con lo que establece el artículo 2 de la Convención Relativa a los Humedales de Importancia Internacional Especialmente como Hábitat de Aves Acuáticas (\"Convención de Ramsar\").\n\n    TERCERO: Que en el año 1993 a solicitud de Costa Rica se incluyó el sitio Ramsar Palo Verde en el Registro de Montreaux, registro en el que se mantiene aún incluido.\n\n    CUARTO: Que mediante el Decreto Ejecutivo N° 27345-MINAE del 18 de agosto de 1998, publicado en La Gaceta N° 199 del 14 de octubre de 1998, se definió las acciones de anejo\n\nactivo a realizar dentro del Parque Nacional Palo Verde, específicamente en los humedales y en las áreas de pasto jaragua (Hyparrhenia rufa) mezcladas con remanentes de bosque secundario.\n\n    SEXTO: Que el Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde fue dictado por el numeral primero del Decreto Ejecutivo 39786- MINAE del 22 de abril del 2016 publicado en la Gaceta N° 148 del 03 de agosto del 2016.\n\n    SETIMO: Que el Plan de Intervención y Monitoreo del Parque Nacional Palo Verde fue aprobado por el Consejo Regional del ACAT mediante el acuerdo N° 8 de la sesión ordinaria 09-2017\n\n    OCTAVO: Que siguiendo lo dispuesto en el artículo 6) inciso f) del Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde fue dictado por el numeral primero del Decreto Ejecutivo 39786-MINAE y de acuerdo a la recomendación del Comité Asesor del PNPV el Consejo Regional del Área de Conservación Arenal Tempisque mediante el acuerdo N° 9 de la sesión ordinaria 09-2017 aprobó la herramienta denominada “Guía Metodológica para la Determinación y Evaluación de Sitios para el pastoreo como Herramienta de Manejo Activo en el Parque Nacional Palo Verde”.\n\n    NOVENO: Que sitio conocido como Laguna Varilla dentro del Parque Nacional Palo Verde, está constituido principalmente por una cobertura de humedal hacia todo el sector Oeste (colindante con el Río Tempisque) y de bosque en dirección al sector Este que abarca los Cerros Espíritu Santo, Punta Piedra, Alto Viejo y La Cueva. Se extiende desde las coordenadas X: 345 616,02-352 021,89, Y: 1 149 833,80-1 146 115,73; con un área de 250 hectáreas en su totalidad laguna la bocana tiene un espejo de agua de aproximadamente de 120 hectáreas el resto es área de influencia de la misma laguna con fluctuaciones de agua dependiendo del invierno y la instrucción de mareas.\n\n    DECIMO: Que en aplicación de la guía metodológica para la determinación y evaluación de sitios para el pastoreo como herramienta de manejo activo en el parque nacional palo verde, la funcionaria Cristina Arguedas Chacón, encargada del Programa Manejo Activo del Parque Nacional Palo Verde recomendó en oficio CARTA SINAC-ACAT-DASP-PNPV- 0088-2026 del 22 de junio del 2026 que en este sitio el pastoreo, con priorización de 1, ya que cumple con la totalidad de los criterios evaluados; así mismo determinó que la actividad de pastoreo con ganado bovino, en ese sitio, es una herramienta que, complementada con la intervención de fangueo y rastra es de alta relevancia, para reducir la biomasa vegetal, controlar las especies invasoras u oportunistas en dicha área, así como rehabilitar el hábitat de las aves acuáticas, aparte de que ayuda a reducir el riesgo potencial de incendios forestales.\n\nCONSIDERANDO\n\n    PRIMERO: Competencia institucional. - Que de conformidad con lo dispuesto en los artículos 22 y 28 de la Ley de Biodiversidad número 7788 y los numerales 21 y 23 del Decreto Ejecutivo número 34433-MINAE denominado Reglamento a la Ley de Biodiversidad el Área de Conservación Arenal Tempisque a través del Parque Nacional Palo Verde es la instancia responsable de la gestión y administración de dicha área protegida.\n\n    Así, es función del Área de Conservación Arenal Tempisque, por medio de la Oficina Administrativa del Parque Nacional Palo Verde, la administración del Área silvestre protegida incluyendo el manejo de los hábitats con el objeto de recuperar, restaurar y rehabilitar los ecosistemas alterados manteniéndolos según sus características al momento de la declaratoria y en cumplimiento de los objetivos que dieron origen al Parque Nacional.