artículos 2 y 3 de la Ley Nº 5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de 1975 y sus reformas.\n\nConsiderando:\n\n1º—Que de conformidad con la Ley N° 59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944 y sus reformas, el Instituto Geográfico Nacional (IGN) es “la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación”; constituyéndose de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.\n\n2º—Que mediante Ley Nº 8905 Reforma del artículo 2 de la ley N° 5695, Creación del Registro Nacional, y sus reformas; y modificación de la Ley N° 59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas del 07 de diciembre del 2010, se estableció al IGN como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones.\n\n3º—Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre (ZMT), posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.\n\n4º—Que la información digital georreferenciada sobre delimitación de la zona pública de la ZMT con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre.\n\n5º—Que la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas; b) el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83 del 03 de marzo de 2007; c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio de 2011; d) Decreto Ejecutivo N° 36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto de 2011; e) Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica del 24 de enero de 2018; f) Decreto Ejecutivo N° 42760-MINAE Criterios técnicos para la ubicación, identificación, clasificación y delimitación de ecosistemas de humedal del 07 de marzo del 2022; y g) Directriz DIG-01-2025 Actualización de Información de la zona pública de la Zona Marítimo Terrestre con respecto al Sistema de Referencia Horizontal CR-SIRGAS para la época de medición 2014.59 del 28 de mayo de 2025.\n\n6º—Que de conformidad con el artículo 62 del Decreto Ejecutivo N° 7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas, se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N° 7841-P señala que “El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública.”\n\n7º—Que el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83 del 30 de marzo del 2007, el cual entre otros aspectos determina a la Red Geodésica Nacional de Referencia Horizontal CR05 y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en el artículo 11 que: “La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera…”; mientras que el artículo 7 indica que “Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado…”\n\n8º—Que el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio del 2011, establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\n9º—Que el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica del 24 de enero de 2018, declara en su artículo 1 que “El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON”; mientras que el artículo 2 establece que “El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense.”\n\nPor su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que “El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica “Universal Transversal de Mercator” (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado.”\n\n10.—Que por medio de la Directriz DIG-01-2025 Actualización de Información de la zona pública de la Zona Marítimo Terrestre con respecto al Sistema de Referencia Horizontal CR-SIRGAS para la época de medición 2014.59 del 28 de mayo del 2025, se procedió a actualizar la información de la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre, pasándola del sistema de referencia horizontal CR05 al sistema de referencia horizontal CR-SIRGAS para la época de medición 2014.59, proyección CRTM05, como mecanismo de delimitación de la Zona Marítimo Terrestre.\n\n11.—Que, en complemento, el artículo 11 del Capítulo I Disposiciones Generales de la Ley N° 6043 Ley sobre la Zona Marítimo Terrestre del 02 de marzo de 1977 y sus reformas, establece que la “Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional.”\n\n12.—Que el artículo 16 de la Ley N° 7575 Ley Forestal del 13 de febrero de 1996 y sus reformas, establece que el Ministerio del Ambiente y Energía (MINAE) delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.\n\n13.—Que el Decreto Ejecutivo N° 36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto de 2011, establece entre sus objetivos “Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).”\n\n14.—Que el Decreto Ejecutivo N° 36786-MINAET en el Punto III.-Competencias para la delimitación y certificación establece que “La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales. La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.\n\nLa ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar.”\n\n15.