El presente reglamento tiene por objeto establecer el servicio de mantenimiento de parques y zonas verdes, el ornato de éstos, y sus respectivos servicios; además, regular su funcionamiento y el cobro de la tasa correspondiente, de conformidad con el artículo 83 del Código Municipal.\n\n Ficha Artículo 1\n\n    Artículo 2º—Definiciones. Para los efectos de este Reglamento, se entenderá por:\n\n    Cantón: El Cantón de San Carlos.\n\n    Concejo: El Concejo Municipal de la Municipalidad de San Carlos.\n\n    Estudios Tarifarios: Estudio que realizará el Departamento de Servicios Públicos y la Administración Tributaria de la Municipalidad de San Carlos para la fijación de la tarifa.\n\n    Municipalidad: La Municipalidad de San Carlos.\n\n    Parques: Terrenos de uso público, destinados por la Municipalidad de San Carlos, con base en la Ley, como áreas verdes, para el esparcimiento o recreación de sus habitantes o entregado por ley para ese fin, de libre acceso a todos los habitantes del país.\n\n    Sujeto pasivo: Aquella persona que sea propietaria de un inmueble, quien por tal condición está obligada al pago de la tasa que cobra la Municipalidad, por mantenimiento de parques, ornato y zonas verdes, en los distritos del cantón de San Carlos, en proporción del valor declarado de su propiedad.\n\n    Tarifa: Tasa. Monto a pagar por el sujeto pasivo de la obligación tributaria.\n\n    Tasa: Tributo cuya obligación tiene como hecho generador la prestación efectiva o potencial de un servicio público que brinda la Municipalidad, individualizado en el contribuyente, cuyo producto no debe tener un destino ajeno al servicio, razón de ser de la obligación.\n\n    Zona verde: Áreas, jardines o terrenos libres ubicados dentro del límite de los parques.\n\n Ficha Artículo 2\n\n    Artículo 3º—Obligaciones de los habitantes del cantón. Los habitantes del Cantón de San Carlos, tendrán las siguientes obligaciones respecto a los parques y zonas verdes ubicados dentro de su jurisdicción:\n\n    1.Utilizar los parques y áreas públicas en las actividades de esparcimiento recreación para las cuales fueron concebidas esas áreas o de acuerdo con su estructura o diseño.\n\n    2.Velar por la limpieza, el mantenimiento y la conservación de las plantas, animales, monumentos y demás elementos existentes en dichos espacios.\n\n    3.Serán responsables de recoger los excrementos de los animales que le acompañen, así como de cualquier daño o perjuicio que ocasionen.\n\n    4.Pagar la tasa correspondiente por mantenimiento de parques, ornato y zonas verdes del distrito donde reside, de acuerdo con las reglas establecidas en el\n\n Ficha Artículo 3\n\ncapítulo segundo de este Reglamento.\n\n    Artículo 4º—Prohibiciones. Está prohibido en los parques y áreas verdes del cantón:\n\n    1.Hacer actividades comerciales o de cualquier tipo, que no hayan sido autorizadas previamente por la Municipalidad.\n\n    2.Destruir las plantas, árboles o arbustos plantados en ellos.\n\n    3.Destruir los monumentos y las obras de infraestructura o equipamiento urbano existentes en ellos.\n\n    4.Maltratar los animales domésticos o silvestres que se encuentren en ellos.\n\n    5.Utilizar sus estructuras (quioscos, asientos, fuentes, basureros, postes de alumbrado, entre otros de no menor importancia) para usos distintos a aquellos para los cuales fueron diseñados.\n\n    6.Pegar propaganda de cualquier tipo en árboles, postes de alumbrado, monumentos y demás estructuras ubicadas en ellos.\n\n    7.Realizar en ellos, actividades prohibidas por la ley o contrarias a la moral y las buenas costumbres.\n\n    8.Consumir en ellos, drogas o bebidas alcohólicas, fumar, y el uso de vapeadores o artículos similares.\n\n    9. Tirar basura en estructuras o sitios que no estén destinados específicamente a ese fin.\n\n    10. Realizar construcciones temporales o permanentes en las zonas verdes, o utilizarlas para ubicar en ellas materiales de construcción o desechos de cualquier tipo.\n\n    11. Hacerse acompañar de animales o mascotas que pongan en peligro la integridad y salud de los demás usuarios.