\n\n    En este mismo sentido, la Ley Forestal No. 7575 del 16 de abril de 1996, la Ley Orgánica del Ambiente No. 7554 del 13 de noviembre de 1995, Ley de Servicios de Parques Nacionales No. 6084 del 24 de agosto de 1977, establecen como fin primordial del Estado, velar por la conservación, protección y administración de las Áreas Silvestres Protegidas. Particularmente, el artículo citado; 6) inciso b) del Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde, Decreto Ejecutivo 39786-MINAE, corresponde a la Dirección Regional del ACAT emitir la resolución administrativa que apruebe la necesidad de autorizar pastoreo en áreas nuevas.\n\n    SEGUNDO: Que se encuentran vigentes los Decretos Ejecutivos 27345-MINAE y 39786-MINAE que establecen las normas específicas para el manejo activo de los ecosistemas del Parque Nacional Palo Verde; las cuales facultan y ordenan a esta administración según se contempla en el numeral segundo y tercero inciso f) del Decreto Ejecutivo 39786-MINAE a realizar la gestión in situ necesaria en aras de rehabilitar o mantener la integridad ecológica de los ecosistemas presentes en el área protegida en busca de la recuperación, rehabilitación y recuperación ecológica en los términos definidos por el artículo 3 incisos i), j) y k) del “Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde” dictado mediante al artículo primero del Decreto Ejecutivo 39786-MINAE.\n\n    TERCERO: Que el pastoreo constituye una de las herramientas de manejo activo expresamente autorizadas por el ordenamiento jurídico nacional para ser aplicada en el Parque Nacional Palo Verde según lo dictan los artículos 2 y 3 del Decreto Ejecutivo 27345-MINAE.\n\n    CUARTO: Que la Administración ha verificado que se han cumplido los requisitos previstos en el numeral 6 inciso b) del Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde dictado por el numeral primero del Decreto Ejecutivo 39786-MINAE para emitir el presente acto administrativo.\n\n    QUINTO: Que el artículo citado; 6) inciso g) del Reglamento para el Manejo Activo de los Ecosistemas del Parque Nacional Palo Verde Decreto Ejecutivo 39786-MINAE dicta los criterios para el otorgamiento de permisos de uso para pastoreo en áreas nuevas identificadas.\n\nPOR TANTO,\n\nLA DIRECCION DEL ÁREA DE CONSERVACIÓN ARENAL TEMPISQUE\n\n    De conformidad con el artículo 22 y siguientes de la Ley de Biodiversidad N° 7788, artículos 11, 16 y 154 de la Ley General de la Administración Pública, Decreto Ejecutivo Nº 27345-MINAE del 18 de agosto de 1998 y el Decreto Ejecutivo 39786-MINAE del 22 de abril del 2016\n\nRESUELVE:\n\n    PRIMERO: Autorizar y comunicar la disponibilidad del siguiente sitio nuevo para el otorgamiento de Permiso de Uso para pastoreo con ganado vacuno dentro del Parque Nacional Palo Verde con fines de restauración ecosistémica:\n\n    Sitio denominado Laguna Varillal, las coordenadas X: 345 616,02-352 021,89, Y: 1 149 833,80-1 146 115,73; It extends from coordinates X: 345 616,02-352 021,89, Y: 1 149 833,80-1 146 115,73; covers 250 hectares in total, and Laguna La Bocana has a water surface of approximately 120 hectares. The remainder is the area influenced by the same lagoon, with water fluctuations depending on the rainy season and tidal inflow.\n\n    TENTH: That, applying the methodological guide for determining and evaluating sites for grazing as an active management tool in Palo Verde National Park, Cristina Arguedas Chacón, the official in charge of the Active Management Program at Palo Verde National Park, recommended in memorandum CARTA SINAC-ACAT-DASP-PNPV-0088-2026 of 22 June 2026 that grazing be given priority 1 at this site, since it meets all the criteria evaluated. She also determined that cattle grazing at this site, complemented by mud plowing and harrowing, is a highly relevant tool for reducing plant biomass, controlling invasive or opportunistic species in the area, and rehabilitating waterfowl habitat, as well as helping reduce the potential risk of forest fires.\n\nCONSIDERING\n\n    FIRST: Institutional authority. That, pursuant to Articles 22 and 28 of the Biodiversity Law No. 7788 and sections 21 and 23 of Executive Decree No. 34433-MINAE, entitled Regulation to the Biodiversity Law, the Arenal Tempisque Conservation Area, through Palo Verde National Park, is the body responsible for the management and administration of that protected area.\n\n    Accordingly, it is the function of the Arenal Tempisque Conservation Area, through the Administrative Office of Palo Verde National Park, to administer the protected wild area, including managing habitats in order to recover, restore, and rehabilitate altered ecosystems while maintaining them according to their characteristics at the time of designation and in fulfillment of the objectives that gave rise to the National Park.