pueda designar mediante notificación al Prestatario.\n\n5.\nLa adquisición de bienes, obras y servicios financiados por la Financiación se realizará\nde conformidad con las directrices de adquisición del Prestatario.\n\nSección\nD\n\n1.\nLa financiación del programa será supervisada por el Banco Mundial como Institución\nCooperante.\n\nSección\nE\n\n1.\nSe designan como motivos adicionales de suspensión de desembolsos los siguientes:\n\na)\nCualquiera de las disposiciones del Manual de Operaciones del Programa (MOP) que\nhaya sido objeto de cesión, renuncia, suspensión, revocación, enmienda u otra\nmodificación, sin el acuerdo previo de las Partes, y el BM o el FIDA hayan determinado,\nprevia consulta con el Prestatario, que tal cesión, renuncia, suspensión,\nrevocación, enmienda o modificación ha tenido consecuencias adversas\nsustanciales para el Programa.\n\nb)\nEn caso de que el Prestatario no haya solicitado un desembolso de la\nFinanciación durante un período de al menos 18 meses sin justificación.\n\nc)\nLa Carta de Acuerdo (LoA) o documento análogo con el\nBM, tal y como se define en el Artículo III de las Condiciones Generales o el\nAcuerdo de Cofinanciación no ha entrado en pleno vigor dentro de los 180 días\nsiguientes a la fecha de este Convenio.\n\nd)\nEl derecho del Prestatario a retirar los fondos del Préstamo del BM ha sido suspendido,\ncancelado o terminado, en todo o en parte; o el Préstamo del BM ha vencido y es\npagadero antes del vencimiento acordado; o se ha producido cualquier\nacontecimiento que, con aviso o el paso del tiempo, podría dar lugar a cualquiera\nde los casos anteriores.\n\ne)\nEn el caso de que el Prestatario no haya solicitado un desembolso de la Financiación\ndurante un período de al menos 12 meses consecutivos sin justificación tras los\nprimeros 18 meses desde la entrada en vigor del Convenio.\n\n2.\nSe designan los siguientes motivos adicionales para la cancelación de\ndesembolsos:\n\na)\nEl acuerdo de financiación con el BM ha sido cancelado.\n\n3.\nLas siguientes se designan como condiciones adicionales específicas que\npreceden a la retirada de desembolsos:\n\na)\nSe obtuvo la no objeción del FIDA al Manual de Operaciones del Programa (MOP).\n\nb)\nLa Carta de Acuerdo con el BM, tal como se define en el Artículo III de las CG o\nel Acuerdo de Cofinanciación ha entrado en pleno vigor dentro de los 180 días siguientes\na la fecha de este Convenio.\n\nc)\nLas condiciones para la retirada de desembolsos por parte del BM han sido cumplidas,\ny\n\nd)\nA excepción del adelanto, el prestatario ha proporcionado pruebas satisfactorias\nal BM y al FIDA de que han alcanzado los respectivos Desembolsos Vinculados al\nResultado (DLRs) y/o, establecidos en el Anexo 2 y que\nestos fueron verificados a través de una Agencia de Verificación Independiente\n(IVA).\n\n4.\nSe modifican los siguientes artículos de las Condiciones Generales para que\nqueden redactados como sigue:\n\na)\nArtículo VII, Sección 7.05 (Adquisiciones); la adquisición de bienes, obras y servicios\nque se financien con el producto de la financiación se realizarán de acuerdo\ncon los sistemas de gestión financiera y adquisición del Prestatario.\n\nb)\nArtículo IX, sección 9.03 (Auditoría de cuentas); Las cuentas del Programa, los\nestados financieros y los estados de gastos serán auditados por auditores independientes\naceptados por el Fondo y el BM, de acuerdo con las normas de auditoría aceptables\npara el BM.\n\n5.\nLas siguientes excepciones a la Sección 4.02 a) y la Sección 4.03 d) de las Condiciones\nGenerales son aplicables al Convenio:\n\na)\nEl desembolso se activará mediante DLI o DLRs\nverificables en lugar de gastos elegibles;\n\nb)\nEl Fondo no requerirá que el Prestatario proporcione evidencia que demuestre que\nlos retiros anteriores se han gastado adecuadamente en gastos elegibles, sino\nmás bien evidencia de que se han cumplido los DLIs o\nDLR acordados;\n\nc)\nLos gastos se considerarán elegibles cuando se cumplan los DLIs\no DLR acordados;\n\nd)\nEl Prestatario podrá retirar los fondos del Financiamiento para financiar\ngastos sobre la base de los resultados (\"Desembolso Vinculado a\nResultados\" o \"DLR\") logrados por el Prestatario, medidos contra\nindicadores específicos (\"Desembolsos Vinculados a Indicadores\" o\n\"DLI\") en el monto asignado del cuadro del párrafo del Anexo 2.\n\ne)\nPara fines aclaratorios se entiende que la Sección 4.03 incisos a, b y c se interpretará\nde conformidad con la Sección 3.02.\n\n6.\nCon respecto a la Sección 5.01 incisos b) y d) de las Condiciones Generales de Financiación\nAgrícola que refieren a Condiciones de los Préstamos, se clarifica que los cargos\npor servicios exigibles mencionados no aplican para este Programa.\n\n7.\nEl presente Convenio está sujeto a la aprobación por parte del poder\nlegislativo del Prestatario y su respectiva publicación en Diario Oficial La\nGaceta.\n\n8.\nSe indican a continuación a los representantes designados y sus respectivas direcciones\nque han de utilizarse para cualquier intercambio de comunicaciones relacionados\ncon el presente Convenio:\n\nPor\nel Prestatario:\n\nMinisterio\nde Hacienda\n\nCalle\n1 y 3, Avenida 2\n\nDiagonal\nal Teatro Nacional\n\nSan\nJose, Costa Rica;\n\nEmail:\ndespachomh@hacienda.go.cr\n\nPor\nel Fondo:\n\nPresidente\n\nFondo\nInternacional de Desarrollo Agrícola\n\nVia Paolo di Dono 44\n\n00142\nRoma, Italia\n\nEn\ncaso de ser aplicable, las Partes aceptan la validez de cualquier firma\nelectrónica utilizada en el presente Acuerdo y reconocen esta como equivalente\na una firma manuscrita.\n\nRepública\nde Costa Rica\n\nPrograma\npara agricultura sostenible, y competitiva en Costa Rica (CSMART)\n\nConvenio\nde Financiación\n\nPréstamo\nNo. 2000005556\n\nEl\npresente Convenio se ha preparado en idioma español en dos (2) copias\noriginales, una (1) para el Fondo y una (1) para el Prestatario y entrará en\nvigor [cuando el FIDA reciba la notificación de la aprobación por el Poder\nLegislativo y su respectiva publicación en el Diario Oficial La Gaceta],\nconforme a la Sección 13.01 de las Condiciones Generales.\n\nREPÚBLICA\nDE COSTA RICA\n\n___________________\n\nD.\nNogui Acosta Jaen\n\nMinistro\nde Hacienda\n\nFecha:\n_30/07/2025___________\n\nFONDO\nINTERNACIONAL PARA EL DESARROLLO AGRÍCOLA\n\n_____________________\n\nÁlvaro\nLario\n\nPresidente\n\nFecha:\n_14/08/2025______________\n\nRepública\nde Costa Rica\n\nPrograma\npara agricultura sostenible, y competitiva en Costa Rica (CSMART)\n\nConvenio\nde Financiación\n\nPréstamo\nNo. 2000005556\n\nAnexo 1\n\nDescripción del Programa y disposiciones\nde ejecución\n\nI. Descripción del\nPrograma\n\n1. Área del Programa.