DE\nAGRICULTURA Y GANADERÍA\n\nCon fundamento en las atribuciones\ny facultades conferidas en los artículos 50, 140 incisos 3) y 18) y 146 de la\nConstitución Política; los artículos 27 inciso 1) y artículo 28 inciso 2) acápite\nb) de la Ley General de la Administración Pública, Nº 6227 del 2 de mayo de\n1978; el artículo 8 inciso g) del Convenio sobre Diversidad Biológica y Anexos,\naprobado mediante la Ley Nº 7416 del 30 de junio de 1994; el artículo 16 de la\nAprobación del Protocolo de Cartagena sobre Seguridad de la Biotecnología del\nConvenio sobre la Diversidad Biológica, aprobado mediante la Ley Nº 8537 del 23\nde agosto de 2006; los artículos 4, 5 inciso b y del 40 al 42 de la Ley de\nProtección Fitosanitaria Nº 7664 del 08 de abril de 1997; la Ley de Fomento a\nla Producción Agropecuaria, Nº 7064 del 29 de abril de 1987 y la Ley de Protección\nal Ciudadano del Exceso de Requisitos y Trámites Administrativos, Ley Nº 8220 del\n4 de marzo de 2002.\n\nCONSIDERANDO:\n\nl. Que, la Ley de\nProtección Fitosanitaria Nº 7664, conforme el capítulo IV, sección II, faculta\nal Servicio Fitosanitario del Estado para la regulación fitosanitaria de\norganismos o productos de la biotecnología.\n\nII. Que, la Aprobación del\nProtocolo de Cartagena sobre Seguridad de la Biotecnología del Convenio sobre\nla Diversidad Biológica, Ley Nº 8537, establece en su artículo 16 los requerimientos\npara la Gestión del Riesgo de organismos vivos modificados (OVM), mediante los\ncuales se deben establecer y mantener mecanismos, medidas y estrategias adecuadas\npara regular, gestionar y controlar los riesgos determinados con arreglo en las\ndisposiciones sobre evaluación del riesgo relacionados con la utilización,\nmanipulación y movimiento transfronterizo de OVM.\n\nIII. Que, el Reglamento de\nAuditorías en Bioseguridad Agrícola del Ministerio de Agricultura y Ganadería\nNº 32486 publicado en la Gaceta Nº 142 del 22 de julio del 2005, presentaba\nlimitaciones en cuanto al uso de definiciones ya superadas en la ciencia y la técnica,\nen la definición de la estructura orgánica misma del SFE, en la\nconceptualización de las responsabilidades de los diferentes actores que\nparticipan en el proceso de inspección y supervisión de las actividades\nrelacionadas con OVM, así como en cuanto a la incorporación de herramientas\npara el resguardo de la independencia e imparcialidad de quienes brindan el servicio\nde Auditorias en Bioseguridad Agrícola, lo que genera vacíos en el alcance y aplicación\nde las normas que ahí se establecían.\n\nIV. Que, el Servicio\nFitosanitario del Estado, como ente encargado de las regulaciones y control de\nlas actividades relacionadas con OVM, considera necesario implementar una modificación\nintegral de la normativa contenida en el Decreto Nº 32486 que permita una nueva\ndefinición del marco técnico, funcional y normativo fundamental para el\nejercicio de la regulación y la administración del riesgo asociado con la\nimportación, exportación, investigación, experimentación, movilización,\nmultiplicación, producción industrial, comercialización y la utilización de OVM\nde uso agrícola, conforme los nuevos conocimientos en bioseguridad agrícola, la\nestructura orgánica vigente del Servicio Fitosanitario del Estado, las\nherramientas de análisis y gestión de la práctica de auditorías en bioseguridad\nagrícola, así como la incorporación de normas que regulen con claridad las funciones\ny responsabilidades de los participantes en los procesos de liberación al\nambiente de OVM.\n\nV. Que, conforme al\nartículo Nº 4 de la Ley de Protección al Ciudadano del Exceso de Trámites y\nRequisitos Administrativos, Ley Nº 8220 del 04 de marzo de 2002, todo trámite o\nrequisitos que el administrado debe cumplir deben constar en una ley, un\ndecreto o un reglamento y estar publicado en el diario oficial La Gaceta.\n\nVI. Que, de conformidad con\nel artículo 361 de la Ley General de la Administración Pública, Ley Nº 6227 del\n02 de mayo de 1978, se realizó la consulta pública de esta propuesta de Decreto\nEjecutivo del 14 de agosto de 2024 al 28 de agosto de 2024, y producto de esta,\ntodas las observaciones fueron atendidas e incorporadas en la misma.\n\nVII. Que, de conformidad\ncon lo establecido en el artículo 12 del Decreto Ejecutivo Nº 37045 del 22 de\nfebrero de 2012 y su reforma \"Reglamento a la Ley de Protección al\nCiudadano del Exceso de Trámites y Requisitos Administrativos\", esta\nregulación cumple con los principios de mejora regulatoria, de acuerdo con el\ninforme Nº DMR-DAR-INF-080-2025 emitido por la Dirección de Mejora Regulatoria\ny Reglamentación Técnica del Ministerio de Economía, Industria y Comercio.\n\nPor tanto:\n\nDECRETAN\n\nREGLAMENTO DE AUDITORÍAS EN\nBIOSEGURIDAD AGRÍCOLA DEL\n\nMINISTERIO DE AGRICULTURA Y\nGANADERÍA; REFORMA DEL INCISO A)\n\nDEL ARTÍCULO 123 DEL\nDECRETO EJECUTIVO Nº 26921-MAG:\n\nREGLAMENTO A LA LEY DE\nPROTECCIÓN FITOSANITARIA Y\n\nDEROGATORIA DEL DECRETO\nEJECUTIVO Nº 32486-MAG: REGLAMENTO\n\nDE AUDITORÍAS EN\nBIOSEGURIDAD AGRÍCOLA DEL MINISTERIO DE\n\nAGRICULTURA Y GANADERÍA\n\nCAPÍTULO I\n\nDel objetivo y de las\ndefiniciones\n\nSección única\n\nArtículo 1.- El presente\nReglamento tiene como objetivo regular las relaciones y obligaciones entre el\nMinisterio de Agricultura y Ganadería, a través del Servicio Fitosanitario del\nEstado como órgano competente en la regulación y control de las actividades con\norganismos vivos modificados utilizados en la agricultura, las entidades\nsujetas a auditorías en bioseguridad agrícola y las empresas auditoras\nencargadas de realizarlas.\n\n Ficha Artículo 1\n\nArtículo 2.- Para los\nefectos de este reglamento se entiende por:\n\na) Auditor en\nbioseguridad agrícola: profesional en ciencias agrícolas o biológicas competente\nen las áreas de la biotecnología o la bioseguridad que asume la responsabilidad\nde verificar, asesorar, recomendar, informar y advertir mediante técnicas\nobjetivas de análisis, diagnóstico y comunicación, sobre una base de\nindependencia e imparcialidad de criterio, el cumplimiento por parte de la\nentidad sujeta de auditoría en bioseguridad agrícola, de las medidas aplicadas\nen las operaciones con OVM de uso en la agricultura.\n\nb) Bioseguridad de los\norganismos vivos modificados: las normas, medidas y acciones requeridas\npara garantizar un nivel adecuado de protección en la transferencia, manipulación\ny utilización segura de los OVM resultantes de la biotecnología moderna que\npuedan tener efectos adversos para la conservación y la utilización sostenible\nde la diversidad biológica, teniendo también en cuenta los riesgos para la\nsalud humana. Comprende las fases: uso confinado, liberación intencional al\nambiente y comercialización de los OVM de uso agrícola. Para efectos del\npresente reglamento, la bioseguridad agrícola se entenderá como la bioseguridad\nde los organismos vivos modificados de uso en la agricultura.\n\nc) Biotecnología\nmoderna: se entiende la aplicación de:\n\n1. Técnicas in vitro de\nácido nucleico, incluidos el ácido desoxirribonucleico recombinante y la\ninyección directa de ácido nucleico en células u orgánulos, o\n\n2. La fusión de células más\nallá de la familia taxonómica, que superan las barreras fisiológicas naturales\nde la reproducción o de la recombinación y que no son técnicas utilizadas en la\nreproducción y selección tradicional.\n\nd) Certificado de\nliberación al ambiente, uso confinado y comercialización: documento resultado\nde la evaluación de riesgos para un evento de transformación específico,\notorgado a una persona física o jurídica que desee importar, movilizar, usar en\nconfinamiento, liberar al ambiente o comercializar los OVM de uso agrícola, en\nel cual se incluyen las medidas de bioseguridad establecidas en la evaluación\nde riesgos.\n\ne) Empresa auditora en\nbioseguridad agrícola: persona jurídica que asume la responsabilidad de brindar\nel servicio de auditoría en bioseguridad agrícola en las actividades relacionadas\ncon OVM, a las entidades sujetas a auditoría, mediante la contratación de auditores\nen bioseguridad agrícola. También podrá ser una persona física que asuma directamente\ndicha responsabilidad mediante la prestación de sus servicios profesionales como\nauditor en bioseguridad agrícola.\n\nf) Entidad sujeta de\nauditoría en bioseguridad agrícola: toda persona física o jurídica que importe,\nmovilice, use en confinamiento, libere al ambiente o comercialice los OVM utilizados\nen la agricultura, producidos dentro o fuera del país. Se exceptúan las\nactividades de docencia e investigación que desarrollen las instituciones de\neducación superior universitaria del Estado en laboratorios e invernaderos, en\nfunción de su autonomía, siempre y cuando dichas actividades no involucren\nfines comerciales o investigaciones que se desarrollen fuera del uso confinado.\n\ng) Inhabilitar: prohibir\ntemporalmente, mediante acto administrativo, que una persona física o jurídica\nejerza funciones en bioseguridad agrícola ante cualquier entidad sujeta al\npresente reglamento.\n\nh) Liberación al\nambiente: uso de un OVM para uso agrícola, fuera de los límites de un confinamiento\nfísico que limite de forma efectiva su contacto con el medio exterior o sus efectos\nsobre dicho medio, tales como un recinto cerrado, laboratorio, biorreactor o\ncualquier otra estructura cerrada. Todo ello bajo las condiciones de\nbioseguridad establecidas en la evaluación de riesgos.\n\ni) Medio receptor: lote,\nterreno, local, instalación o cualquier otro sitio específico, que entrañe la\nmanipulación y uso de organismos producto de la biotecnología moderna.\n\nj) Organismo vivo\nmodificado: cualquier organismo vivo que posea una combinación nueva de\nmaterial genético que se haya obtenido mediante la aplicación de la\nbiotecnología moderna. Comprende lo denominado corno: \"organismo alterado\no manipulado\", \"organismo transgénico\", \"material\ntransgénico\", \"vegetales transgénicos\" o \"producto manipulado\no transgénico\".\n\nk) Riesgo en\nbioseguridad agrícola: son los posibles efectos adversos de los OVM de uso agrícola,\ncon fundamento en la probabilidad de ocurrencia y las consecuencias del efecto,\nen la conservación y utilización sostenible de la diversidad biológica en el\nprobable medio receptor, teniendo también en cuenta los riegos para la\nagricultura y la salud humana y animal.\n\nl) Programa de\nOrganismos Genéticamente Modificados: es la dependencia adscrita al SFE,\nresponsable de autorizar el uso de OVM de uso agrícola, dar seguimiento\nmediante inspecciones, y emitir recomendaciones y medidas de bioseguridad.\n\nm) Uso confinado: cualquier\noperación, llevada a cabo dentro de un local, instalación u otra estructura\nfísica, que entrañe la manipulación de organismos producto de la biotecnología moderna\ncontrolados por medidas específicas que limiten de forma efectiva su contacto\ncon el medio exterior o sus efectos sobre dicho medio.\n\n Ficha Artículo 2\n\nArtículo 3.- Para los\nefectos del presente reglamento, se entenderá por:\n\nCCSS: Caja Costarricense del Seguro Social.\n\nCLA: Certificado de liberación al ambiente, uso confinado y comercialización.\n\nMAG: Ministerio de Agricultura y Ganadería.\n\nOVM: Organismo vivo modificado.\n\nPOGM: Programa de Organismos Genéticamente Modificados.\n\nSFE: Servicio Fitosanitario del Estado.\n\nUPE: Unidad de Programas Especiales.\n\n Ficha Artículo 3\n\nCAPÍTULO II\n\nDe la aprobación de\ninscripciones o actualizaciones de empresas auditoras en\n\nbioseguridad agrícola\n\nSección única\n\nArtículo 4.- Toda persona física\no jurídica que desee ofrecer los servicios de auditorías en bioseguridad\nagrícola debe estar inscrita ante el SFE. El SFE mantendrá un registro actualizado\nde todas las empresas auditoras en bioseguridad agrícola registradas para el ejercicio\nde las auditorías, disponible en su página web: www.sfe.go.cr.\n\n Ficha Artículo 4\n\nArtículo 5.- De los\nrequisitos para las solicitudes de inscripción o actualización de empresas auditoras\nen bioseguridad agrícola. Para realizar el trámite, la persona interesada debe:\n\n1. Presentar de forma\ndigital la solicitud al POGM, mediante el Anexo I de este reglamento, el cual\nconsiste en el formulario de inscripción o actualización de empresas auditoras\nen bioseguridad agrícola, aportando, en carácter de declaración jurada,\ninformación sobre las calidades, representación jurídica, contacto y atestados de\nla persona interesada, para los casos de inscripción o actualización de\npersonas jurídicas, la persona interesada deberá aportar la información\nrelativa a las calidades, contacto y atestados de las personas candidatas a\nauditor en bioseguridad agrícola.\n\n2. Presentar una copia en\nformato digital del curriculum vitae del o los candidatos a auditores en\nbioseguridad agrícola.\n\n3. Encontrarse al día con\nel cumplimiento del artículo 74 de la Ley Nº 17: Ley Constitutiva de la Caja\nCostarricense del Seguro Social, del 22 de octubre de 1943.\n\nEste requisito será\nverificado a nivel interno por el SFE a través de los sistemas de la CCSS.\n\n Ficha Artículo 5\n\nArtículo 6.- De las\nsolicitudes de inscripción o actualización de empresas auditoras en bioseguridad\nagrícola.\n\na. Presentación de la\nsolicitud\n\nPara solicitar la\ninscripción o actualización de una empresa auditora en bioseguridad agrícola, la\npersona interesada deberá presentar de forma digital la solicitud al POGM\nmediante el formulario de inscripción o actualización de empresas auditoras en\nbioseguridad agrícola, firmado digitalmente, disponible en el sitio web oficial\ndel SFE: www.sfe.go.cr\ny en el Anexo 1 de este reglamento, aportando, en carácter de declaración\njurada, información sobre las calidades, representación jurídica, contacto y\natestados de la persona interesada, así como las calidades, contacto y\natestados de la persona o personas candidatas a auditor en bioseguridad\nagrícola.