—Que el Decreto Ejecutivo N° 42760-MINAE Criterios técnicos para la ubicación, identificación, clasificación y delimitación de ecosistemas de humedal del 07 de marzo de 2022, en su artículo 14 establece que: “Consideraciones técnicas complementarias para manglares. El Área de Conservación respectiva, en conjunto con el Instituto Geográfico Nacional, deberá verificar en el campo la existencia de manglar y proceder a su delimitación, conforme a la competencia de cada institución según lo indique ordenamiento jurídico. Para la identificación de un manglar se tomará como parámetro la presencia de árboles de alguna de las especies indicadas en el Anexo I de este decreto; asimismo, se incluyen dentro de estos ecosistemas los esteros y canales existentes. El límite se establece hasta donde se extienda la vegetación asociada con este ecosistema, de conformidad con el Anexo II de este decreto. Además de lo anterior debe contemplarse lo indicado en el Anexo III de este decreto, denominado “Listado de flora por tipo de humedal de acuerdo con clasificación paisajística Humedales Esturianos y Bosques Inundados Salados (manglares)”.\n\nEl proceso de delimitación del manglar deberá necesariamente comprender las áreas que se hallen deterioradas o en proceso de recuperación. Además, en el ámbito de su competencia, el Área de Conservación respectiva, deberá ejecutar las medidas necesarias para fomentar dicha recuperación.\n\n16.—Que el IGN utilizó la metodología de Delimitación Digital Georreferenciada, para delimitar la zona pública de la ZMT correspondiente a un sector de manglar entre el Estero Alcornoque y el Estero Penca, distrito 04° Lepanto, cantón 01° Puntarenas, provincia 06° Puntarenas.\n\n17.—Que mediante oficio SINAC-ACT-DIR-054-2025 del 17 de enero del 2025, suscrito por el señor Ing. Nelson Marin Mora, Director de la Oficina Regional del Área de Conservación Tempisque (ACT), presenta el Informe técnico de levantamiento y delimitación ACT-OR-T-0053-2025 realizado por el señor Ing. Isaac Cisneros González, Topógrafo del Área de Conservación Tempisque (ACT) del 30 de enero de 2025, al cual se le otorga visto bueno.\n\n18.—Que la delimitación de la zona pública de la ZMT de manglar fue realizada por Área de Conservación Tempisque (ACT) conforme Informe técnico de levantamiento y delimitación ACT-ORT-0053-2025 realizado por el señor Ing. Isaac Cisneros González, Topógrafo del Área de Conservación Tempisque (ACT) del 30 de enero de 2025, con el apoyo técnico descrito en el informe ACT-OSRPL-040-2025 del 30 de enero de 2025, realizado por el señor Pedro Andrey Rojas Chaves, Jefe a.i Subregionales Paquera-Lepanto y Cóbano, del Área de Conservación Tempisque (ACT).\n\n19.—Que mediante oficio CARTA-SINAC-SE-DE-PNH -0009-2026 de fecha 26 de marzo del 2026, remitido por MSc. Rotney Piedra Chacón, Coordinador Programa Nacional de Humedales, del Sistema Nacional de Áreas de Conservación (SINAC), se indica que el Programa Nacional de Humedales procederá a coordinar para que se realicen los ajustes correspondientes al límite del manglar en el Registro Nacional de Humedales según la información del informe ACT-OR-T-0053-2025 realizado por el señor Ing. Isaac Cisneros González.\n\n20.—Que mediante oficio CARTA-SINAC-SE-DE-DT-DIRT-090-2026 de fecha 17 de junio 2026, remitido por el Lic. José María Arroyo Arguedas, del Departamento de Información y Regularización del Territorio, de la Secretaria Técnica del Sistema Nacional de Áreas de Conservación (SINAC), se señala que a la fecha el SINAC no cuenta con la capacidad operativa para efectuar directamente las actualizaciones de las capas geoespaciales publicadas en el Sistema Nacional de Información Territorial (SNIT). No obstante, se están realizando las coordinaciones institucionales necesarias y gestionando alternativas técnicas y administrativas que permitan retomar esta función y efectuar las actualizaciones correspondientes en el menor plazo posible.\n\n21.—Que mediante el oficio DIG-GDF-157-2026 de fecha 07 de julio de 2026, generado por el Subproceso Topografía del Departamento Geodesia y Geofísica del IGN se remitió, a la Dirección del IGN, el Informe de revisión técnica para la publicación de delimitación georreferenciada de la zona pública DIG-GDF-030-2026-PU-INF del 23 de junio del 2026, en relación con los trabajos realizados por el Área de Conservación Tempisque (ACT) y relativos a la delimitación de un sector de manglar entre el Estero Alcornoque y el Estero Penca, Lepanto, avalando técnicamente la delimitación realizada para su publicación.\n\n20.—Que el artículo 140 de la Ley N° 6227 Ley General de la Administración Pública del 02 de mayo de 1978 y sus reformas, señala que “el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte”, disposición que necesariamente debe relacionarse con el numeral 240 inciso 1) del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: “Se comunicarán por publicación los actos generales y por notificación, los concretos.”