\n\nEl Programa tiene un alcance\nnacional y se organiza de acuerdo a la división territorial del MAG priorizando\naquellas regiones donde la adopción de acciones nacionales de mitigación\napropiada (NAMAs) en café, caña de azúcar y ganadería\ntiene un mayor aporte al desarrollo de la economía local, y al comercio\nnacional e internacional.\n\nEn el sector cafetalero, el\n93 por ciento de la producción proviene de cuatro regiones:\n\nCentro Oeste, Centro\nOriente, Centro Sur y Brunca. En el sector azucarero,\nel 54 por ciento de la producción de caña de azúcar se realiza en la región\nChorotega, el 12 por ciento en la región Huetar Norte\ny el 11,5 por ciento en la región del Pacífico Central. Asimismo, el 75 por\nciento de la producción de leche se concentra principalmente en tres regiones:\n\nHuetar Norte, Centro Este y Centro Oeste. La\nregión Huetar Norte es la más especializada en la\nproducción ganadera, con el 26 por ciento de la producción de ganado vacuno de\ncarne, el 44 por ciento de la producción de leche y el 34 por ciento de la\nganadería de doble propósito. La región Huetar Caribe\nproduce la mayor cantidad de ganado vacuno y de doble propósito, sin alta\nconcentración productiva. Asimismo, el Programa actuará en zonas geográficas\nespecíficas para apoyar a los pescadores del Golfo de Nicoya en la provincia de\nPuntarenas (Pacífico Central) y a los productores de papa, hortalizas, flores y\nfrutillas del norte de la provincia de Cartago (Llano Grande y Tierra Blanca)\nen la región Centro Oriente. Además, estas áreas geográficas incluyen las\nregiones con mayor concentración de pobreza (Región Huetar\nCaribe, Región Brunca, Huetar\nNorte y Chorotega) y las poblaciones de las zonas costeras más debilitadas. Por\núltimo, el programa también incluye acciones que afectarán a todo el territorio\nnacional como la implementación del sistema de trazabilidad agropecuaria y el\nsistema de registro en la plataforma digital de información al productor.\n\n2. Población-objetivo y\nbeneficiarios del Proyecto.\n\nEl Programa beneficiará\ndirectamente a 30.000 micro, pequeños y medianos productores, de los cuales al\nmenos 24.000 estarán registrados en la plataforma de pequeños y medianos\nproductores agrícolas (PYMPA) del MAG, 9.000 (30 por ciento) serán mujeres y\n4.500 (15 por ciento) serán jóvenes. Los beneficiarios directos tendrán acceso\na servicios como asistencia técnica, inversiones para la adopción NAMAs, crédito y el sistema de trazabilidad.\n\nObjetivo de desarrollo.\n\nEl Programa está orientado a\nlograr los siguientes objetivos de desarrollo: ODS 1: Poner fin a la pobreza, a\ntravés de la generación de mayores ingresos y equidad en su distribución; ODS\n2: Hambre cero, promoviendo la seguridad alimentaria y la agricultura\nsostenible; ODS 5: Igualdad de género, abriendo espacios para la participación\nde las mujeres y promoviendo su empoderamiento económico y social; ODS 10:\nReducir las desigualdades, considerando oportunidades para los más pobres y\nvulnerables a fin de reducir sus condiciones de pobreza y marginación; y ODS\n13: Acción por el clima a través República de Costa Rica de la implementación\nde medidas de NAMAs para la adaptación y resiliencia\nal cambio climático.\n\nÁrea de Resultados\n\nEstos objetivos se\nalcanzarán mediante la implementación de las siguientes áreas de resultados,\nque corresponden a los cuatro ejes del Plan Sectorial Agrícola 2023-2032 (ASP):\n\nÁrea de resultados 1 -\nModernización de las instituciones del Sector\n\nAgropecuario. El objetivo de RA1 es modernizar los\nservicios públicos de extensión agrícola que son clave para apoyar a los\nproductores a mejorar su sostenibilidad, competitividad e inclusión económica.\nPor lo tanto, el RA1 se considera transversal, ya que apoya el logro de las\notras tres áreas de resultados.\n\nÁrea de resultados 2 -\nPromoción de la competitividad.\nEl objetivo de RA2 es promover la competitividad de los productores agrícolas a\ntravés de un mejor acceso a los mercados (nacionales e internacionales). Esto\nse logrará mejorando la información y la trazabilidad del mercado, aumentando\nla capacidad institucional para realizar evaluaciones de diagnóstico\nambientales y (fitos)sanitarias selectas, y\nfomentando la inclusión económica y mejorando los vínculos básicos del mercado\ncon los mercados internos, especialmente para los grupos vulnerables.\n\nÁrea de resultados 3 -\nProducción sostenible. El\nobjetivo de RA3 es mejorar la sostenibilidad ambiental de la producción\nagrícola mediante la ampliación de la adopción de tres NAMA del sector agrícola\n(ganadería, café y caña de azúcar, debido a su preparación para su ampliación a\nescala) y otras prácticas sostenibles relacionadas con el riego. Esto se\nlogrará apoyando la adopción de NAMA por parte de los productores a través de\nasistencia técnica; mejorar el acceso al financiamiento para la adopción de NAMAs a través de un mecanismo conjunto entre el Sistema de\nbanca de desarrollo (BDS) y los bancos privados, incluso para los grupos\nvulnerables; y mejorar el monitoreo, la presentación de informes y la\nverificación de emisiones para los modelos NAMA. RA3 también promoverá el riego\nsostenible en zonas secas y vulnerables al clima para abordar desafíos críticos\nde resiliencia.\n\nÁrea de resultados 4 -\nValor añadido y marketing. El\nobjetivo de RA4 es agregar valor a los beneficios ambientales generados por los\nmodelos de producción NAMA a través de pagos por servicios ambientales. Esto\nayudará a los agricultores a tener una fuente adicional de ingresos hasta que\nse materialicen los beneficios de la adopción de la NAMA, se consolide el valor\nagregado a los productos provenientes de la NAMA y se desarrollen nuevos\nmercados.\n\nII. Disposiciones de\nejecución\n\n1. Organismo Responsable\ndel Programa.\n\nMinisterio de Agricultura y\nGanadería (MAG)\n\n2. Equipo de Coordinación\nTécnica del Programa.\n\nLa Secretaría Ejecutiva de\nPlanificación del Sector Agropecuario (SEPSA) del MAG mantendrá un equipo de\ncoordinación del Programa (ECP), durante toda la ejecución del programa. El\nequipo será responsable de supervisar y gestionar adecuadamente el cumplimiento\nde los términos del Acuerdo Legal del Programa, así como de coordinar y\nsupervisar la implementación del Plan de Acción del Programa (PAP). El equipo\nestará integrado por personal idóneo con los perfiles y responsabilidades\nnecesarios para apoyar la implementación del Programa. Otras instituciones que\nparticipen en la implementación del Programa lo harán en el marco de sus\nacuerdos marco existentes con MAG. En el caso del SBD, será necesario establecer\nun acuerdo marco específico para el Programa. MAG también colaborará con\nasociaciones de la industria (por ejemplo, CORFOGA, LAICA) a través de los\nacuerdos marco existentes.