\n\n Ficha Artículo 4\n\nCAPÍTULO II\n\nDel servicio de mantenimiento\n\nde parques y zonas verdes\n\n    Artículo 5º—Del mantenimiento. Se entiende por mantenimiento de parques, ornato, y zonas verdes, aquella actividad técnica y artesanal, así como el costo financiero que realiza la Municipalidad de San Carlos a través de sus distintas dependencias, para la atención de los parques ubicados en los diferentes distritos del Cantón de San Carlos, donde exista inversión o mejoras realizadas por la Municipalidad de San Carlos, y registradas a su nombre.\n\n Ficha Artículo 5\n\n    Artículo 6º—Actividades incluidas. El servicio de mantenimiento de parques y zonas verdes incluye las siguientes actividades:\n\n    1. Riego de jardines, maceteros y plantas.\n\n    2. Limpieza y recolección de desechos sólidos.\n\n    3. Mantenimiento, restauración, construcción o reconstrucción de la infraestructura propia de dichas áreas, tales como quioscos, asientos, monumentos, fuentes, alumbrado, accesos, entre otros.\n\n    4. Control de malezas y poda de árboles, plantas ornamentales y zacate.\n\n    5. La vigilancia para que no se levanten construcciones que impidan su uso o se realicen modificaciones a su infraestructura.\n\n    6. Cualquiera otro tendiente a garantizar la belleza escénica, la seguridad y el pleno disfrute de esas áreas.\n\n Ficha Artículo 6\n\nCAPÍTULO III\n\nDe la tasa y del procedimiento de cobro\n\n    Artículo 7º—La Municipalidad cobrará una tasa por concepto de mantenimiento de parques, ornato y zonas verdes, a todos los propietarios de bienes inmuebles ubicados dentro del distrito donde se realicen las mejoras o la construcción del área en mención, del Cantón de San Carlos, y la tarifa se fijará según el valor declarado de cada propiedad por el factor que resulte del costo real de dichos servicios, más un diez por ciento para su mantenimiento.\n\n    La tasa indicada se establecerá por distrito, según el inventario de parques y zonas verdes que existan en cada uno de ellos.\n\n Ficha Artículo 7\n\n    Artículo 8º—Fijación de la tarifa. Corresponde al Concejo Municipal fijar la tarifa de dicho servicio, lo cual será tomado en consideración el costo que demande la prestación del servicio más un diez por ciento de utilidad para desarrollarlos según el Código Municipal, más la base imponible de bienes inmuebles existentes para cada distrito, de dicha formula se obtendrá el factor de ponderación que se aplicará a cada contribuyente según el valor declarado de la propiedad. Dicha fijación tarifaria deberá hacerse al menos una vez al año y de previo a su aprobación definitiva, deberá someterse a consulta pública no vinculante por espacio de diez días hábiles.\n\n Ficha Artículo 8\n\n    Artículo 9º—Vigencia de la tarifa. La tarifa o tasa por el servicio de mantenimiento de parques y áreas verdes, empezará a regir treinta días después de su publicación definitiva en el Diario Oficial La Gaceta.\n\n Ficha Artículo 9\n\n    Artículo 10.—Lo recaudado por este servicio, se destinará para las mejoras y el mantenimiento de los parques, ornato, zonas verdes, el servicio y demás elementos existentes en los parques del distrito correspondiente.\n\n Ficha Artículo 10\n\n    Artículo 11.—Plazo de la tarifa y forma de pago. La tarifa o tasa por el servicio de mantenimiento de parques y zonas verdes será anual y se cobrará por trimestres vencidos. El cobro se efectuará en el mismo recibo con el que se cancelan las demás obligaciones tributarias del contribuyente.\n\n Ficha Artículo 11\n\n    Artículo 12.—En la determinación del costo efectivo, la Municipalidad tomará como base el costo real o efectivo que, por la actividad de mantenimiento de parques, ornato y zonas verdes, establezca la Administración Tributaria de la Municipalidad.\n\n Ficha Artículo 12\n\n    Artículo 13.—El cobro de esta tasa regirá a partir del trimestre siguiente de la publicación del presente reglamento.\n\n Ficha Artículo 13\n\n    Transitorio único: El presente Reglamento deja sin efecto toda regulación que anteceda a este.   "body_en_text": "Municipal Regulation 0\n\nRegulation for the Collection of the Fee for the Maintenance of Parks, Beautification, Green Areas, and Their Respective Services\n\n-You are viewing the latest version of the regulation-\n\nGo to the latest version\n\nRegulation Version: 1 of 1\n\nMUNICIPALITY OF SAN CARLOS\n\n    At its ordinary session held on Monday, 13 October 2025, in the Session Hall of the Municipality of San Carlos, Article No. X, Agreement No. 46, Minutes No. 61, the Municipal Council of San Carlos agreed to approve the Regulation for the Collection of the Fee for the Maintenance of Parks, Beautification, Green Areas, and Their Respective Services, set out below:\n\nREGULATION FOR THE COLLECTION OF THE FEE FOR THE\n\nMAINTENANCE OF PARKS, BEAUTIFICATION, GREEN AREAS, AND THEIR\n\nRESPECTIVE SERVICES\n\nGeneral Provisions\n\n    Article 1—Purpose. The purpose of this regulation is to establish the service for maintaining parks and green areas, their beautification, and the respective services; and to regulate their operation and the collection of the corresponding fee, in accordance with Article 83 of the Municipal Code.\n\nArticle Record 1\n\n    Article 2—Definitions. For the purposes of this Regulation, the following terms shall mean:\n\n    Canton: The Canton of San Carlos.\n\n    Council: The Municipal Council of the Municipality of San Carlos.\n\n    Tariff Studies: A study to be conducted by the Public Services Department and the Tax Administration of the Municipality of San Carlos to set the rate.\n\n    Municipality: The Municipality of San Carlos.\n\n    Parks: Public-use land designated by the Municipality of San Carlos, under the law, as green areas for the leisure or recreation of its inhabitants, or assigned by law for that purpose, with free access for all inhabitants of the country.\n\n    Tax obligor: A person who owns real property and who, by virtue of that status, is required to pay the fee charged by the Municipality for maintaining parks, beautification, and green areas in the districts of the Canton of San Carlos, in proportion to the declared value of the property.\n\n    Rate: Fee. Amount payable by the tax obligor under the tax obligation.\n\n    Fee: A tax whose obligation arises from the actual or potential provision of an individualized public service by the Municipality to the taxpayer, and whose proceeds may not be used for a purpose unrelated to the service that gives rise to the obligation.\n\n    Green area: Open areas, gardens, or land located within the boundaries of parks.\n\nArticle Record 2\n\n    Article 3—Obligations of the canton’s inhabitants. The inhabitants of the Canton of San Carlos shall have the following obligations regarding parks and green areas within its jurisdiction:\n\n    1. Use parks and public areas for the leisure and recreation activities for which those areas were designed, or in keeping with their structure or design.\n\n    2. Safeguard the cleanliness, maintenance, and preservation of the plants, animals, monuments, and other features in those spaces.\n\n    3. Be responsible for collecting the excrement of any animals accompanying them, as well as for any damage or harm those animals cause.\n\n    4. Pay the applicable fee for maintaining parks, beautification, and green areas in the district where they reside, in accordance with the rules established in Chapter II of this Regulation.\n\nArticle Record 3\n\n    Article 4—Prohibitions. The following are prohibited in the parks and green areas of the canton:\n\n    1. Engaging in commercial or other activities that have not been previously authorized by the Municipality.\n\n    2. Destroying the plants, trees, or shrubs planted there.\n\n    3. Destroying monuments and existing urban infrastructure or equipment there.\n\n    4. Mistreating domestic or wild animals found there.\n\n    5. Using structures there (kiosks, seats, fountains, garbage bins, streetlights, and other structures of similar importance) for purposes other than those for which they were designed.\n\n    6. Posting propaganda of any kind on trees, streetlights, monuments, or other structures located there.