\n\nb. Admisibilidad\n\nLa información\nproporcionada por la persona interesada en el formulario de inscripción o actualización\nde empresas auditoras en bioseguridad agrícola será sometida a una revisión de admisibilidad,\npara lo cual, el POGM verificará que, junto con la solicitud, la persona interesada\naporte la totalidad de la información requerida en el formulario antes\nmencionado. Para tales efectos, se debe realizar la revisión de admisibilidad\nde la solicitud en los siguientes 10 días naturales a partir de la entrega de\nesta. No se permitirá el inicio del proceso de revisión de fondo de las\nsolicitudes que no cumplan con el proceso de admisibilidad ante el POGM.\n\nc. Prevención única\n\nEl POGM podrá prevenir por\nuna única vez a la persona interesada, a través del medio de comunicación que\nesta haya indicado en la solicitud, la presentación de cualquier documento faltante,\nsubsanación o corrección de cualquier requisito relativo a la solicitud,\notorgándole al efecto un plazo de 30 días hábiles para el cumplimiento de los\naspectos prevenidos, plazo que podrá\nprorrogarse por 30 días hábiles adicionales y por una única vez mediante una solicitud\nde la persona interesada debidamente justificada, la cual debe presentarse\ndentro del plazo otorgado inicialmente. Tal prevención se realizará mediante\nacto administrativo debidamente motivado.\n\nd. Archivo de la gestión en\netapa de admisibilidad\n\nVencido el plazo otorgado a\nla persona interesada en el inciso anterior, si el POGM verifica que los\nincumplimientos o inconsistencias originales no fueron subsanados por parte de\nla persona interesada en su totalidad, podrá ordenar el archivo definitivo de\nla gestión, acto que debe comunicársele a la persona interesada mediante\nresolución administrativa a través del medio de comunicación que esta haya\nseñalado en la solicitud. Contra el acto de la resolución administrativa caben\nlos recursos ordinarios de revocatoria y de apelación, de acuerdo con lo establecido\nen los artículos 342 y 343 de la Ley General de la Administración Pública, Ley N\nº 6227 del 2 de mayo de 1978.\n\ne. Análisis\n\nUna vez recibida la\ndocumentación completa, el POGM realizará el análisis de los atestados, competencias,\nconocimientos y experiencia de cada persona candidata a auditor en bioseguridad\nagrícola y emitirá un criterio de aprobación o rechazo respecto de cada candidatura.\nEl POGM tendrá 20 días naturales para realizar el análisis de la información aportada\nen relación con la solicitud de inscripción o actualización de las personas\nauditoras en bioseguridad agrícola.\n\nf. Resolución\n\nUna vez analizada la\nsolicitud de inscripción o actualización de una empresa auditora en bioseguridad\nagrícola, el POGM comunicará a la persona interesada en un plazo de 10 días naturales,\nmediante resolución administrativa, a través del medio de comunicación que esta\nhaya señalado en la solicitud, el resultado de la solicitud de inscripción o\nactualización para ofrecer los servicios de auditoría en bioseguridad agrícola,\nasí como las consideraciones sobre las cuales se emite dicha decisión.\n\ng. Taller de inducción para\nauditores en bioseguridad agrícola\n\nEn caso de que la solicitud\nde registro sea aprobada, el POGM indicará a la persona física o jurídica interesada,\nen la resolución administrativa, que el o los candidatos a auditores inscritos\ndeberán participar en el taller de inducción para auditores en bioseguridad\nagrícola. El POGM será la entidad responsable de coordinar la ejecución de\ndichos talleres y, de acuerdo con su criterio técnico, definirá los contenidos\nque se impartirán en ellos. La fecha, hora, modalidad y duración en que se\nimpartirán los talleres de inducción serán fijadas por el POGM y publicadas en\nla página web oficial del SFE: www.sfe.go.cr. A partir de la notificación\nde la resolución administrativa, el POGM contará con un plazo de 90 días naturales\npara impartir el taller de inducción para auditores en bioseguridad agrícola.\nLas personas auditoras inscritas deberán participar al menos una vez cada dos\naños en este taller como mecanismo de actualización.\n\nEn caso de que el o los\ncandidatos a auditores inscritos no se presenten al taller de inducción para\nauditores en bioseguridad agrícola previamente coordinado por el POGM, no\npodrán ejercer la actividad de auditoría en bioseguridad agrícola hasta que\nparticipen en dicho taller. El POGM deberá comunicar esta situación a la\npersona física o jurídica interesada mediante oficio, a través del medio de comunicación\nseñalado en la solicitud.\n\nLas personas auditoras en\nbioseguridad agrícola que requieran actualizar su participación en el taller de\ninducción para auditores en bioseguridad agrícola deberán solicitarlo al menos 90 días antes de su vencimiento.\nAsimismo, aquellas que no lo hayan realizado previamente deberán solicitar su\nparticipación en dicho taller. Ambos casos deberán gestionarse ante el POGM\nmediante nota firmada digitalmente. El POGM contará con un plazo máximo de 1 O días\nhábiles para comunicar, mediante oficio, la autorización para participar en un\nfuturo taller coordinado por el POGM.\n\nh. Emisión y entrega del\ncertificado\n\nUna vez concluido el taller\nde inducción para auditores en bioseguridad agrícola, el POGM emitirá, en\nformato digital, un certificado mediante el cual se autoriza a la persona\nauditora el ejercicio de la actividad de auditoría en bioseguridad agrícola\ncontemplada en el presente reglamento. El POGM contará con un plazo máximo de 10\ndías naturales para notificar el certificado a la persona interesada, a través\ndel medio de comunicación señalado en la solicitud. Para tal efecto, la persona\nauditora deberá realizar el acuse de recibo conforme del mismo.\n\ni. Plazo total del trámite\nde inscripción o actualización de personas físicas o jurídicas que desean\nofrecer sus servicios como auditoras en bioseguridad\n\nEl plazo máximo para el\ntrámite de estas solicitudes será de 145 días naturales. En caso de que sea\nrequerida información adicional a la persona interesada, se suspenderá el plazo\nque tiene el POGM para resolver la solicitud.\n\nj. Vigencia\n\nLa inscripción de personas\nfísicas o jurídicas que deseen ofrecer servicios como auditores en bioseguridad\nagrícola tendrá una vigencia indefinida. No obstante, las personas auditoras inscritas\ndeberán participar al menos una vez cada dos años en el taller de inducción\npara auditores en bioseguridad agrícola como mecanismo de actualización. El\ncumplimiento de esta disposición será necesario para mantenerse habilitado para\nejercer la actividad de auditoría en bioseguridad agrícola.\n\n Ficha Artículo 6\n\nCAPÍTULO III\n\nDe las funciones y\nresponsabilidades\n\nSección Primera:\n\nDe las funciones .y\nresponsabilidades del POGM:\n\nArtículo 7.- El POGM tendrá\na su cargo la gestión y supervisión de las auditorías en bioseguridad agrícola,\ncon el fin de fortalecer la regulación fitosanitaria de los OVM de uso agrícola\ny la administración del riesgo asociado a su importación, movilización, uso en confinamiento,\nliberación al ambiente o comercialización.\n\nLas disposiciones y medidas\nadministrativas que emita el POGM en el ejercicio de sus funciones y\nresponsabilidades en materia de auditoría en bioseguridad agrícola serán de acatamiento\nobligatorio para las empresas auditoras en bioseguridad agrícola y para las entidades\nsujetas a auditoría en bioseguridad agrícola.\n\n Ficha Artículo 7\n\nArtículo 8.- El POGM podrá\ninhabilitar o cancelar, en cualquier momento, la autorización para el ejercicio\nde las funciones de auditoría en bioseguridad agrícola de una empresa que asuma\nla responsabilidad de brindar dicho servicio, así como de sus auditores en\nbioseguridad agrícola contratados para tal fin, en los siguientes casos:\n\na) Cancelación por\nincumplimiento en el ejercicio de las auditorías en bioseguridad agrícola: cuando se compruebe que ha cometido alguna de las siguientes acciones u\nomisiones:\n\n1. No envíe al POGM, en\ntiempo y forma y de conformidad con lo establecido en el Capítulo IV de este\nreglamento, los informes mensuales de auditoría en bioseguridad agrícola\nrelativos a las actividades con OVM de uso agrícola bajo su auditoría.\n\n2. Incurra en\nincumplimiento de las responsabilidades en el ejercicio de la auditoría en bioseguridad\nagrícola contempladas en la Sección Segunda del Capítulo III de este reglamento.\n\n3. Incumpla la obligación\nde dar seguimiento a la implementación, por parte de la entidad auditada, de\nlas disposiciones emitidas por el POGM durante las inspecciones a las actividades\ncon OVM de uso agrícola.\n\n4. Incumpla la obligación\nde verificar el acatamiento de las disposiciones específicas establecidas en el\nrespectivo CLA, por parte de la entidad auditada, así como de las medidas de\nbioseguridad agrícola definidas en las resoluciones correspondientes a cada\nproyecto aprobado por el POGM.\n\n5. No comunique al POGM\ncualquier incumplimiento, por parte de la entidad sujeta de auditorías en\nbioseguridad agrícola, de las medidas de bioseguridad consignadas en la resolución\npara la aprobación de cada proyecto, detectado durante el proceso de auditoría,\ncuya inobservancia sea posteriormente identificada por el POGM.\n\nb) Cancelación por\nsolicitud de parte, o de oficio por incumplimiento del deber de probidad y\nveracidad: a solicitud de parte o de oficio. Así mismo,\nse procederá con la cancelación definitiva del registro de la empresa auditora\no de la persona auditora autorizada cuando se compruebe por el POGM el\nincumplimiento del deber de probidad, según lo dispuesto en los artículos 3 y 4\nde la Ley Nº 8422, Ley contra la Corrupción y el Enriquecimiento Ilícito,\naplicable a particulares que participen en la gestión de intereses públicos.\nAsimismo, será causal de cancelación inmediata la existencia de falsedad\ntécnica o la manipulación de datos, conforme a los principios de transparencia\ndel artículo 113 de la Ley Nº 6227, Ley General de la Administración Pública,\nsin perjuicio de las responsabilidades civiles o penales derivadas.\n\nc) Inhabilitación para\nejercer funciones de auditoría respecto de una entidad específica: procederá\nde oficio o a solicitud de parte ante el parentesco (hasta tercer grado de consanguinidad\no segundo de afinidad) de la persona auditora en bioseguridad agrícola con los\njerarcas, gerencia o propietarios de la entidad auditada. Esta medida también\nse aplicará cuando medien intereses privados que puedan influir de forma\ninadecuada en el ejercicio de la auditoría.\n\n Ficha Artículo 8\n\nArtículo 9.- El POGM será\nel responsable de verificar la calidad, objetividad y utilidad de los informes\nde auditoría en bioseguridad agrícola emitidos por las personas físicas o jurídicas\nque desarrollen esta labor, así como del cumplimiento de las funciones y responsabilidades\nestablecidas en la Sección Segunda del Capítulo III del presente reglamento. De\nigual manera, será responsable de verificar el cumplimiento de las observaciones,\ndisposiciones o recomendaciones emitidas a la entidad sujeta de auditoría en bioseguridad\nagrícola.\n\n Ficha Artículo 9\n\nArtículo 10.- Los\nfuncionarios del POGM, debidamente identificados, podrán realizar en cualquier\nmomento visitas de inspección a las entidades sujetas de auditoría en\nbioseguridad agrícola, pudiendo ser estas coordinadas previamente o sin aviso\nprevio.\n\n Ficha Artículo 10\n\nArtículo 11.- Si durante\nlas visitas de inspección los funcionarios del POGM constatan que las anomalías\nseñaladas por la empresa auditora en bioseguridad agrícola no han sido corregidas,\no detectan irregularidades en la administración de los riesgos de bioseguridad agrícola\npor parte de la entidad sujeta de auditoría en bioseguridad agrícola, podrán\npresentar la denuncia correspondiente ante la UPE, a efectos de gestionar la\naplicación de las sanciones previstas en los artículos 31, 68, 69 y 80 de la\nLey de Protección Fitosanitaria Nº 7664 y en el artículo 130, inciso a), así\ncomo en el artículo 134, incisos b) y c) del Reglamento a la Ley de Protección Fitosanitaria,\nDecreto Ejecutivo Nº 26921-MAG. y artículo 249 del Reglamento a la Ley de\nProtección Fitosanitaria N º 26921-MAG.\n\n Ficha Artículo 11\n\nSección Segunda:\n\nDe las funciones y\nresponsabilidades de las empresas auditoras en bioseguridad\n\nagrícola:\n\nArtículo 12.- Las funciones\ngenerales del auditor en bioseguridad agrícola incluyen:\n\na) Verificar que todo\nmaterial OVM de uso agrícola, que se encuentre bajo su auditoría, debe ajustarse\na la normativa contenida en la Ley de Protección Fitosanitaria, Nº 7664, y el Reglamento\na la Ley de Protección Fitosanitaria vigente, en el ámbito que regula la\nmateria.\n\nb) Verificar que la entidad\nsujeta de auditoría en bioseguridad agrícola mantiene a disposición de los\nencargados de atención de los proyectos con OVM de uso agrícola la resolución\nde aprobación del proyecto, emitida por el POGM, que contiene las medidas de\nbioseguridad aplicables de manera específica, de forma que la información pueda\ndisponerse de manera confiable, oportuna y útil, para una mejor aplicación de\nlos criterios técnicos requeridos para la implementación de las medidas de\nbioseguridad agrícola.\n\nc) Verificar que las\nentidades sujetas de auditoría en bioseguridad agrícola que importen movilicen,\nusen en confinamiento, liberen al ambiente o comercialicen los OVM utilizados en\nla agricultura, cumplan con los protocolos presentados por la entidad sujeta de\nauditoría en bioseguridad y aprobados por el POGM en el marco del trámite del\nCLA correspondiente o proyectos de siembra autorizados. Lo dispuesto en este inciso\nrige también cuando las actividades involucren el mantenimiento, reproducción y\ncrecimiento de OVM en espacios confinados de laboratorios o invernaderos. Se\nexceptúan las actividades de docencia e investigación que desarrollen las\ninstituciones de educación superior universitaria del Estado en laboratorios e\ninvernaderos, en función de su autonomía, siempre y cuando dichas actividades\nno involucren fines comerciales o investigaciones que se desarrollen fuera del uso\nconfinado.\n\nd) Detectar y documentar\nincumplimientos de las medidas de bioseguridad establecidas por el POGM en el\nCLA o en la resolución de autorización de los proyectos con OVM de uso agrícola,\nsustentando sus hallazgos en evidencia objetiva e indicando las disposiciones\nque no se cumplen, las posibles causas del incumplimiento y el impacto\ncorrespondiente.