\n\n3. Partes en el Proyecto\ny/o Programa\n\nLas siguientes entidades se\nconsideran Partes del Programa:\n\ni) SEPSA: como la agencia\nprincipal que lidera, gerencia y encargada de la coordinación general del\nPrograma;\n\nii) INCOPESCA y PIMA:\nentidades responsables de contribuir a las actividades para la consecución del\nDLI 4;\n\niii) SFE y SENASA entidades\nresponsables para contribuir a las actividades para la consecución del DLI 3;\n\niv) SENARA, entidad\nresponsable de contribuir a las actividades para la consecución del DLI 7;\n\nv) SBD, entidad responsable\npara contribuir a las actividades para la consecución del DLI 6.\n\nPara facilitar la ejecución\nde la Parte del Programa respectiva, el Prestatario, a través del MAG,\nsuscribirá Convenios de Implementación entre el MAG y cada Parte del Programa,\nsegún los términos y condiciones aprobados por el Banco y el Fondo. Estos\nincluirán lo siguiente: (i) si corresponde, los términos y condiciones bajo los\ncuales los fondos del Préstamo se pondrán a disposición de la Parte del\nPrograma y el derecho del Prestatario a suspender o rescindir el derecho de la\nParte del Programa a utilizar los fondos del Préstamo si esta incumple sus\nobligaciones en virtud del Convenio de Implementación; (ii) la obligación de la\nParte del Programa de ejecutar su Parte Respectiva del Programa de conformidad\ncon los términos de este Convenio y el Manual de Operaciones del Programa; y\n(iii) los requisitos de seguimiento y presentación de informes. El Prestatario,\na través de MAG, ejercerá sus derechos bajo cada uno de los Convenios de\nImplementación de manera que se protejan los intereses del Prestatario, del\nBanco y del Fondo, y se cumplan los fines del Préstamo. Salvo acuerdo en\ncontrario del Banco y el Fondo, el Prestatario, a través de MAG, no cederá,\nmodificará, derogará ni renunciará a ninguno de los Convenios de Implementación\nni a ninguna de sus disposiciones.\n\nEn caso de cualquier\nconflicto entre los términos de los Convenios de Implementación y los de este\nConvenio de Financiación, prevalecerán los términos de este Convenio de\nFinanciación.\n\nDe igual manera, el MAG\nestará a cargo de contribuir con las actividades que permitan alcanzar los DLIs 1,2,3,5,6, y 8.\n\n4. Seguimiento y\nEvaluación\n\nEl MAG, a través del SEPSA,\nserá responsable del seguimiento y evaluación del programa. Los procedimientos\nde planeación, seguimiento y evaluación tendrán en cuenta la normativa nacional\nestablecida por el Ministerio de Planificación Nacional y Política Económica\n(MIDEPLAN), el Ministerio de Hacienda (MH) y la Contraloría General de la\nRepública (CGR); así como los lineamientos del Banco Mundial en esta materia.\n\n5. Manual de Operaciones\ndel Programa (MOP).\n\nSe desarrollará e\nimplementará un Manual de Operaciones del Programa una vez que el proyecto haya\nsido aprobado. El desarrollo del MOP estará liderado por SEPSA. El Banco\nMundial y el FIDA brindarán apoyo técnico según sea necesario.\n\n6. significa que los extensionistas han completado la formación,\ny su participación ha sido documentada por el MAG, en las siguientes áreas: (i)\nadopción de NAMAs, (ii) registro y uso del sistema de\ntrazabilidad del sector agrícola y otros recursos digitales (agromatica), (iii) adaptación de la extensión a\ngrupos vulnerables, y (iv) gestión empresarial general.\n\n10. \"Fondo\nEspecífico\" significa un fondo que se establecerá dentro del FONAFIFO para\nfinanciar el Mecanismo de PSA.\n\n11. \"Diseñado\"\nsignifica que, para el Fondo Dedicado, las fuentes de financiación y el flujo\nde \"NAMA\"\nsignifica medidas de mitigación apropiadas para cada país, que son políticas\ncon acciones y objetivos que los países se comprometen a adoptar para reducir\nlas emisiones en virtud de la Convención Marco de las Naciones Unidas sobre el\nCambio Climático.\n\n25. \"OIRSA\"\nsignifica el Organismo Internacional Regional de Sanidad Agropecuaria, o\ncualquier sucesor aceptable para el Banco Mundial o el Fondo.\n\n26. \"ONS\"\nsignifica la Oficina Nacional de Semillas del Prestatario, o cualquier\nsucesor aceptable para el Banco Mundial o el Fondo.\n\n27. \"Operativo\"\nsignifica cuando el Programa de Financiación NAMA del SBD es accesible al\npúblico y ha documentado su primer crédito o garantía a una PYMPA.\n\n28. \"Pagos por\nServicios Ambientales\" o \"PSA\" se refiere a los pagos a los\nagricultores o propietarios de tierras que han acordado tomar ciertas acciones\npara gestionar sus tierras o cuencas hidrográficas para proporcionar un\nservicio ecológico, y que son financiados por el Fondo Nacional de\nFinanciamiento Forestal (FONAFIFO) del Ministerio de Ambiente y Energía (MINAE)\ny regidos por la Ley Forestal Nº 7575 de 1996.\n\n29. \"Mecanismo\nPSA\" se refiere a un mecanismo financiero que se diseñará y establecerá\npara promover la captura de carbono en suelos agrícolas mediante pagos a los\nproductores de NAMAs por la captura certificada de\ncarbono atribuible a su adopción de NAMAs.\n\n30. \"PIMA\"\nsignifica el Programa Integral de Mercadeo Agropecuario del Prestatario,\no cualquier sucesor del mismo aceptable para el Banco Mundial o el Fondo.\n\n31. \"Plan de Acción del\nPrograma\" significa el plan del Prestatario de fecha 11 de Marzo de 2025 y al que se hace referencia en la Sección E\ndel Anexo 2 del Contrato de financiación del Banco Mundial, según pueda ser\nmodificado ocasionalmente con el acuerdo previo por escrito del Banco o el\nFondo.\n\n32. \"Entidad\nImplementadora del Programa\" se refiere a MAG, como entidad jecutora principal (equivalente a Organismo Responsable de\nProyecto para el Fondo), e INCOPESCA, SBD, SFE, SENARA, PIMA, SENASA e INTA, y\ncualquier sucesor de cualquiera de ellos aceptable para el Banco y el Fondo; y\nel término «Entidades Ejecutoras del Programa» (Partes del Programa para el\nFondo) se refiere colectivamente a todas estas entidades, incluido cualquier\nsucesor de cualquiera de técnica por\nparte de extensionistas del MAG que les permita alcanzar los criterios\nnecesarios para que su actividad productiva sea calificada como NAMA.