\n\n    7. Carrying out activities there that are prohibited by law or contrary to morality and good customs.\n\n    8. Consuming drugs or alcoholic beverages there, smoking, or using vaping devices or similar items.\n\n    9. Throwing garbage into structures or places not specifically designated for that purpose.\n\n    10. Erecting temporary or permanent structures in green areas, or using them to place construction materials or waste of any kind.\n\n    11. Bringing animals or pets that endanger the safety or health of other users.\n\nArticle Record 4\n\nCHAPTER II\n\nThe Service for Maintaining\n\nParks and Green Areas\n\n    Article 5—Maintenance. Maintenance of parks, beautification, and green areas means the technical and manual work, as well as the financial cost, incurred by the Municipality of San Carlos through its various departments to care for parks in the different districts of the Canton of San Carlos where the Municipality of San Carlos has made investments or improvements that are registered in its name.\n\nArticle Record 5\n\n    Article 6—Included activities. The service for maintaining parks and green areas includes the following activities:\n\n    1. Watering gardens, planters, and plants.\n\n    2. Cleaning and collecting solid waste.\n\n    3. Maintaining, restoring, building, or rebuilding the infrastructure belonging to those areas, such as kiosks, seats, monuments, fountains, lighting, access points, and others.\n\n    4. Controlling weeds and pruning trees, ornamental plants, and grass.\n\n    5. Monitoring to ensure that no structures are erected that prevent the areas from being used, and that no modifications are made to their infrastructure.\n\n    6. Any other activity aimed at ensuring the scenic beauty, safety, and full enjoyment of those areas.\n\nArticle Record 6\n\nCHAPTER III\n\nThe Fee and Collection Procedure\n\n    Article 7—The Municipality shall charge a fee for maintaining parks, beautification, and green areas to all owners of real property located within a district of the Canton of San Carlos where improvements are made or the area in question is built. The rate shall be set according to the declared value of each property, multiplied by the factor derived from the actual cost of those services, plus ten percent for their maintenance.\n\n    The stated fee shall be established by district, according to the inventory of parks and green areas in each district.\n\nArticle Record 7\n\n    Article 8—Setting the rate. The Municipal Council is responsible for setting the rate for this service. In doing so, it shall take into account the cost of providing the service, plus a ten percent profit to develop it, as provided for in the Municipal Code, and the taxable base of the real property in each district. This formula shall yield a weighting factor to be applied to each taxpayer according to the declared value of the property. The rate shall be set at least once a year and, before final approval, shall be submitted for a nonbinding public consultation lasting ten business days.\n\nArticle Record 8\n\n    Article 9—Effective date of the rate. The rate or fee for the service of maintaining parks and green areas shall take effect thirty days after its final publication in the official gazette, La Gaceta.\n\nArticle Record 9\n\n    Article 10. The revenue collected for this service shall be used for improvements to and maintenance of parks, beautification, green areas, the service, and other features in the parks of the corresponding district.\n\nArticle Record 10\n\n    Article 11—Rate period and method of payment. The rate or fee for the service of maintaining parks and green areas shall be annual and collected in arrears by quarter. It shall be collected on the same bill used to pay the taxpayer’s other tax obligations.\n\nArticle Record 11\n\n    Article 12. To determine the actual cost, the Municipality shall use as its basis the actual or effective cost of maintaining parks, beautification, and green areas, as established by the Tax Administration of the Municipality.\n\nArticle Record 12\n\n    Article 13.