\n\ne) Recomendar a las\nentidades sujetas de auditoría en bioseguridad agrícola, oportunidades de\nmejora en las actividades de importación, movilización, uso confinado,\nliberación al ambiente, comercialización y documentación relacionadas con el\nmanejo de OVM de uso agrícola, que permitan optimizar las herramientas y\nesfuerzos para administrar eficazmente los riesgos en bioseguridad agrícola.\n\nf) Advertir a las entidades\nsujetas de auditoría en bioseguridad agrícola, de la ocurrencia de errores u\nomisiones en las actividades de importación, movilización, uso confinado, liberación\nal ambiente, comercialización y documentación relacionadas con el manejo de OVM\nde uso agrícola, que incrementen el riesgo de liberación accidental del OVM, y\nde manera particular de aquel material con potencial reproductivo.\n\ng) Informar de manera\nobjetiva, confiable, independiente y oportuna al POGM los resultados de la\nevaluación de las operaciones con OVM. El POGM, a su vez, informará dichos resultados\na las entidades sujetas de auditoría en bioseguridad agrícola. Esta evaluación deberá\nbasarse en la pericia del auditor y realizarse con el debido cuidado\nprofesional, de modo que permita diagnosticar con seguridad razonable la\nefectividad de las medidas de valoración de los riesgos en bioseguridad\nagrícola y su control.\n\n Ficha Artículo 12\n\nArtículo 13.- Cuando se\ntrate de la importación o movilización de OVM de uso agrícola, la empresa\nauditora en bioseguridad agrícola deberá:\n\na) Verificar que los OVM de\nuso agrícola, que se importen o movilicen, se encuentren debidamente\nautorizados e inscritos en el POGM.\n\nb) Verificar que la\ninformación técnica que se adjunta en la documentación que identifica a los OVM\nse consigne de conformidad con el Formulario BIO-04, establecido en el Anexo 6 del Reglamento a la Ley de Protección\nFitosanitaria, Decreto Ejecutivo Nº 26921-MAG, disponible en el sitio web\noficial del SFE: www.sfe.go.cr.\n\nc) Verificar que los OVM de\nuso agrícola se movilicen según los protocolos presentados por la entidad\nsujeta de auditoría y aprobados por el POGM en el marco del trámite del CLA correspondiente,\nasí como las medidas de bioseguridad agrícola consignadas en la resolución para\nla aprobación de cada proyecto, con el fin de administrar los riesgos de escape\naccidental del OVM durante el transporte.\n\nd) Emitir recomendaciones a\nla entidad sujeta de auditoría en bioseguridad agrícola en relación con los OVM\nde uso agrícola que no cumplan con las medidas establecidas en la resolución de\naprobación del CLA correspondiente o en la resolución de aprobación del proyecto,\naplicables a la importación o movilización del OVM, para que sean corregidas.\n\ne) Verificar que el\ncontenido y la descripción del OVM de uso agrícola indicado en la documentación\npara la importación o movilización, sea concordante con el contenido del empaque\no envase en el que se importe o movilice.\n\nf) Verificar que se\npractiquen en forma oportuna las correcciones, modificaciones o cambios de la información\ntécnica en la documentación para la importación o movilización de los OVM de\nuso agrícola, cuando así sea requerido.\n\ng) Verificar que la\ninformación técnica, consignada en la documentación para la importación o\nmovilización de los OVM de uso agrícola, coincida con la aprobada al efecto por\nel POGM.\n\n Ficha Artículo 13\n\nArtículo 14.- Cuando se\ntrate del almacenamiento o movimiento interno en el proyecto de OVM de uso\nagrícola, la empresa auditora en bioseguridad agrícola deberá:\n\na) Verificar que el OVM\npara uso agrícola importado, movilizado, confinado, liberado al ambiente,\nalmacenado o comercializado debe mantenerse en las áreas y locales\nespecificados por el POGM.\n\nb) Verificar que los OVM de\nuso agrícola se almacenen según los protocolos presentados por la entidad\nsujeta de auditoría y aprobados por el POGM en el marco del trámite del CLA correspondiente,\nasí como las medidas de bioseguridad agrícola consignadas en la resolución para\nla aprobación de cada proyecto, con el fin de evitar problemas de\ncontaminación, de identificación o salidas no autorizadas del OVM.\n\nc) Verificar que los medios\nde transporte utilizados para la movilización interna de los OVM de uso\nagrícola cumplan con los protocolos de bioseguridad específicos para cada OVM según\nel respectivo CLA, así como las medidas de bioseguridad agrícola dadas para la aprobación\nde cada proyecto.\n\n Ficha Artículo 14\n\nArtículo 15.- Cuando se\ntrate de la evaluación de bioseguridad del medio receptor donde se desarrollan\nproyectos con OVM de uso agrícola, la empresa auditora en bioseguridad agrícola\ndeberá:\n\na) Verificar que se cumplan\nlas medidas de bioseguridad en el medio receptor donde se desarrollen\nactividades con OVM de uso agrícola, establecidas en el CLA, así como las medidas\nde bioseguridad agrícola dadas para la aprobación de cada proyecto\ncorrespondiente y determinadas según la evaluación de riesgos de cada OVM.\n\n Ficha Artículo 15\n\nArtículo 16.- Cuando se\ntrate de la evaluación de la ejecución de los proyectos con OVM de uso\nagrícola, la empresa auditora en bioseguridad agrícola deberá:\n\na) Verificar que los OVM de\nuso agrícola sembrados por la entidad sujeta de auditoría en bioseguridad\nagrícola formen parte de proyectos de siembra debidamente autorizados por el POGM.\n\nb) Verificar que los\nproyectos con OVM de uso agrícola se desarrollen según los protocolos presentados\npor la entidad sujeta de auditoría en bioseguridad y aprobados por el POGM en el\nmarco del trámite del CLA correspondiente, así como las medidas de bioseguridad\nagrícola consignadas en la resolución para la aprobación de cada proyecto.\n\nc) Llevar un control\ndetallado y actualizado de los diferentes OVM de uso agrícola y sus características,\nregistrados por la entidad sujeta de auditoría en bioseguridad.\n\nd) Verificar que la\nvigencia del registro de los OVM de uso agrícola y no permitir la utilización\nde aquellos cuyo registro haya sido cancelado.\n\ne) Verificar que la entidad\nsujeta de auditoría en bioseguridad agrícola remita mensualmente al POGM el\nreporte actualizado de las operaciones con OVM de uso agrícola.\n\n Ficha Artículo 16\n\nArtículo 17.- Cuando se\ntrate de las características del OVM de uso agrícola, la empresa auditora en\nbioseguridad agrícola deberá:\n\na) Verificar que los OVM de\nuso agrícola no presenten características substancialmente diferentes a las\nenlistadas en la solicitud del CLA, ni presenten efectos no previstos en los organismos\nque entren en su contacto.\n\nb) Verificar porque solo se\nutilicen los OVM de uso agrícola que mantengan las características presentadas\npor la entidad sujeta de auditoría en bioseguridad en el marco del trámite del\nCLA correspondiente.\n\nc) Asegurarse de comunicar\nde forma inmediata al POGM, dentro de las 24 horas siguientes al imprevisto, la\ndetección de OVM de uso agrícola que no mantengan las características presentadas\npor la entidad sujeta de auditoria en bioseguridad en el marco del trámite del CLA\ncorrespondiente.\n\n Ficha Artículo 17\n\nArtículo 18.- Las empresas\nauditoras en bioseguridad agrícola no podrán ofrecer los servicios de\nauditorías a una entidad sujeta de auditoría en bioseguridad, cuando existan\nelementos que generen conflictos de intereses, según lo establecido en la\nnormativa vigente particularmente referidas a lo indicado en el Artículo 230 de\nla Ley General de la Administración Pública, Ley Nº 6227, en el Artículo 31 de\nla Reforma Integral a la Ley Orgánica del Poder Judicial, número 7333; en el\nArtículo 12 del Código Procesal Civil, Ley Nº 9342, y las \"Directrices Generales\nsobre Principios y Enunciados Éticos a observar por parte de los jerarcas,\ntitulares subordinados, funcionarios de la Contraloría General de la República,\nAuditorías Internas y servidores públicos en general\" número D-2-2004-CO.\nLo anterior es cuando un servidor pone en riesgo su independencia de criterio\nen la decisión de un determinado asunto o situación, es decir, superpone su\ninterés personal sobre el interés general que está llamado a resguardar; y no\npor los costos asociados al servicio de auditoraje.\n\n Ficha Artículo 18\n\nArtículo 19.- Toda empresa\nauditora en bioseguridad agrícola, deberá firmar con la entidad sujeta de\nauditoría en bioseguridad agrícola el formulario denominado Declaración de no conflicto\nde interés, disponible en el sitio web oficial del SFE: www.sfe.go.cr y en\nel Anexo 2 de este reglamento del cual se deberá aportar copia al POGM para su\ncustodia.\n\n Ficha Artículo 19\n\nArtículo 20.- A fin de\nproteger la objetividad e independencia como característica fundamental para la\ngestión profesional, queda prohibido a las empresas auditoras en bioseguridad\nagrícola, la ejecución de otras labores profesionales o administrativas para\nlas empresas sujetas de auditoría en bioseguridad agrícola diferentes a la\nrealización de las auditorías contempladas en este reglamento. Sólo se podrá\nexceptuar de esta prohibición, la realización de actividades de capacitación a\nfuncionarios de la entidad sujeta de auditoria en bioseguridad agrícola en\ntemas relacionados a este concepto.\n\n Ficha Artículo 20\n\nArtículo 21.- En caso de\nrenuncia de la empresa auditora en bioseguridad agrícola o del auditor en\nbioseguridad agrícola, la persona interesada deberá notificar formalmente al POGM.\nUna vez recibida dicha comunicación, el POGM elaborará la resolución administrativa\ncorrespondiente mediante la cual se tendrá por acogida la renuncia comunicada\ny, cuando corresponda, se procederá a cancelar la autorización para el ejercicio\nde las funciones de auditoría en bioseguridad agrícola. Dicho acto deberá ser\ncomunicado a la persona interesada a través del medio de comunicación que esta\nhaya señalado en la solicitud. Contra el acto de la resolución administrativa\ncaben los recursos ordinarios de revocatoria y de apelación, de acuerdo con lo\nestablecido en los artículos 342 y 343 de la Ley General de la Administración\nPública, Ley Nº 6227 del 2 de mayo de 1978\n\n Ficha Artículo 21\n\nSección Tercera:\n\nDe las funciones y\nresponsabilidades de las entidades sujetas de auditoría en\n\nbioseguridad agrícola:\n\nArtículo 22.- Toda entidad\nsujeta de auditoría en bioseguridad agrícola, deberá enviar al POGM, durante\nlos primeros 10 días hábiles de cada mes, un informe mensual sobre los datos correspondientes\na las actividades de importación y arribo, movilización, siembra, procesamiento,\nalmacenamiento, comercialización y exportación. Sin perjuicio de lo anterior, el\nPOGM podrá requerir información complementaria o específica, según se considere\nnecesaria, para el adecuado seguimiento y análisis técnico del proyecto. El\ncumplimiento del envío del informe será revisado periódicamente por la empresa\nauditora en bioseguridad agrícola y por el POGM.\n\n Ficha Artículo 22\n\nArtículo 23.- Las\ndisposiciones emitidas por el POGM en materia de bioseguridad de los OVM de uso\nen la agricultura serán de acatamiento obligatorio para las entidades sujetas\nde auditoría en bioseguridad agrícola.\n\n Ficha Artículo 23\n\nArtículo 24.- Toda entidad\nsujeta de auditoría en bíoseguridad agrícola deberá archivar de manera ordenada,\nutilizando medios físicos o digitales, los documentos atinentes a la actividad,\ntales como comprobantes de importación de OVM, informes de auditoría en bioseguridad\nagrícola, documentos internos de cumplimiento y verificación de la aplicación de\nlas medidas de bioseguridad agrícola, que permitan brindar seguridad razonable\nde la eficacia en la administración de los riesgos en bioseguridad asociados al\nuso y manejo de los OVM. Así mismo, debe garantizarse su oportuna\ndisponibilidad y acceso para verificación y consulta por parte de los\nfuncionarios del POGM y la persona auditora en bioseguridad agrícola, cuando\nestos lo soliciten.\n\n Ficha Artículo 24\n\nArtículo 25.- Las\ndisposiciones emitidas por la empresa auditora en bioseguridad agrícola serán\nde acatamiento obligatorio para la entidad sujeta de auditoría en bioseguridad agrícola, una vez que hayan sido avaladas por\nel POGM.\n\n Ficha Artículo 25\n\nArtículo 26.- La entidad\nsujeta de auditoría en bioseguridad agrícola deberá brindar la colaboración\nrequerida para que los funcionarios del POGM y las personas auditoras en bioseguridad\nagrícola realicen la labor que les corresponde. Asimismo, estará en la obligación\nde mostrar los documentos probatorios del cumplimiento de las medidas de bioseguridad\nestablecidas en el CLA o en la resolución administrativa de autorización de proyectos\ncon OVM de uso agrícola, y de suministrar la información que dichos\nfuncionarios requieran para la verificación, análisis y control del\ncumplimiento del Decreto Ejecutivo Nº 26921-MAG, Reglamento a la Ley de\nProtección Fitosanitaria en materia de bioseguridad de los OVM.\n\n Ficha Artículo 26\n\nArtículo 27.- Cuando una\nentidad sujeta de auditoría en bioseguridad agrícola, por cualquier motivo,\ncierre las actividades con OVM de uso agrícola, deberá comunicarlo por escrito\nal POGM en un periodo máximo de 30 días naturales a partir del cierre, para que\nse deje sin efecto su inscripción oficial. Asimismo, el POGM podrá verificar de\noficio el cierre de las actividades con OVM de uso agrícola, mediante visitas\nno anunciadas a las entidades sujetas de auditoría en bioseguridad agrícola.\nUna vez verificado el cierre de las actividades, el POGM elaborará la\nresolución administrativa correspondiente, pudiendo establecer en ella un\nperíodo de monitoreo cuyas condiciones serán definidas según el análisis de\nriesgos de bioseguridad agrícola del OVM involucrado.\n\nContra el acto de la\nresolución administrativa caben los recursos ordinarios de revocatoria y de\napelación, de acuerdo con lo establecido en los artículos 342 y 343 de la Ley\nGeneral de la Administración Pública, Ley Nº 6227 del 2 de mayo de 1978.\n\n Ficha Artículo 27\n\nCAPÍTULO IV\n\nDe los informes de\nAuditoría en Bioseguridad Agrícola\n\nSección única\n\nArtículo 28.