\n\n36. \"SBD\"\nsignifica el Sistema de Banca para el Desarrollo de Costa Rica, o\ncualquier sucesor aceptable para el Banco Mundial o el Fondo.\n\n37. \"Programa de\nFinanciación NAMA del SBD\": un programa adaptado y accesible únicamente a\nlas PYMPA para financiar la adopción de NAMAs, y que\nconsiste en un mecanismo de financiación y un sistema de garantía.\n\n38. \"Registrado y\nActivo\" significa que los productores han creado un perfil en la\nPlataforma Digital de Información al Productor y su información es accesible\npara los usuarios de la plataforma.\n\n39. \"SENARA\"\nsignifica el Servicio Nacional de Aguas Subterráneas, Riego, y Avenamiento del\nPrestatario, o cualquier sucesor del mismo aceptable para el Banco Mundial o el\nFondo.\n\n40. \"SENASA\"\nsignifica el Servicio Nacional de Salud Animal del Prestatario, o\ncualquier sucesor del mismo aceptable para el Banco Mundial o el Fondo.\n\n41. \"SEPSA\"\nsignifica la Secretaría Ejecutiva de Planificación Sectorial Agropecuaria del\nMAG, o cualquier organismo sucesor aceptable para el Banco Mundial o el Fondo.\n\n42. \"Contraloría de\nServicios\" significa las Contralorías de Servicios, o cualquier\notra(s) entidad(es) o departamento(s) que el Prestatario determine e informe\ndebidamente al Banco, a través de la(s) cual(es) los ciudadanos pueden\npresentar quejas, reclamaciones o sugerencias utilizando canales tales como\nformularios en línea, correo electrónico, visitas presenciales o teléfono.\n\n43. \"SFE\"\nsignifica el Servicio Fitosanitario del Estado del Prestatario, o\ncualquier sucesor del mismo aceptable para el Banco Mundial o el Fondo.\n\n44. \"Sistema Trazar-Agro\"\nsignifica el Sistema Regional Armonizado de Trazabilidad y Registro Agropecuario,\nAcuícola y Pesquero del OIRSA, sistema de trazabilidad que facilita la\naplicación de normas regionales de trazabilidad, el registro y control de\npersonas y establecimientos agropecuarios, acuícolas y pesqueros, y el\nseguimiento de otras operaciones de trazabilidad.\n\n45. Por \"Convención\nMarco de las Naciones Unidas sobre el Cambio Climático\" se entiende la\nConvención de las Naciones Unidas del mismo nombre de 9 de mayo de 1992.\n\n46. \"Agencia de\nVerificación\" significa la agencia y/o consultor/es del Prestatario que se\nseleccionará/n y designará/n de conformidad con las disposiciones de la Sección\nI.D del Anexo 2 del Contrato de financiación del Banco Mundial a efectos de\nllevar a cabo la verificación de la consecución de los DLR por parte del MAG\n\ny de las Entidades Implementadoras del Programa; así como la referencia a\nSección E, numeral 3 del Convenio de Financiación entre el Fondo y el\nPrestatario.\n\n47. \"Protocolo de\nVerificación\" significa el protocolo acordado entre el Prestatario y el\nBanco con fecha 11 de marzo de 2025, en el que se establecen los medios,\nprocedimientos y pruebas en los que se basará la certificación de la\nconsecución de los DLR, así como las entidades responsables de los mismos, y el\ncontenido\n\n y/o formato de los informes que se facilitarán al Banco\nen apoyo de los mismos, pudiendo ser modificado de vez en cuando con el acuerdo\nprevio por escrito del Banco.\n\n48. \"Sociedades de\nUsuarios de Agua\" significa las Sociedades de Usuarios de Agua\nconstituidas conforme a la Ley de Aguas de Costa Rica No. 276 del 27 de agosto\nde 1942, y modificada por última vez el 25 de junio de 2012, para regir el uso\ncolectivo del agua pública.\n\n49. \"Jóvenes\":\npersonas con una edad mínima de 18 años y máxima de 35.\n\nAnexo 3\n\nCompromisos especiales\n\nI. El Prestatario, a través del MAG, se asegurará de\nque (i) se establezca un sistema de planificación, seguimiento y evaluación\n(PM&E) en un plazo de doce (12) meses a partir de la fecha de entrada en\nvigor del presente Acuerdo y (ii) se brinden los informes semestrales, que\nincluyan los Indicadores particulares para el FIDA descritos en el Anexo I de\neste Convenio.\n\n2. Género y Jóvenes. El\nPrestatario, a través del MAG, deberá garantizar que se tengan debidamente en\ncuenta las preocupaciones de las mujeres y los jóvenes al implementar el\nPrograma y que se cumplan las cuotas de participación de mujeres y jóvenes\nestablecidas en el documento de diseño del Programa.\n\n3. Preocupaciones de los\npueblos indígenas. El Prestatario, a través del MAG, se asegurará de que se\ntengan debidamente en cuenta las preocupaciones de los PI al ejecutar el\nPrograma y, para ello, se asegurará de que\n\n(a) el Programa se lleve a\ncabo de conformidad con las disposiciones aplicables de la [legislación\nnacional pertinente de los PI];\n\n(b) los pueblos indígenas\nestén adecuada y justamente representados en toda la planificación local de las\nactividades del Programa;\n\n(c) Los derechos de los PI\nson debidamente respetados;\n\n(d) Las comunidades de PI\nparticipan en el diálogo político y en la gobernanza local;\n\n(e) Se respetan los términos\nde las Declaraciones, Pactos y/o Convenios ratificados por el Prestatario en la\nmateria;\n\n(f) El Programa no implicará\nla invasión de los territorios tradicionales utilizados u ocupados por las\ncomunidades indígenas\n\n4. Medidas anticorrupción.\nEl Prestatario deberá garantizar que el Programa se lleve a cabo de conformidad\ncon las disposiciones de las \"Directrices del Banco Mundial para prevenir\ny combatir el fraude y la corrupción en el financiamiento de programas por\nresultados\", de fecha 1 de febrero de 2012 y revisadas el 10 de julio de\n2015. A los efectos de este Acuerdo, un hallazgo de corrupción de conformidad\ncon las disposiciones de las \"Directrices del Banco Mundial para prevenir\ny combatir el fraude y la corrupción en el Programa por resultados\" se\nconsiderará un hallazgo de corrupción según la \"Política del FIDA para la\nprevención del fraude y la corrupción en sus actividades y operaciones\".\n\n5. Acoso sexual,\nexplotación sexual y abuso. El Prestatario y las Partes del Proyecto se\nasegurarán de que el Proyecto se lleve a cabo de conformidad con las\ndisposiciones de la Política del FIDA sobre prevención y respuesta al acoso\nsexual, la explotación sexual y el abuso.\n\n6. Salvaguardias\nambientales, sociales y climáticas (ESC). El Prestatario, a través del MAG,\ngarantizará que el Programa se implementará de conformidad con las\ndisposiciones de salvaguardias especificadas en el Acuerdo del Banco Mundial y\ngarantizará que: (a) todas las actividades del Programa se implementen en\nestricta conformidad con las leyes/regulaciones pertinentes del Prestatario (b)\ntodas las actividades del Programa den especial consideración a la participación\ny las prácticas de la población de conformidad con la Política del FIDA, (c) se\nobtenga el consentimiento libre, previo e informado de todas las personas cuyo\nacceso a la tierra y los recursos pueda verse afectado u obstaculizado por las\nactividades del Programa.