\n\nCOMUNICA:\n\n1º—Que el 14 de enero de 2026, funcionarios del Área de Conservación Tempisque, realizaron el trabajo de campo para la delimitación digital georreferenciada al sistema nacional de coordenadas de la zona pública de un sector de manglar entre el Estero Alcornoque y el Estero Penca, distrito 04° Lepanto, cantón 01° Puntarenas, provincia 06° Puntarenas\n\n2º—El IGN publica la delimitación digital georreferenciada de la zona pública de 46 puntos que describen un sector de manglar entre el Estero Alcornoque y el Estero Penca, distrito 04° Lepanto, cantón 01° Puntarenas, provincia 06° Puntarenas, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y a la metodología usada y validada por el Área de Conservación Tempisque (SINAC-ACT).\n\n3º—Que la zona pública delimitada corresponde a un sector de manglar entre el Estero Alcornoque y el Estero Penca, distrito 04° Lepanto, cantón 01° Puntarenas, provincia 06° Puntarenas de conformidad a los oficios DIG-GDF-157-2026 de fecha 07 de julio de 2026, generado por el Subproceso Topografía del Departamento Geodesia y Geofísica del Instituto Geográfico Nacional, SINAC-ACT-DIR-054-2025 del 17 de enero del 2025, ACT-OR-T-0053-2025 y ACT-OSRPL-040-2025, ambos de fecha 30 de enero de 2025, emitidos por el del Área de Conservación Tempisque y la Oficina Subregional Paquera - Lepanto del Área de Conservación Tempisque. Law Nº 6043, Law on the Maritime-Terrestrial Zone, of 2 March 1977, and its respective regulations; and Articles 2 and 3 of Law Nº 5695, Law Establishing the National Registry, dated 28 May 1975, as amended.\n\nConsidering:\n\n1º—That, pursuant to Law N° 59, Law Establishing and Organizing the National Geographic Institute, of 4 July 1944, as amended, the National Geographic Institute (IGN) is “the leading scientific and technical agency for national cartography, responsible for preparing the official basic map and the basic geographic description of the Republic of Costa Rica, as well as for studies, research, work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, or similar nature related to those works, in order to support planning processes”; thereby serving permanently, on behalf of the State, as the official authority on geodesy and the spatial representation of the geography of the Republic of Costa Rica, with its authority extending to activities of any kind originating from the work entrusted to it.\n\n2º—That Law Nº 8905, amending Article 2 of Law N° 5695, which established the National Registry, as amended, and amending Law N° 59, establishing and organizing the National Geographic Institute, of 4 July 1944, as amended, dated 7 December 2010, established the IGN as an agency of the National Registry, which shall enter into the contracts and agreements necessary for the exercise of its functions.\n\n3º—That georeferencing to the national coordinate system as a means of delineating the public zone of the Maritime-Terrestrial Zone (ZMT) makes it possible to delineate the public zone correctly for purposes of preparing regulatory plans, endorsing land-survey plans, granting concessions in the Restricted Zone, and other aspects of coastal territorial planning.\n\n4º—That the IGN’s georeferenced digital information on the delineation of the public zone of the ZMT is called the IGN’s Georeferenced Digital Geodatabase (GDG) for the Maritime-Terrestrial Zone.\n\n5º—That the IGN’s Georeferenced Digital Geodatabase (GDG) for the Maritime-Terrestrial Zone is technically based on the application of the regulations established by: a) Executive Decree N° 7841-P, Regulations to Law N° 6043 on the Maritime-Terrestrial Zone, of 16 December 1977, as amended; b) Executive Decree N° 33797-MJ-MOPT, declaring CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation and Reference Systems Service (IERS) for measurement epoch 2005.83, the official horizontal datum for Costa Rica, of 3 March 2007; c) Executive Decree N° 36642-MP-MOPT-MINAET, Regulations on Specifications for Delineating the Public Zone of the Maritime-Terrestrial Zone, of 28 June 2011; d) Executive Decree N° 36786-MINAET, Manual for Classifying Lands Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, of 12 August 2011; e) Executive Decree Nº 40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica, of 24 January 2018; f) Executive Decree N° 42760-MINAE, Technical Criteria for the Location, Identification, Classification, and Delineation of Wetland Ecosystems, of 7 March 2022; and g) Directive DIG-01-2025, Update of Information on the Public Zone of the Maritime-Terrestrial Zone with Respect to the CR-SIRGAS Horizontal Reference System for Measurement Epoch 2014.59, of 28 May 2025.\n\n6º—That, pursuant to Article 62 of Executive Decree N° 7841-P, Regulations to the Law on the Maritime-Terrestrial Zone, of 16 December 1977, as amended, the IGN’s authority to delineate the public zone of the Maritime-Terrestrial Zone and officially publish that delineation in the official gazette La Gaceta is recognized; Article 63 of Executive Decree N° 7841-P states that “The National Geographic Institute shall publish notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.”