- Toda empresa\nauditora en bioseguridad agrícola deberá elaborar, durante los primeros 10 días\nhábiles de cada mes, un informe de las labores de auditoría en bioseguridad agrícola\nrealizadas el mes anterior sobre las actividades o proyectos con OVM bajo su auditoría.\nDicho informe deberá incluir el detalle de la información relevante relacionada\ncon el manejo de la bioseguridad, el comportamiento de las características del\nOVM, los eventuales riesgos de bioseguridad detectados durante el desarrollo de\nlas actividades o del proyecto, los hallazgos identificados durante la\nauditoría y, cuando corresponda, recomendaciones para el fortalecimiento de las\nmedidas de bioseguridad. Los mecanismos físicos o electrónicos para la\ncomunicación de estos informes serán establecidos por el POGM.\n\n Ficha Artículo 28\n\nArtículo 29.- El informe de\nauditorías en bioseguridad agrícola debe contener al menos las siguientes\nsecciones:\n\na) Introducción.\n\nb) Resumen ejecutivo del\nproyecto: breve descripción del estado del proyecto en términos de su\nextensión, estado fenológico o etapa de ejecución.\n\nc) Descripción del\nproyecto: incluir un marco de referencia del proyecto, indicando el evento y\nsus características, el correspondiente CLA o la resolución para la\nautorización del proyecto, el área aprobada, la ubicación y los lotes\ninvolucrados, así como una breve descripción de la finalidad o los objetivos\ndel proyecto. En los informes mensuales posteriores, bastará con reportar\núnicamente los cambios o novedades relevantes respecto a esta información.\n\nd) Alcance: descripción de\nlos objetivos de la auditoría del periodo, las actividades realizadas para\nevaluar el proyecto y las operaciones con OVM, así como cualquier limitación\nque haya podido afectar la ejecución de la auditoria.\n\ne) Desarrollo: descripción\ndetallada de los procesos y actividades ejecutadas durante la auditoría, en\nfunción del alcance definido para el periodo, indicando cómo se aplicaron las medidas\nde bioseguridad en las distintas etapas del proyecto y cualquier situación\nrelevante observada.\n\nf) Hallazgos: resultados\nobtenidos durante la ejecución del proceso de auditoría, documentados técnica y\ndocumentalmente, en función del alcance definido para el periodo de la\nauditoría.\n\ng) Conclusiones: análisis\nde los hallazgos, indicando qué medidas de bioseguridad o normas se han visto\nafectadas y las posibles consecuencias sobre las buenas prácticas de\nbioseguridad del proyecto.\n\nh) Recomendaciones:\nsugerencias, cuando sean necesarias, de carácter constructivo basadas en los\nhallazgos detectados durante la auditoria, orientadas a la implementación de\nsoluciones prácticas o mejoras efectivas en las medidas de bioseguridad del\nproyecto.\n\ni) Monitoreo post\nproyectos: reporte de las actividades y resultados de inspección, seguimiento y\natención de las áreas autorizadas en las que se desarrollaron proyectos con OVM,\nincluyendo aquellas que se encuentren en descanso, cuando corresponda.\n\nj) Seguimiento a\nrecomendaciones o consultas: revisión y verificación por parte de la persona auditora\ndel cumplimiento de las recomendaciones o consultas previamente emitidas por el\nPOGM o aquellas emitidas por la propia persona auditora y avaladas por el POGM.\n\nK) Las secciones indicadas\nen el presente artículo constituyen el contenido mínimo del informe. Sin\nperjuicio de lo anterior, el POGM mediante criterio técnico debidamente fundamentado,\npodrá requerir la incorporación de información o secciones adicionales cuando\nlas características del proyecto, las condiciones de bioseguridad o el alcance\nde la auditoría así lo justifiquen.\n\n Ficha Artículo 29\n\nArtículo 30.- En caso de\nque el POGM lo solicite por medio de una nota de aclaración, enviada a través\ndel medio de comunicación señalado en la solicitud, es obligación de la empresa\nauditora en bioseguridad agrícola, que emite el informe de auditoría en\nbioseguridad agrícola, ampliar la información, aclarar o sustentar los\ncriterios emitidos y evacuar dudas sobre los hallazgos determinados en el\ninforme, para lo cual, la empresa auditora dispondrá para responder un plazo de\n10 días hábiles posterior a la solicitud de ampliación o aclaración emitida por\nel POGM. Este plazo podrá prorrogarse por 10 días hábiles adicionales y por una\núnica vez mediante una solicitud de la persona interesada debidamente\njustificada, la cual debe presentarse dentro del plazo otorgado inicialmente.\n\n Ficha Artículo 30\n\nArtículo 31.- Vencido el\nplazo de 10 días hábiles, o el plazo de la prórroga, otorgado a la persona\ninteresada, si el POGM verifica que los incumplimientos o inconsistencias\noriginales no fueron subsanados por parte de la persona interesada en su\ntotalidad, podrá iniciar un proceso administrativo de acuerdo con lo\nestablecido en el Capítulo VI de las sanciones administrativas del presente\nreglamento.\n\n Ficha Artículo 31\n\nArtículo 32.- La empresa\nauditora en bioseguridad agrícola enviará el informe mensual de auditoría en\nbioseguridad agrícola al POGM. Una vez notificada la aprobación del informe por\nparte del POGM, la empresa auditora en bioseguridad agrícola deberá remitirlo\nde forma digital conforme a la siguiente distribución:\n\na) Una copia del informe\nrevisado y autorizado quedará custodiada por el POGM como informe oficial.\n\nb) Una copia deberá ser\nentregada por la empresa auditora en bioseguridad al representante técnico o\nlegal de la entidad sujeta de auditoría en bioseguridad agrícola.\n\nc) Una copia será para el\nrespaldo de la empresa auditora en bioseguridad agrícola que ha desarrollado el\ninforme.\n\n Ficha Artículo 32\n\nCAPÍTULO V\n\nDe las restricciones en la\nprestación de los servicios de auditoría en bioseguridad\n\nagrícola\n\nSección única\n\nArtículo 33.- Las empresas\nauditoras en bioseguridad agrícola deberán abstenerse de ofrecer los servicios\nde auditorías en bioseguridad a las entidades sujetas de auditorías que estén\nen posición de conflicto de interés, de forma que se preserve la objetividad de\nla labor de auditoría en bioseguridad agrícola. Entiéndase conflicto de interés\nsegún lo indicado en el artículo 18 de la presente norma, esto es, cuando un\nservidor pone en riesgo su independencia de criterio en la decisión de un\ndeterminado asunto o situación, es decir, superpone su interés personal sobre\nel interés general que está llamado a resguardar; y no por los costos asociados\nal servicio de auditoraje.\n\n Ficha Artículo 33\n\nCAPÍTULO VI\n\nDe las sanciones\nadministrativas\n\nSección única\n\nArtículo 34.- El POGM podrá\ncancelar, en cualquier momento, la autorización para el ejercicio de las\nfunciones de auditoría en bioseguridad agrícola de una persona física que asuma\nla responsabilidad de brindar dicho servicio, de conformidad con lo establecido\nen el inciso a) del artículo 8 de este reglamento.\n\nEn tales casos, el POGM\nemitirá un apercibimiento a la persona auditora en bioseguridad agrícola, a\ntravés del medio de comunicación que esta haya señalado en la solicitud de inscripción\ncomo empresa auditora, ante la ocurrencia de cualquiera de dichas acciones u omisiones.\nLa persona auditora deberá subsanar los incumplimientos señalados e incorporar,\nde manera verificable, las evidencias de cumplimiento en el informe de auditoría\nen bioseguridad correspondiente al mes en curso, cuando el apercibimiento se\nhaya realizado dentro de los primeros diez días naturales del mes; en caso\ncontrario, el cumplimiento deberá reflejarse, a más tardar, en el informe de\nauditoría en bioseguridad del mes siguiente.\n\nLa persona auditora en\nbioseguridad agrícola apercibida podrá solicitar, por una única vez y de forma\ndebidamente justificada, una prórroga para subsanar los incumplimientos\nseñalados en el apercibimiento, mediante la remisión al POGM de una nota\nfirmada digitalmente, la cual deberá presentarse dentro del plazo originalmente\notorgado. El POGM podrá autorizar dicha prórroga, siempre que esta no exceda el\ntiempo de presentación del informe mensual de auditoria inmediatamente\nposterior al periodo de subsane original. La persona auditora tendrá este nuevo\nplazo para integrar las evidencias verificables de cumplimiento correspondientes.\n\nEn caso de que la respuesta\no las acciones de corrección derivadas del apercibimiento no resulten\nsatisfactorias o generen dudas al POGM, este remitirá a la persona auditora en bioseguridad\nagrícola una nota de aclaración, a fin de requerir las correcciones correspondientes\ny asegurar la debida subsanación de la situación. Para tal efecto, la persona auditora\ndispondrá de 10 días hábiles para atender lo solicitado, debiendo remitir\nnuevamente el informe de bioseguridad agrícola con la información requerida.\n\nEn caso de no subsanarse,\nen tiempo y forma, la situación consignada en el apercibimiento, el POGM\nprocederá a la cancelación del ejercicio de las funciones de auditoria en bioseguridad\nagrícola de la persona auditora.\n\n Ficha Artículo 34\n\nArtículo 35.- El POGM podrá\ninhabilitar o cancelar, en cualquier momento, la autorización para el ejercicio\nde las funciones de auditoria en bioseguridad agrícola de una empresa que asuma\nla responsabilidad de brindar dicho servicio, así como de sus auditores en\nbioseguridad agrícola contratados para tal fin, de conformidad con lo\nestablecido en los incisos b) y c) del artículo 8 de este reglamento,\nrespectivamente. Ambas medidas podrán gestionarse de oficio o a solicitud de\nparte, y su aplicación procederá una vez comprobada la incursión en las faltas previstas\nen dichos incisos.\n\n Ficha Artículo 35\n\nArtículo 36.- Cada vez que\nse realicen inhabilitaciones o cancelaciones para el ejercicio de la función de\nauditorías en bioseguridad agrícola, el POGM deberá comunicar la decisión mediante\nresolución administrativa a la empresa que asuma la responsabilidad de brindar dicho\nservicio, así como a sus auditores en bioseguridad agrícola contratados para\ntal fin. La resolución administrativa se comunicará a la persona interesada a\ntravés del medio de comunicación que esta haya señalado en la solicitud de\ninscripción como empresa auditora en bioseguridad agrícola. Contra el acto de\nla resolución administrativa caben los recursos ordinarios de revocatoria y de\napelación, de acuerdo con lo establecido en los artículos 342 y 343 de la la\nLey General de la Administración Pública, Ley Nº 6227 del 2 de mayo de 1978\n\n Ficha Artículo 36\n\nArtículo 37.- Cada vez que\nse disponga la inhabilitación o cancelación para el ejercicio de la función de\nauditorías en bioseguridad agrícola, el POGM comunicará, a través del medio de comunicación\nseñalado en el formulario de registro de personas físicas o jurídicas que\ndesean utilizar organismos producto de la biotecnología moderna, establecido en\nel artículo 119 del Reglamento a la Ley de Protección Fitosanitaria, Decreto\nEjecutivo Nº 26921-MAG, a la entidad sujeta a auditorías en bioseguridad, las\nconsideraciones y alcances del respectivo acto administrativo.\n\nEn tales casos, el POGM\nestablecerá, mediante dicha comunicación, un período de monitoreo transitorio y\nexcepcional, el cual será realizado por funcionarios del POGM por un plazo no mayor\na seis meses, contados a partir de la notificación. Este monitoreo abarcará los\nproyectos con OVM en ejecución dentro de la entidad sujeta a auditoría en\nbioseguridad agrícola. Asimismo, el POGM definirá las condiciones de dicho\nmonitoreo, a fin de que la entidad pueda gestionar, durante este período, la\ncontratación de los servicios de otra empresa auditora.\n\nLa entidad sujeta a\nauditoría en bioseguridad agrícola podrá solicitar, por única vez y de forma\ndebidamente justificada, una prórroga del período de monitoreo transitorio y excepcional.\nPara ello, deberá remitir al POGM una nota firmada digitalmente dentro del plazo\noriginalmente otorgado. El POGM podrá autorizar dicha prórroga, siempre que no exceda\nlos tres meses a partir de su aprobación. Durante este plazo adicional, la\nentidad deberá gestionar la contratación de los servicios de otra empresa\nauditora.\n\nAsimismo, de conformidad\ncon lo dispuesto en los artículos 118, 123 y 129 del Reglamento a la Ley de\nProtección Fitosanitaria, Decreto Ejecutivo Nº 26921-MAG, contar con servicios de\nauditoría en bioseguridad agrícola constituye un requisito indispensable para\nla ejecución de proyectos de siembra y la importación de OVM de uso agrícola.\n\nEn caso de que la entidad\nsujeta a auditoría no disponga de dichos servicios, quedará inhabilitada para\ngestionar autorizaciones de importación de semilla y la inscripción de nuevos\nproyectos de siembra ante el POGM, hasta que la situación sea formalmente regularizada.\nLo anterior se aplicará sin perjuicio de lo dispuesto en el inciso a) del\nartículo 130, así como en los incisos b) y c) del artículo 134 del Reglamento a\nla Ley de Protección Fitosanitaria, Decreto Ejecutivo Nº 26921-MAG.\n\n Ficha Artículo 37\n\nArtículo 38.- La aplicación\nde las sanciones administrativas contempladas en los artículos 34 y 35 de este\nreglamento, no impide la aplicación de lo señalado en el inciso 3 del Artículo 256\ndel Reglamento a la Ley de Protección Fitosanitaria, Decreto Ejecutivo Nº\n26921-MAG.\n\n Ficha Artículo 38\n\nCAPÍTULO VII\n\nDisposiciones finales\n\nSección única\n\nArtículo 39.- Refórmese el inciso a del\nartículo 123 del Decreto Ejecutivo Nº 26921-MAG: Reglamento a la Ley de\nProtección Fitosanitaria, del 20 de marzo de 1998, para que se lea de la\nsiguiente manera:\n\n\"a. Alcance.\n\nEl SFE será el ente\nresponsable para ejecutar el registro, inspección y seguimiento de los proyectos\nde siembra, reproducción, mantenimiento, investigación, experimentación o comercialización\nde los OVM para uso agrícola, tanto en uso confinado como para liberación al\nambiente, para tales fines, tendrá acceso a todas las áreas e instalaciones en\nque se desarrollen actividades con los mismos, en el momento que así lo\nconsidere necesario.\n\nAsí mismo, el SFE regulará\nlas auditorías en bioseguridad agrícola, las cuales coadyuvarán en el\ndiagnóstico del cumplimiento, por parte de la persona física o jurídica a la\nque se le haya autorizado algún proyecto, de las medidas de bioseguridad\naplicadas en las operaciones con los OVM para uso agrícola, así como de las\ndirectrices emitidas por el SFE y de las buenas prácticas en materia de\nbioseguridad establecidas en la evaluación de riesgos.\n\n Ficha Artículo 39\n\nArtículo 40.- Deróguese el\nDecreto Ejecutivo Nº 32486-MAG, denominado Reglamento de Auditorías en\nBioseguridad Agrícola del Ministerio de Agricultura y Ganadería, del 20 de junio\ndel 2005, publicado en la Gaceta Nº142 del 22 de julio del 2005.\n\n Ficha Artículo 40\n\nTRANSITORIO I: Se establece un plazo de seis meses a partir de la publicación del\npresente Decreto Ejecutivo para que el POGM implemente sus disposiciones,\ndurante ese lapso las empresas auditoras en bioseguridad agrícola que se\nencuentren ejerciendo la función de auditorías en bioseguridad agrícola y las\nentidades sujetas de auditorías en bioseguridad agrícola, que al momento de\nentrada en vigencia de la presente norma cuenten con proyectos en ejecución con\nOVM de uso agrícola, podrán seguir utilizando los procedimientos y formularios\nestablecidos en el Decreto Ejecutivo Nº 32486-MAG, denominado Reglamento de\nAuditorías en Bioseguridad Agrícola del Ministerio de Agricultura y Ganadería,\npublicado en la Gaceta Nº 142 del 22 de julio del 2005.\n\n Ficha Artículo 1 Transitorio\n\nArtículo 41. - Rige a\npartir de su publicación en el Diario Oficial La Gaceta.\n\nDado en la Presidencia de\nla República, a los veintitrés días del mes de abril del dos mil veintiséis.",