\n\nEn caso de adquisición\nimprevista de tierras o reasentamiento involuntario en el marco del Programa,\nel Prestatario, a través del MAG, informará inmediatamente al Banco Mundial y\nal Fondo y preparará los documentos de planificación necesarios, que se\npublicarán en el sitio web del FIDA y a nivel local; d) mujeres y hombres\nrecibirán igual remuneración por un trabajo de igual valor en el marco del\nPrograma; e) en el marco del Programa no se recurre al trabajo infantil; (f)\ntrato justo, no discriminación e igualdad de oportunidades de los trabajadores\ndel Programa; (g) se adopten las medidas incluidas en el Plan de Acción de\nGénero preparado para el Programa y se pongan a disposición los recursos\nnecesarios para su implementación, de manera oportuna; (h) se tomen debidamente\ntodas las medidas necesarias y apropiadas para implementar el Plan de Acción de\nGénero para garantizar que las mujeres puedan participar y beneficiarse\nequitativamente del Programa; y (i) se establece y opera eficazmente un\nmecanismo de reparación de quejas a nivel de programa fácilmente accesible y\nreceptivo.\n\nAsimismo, el Prestatario, a\ntravés del MAG, garantizará términos claros sobre la gestión de riesgos y la\nasunción de costos en caso de que surjan problemas críticos para salvaguardar\nla reputación institucional. Program Description\n\n1. Program Area.\n\nThe Program has a national\nscope and is organized according to the territorial division of the MAG, prioritizing\nthose regions where the adoption of Nationally Appropriate Mitigation Actions (NAMAs) in coffee, sugarcane, and livestock\nfarming has a greater contribution to the development of the local economy, and to national\nand international trade.\n\nIn the coffee sector, 93\npercent of production comes from four regions:\n\nCentro Oeste, Centro\nOriente, Centro Sur, and Brunca. In the sugar sector,\n54 percent of sugarcane production is carried out in the Chorotega\nregion, 12 percent in the Huetar Norte region,\nand 11.5 percent in the Pacífico Central region. Likewise, 75 percent of milk production is mainly concentrated in three regions:\n\nHuetar Norte, Centro Este, and Centro Oeste. The\nHuetar Norte region is the most specialized in\nlivestock production, with 26 percent of beef cattle production, 44 percent of milk production, and 34 percent of dual-purpose\nlivestock farming. The Huetar Caribe region\nproduces the largest quantity of beef and dual-purpose cattle, without high\nproductive concentration. Likewise, the Program will act in specific geographical\nareas to support fishermen of the Gulf of Nicoya in the province of\nPuntarenas (Pacífico Central) and potato, vegetable, flower, and\nstrawberry producers in the north of the province of Cartago (Llano Grande and Tierra Blanca)\nin the Centro Oriente region. In addition, these geographic areas include the\nregions with the highest concentration of poverty (Región Huetar\nCaribe, Región Brunca, Huetar\nNorte, and Chorotega) and the most weakened populations in coastal areas. Finally, the program also includes actions that will affect the entire national\nterritory, such as the implementation of the agricultural traceability system and the\nregistration system on the producer information digital platform.\n\n2. Project Target Group and\nBeneficiaries.\n\nThe Program will directly\nbenefit 30,000 micro, small, and medium-sized producers, of whom at\nleast 24,000 will be registered in the MAG's platform for small and medium-sized agricultural producers (PYMPA), 9,000 (30 percent) will be women, and\n4,500 (15 percent) will be young people. The direct beneficiaries will have access\nto services such as technical assistance, investments for NAMA adoption, credit, and the traceability system.\n\nDevelopment Objective.\n\nThe Program is aimed at\nachieving the following development objectives: SDG 1: End poverty, through the generation of higher incomes and equity in their distribution; SDG\n2: Zero hunger, promoting food security and sustainable\nagriculture; SDG 5: Gender equality, opening spaces for the participation\nof women and promoting their economic and social empowerment; SDG 10:\nReduce inequalities, considering opportunities for the poorest and\nmost vulnerable in order to reduce their conditions of poverty and marginalization; and SDG\n13: Climate action through the Republic of Costa Rica's implementation\nof NAMA measures for adaptation and resilience\nto climate change.\n\nResults Areas\n\nThese objectives will be\nachieved through the implementation of the following results areas,\nwhich correspond to the four axes of the Plan Sectorial Agrícola 2023-2032 (ASP):\n\nResults Area 1 -\nModernization of the Agricultural Sector\nInstitutions. The objective of RA1 is to modernize the public\nagricultural extension services that are key to supporting\nproducers to improve their sustainability, competitiveness, and economic inclusion.\nTherefore, RA1 is considered cross-cutting, as it supports the achievement of the\nother three results areas.\n\nResults Area 2 -\nPromotion of Competitiveness.\nThe objective of RA2 is to promote the competitiveness of agricultural producers through better access to markets (national and international). This\nwill be achieved by improving market information and traceability, increasing\ninstitutional capacity to carry out selected environmental and (phyto)sanitary diagnostic\nassessments, and\nfostering economic inclusion and improving basic market\nlinks with domestic markets, especially for vulnerable groups.\n\nResults Area 3 -\nSustainable Production. The\nobjective of RA3 is to improve the environmental sustainability of agricultural\nproduction through the expansion of the adoption of three NAMAs of the agricultural sector\n(livestock, coffee, and sugarcane, due to their readiness for scaling up)\nand other sustainable practices related to irrigation. This will\nbe achieved by supporting the adoption of NAMAs by producers through\ntechnical assistance; improving access to financing for the adoption of NAMAs through a joint mechanism between the Sistema de\nbanca de desarrollo (BDS) and private banks, including for vulnerable\ngroups; and improving the monitoring, reporting, and\nverification of emissions for the NAMA models. RA3 will also promote sustainable\nirrigation in dry and climate-vulnerable zones to address critical resilience challenges.