\n\n7º—That Executive Decree N° 33797-MJ-MOPT, declaring CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation and Reference Systems Service (IERS) for measurement epoch 2005.83, the official horizontal datum for Costa Rica, of 30 March 2007, among other matters designates the CR05 National Horizontal Reference Geodetic Network and its associated CRTM05 map projection as the official system to which the coordinates of all geodetic, cartographic, and cadastral work carried out in our country must be referenced. Specifically, Article 11 provides: “The CR05 National Horizontal Reference Geodetic Network and the CRTM05 map projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, to which all surveys and cartographic and geodetic activities carried out in the National Territory by any public agency, person, or domestic or foreign private entity must be referenced…”; Article 7, meanwhile, provides that “As cartographic data are produced using the new CRTM05 map projection system, the National Geographic Institute shall publish through appropriate means such information as has been made official…”\n\n8º—That Executive Decree N° 36642-MP-MOPT-MINAET, Regulations on Specifications for Delineating the Public Zone of the Maritime-Terrestrial Zone, of 28 June 2011, provides in Article 18 that, to delineate the public zone of the Maritime-Terrestrial Zone, the IGN may use either of two methods described in Articles 19 and 20: delineation of the public zone of the Maritime-Terrestrial Zone by placing boundary markers and/or by georeferenced digital delineation, in order to expedite delineations and provide greater technical certainty to interested parties.\n\n9º—That Executive Decree Nº 40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica, of 24 January 2018, declares in Article 1 that “The official horizontal geodetic reference system for Costa Rica, known as CR05 and realized through the National Geodetic Network, changes its acronym to CRSIRGAS as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08) for measurement epoch 2014.59. From then on, changes and updates shall be governed by the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS), known as SIRGAS-CON”; Article 2 provides that “The CRTM05 map projection system shall remain the official one for cartographic representation of the continental national territory, extended, for purposes of applying this map projection, to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, that baseline being defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea as the starting point for calculating the maximum breadth of all the Costa Rican State’s maritime areas under its jurisdiction.”\n\nArticle 12 of the cited decree further reinforces the application of the CRTM05 map projection as the official national coordinate system to which references must be made in the continental territory of our country, by providing that “The CRSIRGAS horizontal reference system and its associated CRTM05 map projection for the continental territory extended to the baseline of the territorial sea, and the ‘Universal Transverse Mercator’ (UTM) map projection, zones 16 and 17, for the maritime and insular areas under jurisdiction in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica. All surveys and cartographic and geodetic activities carried out in the national territory by any public agency, person, or domestic or foreign private entity undertaking or commissioning geodetic and cartographic work must be referenced to that system, thereby helping to avoid public expenditure and, in turn, obtaining reliable, consistent, and comparable geographic information of general utility that supports decision-making at the various levels of the State.”\n\n10.—That, by means of Directive DIG-01-2025, Update of Information on the Public Zone of the Maritime-Terrestrial Zone with Respect to the CR-SIRGAS Horizontal Reference System for Measurement Epoch 2014.59, of 28 May 2025, the IGN’s Georeferenced Digital Geodatabase (GDG) for the Maritime-Terrestrial Zone was updated by transferring it from the CR05 horizontal reference system to the CR-SIRGAS horizontal reference system for measurement epoch 2014.59, using the CRTM05 projection, as a means of delineating the Maritime-Terrestrial Zone.\n\n11.—That, in addition, Article 11 of Chapter I, General Provisions, of Law N° 6043, Law on the Maritime-Terrestrial Zone, of 2 March 1977, as amended, provides that the “public zone is also, regardless of its extent, the area occupied by all mangroves on the continental and insular coasts and estuaries of the national territory.”\n\n12.—That Article 16 of Law N° 7575, Ley Forestal, of 13 February 1996, as amended, provides that the Ministry of Environment and Energy (MINAE) shall mark on the ground the boundaries of the areas comprising the State’s Natural Heritage.\n\n13.