The Ley de Protección Fitosanitaria Nº 7664, pursuant to Chapter IV, Section II, authorizes the State Phytosanitary Service (Servicio Fitosanitario del Estado, SFE) to carry out phytosanitary regulation of organisms or products derived from biotechnology.\n\nII. The Approval of the Cartagena Protocol on Biosafety to the Convention on Biological Diversity, Law Nº 8537, establishes in its Article 16 the requirements for Risk Management of living modified organisms (organismos vivos modificados, OVM), under which adequate mechanisms, measures, and strategies must be established and maintained to regulate, manage, and control the risks identified pursuant to the risk assessment provisions relating to the use, handling, and transboundary movement of OVM.\n\nIII. The Reglamento de Auditorías en Bioseguridad Agrícola of the Ministerio de Agricultura y Ganadería, Nº 32486, published in La Gaceta Nº 142 of July 22, 2005, presented limitations with respect to the use of definitions already superseded by science and technology, the definition of the SFE's own organizational structure, the conceptualization of the responsibilities of the different actors participating in the inspection and supervision of activities related to OVM, and the incorporation of tools to safeguard the independence and impartiality of those providing the agricultural biosafety audit (auditoría en bioseguridad agrícola) service, thereby creating gaps in the scope and application of the rules established therein.\n\nIV. The SFE, as the body responsible for the regulation and control of activities related to OVM, considers it necessary to implement a comprehensive overhaul of the regulatory framework contained in Decree Nº 32486, which would permit a new definition of the technical, functional, and regulatory framework essential to the exercise of regulation and risk management associated with the import, export, research, experimentation, transport, multiplication, industrial production, commercialization, and use of OVM for agricultural purposes, in accordance with new knowledge in agricultural biosafety (bioseguridad agrícola), the current organizational structure of the SFE, the analytical and management tools of agricultural biosafety audit practice, and the incorporation of rules that clearly regulate the functions and responsibilities of the participants in the processes of environmental release (liberación al ambiente) of OVM.\n\nV. In accordance with Article 4 of the Ley de Protección al Ciudadano del Exceso de Trámites y Requisitos Administrativos, Ley Nº 8220 of March 4, 2002, every procedure or administrative requirement that a regulated party must fulfill must be set forth in a law, a decree, or a regulation and must be published in the official gazette La Gaceta.\n\nVI. In accordance with Article 361 of the Ley General de la Administración Pública, Ley Nº 6227 of May 2, 1978, a public consultation on this proposed Executive Decree was carried out from August 14, 2024, to August 28, 2024, and as a result, all observations received were addressed and incorporated into the text.\n\nVII. In accordance with Article 12 of Executive Decree Nº 37045 of February 22, 2012, and its amendment, the \"Reglamento a la Ley de Protección al Ciudadano del Exceso de Trámites y Requisitos Administrativos,\" this regulation complies with the principles of regulatory improvement, as established in Report Nº DMR-DAR-INF-080-2025 issued by the Dirección de Mejora Regulatoria y Reglamentación Técnica of the Ministerio de Economía, Industria y Comercio.\n\nPor tanto:\n\nHEREBY DECREE\n\nREGULATIONS ON AGRICULTURAL BIOSAFETY AUDITS OF THE MINISTERIO DE AGRICULTURA Y GANADERÍA; AMENDMENT OF SUBPARAGRAPH A) OF ARTICLE 123 OF EXECUTIVE DECREE Nº 26921-MAG: REGLAMENTO A LA LEY DE PROTECCIÓN FITOSANITARIA AND REPEAL OF EXECUTIVE DECREE Nº 32486-MAG: REGLAMENTO DE AUDITORÍAS EN BIOSEGURIDAD AGRÍCOLA DEL MINISTERIO DE AGRICULTURA Y GANADERÍA\n\nCHAPTER I\n\nPurpose and Definitions\n\nSole Section\n\nArticle 1. The purpose of these Regulations is to govern the relationships and obligations between the Ministerio de Agricultura y Ganadería, acting through the SFE as the competent body for the regulation and control of activities involving living modified organisms used in agriculture, the entities subject to agricultural biosafety audits, and the auditing firms responsible for carrying them out.\n\nArticle 1 Record\n\nArticle 2. For the purposes of these Regulations, the following definitions shall apply:\n\na) Agricultural biosafety auditor (Auditor en bioseguridad agrícola): a professional in agricultural or biological sciences with competence in the areas of biotechnology or biosafety who assumes responsibility for verifying, advising, recommending, reporting on, and warning, by means of objective techniques of analysis, diagnosis, and communication, and on the basis of independence and impartiality of judgment, the compliance by the entity subject to agricultural biosafety audit with the measures applied in operations involving OVM for agricultural use.\n\nb) Biosafety of living modified organisms (Bioseguridad de los organismos vivos modificados): the rules, measures, and actions required to ensure an adequate level of protection in the transfer, handling, and safe use of OVM resulting from modern biotechnology (biotecnología moderna) that may have adverse effects on the conservation and sustainable use of biological diversity, taking into account risks to human health as well. It encompasses the following phases: contained use (uso confinado), intentional environmental release, and commercialization of OVM for agricultural use. For the purposes of these Regulations, agricultural biosafety shall be understood as the biosafety of living modified organisms for use in agriculture.\n\nc) Modern biotechnology: refers to the application of:\n\n1. In vitro nucleic acid techniques, including recombinant deoxyribonucleic acid and the direct injection of nucleic acid into cells or organelles, or\n\n2. Cell fusion beyond taxonomic family boundaries, overcoming the natural physiological barriers to reproduction or recombination, which are not techniques used in traditional breeding and selection.\n\nd) Certificate of environmental release, contained use, and commercialization (Certificado de liberación al ambiente, uso confinado y comercialización): a document resulting from the risk assessment (evaluación de riesgos) for a specific transformation event, issued to a natural or legal person wishing to import, transport, use under confinement, release into the environment, or commercialize OVM for agricultural use, in which the biosafety measures established in the risk assessment are included.\n\ne) Agricultural biosafety auditing firm (Empresa auditora en bioseguridad agrícola): a legal entity that assumes responsibility for providing the agricultural biosafety audit service for activities related to OVM to entities subject to audit, through the hiring of agricultural biosafety auditors. It may also be a natural person who directly assumes such responsibility by providing professional services as an agricultural biosafety auditor.\n\nf) Entity subject to agricultural biosafety audit (Entidad sujeta de auditoría en bioseguridad agrícola): any natural or legal person that imports, transports, uses under confinement, releases into the environment, or commercializes OVM used in agriculture, whether produced within or outside the country. Excluded are teaching and research activities carried out by state university-level higher-education institutions in laboratories and greenhouses, by virtue of their autonomy, provided that such activities do not involve commercial purposes or research conducted outside contained use.\n\ng) Disqualification (Inhabilitar): to temporarily prohibit, by administrative act, a natural or legal person from performing functions in agricultural biosafety before any entity subject to these Regulations.\n\nh) Environmental release (Liberación al ambiente): the use of an OVM for agricultural purposes outside the boundaries of a physical containment that effectively limits its contact with or effects on the external environment, such as an enclosed facility, laboratory, bioreactor, or any other closed structure. All such activities are carried out under the biosafety conditions established in the risk assessment.\n\ni) Receiving environment (Medio receptor): a plot of land, premises, facility, or any other specific site that involves the handling and use of organisms derived from modern biotechnology.\n\nj) Living modified organism (Organismo vivo modificado): any living organism that possesses a novel combination of genetic material obtained through the application of modern biotechnology. This encompasses what is referred to as: \"altered or manipulated organism,\" \"transgenic organism,\" \"transgenic material,\" \"transgenic plants,\" or \"manipulated or transgenic product.\"\n\nk) Agricultural biosafety risk (Riesgo en bioseguridad agrícola): the possible adverse effects of OVM for agricultural use, based on the probability of occurrence and the consequences of such effects, on the conservation and sustainable use of biological diversity in the probable receiving environment, taking into account risks to agriculture and to human and animal health as well.\n\nl) Programa de Organismos Genéticamente Modificados: the division attached to the SFE, responsible for authorizing the use of OVM for agricultural purposes, carrying out follow-up through inspections, and issuing recommendations and biosafety measures.\n\nm) Contained use (Uso confinado): any operation carried out within a premises, facility, or other physical structure, involving the handling of organisms derived from modern biotechnology and controlled by specific measures that effectively limit their contact with or effects on the external environment.\n\nArticle 2 Record\n\nArticle 3. For the purposes of these Regulations, the following abbreviations shall apply:\n\nCCSS: Caja Costarricense del Seguro Social.\n\nCLA: Certificado de liberación al ambiente, uso confinado y comercialización.\n\nMAG: Ministerio de Agricultura y Ganadería.\n\nOVM: Organismo vivo modificado.\n\nPOGM: Programa de Organismos Genéticamente Modificados.\n\nSFE: Servicio Fitosanitario del Estado.\n\nUPE: Unidad de Programas Especiales.\n\nArticle 3 Record\n\nCHAPTER II\n\nApproval of Registrations or Updates of Agricultural Biosafety Auditing Firms\n\nSole Section\n\nArticle 4. Any natural or legal person wishing to offer agricultural biosafety audit services must be registered with the SFE. The SFE shall maintain an updated registry of all agricultural biosafety auditing firms registered to conduct audits, available on its website: www.sfe.go.cr.\n\nArticle 4 Record\n\nArticle 5. Requirements for applications to register or update agricultural biosafety auditing firms. To complete the procedure, the interested party must:\n\n1. Submit digitally to the POGM the application set out in Anexo I of these Regulations, which consists of the registration or update form for agricultural biosafety auditing firms, providing, by way of sworn statement (declaración jurada), information on the personal particulars, legal representation, contact details, and credentials (atestados) of the interested party; for cases involving the registration or update of legal entities, the interested party must also provide information on the personal particulars, contact details, and credentials of the candidate agricultural biosafety auditor or auditors.\n\n2. Submit a digital copy of the curriculum vitae of the candidate agricultural biosafety auditor or auditors.\n\n3. Be current in compliance with Article 74 of Law Nº 17: Ley Constitutiva de la Caja Costarricense del Seguro Social, of October 22, 1943.\n\nThis requirement shall be verified internally by the SFE through the CCSS's systems.\n\nArticle 5 Record\n\nArticle 6. Applications to register or update agricultural biosafety auditing firms.\n\na. Submission of the application\n\nTo apply for the registration or update of an agricultural biosafety auditing firm, the interested party must submit digitally to the POGM the registration or update form for agricultural biosafety auditing firms, digitally signed, available on the SFE's official website: www.sfe.go.cr and in Anexo 1 of these Regulations, providing, by way of sworn statement, information on the personal particulars, legal representation, contact details, and credentials of the interested party, as well as the personal particulars, contact details, and credentials of the candidate agricultural biosafety auditor or auditors.