\n\nResults Area 4 -\nAdded Value and Marketing. The\nobjective of RA4 is to add value to the environmental benefits generated by the\nNAMA production models through payments for environmental services (pagos por servicios ambientales). This\nwill help farmers have an additional source of income until\nthe benefits of NAMA adoption materialize, the added\nvalue to products coming from the NAMA is consolidated, and new\nmarkets are developed.\n\nII. Implementation Arrangements\n\n1. Lead Program Agency.\n\nMinisterio de Agricultura y\nGanadería (MAG)\n\n2. Program Technical\nCoordination Team.\n\nThe Secretaría Ejecutiva de\nPlanificación del Sector Agropecuario (SEPSA) of the MAG shall maintain a Program\nCoordination Team (ECP) throughout the program's implementation. The\nteam shall be responsible for adequately supervising and managing compliance\nwith the terms of the Program's Legal Agreement, as well as for coordinating and\nsupervising the implementation of the Program Action Plan (PAP). The team\nshall be composed of suitable personnel with the necessary profiles and responsibilities\nto support the Program's implementation. Other institutions that\nparticipate in the Program's implementation shall do so within the framework of their\nexisting framework agreements with MAG. In the case of the SBD, it will be necessary to establish\na specific framework agreement for the Program. MAG shall also collaborate with\nindustry associations (for example, CORFOGA, LAICA) through the\nexisting framework agreements.\n\n3. Project and/or Program\nParties\n\nThe following entities are\nconsidered Program Parties:\n\ni) SEPSA: as the lead agency\nleading, managing, and in charge of the overall coordination of the\nProgram;\n\nii) INCOPESCA and PIMA:\nentities responsible for contributing to the activities for the achievement of\nDLI 4;\n\niii) SFE and SENASA entities\nresponsible for contributing to the activities for the achievement of DLI 3;\n\niv) SENARA, entity\nresponsible for contributing to the activities for the achievement of DLI 7;\n\nv) SBD, entity responsible\nfor contributing to the activities for the achievement of DLI 6.\n\nTo facilitate the implementation\nof the respective Program Part, the Borrower, through MAG,\nshall enter into Implementation Agreements between MAG and each Program Party,\nunder the terms and conditions approved by the Bank and the Fund. These\nshall include the following: (i) if applicable, the terms and conditions under\nwhich the Loan funds shall be made available to the Program\nParty and the Borrower's right to suspend or terminate the Program\nParty's right to use the Loan funds if it breaches its\nobligations under the Implementation Agreement; (ii) the obligation of the\nProgram Party to execute its Respective Part of the Program in accordance\nwith the terms of this Agreement and the Program Operations Manual; and\n(iii) the monitoring and reporting requirements. The Borrower,\nthrough MAG, shall exercise its rights under each of the Implementation\nAgreements in a manner that protects the interests of the Borrower, the\nBank, and the Fund, and fulfills the purposes of the Loan. Unless otherwise\nagreed by the Bank and the Fund, the Borrower, through MAG, shall not assign,\namend, abrogate, or waive any of the Implementation Agreements\nor any of their provisions.\n\nIn case of any\nconflict between the terms of the Implementation Agreements and those of this\nFinancing Agreement, the terms of this Financing\nAgreement shall prevail.\n\nLikewise, MAG\nshall be in charge of contributing to the activities that allow the achievement of DLIs 1, 2, 3, 5, 6, and 8.\n\n4. Monitoring and\nEvaluation\n\nMAG, through SEPSA,\nshall be responsible for the monitoring and evaluation of the program. The\nplanning, monitoring, and evaluation procedures shall take into account the national regulations\nestablished by the Ministerio de Planificación Nacional y Política Económica\n(MIDEPLAN), the Ministerio de Hacienda (MH), and the Contraloría General de la\nRepública (CGR); as well as the World Bank's guidelines on this matter.\n\n5. Program Operations Manual\n(MOP).\n\nA Program Operations Manual will be developed and\nimplemented once the project has been approved. The development of the MOP will be led by SEPSA. The World\nBank and FIDA will provide technical support as needed.\n\n6. central Costa Rica.\n\n6. \"Cartago Irrigation District\" means the irrigation project planned under this Program, located in the northern zone of the province of Cartago.\n\n7. \"Cold storage facility (almacén frigorífico)\" means a facility that stores products, such as fresh fish, that need to be kept at a controlled temperature, and which will be designed and built in the central Pacific region of Costa Rica.\n\n8. \"Completed or Finalized\" means that the final feasibility study and the design plans for the modernization of the Cartago Irrigation District have been approved by the MAG through an official decree.\n\n9. \"Training completed (formación completada)\" means that the extensionists have completed the training, and their participation has been documented by the MAG, in the following areas: (i) adoption of NAMAs, (ii) registration and use of the agricultural sector traceability system and other digital resources (agromática), (iii) adaptation of extension services to vulnerable groups, and (iv) general business management.\n\n10. \"Specific Fund (Fondo Específico)\" means a fund to be established within FONAFIFO to finance the PSA Mechanism.\n\n11. \"Designed\" means that, for the Dedicated Fund, the sources of financing and the flow of funds have been (i) approved by the applicable authorities, and (ii) the respective legal or regulatory approvals have been promulgated or issued, as the case may be.\n\n12. \"Developed and Launched\" means when a module of the Trazar Agro System has completed technical and operational development plans and has been officially announced as functional at a launch event.\n\n13. \"Developed and Operational\" means when the Digital Producer Information Platform is integrated with the MAG, SENASA, and SFE systems and users can access and navigate it.\n\n14. \"Digital Producer Information Platform (Plataforma Digital de Información al Productor)\" means the MAG's Agricultural Extension Information System (Sistema de Información de Extensión Agropecuaria).