—That Executive Decree N° 36786-MINAET, Manual for Classifying Lands Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, of 12 August 2011, states among its objectives: “To identify within the Maritime-Terrestrial Zone those lands classified as forests, lands suitable for forestry (Class VII and VIII soils), and wetlands (mangroves, estuaries, inlets, salt marshes, coastal lagoons, swamps, flooded forests, salt flats), so that they may be certified and incorporated as part of the State’s Natural Heritage (PNE).”\n\n14.—That Executive Decree N° 36786-MINAET, at Section III—Competencies for Delineation and Certification, provides that “Classification of land within the ZMT shall be the responsibility of the Conservation Areas (AC) of the National System of Conservation Areas (SINAC) and duly accredited private professionals affiliated with the respective professional associations, who shall classify forests, lands suitable for forestry (Class VII and VIII soils), (mangroves, estuaries, inlets, salt marshes, coastal lagoons, swamps, flooded forests, salt flats), and wetlands. The validity of classification documents issued by private professionals shall be subject to approval by the AC with territorial jurisdiction. The SINAC ACs with jurisdiction over the ZMT shall also be responsible for verification, oversight, demarcation, and certification of the lands comprising the State’s Natural Heritage and the protection zones.\n\nThe location and delineation of areas of the State’s Natural Heritage within the Maritime-Terrestrial Zone must be carried out as part of the process for approving the Coastal Regulatory Plan (PRC), defined by Ley 6043, because the Coastal Regulatory Plan is the territorial-planning instrument that defines and locates all zones available for concessions within the ZMT and classifies it at the cadastral-plan level. Therefore, the Coastal Regulatory Plan must clearly and expressly identify the PNE areas so they are not counted in the total area available for concessions.”\n\n15.—That Executive Decree N° 42760-MINAE, Technical Criteria for the Location, Identification, Classification, and Delineation of Wetland Ecosystems, of 7 March 2022, provides in Article 14: “Supplementary technical considerations for mangroves. The respective Conservation Area, together with the National Geographic Institute, shall verify in the field the presence of mangrove and proceed with its delineation, in accordance with each institution’s competence as provided by the legal system. The presence of trees belonging to any species listed in Annex I to this decree shall be used as a criterion for identifying a mangrove; existing estuaries and channels are also included in these ecosystems. The boundary shall extend to the limit of the vegetation associated with this ecosystem, in accordance with Annex II to this decree. In addition, the provisions of Annex III to this decree, entitled ‘List of Flora by Wetland Type According to Landscape Classification: Estuarine Wetlands and Saline Flooded Forests (Mangroves),’ must be taken into account.\n\nThe process of delineating mangroves must necessarily include areas that are degraded or undergoing recovery. In addition, within its area of competence, the respective Conservation Area shall implement the measures necessary to promote that recovery.”\n\n16º—That the IGN used the Georeferenced Digital Delineation method to delineate the public zone of the ZMT corresponding to a mangrove sector between Estero Alcornoque and Estero Penca, District 04° Lepanto, Canton 01° Puntarenas, Province 06° Puntarenas.\n\n17º—That, by means of official letter SINAC-ACT-DIR-054-2025 dated 17 January 2025, signed by Eng. Nelson Marin Mora, Director of the Regional Office of the Tempisque Conservation Area (ACT), the technical survey and delineation report ACT-OR-T-0053-2025, prepared by Eng. Isaac Cisneros González, Surveyor for the Tempisque Conservation Area (ACT), dated 30 January 2025, was submitted and approved.\n\n18º—That the public zone of the mangrove ZMT was delineated by the Tempisque Conservation Area (ACT) in accordance with technical survey and delineation report ACT-ORT-0053-2025, prepared by Eng. Isaac Cisneros González, Surveyor for the Tempisque Conservation Area (ACT), dated 30 January 2025, with the technical support described in report ACT-OSRPL-040-2025 dated 30 January 2025, prepared by Pedro Andrey Rojas Chaves, Acting Head of the Paquera-Lepanto and Cóbano Subregional Offices of the Tempisque Conservation Area (ACT).\n\n19º—That, by means of official letter CARTA-SINAC-SE-DE-PNH -0009-2026 dated 26 March 2026, sent by MSc. Rotney Piedra Chacón, Coordinator of the National Wetlands Program of the National System of Conservation Areas (SINAC), it was indicated that the National Wetlands Program would coordinate the corresponding adjustments to the mangrove boundary in the National Wetlands Registry based on the information in report ACT-OR-T-0053-2025 prepared by Eng. Isaac Cisneros González.