\n\nb. Admissibility\n\nThe information provided by the interested party on the registration or update form for agricultural biosafety auditing firms shall be subject to an admissibility review (revisión de admisibilidad), for which purpose the POGM shall verify that, together with the application, the interested party has provided all of the information required in the aforementioned form. For this purpose, the admissibility review of the application must be completed within the following 10 calendar days from its submission. Applications that do not pass the admissibility review before the POGM shall not be permitted to proceed to substantive review.\n\nc. Single notice of deficiency\n\nThe POGM may, on a single occasion, issue a notice of deficiency (prevención única) to the interested party, through the means of communication indicated in the application, requesting submission of any missing document or the correction of any requirement relating to the application, granting for this purpose a period of 30 business days to comply with the matters identified in the notice; this period may be extended by an additional 30 business days on a single occasion, upon a duly justified request from the interested party, which must be submitted within the initially granted period. Such notice shall be issued by means of a duly reasoned administrative act.\n\nd. Archiving of the proceeding at the admissibility stage\n\nUpon expiration of the period granted to the interested party under the preceding subparagraph, if the POGM determines that the original deficiencies or inconsistencies have not been fully remedied by the interested party, it may order the definitive archiving of the proceeding, an act that must be communicated to the interested party by means of an administrative ruling (resolución administrativa) through the means of communication indicated in the application. The ordinary remedies of reconsideration (revocatoria) and appeal (apelación) are available against the administrative ruling, in accordance with Articles 342 and 343 of the Ley General de la Administración Pública, Ley Nº 6227 of May 2, 1978.\n\ne. Review\n\nOnce the complete documentation has been received, the POGM shall carry out a review of the credentials, competencies, knowledge, and experience of each candidate agricultural biosafety auditor and shall issue an approval or rejection decision with respect to each candidacy. The POGM shall have 20 calendar days to carry out the review of the information submitted in connection with the application for registration or update of agricultural biosafety auditors.\n\nf. Ruling\n\nOnce the registration or update application for an agricultural biosafety auditing firm has been reviewed, the POGM shall notify the interested party within 10 calendar days, by means of an administrative ruling, through the means of communication indicated in the application, of the outcome of the registration or update application to offer agricultural biosafety audit services, as well as the considerations on which such decision is based.\n\ng. Induction workshop for agricultural biosafety auditors\n\nIf the registration application is approved, the POGM shall indicate to the interested natural or legal person, in the administrative ruling, that the registered auditor candidates must participate in the induction workshop (taller de inducción) for agricultural biosafety auditors. The POGM shall be the entity responsible for coordinating the implementation of such workshops and, based on its technical judgment, shall define the content to be covered in them. The date, time, format, and duration of the induction workshops shall be set by the POGM and published on the SFE's official website: www.sfe.go.cr. From the date of notification of the administrative ruling, the POGM shall have a period of 90 calendar days within which to hold the induction workshop for agricultural biosafety auditors. Registered auditors must participate at least once every two years in this workshop as a mechanism for continuing professional development.\n\nIf the registered auditor candidates fail to attend the induction workshop for agricultural biosafety auditors previously coordinated by the POGM, they may not carry out agricultural biosafety audit activities until they have participated in said workshop. The POGM shall communicate this situation to the interested natural or legal person by official communication (oficio), through the means of communication indicated in the application.\n\nAgricultural biosafety auditors who need to renew their participation in the induction workshop for agricultural biosafety auditors must request to do so at least 90 days before the expiration of their previous participation. Likewise, those who have not previously done so must request their participation in said workshop. Both cases must be managed before the POGM by means of a digitally signed note. The POGM shall have a maximum period of 10 business days to communicate, by official communication, the authorization to participate in a future workshop coordinated by the POGM.\n\nh. Issuance and delivery of the certificate\n\nOnce the induction workshop for agricultural biosafety auditors has concluded, the POGM shall issue, in digital format, a certificate authorizing the auditor to carry out the agricultural biosafety audit activity contemplated in these Regulations. The POGM shall have a maximum period of 10 calendar days to notify the certificate to the interested party, through the means of communication indicated in the application. To this end, the auditor must provide an acknowledgment of receipt (acuse de recibo) of the certificate.\n\ni. Total time limit for the registration or update procedure for natural or legal persons wishing to offer their services as agricultural biosafety auditors\n\nThe maximum time limit for processing these applications shall be 145 calendar days. If additional information is requested from the interested party, the period within which the POGM must resolve the application shall be suspended.\n\nj. Validity\n\nThe registration of natural or legal persons wishing to offer services as agricultural biosafety auditors shall be of indefinite validity. Nevertheless, registered auditors must participate at least once every two years in the induction workshop for agricultural biosafety auditors as a mechanism for continuing professional development. Compliance with this provision shall be required in order to remain authorized to carry out agricultural biosafety audit activities.\n\nArticle 6 Record\n\nCHAPTER III\n\nFunctions and Responsibilities\n\nFirst Section:\n\nFunctions and Responsibilities of the POGM:\n\nArticle 7. The POGM shall be responsible for the management and supervision of agricultural biosafety audits, with the aim of strengthening the phytosanitary regulation of OVM for agricultural use and the management of risks associated with their import, transport, contained use, environmental release, or commercialization.\n\nThe administrative provisions and measures issued by the POGM in the exercise of its functions and responsibilities in the area of agricultural biosafety audits shall be mandatory for agricultural biosafety auditing firms and for entities subject to agricultural biosafety audit.\n\nArticle 7 Record\n\nArticle 8. The POGM may, at any time, disqualify or cancel the authorization for the exercise of agricultural biosafety audit functions of a firm assuming responsibility for providing such services, as well as of its agricultural biosafety auditors hired for that purpose, in the following cases:\n\na) Cancellation for non-compliance in the exercise of agricultural biosafety audits: when it is established that any of the following acts or omissions has been committed:\n\n1. Failure to submit to the POGM, in a timely and proper manner and in accordance with the provisions of Chapter IV of these Regulations, the monthly agricultural biosafety audit reports relating to activities involving OVM for agricultural use under its audit.\n\n2. Non-compliance with the responsibilities in the exercise of the agricultural biosafety audit set forth in the Second Section of Chapter III of these Regulations.\n\n3. Failure to comply with the obligation to monitor the implementation, by the audited entity, of the provisions issued by the POGM during inspections of activities involving OVM for agricultural use.\n\n4. Failure to comply with the obligation to verify the audited entity's compliance with the specific provisions established in the respective CLA, as well as with the agricultural biosafety measures defined in the rulings corresponding to each project approved by the POGM.\n\n5. Failure to notify the POGM of any non-compliance, by the entity subject to agricultural biosafety audit, with the biosafety measures set out in the ruling approving each project, detected during the audit process, the non-observance of which is subsequently identified by the POGM.\n\nb) Cancellation at the request of a party, or ex officio for breach of the duty of probity and truthfulness: at the request of a party or ex officio. Likewise, definitive cancellation of the registration of the auditing firm or of the authorized auditor shall proceed when the POGM establishes breach of the duty of probity (deber de probidad), in accordance with Articles 3 and 4 of Law Nº 8422, Ley contra la Corrupción y el Enriquecimiento Ilícito, as applicable to private parties participating in the management of public interests. Furthermore, the existence of technical misrepresentation (falsedad técnica) or data manipulation shall be an immediate ground for cancellation, in accordance with the transparency principles set forth in Article 113 of Law Nº 6227, Ley General de la Administración Pública, without prejudice to any resulting civil or criminal liability.\n\nc) Disqualification from exercising audit functions with respect to a specific entity: this shall proceed ex officio or at the request of a party when there exists a family relationship (up to the third degree of consanguinity or second degree of affinity) between the agricultural biosafety auditor and the executive officers, management, or owners of the audited entity. This measure shall also apply when there are private interests that may unduly influence the exercise of the audit.\n\nArticle 8 Record\n\nArticle 9. The POGM shall be responsible for verifying the quality, objectivity, and usefulness of the agricultural biosafety audit reports issued by the natural or legal persons carrying out this work, as well as for ensuring compliance with the functions and responsibilities established in the Second Section of Chapter III of these Regulations. Likewise, it shall be responsible for verifying compliance with the observations, provisions, or recommendations issued to the entity subject to agricultural biosafety audit.\n\nArticle 9 Record\n\nArticle 10. Duly identified POGM officials may at any time carry out inspection visits to entities subject to agricultural biosafety audit, whether coordinated in advance or without prior notice.\n\nArticle 10 Record\n\nArticle 11. If, during inspection visits, POGM officials determine that the anomalies identified by the agricultural biosafety auditing firm have not been corrected, or detect irregularities in the management of agricultural biosafety risks by the entity subject to agricultural biosafety audit, they may file the corresponding complaint with the UPE, for the purpose of pursuing the application of the sanctions provided for in Articles 31, 68, 69, and 80 of the Ley de Protección Fitosanitaria Nº 7664 and in Article 130, subparagraph a), as well as in Article 134, subparagraphs b) and c) of the Reglamento a la Ley de Protección Fitosanitaria, Executive Decree Nº 26921-MAG, and Article 249 of the Reglamento a la Ley de Protección Fitosanitaria Nº 26921-MAG.\n\nArticle 11 Record\n\nSecond Section:\n\nFunctions and Responsibilities of Agricultural Biosafety Auditing Firms:\n\nArticle 12. The general functions of the agricultural biosafety auditor include:\n\na) Verifying that all OVM material for agricultural use under audit must conform to the regulatory framework contained in the Ley de Protección Fitosanitaria, Nº 7664, and the applicable Reglamento a la Ley de Protección Fitosanitaria, within the scope that governs the subject matter.\n\nb) Verifying that the entity subject to agricultural biosafety audit keeps available, for those responsible for the management of projects involving OVM for agricultural use, the POGM-issued project approval ruling containing the specifically applicable biosafety measures, so that the information is accessible in a reliable, timely, and useful manner, to better apply the technical criteria required for the implementation of agricultural biosafety measures.\n\nc) Verifying that entities subject to agricultural biosafety audit that import, transport, use under confinement, release into the environment, or commercialize OVM used in agriculture comply with the protocols submitted by the entity subject to biosafety audit and approved by the POGM within the framework of the relevant CLA procedure or authorized planting projects. The provisions of this subparagraph shall also apply when the activities involve the maintenance, reproduction, and growth of OVM in confined laboratory or greenhouse spaces. Excluded are teaching and research activities carried out by state university-level higher-education institutions in laboratories and greenhouses, by virtue of their autonomy, provided that such activities do not involve commercial purposes or research conducted outside contained use.\n\nd) Detecting and documenting instances of non-compliance with the biosafety measures established by the POGM in the CLA or in the authorization ruling for projects involving OVM for agricultural use, supporting their findings with objective evidence and indicating the provisions that are not being complied with, the possible causes of non-compliance, and the corresponding impact.