\n\n15. \"Established\" means that, for the PSA Mechanism, the scope of application, the recognition of environmental services (servicios ambientales), and the implementation provisions have been (i) designed, (ii) approved by the applicable authorities, and (iii) the respective legal or regulatory approvals have been promulgated or issued, as the case may be.\n\n16. \"In operation (En funcionamiento)\" means when documentation, such as transaction receipts, is provided from fishers using the cold storage facility.\n\n17. \"FONAFIFO\" means the Borrower's National Forestry Financing Fund (Fondo Nacional de Financiamiento Forestal), or any successor acceptable to the World Bank or the Fund.\n\n18. \"Finalized\" means the approval by the MAG, through an official decree, of the design plan for the cold storage facility.\n\n19. \"Information campaign (campaña de información)\" refers to a campaign to raise awareness and improve the capacity to use the Digital Producer Information Platform, carried out through various communication methods, including face-to-face events, print media, and digital media, for which Program.\n\n21. \"INCOPESCA\" means the Costa Rican Institute of Fisheries and Aquaculture (Instituto Costarricense de Pesca y Acuicultura), or any successor acceptable to the World Bank or the Fund.\n\n22. \"INTA\" means the Borrower's National Institute for Innovation and Transfer in Agricultural Technology (Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria), or any successor acceptable to the World Bank or the Fund.\n\n23. \"MAG\" means the Borrower's Ministry of Agriculture and Livestock (Ministerio de Agricultura y Ganadería), or any successor acceptable to the World Bank or the Fund.\n\n24. \"NAMA\" means Nationally Appropriate Mitigation Actions, which are policies with actions and objectives that countries commit to adopt to reduce emissions under the United Nations Framework Convention on Climate Change.\n\n25. \"OIRSA\" means the Regional International Organization for Agricultural Health (Organismo Internacional Regional de Sanidad Agropecuaria), or any successor acceptable to the World Bank or the Fund.\n\n26. \"ONS\" means the Borrower's National Seed Office (Oficina Nacional de Semillas), or any successor acceptable to the World Bank or the Fund.\n\n27. \"Operational\" means when the SBD NAMA Financing Program is accessible to the public and has documented its first credit or guarantee to a PYMPA.\n\n28. \"Payment for Environmental Services\" or \"PSA\" (Pagos por Servicios Ambientales) refers to payments to farmers or landowners who have agreed to take certain actions to manage their land or watersheds to provide an ecological service, and which are financed by the National Forestry Financing Fund (FONAFIFO) of the Ministry of Environment and Energy (MINAE) and governed by Ley Forestal Nº 7575 of 1996.\n\n29. \"PSA Mechanism (Mecanismo PSA)\" refers to a financial mechanism to be designed and established to promote carbon sequestration in agricultural soils through payments to NAMA producers for certified carbon sequestration attributable to their adoption of NAMAs.\n\n30. \"PIMA\" means the Borrower's Comprehensive Agricultural Marketing Program (Programa Integral de Mercadeo Agropecuario), or any successor thereof acceptable to the World Bank or the Fund.\n\n31. \"Program Action Plan (Plan de Acción del Programa)\" means the Borrower's plan dated March 11, 2025 and referred to in Section E of Anexo 2 of the World Bank Financing Agreement, as may be amended occasionally with the prior written agreement of the Bank or the Fund.\n\n32. \"Program Implementing Entity (Entidad Implementadora del Programa)\" refers to MAG, as the main executing entity (equivalent to the Responsible Body for the Project for the Fund), and INCOPESCA, SBD, SFE, SENARA, PIMA, SENASA, and INTA, and any successor of any of them acceptable to the Bank and the Fund; and the term \"Program Implementing Entities\" (Program Parts for the Fund) refers collectively to all these entities, including any successor of any of them acceptable to the Bank or the Fund.\n\n33. \"Program Operations Manual\" or \"Operations Manual (Manual de Operaciones)\" means the manual referred to in Section I.C of Anexo 2 of the World Bank Agreement, as amended periodically with the Bank's agreement; as well as Paragraph 5 of Section II of Anexo I referring to Implementation Provisions of the Financing Agreement between the Fund and the Borrower.\n\n34. \"PYMPA\" means Costa Rican small and medium-sized agricultural producers classified as such in accordance with Article 9 of Decreto No. 37911-MAG dated August 19, 2013.\n\n35. \"PYMPA receiving technical assistance to adopt NAMAs\" means livestock, coffee, and sugarcane PYMPAs that have received technical assistance from MAG extensionists enabling them to meet the criteria necessary for their productive activity to be classified as a NAMA.\n\n36. \"SBD\" means the Development Banking System of Costa Rica (Sistema de Banca para el Desarrollo), or any successor acceptable to the World Bank or the Fund.\n\n37. \"SBD NAMA Financing Program\": a program tailored and accessible only to PYMPAs to finance the adoption of NAMAs, and consisting of a financing mechanism and a guarantee system.\n\n38. \"Registered and Active\" means that producers have created a profile on the Digital Producer Information Platform and their information is accessible to platform users.\n\n39. \"SENARA\" means the Borrower's National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego, y Avenamiento), or any successor thereof acceptable to the World Bank or the Fund.\n\n40. \"SENASA\" means the Borrower's National Animal Health Service (Servicio Nacional de Salud Animal), or any successor thereof acceptable to the World Bank or the Fund.\n\n41. \"SEPSA\" means the MAG's Executive Secretariat for Agricultural Sector Planning (Secretaría Ejecutiva de Planificación Sectorial Agropecuaria), or any successor body acceptable to the World Bank or the Fund.\n\n42. \"Comptroller of Services (Contraloría de Servicios)\" means the Comptroller's Offices of Services, or any other entity(ies) or department(s) that the Borrower determines and duly informs the Bank of, through which citizens can submit complaints, claims, or suggestions using channels such as online forms, email, face-to-face visits, or telephone.\n\n43. \"SFE\" means the Borrower's State Phytosanitary Service (Servicio Fitosanitario del Estado), or any successor thereof acceptable to the World Bank or the Fund.