\n\n20º—That, by means of official letter CARTA-SINAC-SE-DE-DT-DIRT-090-2026 dated 17 June 2026, sent by Lic. José María Arroyo Arguedas of the Department of Territorial Information and Regularization of the Technical Secretariat of the National System of Conservation Areas (SINAC), it was stated that, as of that date, SINAC lacked the operational capacity to directly update the geospatial layers published in the National Territorial Information System (SNIT). Nevertheless, the necessary institutional coordination and technical and administrative alternatives were being pursued to resume this function and make the corresponding updates as soon as possible.\n\n21.—That, by means of official letter DIG-GDF-157-2026 dated 7 July 2026, generated by the Topography Subprocess of the IGN Department of Geodesy and Geophysics, the technical review report for publication of the georeferenced delineation of the public zone, DIG-GDF-030-2026-PU-INF dated 23 June 2026, was sent to the IGN Directorate concerning the work carried out by the Tempisque Conservation Area (ACT) relating to delineation of a mangrove sector between Estero Alcornoque and Estero Penca, Lepanto, and technically endorsing the delineation for publication.\n\n20.—That Article 140 of Law N° 6227, Ley General de la Administración Pública, of 2 May 1978, as amended, provides that “an administrative act shall produce its effect after it has been communicated to the person concerned, except where it grants rights only, in which case it shall produce its effect from the time it is adopted.” This provision must necessarily be read together with paragraph 1 of Article 240 of the same statute, which defines the appropriate means of communicating acts of a general nature by providing that: “General acts shall be communicated by publication and specific acts by notification.”\n\nCOMMUNICATES:\n\n1º—That on 14 January 2026, officials of the Tempisque Conservation Area carried out fieldwork for the georeferenced digital delineation, using the national coordinate system, of the public zone of a mangrove sector between Estero Alcornoque and Estero Penca, District 04° Lepanto, Canton 01° Puntarenas, Province 06° Puntarenas.\n\n2º—The IGN publishes the georeferenced digital delineation of the public zone, consisting of 46 points that describe a mangrove sector between Estero Alcornoque and Estero Penca, District 04° Lepanto, Canton 01° Puntarenas, Province 06° Puntarenas, based on the Regulations on Specifications for Delineating the Public Zone of the Maritime-Terrestrial Zone and the method used and validated by the Tempisque Conservation Area (SINAC-ACT).\n\n3º—That the delineated public zone corresponds to a mangrove sector between Estero Alcornoque and Estero Penca, District 04° Lepanto, Canton 01° Puntarenas, Province 06° Puntarenas, in accordance with official letters DIG-GDF-157-2026 dated 7 July 2026, generated by the Topography Subprocess of the Department of Geodesy and Geophysics of the National Geographic Institute; SINAC-ACT-DIR-054-2025 dated 17 January 2025; ACT-OR-T-0053-2025 and ACT-OSRPL-040-2025, both dated 30 January 2025, issued by the Tempisque Conservation Area and the Paquera-Lepanto Subregional Office of the Tempisque Conservation Area; as well as official letter CARTA-SINAC-SE-DE-PNH-0009-2026 dated 26 March 2026, issued by the National Wetlands Program of the National System of Conservation Areas (SINAC), and official letter CARTA-SINAC-SE-DE-DT-DIRT-090-2026 dated 17 June 2026, sent by the Department of Territorial Information and Regularization of the Technical Secretariat of the National System of Conservation Areas (SINAC).\n\n4º—The public zone of the ZMT corresponding to a mangrove sector between Estero Alcornoque and Estero Penca, District 04° Lepanto, Canton 01° Puntarenas, Province 06° Puntarenas, whose coordinates in Costa Rica’s official CRTM05 map projection system and updated from the CR05 to the CR-SIRGAS horizontal reference system are as follows:\n\n5º—The sectors located in District 04° Lepanto, Canton 01° Puntarenas, Province 06° Puntarenas that, as of this date, have a delineation of the public zone of the ZMT by placement of boundary markers and the corresponding publication in the official gazette La Gaceta retain their official status.\n\n6º—The official technical data for the georeferenced digital delineation of the public zone of the Maritime-Terrestrial Zone corresponding to a mangrove sector between Estero Alcornoque and Estero Penca, District 04° Lepanto, Canton 01° Puntarenas, Province 06° Puntarenas, have been recorded in the National Geographic Institute’s (IGN) Georeferenced Digital Geodatabase (GDG) for the Maritime-Terrestrial Zone (ZMT), in a vector shape-format file, under the code: ZONA PUBLICA_ mojones.\n\n7º—Takes effect upon publication.\n\nIssued in Curridabat, San José, 7 July 2026.\n\nArticle 1 Record"