\n\ne) Recommending to entities subject to agricultural biosafety audit opportunities for improvement in the activities of import, transport, contained use, environmental release, commercialization, and documentation related to the handling of OVM for agricultural use, so as to optimize the tools and efforts for effectively managing agricultural biosafety risks.\n\nf) Warning entities subject to agricultural biosafety audit of the occurrence of errors or omissions in the activities of import, transport, contained use, environmental release, commercialization, and documentation related to the handling of OVM for agricultural use, that increase the risk of accidental release of the OVM, and in particular of material with reproductive potential.\n\ng) Reporting to the POGM the results of the assessment of operations involving OVM in an objective, reliable, independent, and timely manner. The POGM, in turn, shall communicate those results to the entities subject to agricultural biosafety audit. This assessment must be based on the auditor's expertise and carried out with the requisite professional care, so as to enable a diagnosis with reasonable assurance of the effectiveness of the agricultural biosafety risk assessment and control measures.\n\nArticle 12 Record\n\nArticle 13. In the case of the import or transport of OVM for agricultural use, the agricultural biosafety auditing firm must:\n\na) Verify that the OVM for agricultural use being imported or transported are duly authorized and registered with the POGM.\n\nb) To verify that the technical information included in the documentation identifying the living modified organisms (organismos vivos modificados, OVM) is recorded in accordance with Form BIO-04, established in Anexo 6 of the Reglamento a la Ley de Protección Fitosanitaria, Decreto Ejecutivo Nº 26921-MAG, available on the official website of the SFE: www.sfe.go.cr.\n\nc) To verify that OVM intended for agricultural use are transported in accordance with the protocols submitted by the audited entity (entidad sujeta de auditoría) and approved by the POGM within the framework of the corresponding CLA procedure, as well as the agricultural biosafety (bioseguridad agrícola) measures set forth in the resolution authorizing each project, in order to manage the risks of accidental escape of the OVM during transport.\n\nd) To issue recommendations to the audited entity regarding agricultural biosafety in relation to OVM intended for agricultural use that do not comply with the measures established in the corresponding CLA authorization resolution or in the project authorization resolution, applicable to the importation or transportation of the OVM, so that such deficiencies may be corrected.\n\ne) To verify that the content and description of the OVM intended for agricultural use stated in the documentation for importation or transportation are consistent with the contents of the packaging or container in which they are imported or transported.\n\nf) To verify that corrections, modifications, or changes to the technical information in the documentation for the importation or transportation of OVM intended for agricultural use are carried out in a timely manner, when so required.\n\ng) To verify that the technical information recorded in the documentation for the importation or transportation of OVM intended for agricultural use is consistent with that approved for such purpose by the POGM.\n\nArticle 13 Record\n\nArticle 14. When storage or internal movement of OVM intended for agricultural use within the project is concerned, the agricultural biosafety auditing company (empresa auditora en bioseguridad agrícola) shall:\n\na) Verify that OVM intended for agricultural use that have been imported, transported, confined, released into the environment, stored, or commercialized are kept in the areas and premises specified by the POGM.\n\nb) Verify that OVM intended for agricultural use are stored in accordance with the protocols submitted by the audited entity and approved by the POGM within the framework of the corresponding CLA procedure, as well as the agricultural biosafety measures set forth in the resolution authorizing each project, in order to prevent contamination, misidentification, or unauthorized removal of the OVM.\n\nc) Verify that the means of transport used for the internal movement of OVM intended for agricultural use comply with the biosafety protocols specific to each OVM according to the respective CLA, as well as the agricultural biosafety measures established for the authorization of each project.\n\nArticle 14 Record\n\nArticle 15. When the agricultural biosafety assessment of the receiving environment (medio receptor) where projects involving OVM intended for agricultural use are carried out is concerned, the agricultural biosafety auditing company shall:\n\na) Verify that the biosafety measures established in the CLA for the receiving environment where activities with OVM intended for agricultural use take place are complied with, as well as the agricultural biosafety measures established for the authorization of each corresponding project and determined according to the risk assessment of each OVM.\n\nArticle 15 Record\n\nArticle 16. When the assessment of the implementation of projects involving OVM intended for agricultural use is concerned, the agricultural biosafety auditing company shall:\n\na) Verify that OVM intended for agricultural use planted by the audited entity form part of planting projects duly authorized by the POGM.\n\nb) Verify that projects involving OVM intended for agricultural use are developed in accordance with the protocols submitted by the audited entity and approved by the POGM within the framework of the corresponding CLA procedure, as well as the agricultural biosafety measures set forth in the resolution authorizing each project.\n\nc) Maintain a detailed, up-to-date record of the different OVM intended for agricultural use and their characteristics, as registered by the audited entity.\n\nd) Verify the validity of the registration of OVM intended for agricultural use and prevent the use of those whose registration has been cancelled.\n\ne) Verify that the audited entity submits to the POGM, on a monthly basis, an updated report of operations involving OVM intended for agricultural use.\n\nArticle 16 Record\n\nArticle 17. When the characteristics of OVM intended for agricultural use are concerned, the agricultural biosafety auditing company shall:\n\na) Verify that OVM intended for agricultural use do not exhibit characteristics substantially different from those listed in the CLA application, nor produce unforeseen effects on organisms that come into contact with them.\n\nb) Verify that only OVM intended for agricultural use that retain the characteristics submitted by the audited entity within the framework of the corresponding CLA procedure are used.\n\nc) Ensure that the POGM is immediately notified, within 24 hours following the incident, upon detection of OVM intended for agricultural use that do not retain the characteristics submitted by the audited entity within the framework of the corresponding CLA procedure.\n\nArticle 17 Record\n\nArticle 18. Agricultural biosafety auditing companies may not offer auditing services to an audited entity when there are factors that give rise to conflicts of interest, as established in the applicable regulations, particularly as set forth in Article 230 of the Ley General de la Administración Pública, Ley Nº 6227; in Article 31 of the Reforma Integral a la Ley Orgánica del Poder Judicial, number 7333; in Article 12 of the Código Procesal Civil, Ley Nº 9342; and in the \"Directrices Generales sobre Principios y Enunciados Éticos a observar por parte de los jerarcas, titulares subordinados, funcionarios de la Contraloría General de la República, Auditorías Internas y servidores públicos en general\" number D-2-2004-CO. This prohibition applies when a public official places his or her independence of judgment at risk in deciding a particular matter or situation — that is, when the official's personal interest supersedes the general interest that he or she is duty-bound to protect — and not on account of the costs associated with the auditing service.\n\nArticle 18 Record\n\nArticle 19. Every agricultural biosafety auditing company shall execute, together with the audited entity, the form entitled Declaration of No Conflict of Interest (Declaración de no conflicto de interés), available on the official website of the SFE: www.sfe.go.cr and in Anexo 2 of this regulation, a copy of which shall be submitted to the POGM for safekeeping.\n\nArticle 19 Record\n\nArticle 20. In order to protect objectivity and independence as fundamental characteristics of professional practice, agricultural biosafety auditing companies are prohibited from performing any professional or administrative work for audited entities other than conducting the audits provided for in this regulation. The sole exception to this prohibition shall be the provision of training activities to staff of the audited entity on topics related to agricultural biosafety.\n\nArticle 20 Record\n\nArticle 21. In the event that an agricultural biosafety auditing company or an agricultural biosafety auditor resigns, the interested party shall formally notify the POGM. Upon receipt of such notification, the POGM shall issue the corresponding administrative resolution (resolución administrativa) by which the submitted resignation is accepted and, where applicable, the authorization to perform agricultural biosafety auditing functions is revoked. Such act shall be communicated to the interested party through the means of communication indicated by that party in the application. The administrative resolution may be challenged through the ordinary remedies of reconsideration (revocatoria) and appeal (apelación), in accordance with the provisions of Articles 342 and 343 of the Ley General de la Administración Pública, Ley Nº 6227 of May 2, 1978.\n\nArticle 21 Record\n\nThird Section:\n\nFunctions and Responsibilities of Audited Entities in Agricultural Biosafety:\n\nArticle 22. Every audited entity in agricultural biosafety shall submit to the POGM, within the first 10 business days of each month, a monthly report on data corresponding to importation and arrival, transportation, planting, processing, storage, commercialization, and export activities. Without prejudice to the foregoing, the POGM may request supplementary or specific information as deemed necessary for the adequate monitoring and technical analysis of the project. Compliance with the submission of the report shall be periodically reviewed by both the agricultural biosafety auditing company and the POGM.\n\nArticle 22 Record\n\nArticle 23. The directives issued by the POGM regarding the biosafety of OVM intended for agricultural use shall be mandatory for audited entities in agricultural biosafety.\n\nArticle 23 Record\n\nArticle 24. Every audited entity in agricultural biosafety shall maintain an orderly archive, using physical or digital means, of documents pertaining to the activity — such as OVM import receipts, agricultural biosafety audit reports, and internal compliance and verification documents related to the application of agricultural biosafety measures — in a manner that provides reasonable assurance of the effectiveness in managing the biosafety risks associated with the use and handling of OVM. Likewise, the timely availability of and access to such documents for verification and consultation by POGM officials and the agricultural biosafety auditor, upon their request, must be guaranteed.\n\nArticle 24 Record\n\nArticle 25. The directives issued by the agricultural biosafety auditing company shall be mandatory for the audited entity in agricultural biosafety, once they have been endorsed by the POGM.\n\nArticle 25 Record\n\nArticle 26. The audited entity in agricultural biosafety shall provide the cooperation required for POGM officials and agricultural biosafety auditors to carry out their respective duties. Likewise, the audited entity shall be obligated to present documentary evidence of compliance with the biosafety measures established in the CLA or in the administrative resolution authorizing projects involving OVM intended for agricultural use, and to provide the information that such officials require for the verification, analysis, and monitoring of compliance with Decreto Ejecutivo Nº 26921-MAG, Reglamento a la Ley de Protección Fitosanitaria, regarding the biosafety of OVM.\n\nArticle 26 Record\n\nArticle 27. When an audited entity in agricultural biosafety, for any reason, ceases activities involving OVM intended for agricultural use, it shall notify the POGM in writing within a maximum period of 30 calendar days from the date of closure, so that its official registration may be voided. Likewise, the POGM may verify the cessation of activities involving OVM intended for agricultural use on its own motion, through unannounced visits to audited entities in agricultural biosafety. Once the cessation of activities has been verified, the POGM shall issue the corresponding administrative resolution, and may establish therein a monitoring period whose conditions shall be defined in accordance with the agricultural biosafety risk analysis of the OVM involved.\n\nThe administrative resolution may be challenged through the ordinary remedies of reconsideration and appeal, in accordance with the provisions of Articles 342 and 343 of the Ley General de la Administración Pública, Ley Nº 6227 of May 2, 1978.\n\nArticle 27 Record\n\nCHAPTER IV\n\nAgricultural Biosafety Audit Reports\n\nSingle Section\n\nArticle 28. Every agricultural biosafety auditing company shall prepare, within the first 10 business days of each month, a report of the agricultural biosafety auditing work performed during the previous month with respect to the activities or projects involving OVM under its audit. Said report shall include a detailed account of relevant information related to biosafety management, the behavior of the OVM's characteristics, any potential biosafety risks detected during the course of the activities or project, the findings identified during the audit, and, where applicable, recommendations for strengthening biosafety measures. The physical or electronic mechanisms for communicating these reports shall be established by the POGM.