\n\n    In the same vein, the Forest Law No. 7575 of 16 April 1996, the Organic Environmental Law No. 7554 of 13 November 1995, and the National Parks Services Law No. 6084 of 24 August 1977 establish as the State’s primary purpose ensuring the conservation, protection, and administration of Protected Wild Areas. In particular, the cited Article 6, subsection b), of the Regulation for the Active Management of Ecosystems in Palo Verde National Park, Executive Decree 39786-MINAE, assigns the ACAT Regional Directorate responsibility for issuing the administrative resolution approving the need to authorize grazing in new areas.\n\n    SECOND: That Executive Decrees 27345-MINAE and 39786-MINAE remain in force and establish the specific rules for active management of the ecosystems of Palo Verde National Park. These empower and direct this administration, as set out in section two and section three, subsection f), of Executive Decree 39786-MINAE, to carry out the necessary on-site management to rehabilitate or maintain the ecological integrity of the ecosystems present in the protected area, in pursuit of ecological recovery and rehabilitation as defined in Article 3, subsections i), j), and k), of the “Regulation for the Active Management of Ecosystems in Palo Verde National Park,” issued by Article One of Executive Decree 39786-MINAE.\n\n    THIRD: That grazing is one of the active management tools expressly authorized by the national legal system for application in Palo Verde National Park, as provided in Articles 2 and 3 of Executive Decree 27345-MINAE.\n\n    FOURTH: That the Administration has verified that the requirements set out in section 6, subsection b), of the Regulation for the Active Management of Ecosystems in Palo Verde National Park, issued by section one of Executive Decree 39786-MINAE, have been met for issuance of this administrative act.\n\n    FIFTH: That the cited Article 6, subsection g), of the Regulation for the Active Management of Ecosystems in Palo Verde National Park, Executive Decree 39786-MINAE, sets out the criteria for granting permits to use land for grazing in identified new areas.\n\nTHEREFORE,\n\nTHE DIRECTORATE OF THE ARENAL TEMPISQUE CONSERVATION AREA\n\n    Pursuant to Article 22 et seq. of the Biodiversity Law No. 7788, Articles 11, 16, and 154 of the General Law on Public Administration, Executive Decree No. 27345-MINAE of 18 August 1998, and Executive Decree 39786-MINAE of 22 April 2016,\n\nRESOLVES:\n\n    FIRST: To authorize and communicate the availability of the following new site for the granting of a permit to use land for cattle grazing within Palo Verde National Park for ecosystem restoration purposes:\n\n    Site known as Laguna Varillal, coordinates X: 345 616,02-352 021,89, Y: 1 149 833,80-1 146 115,73; with a total area of 250 hectares. The remainder is the area influenced by the same lagoon, with water fluctuations depending on the rainy season and tidal inflow.\n\n    Information on the exact location of the area is on file and may be consulted by any interested party through the Palo Verde National Park Administration at manrique.montes@sinac.go.cr.\n\n    SECOND: To notify interested parties that they may submit an application for a permit to use land for grazing to the Directorate of the Arenal Tempisque Conservation Area at its offices in Tilarán, 275 meters south of the Fuerza Pública facilities, next to the Fire Station, within one month from publication of this act, meeting the requirements set out in section 6, subsection d), of the Regulation for the Active Management of Ecosystems in Palo Verde National Park, Executive Decree 39786-MINAE.\n\n    THIRD: Applications for the granting of a permit to use land for grazing in the area described in the first provision of this resolution shall be decided according to the following criteria, applied in the order established here: 1) Priority shall be given to persons domiciled in the areas of influence of the National Park. 2) The first to submit an application shall have priority in the right to be granted the permit, provided the regulatory requirements are met.\n\n    FOURTH: Publish in the official gazette La Gaceta.\n\nArticle 1" }