\n\n44. \"Trazar-Agro System (Sistema Trazar-Agro)\" means OIRSA's Harmonized Regional Agricultural, Aquaculture, and Fisheries Traceability and Registry System (Sistema Regional Armonizado de Trazabilidad y Registro Agropecuario, Acuícola y Pesquero), a traceability system that facilitates the application of regional traceability standards, the registration and control of persons and agricultural, aquaculture, and fisheries establishments, and the monitoring of other traceability operations.\n\n45. \"United Nations Framework Convention on Climate Change\" means the United Nations Convention of the same name of May 9, 1992.\n\n46. \"Verification Agency (Agencia de Verificación)\" means the agency and/or consultant(s) of the Borrower to be selected and appointed in accordance with the provisions of Section I.D of Anexo 2 of the World Bank Financing Agreement for the purpose of carrying out the verification of the achievement of the DLRs by the MAG\n\nand the Program Implementing Entities; as well as the reference to Section E, numeral 3 of the Financing Agreement between the Fund and the Borrower.\n\n47. \"Verification Protocol (Protocolo de Verificación)\" means the protocol agreed between the Borrower and the Bank dated March 11, 2025, which sets out the means, procedures, and evidence on which the certification of the achievement of the DLRs will be based, as well as the entities responsible for them, and the content\n\n and/or format of the reports to be provided to the Bank in support thereof, which may be amended from time to time with the prior written agreement of the Bank.\n\n48. \"Water User Associations (Sociedades de Usuarios de Agua)\" means the Water User Associations constituted pursuant to the Water Law of Costa Rica No. 276 of August 27, 1942, and last amended on June 25, 2012, to govern the collective use of public water.\n\n49. \"Youth (Jóvenes)\": persons with a minimum age of 18 years and a maximum of 35.\n\nAnexo 3\n\nSpecial Commitments\n\nI. General Provisions\n\nIn accordance with Section 12.01(a)(xxiii) of the General Conditions, the Fund may suspend, in whole or in part, the right of the Borrower to request withdrawals from the Loan Account if the Borrower has failed to comply with any of the covenants set forth below, and the Fund has determined that such failure has had, or is likely to have, a material adverse effect on the Program:\n\n1. Planning, monitoring, and evaluation. The Borrower, through the MAG, shall ensure that (i) a planning, monitoring, and evaluation (PM&E) system is established within twelve (12) months from the effective date of this Agreement and (ii) semi-annual reports are provided, including the specific Indicators for IFAD described in Anexo I of this Agreement.\n\n2. Gender and Youth. The Borrower, through the MAG, shall ensure that the concerns of women and youth are duly taken into account when implementing the Program and that the participation quotas for women and youth established in the Program design document are met.\n\n3. Concerns of Indigenous Peoples. The Borrower, through the MAG, shall ensure that the concerns of IPs are duly taken into account when executing the Program and, to this end, shall ensure that\n\n(a) the Program is carried out in accordance with the applicable provisions of the [relevant national legislation on IPs];\n\n(b) indigenous peoples are adequately and fairly represented in all local planning of Program activities;\n\n(c) The rights of IPs are duly respected;\n\n(d) IP communities participate in policy dialogue and local governance;\n\n(e) The terms of the Declarations, Pacts, and/or Conventions ratified by the Borrower on the matter are respected;\n\n(f) The Program shall not involve the invasion of traditional territories used or occupied by indigenous communities.\n\n4. Anti-corruption measures. The Borrower shall ensure that the Program is carried out in accordance with the provisions of the \"World Bank Guidelines for Preventing and Combating Fraud and Corruption in Program-for-Results Financing,\" dated February 1, 2012, and revised on July 10, 2015. For the purposes of this Agreement, a finding of corruption in accordance with the provisions of the \"World Bank Guidelines for Preventing and Combating Fraud and Corruption in Program-for-Results\" shall be considered a finding of corruption under the \"IFAD Policy on the Prevention of Fraud and Corruption in its Activities and Operations.\"\n\n5. Sexual harassment, sexual exploitation, and abuse. The Borrower and the Project Parties shall ensure that the Project is carried out in accordance with the provisions of the IFAD Policy on Prevention and Response to Sexual Harassment, Sexual Exploitation, and Abuse.\n\n6. Environmental, social, and climate safeguards (ESC). The Borrower, through the MAG, shall ensure that the Program is implemented in accordance with the safeguard provisions specified in the World Bank Agreement and shall ensure that: (a) all Program activities are implemented in strict conformity with the relevant laws/regulations of the Borrower; (b) all Program activities give special consideration to the participation and practices of the population in accordance with IFAD Policy; (c) the free, prior, and informed consent of all persons whose access to land and resources may be affected or hindered by Program activities is obtained.\n\nIn the event of unforeseen land acquisition or involuntary resettlement under the Program, the Borrower, through the MAG, shall immediately inform the World Bank and the Fund and prepare the necessary planning documents, which shall be published on the IFAD website and locally; d) women and men shall receive equal remuneration for work of equal value under the Program; e) child labor is not used under the Program; (f) fair treatment, non-discrimination, and equal opportunity for Program workers; (g) the measures included in the Gender Action Plan prepared for the Program are adopted and the necessary resources for its implementation are made available in a timely manner; (h) all necessary and appropriate measures are duly taken to implement the Gender Action Plan to ensure that women can participate in and benefit equitably from the Program; and (i) an easily accessible and responsive program-level grievance redress mechanism is established and effectively operated.\n\nFurthermore, the Borrower, through the MAG, shall ensure clear terms on risk management and the assumption of costs in the event that critical issues arise to safeguard institutional reputation. This must also be included in the Program Operations Manual (MOP)." }