\n\nArticle 28 Record\n\nArticle 29. The agricultural biosafety audit report shall contain at least the following sections:\n\na) Introduction.\n\nb) Executive summary of the project: a brief description of the status of the project in terms of its scope, phenological status, or stage of implementation.\n\nc) Project description: a reference framework for the project, indicating the event and its characteristics, the corresponding CLA or the resolution authorizing the project, the approved area, the location and plots involved, and a brief description of the purpose or objectives of the project. In subsequent monthly reports, it shall suffice to report only the relevant changes or updates to this information.\n\nd) Scope: a description of the audit objectives for the period, the activities carried out to evaluate the project and OVM operations, and any limitations that may have affected the conduct of the audit.\n\ne) Development: a detailed description of the processes and activities carried out during the audit, based on the scope defined for the period, indicating how biosafety measures were applied at the various stages of the project and any relevant situation observed.\n\nf) Findings: results obtained during the conduct of the audit process, documented in technical and documentary form, based on the scope defined for the audit period.\n\ng) Conclusions: an analysis of the findings, indicating which biosafety measures or standards have been affected and the potential consequences for the project's good biosafety practices.\n\nh) Recommendations: constructive suggestions, when necessary, based on the findings identified during the audit, aimed at the implementation of practical solutions or effective improvements to the project's biosafety measures.\n\ni) Post-project monitoring: a report of the inspection, monitoring, and management activities and results for the authorized areas where projects involving OVM were carried out, including those that are in a resting period, where applicable.\n\nj) Follow-up on recommendations or queries: review and verification by the auditor of compliance with recommendations or queries previously issued by the POGM, or those issued by the auditor itself and endorsed by the POGM.\n\nk) The sections set forth in this article constitute the minimum content of the report. Without prejudice to the foregoing, the POGM, through duly substantiated technical judgment, may require the inclusion of additional information or sections when the characteristics of the project, the biosafety conditions, or the scope of the audit so justify.\n\nArticle 29 Record\n\nArticle 30. In the event that the POGM requests clarification through a clarification note sent via the means of communication indicated in the application, the agricultural biosafety auditing company that issued the agricultural biosafety audit report is obligated to expand on the information provided, clarify or substantiate the criteria expressed, and resolve any doubts regarding the findings set forth in the report. For this purpose, the auditing company shall have 10 business days following the POGM's request for expansion or clarification to respond. This period may be extended by an additional 10 business days, on one occasion only, upon a duly justified request from the interested party, which must be submitted within the initially granted period.\n\nArticle 30 Record\n\nArticle 31. Upon the expiration of the 10-business-day period, or the extension period, granted to the interested party, if the POGM determines that the original deficiencies or inconsistencies have not been fully remedied by the interested party, the POGM may initiate an administrative proceeding in accordance with the provisions of Chapter VI on administrative sanctions of this regulation.\n\nArticle 31 Record\n\nArticle 32. The agricultural biosafety auditing company shall submit the monthly agricultural biosafety audit report to the POGM. Once notified of the report's approval by the POGM, the agricultural biosafety auditing company shall distribute it digitally as follows:\n\na) One copy of the reviewed and authorized report shall be held by the POGM as the official record.\n\nb) One copy shall be delivered by the agricultural biosafety auditing company to the technical or legal representative of the audited entity in agricultural biosafety.\n\nc) One copy shall be retained by the agricultural biosafety auditing company that prepared the report.\n\nArticle 32 Record\n\nCHAPTER V\n\nRestrictions on the Provision of Agricultural Biosafety Auditing Services\n\nSingle Section\n\nArticle 33. Agricultural biosafety auditing companies shall refrain from offering biosafety auditing services to audited entities that are in a position of conflict of interest, so as to preserve the objectivity of the agricultural biosafety audit work. \"Conflict of interest\" shall be understood as defined in Article 18 of this regulation — that is, when a public official places his or her independence of judgment at risk in deciding a particular matter or situation, i.e., when the official's personal interest supersedes the general interest that he or she is duty-bound to protect — and not on account of the costs associated with the auditing service.\n\nArticle 33 Record\n\nCHAPTER VI\n\nAdministrative Sanctions\n\nSingle Section\n\nArticle 34. The POGM may revoke, at any time, the authorization to perform agricultural biosafety auditing functions granted to an individual who has assumed the responsibility of providing such service, in accordance with the provisions of subparagraph a) of Article 8 of this regulation.\n\nIn such cases, the POGM shall issue a formal warning (apercibimiento) to the agricultural biosafety auditor through the means of communication indicated by that person in the registration application as an auditing company, upon the occurrence of any of said acts or omissions. The auditor shall remedy the identified deficiencies and incorporate, in a verifiable manner, evidence of compliance in the corresponding agricultural biosafety audit report for the current month, when the formal warning was issued within the first ten calendar days of the month; otherwise, compliance shall be reflected, no later than in the agricultural biosafety audit report for the following month.\n\nThe formally warned agricultural biosafety auditor may request, on one occasion only and in a duly justified manner, an extension of time to remedy the deficiencies identified in the formal warning, by submitting a digitally signed note to the POGM, which must be presented within the originally granted period. The POGM may authorize said extension, provided it does not exceed the submission deadline of the monthly audit report immediately following the original remediation period. The auditor shall have this new period to incorporate the corresponding verifiable evidence of compliance.\n\nIn the event that the response or corrective actions arising from the formal warning are not satisfactory or give rise to doubts on the part of the POGM, the POGM shall send the agricultural biosafety auditor a clarification note in order to request the corresponding corrections and ensure proper resolution of the situation. For this purpose, the auditor shall have 10 business days to address the request, and shall resubmit the agricultural biosafety report with the required information.\n\nIf the situation recorded in the formal warning is not remedied in a timely and proper manner, the POGM shall proceed to revoke the authorization to perform agricultural biosafety auditing functions held by the auditor.\n\nArticle 34 Record\n\nArticle 35. The POGM may suspend (inhabilitación) or revoke (cancelación), at any time, the authorization to perform agricultural biosafety auditing functions granted to a company that has assumed the responsibility of providing such service, as well as to its contracted agricultural biosafety auditors, in accordance with the provisions of subparagraphs b) and c) of Article 8 of this regulation, respectively. Both measures may be initiated on the POGM's own motion or upon request of a party, and their application shall proceed once the commission of the offenses provided for in those subparagraphs has been established.\n\nArticle 35 Record\n\nArticle 36. Whenever suspensions or revocations of the authorization to perform agricultural biosafety auditing functions are carried out, the POGM shall communicate the decision by means of an administrative resolution to the company that assumed responsibility for providing such service, as well as to its contracted agricultural biosafety auditors. The administrative resolution shall be communicated to the interested party through the means of communication indicated by that party in the registration application as an agricultural biosafety auditing company. The administrative resolution may be challenged through the ordinary remedies of reconsideration and appeal, in accordance with the provisions of Articles 342 and 343 of the Ley General de la Administración Pública, Ley Nº 6227 of May 2, 1978.\n\nArticle 36 Record\n\nArticle 37. Whenever a suspension or revocation of the authorization to perform agricultural biosafety auditing functions is ordered, the POGM shall communicate, through the means of communication indicated in the registration form for natural or legal persons wishing to use organisms produced through modern biotechnology, established in Article 119 of the Reglamento a la Ley de Protección Fitosanitaria, Decreto Ejecutivo Nº 26921-MAG, the considerations and scope of the respective administrative act to the audited entity.\n\nIn such cases, the POGM shall establish, through said communication, a transitional and exceptional monitoring period, which shall be carried out by POGM officials for a period of no more than six months, counted from the date of notification. This monitoring shall cover the OVM projects in progress within the audited entity. Likewise, the POGM shall define the conditions of said monitoring, so that the entity may manage, during this period, the contracting of services from another auditing company.\n\nThe audited entity may request, on one occasion only and in a duly justified manner, an extension of the transitional and exceptional monitoring period. To do so, the entity shall submit a digitally signed note to the POGM within the originally granted period. The POGM may authorize said extension, provided it does not exceed three months from the date of its approval. During this additional period, the entity shall manage the contracting of services from another auditing company.\n\nLikewise, in accordance with the provisions of Articles 118, 123, and 129 of the Reglamento a la Ley de Protección Fitosanitaria, Decreto Ejecutivo Nº 26921-MAG, having agricultural biosafety auditing services constitutes an indispensable requirement for the implementation of planting projects and the importation of OVM intended for agricultural use.\n\nIn the event that the audited entity does not have such services, it shall be disqualified from applying for seed importation authorizations and from registering new planting projects with the POGM, until the situation has been formally regularized. The foregoing shall apply without prejudice to the provisions of subparagraph a) of Article 130, as well as subparagraphs b) and c) of Article 134 of the Reglamento a la Ley de Protección Fitosanitaria, Decreto Ejecutivo Nº 26921-MAG.\n\nArticle 37 Record\n\nArticle 38. The application of the administrative sanctions provided for in Articles 34 and 35 of this regulation shall not preclude the application of the provisions of subparagraph 3 of Article 256 of the Reglamento a la Ley de Protección Fitosanitaria, Decreto Ejecutivo Nº 26921-MAG.\n\nArticle 38 Record\n\nCHAPTER VII\n\nFinal Provisions\n\nSingle Section\n\nArticle 39. Subparagraph a of Article 123 of Decreto Ejecutivo Nº 26921-MAG: Reglamento a la Ley de Protección Fitosanitaria, of March 20, 1998, is hereby amended to read as follows:\n\n\"a. Scope.\n\nThe SFE shall be the entity responsible for carrying out the registration, inspection, and monitoring of projects involving the planting, reproduction, maintenance, research, experimentation, or commercialization of OVM intended for agricultural use, both in confined use and for release into the environment. For such purposes, it shall have access to all areas and facilities where activities with OVM are carried out, at such times as it deems necessary.\n\nLikewise, the SFE shall regulate agricultural biosafety audits, which shall assist in assessing compliance, by the natural or legal person authorized to carry out a project, with the biosafety measures applied in operations involving OVM intended for agricultural use, as well as with the directives issued by the SFE and the best practices in biosafety established in the risk assessment.\n\nArticle 39 Record\n\nArticle 40. Decreto Ejecutivo Nº 32486-MAG, entitled Reglamento de Auditorías en Bioseguridad Agrícola del Ministerio de Agricultura y Ganadería, of June 20, 2005, published in the Gaceta Nº 142 of July 22, 2005, is hereby repealed.\n\nArticle 40 Record\n\nTRANSITORY I: A period of six months from the publication of this Executive Decree is established for the POGM to implement its provisions. During that period, agricultural biosafety auditing companies currently performing agricultural biosafety auditing functions, and audited entities that, at the time this regulation enters into force, have OVM projects in progress intended for agricultural use, may continue to use the procedures and forms established in Decreto Ejecutivo Nº 32486-MAG, entitled Reglamento de Auditorías en Bioseguridad Agrícola del Ministerio de Agricultura y Ganadería, published in the Gaceta Nº 142 of July 22, 2005.\n\nArticle 1 Record — Transitory\n\nArticle 41. This decree shall take effect upon its publication in the Diario Oficial La Gaceta.\n\nGiven at the Office of the Presidency of the Republic, on the twenty-third day of the month of April of the year two thousand and twenty-six."
